(i) िम्मू-कश्मीर संघ राज्य क्षेत्र को लोक सभा में आिंरित की िान े िाली सीिों की कुल संख्या पाचं (5) होगी, जिसमें से िून्य (0) सीि अनुसूजचत िाजतयों के जलए आरजक्षत होगी और िून्य (0) सीि अनुसूजचत िनिाजतयों के जलए आरजक्षत होगी, और (ii) संघ राज्य-क्षेत्र की जिधान सभा को आिंरित की िाने िाली सीिों की कुल संख्या नब्बे (90) होगी, जिनमें से सात (7) सीिें अनुसूजचत िाजतयों के जलए और नौ (9) सीिें अनुसूजचत िनिाजतयों के जलए आरजक्षत होंगी; और 3062 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(iii)] यतः, पररसीमन अजधजनयम, 2002 की धारा 9 की उप-धारा (1) के साथ परठत धारा 5 की उप-धारा (1) और िम्मू-कश्मीर पुनगगठन अजधजनयम, 2019 के भाग-V के अनसु रण में, पररसीमन आयोग ने संघ राज्य-क्षेत्र के संसिीय और जिधानसभा जनिागचन क्षेत्रों के पररसीमन की कायगिाजहयों के जलए संघ राज्य-क्षेत्र के सह सिस्ट्यों को अपन े साथ संबद्ध दकया ह;ै और यतः, पररसीमन अजधजनयम, 2002 की धारा 9 की उप-धारा (2) और िम्म-ू कश्मीर पुनगगठन अजधजनयम, 2019 के भाग-V के अनुसरण म,ें पररसीमन आयोग ने 2011 की िनगणना म ें प्रकाजित संगत आकं डों के आधार पर सघं राज्य क्षेत्र में संसिीय और जिधानसभा क्षेत्रों के पररसीमन के जलए अपने प्रारूप प्रस्ट्तािों को भारत के रािपत्र और िम्मू-कश्मीर संघ राज्य-क्षेत्र के रािपत्र के असाधारण अंकों म ें 14 माच,ग 2022 को प्रकाजित दकया तादक पिू ोक्त प्रस्ट्तािों के संबंध में 21 माचग, 2022 तक आपजियां और सुझाि आमंजत्रत दकए िा सकें; और यतः, पररसीमन अजधजनयम, 2002 की धारा 9 की उप-धारा (2) और िम्म-ू कश्मीर पुनगगठन अजधजनयम, 2019 के भाग-V के अनुसरण म,ें आयोग के ऊपर उजल्लजखत आिेि सं. 1 और आयोग के ऊपर संिर्भगत प्रारूप प्रस्ट्ताि 14 माच,ग 2022 को स्ट्थानीय समाचार पत्रों में प्रकाजित दकए गए थ े और उन्ह ें रेजडयो एि ं िेलीजििन तथा िन संचार के अन्य साधनों के माध्यम स े आगे और प्रचाररत-प्रसाररत दकया गया था; और यतः, पररसीमन अजधजनयम, 2002 की धारा (9) की उक्त उप-धारा (2) और िम्म-ू कश्मीर पुनगगठन अजधजनयम, 2019 के भाग-V के अनुसरण म,ें आयोग न े 25 माच,ग 2022 को एक सािगिजनक सूचना भी िारी की जिसम ें सभी आपजियों और सुझािों पर जिचार करन े के जलए इसकी सािगिजनक बैठकों के स्ट्थानों और जतजथयों को जनर्िष्टग दकया गया था; और यतः, पररसीमन अजधजनयम, 2002 की धारा 9 की उक्त उप-धारा (2) और िम्म-ू कश्मीर पनु गगठन अजधजनयम, 2019 के भाग-V के अनुसरण में, आयोग ने 4 अप्रैल, 2022 को िम्मू में और 5 अप्रैल, 2022 को श्रीनगर में सािगिजनक बैठकों का आयोिन दकया और िनता के सिस्ट्यों को सुना और उन्ह ें आयोग को पहल े से भेिे गए जलजखत अभ्यािेिनों, यदि कोई हों, के अलािा मौजखक और जलजखत जनिेिन प्रस्ट्तुत करन ेका पूरा अिसर दिया; और यतः, आयोग न े संजिधान और उक्त अजधजनयमों के प्रासंजगक प्रािधानों के आलोक में अपने उक्त प्रस्ट्तािों के संबंध में पूिोक्त सािगिजनक बैठकों में की गई और/या इसके द्वारा अन्यथा प्राप्त सभी आपजियों और सुझािों पर जिचार दकया है; अब, इसजलए यथा संिोजधत पररसीमन अजधजनयम, 2002 की धारा 4 की उप-धारा (2) के साथ परठत धारा 9 की उप-धारा (2) के खंड (घ) और िम्म-ू कश्मीर पुनगगठन अजधजनयम, 2019 के भाग-V के अनुसरण म,ें पररसीमन आयोग एतद्द्वारा जनम्नानुसार जनधागररत करता ह:ै 1. नब्बे राज्य-क्षेत्रीय जिधान सभा जनिागचन क्षेत्र जिनमें संघ राज्य-क्षेत्र की जिधान सभा के जनिागचनों के प्रयोिनाथ ग िम्म-ू कश्मीर संघ राज्य-क्षेत्र को जिभाजित दकया िाएगा, और ऐसे प्रत्येक जनिागचन क्षेत्र का जिस्ट्तार ताजलका-क में ििाएग अनुसार होगा; [िैसा दक िम्मू-कश्मीर पुनगगठन अजधजनयम, 2019 (2019 का 34) की धारा 14(4) म ें पररकजल्पत ह,ै पररसीमन के प्रयोिनाथग 24 सीिों को नहीं जलया गया ह]ै। 