L.-33004/99 सी.जी.-डी.एल.-अ.-28102026-277479 CG-DxLx-xEG-I2D8H1x0x2x0 26-277479 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 5591] नई दिल्ली, मगं लवार, अक्त बू र 27, 2026/कार्तकि 5, 1948 No. 5591] NEW DELHI, TUESDAY, OCTOBER 27, 2026/KARTIKA 5, 1948 पर्यावरण, वन और जलवयर् ु पररवर्ना मंत्रयलर् अधिसचू नय नई दिल्ली, 27 अक् तूबर, 2026 कय.आ. 5816(अ).—मत्रं ालय की अंततम अधिसूचना के अधिक्रमण में का.आ. 3237 (अ), तारीख 22 ससतंबर, 2020 और उसके बाि की अधिसूचना का.आ. 3832(अ), तारीख 06.09.2024 को तनरस्त करते हुए, अधिसचू ना का तनम्नसलखखत प्रारूप, जिसे केंद्रीय सरकार पयाावरण (संरक्षण) अधितनयम, 1986 (1986 का 29) की िारा 3 की उप-िारा (2) के खंड (v) और खंड (xiv) और उप-िारा (3) के साथ पदित उप-िारा (1) द्वारा प्रित्त शजक्तयों का प्रयोग करते हुए िारी करन े का प्रस्ताव करती है, को इससे प्रभाववत होने वाली प्रत् यासशत िनता के सूचनाथ,ा पयाावरण (संरक्षण) तनयम, 1986 के तनयम 5 के उप-तनयम (3) के अिीन अपक्षे क्षत एतद्द्वारा प्रकासशत ककया िाता है; और एतद्द्वारा सूचना िी िाती है कक उक्त प्रारूप अधिसचू ना पर उस तारीख, जिस पर इस अधिसूचना वाले रािपत्र की प्रततयां िनता को उपलब्ि कराई िाती हैं, से साि दिन की अवधि की समाजतत पर या उसके बाि ववचार ककया िाएगा। 8178 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्रारूप अधिसूचना में तनदहत प्रस्तावों के संबिं में कोई आपवत्त या सझु ाव िेने में रुधच रखने वाला कोई भी व्यजक्त ववतनदिाष्ट अवधि के भीतर केंद्रीय सरकार के ववचाराथ ा सधचव, पयाावरण, वन और िलवायु पररवतना मंत्रालय, इंदिरा पयाावरण भवन, िोरबाग रोड, अलीगंि, नई दिल्ली -110003 को या या इसे मंत्रालय के ई-मेल पते : esz-mef@nic.in पर सलखखत रूप में भिे सकता है। प्रयरूप अधिसूचनय जबकक, महानंिा वन्यिीव अभयारण्य पजचचमी बंगाल के िाजिसा लगं और िलपाईगडु ी जिलों, जिनमें ववशेष रूप स े चाय बागानों और ग्रामों स े सटे ववसभन्न प्रिाततयों से यक्ु त वन और निी पाररप्रणाली मौििू हैं, में जस्थत है। इस अभयारण्य का क्षेत्रफल 161.17 वग ा ककलोमीटर है जिसमें गौर (बोस गोरस) की प्रिाततयों का वास है। यह उत्तरी बंगाल में तीस्ता और मेची निी के बीच, गोरुमारा राष्रीय उद्यान, बैकंुिपुर वनों के बीच और तीस्ता निी और कसलम्पोंग प्रभाग के वनों के बीच वन्य हाधथयों की आबािी को संपोवषत करने के सलए एक गसलयारे के रूप में भी काय ा करता है;

और, महानंिा वन्यिीव अभयारण्य की एक ववशेषता यह भी है कक यह हाधथयों के आवागमन का रास्ता है और मॉनसून और शीत ऋतु के िौरान अभयारण्य में ववसभन्न प्रकार के प्रवासी हाथी आश्रय लेते हैं और यहां रॉयल बंगाल टाइगर (पथैं ेरा दटगररस) भी िेखे गए हैं। यह क्षेत्र चीतल (एजक्सस एजक्सस), बाककिंग डीअर (मदुं टआकस मुंिटक), सूअर (सुस स् क्रोफा), पगैं ोसलन (मतनस क्राससकुआडाटा), सांभर (रूसा यतनकलर), रीसस बिं र (मकाका मुलाटा), दहमालयन काला भाल ू(उससा धथबेटानुस लते नगेर), कफसशगं कैट (प्रीओनेलुरुस वववेरीनुस), िगं ली बबल्ली (फेसलस चाउस), क्लाउडेड तेंिआु (नेओफेसलस नेबुलोसा), िलु भा माउंटेन गोट (कैपररकोतनसा थार), आदि के सलए भी प्रससद्ि है;

और जबकक, महानंिा वन्यिीव अभयारण्य वनस्पतत और िीविंतु िैव-वववविता के प्रभावी संरक्षण और सुरक्षा के सलए ववसभन्न मानव-ितनत िबावों की सीमा को तनयंबत्रत ककया िाना चादहए क्योंकक इस नािुक पाररप्रणाली के तनकटवती क्षत्रे पाररजस्थततकी रूप से अधिक संविे नशील हैं िो इस संरक्षक्षत क्षेत्र और संपूण ा पजचचम बंगाल पर काफी प्रभाव डालते हैं;

और जबकक, पैरा 1 में तनदिाष्ट महानंिा वन्यिीव अभयारण्य के क्षेत्र, ववस्तार और सीमाओं का पाररजस्थततकीय, पयाावरण और िैव-वववविता के दृजष्टगत पाररजस्थततकी संविे ी जोन के रूप में सरं क्षण और सुरक्षा करना तथा उक्त पयाावरण संवेिी जोन में उद्योगों या उद्योगों की श्रेणी और उनके प्रचालन और प्रकक्रयाओं को तनवषद्ि करना आवचयक है;

अर्ः, अब, केन्द्रीय सरकार, पयाावरण (संरक्षण) तनयम, 1986 के तनयम 5 के उप-तनयम (3) के साथ पदित पयाावरण (संरक्षण) अधितनयम, 1986 (1986 का 29) (म्िस ेइस अधिसूचना में इसके िश्चात िर्ाावरण अधिननर्म कहा गर्ा है) की िारा 3 की उप-िारा (1) और उप-िारा (2) के खंड (v) और खंड (xiv) तथा उप-िारा (3) द्वारा प्रित्त शजक्तयों का प्रयोग करत ेहुए, पजचचम बगं ाल राज्य के िाजिसा लगं और िलपाईगुडी म्िलों के महानंिा वन्यिीव अभयारण्य की सीमा से लग े 1 ककमी. स े 18.16 ककमी. तक ववस्ताररत क्षेत्र को महानंिा वन्यिीव अभयारण्य पाररजस्थततकी संवेिी िोन (जिस े इसमें इसके पच चात ् पाररजस्थततकी संवेिी िोन कहा गया है) के रूप में अधिसूधचत करती है, जिसका वववरण तनम्नानुसार है, अथाात ्:-

1. पयररस्थितर्की संवेदी जोन कय ववथर्यर और सीमयए ं-

(1) पाररजस्थततकी संविे ी िोन का ववस्तार महानंिा वन्यिीव अभयारण्य की सीमा से लगे 1 ककमी. से 18.16 ककमी. तक ववस्ताररत क्षेत्र और पाररजस्थततकी संवेिी िोन का क्षेत्रफल 539.86 वग ा ककलोमीटर है।

(2) महानंिा वन्यिीव अभयारण्य और इसके पाररजस्थततकी संवेिी िोन की सीमा का वववरण संलग्न क-I के रूप में संलग्न है।

(3) महानंिा वन्यिीव अभयारण्य के आस-पास के पाररजस्थततकी संविे ी जोन के मानधचत्र तथा महत्वपूण ा माग ा बबिं ओु ं के भू-तनिेशाकं संलग्न क-IIक, संलग्न क-IIख, संलग्न क-IIग और संलग् नक- IIघ के रूप में संलग्न हैं।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5

(4) महानंिा वन्यिीव अभयारण्य और इसके पाररजस्थततकी संवेिी िोन की सीमा के भू-तनिेशाकं संलग्न क-III के रूप में संलग्न है।

(5) पाररजस्थततकी संवेिी जोन के अंतगता आने वाले क्षत्रे ों (ग्रामों, चाय के बागानों, वनों) की सूची संलग्न क-IV के रूप में संलग्न है।

2. पयररस्थितर्की संवेदी जोन के ललए आंचललक महयर्ोजनय –

(1) राज्य सरकार, पाररजस्थततकी संवेिी िोन के प्रयोिनों के सलए रािपत्र में इस अंततम अधिसचू ना के प्रकाशन की तारीख से िो वष ा की अवधि के भीतर, स्थानीय व्यजक्तयों के परामश ा से और इस अधिसचू ना में दिए गए अनुबंिों का पालन करत े हुए आंचसलक महायोिना तैयार करेगी जिस पर राज्य में सक्षम प्राधिकारी का अनुमोदित प्रातत करना होगा।

(2) राज्य सरकार द्वारा पाररजस्थततकी संवेिी िोन के सलए आचंसलक महायोिना इस अधिसूचना में ववतनदिाष् ट रीतत से तथा प्रासंधगक केंद्रीय और राज्य ववधियों के अनुरूप और राज्य सरकार द्वारा िारी दिशा तनिेशों, यदि कोई हों, के अनुसार बनायी िाएगी।

(3) इस आंचसलक महायोिना को तनम्नसलखखत ववभागों के परामश ा से तैयार ककया िाएगा जिसस े कक इसमें पाररजस्थततकी और पयाावरण सम्बिं ी ववषयों को शासमल ककया िा सके:-

(i) वन;

(ii) रािस्व;

(iii) कृवष;

(iv) पंचायती राि और ग्रामीण ववकास;

(v) ससचांई और बाढ़ तनयंत्रण;

(vi) पयटा न;

(vii) नगरपासलका और शहरी ववकास;

(viii) लोक तनमााण ववभाग और रािमाग;ा

(ix) पजचचम बंगाल राज्य प्रिषू ण तनयंत्रण बोड;ा

(x) पयाावरण;

(xi) चाय बागानों, रेलवे, रक्षा, एनएचपीसी और भारतीय तेल तनगम के प्रतततनधियों ने भाग सलया।

