(v) और खंड (xiv) तथा उप-धारा (3) के साथ परित उप-धारा (1) के द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए केंद्र सरकार प्रस्ट्ताजवत जनम्नजलजखत प्रारुप अजधसूचना को िारी करने का प्रस्ट्ताव करती है, और पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) की अपेक्षानुसार उन लोगों की िानकारी के जलए प्रकाजित करती ह,ै जिनकी इसस े प्रभाजवत होने की संभावना ह ै और एतद्द्वारा र्ह सूजचत दकर्ा िाता ह ै दक उि प्रारुप अजधसूचना पर उस तारीख से साि दिन की अवजध की समाजि पर र्ा उसके बाि जवचार दकर्ा िाएगा जिस तारीख को इस अजधसूचना वाले रािपत्र की प्रजतर्ां िनता को उपलब्ध करा िी िाती ह।ैं प्रारुप अजधसूचना म ें जनजहत प्रस्ट्तावों के संबंध म ेंआपजत्त र्ा सझु ाव िेने म ेंरुजच रखने वाला कोई भी व्यजि इन् ह ें जलजखत रूप म ेंर्था जवजनर्िाष् ट अवजध के भीतर केंद्रीर् सरकार के जवचाराथा सजचव, पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर्, इंदिरा पर्ाावरण भवन, िोर बाग रोड, अलीगंि, नई दिल्ली-110003 को र्ा इन् ह ें मंत्रालर् के ई-मले पत े esz- mef@nic.in पर भेि सकता ह।ै 6762 GI/20262 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] प्रारुप अजधसचू ना िबदक, नागरहोल टाइगर ररिवा, जिसका क्षेत्रफल 843.96 वग ा दकलोमीटर ह,ै कनााटक राज्र् के मैसूर जिल े (हुनसुर, पेररर्ापटना और हग्े गडेिेवनकोट तालुकों) और कोडग ु जिले (पोन्नमपेटे और जवरािपटे तालुकों) में जस्ट्थत ह।ै र्ह 11°50'उत्तर अक्षािं और 12°25'उत्तर िेिांतर तथा 75°54'पूवा िेिांतर और 76°18'पूव ा ििे ांतर के बीच जस्ट्थत ह।ै इस क्षेत्र को सवाप्रथम वर् ा 1955 म ें नागरहोल वन्र्िीव अभर्ारण्र् के रूप म ें गरित दकर्ा गर्ा था, जिसका क्षेत्रफल 285 वग ा दकलोमीटर था। बाि में, इसम ें अजतररि क्षेत्र सजममजलत दकए गए और वर् ा 1983 म ें 643.39 वग ा दकलोमीटर के क्षेत्र के जलए अंजतम अजधसूचना िारी की गई, जिसमें इसे नागरहोल राष्ट्रीर् उद्यान के रूप म ें अजधसजू चत दकर्ा गर्ा। वर् ा 2002 में, राष्ट्रीर् उद्यान क्षेत्र को बांिीपुर टाइगर ररिवा के जवस्ट्तार के रूप में अजधसूजचत दकर्ा गर्ा था। और चदूं क, नागरहोल टाइगर ररिवा को 20 दिसंबर, 2007 को कोर/महत्वपूण ा बाघ पर्ाावास (सीटीएच ) के रूप म ें अजधसूजचत दकर्ा गर्ा था। इसके अलावा, 562.41 वगा दकलोमीटर क्षेत्र को 14 अगस्ट्त, 2012 को नागरहोल टाइगर ररिवा के बफर िोन के रूप में अजधसूजचत दकर्ा गर्ा था;

