रखरखाव उपभोगी संस्ट्था द्वारा दकया जायेगाA इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाद उपभोगी संस्ट्था द्वारा जनगरानी की
जाएगी A
3. 674 वृक्षो को काटे/ प्रत्यारोपण दकए जाने के बदले मे 1:10 के अनुपात मे स्ट्वदेिी प्रजाजतयों के 6-8 फीट की ऊाँचाई वाले 6740
पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया जाएगा । वृक्षारोपण की अनुमजत के जारी िोने के तीन मिीने के अंदर
जनधााररत की गई भूजम पर अजतररक्त उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया जाएगा
और उसका रखरखाव उपभोगी संस्ट्था द्वारा अपने स्ट्वयं की लागत पर दकया जाएगा ।
4. यदद उपभोगी संस्ट्था सफलतापूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि।ै उपभोगी संस्ट्था द्वारा अजतररक्त साइट सुधार खचों
को जमा दकया जाएगा जो दक वृक्ष अजधकारी ¼दजक्षण½ द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुक्त बनाने के जलए आवश्यक
िो सकती ि ै ।
5. जो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना
निीं दकया जाएगा।
6. उपभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को ददल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में वृक्ष
अजधकारी ¼दजक्षण½ को प्रस्ट्तुत दकया जाएगा ।
7. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यजीव जवभाग राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार को जनधााररत करेंगी
और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अंत में प्रस्ट्तुत की जाएगी ।
8. उपभोगी संस्ट्था द्वारा वृक्षो को काटने/ प्रत्यारोपण का काया िुरू करने से पूवा साइट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत
योजना प्रस्ट्तुत दकया जाएगा ।
9. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृदा नमी संरक्षण काया की गजतजवजधयों को दकया जाएगा ।
10. अनुमजत जारी िोन ेके तुरंत बाद वृक्षो का प्रत्यारोपण उपभोगी संस्ट्था द्वारा िुरू दकया जाएगा और इसे तीन मिीने के अंतराल में पूण ा
दकया जाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोने का बाद एक सम्पूणा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की जायेगी । प्रत्यारोपण
स्ट्थल मे प्रत्यारोजपत वृक्षो की दरू ी 4 मीटर (लबद ुसे लबद)ु से कम निीं िोनी चाजिए ।
11. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया जाएगा ।
12. 534 वृक्षो को प्रत्यारोपण/ काटन/े छंटाई/ िडे बैककग के जलए अनुमजत उनके स्ट्वयं के जोजखम पर और दकसी भी अन्य व्यजक्त के दावे के
पक्षपात के जबना, जो वृक्षो और भूजम पर सिी िो सकती िै, दी जा रिी ि ै।
13. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक वृक्षो की कटाई/ प्रत्यारोपण स े पूवा कोई लंजबत मुकदमेबाजी या स्ट्थगन
आदिे दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो ।
14. उपभोगी संस्ट्था द्वारा वृक्षो को कटाई/ प्रत्यारोपण का काया सभी वैधाजनक मंजूररयों को लेने के बाद िी िुरू दकया जाएगा ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3
15. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक इस प्रस्ट्ताव की योजना को पररवर्थतत निीं दकया जाएगा ।
16. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की
जाएगी ।
17. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए जाने के उपरान्त प्राप्त लकजड़यों की नीलामी की जाएगी और उससे प्राप्त धनराजि को सरकार के
खाते मे राजस्ट्व के रूप में जमा की जाएगीA
18. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds उपरान्त izkIr लकजड़यों को मुफ्त में जनकटतम lkoZtfud 'konkgksa es a
iz;ksx gsr q सौपी जाएगी और इसकी सूचना वृक्ष अजधकारी (दजक्षण) को भी दी जाएगी ।
19. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए जाने के स्ट्थल से लकजड़यों को ys tku s l s iwo Z o`{k vf/kdkjh ¼दजक्षण½ l s <yq kbZ vuqefr izkIr

20. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैदा िोने वाली वन उपज को सावाजजनक श्मिान मे 90 ददनों के अंदर
पूरा दकया जाएगा ।
21. उपभोगी संस्ट्था द्वारा 585 वृक्षो को काटने से पूवा प्रत्यारोपण दकया जाएगा । 585 वृक्षो की अनुमजत 89 वृक्षो के सफल प्रत्यारोपण और
mi&ou laj{kd (दजक्षण) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाद दी जायेगी ।
22. भूजम स्ट्वाजमत्व एजेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो ।
23. उपभोगी संस्ट्था द्वारा 674 वृक्षो के अलावा दकसी भी वृक्ष की कटाई / प्रत्यारोपण एक अपराध िोगा ।
24. यदद दकसी वृक्ष में पजक्षयों का घोंसला पाया जाता ि ैतो उस वृक्ष को घोंसला स्ट्थानांतररत करने के पिात िी काटा जाएगा ।
25. उपभोगी संस्ट्था के द्वारा पयाावरण मंजूरी में उजल्लजखत सभी ितों का पालन दकया जायेगा ।
यि माननीय पयाावरण एवं वन मंत्री राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार के पूवा अनुमोदन से जारी दकया जाता ि ै ।

Delhi, the 11th November, 2021
F. No. R.1563/TO(S)/TC-Felling/2021-22/ 6919-27.—In exercise of the powers conferred by section
29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital
Territory of Delhi, hereby, in public interest exempts an area of 20 ha. approx. as detailed below for Development
of Economic Corridors, Inter Corridors and Feeder Routes to improve the efficiency of freight movement in India
under Bharatmala Pariyojna (Lot-4/ Package-I) NH-148 NA, New Delhi from the provision of sub-section (3) of
section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. National Highway Authority of India (NHAI), herein referred to as User Agency, shall make an advance deposit
of an amount of Rs. 3,84,18,000 /- (Rs. Three Crore Eighty Four Lakh Eighteen Thousand Only) towards security
deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,4 DELHI GAZETTE : EXTRAORDINARY PART IV]

(b) Transplantation of 89 no. of trees which are standing on site shall be done by User Agency at Eco-Park,
NTPC Land Badarpur, New Delhi with their own funds.
2. 100% Compensatory Plantation of 6740 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.
Photographic/ videographic evidence in due course shall be submitted to Tree Officer concerned.
3. 6740 Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10
on non-forest land in lieu of transplantation of 89 no. of trees and felling of 585 nos. of trees. The plantation
shall be done by following site specific plantation techniques with additional measures on identified land
within three months of issue of tree removal permission and maintenance shall be carried out there after by
User Agency with their own funds.
4. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit
extra site improvement expenses which may be required to make the site suitable for plantation as calculated
by Tree Officer concerned (as deposits).
5. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
6. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section 12 of
Delhi Preservation of Trees Act, 1994 before initiating felling/ transplantation.
7. User Agency shall maintain plantation journal as prescribed by Department of Forests and Wildlife, Govt. of
NCT of Delhi and submit a copy of same at end of each financial year.
8. User Agency shall submit a detailed plan for site preparation and plantation before initiating felling/
transplantation
9. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation / transplantation site.
10. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than three months, after which a completion report has to be submitted to the concerned Tree Officer.
The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation
site.
11. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
12. Permission for transplantation/ felling of 674 nos. of tress is being granted at their own risk and without
prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
13. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling/ transplantation of trees.
14. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
15. The User Agency shall ensure that the plan of this proposal shall not be changed.[PART IV DELHI GAZETTE : EXTRAORDINARY 5
16. The progress report of transplantation shall be submitted through inspection officer concerned along with
complete details of trees.
17. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to
the Government account by the User Agency.
18. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (South) by User Agency.
19. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the DCF (South) by User Agency.
20. Felling/ transplantation of trees and transportation of forest produce arising threfrom to the public
crematorium shall be completed within 90 days.
21. The transplantation shall be carried out prior to felling of 585 nos. of trees permitted herein. The 585 trees
shall be removed/ felled after successful transplantation of 89 trees and submission of compliance certificate
to DCF (South).
22. Land Owning agency shall ensue that there is no encroachment in area proposed for compensatory
plantation.
23. Felling/ Transplantation of any tree apart from 674 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act, 1994.
24. If any tree is found to have nest of birds it should not be felled/ transplant till the same is abandoned by the
birds.
25. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any
obtained, shall be followed scrupulously.
