हजियारों, िाहनों, रक्षा उपस्ट्करों और गैर-रक्षा उपस्ट्करों के उत्पादन की गजतजिजधयों को (िो पहले रक्षा उत्पादन जिभाग, रक्षा
मंत्रालय के अधीन आयुध जनमायणी बोडय (“ओएफबी”) की 41 इकाईयों द्वारा दकया िाता िा) अनुबंध ‘क’में जनधायररत संरिना के अनुसार
1 अक्टूबर, 2021 (जनयत तारीख)से नए डीपीएसयू को हस्ट्तांतररतकर ददया गया ह।ै इसके अजतररक्त,ओएफबी की जिजन्हतगैर-उत्पादन
इकाइयों के प्रबंधन, जनयंत्रण, संिालन और रखरखाि तिा ओएफबीकी 16 उत्पादन इकाइयों की जिजन्हत अजतररक्त भूजम को अनुबंध
‘ख’ में दकए गए जनधायरण के अनुसार 01 अक्टूबर, 2021 से रक्षा उत्पादन जिभाग के अधीन गरित आयुध जनदिे ालय (समन्िय एि ं
सेिाएं) ("जनदिे ालय")को हस्ट्तांतररत कर ददया गया है।
2. जनयत तारीख को और उसके बाद से, ओएफबी, जिसकी स्ट्िापना रक्षा मंत्रालय के ददनांक 09.01.1979 केपत्रांक 1(82)/78/रक्षा
(जनमाणय ी.I) के तहत की गई है, का एक जनकाय के रूप में अजस्ट्तत्ि समाप्त हो िाएगा।
3. अनुबंध ‘क’और ‘ख’म ें जनधायररत सरं िना के अनुसार ओएफबी की सभी पररसंपजियााँ और दये ताएाँ नए डीपीएसयू और जनदिे ालय
को हस्ट्तांतररतकर दी गई ह ैं।

4. संयंत्र और मिीनरी, कच्चे माल, भूजम और भिन की खरीद, प्रौद्योजगकी का स्ट्िानान्तरण और सेिाओं की आपूर्तय या कोई अन्य
व्यिस्ट्िा की आपूर्तय के संबंध में जिजभन्न आपूर्तयकतायओं, िेकेदारों, जिक्रेताओं, कंपजनयों, संगिनों और व्यजक्तयो के साि ओएफबी या
इसके दकसी भी उत्पादन और गैर-उत्पादन इकाईयों द्वारा दकए गए सभी मौिूदा अनुबंधो,समझौत,ेजिलेख,खरीद आदिे और समझौता
ज्ञापन, व्यापार के स्ट्िानान्तरण की तारीख को िारी रखने और/या नए डीपीएसयू और जनदिे ालय के संिालन के जलए
आियक(अनुबंध‘क’ और ‘ख’ में जनधायररत संरिना के अनुसार) और डीपीएसयू और जनदिे ालय द्वारा प्रदान की िाने िाली सभी प्रकार
की सेिाओं के अजभदाताओं के साि नई डीपीएसयू और जनदिे ालय (अनुबंध क और ख में जनधायररत संरिना के अनुसार) को भी
जनधायररत तारीख से हस्ट्तांतररत कर ददया िाएगा।
5. नए डीपीएसयू और जनदिे ालय इन अनुबंधों, समझौतों, जिलेखों, खरीद आदिे ों और समझौता ज्ञापनो का उजित कायय-जनष्पादन
का सम्मान करने के जलए पूरी तरह जिम्मेदार होंगे और जििादों के मामले में अनुबंधों, समझौतों, जिलेखों, खरीद आदिे ों और समझौता
ज्ञापनों के तहत उिराजधकारी/समनुदजे िती के रुप में मुकदमा िलाने और िलने के जलए और दकसी भी िूक, दरे ी, गैर-काययजनष्पादन के
जलए उिरदायी होगें।
6. जनयत तारीख स,े दकसी भी पत्रािार, जबल, नोरटस और ओएफबी के अन्य दस्ट्तािेिों के संदभय जनयत तारीख से पहले िारी दकये
गए हों, िहााँ कभी भी संदभय इसकी अनुमजत और इिाित दते ा ह,ै को अनुबंध क और ख में जनधायररत संरिना के अनुसार नय े
डीपीएसयू और जनदिे ालय के संदभय के रुप में पढा िाएगा।
7. जनयत तारीख स,े नये डीपीएसयू और जनदिे ालय द्वारा िारी दकये गये दकसी भी जबल, नोरटस या अन्य दस्ट्तािेि, जिसम ें
ओएफबी का कोई संदभय हो,िहााँ कभी भी संदभय इसकी अनुमजत और इिाित दते ा है, को अनुबंध क और ख में जनधायररत संरिना के
अनुसार नये डीपीएसयू और जनदिे ालय के रुप में पढा िाएगा।
8. जनयत तारीख स,ेसभी िेक, ड्राफ्ट या अन्य जिलेख जिसके तहत ओएफबी को दये राजि के संबंध में भारत सरकार के पक्ष में
भुगतान दकया िाना ह,ै िहााँ कभी भी संदभय इसकी अनुमजत और इिाित दते ा ह,ै को अनुबंध क और ख में जनधायररत संरिना के
अनुसार नये डीपीएसयू और जनदिे ालय के पक्ष में िारी दकए िाएं।