और चदूं क, नागरहोल टाइगर ररिवा नीलजगरी िीवमंडल अभर्ारण्र् (5500 वगा दकमी) का जहस्ट्सा ह ै और मैसूर हाथी अभर्ारण्र् का भी अजभन्न अगं ह।ै र्ह एजिर्ाई हाजथर्ों के बहुत उच्च घनत्व को आश्रर् िेता है, जिसमें वर्स्ट्क नर हाजथर्ों की संख्र्ा काफी अजधक ह,ै िो इसके पाररजस्ट्थजतक महत्व को ििााता ह;ै और चदूं क, नागरहोल टाइगर ररिवा बांिीपुर टाइगर ररिवा और केरल राज्र् म ें वार्नाड वन्र्िीव अभर्ारण्र् से सटा हुआ ह,ै जिससे र्ह िेि के सबसे बड े वन्र्िीव पर्ाावास क्षेत्रों म ें स े एक बन िाता ह।ै र्ह टाइगर ररिवा केरल के आरजक्षत वनों के माध्र्म से ब्रह्मजगरर वन्र्िीव अभर्ारण्र् से भी िडु ा हुआ ह।ै र्ह संपूण ा क्षेत्र िगं ली बाघों की एक स्ट्वस्ट्थ और व्यवहार् ा आबािी का भी घर ह;ै और चदूं क, नागरहोल टाइगर ररिवा कावेरी, लक्ष्मणतीथ ा और काजबनी नदिर्ों की महत्वपूणा बारहमासी धाराओं और सहार्क नदिर्ों के िलग्रहण क्षेत्र के रूप में भी कार्ा करता ह।ै र्ह क्षेत्र िेन ु कुरुबा, बेट्टा कुरुबा और र्ेरवा वनवासी अनुसूजचत िनिाजतर्ों का घर ह;ै और चदूं क, इस क्षेत्र में वनस्ट्पजतर्ों और िीवों की जवजवधता बहुत अजधक ह।ै नागरहोल राष्ट्रीर् उद्यान और टाइगर ररिवा के प्रमुख वनों को मोटे तौर पर िजक्षणी उष्णकरटबंधीर् अधा-सिाबहार वनों में वगीकृत दकर्ा िा सकता ह,ै िो केरल के साथ पजिमी सीमा के दकनारे जिटपुट रूप से पाए िाते ह;ैं िजक्षणी उष्णकरटबंधीर् नम पणपा ाती वन, िो हटघाट, नलकेरी, अररकेरी और काकनकोट के िजक्षण-पजिमी भागों और मेरटकुप्पे के पजिमी भाग के आरजक्षत वनों में पाए िाते हैं; और िजक्षणी उष्णकरटबंधीर् िुष्क पणापाती वन, िो मेरटकुप्पे, वीरानाहोसाहल्ली, कचुवनहल्ली और काकनकोट के कुि जहस्ट्सों के आरजक्षत वनों तक सीजमत ह।ैं और चदूं क, इस क्षेत्र की वनस्ट्पजत म ें िोररर्ा तालरुा, सैंटालम एल्बम, टर्मानजलर्ा चेबलु ा, एनोजिसस लैरटफोजलर्ा, अजादिराच्टा इंजडका, क्लोरोजक्सलोन जस्ट्वएटेजनर्ा, एकेजिर्ा ल्र्ूकोफ्लोआ, एकेजिर्ा कैटेचू, स्ट्टीररर्ोस्ट्पमाम चले ोनोइड्स, जजजजफ़स एसपीएस, डार्ोस्ट्पार्रोस मेलनॉजक्सलोन, डार्ोस्ट्पार्रोस मोंटाना आदि प्रिाजतर्ााँ सजममजलत ह।ैं लैंटाना की झाजडर्ााँ बडे क्षेत्रों को ढक लेती हैं, जिनमें कुि स्ट्थानों पर फीजनक्स एकौजलस भी सजममजलत ह।ै कैजसर्ा टोरा, कैजसर्ा ऑररकुलाटा, डेस्ट्मोजडर्म आदि भी इस वनस्ट्पजत का जहस्ट्सा ह।ैं अकेजिर्ा इंजससर्ा एक आम लता ह।ै बांस आमतौर र्हा ं नहीं पाए िात े ह।ैं इस प्रकार के िंगलों म ेंचंिन बहुतार्त म ेंपार्ा िाता ह।ै और चदूं क, नागरहोल टाइगर ररिवा की जवजवध िीव-िंतु जवजवधता इसके पाररजस्ट्थजतक जभन्नताओं के कारण है, िो राष्ट्रीर् उद्यान के पूवी क्षेत्रों म ें िुष्क पणापाती वनों स े लेकर राष्ट्रीर् उद्यान के पजिमी भागों म ें उष्णकरटबंधीर् नम पणपा ाती वनों तक फैली हुई ह।ै स्ट्थानीर् रूप से 'हडलस' कहलान े वाल े अजद्वतीर् घास के िलिल ग्रीष्म ऋतु के िुष्क मौसम म ें िाकाहारी[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 3 िीवों के जलए चारा उपलब्ध कराते ह।ैं टाइगर ररिवा की ऊंचाई 700 मीटर से 960 मीटर तक जभन्न होती ह।ै इस क्षेत्र म ें उष्णकरटबंधीर् िलवार्ु ह ैऔर वर्ाा 1000 जममी स े1500 जममी तक होती ह।ै और चदूं क, र्ह बाघों के सरं क्षण के जलए वैजिक बाघ पहल द्वारा मान्र्ता प्राि उच्च घनत्व वाल े बाघ पररिश्ृ र्ों में से एक ह।ै र्ह सात बड े खुर वाल े िानवरों की प्रिाजतर्ों िैस े चीतल, सांभर, चौससंगा, गौर, मुंटिैक, िगं ली सूअर और हाथी के अक्षुण्ण समूह के जलए भी प्रजसद्ध सबसे समृद्ध वन्र्िीव क्षेत्रों में से एक ह;ै और चदूं क, अन्र् सामान्र् रूप से पाए िाने वाले स्ट्तनधाररर्ों में बाघ, तिें आु , िगं ली जबल्ली, तेंिआु जबल्ली, मिली पकडने वाली जबल्ली, िंग लगी जचत्तीिार जबल्ली, िोटी भारतीर् जसवेट, सामान्र् ताड जसवेट, सामान्र् नेवला, धारीिार गिान वाला नेवला, भूरा नेवला, लाल नेवला, जसर्ार ढोल र्ा भारतीर् िगं ली कुत्ता, सस्ट्ु त भालू, सामान्र् ऊिजबलाव, उडन े वाली लोमडी, भारतीर् जविाल जगलहरी, सामान्र् जविाल उडन े वाली जगलहरी, तीन धारीिार ताड जगलहरी, भारतीर् साही, भारतीर् खरगोि, हाथी, गौर, चार सींग वाला मृग, सांभर, चीतल, भौंकन े वाला जहरण, चूहा जहरण, िगं ली सूअर, भारतीर् पैंगोजलन आदि भी टाइगर ररिवा म ेंवास करत े ह।ैं और चदूं क, टाइगर ररिवा म ें पजक्षर्ों की 330 प्रिाजतर्ा ं िैसे दक मालाबार पाइड हॉनजा बल, मालाबार रोगन, ग्रीन इंपीररर्ल जपिन, मोर, क्रेस्ट्टेड सपेंट ईगल, ऑस्ट्प्र,े ग्रे िगं ल फाउल, वूली नक्े ड स्ट्टॉका, ककंग वल्चर आदि, साथ ही गंभीर रूप से लुिप्रार् लॉन्ग-जबल्ड और व्हाइट-रमप्ड वल्चर भी िि ाकी गई ह,ैं और चदूं क, महत्वपणू ा जततली प्रिाजतर्ों में री जनमफ, ब्ल ू टाइगर, कॉमन टाइगर, प्लेन टाइगर, कॉमन इंजडर्न क्रो, कॉमन फोर-ररंग, कॉमन इवसनंग-ब्राउन, टॉनी रािा, ग्रे काउंट, बरै ोनटे , कलर सािेंट, कॉमन सािेंट, कॉमन सेलर, ग्रेट एग फ्लाई, डैनाइड एग फ्लाई, ग्रे पैंसी, चॉकलेट पैंसी, र्ेलो पैंसी, ब्ल ू पैंसी, लेमन पैंसी, पीकॉक पैंसी, स्ट्मॉल लेपड,ा एगं ल्ड कैस्ट्टर, पेल ग्रास ब्ल,ू ग्राम ब्ल,ू कॉमन बड-ा सवंग, दक्रमसन रोज, कॉमन रोज, कॉमन माइम, ब्लू मॉमान, रेड हले ने , कॉमन मॉमान, लाइम बटरफ्लाई, मालाबार-बैंडडे स्ट्वलै ो-टेल, स्ट्पेक्टेकल स्ट्वॉडा-टेल, टेल्ड ि,े कॉमन िेजबले , इंजडर्न कैबेि व्हाइट, ग्रेट ऑरेंि रटप, कॉमन एजमग्रेंट, कॉमन ग्रास र्ेलो, आदि; िसै ी प्रिाजतर्ां सजममजलत ह।ैं और चदूं क, नागरहोल टाइगर ररिवा की सीमाओं के आसपास के क्षेत्र को, जिसे अनच्ु िेि 1 में पाररजस्ट्थजतक, पर्ाावरणीर् और िैव जवजवधता के िजृ िकोण से पाररजस्ट्थजतकी-संवेिी िोन के रूप में जनर्िाि दकर्ा गर्ा है, संरजक्षत और सुरजक्षत करना आवश्र्क ह,ै और उि पाररजस्ट्थजतकी-संवेिी िोन म ें उद्योगों र्ा उद्योगों के वगा और उनके संचालन और प्रदक्रर्ाओं को प्रजतबंजधत करना आवश्र्क ह;ै अब, अतः पर्ाावरण (संरक्षण) जनर्म, 1986 के जनर्म 5 के उप-जनर्म (3) के साथ परित, पर्ाावरण (संरक्षण) अजधजनर्म 1986 (1986 का 29) (जिसे इस अजधसूचना में आगे पर्ाावरण अजधजनर्म कहा गर्ा ह)ै की उपधारा (1) और धारा 3 की उपधारा (2) के खंड (v) और (xiv) तथा उपधारा (3) द्वारा प्रित्त िजिर्ों का प्रर्ोग करते हुए, केंद्र सरकार एतद्द्वारा कनााटक राज्र् में नागरहोल बाघ अभर्ारण्र् की सीमा के आसपास 0 (िन्ू र्) से 7.5 दकमी तक के क्षेत्र को पाररजस्ट्थजतकी- संवेिी िोन (जिस े इसमें इसके पिात् ‘पाररजस्ट्थजतकी-संवेिी िोन’ कहा िाएगा) के रूप म ें अजधसूजचत करती ह,ै जिसका जववरण जनम्नानुसार ह:ै-