2. िे राज्य-क्षेत्रीय संसिीय जनिागचन क्षेत्र जिनम ें लोकसभा के जनिागचनों के प्रयोिनाथग िम्मू-कश्मीर संघ राज्य-क्षेत्र को जिभाजित दकया िाएगा, और ऐसे प्रत्येक जनिागचन क्षेत्र का जिस्ट्तार ताजलका-ख में ििाएग अनुसार होगा; 3. िहां ताजलका-क अथिा ताजलका-ख म ें यथा-िर्िगत जनिागचन क्षेत्र के नाम कोष्ठकों और अक्षरों (अ.िा.) द्वारा सुजभन्न दकए गए ह,ैं िहां उस जनिागचन क्षेत्र म ेंिह सीि अनुसूजचत िाजतयों के जलए आरजक्षत ह।ै[भाग II—खण् ड 3(iii)] भारत का रािपत्र : असाधारण 3 4. िहां ताजलका-क अथिा ताजलका-ख में यथा-िर्िगत जनिागचन क्षेत्र के नाम कोष्ठकों और अक्षरों (अ.ि.िा.) द्वारा सुजभन्न दकए गए ह,ैं िहां उस जनिागचन क्षेत्र म ेंिह सीि अनुसूजचत िनिाजतयों के जलए आरजक्षत ह।ै ताजलका-क जिधानसभा जनिाचग न क्षत्रे और उनका प्रस्ट्ताजित जिस्ट्तार क्र. स.ं जिधान सभा जनिाचग न जिस्ट्तार क्षत्रे का नाम 1-जिलाः कुपिाडा 1 करनाह करनाह तहसील और करालपुरा तहसील (भाग) – गुंििोनरेिी, पंिगाम और िूलूरा पििार सर्कगल। 2 त्रेहगम त्रेहगम और केरन तहसील, करालपरु ा तहसील (भाग) – करालपुरा तहसील गुंििोनरेिी, पंिगाम और िूलूरा पििार सर्कगलों को छोडकर तथा कुपिाडा तहसील (भाग) - ORDER NO. 2 WHEREAS, in pursuance of Sections 8 and 4 of the Delimitation Act, 2002 (33 of 2002), as amended by the Delimitation (Amentment) Act, 2003(3 of 2004), and Part – V of the Jammu & Kashmir Reorganisation Act, 2019, the Delimitation Commision has, by its Order No.1 dated 14th March, 2022 published in the extraordinary issue of the Gazette of India and the Union Territory of Jammu & Kashmir Gazette on 14th March, 2022, determined – (i) the total number of seats in the House of the People to be allocated to the Union Territory of Jammu & Kashmir as five (5) of which Zero(0) seat shall be reserved for Scheduled Castes and Zero(0) seat shall be reserved for the Scheduled Tribes, and (ii) the total number of seats to be assigned to the Legislative Assembly of the Union Territory as Ninty (90) of which, Seven (7) seats shall be reserved for the Scheduled Castes and Nine (9) seats for the Scheduled Tribes; and WHEREAS, in pursuance of sub-section (1) of Section 5, read with sub Section (1) of Section 9 of the Delimitation Act, 2002 and Part-V of the Jammu & Kashmir Reorganisation Act, 2019, the Delimitation Commission associated with itself the Associate Members from the Union Territory with the proceedings for the delimitation of Parliamentary and Assembly Constituencies in the Union Territory; and WHEREAS, in pursuance of sub-section (2) of Section 9 of the Delimitation Act, 2002 and Part –V of the Jammu & Kashmir Reorganisation Act, 2019, the Delimitation Commission published its draft proposals, for the delimitation of Parliamentary and Assembly Constituencies in the Union