(ई) ''िुमागना'' स ेआिय अजधजनयम की धारा 436 म ें जवजहत िमु ागने स े होगा; (2) इन जनयमों म ें जिन िब् िों और अजभव् यजियों का प्रयोग दकया गया ह ै और इनकी पररभार्ा नहीं िी गई ह ै ककंत ु इनकी पररभार्ा अजधजनयम म ें िी गई ह ैतो अजधजनयम म ें इन्‍द ह ेंदिया गया अथग ही इनका अथ ग होगा। 3. अपील की सीमावजध—अजधजनयम की धारा 436 की उप-धारा (3) के अंतगगत प्रधान अजधकारी के आिेि द्वारा िो भी व् यजि व् यजथत होगा वह उस आिेि की प्राजि की तारीख स े तीस दिनों की अवजध के भीतर अपीलीय प्राजधकारी के समि अपनी अपील प्रस्ट्त ुत कर सकता ह:ै बिते अपीलकता ग अपीलीय प्राजधकारी को संतुष्ि कर ि े दक उसके पास समय रहत े अपील प्रस्ट्त ुत न कर पान े का पयागप् त कारण था तो पूवोक्त अवजध की समाजि के बाि भी अपीलीय प्राजधकारी दकसी अपील को स्ट् वीकार कर सकता ह:ै बिते इसके अलावा ऐसे आििे की प्राजि की तारीख स े एक सौ अस्ट् सी दिन की अवजध के उपरांत कोई अपील नहीं स्ट् वीकारी िा सकती। 4. अपील का फॉम ग और इसम ें जनजहत सामग्री—अजधजनयम की धारा 436 की उप-धारा (3) के अतं गतग , फॉम ग म ें जवजनर्िगष् ि तरीके स े जहन्‍दि ी या अग्रं ेिी म ेंअपीलीय प्राजधकारी को आवेिन दकया िाएगा। (2) उप-जनयम (1) म ेंदकए गए आवेिन के साथ उस आिेि की प्रजत सलं ग् न की िाएगी जिसके जवरुद्ध अपील की गई ह।ै (3) हर अपीलकता ग यह सुजनजश्चत करेगा दक उप-जनयम (1) म ें दकए गए आवेिन म ें जनम्न जलजखत जववरण पूरी तरह स े दिए गए हों, य ेह:ैं- (ए) आवेिन म ेंसमस्ट्त महत् वपूणग कथन, तकग और वे आधार जनजहत होंगे जिन पर अपीलकता गको जवश् वास ह;ै (बी) अपील म ेंअनािरपूण ग या अनुजचत भार्ा का प्रयोग नहीं होगा; (सी) अपील म ें वे आधार स्ट् पष्ि रूप स े जलखे िाएगं े जिनके आधार पर इस े दकया गया ह,ै इसम ें तथ्य या जवजधक या प्रिासजनक प्रदियाओं की समस्ट्त त्रुरियों, िुमानग े की समानुपाजतकता, कोई नई स्ट् वीकाय ग िानकारी,बिली हुई पररजस्ट्थजतयां, जहत का िकराव या संवैधाजनक अजधकार का उल्ल ंघन हुआ हो तो उसे िाजमल दकया िाएगा। (डी) आवेिन म ें जवजिष्ि प्राथगनाए ं यानी प्रेयर जनजहत होंगी; (ई) आवेिन अपने आप म ेंपरू ा हो। 5. अपील पर जवचार दकया िाना—जनयम 4 के उप-जनयम (1) के अंतगगत यदि कोई आवेिन दकया िाता ह ै तो, अपीलीय प्राजधकारी जनम्न जलजखत मामलों पर जवचार करेगा, यह ह:ैं- (ए) क्य ा इन जनयमों में िो प्रदिया िी गई ह,ैउसका अनपु ालन दकया गया ह ै और, यदि नहीं, तो इस अनुपालन न दकए िान े के पररणामस्ट् वरूप अजधजनयम या इन जनयमों या भारत के संजवधान के दकसी प्रावधान का उल्ल ंघन हुआ ह ैया न्‍द याय नहीं जमल पाया ह;ै (बी) क्य ा अजधजनयम की धारा 436 की उप-धारा (3) के अंतगगत प्रधान अजधकारी के आिेि म ें लगाया गया िुमागना समानुपाजतक ह ैया नहीं; (सी) क्य ा ऐस े आिेिों को पाररत दकए िाते समय उजचत और न्‍द यायपणू ग रीजत स े मामल े की सभी पररजस्ट्थजतयों पर जवचार दकया गया ह।ै (डी) क्य ा अपील जनयम 4 के उप-जनयम 3 की मि (सी) के अनसु रण म ेंिायर की गई ह।ै (ई) अपील का जनपिान इस उप-जनयम के अनुसरण म ेंहोगा[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (2) जनयम 4 के उप-जनयम (1) के अंतगगत दकए गए दकसी भी आवेिन का जनपिान अपीलकताग को सुने िाने का उजचत अवसर दिए जबना नहीं दकया िाएगा। (3) अपीलीय प्राजधकारी प्राकृजतक न्‍द याय के जसद्धांतों और इस अजधजनयम या इसके अंतगगत बने अन्‍द य दकन्‍द हीं जनयमों के अन्‍द य प्रावधानों स े मागिग िगन प्राप् त करेंग,े उन्‍द ह ें यह िजि होगी दक व े इस जनयम के अतं गतग की गई दकसी अपील पर जवचार करने के प्रयोिन स े इससे संबंजधत कायगव्य ापार को करने के जलए स्ट्थ ानों सजहत, अपनी स्ट् वय ं की प्रदिया जवजनयजमत कर सकें। (4) जनयम 4 के उप-जनयम (1) के अंतगगत दकए गए आवेिन का जनपिान यथािीघ्र दकया िाएगा और ऐस े आवेिन का जनपिान करन े म ेंइस आवेिन को दकए िाने की तारीख से छह मास स े अजधक का समय नहीं लगाया िाएगा। 