1. नागरहोल टाइगर ररिव ाके पाररजस्ट्थजतकी-सवं िे ी िोन का जवस्ट्तार एव ंसीमाए-ाँ

(1) नागरहोल टाइगर ररिव ा की सीमा के चारों ओर 0 (िून्र्) से 7.5 दकमी तक पाररजस्ट्थजतकी-संवेिी िोन होगा और पाररजस्ट्थजतकी-संवेिी िोन का क्षेत्रफल 573.959 वगा दकमी ह।ै जवजभन्न दििाओं में पाररजस्ट्थजतकी-संवेिी िोन का जवस्ट्तार नीचे दिर्ा गर्ा ह:ै- दििा सरं जक्षत क्षत्रे की सीमा स े(दकमी म)ें उत्तर 1 - 6.9 उत्तर-पूव ा 5.20 पूवा 7.4 िजक्षण-पूव ा 0 िजक्षण 0 िजक्षण-पजिम 0 पजिम 1 उत्तर-पजिम 24.08[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 5 पाररजस्ट्थजतकी-सवं िे ी िोन को िन्ू र् रखन े का औजचत्र्: केरल के साथ अंतरराज्र्ीर् सीमा के कारण िजक्षण-पूवा, िजक्षण और िजक्षण-पजिम दििाओं म ेंपाररजस्ट्थजतकी-संवेिी िोन को िून्र् (0 दकमी) रखा गर्ा ह।ै ➢ पाररजस्ट्थजतकी-संवेिी िोन में 101 गााँव (पणू ा/आंजिक) सजममजलत ह,ैं जिनका भौगोजलक क्षेत्रफल 271.61 वग ा दकमी ह।ै ➢ नागरहोल टाइगर ररिवा के पाररजस्ट्थजतकी-संवेिी िोन के अधीन अजधसूजचत आरजक्षत वन क्षेत्रों का भौगोजलक क्षेत्रफल 302.36 वगा दकमी ह।ै ➢ नागरहोल टाइगर ररिवा की सीमा से उत्तर दििा में जस्ट्थत पडोसी आरजक्षत वन क्षेत्रों की िरू ी 23.6 दकमी ह।ै

(2) नागरहोल बाघ अभर्ारण्र् और इसके पाररजस्ट्थजतकी-संवेिी िोन की सीमा का जववरण अनलु ग्नक-I क और अनलु ग्नक-I ख के रूप में सलं ग्न ह।ै

(3) नागरहोल बाघ अभर्ारण्र् और इसके पाररजस्ट्थजतकी-संवेिी िोन का मानजचत्र अनलु ग्नक-II के रूप में सलं ग्न ह।ै

(4) नागरहोल टाइगर ररिव ा और पाररजस्ट्थजतकी-संवेिी िोन की सीमा के प्रमुख भौगोजलक जनििे ांकों की सूची अनलु ग्नक-IIIक और अनलु ग्नक-IIIख के रूप में सलं ग्न ह।ै

(5) प्रस्ट्ताजवत पाररजस्ट्थजतकी-सवं ेिी िोन में आन े वाले गांवों की सूची अनलु ग्नक-IV के रूप में संलग्न ह।ै

(6) नागरहोल टाइगर ररिव ा के पाररजस्ट्थजतकी-संवेिी िोन में सजममजलत आस-पास के आरजक्षत वन क्षेत्रों की सूची अनलु ग्नक-V के रूप में सलं ग्न ह।ै

2. नागरहोल टाइगर ररिव ाके पाररजस्ट्थजतकी सवं िे ी िोन के जलए आचं जलक महार्ोिना -

(1) राज्र् सरकार, पाररजस्ट्थजतकी-संवेिी िोन के प्रर्ोिनों के जलए रािपत्र में इस अजधसूचना के प्रकािन की तारीख से िो वर्ा की अवजध के भीतर, स्ट्थानीर् व्यजिर्ों के परामिा स े और इस अजधसूचना म ें दिए गए अनुबंधों का पालन करते हुए राज्र् सरकार के सक्षम प्राजधकारी के अनुमोिन के जलए आंचजलक महार्ोिना तैर्ार करेगी।

(2) पाररजस्ट्थजतकी-संवेिी िोन के जलए आचंजलक महार्ोिना राज्र् सरकार द्वारा इस अजधसूचना में जवजनर्िाष् ट तरीके के अनुसार तथा सुसंगत केंद्रीर् और राज्र् कानूनों तथा केंद्रीर् सरकार द्वारा िारी मागाििाक-जसद्धांतों, र्दि कोई हों, के अनरुु प तैर्ार की िाएगी।