Territory on the basis of the relevant published figures of 2011 Census, in the extraordinary issue of the Gazette of India and in the Jammu & Kashmir Union Territory Gazette on 14th March, 2022, inviting objections and suggestions in relation to the aforesaid proposals by 21st March, 2022; and WHEREAS, in pursuance of the said sub-section (2) of Section 9 of the Delimitation Act, 2002 and Part -V the Jammu & Kashmir Reorganisation Act, 2019, the Commission’s Order No. 1 mentioned above and the above referred draft proposals of the Commission was published in the local newspapers on 14th March, 2022 and given further publicity through radio and television and other media of mass communication; and WHEREAS, in pursuance of the said sub-section (2) of Section (9) of the Delimitation Act, 2002 and Part – V of the Jammu & Kashmir Reorganisation Act, 2019, the Commission also issued a public notice on 25th March, 2022 specifying the places and dates of its public sittings to consider all objections and suggestions; and WHEREAS, in pursuance of the said sub-section (2) of Section 9 of the Delimitation Act, 2002 and Part – V of the Jammu & Kashmir Reorganisation Act, 2019, the Commission held public sittings on 4th April, 2022 at Jammu and on 5th April, 2022 at Srinagar and heard the members of the public and afforded them full opportunity of making oral and written submissions, in addition to the written representations already sent, if any, to the Commission; and10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(iii)] WHEREAS, the Commission has considered all objections and suggestions made at the aforesaid public sittings and/or received by it otherwise, in relation to its said proposals, in the light of the relevant provisions of the Constitution and the said Acts; NOW THEREFORE, in pursuance of clause (d) of Sub-Section (2) of Section 9 read with Sub-Section (2) of Section 4 of the Delimitation Act, 2002, as amended and Part – V of the Jammu & Kashmir Reorganisation Act, 2019, the Delimitation Commission hereby determines as follows: 1. Ninety territorial Assembly Constituencies into which the Union Territory of Jammu & Kashmir shall be divided for the purpose of elections to the Legislative Assembly of the Union Territory and the extent of each such Constituency shall be as shown in Table-A [As envisaged in Section 14(4) of The Jammu and Kashmir Reorganisation Act, 2019 (34 of 2019), 24 seats have not been taken up for the purpose of delimitation]. 2. The territorial Parliamentary Constituencies into which the Union Territory of Jammu & Kashmir shall be divided for the purpose of elections to the House of the People and the extent of each such Constituency shall be as shown in Table-B. 3. Where the name of a Constituency as shown in Table-A or Table-B is distinguished by the brackets and letters “(SC)” the seat in that Constituency is reserved for the Scheduled Castes. 4.