(4) िब तक इस अधिसचू ना में ववतनदिाष्ट न हो, आचं सलक महायोिना में वतमा ान में अनुमोदित भू-उपयोग, अवसंरचना और कक्रयाकलापों पर कोई प्रततबंि नहीं लगाया िाएगा तथा आचसं लक महायोिना में सभी अवसंरचनाओं और कक्रयाकलापों में सुिार करके उन्हे अधिक कारगर और पाररजस्थततकी-अनुकूल बनाने की व्यवस्था की िाएगी।

(5) इस आंचसलक महायोिना में वनरदहत और अवक्रसमत क्षत्रे ों के सिु ार, ववद्यमान िल तनकायों के संरक्षण, आवाह क्षत्रे ों के प्रबंिन, िल-संभरों के प्रबंिन, भू-िल के प्रबंिन, मिृ ा और नमी के संरक्षण, स्थानीय िनता की आवचयकताओं तथा पाररजस्थततकी एवं पयाावरण के ऐसे अन्य सन्िभो के सलए प्राविान ककये िायेंगे जिन पर ध्यान दिया िाना आवचयक है।

(6) इस आंचसलक महायोिना में सभी ववद्यमान पूिा स्थ लों, ग्रामों एवं शहरी बजस्तयों, वनों की श्रेखणयों एव ं ककस् मों, कृवष क्षेत्रों, उद्यानों एवं उद्यानों की तरह के हररत क्षत्रे ों, बागवानी क्षत्रे ों,6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] बगीचों, झीलों और अन्य िल तनकायों की सीमा का सहायक मानधचत्र के साथ तनिाारण ककया िाएगा और प्रस्ताववत भू-उपयोग की ववशेषताओं का ब्यौरा भी दिया िाएंगा।

(7) इस आंचसलक महायोिना में पाररजस्थततकी संवेिी िोन में होने वाले ववकास का ववतनयमन ककया िाएगा और सारणी में यथासूचीबद्ि प्रततवषद्ि, ववतनयसमत कक्रयाकलापों का पालन ककया िाएगा और इसमें स् थानीय िनता की आिीववका की सुरक्षा के सलए पाररजस्थततकी-अनुकूल ववकास का भी सुतनचचयन एवं संविना ककया िाएगा।

(8) यह आंचसलक महायोिना, क्षेत्रीय ववकास योिना की सह-कासलक होगी।

(9) अनुमोदित आंचसलक महायोिना, तनगरानी ससमतत के सलए एक संिभ ा िस्ताविे का काम करेगी ताकक वह इस अधिसूचना के उपबंिों के अनुसार तनगरानी के अपने कतव्ा यों का तनवहा न कर सके।

(10) आंचसलक महायोिना की लजम्बत और अनुमोिन, कोई नया ववकासात्मक कक्रयाकलाप उपपैरा

(1) और (2) के पैरा 6 में ववतनदिाष्ट उपबंिों द्वारा शाससत होंगे।

3. रयज्र् सरकयर द्वयरय ककए जयने वयले उपयर् - राज्य सरकार इस अधिसचू ना के उपबंिों को प्रभावी बनाने के सलए तनम्नसलखखत उपाय करेगी, यथा:-

(1) भू-उपर्ोग – (क) पाररजस्थततकी संवेिी िोन में वनों, बागवानी क्षेत्रों, कृवष क्षेत्रों, मनोरंिन के सलए असभज्ञात उद्यानों और खलु े स्थानों का वहृ ि वाखणजज्यक या औद्योधगक कक्रयाकलापों के सलए प्रयोग या इसके संपररवतना की अनुमतत नही होगी:

परंतु पाररजस्थततकी संवेिी िोन के भीतर उपयुक्ा त भाग (क) में ववतनदिाष्ट प्रयोिन से सभन्न ककसी अन्य प्रयोिन के सलए कृवष और अन्य भूसम का संपररवतना को तनगरानी ससमतत की ससफाररश पर और क्षत्रे ीय नगर योिना अधितनयम तथा यथा लागू केन्द्र सरकार या राज्य सरकार के अन्य तनयमों एवं ववतनयमों के अिीन तथा इस अधिसूचना के उपबंिों के अनुसार सक्षम प्राधिकारी के पूव ा अनुमोिन से स्थानीय तनवाससयों की तनम्नसलखखत आवासीय िरूरतों को पूरा करने के सलए अनुमतत िी िा सकेगी:- i. ववद्यमान सडकों को चौडा करना, उन्हें सुदृढ़ करना और नई सडकों का तनमाणा करना;

ii. बुतनयािी ढाचं ों और नागररक सुवविाओं का संतनमाणा और नवीकरण; iii. प्रिषू ण उत्पन्न न करने वाले लघु उद्योग; iv. कुटीर उद्योग सदहत ग्राम उद्योग; पाररजस्थततकी पयटा न में सहायक सुवविा भण्डार, और स्थानीय सुवविाएं तथा गहृ वास; और v. पैराग्राफ-7 में यथा उजल्लखखत बढ़ावा दिए गए कक्रयाकलापः परंतु यह भी कक राज्य सरकार अनुमोिन के बबना एव ं भारत के सवं विान के अनच्ु छेि 244 के उपबंिों तथा तत्समय प्रवत्तृ ववधि, जिसके अंतगता अनुसूधचत िनिातत और अन्य परंपरागत वन तनवासी[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 7 (वन अधिकारों की मान्यता) अधितनयम, 2006 (2007 का 2) भी आता है, का अनुपालन ककए बबना वाखणजज्यक और औद्योधगक ववकास कक्रयाकलापों के सलए िनिातीय भूसम के प्रयोग की अनुमतत नहीं होगी। परंतु यह भी कक पाररजस्थ ततकी संवेिी िोन के अंतगता आने वाली भूसम के असभलेखों में हुई ककसी त्रुदट को, तनगरानी ससमतत के ववचार प्रातत करने के पचचात,् राज्य सरकार द्वारा प्रत्येक मामल े में एक बार सुिारा िा सकेगा और उक्त त्रुदट को सुिारे िाने की सूचना केंद्र सरकार के पयाावरण, वन और िलवायु पररवतना मत्रं ालय को िी िाएगी:

परंतु यह और भी कक उपयुक्ा त त्रुदट के संशोिन में इस उप पैरा के अिीन यथा उपबंधित के ससवाय ककसी भी िशा में भू-उपयोग का पररवतना सजम्मसलत नहीं होगा : (ख) वनीकरण और पयाावास पनु बहा ाली कक्रयालापों के साथ अप्रयक्ु त या अनुत् पािक कृवष क्षेत्रों में पुन: वनीकरण करने के प्रयास ककए िाएंगे ।

(2) प्रयकृतर्क जल स्रोर् - इस आंचसलक महायोिना में आने वाले सभी प्राकृततक िलमागों के आवाह क्षेत्रों की पहचान की िाएगी और आंचसलक महायोिना में उनके संरक्षण और बहाली की योिना सजम् मसलत की िाएगी और राज् य सरकार द्वारा िल आवाह प्रबंिन योिना इस रीतत से बनाई िाएगी कक उसमें आवाह क्षेत्रों में ववकास कक्रयाकलापों को प्रततवषद्ि और तनबधिं ित ककया गया हो ।

(3) पर्टा न एवं पयररस्थितर्की पर्टा न – (क) पाररजस्थततकी संवेिी िोन में सभी नए पाररजस्थततकी पयटा न कक्रयाकलाप या ववद्यमान पयटा न कक्रयाकलापों का ववस्तार पाररजस्थततकी संवेिी िोन संबंिी पयटा न महायोिना के अनुसार होगा। ख. पाररजस्थततकी पयटा न महायोिना, राज्य के पयाावरण और वन ववभागों के परामश ा से राज्य के पयटा न ववभाग द्वारा बनायी िाएगी। ग. पयटा न महायोिना आंचसलक महायोिना का घटक होगी। घ. पयटा न महायोिना पाररजस्थततकी संविे ी िोन की वहन क्षमता के आिार पर तैयार की िायेगी। ङ. पाररजस्थततकी पयटा न संबंिी कक्रयाकलाप तनम् नानुसार ववतनयसमत ककए िाएंगे, अथाात:्- i. वन्य िीव अभयारण्य की सीमा से एक ककलोमीटर के भीतर या पाररजस्थततकी संविे ी िोन की सीमा तक, इनमें से िो भी अधिक तनकट हो, ककसी होटल या ररिॉटा का नया तनमााण को अनुमत नहीं ककया िाएगाः परंतु यह भी कक, इस संरक्षक्षत क्षेत्र की सीमा रेखा स े 1 ककलोमीटर की िरू ी से परे और पाररजस्थततकी संविे ी िोन के ववस्तार तक, ककसी नये होटलों और ररिॉटा के तनमााण की कोई भी अनुमतत पयटा न महायोिना के अनुसार तथा पाररजस्थततकी पयटा न सुवविाओं के सलए पूव ा तनिााररत और अधथधचजन्हत क्षत्रे ों में ही िी िाएगी;

ii. पाररजस्थततकी संवेिी िोन के अन्िर सभी नए पयटा न कक्रया-कलापों या ववद्यमान पयटा न कक्रयाकलापों का ववस्तार, केन्द्र सरकार के पयाावरण, वन और िलवाय ु पररवतना मंत्रालय8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] द्वारा िारी दिशातनिेशों तथा पाररजस्थततकी पयटा न, पाररजस्थततकी-सशक्षा और पाररजस्थततकी-ववकास पर बल िेने वाले राष्रीय व्याघ्र संरक्षण प्राधिकरण द्वारा िारी पाररजस्थततकी पयटा न संबंिी दिशातनिेशों (समय-समय पर यथा संशोधित) के अनुसार होगा;

iii. िब तक इस आंचसलक महायोिना को तैयार एव ंअनुमोदित नहीं कर दिया िाता हैं तब तक पयटा न के ववकास और ववद्यमान पयटा न कक्रयाकलापों के ववस्तार की कोई भी अनुमतत सम्बजन्ित ववतनयामक प्राधिकरणों के द्वारा ही िी िाएगी िो कक तनगरानी ससमतत की स्थल ववसशष्ट वास्तववक िााँच और उसकी ररपोटा पर आिाररत होगी और तब तक ऐसे पाररजस्थततकी संविे ी िोन में ककसी नए होटल, ररिॉटा या वाखणजज्यक स्थापना के तनमााण की अनुमतत नहीं होगी।