(3) पाररजस्ट्थजतकीर् और पर्ावा रणीर् तथ्र् ों को उि र्ोिना म ें समाकजलत करन े के जलए राज्र् सरकार के जनम्नजलजखत जवभागों के परामि ासे आंचजलक महार्ोिना तैर्ार की िाएगी:-

(i) पर्ाावरण;

(ii) वन और वन्र्िीव;

(iii) कृजर्;

(iv) रािस्ट्व;

(v) िहरी जवकास;

(vi) पर्ाटन;

(vii) ग्रामीण जवकास;

(viii) ससंचाई और बाढ़ जनर्ंत्रण;

(4) आंचजलक महार्ोिना म ें अनुमोदित वतामान भू-उपर्ोग, अवसंरचना और दक्रर्ाकलापों पर कोई प्रजतबन्ध नही लगार्ा िाएगा िब तक दक इस अजधसूचना म ें इस प्रकार जवजनर्िाष् ट न हो और आचंजलक महार्ोिना म ें सभी अवसंरचना और दक्रर्ाकलापों म ें सुधार सजममजलत होगा िो दक अजधक िक्ष और पाररजस्ट्थजतकी अनुकूल हों।

(5) आंचजलक महार्ोिना म ें अनाच्िादित क्षेत्रों के िीणोद्धार, वतामान िल स्रोतो के संरक्षण, आसपास के क्षेत्रों के प्रबंधन, िल-संभरों के प्रबंधन, भूतल िल के प्रबंधन, मिृ ा और नमी सरं क्षण, स्ट्थानीर् समुिार्ों की आवश्र्कताओं तथा पाररजस्ट्थजतकी और पर्ाावरण स े संबंजधत ऐसे अन्र् पहलओंु का प्रावधान होगा, जिन पर ध्र्ान िेना आवश्र्क ह।ै

(6) आंचजलक महार्ोिना म ें वतामान और प्रस्ट्ताजवत भूजम उपर्ोग जविेर्ताओं के ब्र्ौरों स े अनुसमर्थात मानजचत्र के साथ सभी जवद्यमान पूिा स्ट्थलों, ग्रामों और िहरी बजस्ट्तर्ों, वनों के प्रकार और दकस्ट् मों, कृजर् क्षेत्रों, ऊपिाऊ भूजम, हररत क्षत्रे िैस े उद्यान, उद्यान कृजर् क्षत्रे , फलोउद्यान, झीलों और अन्र् िल जनकार्ों का सीमांकन दकर्ा िाएगा।

(7) आंचजलक महार्ोिना पाररजस्ट्थजतकी संवेिी िोन म ें जवकास को जवजनर्जमत करेगी और पैरा 4 म ें सारणी म ें सूचीबद्ध प्रजतजर्द्ध, जवजनर्जमत दक्रर्ाकलापों का अनुपालन करेगी और स्ट् थानीर् समुिार्ों की िीजवका को सुरजक्षत करने के जलए पाररजस्ट्थजतकी अनुकूल जवकास को सुजनजित करेगी और उसका संवधान करेगी ।

(8) आंचजलक महार्ोिना, क्षेत्रीर् जवकास र्ोिना की सह-काजलक होगी।

(9) इस प्रकार अनुमोदित आंचजलक महार्ोिना इस अजधसूचना के उपबंधों के अनुसार जनगरानी के अपने कार्ों को करने के जलए जनगरानी सजमजत के जलए एक संिभा िस्ट्तावेि होगी।

3. राज्र् सरकार द्वारा दकए िान े वाल े उपार्.- राज्र् सरकार इस अजधसूचना के उपबंधों को प्रभावी करन े के जलए जनम्नजलजखत उपार् करेगी, अथाात: -

(1) भ-ू उपर्ोग.– (क) पाररजस्ट्थजतकी संवेिी िोन म ें वनों, उद्यान कृजर् क्षेत्रों, कृजर् क्षेत्रों, मनोरंिन के प्रर्ोिनों के जलए जचजन्हत दकए गए पाकों और खलु े स्ट्थानों का वाजणजज्र्क र्ा आवासीर् र्ा औद्योजगक संबद्ध जवकास दक्रर्ाकलापों के जलए उपर्ोग र्ा पररवतान नहीं होगा:

बिते दक पाररजस्ट्थजतकी संवेिी िोन के भीतर उपर्िुा भाग (क) म ें जवजनर्िाि प्रर्ोिनों स े पथृ क प्रर्ोिनों के जलए कृजर् और अन्र् भूजम का पररवतान, जनगरानी सजमजत की जसफाररि पर और र्था लागू और क्षेत्रीर् नगर र्ोिना अजधजनर्म और केन्द्रीर् सरकार र्ा राज्र् सरकार के अन्र् जनर्मों तथा जवजनर्मों के अधीन सक्षम प्राजधकारी के पूवा अनुमोिन स,े और इस अजधसूचना के उपबंधों द्वारा स्ट्थानीर् जनवाजसर्ों की जनम्नजलजखत आवासीर् आवश्र्कताओं को परू ा करन े के जलए इसकी अनमु जत िी गई ह,ै िैसे:-

(i) वतामान सडकों को चौडा करना और उन्ह ेंसुिढ़ृ करना और नई सडकों का जनमााण करना;

(ii) बुजनर्ािी ढांचों और नागररक सुजवधाओं का संजनमााण और नवीकरण;

(iii) प्रिर्ू ण उत्पन्न न करने वाल ेलघु उद्योग;

(iv) कुटीर उद्योग सजहत ग्राम उद्योग; पाररजस्ट्थजतकी पर्ाटन म ें सहार्क सुजवधा भण्डार, और स्ट्थानीर् सुजवधाएं जिसके अधीन गृह वास सजममजलत; और[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 7

(v) पैराग्राफ-4 के अधीन दिए गए संवर्धात दक्रर्ाकलापः र्ह भी दक क्षेत्रीर् नगर जनर्ोिन अजधजनर्म और अन्र् जनर्मों और जवजनर्मों के अधीन सक्षम प्राजधकारी के पूव ा अनुमोिन जबना और संजवधान के अनुच्िेि 244 के उपबंधों र्ा तत्समर् प्रवृत्त जवजध, जिसके अधीन अनुसूजचत िनिाजत और अन्र् परंपरागत वन जनवासी (वन अजधकारों की मान्र्ता) अजधजनर्म, 2006 (2007 का 2) भी आता ह,ै के अनपु ालन के जबना वाजणजज्र्क और औद्योजगक जवकास दक्रर्ाकलापों के जलए िनिातीर् भूजम के उपर्ोग की अनमु जत नहीं होगी:

परंत ु र्ह भी दक पाररजस्ट्थजतकी संवेिी िोन के भीतर आने वाली भूजम के अजभलेखों म ें पाई िाने वाली दकसी त्रुरट को, जनगरानी सजमजत के जवचार प्राि करने के पिात,् राज्र् सरकार द्वारा प्रत्र्ेक मामले म ें एक बार सुधारा िा सकेगा और उि त्रुरट को सुधारे िाने की सूचना केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् को िी िाएगी:

परंत ु र्ह और भी दक उपर्ुाि त्रुरट के संिोधन म ें इस उप परै ा के अधीन र्था उपबंजधत के जसवार् दकसी भी ििा म ें भ-ू उपर्ोग का पररवतान सजममजलत नहीं होगा : (ख) वनरोपण और आवास पुनस्ट्थाापन दक्रर्ाकलापों के माध्र्म स े अप्रर्िु र्ा अनुत्पािक कृजर् क्षेत्रों को पुनः वनरोपण करन े का प्रर्ास दकर्ा िाएगा।

(2) प्राकृजतक िल स्रोत.- सभी प्राकृजतक िल स्रोतों/नदिर्ों/नहरों के िलग्रहण क्षेत्रों की पहचान की िाएगी और उनके संरक्षण और पनु िीवन की र्ोिनाएाँ आंचजलक महार्ोिना में सजममजलत दकर्ा िाएंगी।

(3) पर्टा न र्ा पाररजस्ट्थजतकी पर्टा न.– (क) पाररजस्ट्थजतकी संविे ी िोन के भीतर सभी नए पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलाप र्ा वतामान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार पाररजस्ट्थजतकी संवेिी िोन स ेसबंजधत पर्ाटन महार्ोिना के अनुसार होगा। (ख) पर्ाटन महार्ोिना, राज्र् सरकार के पर्ाावरण और वन जवभागों के परामि ास ेराज्र् के पर्ाटन जवभाग द्वारा बनार्ी िाएगी। (ग) पर्ाटन महार्ोिना आंचजलक महार्ोिना का घटक होगी। (घ) पर्ाटन महार्ोिना पाररजस्ट्थजतकी संवेिी िोन की वहन क्षमता के आधार पर तैर्ार की िार्ेगी। (ङ) पाररजस्ट्थजतकी पर्ाटन संबधं ी दक्रर्ाकलाप जनमन ानुसार जवजनर्जमत दकए िाएंग,े अथाात:् -

(i) टाइगर ररिव ा की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन की सीमा तक, इनम ें से िो भी अजधक जनकट हो, दकसी होटल र्ा ररिॉटा का नर्ा जनमााण को अनुमजत नहीं िी िाएगी; बिते दक, टाइगर ररिवा की सीमा रेखा से एक दकलोमीटर की िरू ी से परे और पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, दकसी नर् े होटल और ररिॉटा के जनमााण की कोई भी अनुमजत पर्ाटन महार्ोिना के अनुसार पारर-पर्ाटन सुजवधाओं के जलए केवल पूवा जनधााररत क्षत्रे ों में ही अनुमत होगी।

(ii) पाररजस्ट्थजतकी संवेिी िोन के अन्िर सभी नए पर्ाटन दक्रर्ाकलापों र्ा वतामान पर्ाटन दक्रर्ाकलापों का जवस्ट्तार, केन्द्र सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा िारी दििाजनिेिों तथा राष्ट्रीर् व्याघ्र संरक्षण प्राजधकरण द्वारा िारी पारर-पर्ाटन सबं ंधी मागाििाक जसद्धांत (समर्-समर् पर र्था संिोजधत) जिसमें पर्ाावरण-पर्ाटन पर जविेर् िोर दिर्ा िाएगा।

(iii) िब तक इस आंचजलक महार्ोिना को अनुमोदित नहीं कर दिर्ा िाता तब तक पर्ाटन के जवकास और वतामान पर्ाटन दक्रर्ाकलापों के जवस्ट्तार की कोई भी अनुमजत संबंजधत जवजनर्ामक प्राजधकरणों के द्वारा ही िी िाएगी, िो दक जनगरानी सजमजत की वास्ट् तजवक स्ट्थल जवजिि वास्ट्तजवक संवीक्षा और संस्ट् तुजत पर आधाररत होगी और पाररजस्ट्थजतकी संवेिी िोन म ें दकसी नए होटल, ररिॉटा र्ा वाजणजज्र्क स्ट्थापना के8 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] जनमााण की अनुमजत नहीं होगी।

(4) नसै र्गका जवरासत.– पाररजस्ट्थजतकी संवेिी िोन म ें बहुमूल्र् नैसर्गाक जवरासत के सभी स्ट्थलों िैसे दक िीन कोि आरजक्षत क्षत्रे , िलै संरचना, िल प्रपात, झरन,े िरे, उपवन, गफु ाए,ं स्ट्थल, वनपथ, रोहण मागा, उत्प्रपात आदि की पहचान की िाएगी और उनकी सुरक्षा एव ं संरक्षण के जलए आंचजलक महार्ोिना के भाग के रूप म ें जवरासत संरक्षण र्ोिना बनाई िाएगी।

(5) मानव जनर्मता जवरासत स्ट्थ ल.- पाररजस्ट्थजतकी संवेिी िोन म ें भवनों, संरचनाओं, कलाकृजतर्ों ऐजतहाजसक, स्ट्थापत्र् संबधी, सौंिर्ाात्मक और सांस्ट्कृजतक महत्व के क्षेत्रों व इि-ा जगि ा के क्षेत्रों की पहचान की िाएगी और उनके सरं क्षण के जलए आंचजलक के भाग के रूप म ेंएक जवरासत संरक्षण र्ोिना बनार्ी िाएगी।

(6) ध्व जन प्रिर्ू ण.- पाररजस्ट्थजतकी संवेिी िोन म ें ध्वजन प्रिर्ू ण के जनवारण और जनर्ंत्रण का अनुपालन पर्ाावरण (संरक्षण) अजधजनर्म, 1986 के अधीन तथा समर् समर् पर र्था संिोजधत ध्वजन प्रिर्ू ण (जवजनर्मन और जनर्ंत्रण) जनर्म, 2000 के उपबंधों के अनुसार दकर्ा िाएगं ा।