RESOLUTION
New Delhi, the 1st October, 2021
No.7(E)– By virtue of the Memorandum of Understanding dated 29th September, 2021 entered into between
the President of India (acting through Shri Puneet Agarwal, Joint Secretary to Government of India, Department of
Defence Production (DDP), Ministry of Defence) and Munitions India Limited, Armoured Vehicles Nigam Limited,
Advanced Weapons and Equipment India Limited, Troop Comforts Limited, Yantra India Limited, India Optel
Limited and Gliders India Limited (the seven companies collectively referred to as “New DPSUs”), the activities in
the production of arms, ammunitions, weapons, vehicles, defence equipment and non-defence equipment (which were
earlier undertaken by the 41 units of Ordnance Factory Board (“OFB”) under Department of Defence Production,
Ministry of Defence) have been transferred to the New DPSUs with effect from 1st October, 2021 (“Appointed
Date”), as per the structure set out in Annexure A. Further, the management, control, operations and maintenance of
certain identified non-production units of OFB and identified surplus land at 16 production units of OFB have been
transferred to the Directorate of Ordnance (Coordination & Services) (“Directorate”) under the DDP with effect from
1st October, 2021, as set out in Annexure B.
2. On and with effect from the Appointed Date, OFB, which has been set up vide Ministry of Defence letter no.
1(82)/78/D(Fy.I) dated 09.01.1979, shall cease to exist as a body.
3. All the assets and liabilities of OFB stand transferred to the New DPSUs and the Directorate, as per the structure
set out in Annexures A and B.
4. All the existing contracts, agreements, deeds, purchase orders and Memorandum of Understandings entered into
by OFB or any of its production and non-production units with various suppliers, contractors, vendors, companies,
Organisations and individuals in respect of supply of plant and machinery, raw materials, purchase of land and
building, Transfer of Technology and supply of services or any other arrangement, subsisting on the date of transfer of
business and/or required for operations of the New DPSUs and Directorate (as per the structure set out in Annexures
A and B) and with subscribers of all types of services to be provided by the New DPSUs and Directorate, will also
stand transferred to the New DPSUs and the Directorate (as per the structure set out in Annexures A and B) with
effect from the Appointed Date.
5. The New DPSUs and the Directorate will be solely responsible for honouring these contracts, agreements, deeds,
purchase orders and Memorandum of Understandings for their due performance and in case of disputes to sue and be
sued as the successor/assignee under the contracts, agreements, deeds, purchase orders and Memorandum of
Understandings and shall be liable for any defaults, delays, or non-performance.
6. With effect from the Appointed Date, any reference, in any correspondence, bills, notices, and other documents
to the OFB, having been issued prior to the Appointed Date shall, wherever the context so permits and allows, be read
as reference to the New DPSUs and the Directorate, as per the structure set out in Annexures A and B.
7. With effect from the Appointed Date, in any bill, notice, or other document issued by the New DPSUs and the
Directorate, bearing any reference to the OFB, shall, wherever the context so permits and allows, be read as reference

8. With effect from the Appointed Date, all cheques, drafts or other instruments under which payment is to be made
in favour of the Government of India in respect of monies owed to the OFB, wherever the context so permits and
allows, be drawn in favour of the New DPSUs and the Directorate, as per the structure set out in Annexures A and B.