4. प्रयकृतर्क ववरयसर् – पाररजस्थततकी संवेिी िोन के अंतगता आने वाले बहुमूल्य प्राकृततक ववरासत के सभी स्थलों िैसे कक िीन पूल ररजव ा क्षेत्र, शैल सरं चना, िल प्रपात, झरने, िरे, उपवन, गुफाएं, स्थल, वनपथ, रोहण माग,ा उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एवं संरक्षण के सलए आंचसलक महायोिना के भाग के रूप में एक ववरासत संरक्षण योिना बनायी िाएगी।

5. मयनव तनलमर्ा ववरयसर् थि ल - पाररजस्थततकी संवेिी िोन में भवनों, संरचनाओ,ं कलाकृतत-क्षेत्रों तथा ऐततहाससक, स्थापत्य संबिी, सौंियाात्मक और सास्ं कृततक महत्व के क्षत्रे ों की पहचान की िाएगी और उनके संरक्षण के सलए आंचसलक महायोिना के भाग के रूप में एक ववरासत संरक्षण योिना बनायी िाएगी।

6. ध् वतन प्रदषू ण - पयाावरण (संरक्षण) अधितनयम 1986 और उसमें सशं ोिन के अिीन ध्वतन प्रिषू ण (ववतनयमन और तनयंत्रण) तनयम, 2000 में तनयत उपबंिों के अनुसार पाररजस्थततकी संवेिी िोन में ध्वतन प्रिषू ण की रोकथाम और तनयंत्रण ककया िाएगं ा ।

7. वयर्ु प्रदषू ण - पाररजस्थततकी संवेिी िोन में वायु प्रिषू ण का तनवारण और तनयंत्रण, भारत सरकार के पयाावरण और वन मंत्रालय की अधिसचू ना संखयांक का.आ. 351 (अ), तारीख 15 मई, 1981, के द्वारा प्रकासशत वायु (प्रिषू ण की रोकथाम और तनयंत्रण) अधितनयम, 1981 (1981 का 14), तथा पयाावरण अधितनयम तथा तद्िीन बनाए गए तनयमों, के उपबिं ों के अनुसार ककया िाएगा ।

8. बहहस्रयव कय तनथसरण - पाररजस्थततकी संवेिी िोन में उपचाररत बदहस्राव का तनस्सारण, भारत सरकार के पयाावरण और वन मंत्रालय की अधिसचू ना संखयांक का.आ. 58 (अ), तारीख 27 फरवरी, 1975, के द्वारा प्रकासशत िल प्रिषू ण) तनवारण और तनयंत्रण) अधितनयम, 1974 (1974 का 6) तथा पयाावरण अधितनयम और तद्िीन बनाए गए तनयमों, के उपबंिों के अनुसार ककया िाएगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 9

9. ठोस अपलिष्ट - िोस अपसशष्ट का तनपटान एव ं प्रबन्िन तनम्नानुसार ककया िाएगा:- क. पाररजस्थततकी संवेिी िोन में िोस अपसशष्ट का तनपटान और प्रबंिन केंद्र सरकार द्वारा पयाावरण, वन और िलवायु पररवतना मंत्रालय की अधिसूचना सं. का.आ. 1357(अ), दिनाकं 8 अप्रैल, 2016 के तहत प्रकासशत िोस अपसशष्ट प्रबिं न तनयम, 2016 के उपबंिों के अनुसार ककया िाएगा; अकाबता नक पिाथो का तनपटान पाररजस्थततकी संवेिी िोन और उपरोक्त अपसशष्ट प्रबंिन तनयमों के अनुसार स े बाहर असभज्ञात ककए गए स्थानों पर पयाावरण-अनुकूल रीतत से ककया िाएगा। ख. पाररजस्थततकी संविे ी िोन में मान्य प्रौद्योधगककयों का प्रयोग करते हुए ववद्यमान तनयमों और ववतनयमों के अनुरूप िोस अपसशष्ट के तनरापि और पयाावरण अनुकूल प्रबंिन की अनुमतत िी िा सकेगी। ग. (iii) िैव अक्रमणीय सामग्री का पुनचक्रा ण अधिमानतः कम्पोजस्टंग या वमीकल्चर के माध्यम से ककया िाएगा। घ (iv) अिैववक सामग्री का तनपटान पाररजस्थततकी-संवेिी िोन के बाहर असभज्ञात स्थलों में पायाावरणीय स्वीकाय ा रीतत से ककया िाएगा और पाररजस्थततकी-संवेिी िोन में िोस अपसशष्टों को िलाने या भस्मीकरण की अनुमतत नहीं होगी।

10. जैव धचककत्सय अपलिष्ट - िैव धचककत्सा अपसशष् ट का प्रबंिन तनम्नानुसार ककया िाएगा:- क. पाररजस्थततकी संवेिी िोन में िैव धचककत्सा अपसशष्ट का तनपटान केंद्र सरकार द्वारा पयाावरण, वन और िलवायु पररवतना मंत्रालय की समय–समय पर यथा संशोधित अधिसूचना सं. सा.का.तन 343 (अ), तारीख 28 माच,ा 2016 के तहत प्रकासशत िैव धचककत्सा अपसशष्ट प्रबिं न तनयम, 2016 के उपबंिों के अनुसार ककया िाएगा। (ख) पाररजस्थततकी संविे ी िोन में मान्य असभज्ञात प्रौद्योधगककयों का प्रयोग करत े हुए ववद्यमान तनयमों और ववतनयमों के अनुरूप िैव धचककत्सा अपसशष्ट का सुरक्षक्षत और पयाावरण अनुकूल प्रबंिन अनुमत ककया िायेगा।

11. प्लयस्थटक अपलिष्ट कय प्रबिं न - पाररजस्थततकी संविे ी िोन में तलाजस्टक अपसशष्ट का प्रबंिन, केंद्र सरकार द्वारा पयाावरण, वन और िलवायु पररवतना मंत्रालय की समय-समय पर यथा संशोधित अधिसचू ना सं. सा.का.तन 340(अ), तारीख 18 माच,ा 2016 के तहत प्रकासशत तलाजस्टक अपसशष्ट प्रबंिन तनयम, 2016 के उपबिं ो के अनुसार ककया िाएगा।

12. तनमयाण और ववध्वंस अपलिष्ट कय प्रबिं न - पाररजस्थततकी संवेिी िोन में तनमाणा और ववध्वंस अपसशष्ट का प्रबिं न, केंद्र सरकार द्वारा पयाावरण, वन और िलवाय ु पररवतना मंत्रालय की समय-समय पर यथा संशोधित अधिसचू ना सं. सा.का.तन 317(अ), तारीख 29 माच,ा 2016 के तहत प्रकासशत तनमाणा और ववध्वंस अपसशष्ट प्रबिं न तनयम, 2016 के उपबंिों के अनुसार ककया िाएगा।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

13. ई–अपलिष्ट - पाररजस्थततकी संवेिी िोन में ई–अपसशष्ट का प्रबंिन, केंद्र सरकार द्वारा पयाावरण, वन और िलवायु पररवतना मंत्रालय द्वारा प्रकासशत समय-समय पर यथा संशोधित ई–अपसशष्ट प्रबिं न तनयम, 2016 के उपबिं ों के अनुसार ककया िाएगा।

14. सड़क-र्यर्यर्यर् - सडक-यातायात को पयाावास-अनुकूल तरीके से ववतनयसमत ककया िाएगा और इस संबंि में आंचसलक महायोिना में ववशेष उपबंि शासमल ककए िाएंगे। आंचसलक महायोिना के तैयार होने और राज्य सरकार के सक्षम प्राधिकारी स े अनुमोदित होने तक, तनगरानी ससमतत प्रासंधगक अधितनयमों और उनके तहत बनाए गए तनयमों एवं ववतनयमों के अनुसार सडक-यातायात के अनुपालन की तनगरानी करेगी।

15. वयहन जतनर् प्रदषू ण - वाहन ितनत प्रिषू ण की रोकथाम और तनयंत्रण लागू ववधियों के अनुसार ककया िाएगा। स्वच्छतर ईंिन उिाहरण के सलए सीएनिी, एलपीिी आदि के उपयोग के सलए प्रयास ककए िाएंगे।

16. औद्र्ोधगक ईकयइर्यं - (क) रािपत्र में इस अधिसूचना के प्रकाशन पर या उसके पचचात पाररजस्थततकी संविे ी िोन के भीतर कोई नए प्रिषू णकारी उद्योगों की स्थापना की अनुज्ञा नहीं िी िाएगी। (ख) केन्द्रीय प्रिषू ण तनयंत्रण बोड ा द्वारा फरवरी, 2016 में िारी मागिा शका ससद्िान्तों में उद्योगों के वगीकरण के अनुसार, िब तक कक अधिसचू ना में इस प्रकार ववतनदिाष्ट न हो, पाररजस्थततकी संवेिी िोन के भीतर केवल गैर-प्रिषू णकारी उद्योगों को अनुज्ञात ककया िाएगा। इसके अततररक्त, गैर प्रिषू णकारी कुटीर उद्योगों को बढ़ावा दिया िाएगा।

17. पहयड़ी ढलयनों कय संरक्षण - पहाडी ढलानों का संरक्षण तनम्नानुसार ककया िाएगा:- (क) आंचसलक महायोिना में पहाडी ढलानों के उन क्षेत्रों को िशााया िाएगा जिनमें ककसी भी तनमााण की अनज्ञु ा नही ं होगी; (ख) जिन ढलानों या ववद्यमान खडी पहाडी ढलानों में अत्यधिक भू-क्षरण होता है उनमें ककसी भी तनमााण की अनज्ञु ा नहीं होगी ।

4. पयररस्थितर्की संवेदी जोन में प्रतर्वषद्ि र्य ववतनर्लमर् ककए जयन े वयले किर्यकलयपों की सूची - पाररजस्थततकी संविे ी िोन में सभी कक्रयाकलाप, पयाावरण (संरक्षण) अधितनयम, 1986 (1986 का 29) के उपबिं ों और उसके अिीन बने तनयमों, जिसमें तटीय ववतनयमन िोन (सीआरिेड), 2011 एव ं पयाावरणीय प्रभाव आकलन अधिसचू ना (ईआईए), 2006 शासमल है, सदहत वन (संरक्षण) अधितनयम, 1980 (1980 का 69), भारतीय वन अधितनयम, 1927 (1927 का 16), वन्यिीव (संरक्षण) अधितनयम, 1972 (1972 का 53) अन्य लागू तनयमों के उपबिं ों तथा उनमें ककए गए संशोिनों के अनुसार शाससत होंगे और नीचे िी गई सारणी में ववतनदिाष्ट रीतत से ववतनयसमत होंगे, यथा :-[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 11 सयरणी िम सं. किर्यकलयप हटप्पणी