(7) वार् ु प्रिर्ू ण. - पाररजस्ट्थजतकी संवेिी िोन म ें वार् ु प्रिर्ू ण का जनवारण और जनर्ंत्रण समर् समर् पर र्था संिोजधत का अनुपालन वार्ु (प्रिर्ू ण जनवारण और जनर्ंत्रण) अजधजनर्म, 1981 (1981 का 14) और उसके अधीन बनाए गए जनर्म तथा उनम ेंसंिोधन के उपबंधों के अनुसार दकर्ा िाएगा।

(8) बजहस्राव का जनस्ट्सरण. - पाररजस्ट्थजतकी संवेिी िोन म ें उपचाररत बजहस्राव का जनस्ट्सारण समर् समर् पर र्था संिोजधत, िल (प्रिर्ू ण जनवारण तथा जनर्ंत्रण) अजधजनर्म, 1974 (1974 का 6) पर्ाावरण (सरं क्षण) अजधजनर्म, 1986 और उसके अधीन बनाए गए जनर्मों र्ा राज्र् सरकार द्वारा जनधााररत मानकों, िो भी अजधक किोर हो, के उपबंधों के अनुसार दकर्ा िाएगा।

(9) िोस अपजिि. - िोस अपजिि का जनपटान और प्रबन्धन जनम्नानुसार दकर्ा िाएगा: - (क) पाररजस्ट्थजतकी संवेिी िोन म ें िोस अपजिि का जनपटान और प्रबंधन भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा समर्-समर् पर र्थासंिोजधत अजधसूचना सं. का.आ. 1357(अ), तारीख 08 अप्रलै , 2016 के अधीन प्रकाजित िोस अपजिि प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा; अकाबाजनक पिाथों का जनपटान पाररजस्ट्थजतकी संवेिी िोन से बाहर जचजन्हत दकए गए स्ट्थान पर पर्ाावरणीर् स्ट् वीकार्ा रीजत स ेदकर्ा िाएगा;

(ख) पाररजस्ट्थजतकी संवेिी िोन म ें मान्र् प्रौद्योजगदकर्ों का प्रर्ोग करत े हुए वतामान जनर्मों और जवजनर्मों के अनरूु प िोस अपजिि के सरु जक्षत और पर्ाावरण अनुकूल प्रबंधन (ईएसएम) की अनुमजत िी िा सकती ह।ै

(10) िवै जचदकत्सा अपजिि.- िैव जचदकत्सा अपजिि का प्रबधं न इस प्रकार दकर्ा िाएगा; (क) पाररजस्ट्थजतकी संवेिी िोन म ें िैव जचदकत्सा अपजिि का जनपटान भारत सरकार के पर्ाावरण, वन और िलवार् ु पररवतान मंत्रालर् द्वारा समर्-समर् पर संिोजधत अजधसूचना सं. सा.का.जन 343 (अ), तारीख 28 माचा, 2016, के अधीन प्रकाजित िैव-जचदकत्सा अपजिि प्रबंधन जनर्म, 2016 के अनसु ार दकर्ा िाएगा। (ख) पाररजस्ट्थजतकी संवेिी िोन में जचजन्हत प्रौद्योजगदकर्ों का प्रर्ोग करते हुए वतामान जनर्मों और जवजनर्मों के अनुरूप िैव-जचदकत्सा अपजिि को सुरजक्षत और पर्ाावरण अनकु ूल प्रबंधन (ईएसएम) की अनमु जत िी िाएगी।

(11) प्लाजस्ट्टक अपजिि का प्रबधं न - पाररजस्ट्थजतकी संवेिी िोन में प्लाजस्ट्टक अपजिि का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा समर्-समर् पर र्था संिोजधत अजधसचू ना सं. सा.का.जन 340(अ), तारीख 18 माचा, 2016 के अधीन प्रकाजित प्लाजस्ट्टक अपजिि प्रबंधन जनर्म, 2016 के उपबधं ों के अनुसार दकर्ा िाएगा।[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 9

(12) जनमाणा और जवध्वसं अपजिि का प्रबधं न - पाररजस्ट्थजतकी संवेिी िोन में जनमााण और जवध्वंस अपजिि का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मत्रं ालर् द्वारा समर्-समर् पर र्था संिोजधत अजधसूचना स.ं सा.का.जन 317(अ), तारीख 29 माचा, 2016 के अधीन प्रकाजित जनमााण और जवध्वंस अपजिि प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(13) ई–अपजिि - पाररजस्ट्थजतकी संवेिी िोन में ई–अपजिि का प्रबंधन, भारत सरकार के पर्ाावरण, वन और िलवार्ु पररवतान मंत्रालर् द्वारा प्रकाजित समर्-समर् पर र्था संिोजधत ई–अपजिि प्रबंधन जनर्म, 2016 के उपबंधों के अनुसार दकर्ा िाएगा।

(14) सडक-र्ातार्ात - सडक-र्ातार्ात को पर्ाावास अनुकूल तरीके से जवजनर्जमत दकर्ा िाएगा और इस संबंध में आंचजलक महार्ोिना में जविेर् उपबंध सजममजलत दकए िाएंग।े आंचजलक महार्ोिना के तैर्ार होन े और राज्र् सरकार के सक्षम प्राजधकारी स े अनुमोदित होन े तक, जनगरानी सजमजत प्रासंजगक अजधजनर्मों और उनके अधीन बनाए गए जनर्मों एव ं जवजनर्मों के अनुसार सडक-र्ातार्ात के अनुपालन की जनगरानी करेगी।

(15) वाहन िजनत प्रिर्ू ण. – वाहन प्रिर्ू ण का जनवारण और जनर्ंत्रण लाग ू कानूनों के अनुसार दकर्ा िाएगा और स्ट्वच्ि ईंधन िैस ेसंपीजडत प्राकृजतक गसै , तरलीकृत पेरोजलर्म गैस आदि के उपर्ोग के जलए प्रर्ास दकए िाएंगे।