6. अपीलीय प्राजधकारी की िजिया—ं इस जनयम के अतं गतग प्रित् त िजियों का प्रयोग करत े हुए दकसी समय जविेर् हते ु प्रवृत् त दकसी अन्‍द य जवजध म ें जनजहत दकसी भी बात के रहते हुए, अपीलीय प्राजधकारी,जनयम 4 के उप-जनयम (1) के अंतगगत दिए गए दकसी आवेिन का जनणगय करत े समय, उसके पास वही िजिया ं होंगी िो दक कोड ऑफ जसजवल प्रोसीिर, 1908 (1908 का 5) के अंतगगत जसजवल कोिग के पास होती ह,ैं य ेजनम्न जलजखत मामलों के संबंध म ें ह,ैं िो ह:ैं- (ए) उस िगह और उस समय पर अपीलीय प्राजधकारी द्वारा यथा जवजनर्िगष् ि रूप स े पुस्ट्त कों या दकन्‍द हीं प्रलेखों को खोिा और प्रस्ट् ततु दकया िाए और िपथ दिलवाकर इनकी परीिा की िाए; (बी) दकसी व् यजि की दकन्‍द हीं पस्ट्ु तकों, रजिस्ट् िरों और अन्‍द य प्रलखे ों का जनरीिण; (सी) गवाहों या प्रलेखों की परीिा हते ु कमीिन िारी करना; (डी) भारतीय साक्ष्य अजधजनयम, 1872 (1872 का 1) की धारा 123 और 124 के प्रावधानों के अधीन, दकसी कायागलय स े कोई सावगिजनक अजभलेख, या प्रलेख या ऐस े अजभलेख या प्रलेख की प्रजत की मांग करना और ऐेस े प्रलेखों को प्रस्ट् तुत करना; (ई) िपथपत्र पर साक्ष्य प्राप् त करना; (एफ) चूक के कारण दकसी आविे न को एकतरफा जडसजमस या जडसाइड करना; (िी) चूक के कारण दकसी आवेिन को एकतरफा जडसजमस दकए िाने या पाररत दकए गए दकसी आिेि को रद्द करना; (एच) अंतररम राहत संस्ट् वीकृत करना; (आई) इसके जनणगय की समीिा करना; और (ि)े अपीलीय प्राजधकारी को िो उजचत लग े वह कोई अन्‍द य मामला। (2) अपीलीय प्राजधकारी के समि हर कायगवाही को भारतीय िडं संजहता (1860 का 45) की धारा 193 और 228 के अथ ग के भीतर और धारा 196 के प्रयोिनों हते ु न्‍द याजयक कायगवाही समझा िाएगा, और अपीलीय प्राजधकारी को कोड ऑफ दिजमनल प्रोसीिर, 1973 (1974 का 2) की धारा 195 और अध् याय XXVI के प्रयोिनों हते ु जसजवल कोिग समझा िाएगा। 7. अपीलीय प्राजधकारी द्वारा पाररत आिेि - जनयम 4 के अधीन, अपीलीय प्राजधकारी - (ए) अजधजनयम की धारा 436 की उप-धारा(3) के अंतगगत जिस आिेि के जवरुद्ध अपील की गई ह ै उसकी पुजि करना या उस े आिोजधत करना या रद्द करना या उसे उलि िेना; (बी) आििे द्वारा लगाए गए िुमागने की पुजि करना या इस े कम करना या इस े बढा िेना या इस े रद्द करना या िहा ं िुमागना न लगाया गया हो वहा ंिुमागना लगा िेना: बिते दकसी आििे म ें िुमागने को इतना बढाकर नहीं लगाया िाएगा िो दक धारा 436 की उप-धारा (2) म ें जवजहत िुमागने की धनराजि स े अजधक हो:4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] बिते यह और दक दकसी आिेि म ें िुमागन े को बढाकर तब तक न लगाया िाए िब तक दक अपीलकता ग को इस बढ े हुए िुमागने के जवरुद्ध अभ् यावेिन करने का उजचत अवसर न दिया गया हो और इस े बढाए िाने के कारण जलजखत रूप म ें दिए िाए;ं (सी) दकन्‍द हीं प्रिासजनक या कानूनी प्रदियाओं के िरुु पयोग को रोकने की िजृ ि स े हर सारहीन अपील पर िुमागना लगान े के आिेि पाररत करना: बिते लगाया गया कोई िुमागना िमु ागने की उस अजधकतम धनराजि स े अजधक न हो िो दक धारा 436 की उप- धारा (2) म ेंजवजहत हो; Objections or suggestions, if any, may be addressed to the Additional Secretary (Ports, Shipping & Waterways), Ministry of Ports, Shipping & Waterways, Government of India, Transport Bhavan, 1, Parliament Street, New Delhi–110 001; The objection or suggestion which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period shall be taken into consideration by the Central Government.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. Short title and commencement. - (1) These rules may be called the Merchant Shipping (Form and Manner of Appeal) Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions. — (1) In these rules, unless the context otherwise requires, — (a) "Act" means the Merchant Shipping Act, 1958 (44 of 1958); (b) “appellant” means whoever prefers an appeal under sub-section (3) of Section 436 of the Act; (c) “Appellate Authority” means the Director-General of Shipping appointed under section 