(1) (2) (3) क. प्रतर्वषद्ि किर्यकलयप

1. वाखणजज्यक खनन, पत्थर (क) पाररजस्थततकी संवेिी िोन के अंतगता वास्तववक स्थानीय उत्खनन और भ्रन्िक इकाइयां। तनवाससयों की घरेलू आवचयकताओं, जिसमें मकानों के तनमााण या मरम्मत के सलए िरती को खोिना सजम्मसलत है, के ससवाय सभी प्रकार के नए और ववद्यमान खनन (लघु और वहृ त खतनि), पत्थर उत्खनन और भ्रन्िक इकाइयां तत्काल प्रभाव से प्रततवषद्ि होंगी;

(ख) खनन प्रचालन, वष ा 1995 की डब्ल्य.ूपी.(सी) सं. 202 में टी.एन. गोिावमना ततरुमलपाि बनाम यूओआई के मामले में दिनाकं 04 अगस् त, 2006; वष ा 2012 की डब्ल्यू.पी.(सी) सं. 435 में गोवा फाउंडेशन बनाम यूओआई के मामले में दिनांक 21 अप्रैल, 2014 और वष ा 1995 की डब्ल्य.ूपी.(सी) सं. 202 में टी.एन. गोिावमना ततरुमलपाि बनाम यूओआई के मामले में दिनांक 28 अप्रलै , 2023 के माननीय उच् चतम न्यायालय के आिेशों के अनुसार ककए िाएगं े।

2. प्रिषू ण (िल, वायु, मिृ ा, ध्वतन, पाररजस्थततकी संवेिी िोन में कोई प्रिषू णकारी उद्योग लगाने आदि) उत्पन्न करने वाले या उसके ववस्तार की अनुमतत नहीं िी िाएगी। मौििू ा उद्योगों उद्योगों की स्थापना। द्वारा प्रिषू ण तनवारण प्रौद्योधगककयां और ध्वतन अवरोिक संस्थावपत ककए िाने चादहए।

3. बडी िल ववद्युत पररयोिनाओ ं प्रततवषद्ि। की स्थापना।

4. ककसी पररसकं टमय पिाथ ा का क. पाररजस्थततकी संविे ी िोन के भीतर कोई पररसंकटमय प्रयोग या उत्पािन या अपसशष्ट शोिन सवु विा अवजस्थत नहीं होगी प्रस्संकरण। ख. पाररजस्थततकी संवेिी िोन के भीतर उत्पन्न सभी पररसंकटमय अपसशष्ट को पाररजस्थततकी संवेिी िोन के बाहर ले िाया िाएगा। पाररजस्थततकी संवेिी िोन के बाहर उत्पन्न ककसी भी पररसंकटमय अपसशष्ट को पाररजस्थततकी संवेिी िोन के अंिर संभालने, संसाधित करने या शोधित करने की अनुमतत नहीं िी िाएगी।

5. प्राकृततक िल तनकायों या भसू म प्रततवषद्ि। क्षेत्र में अशोधित बदहस्रावों का तनस्सरण।

6. नई सॉ समलों की स् थापना की पाररजस्थततकी संवेिी िोन के भीतर नई या मौिूिा सॉ समलों स् थापना। के ववस्तार की अनुमतत नहीं िी िाएगी।12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

7. ईंट भट्टों की स्थापना। प्रततवषद्ि।

8. पॉलीथीन बैग और तलाजस्टक पयटा न कायका लाप के सलए प्रततवषद्ि। अन्य वाखणजज्यक का प्रयोग। प्रततष्िान के सलए 50 माइक्रोन से कम आकार का तलाजस्टक प्रततससद्ि रहेगा।

9. िलावन लकडी का वाखणजज्यक प्रततवषद्ि। उपयोग।

10. सतही एवं भूिल का प्रततवषद्ि। वाखणजज्यक तनष्कषणा ।

11. वविेशी प्रिाततयों को लाना। प्रततवषद्ि।

12. िोस अपसशष्ट शोिन (क) पाररजस्थततकी संवेिी िोन में िैव-तनम्नीकरणीय िोस अपसशष्ट तनपटान और प्रबिं न भारत सरकार के पयाावरण, वन और िलवाय ु पररवतना मंत्रालय द्वारा दिनाकं 8 अप्रैल, 2016 की अधिसूचना संखया का.आ. 1357 (ई) द्वारा प्रकासशत िोस अपसशष्ट प्रबंिन तनयम, 2016 के अनुसार ककया िाएगा; अिैववक सामग्री का तनपटान पाररजस्थततकी संवेिी िोन के बाहर धचजन्हत स्थल पर पयाावरण की दृजष्ट स े स्वीकाय ा तरीके से ककया िा सकता है। (ख) पाररजस्थततकी संवेिी िोन के बाहर उत् सजिता ककसी भी िोस अपसशष्ट को पाररजस्थततकी संविे ी िोन के भीतर उपचाररत/प्रसस्ं कृत करने की अनुमतत नहीं िी िाएगी।

13. िैव-धचककत्सा अपसशष्ट की (क) पाररजस्थततकी संवेिी िोन में िैव-धचककत् सा अपसशष्ट का शोिन सुवविा की स्थापना। तनपटान भारत सरकार के पयाावरण, वन और िलवायु पररवतना मंत्रालय की दिनांक 28 माच,ा 2016 की अधिसचू ना संखया सा.का.तन. 343(अ) द्वारा प्रकासशत िैव-धचककत् सा अपसशष्ट प्रबिं न, तनयम, 2016 के अनुसार ककया िाएगा। पाररजस्थततकी संवेिी जोन के भीतर कोई िैव-धचककत् सा अपसशष्ट शोिन सुवविा जस्थत नहीं होगी। (ख) पाररजस्थततकी संविे ी िोन के भीतर िैव-धचककत्सा इकाइयों से उत् सजिता सभी अपसशष् ट को शोिन और तनपटान के सलए पाररजस्थततकी संवेिी िोन के बाहर ले िाया िाएगा। पाररजस्थततकी संवेिी िोन के बाहर उत् सजिता ककसी भी िवै -धचककत्सा अपसशष्ट का पाररजस्थततकी संविे ी िोन के अंिर हथालन, प्रसस्ं करण या शोिन करने की अनुमतत नहीं िी िाएगी।

14. तलाजस्टक अपसशष्ट की शोिन (क) पाररजस्थततकी संवेिी िोन में तलाजस्टक अपसशष्ट प्रबंिन, सुवविा की स्थापना। भारत सरकार के पयाावरण, वन और िलवायु पररवतना[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 13 मंत्रालय द्वारा दिनाकं 18 माच,ा 2016 की अधिसूचना संखया सा.का.तन. 340(अ) के तहत प्रकासशत तलाजस्टक अपसशष्ट प्रबंिन तनयम, 2016, समय-समय पर यथासंशोधित, के उपबंिों के अनुसार ककया िाएगा। आंचसलक महायोिना में अततररक्त स् थान-ववसशष्ट प्रततबंि तनिााररत ककए िा सकते हैं। पाररजस्थततकी संविे ी िोन के अिं र कोई भी तलाजस्टक अपसशष्ट शोिन सुवविा जस्थत नहीं होनी चादहए। (ख) पाररजस्थततकी संवेिी िोन के अंिर उत् सजिता सभी तलाजस्टक अपसशष् ट को ईएसिेड के बाहर ले िाया िाएगा। पाररजस्थततकी संविे ी िोन के बाहर उत् सजिता ककसी भी तलाजस्टक अपसशष् ट का पाररजस्थततकी संविे ी िोन के अंिर हथालन, प्रसस्ं करण या शोिन करने की अनुमतत नहीं िी िाएगी।

15. ई-अपसशष्ट की शोिन सवु विा (क) पाररजस्थततकी संविे ी िोन में ई-अपसशष् ट प्रबिं न, भारत की स्थापना। सरकार के पयाावरण, वन और िलवायु पररवतना मत्रं ालय द्वारा प्रकासशत ई-अपसशष्ट प्रबंिन तनयम, 2016, समय- समय पर यथासंशोधित, के प्राविानों के अनुसार ककया िाएगा। आंचसलक महायोिना में ववसशष्टताएं और अततररक्त स्थ ान-ववसशष्ट प्रततबंि तनिााररत ककए िा सकते हैं। पाररजस्थततकी सवं ेिी िोन के अंिर कोई ई- अपसशष्ट शोिन सवु विा जस्थत नहीं होनी चादहए। (ख) पाररजस्थततकी संवेिी िोन के अंिर उत् सजिता सभी ई- अपसशष्ट को पाररजस्थततकी संवेिी िोन के बाहर ल े िाया िाएगा। पाररजस्थततकी संविे ी िोन के बाहर उत् सजिता ककसी भी ई-अपसशष्ट का पाररजस्थततकी संवेिी िोन के अंिर हथालन, प्रसस्ं करण या शोिन करने की अनुमतत नहीं िी िाएगी। ख. ववतनर्लमर् किर्यकलयप

16. होटलों और ररसोटों की पाररजस्थततकी पयटा न कक्रयाकलापों हेतु लघु अस्थायी संरचनाओं वाखणजज्यक स्थापना । के तनमाणा के ससवाय, संरक्षक्षत क्षत्रे की सीमा से एक ककलोमीटर के भीतर या पाररजस्थततकी संवेिी िोन की सीमा तक, इनमें िो भी अधिक तनकट हो, नए वाखणजज्यक होटलों और ररसोटों की स्थापना की अनुमतत नहीं होगी:

परंत,ु संरक्षक्षत क्षत्रे की सीमा से एक ककलोमीटर बाहर या पाररजस्थततकी संवेिी िोन की सीमा तक, इनमें िो भी अधिक तनकट हो, पयटा न महायोिना और लागू दिशातनिेशों के अनुसार14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सभी नए पाररजस्थततकी पयटा न कक्रयाकलाप करन े या ववद्यमान कक्रयाकलापों का ववस्तार करने की अनुज्ञा होगी।