(16) औद्योजगक ईकाइर्ा ं - (क) रािपत्र म ें इस अजधसूचना के प्रकािन पर र्ा उसके पिात पाररजस्ट्थजतकी संवेिी िोन के भीतर दकसी नए प्रिर्ू णकारी उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी। (ख) केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोड ा द्वारा फरवरी, 2025 म ें िारी जसद्धान्तों में उद्योगों के वगीकरण (समर्-समर् पर दकए गए संिोधनों सजहत) के अनुसार, िब तक दक अजधसूचना में इस प्रकार जवजनर्िाि न हो, पाररजस्ट्थजतकी संवेिी िोन के भीतर केवल गरै -प्रिर्ू णकारी उद्योगों को अनुमजत िी िाएगी । इसके अजतररि, गरै प्रिर्ू णकारी कुटीर उद्योगों को बढ़ावा दिर्ा िाएगा।

(17) पहाडी ढलानों का सरं क्षण - पहाडी ढलानों का संरक्षण जनम्नानसु ार दकर्ा िाएगा :- (क) आंचजलक महार्ोिना म ें पहाडी ढलानों के उन क्षेत्रों को ििाार्ा िाएगा जिनम ें दकसी भी जनमाणा की अनुमजत नहीं होगी; (ख) जिन ढलानों र्ा जवद्यमान खडी पहाडी ढलानों म ें अत्र्जधक भू-क्षरण होता ह ै उनम ें दकसी भी जनमााण की अनुमजत नहीं होगी।

4. पाररजस्ट्थजतकी सवं िे ी िोन म ेंप्रजतजर्द्ध र्ा जवजनर्जमत दकए िान ेवाल ेदक्रर्ाकलापों की सचू ी.- नागरहोल टाइगर ररजवा के पाररजस्ट्थजतकी-संवेिी िोन में सभी दक्रर्ाकलापों पर्ाावरण (संरक्षण) अजधजनर्म, 1986 (1986 का 29), वन्र्िीव (संरक्षण) अजधजनर्म, 1972 (1972 का 53), वन (संरक्षण) अजधजनर्म, 1980 (1980 का

69), भारतीर् वन अजधजनर्म, 1927 (16 का 1927), और अन्र् लागू जवजधर्ों, जिनमें तटीर् जवजनर्मन क्षेत्र (सीआरजडे ), 2011, पर्ाावरण समाघात जनधारा ण (ईआईए) अजधसूचना, 2006 और राज्र् में प्रचजलत अन्र् अजधजनर्म और जनर्म सजममजलत ह,ैं के उपबंधों द्वारा िाजसत होंगी। पाररजस्ट्थजतकी-संवेिी िोन के अधीन आने वाले वन क्षेत्र पर मौिूिा वन जवजधर्ों और उनम ेंदकए गए संिोधनों के अधीन ही िासन लाग ूरहगे ा। इसमें कनाटा क वन अजधजनर्म, 1963, कनााटक वन जनर्म, 1969 और उनमें दकए गए संिोधन िाजमल ह।ैं इस अनुच्िेि के उपबंधों के अधीन रहते हुए, पाररजस्ट्थजतकी-संवेिी िोन म ेंहोने वाली दक्रर्ाकलापों को नीच ेिी गई सारणी में जवजनर्िाि रीजत से जवजनर्जमत दकर्ा िाएगा, अथाात:् -10 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी क्रम स.ं दक्रर्ाकलाप रटप्पजणर्ा ं

1. वाजणजज्र्क खनन, रेत खनन और (क) पाररजस्ट्थजतकी संवेिी िोन के भीतर घरों के जनमााण र्ा मरममत अपघर्णा इकाइर्ा ं । के जलए जमट्टी की खुिाई सजहत वास्ट्तजवक स्ट्थानीर् जनवाजसर्ों की घरेल ू आवश्र्कताओं को परू ा करन े के जसवार् सभी नए और जवद्यमान (लघु और प्रमुख खजनि), रेत उत्खनन और उनके तोडन े की इकाइर्ों को तत्काल प्रभाव स े प्रजतबंजधत दकर्ा िाता ह।ै (ख) खनन कार्ा माननीर् उच्चतम न्र्ार्ालर् के तारीख 4 अगस्ट्त, 2006 के आििे (टी.एन. गोिावमान जथरुमलु पाि बनाम भारत सघं के मामले में, ररट र्ाजचका संख्र्ा 202/1995) और तारीख 21 अप्रैल, 2014 के आिेि (गोवा फाउंडेिन बनाम भारत संघ के मामले म,ें लोकजहत र्ाजचका संख्र्ा 435/2012); और आईए संख्र्ा 1000 वर्ा 2003 तारीख 03 िून, 2022। आईए संख्र्ा 131377 वर्ा 2022, तारीख 26 अप्रलै , 2023 और 28 अप्रैल, 2023 के जनणार् और आईए संख्र्ा 162023, 162034, 162154 और 162155 वर् ा 2025 म ें तारीख 23 िलु ाई 2025 के बाि के जनणार् र्ा खनन के संबंध म ें कोई और आिेि के अनुसार दकए िाएंगे।

2. प्रिर्ू ण (िल, वार्ु, मृिा, ध्वजन, पाररजस्ट्थजतकी-संवेिी िोन में कोई नर्ा उद्योग लगान े और वतामान प्रिर्ू णकारी उद्योगों का जवस्ट्तार करने की अनज्ञु ा नहीं होगी। केंद्रीर् आदि) उत्पन्न करन े वाल े उद्योगों की प्रिर्ू ण जनर्ंत्रण बोडा द्वारा फरवरी 2025 म ें िारी और समर्-समर् स्ट्थापना । पर संिोजधत दििाजनिेिों म ें उद्योगों के वगीकरण के अनुसार, पाररजस्ट्थजतकी-संवेिी िोन म ें केवल प्रिर्ू ण रजहत उद्योगों को ही अनुमजत िी िाएगी, िब तक दक इस अजधसूचना म ें अन्र्था जवजनर्िाि न दकर्ा गर्ा हो। इसके अजतररि गरै -प्रिर्ू णकारी कुटीर उद्यागों र्ा कृजर्-आधाररत उद्योगों का संवधान दकर्ा िाएगा।

3. प्रमुख िलजवद्युत पररर्ोिना की प्रजतबंजधत। स्ट्थापना।

4. दकसी पररसंकटमर् पिाथा का प्रर्ोग प्रजतबंजधत । र्ा उत्पािन र्ा प्रस्ट्संकरण ।

5. प्राकृजतक िल जनकार्ों र्ा भूजम क्षत्रे प्रजतबंजधत । म ें अनपु चाररत अपजििों का जनवाहन।