7 of the Act; (d) “form” means the Form annexed to these rules; (e) “penalty” means the penalty prescribed in Section 436 of the Act. (2) Words and expressions used in these rules and not defined but defined in the Act shall have the same meaning as assigned to them in the Act. 3. Period of Limitation of Appeal. —Whoever aggrieved by an order of the Principal Officer under sub-section (3) of Section 436 of the Act, may, within a period of thirty days from the date of receipt of such order, prefer an appeal before the Appellate Authority: Provided that the Appellate Authority may admit any appeal after the expiry of the period aforesaid, if the appellant satisfies the Appellate Authority that he had sufficient cause for not preferring the appeal in time: Provided further that no appeal may be admitted after a period of one hundred and eighty days from the date of the receipt of such Order. 4. Form and Content of Appeal. — (1) An application to the Appellate Authority under sub-section (3) of Section 436 of the Act shall be made in English or Hindi, in the manner specified in the Form. (2) An application made in sub-rule (1) shall be accompanied by a copy of the order appealed against. (3) Every appellant shall ensure that an application made in sub-rule (1) fulfils the following particulars, namely: — (a) the application contains all material statements, arguments and grounds relied on by the appellant; (b) the application contains no disrespectful or improper language; (c) The appeal shall clearly state the grounds on which it is made, including any errors of fact or legal or administrative process, proportionality of the penalty, any new admissible information, changed circumstances, conflict of interest or breach of constitutional right. (d) the application contains specific prayers; (e) the application is complete in itself. 5. Consideration of the Appeal. — (1) In the case of any application made under sub-rule (1) of rule 4, the Appellate Authority shall consider the following matters, namely: — (a) whether the procedure laid down in these rules has been complied with, and, if not, whether such non compliance has resulted in the violation of any provision of the Act or these rules or the Constitution of India or in the failure of justice; (b) whether the penalty imposed in the order of the Principal Officer under sub-section (3) of Section 436 of the Act is proportionate or not; (c) whether all the circumstances of the case have been considered to pass such orders as it may deem just and equitable. (d) whether the appeal has been preferred in accordance with item (c) of sub rule 3 of rule 4. (e) disposal of appeal shall be in accordance with this sub-rule. (2) No application made under sub-rule (1) of rule 4 shall be disposed without giving the appellant a reasonable opportunity of being heard. (2) The Appellate Authority shall be guided by the principles of natural justice and subject to other provisions of this Act and of any rules made thereunder, shall have powers to regulate its own procedure, including the places at which it shall conduct its business for the purpose of considering any appeal preferred under this rule. (5) An application made under sub-rule (1) of rule 4 shall be disposed of as expeditiously as possible and the disposal of such application shall not exceed a period of six months from the date of filing such application. 