17. तनमााण कक्रयाकलाप। (क) संरक्षक्षत क्षेत्र की सीमा से एक ककलोमीटर के भीतर या पाररजस्थततकी संविे ी िोन के ववस्तार तक िो भी तनकट हो, ककसी भी प्रकार का वाखणजज्यक तनमााण को अनुमत नहीं ककया िाएगा: परंतु स् थानीय लोगों को पैराग्राफ 3 के उप पैराग्राफ (1) में सूचीबद्ि कक्रयाकलापों सदहत उनके उपयोग के सलए उनकी भसू म में स्थानीय तनवाससयों की आवासीय आवचयकताओं को पूरा करने सलए तनमाणा करने की अनुमतत भवन उपववधियों के अनुसार िी िा सकेगी:

परन्तु ऐसे लघु उद्योगों िो प्रिषू ण उत् पन् न नहीं करते हैं, से संबंधित तनमाणा कक्रयाकलाप ववतनयसमत ककए िाएगं े और लागू तनयमों और ववतनयमों, यदि कोई हों, के अनुसार सक्षम प्राधिकारी की पूव ा अनुमतत से ही न् यूनतम पर रख े िाएंगे। (ख) एक ककलोमीटर से आगे आंचसलक महायोिना के अनुसार ववतनयसमत होंगे।

18. गैर प्रिषू णकारी लघु उद्योग। फरवरी, 2016 में केन्द्रीय प्रिषू ण तनयंत्रण बोड ा द्वारा िारी समय-समय पर संशोधित उद्योगों के वगीकरण के अनुसार सक्षम प्राधिकारी गैर-प्रिषू णकारी उद्योग और अपररसकं टमय, लघु और सेवा उद्योग, कृवष, पुष्प कृवष, उद्यान कृवष या पाररजस्थततकी संवेिी िोन की अपनी सामग्री से उत्पािों को उत्पन्न करने वाले कृवष आिाररत उद्योग को अनमु तत िे सकेंगे।

19. वक्षृ ों की कटाई। (क) राज्य सरकार के सक्षम प्राधिकारी की पूव ा अनुमतत के बबना वन भूसम या सरकारी या रािस्व या तनिी भसू म पर वक्षृ ों की कटाई नहीं की िा सकेगी। (ख) वक्षृ ों की कटाई संबंधित केंद्रीय या राज्य अधितनयम या उसके अिीन बनाए गए तनयमों के उपबिं ों के अनुसार ववतनयसमत होगी।

20. वन उत्पािों और गैर काष्ि वन लागू ववधियों के अिीन ववतनयसमत होगा। उत्पािों (एनटीएफपी) का संग्रहण।

21. ववद्युत और संचार टॉवर लागू ववधियों के अिीन ववतनयसमत होगा। भूसमगत केबल लगान,े तार-बबछाने तथा अन्य बबछाने को बढ़ावा दिया िाएगा। बुतनयािी ढाचं े की व्यवस्था।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 15

22. नागररक सुवविाओं सदहत लागू कानूनों, तनयमों और ववतनयमों और उपलब्ि दिशातनिेशों बुतनयािी ढाचाँ ा। के अनुसार शमन के उपाय करना।

23. मौिूिा सडकों को चौडा करना, लागू ववधियों, तनयमों और ववतनयमन और उपलब्ि उन्हें सदृु ढ बनाना और नई दिशातनिेशों के अनुसार उधचत पयाावरण प्रभाव मल्ू यांकनके सडकों का तनमाणा । साथ न्यूनीकरण उपाय करना।

24. पयटा न से संबंधित अन्य लागू ववधियों के अिीन ववतनयसमत होगा। कक्रयाकलाप िैस े कक पाररजस्थततकी संविे ी िोन क्षेत्र के ऊपर स े गम ा वाय ु के गुब्बारे, हेलीकातटर, ड्रोन, माइक्रोलाइट्स उडाना आदि।

25. पहाडी ढालों और निी तटों का लागू ववधियों के अिीन ववतनयसमत होगा। संरक्षण।

26. राबत्र में वाहन यातायात का लागू ववधियों के अिीन ववतनयसमत होगा। संचलन।

27. स्थानीय िनता द्वारा अपनायी स्थानीय िनता के प्रयोग के सलए लागू ववधियों के अिीन िा रही वतमा ान कृवष और अनुमत होंगे। बागवानी पद्िततयों के साथ डेयररया,ं िग्ु ि उत्पािन, िल कृवष और मत्स्य पालन।

28. फमों, कारपोरेट, कंपतनयों द्वारा स्थानीय आवचयकताओं को पूरा करने को लागू ववधियों के बडे पैमाने पर वाखणजज्यक अिीन ववतनयसमत (अन्यथा प्रिान ककए गए) होंगे। पशुिन संपिा और कुक्कुट फामों की स्थापना।

29. कृवष या अन्य उपयोग के सलए ववतनयसमत और कायका लाप की उपयक्ु त प्राधिकारी द्वारा खुला कुआ,ाँ बोरवेल आदि। कडाई से तनगरानी की िानी चादहए।

30. प्राकृततक िल तनकायों या भू उपचाररत अपसशष्ट िल या बदहस्रााव का िल तनकायों में क्षेत्र में उपचाररत अपसशष्ट तनस्सारण नहीं होने दिया िायेगा। उपचाररत अपसशष्ट िल िल/बदहस्रााव का तनस्सारण। के पुनचक्रा ण और पुन:उपयोग के प्रयास ककए िाएंगे। अन्यथा उपचाररत अपसशष्ट िल या बदहस्रााव का तनस्सरण लागू ववधियों के अनुसार ववतनयसमत ककया िाएगा।

31. पाररजस्थततकी पयटा न। लागू ववधियों के अिीन ववतनयसमत होगा।

32. वाखणजज्यक संकेत बोड ा और लागू ववधियों के अिीन ववतनयसमत होगा। होडडगिं का प्रयोग। ग. संवधिर्ा किर्यकलयप

33. वषाा िल संचय। सकक्रय रूप से बढ़ावा दिया िाएगा।

35. सभी गततववधियों के सलए हररत सकक्रय रूप से बढ़ावा दिया िाएगा। प्रौद्योधगकी का अंगीकरण।

36. ग्रामीण कारीगरी सदहत कुटीर सकक्रय रूप से बढ़ावा दिया िाएगा। उद्योग।

37. नवीकरणीय ऊिाा और ईंिन का बायोगैस, सौर ऊिा ा इत्यादि को सकक्रय बढ़ावा दिया िाएगा। प्रयोग।

38. कृवष वातनकी। सकक्रय रूप से बढ़ावा दिया िाएगा।

39. बागान लगाना और िडी बूदटयों सकक्रय रूप से बढ़ावा दिया िाएगा। का रोपण।

40. पाररजस्थततकी अनुकूल पररवहन सकक्रय रूप से बढ़ावा दिया िाएगा। का प्रयोग।

41. कौशल ववकास। सकक्रय रूप से बढ़ावा दिया िाएगा।

42. अवक्रसमत भूसम/वनों/ पयाावासों सकक्रय रूप से बढ़ावा दिया िाएगा। की बहाली।

43. पयाावरण के प्रतत िागरुकता। सकक्रय रूप से बढ़ावा दिया िाएगा।

44. संिारणीय वन प्रबिं न सकक्रय रूप से बढ़ावा दिया िाएगा। कायका लाप।

5. पयररस्थितर्की संवेदी जोन की अधिसचू ना की ननगरानी के लिए ननगरानी सलमतर् - केंद्रीय सरकार, पयाावरण (संरक्षण) अधितनयम, 1986 की िारा 3 की उप-िारा (3) के तहत इस अधिसचू ना के उिबंिों की प्रभावी तनगरानी के ललए तनम्नसलखखत को शासमल करते हुए एतद्द्वारा तनगरानी ससमतत का गठन करती है, अथाात:्- ि.स. ननगरानी सलमतर् कय गठन पदनयम

(i) संबंधित जिला कलेक्टर िदेन, अध्र्क्ष;

(ii) राज्य सरकार द्वारा समय-समय पर प्रत्येक तीन वष ा में नासमत सिस्य; ककए िाने वाला वन्यिीव संरक्षण (िरोहर संरक्षण सदहत) के क्षेत्र में कायरा त गैर-सरकारी सगं िन का एक प्रतततनधि

(iii) राज्य सरकार द्वारा समय-समय पर प्रत्येक तीन वष ा में नासमत सिस्य; ककए िाने वाला प्रततजष्ित संस्थान या ववचवववद्यालय स े पाररजस्थततकी के क्षेत्र में एक ववशेषज्ञ

(iv) राज्य सरकार द्वारा समय-समय पर प्रत्येक तीन वष ा में नासमत सिस्य; ककया िाने वाला िैव वववविता का ववशेषज्ञ

(v) राज्य लोक तनमााण ववभाग का एक प्रतततनधि िदेन, सिस्य;

(vi) राज्य प्रिषू ण तनयंत्रण बोड ा का एक प्रतततनधि िदेन, सिस्य;

(vii) संबंधित प्रभागीय वन अधिकारी िदेन, सिस्य-सधचव[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 17

6. तनगरयनी सलमतर् के कयर् ा-

(1) तनगरानी ससमतत, वास्तववक स्थल-ववसशष्ट जस्थततयों के आिार पर उन कक्रयाकलापों की छानबीन करेगी िो कक भारत सरकार के एतद्पूव ा पयाावरण और वन मंत्रालय, की अधिसूचना संखया का.आ. 1553 (अ), तारीख 14 ससतंबर, 2006, के अंतगता आते हों और पाररजस्थततकी संवेिी िोन में हो रहे हों, उसके पैरा 4 के अिीन सारणी में तनदिाष्ट तनवषद्ि कक्रयाकलापों को छोडकर, और उक्त अधिसूचना के प्राविानो के अंतगता पयाावरण की दृजष्ट से पूव-ा जक्लयरेन्स के सलए केन्द्र सरकार के पयाावरण, वन और िलवायु पररवतना मंत्रालय या राज्य पयाावरण आघात मूल्यांकन प्राधिकरण के पास सन्िसभता कर दिए गए हों।

(2) भारत सरकार के तत्कालीन पयाावरण एवं वन मंत्रालय की अधिसचू ना क्रमांक का.आ. 1533 (अ), तारीख 14 ससतंबर, 2006 और पाररजस्थततकी संवेिी िोन में आने वाले कक्रयाकलापों, उसके पैरा 4 के अिीन सारणी में तनदिाष्ट तनवषद्ि कक्रयाकलापों को छोडकर, की तनगरानी ससमतत द्वारा वास्तववक साइट-ववसशष्ट की जस्थततयों के आिार पर िाचं की िाएगी और संबंधित ववतनयामक प्राधिकरणों को तनदिाष्ट की िाएगी।

(3) तनगरानी ससमतत के सिस्य-सधचव या संबंधित कलक्े टर या संबंधित उप वन संरक्षक पयाावरण (संरक्षण) अधितनयम, 1986 की िारा 19 के अिीन इस अधिसचू ना के उपबिं ों का उल्लंघन करने वाले ककसी भी व्यजक्त के ववरुद्ि सशकायत िि ा करन े के सलए सक्षम होंगे।

(4) मामले िर मामले की आवचयकता के आिार पर तनगरानी ससमतत संबंधित ववभागों के प्रतततनधियों या ववशेषज्ञों, उद्योग संघों के प्रतततनधियों या संबंधित दहतिारकों को अपने ववचार- ववमश ा में सहायता के सलए आमंबत्रत कर सकती है।

(5) तनगरानी ससमतत संलग्नक-V में ववतनदिाष्ट प्रोफामाा के अनुसार प्रत्येक वष ा 31 माच ा तक के अपने कक्रयाकलापों की वावषका कारावाई ररपोटा उस वष ा के 30 िून तक राज्य के मखु य वन्यिीव संरक्षक को प्रस्तुत करेगी।

(6) केन्द्र सरकार का पयाावरण, वन और िलवायु पररवतना मंत्रालय तनगरानी ससमतत को उसके काय-ा कलापों के प्रभावी तनवहा न के सलए ऐसे तनिेश िे सकेगा िो वह उधचत समझे।

7. अतर्ररक् र् उपयर् : इस अधिसूचना के उपबंिों को कारगर बनाने के सलए केंद्र सरकार और केंद्र शाससत क्षत्रे अततररक् त उपाय, यदि कोई हों, भी ववतनदिाष् ट कर सकेंगी।

8. उच्चर्म न्र्यर्यलर्, आहद के आदेि : इस अधिसूचना के उपबंि भारत के माननीय उच्चतम न्यायालय या उच्च न्यायालय या राष्र ीय हररत अधिकरण द्वारा दिये गए या िारी ककए िान े वाल े आिेश, यदि कोई हो, के अध्यिीन होंगे। [फा. सं. 25/36/2016-ईएसिडे -आरई] वेि प्रकाश समश्रा, संयुक्त सधचव18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] संलग्न क-I महयनंदय वन्र्जीव अभर्यरण्र् के पयररस्थितर्की संवदे ी जोन की सीमय कय वववरण उत्तर की र्रफ, पाररजस्थततकी संवेिी िोन की कुससया ांग वन प्रभाग खंडों िैसे बाबुखोला वन, महलिीराम वन, बारा ससट्टोंग खासमाहल, लोंगकू खासमाहल, रोलक खासमाहल, सलजीपुर और मकईबारी चाय बागान के साथ एक साझा सीमा है। पस्चचमी सीमय, पाररजस्थततकी संवेिी िोन कुछ हि तक पंकाभरी सडक के साथ मकाईबारी चाय बागान, पटोंग चाय बागान, मंझुआ वन, मचे ी निी के पवू ी सीमा, सूरि बरेर चटै , ससरससया चाय बागान, मेरी व्यू चाय बागान, सन्ं यासी थानेर चैट, बेंगडुबी सैन्य स्टेशन का दहस्सा, बालासन निी, फुलबारी चैट, पाटेन िारेर चैट की सीमा से लगकर आगे बढ़ रहा है, उसके बाि पाररजस्थततकी संवेिी िोन मानेकशॉ माग ा और बबकास रोड के साथ बढ़ता है और एनएच 55 को पार करन े तक महानंिा पीए से 1 ककमी न्यूनतम पाररजस्थततकी संविे ी िोन रेखा के साथ समलता है। उसके बाि यह पंचनोई निी और पूव ा की तरफ मोहरगोंग-गुलमा चाय बागान की सीमा के साथ आगे बढ़ता है। पाररजस्थततकी संवेिी िोन की सीमांककत िक्षक्षणी सीमय, तोरीबारी-पुलमैन सडक के साथ महानंिा पीए की साझा सीमा से 1 ककमी न्यूनतम पाररजस्थततकी संवेिी िोन रेखा के साथ समलती है। बंगाल सफारी तक पहुंचने के बाि पाररजस्थततकी संवेिी िोन की सीमा सेवोक रोड और सेवोक सैन्य स्टेशन के उत्तर में 70 मीटर तक नीचे की ओर मुडती है। इसके आगे यह िक्षक्षण की ओर गिोलिोबा रोड के उत्तर में 300 मीटर तक सरुगरह, डाबग्राम, अम् बारी, बेलाकोबा रेंि िैसे बैकंुिपुर के वन से होते हुए आग े बढ़ती है, िो अंत में बबदं ु ई (उ26o 47' 54.38" पू88o 32' 02.16") स े समलती है। पाररजस्थततकी संविे ी िोन की पूवी सीमय, बबदं ु ई (उ 26o 47' 54.38" प8ू 8o 32' 02.16") से पूव ा की ओर 500 मीटर पूव ा की ओर वाशबरी चाय बागान, मोंगपोंग वन, कसलम्पोंग वन प्रभाग के गसु लगं वन और यांग खसमाहल की साझा सीमा के साथ-साथ तीस्ता निी तल की पूवी सीमा तक बढ़ती है।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 19 महयनंदय वन्र्जीव अभर्यरण्र् के पयररस्थितर्की संवदे ी जोन की सीमय कय महत्वपणू ा भू-तनदेियंक सदं भों के सयि ववथर्र्ृ वववरण ववथ र्यर वववरण उत्तरी इस पाररजस्थततकी संवेिी िोन की सीमा रेखा बबदं ु आई (उ26o 58' 02.98” प8ू 8o 26' 14.62”) स े चलते हुए तीस्ता निी चैनल को काटत े हुए पजचचमी दिशा में बबिं ु उ26o 57' 46.42” प.88o 25'

29.83” तक िाती है; आगे यह िक्षक्षण पजचचमी दिशा में कंडुंग वन बस्ती और लोंकु खासमहल के बीच ररि के साथ-साथ बबिं ु उ26o 57' 15.85” पू88o 25' 17.56” तक िाती है; आगे यह िक्षक्षण पजचचमी दिशा में बबिं ु उ26o 56' 31.08” प8ू 8o 25' 15.15” तक िाती है। इसके बाि सीमा पजचचमी दिशा में आगे िाती है और सेल्फू-6 मील सडक को काटत े हुए बबिं ु उ26o 56' 17.37" पू88o 24' 26.18" तक िाती है। इसके बाि यह िक्षक्षण-पजचचमी दिशा में आगे िाती है और बबिं ु उ26o 55' 03.23" पू88o 23' 34.26" तक िाती है। कफर लाटपंचोर िंगल से लगभग 1 ककमी िरू समानांतर ररि के साथ-साथ चलत े हुए बबिं ु उ26o 54' 26.31” प8ू 8o 22' 39.37” तक िाती है। कफर आगे पजचचमी दिशा में ससमररगं चाय बागान को काटते हुए बबिं ु उ26o 53’ 36.61’’ पू88o 21’ 12.66” तक िाती है। कफर आगे िक्षक्षण-पजचचमी दिशा में धगदटगं ी चाय बागान को काटते हुए बबिं ु उ26o 52' 30.18” पू88o 20’ 52.36’’ तक िाती है। कफर पहाडी से नीचे बबिं ु उ26o 51' 54.62” पू88o 20' 57.54’’ तक िाती है। कफर पजचचमी दिशा में बबिं ु उ26o 51' 45.75” पू88o 20' 44.86’’ तक िाती है। आगे िक्षक्षण में नूरबांग चाय बागान की ओर बबिं ु उ26o 50' 39.61” पू88o 21' 08.76’’ तक िाती है। कफर पजचचमी तरफ बबन्ि ु उ26o 50' 27.48” प8ू 8o 20' 33.50” तक िाती है। कफर आग े पजचचमी तरफ बबन्ि ु उ26o 50' 31.22” प8ू 8o 20' 23.08” तक िाती है। कफर उत्तर दिशा में बबन्ि ु उ26o 50' 33.63” पू88o 20' 20.96” की ओर। कफर पूव ा की तरफ बबन्ि ु उ26o 50' 34.16” पू80 20' 22.57” तक िाती है। कफर आगे उत्तर की ओर बबन्ि ु उ26o 50' 38.09” पू88o 20' 19.51” तक िाती है। कफर आगे उत्तर की ओर बबन्ि ु उ26o 50' 41.01” पू88o 20'

WHEREAS, the Mahananda Wildlife Sanctuary is situated in Darjeeling and Jalpaiguri districts of West Bengal which are characterized by forest and riverine ecosystem adjoining tea gardens and villages with diverse ethnicities. The Sanctuary has an area of 161.17 square kilometers harboring species of Gaurs (Bos gaurus). It also acts as a corridor for sustaining population of wild elephants in North Bengal in between Teesta and Mechi River, between Gorumara National Park, Baikunthpur Forests and between Teesta river and Forests of Kalimpong division;

AND WHEREAS, Mahananda Wildlife Sanctuary is characterized by elephant migration route and variety of migratory elephant takes shelters. Royal Bengal tiger (Panthera tigris) was also reported from the Sanctuary during monsoons and winter seasons. The area is also famous for chital (Axis axis), barking deer (Muntiacus munjtak), boar (Sus scrofa), pangolin (Manis crassicaudata), sambar (Rusa unicolour), Rhesus monkey (Macaca mulatta), Himalayan black bear (Ursus thibetanus laniger), fishing cat (Prionailurus viverrinus), jungle cat (Felis chaus), clouded leopard (Neofelis nebulosa), rare mountain goat (Capricornis thar), etc.;[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 39