6. Powers of the Appellate Authority. — (1) Notwithstanding anything contained in any other law for the time being in force while exercising powers under this rule, the Appellate Authority, while deciding any application made under[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 sub-rule (1) of rule 4, shall have the same powers as are vested in a civil court under the Code of Civil Procedure, 1908 (5 of 1908), in respect of the following matters, namely: — (a) the discovery and production of books or any documents, at such place and such time as may be specified by the Appellate Authority and examining them on oath; (b) inspection of any books, registers and other documents of any person; (c) issuing commissions for the examination of witnesses or documents; (d) subject to the provisions of sections 123 and 124 of the Indian Evidence Act, 1872 (l of 1872), requisitioning any public record or document or a copy of such record or document, from any office and production of such documents; (e) receiving evidence on affidavits; (f) dismissing an application for default or deciding it, ex parte; (g) setting aside any order of dismissal of any application for default or any order passed by it, ex parte; (h) granting interim relief; (i) reviewing its decision; and (j) any other matter as the Appellate Authority may deem fit. (2) Every proceeding before the Appellate Authority shall be deemed to be a judicial proceeding within the meaning of sections 193 and 228, and for the purposes of section 196, of the Indian Penal Code (45 of 1860) and Appellate Authority shall be deemed to be a Civil Court for the purposes of section 195 and Chapter XXVI of the Code of Criminal Procedure, 1973 (2 of 1974). 7. Orders passed by the Appellate Authority. —Subject to rule 4, the Appellate Authority may— (a) confirm or modify or set aside or reverse the order appealed against under sub-section (3) of Section 436 of the Act; (b) confirm or reduce or enhance or set aside the penalty imposed by the order or impose any penalty where no penalty has been imposed: Provided that no order imposing an enhanced penalty shall exceed the amount of penalty prescribed in sub- section (2) of Section 436: Provided further that no order imposing an enhanced penalty shall be made unless the appellant has been given a reasonable opportunity of making a representation against such enhanced penalty and reasons for such enhancement have been recorded in writing; (c) pass such orders for penalising any frivolous appeals as a deterrence to the abuse of any administrative or legal procedures: Provided any penalty imposed shall not exceed amount of maximum penalty prescribed in sub-section (2) of Section 436; or, (d) pass such orders as it may deem fit in the circumstances of the case. 8. Effect of Orders passed by the Appellate Authority. — (1) Subject to the provisions of sub-rule (1) of rule 6, every order passed by the Appellate Authority under rule 5 shall be final. (2) Every order passed by the Appellate Authority under rule 5 shall, as soon as practicable, be submitted to the Central Government. 9. Award of costs in the proceedings. — (1) Whenever the Appellate Authority deems fit, it may award cost for meeting the legal expenses of the respondent or defaulting party. (2) The Appellate Authority may, where it determines that there has been an abuse of process under these rules, impose exemplary costs on the defaulting party.