AND WHEREAS, the major fauna of the Mahananda Wildlife Sanctuary includes mammals such as Sikkim large-clawed shrew (Soriculus nigrescens Gray), Hodgson's brown-toothed shrew (Episoriculus caudatus Horsefield), Indian long-tailed shrew (Soriculus leucops Horsefield), Himalayan water shrew (Chimmarogale platycephala himalayica), fulvour fruit bat (Rousettus leschenaultii), demares flying fox (Pteropus giganteus), Dobson's tube nosed bat (Murinacyclotis, Dobson), Himalayan hairy-winged bat (Hariooeephalus harpia lasyuras, Hodgson), Assamese macaque (Maeaea assamensis pelops, Hodgson), small Indian civet (Viverricula indica), toddy cat (Paradosurus hermaphrodites), , leopard (Panthera pardus), gaur (Ribos frontatis gaurus), common otter (Lutra lutra), Elephant (Elephas indicus), serow (Copricornis sumatraensis Hodgson), Indian or black naped hare (Lepus nigricollis ruficaudatus, Geoffroy), lesser giant flying squirrel (Petaurista elegans, Gray), etc.;

AND WHEREAS, the major reptiles and amphibians found in Mahananda Wildlife Sanctuary are Fan-throated lizard (Sitana ponticeriana), Garden lizard (Calotes ersicolor), Bark Gecko (Hemidactylus leschenaultia), Ornamental flying snake(Chrysopale ornate), King Cobra(Ophiophagus hanna), Cobra (Naja naja), Buff-striped keel back (Amphiesma stolata), Land monitor lizard (varnus bengalensis), Common Indian Skink (Mabuya carinata), Indian tent turtle (Kachuga tentoria), Indian Bull Frog (Rana tigerina),Tree Frog (Polypedates leucomystax), Ballon Frog (Uperodon globulosus), Leaping Frog (Rana erythraea), Warty Frog (Rana Verrucosa) etc ;

AND WHEREAS, the major butterflies so far known to be found in Mahananda Wildlife Sanctuary are, Common Bluebottle butterfly (Graphium sarpedon), Tailed Jay butterfly (Graphium Agamemnon), Common Five ring butterfly (Ypthima baldus), Plain Tiger butterfly

(Danaus), Common Leopard butterfly (Phalanta Phalantha), Banded Treebrown butterfly Neope confuse, Psyche butterfly (Leptosia nina), Crimson Rose butterfly (Pachliopta hector), Danaid eggfly butterfly (Hypolimnas misippus), Chocolate Pansy butterfly (Precis iphita), Painted Jazebel butterfly (Delias hyperate), Oakleaf butterfly (Kallima horsfieldi), Common Nawab butterfly (Charaxes athamus), Common Sailor butterfly (Neptis hylas), Striped Tiger butterfly (Danaus genutia), Common Map (Cyrestis thyodbmus), Tawny Rajah butterfly (Charaxes bernardus) etc;

AND WHEREAS, for effective conservation and protection of the floral and faunal biodiversity of Mahananda Wildlife Sanctuary, the extent of different anthropogenic pressures has to be regulated as the immediate area adjoining this fragile ecosystem is much ecologically sensitive having great impact on this protected area and wildlife in whole of North Bengal;

AND WHEREAS, it is necessary to conserve and protect the area, the extent and boundaries of Mahananda Wildlife Sanctuary which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW, THEREFORE, , in exercise of the powers conferred by sub-section (1) clause (v) and clause (xiv) of sub-section (2) and sub-section (3) of Section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notify 1 kilometer to 18.16 kilometers from the boundary[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 41 of the Mahananda Wildlife Sanctuary in Darjeeling , Kalimpong and Jalpaiguri District in the State of West Bengal as the Eco-sensitive Zone (hereafter in this notification referred to as Eco- sensitive zone) details of which are as under, namely:-

1. Extent and boundaries of Eco-Sensitive Zone-

(1) The Eco-sensitive Zone is extends from 1 kilometer to 18.16 kilometers around the boundary of Mahananda Wildlife Sanctuary and the area of the Eco-sensitive Zone is approximately 539.86 square kilometer.

(2) The boundary description of the Eco Sensitive Zone of Mahananda Wildlife Sanctuary is appended as Annexure-I.

(3) The Maps of the Eco-sensitive Zone around Mahananda Wildlife Sanctuary and Geo- coordinates of the important way points is appended as Annexure- II A, Annexure II B Annexure II C and Annexure II D.

(4) Geo Coordinates on the boundary of Mahananda Wildlife Sanctuary and its Eco-sensitive zone are appended at Annexure -III.

(5) The list of areas falling (Villages, Tea Gardens, Forests) under the Eco-sensitive Zone is appended as Annexure-IV.

2. Zonal Master Plan for Eco-Sensitive Zone-

(1) The State Government shall, for the purposes of the Eco-sensitive Zone prepare a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of the competent authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following Departments of the State Government, for integrating the ecological and environmental

considerations into the said plan:-

(i) Forest;

(ii) Revenue;

(iii) Agriculture;

(iv) Panchayati Raj and Rural Development;42 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(v) Irrigation and Flood Control;

(vi) Tourism;

(vii) Municipal and Urban Development;

(viii) Public Works Department and Highway;

(ix) West Bengal State Pollution Control Board;

(x) Environment;

(xi) Representatives from Association of Tea Gardens, Railways, Defense, NHPC and Indian Oil Corporation.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, green area, such as, parks, horticultural areas, orchards, lakes and other water bodies with supporting maps giving details of existing and proposed land use features.

(7) The Zonal Master Plan shall regulate development in Eco-sensitive Zone and adhere to prohibited and regulated activities listed in the Table in paragraph 4 and also ensure and promote eco-friendly development for security of local communities’ livelihood.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

(10) Pending preparation and approval of the Zonal Master Plan, any new developmental activities shall be governed by provisions specified at paragraph 6 of sub-para (1) and

(2).

3. Measures to be taken by the State Government. - The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

(1) Land use.– (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or

converted into areas for commercial or residential or industrial activities:[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 43

Provided that the conversion of agricultural and other lands, for the purposes other than that specified at part (a) above, within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the Central Government or the State Government as applicable and vide provisions of this notification, to meet the residential needs of the local residents and for activities such as-

(i) widening and strengthening of existing roads and construction of new roads;

(ii) construction and renovation of infrastructure and civic amenities;

(iii) small scale industries not causing pollution;

(iv) cottage industries including village industries; convenience stores and local amenities supporting eco-tourism including home stay; and

(v) promoted activities given in paragraph 4:

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under Regional Town Planning Act and other rules and regulations of the State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and

Climate Change:

Provided also that the correction of error shall not include change of land use in any case except as provided under this sub-paragraph;

(b) efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

(2) Natural water bodies.-The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and the guidelines shall be drawn up by the State Government in such a44 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] manner as to prohibit development activities at or near these areas which are detrimental to such areas.

(3) Tourism or eco-tourism.- (a) All new eco-tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone;

(b) the Tourism Master Plan shall be prepared by the State Department of Tourism in consultation with the State Departments of Environment and Forests;

(c) the Tourism Master Plan shall form a component of the Zonal Master Plan;

(d) the Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco-sensitive Zone;

(e) the activities of eco-tourism shall be regulated as under, namely:-

(i) new construction of hotels and resorts shall not be allowed within one kilometre from the boundary of the protected area or upto the extent of the Eco-sensitive Zone, whichever is nearer;

Provided that beyond the distance of one kilometer from the boundary of the protected area till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for eco-tourism facilities as per Tourism Master Plan;

(ii) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government and the eco-tourism guidelines issued by the National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism, eco-education and eco-development;

(iii) until the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scrutiny and recommendation of the Monitoring Committee and no new hotel, resort or commercial establishment construction shall be permitted within Eco-sensitive Zone area.

(4) Natural heritage.- All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

(5) Man-made heritage sites.- Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part of the Zonal Master Plan.

(6) Noise pollution. - Prevention and control of noise pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Noise Pollution (Regulation and Control) Rules, 2000 and its amendments.

(7) Air pollution.- Prevention and control of air pollution in the Eco-sensitive Zone shall be carried out in accordance with the provisions of the Air (Prevention and Control of[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 45 Pollution) Act, 1981 (14 of 1981) and Environment (Protection) Act, 1986 and the rules made there under these Acts.

(8) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974) and Environment (Protection) Act, 1986 and the rules made there under these Acts.

(9) Solid wastes.- Disposal and Management of solid wastes shall be as under:-

(a) the solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

(b) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-biodegradable components;

(c) (iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(d) (iv) the inorganic material may be disposed in an environmentally acceptable manner at site(s) identified outside the Eco-sensitive Zone and no burning or incineration of solid wastes shall he permitted in the Eco-sensitive Zone.

(10) Bio-Medical Waste.– Bio-Medical Waste Management shall be as under:-

(a) the Bio-Medical Waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 343 (E), dated the 28th March, 2016;

(b) safe and Environmentally Sound Management of Bio-Medical Wastes in conformity with the existing rules and regulations using identified technologies may be allowed within the Eco-sensitive Zone.

(11) Plastic waste management. - The plastic waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

(12) Construction and demolition waste management.- The construction and demolition waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide

notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

(13) E-waste.- The e - waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time.46 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(14) Vehicular traffic.– The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the competent authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made thereunder.

(15) Vehicular pollution.- Prevention and control of vehicular pollution shall be incompliance with applicable laws and efforts shall be made for use of cleaner fuels.

(16) Industrial units.– (a) On or after the publication of this notification in the Official Gazette, no new polluting industries shall be permitted to be set up within the Eco- sensitive Zone;

(b) only non-polluting industries shall be allowed within Eco-sensitive Zone as per the classification of Industries in the guidelines issued by the Central Pollution Control Board in February, 2016, as amended from time to time, unless so specified in this notification, and in addition, the non-polluting cottage industries shall be promoted.

(17) Protection of hill slopes.- The protection of hill slopes shall be as under:-

(a) the Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted;

(b) construction on existing steep hill slopes or slopes with a high degree of erosion shall not be permitted.

2. List of activities prohibited or to be regulated within Eco-sensitive Zone- All activities in the Eco-Sensitive Zone shall be governed by the provisions of the Environment Act and the rules made there under including the Environmental Impact Assessment Notification, 2006 (or the latest notification) and other applicable laws including the Forest (Conservation) Act, 1980 (69 of 1980), the Indian Forest Act, 1927 (16 of 1927), the Wildlife (Protection) Act 1972 (53 of 1972), and amendments made thereto and be regulated in the manner specified in the Table below, namely:- TABLE S. (b) The mining operations shall be carried out in accordance with the orders of the Hon’ble Supreme Court, dated the 4th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. UOI in W.P.(C) No.202 of 1995; dated 21st April, 2014 in the matter of Goa Foundation Vs. UOI in W.P.(C) No.435 of 2012; and dated the 28th April, 2023 in the matter of T.N. Godavarman Thirumulpad Vs. UOI and in W.P.(C) No.202 of 1995.

2. Setting of industries causing No new or expansion of polluting industries in the Eco- pollution (Water, Air, Soil, sensitive Zone shall be permitted. Pollution prevention Noise, etc.). technologies and noise barriers should be installed by existing industries.

3. Establishment of major Prohibited. hydroelectric project.

4. Use or production or a) No hazardous waste treatment facility shall be processing of any hazardous located within the ESZ substance/hazardous waste. b) All hazardous waste generated inside the ESZ shall be taken outside the ESZ. No hazardous waste generated outside the ESZ will be allowed to be handled, processed or treated inside the ESZ

5. Discharge of untreated Prohibited. effluents in natural water bodies or land area.

6. Setting up of new saw mills. New or expansion of existing saw mills shall not be permitted within the Eco-sensitive Zone.

7. Setting up of brick kilns. Prohibited.

8. Use of polythene bags and Prohibited for tourism activity. For other commercial plastics. establishment, plastic below 50 microns will be prohibited

9. Commercial use of Prohibited. firewood.

10. Commercial extraction of Prohibited. surface and ground water.

11. Introduction of Exotic Prohibited. species.

12. Solid waste treatment. (a) The bio-degradable solid waste disposal and management in the Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change vide48 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

notification number S.O. 1357 (E), dated the 8th April, 2016; the inorganic material may be disposed in an environmentally acceptable manner at site identified outside the Eco- sensitive Zone.

(b) No solid waste generated outside the Eco Sensitive Zone will be allowed to be treated/ processed within the Eco Sensitive Zone.

13. Treatment of Bio-Medical (a) The Bio-Medical Waste disposal in the Eco waste. Sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management, Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R 343 (E), dated the 28th March, 2016. No Bio Medical Waste treatment facility shall be located within the Eco Sensitive Zone.

(b) All waste generated from bio-medical units within the Eco-sensitive Zone shall be taken outside the Eco-sensitive Zone for treatment and disposal. No Bio-medical waste generated outside the Eco- sensitive Zone will be allowed to be handled, processed or treated inside the Eco-sensitive Zone.

14. Treatment of plastic (a) The Plastic waste management in the Eco-sensitive waste. Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016, published by the Government of India in the MoEF&CC vide

notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

Additional site-specific restrictions may be prescribed in the Zonal Master Plan. No plastic waste treatment facility should be located inside the Eco-sensitive Zone.

(b) All plastic waste generated inside the Eco-sensitive Zone shall be taken outside the Eco-sensitive Zone . No plastic waste generated outside the Eco- sensitive Zone will be allowed to be handled, processed or treated inside the Eco-sensitive Zone.

15. Treatment of E-waste. (a) The e-waste management in the Eco-sensitive Zone shall be carried out as per the provisions of the e- waste Management Rules, 2016, published by the Government of India in the Ministry of Environment, Forest and Climate Change, as amended from time to time. Specifications and additional site-specific restrictions may be prescribed in the Zonal Master Plan. No e-waste treatment facility should be located inside the Eco- sensitive Zone.[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 49

(b) All e-waste generated inside the Eco-sensitive Zone shall be taken outside the Eco-sensitive Zone . No e-waste generated outside the Eco-sensitive Zone will be allowed to be handled, processed or treated inside the Eco-sensitive Zone.

B. Regulated Activities

16. Commercial establishment No new commercial hotels and resorts shall be permitted of hotels and resorts. within one kilometer of the boundary of the Protected Area or upto the extent of Eco-sensitive zone, whichever is nearer, except for small temporary structures for Eco-

tourism activities:

Provided that, beyond one kilometer from the boundary of the protected Area or upto the extent of Eco-sensitive Zone whichever is nearer, all new tourist activities or expansion of existing activities shall be in conformity with the Tourism Master Plan and guidelines as applicable.

17. Construction activities. (a) New commercial construction of any kind shall not be permitted within one kilometer from the boundary of the Protected Area or upto extent of the Eco-

sensitive Zone whichever is nearer:

Provided that, local people shall be permitted to undertake construction in their land for their use including the activities listed in sub-paragraph (1) of paragraph 3 as per building bye-laws to meet the

residential needs of the local residents:

Provided that the construction activity related to small scale industries not causing pollution shall be regulated and kept at the minimum, with the prior permission from the competent authority as per applicable rules and regulations, if any.

(b) Beyond one kilometer it shall be regulated as per the Zonal Master Plan.

18. Small scale non-polluting Non-polluting industries as per classification of industries. industries issued by the Central Pollution Control Board in February, 2016, as amended from time to time, and non-hazardous, small-scale and service industry, agriculture, floriculture, horticulture or agro-based industry producing products from indigenous materials from the Eco-sensitive Zone shall be permitted.

19. Felling of trees. (a) There shall be no felling of trees in the forest or Government or revenue or private lands without prior permission of the competent authority in the State Government.50 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made there under.

20. Collection of Forest Produce Regulated under applicable laws. or Non-Timber Forest Produce.

21. Erection of electrical and Regulated under applicable laws of underground cabling communication towers and may be promoted. laying of cables and other infrastructures.

22. Infrastructure including civic Taking measures of mitigation, as per applicable laws, amenities. rules and regulation and available guidelines.

25. Protection of Hill Slopes and Regulated as per the applicable laws. river banks.

26. Movement of vehicular Regulated as per applicable laws. traffic at night.

27. Ongoing agriculture and Permitted as per the applicable laws for use of locals. horticulture practices by local communities along with dairies, dairy farming, aquaculture and fisheries.

28.. Establishment of large-scale Regulated as per applicable laws except for meeting local commercial livestock and needs. poultry farms by firms, corporate and companies.

29. Open Well, Bore Well, etc. Regulated and the activity should be strictly monitored for agriculture or other by the appropriate authority. usage.

30. Discharge of treated waste The discharge of treated waste water or effluents shall be water/effluents in natural avoided to enter into the water bodies and efforts shall be water bodies or land area. made for recycle and reuse of treated waste water.

37. Use of renewable energy Bio-gas, solar light etc. shall be actively promoted. and fuels.

38. Agro-Forestry. Shall be actively promoted.

39. Plantation of Horticulture Shall be actively promoted. and Herbals.

40. Use of eco-friendly Shall be actively promoted. transport.

41. Skill Development. Shall be actively promoted.

42. Restoration of Degraded Shall be actively promoted.

Land/ Forests/ Habitat.

43. Environmental Awareness. Shall be actively promoted.

44. Sustainable Forest Shall be actively promoted.

Management Activities.

5. Monitoring Committee for Monitoring the Eco-Sensitive Zone Notification- For effective monitoring of the provisions of this notification under sub-section (3) of

section 3 of the Environment (Protection) Act, 1986, the Central Government hereby constitutes a Monitoring Committee, comprising of the following, namely:-52 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] S.No. Constituent of the Monitoring Committee Designation

University to be nominated by the State Government from time to time every three years.

(iv) An expert in Biodiversity to be nominated by the State Member;

Government from time to time every three years.

(v) A representative from State Public Works Department ex-officio, Member;

(vi) A representative from State Pollution Control Board ex-officio, Member;

(vii) Concerned Divisional Forest Officer ex-officio, Member-Secretary.

6. Functions of the Monitoring Committee –

(1) The Monitoring Committee shall, based on the actual site-specific conditions scrutinise, the activities covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forest, vide number S.O. 1533 (E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, and referred to the Central Government in the Ministry of Environment, Forest and Climate Change or the State Environment Impact Assessment Authority, as the case maybe, for prior environmental clearances under the provisions of the said notification.

(2) The activities not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests vide number S.O. 1533 (E), dated the 14th September, 2006 and falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned Regulatory Authorities.

(3) The Member-Secretary of the Monitoring Committee or the concerned Collector or the concerned Deputy Conservator of Forests shall be competent to file complaint under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.[भाग II—खण्‍ड 3(ii)] भारत‍का‍राजपत्र‍:‍असाधारण 53

(4) The Monitoring Committee may invite representative or expert from concerned Department, representative from industry associations or concerned stakeholders to assist in its deliberations depending on the requirements on case to case basis.

(5) The Monitoring Committee shall submit the annual action taken report of its activities for the period up to the 31st March of every year by the 30th June of that year to the Chief Wildlife Warden of the State in pro-forma specified in Annexure-V, appended to this

notification.

(6) The Central Government may give such directions in writing, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional Measures: The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Supreme Court, etc. orders. The provisions of this notification shall be subject to the orders, if any passed or to be passed by the Hon’ble Supreme Court of India or High Court or the National Green Tribunal.

[F. No. 25/36/2016/ESZ-RE] VED PRAKASH MISHRA, Jt. Secy.54 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Annexure I BOUNDARY DESCRIPTION OF ECO-SENSITIVE ZONE OF MAHANANDA WILDLIFE SANCTUARY In the Northern Side, the ESZ has a common boundary with Kurseong forest division blocks like Babukhola forest, Mahaldiram forest, Bara Sittong Khasmahal, Longku Khasmahal, Rolak Khasmahal, Lizziepur and Makaibari Tea garden.

The Western Boundary, the ESZ is moving along the Pankabhari road to a certain extent having boundary with Makaibari Tea Garden, Patong Tea Garden, Manjhua Forest, Eastern Boudary of Mechi River, Suraj Barer Chat, Sirsia Tea Garden, Merry view Tea Garden, Sanyasi Thaner Chat, part of Bengdubi Military Station, Balason River, Fulbari Chat, Paten Jarer Chat, then ESZ runs along the Maneckshaw Marg and Bikas Road and merges with the 1 km minimum ESZ line from the Mahananda PA till it cuts NH 55. Then it moves along Panchanoi river and boundary of Mohurgong-Gulma Tea Garden on the eastern side.

The Demarcated Southern Boundary of ESZ merges with 1 km minimum ESZ line from Mahananda PA sharing boundary with Toribari-Pulman road. After reaching Bengal Safari the boundary of ESZ turns downward to 70 meters north of Sevoke road and Sevoke Military Station.Further it runs southward constituting the Forest of Baikunthapur like Sarugarah, Dabgram, Ambari, Belacoba Ranges till 300 meters north of Gajoldoba road finally meeting Point E (N26 47’ 54.38”E88 32’ 02.16”).