6. िोस अपजिि जनपटान स्ट्थल और पाररजस्ट्थजतकी-संवेिी िोन म ें िोस कचरे के जनपटान के जलए कोई िोस व िैव जचदकत्सा अपजिि के नई िगह र्ा कचरे के उपचार/प्रसंस्ट्करण की सुजवधा बनाने की जलए सामूजहक भस्ट्मीकरण सुजवधा अनुमजत नहीं ह।ै इसके अजतररि, औद्योजगक प्रदक्रर्ाओं और की स्ट्थापना। अस्ट्पतालों इत्र्ादि स े जनकलन े वाले दकसी भी तरह के िोस कचरे के उपचार के जलए सामूजहक र्ा अलग-अलग भस्ट्मीकरण (कचरा[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 11 िलाने की मिीन) लगान े की अनुमजत नहीं होगी।

7. नई आरा जमलों की स्ट्थापना। पाररजस्ट्थजतकी संवेिी िोन के भीतर नई र्ा वतामान आरा जमलों की जवस्ट्तार की अनुमजत नहीं होगी।

8. ईंट भट्टों की स्ट्थापना। प्रजतबंजधत ।

9. िलावन लकडी का वाजणजज्र्क प्रजतबंजधत । उपर्ोग।

10. काष्ठ आधाररत नर्ा उद्योग पाररजस्ट्थजतकी संवेिी िोन के भीतर काष्ठ आधाररत दकसी भी नए उद्योग की स्ट्थापना की अनुमजत नहीं िी िाएगी।

11. पर्ाटन स े िुडी गजतजवजधर्ां करना, लाग ूजवजधर्ों के अधीन प्रजतबंजधत । िैसे दक दकसी भी जवमान र्ा गम ा – हवा वाले गुब्बारे स े राष्ट्रीर् उद्यान के इलाके के ऊपर से उडान भरना। ख. जवजनर्जमत दक्रर्ाकलाप

12. वाजणजज्र्क होटलों और ररसॉससा की पाररजस्ट्थजतकी पर्ाटन दक्रर्ाकलापों के जलए लघ ु अस्ट्थार्ी स्ट्थापना। संरचनाओं के जनमाणा के जसवार्, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनम ें िो भी अजधक जनकट हो, नए वाजणजज्र्क होटलों और ररसोटों को स्ट्थापना अनुमजत नहीं िी िाएगी:

परंतु, संरजक्षत क्षत्रे की सीमा स े एक दकलोमीटर बाहर र्ा पाररजस्ट्थजतकी संवेिी िोन के जवस्ट्तार तक, इनम ें िो भी अजधक जनकट हो, सभी नए पर्ाटन दक्रर्ाकलाप र्ा वतामान दक्रर्ाकलापों का जवस्ट्तार पर्ाटन महार्ोिना और र्था लागू मागिा िाक जसद्धांतों के अनरूु प होगा ।

13. जनमााण दक्रर्ाकलाप। (क) संरजक्षत क्षेत्र की सीमा स े एक दकलोमीटर के भीतर र्ा पाररजस्ट्थजतकी-संवेिी िोन के जवस्ट्तार तक, िो भी जनकट हो, दकसी भी प्रकार के नए वाजणजज्र्क संजनमााण की अनुमजत नहीं िी िाएगी:

परंत,ु स्ट्थानीर् जनवाजसर्ों की आवासीर् आवश्र्कताओं को पूरा करने के जलए भवन उपजवजधर्ों के अनुसार पैराग्राफ 3 के उप- पैराग्राफ (1) म ें सूचीबद्ध दक्रर्ाकलापों सजहत स्ट्थानीर् लोगों को उनके उपर्ोग के जलए अपनी भूजम पर संजनमााण करन े की अनुमजत िी िाएगी:

i. पर्ाावरण के अनुकूल पर्ाटन दक्रर्ाकलापों के जलए पर्ाटकों के अस्ट्थार्ी जनवास हते ु पर्ाावरण के अनुकूल कॉटेि, िैसे दक तंबू, लकडी के घर आदि। ii. मौिूिा सडकों का चौडीकरण और सुिढ़ृ ीकरण; iii. प्रिर्ू ण न फैलान े वाले लघ ुउद्योग;

iv. बुजनर्ािी ढांचे और नागररक सुजवधाओं का जनमााण और12 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] नवीनीकरण; v. ग्राम जिल्पकारों सजहत कुटीर उद्योग; गृहवास सजहत पर्ाावरण- अनुकूल पर्ाटन का संवधान करने वाली सुजवधा भंडार और स्ट्थानीर् सुजवधाएं; और vi. इस अजधसूचना म ेंसूचीबद्ध दक्रर्ाकलापों का संवधान करना । परंत,ु गरै प्रिर्ू णकारी लघ ु उद्योगों स े संबंजधत संजनमााण दक्रर्ाकलाप लागू जनर्मों और जवजनर्मों र्दि कोई हो, के अनुसार सक्षम प्राजधकारी की पूव ा अनुमजत स े जवजनर्जमत दकए िाएंग े और व े न्र्ूनतम होंगे। (ग) एक दकलो मीटर के परे र्े आंचजलक महार्ोिना के अनुसार जवजनर्जमत होंगे।

14. गैर प्रिर्ू णकारी लघ ु उद्योग। फरवरी, 2026 म ें केन्द्रीर् प्रिर्ू ण जनर्ंत्रण बोडा द्वारा िारी समर्- समर् पर र्था संिोजधत उद्योगों के वगीकरण के अनुसार गरै - प्रिर्ू णकारी उद्योग और अपररसंकटमर्, लघ ु और सेवा उद्योग, कृजर्, पुष्प कृजर्, उद्यान कृजर् र्ा पाररजस्ट्थजतकी संवेिी िोन की अपनी सामग्री स े उत्पािों को उत्पन्न करन े वाल े कृजर् आधाररत उद्योग की अनुमजत सक्षम प्राजधकारी द्वारा िी िाएगी।

15. वृक्षों की कटाई । (क) राज्र् सरकार म ें सक्षम प्राजधकारी की पूव ा अनुमजत के जबना वन र्ा सरकारी र्ा रािस्ट्व र्ा जनिी भूजम पर वृक्षों की कटाई नहीं की िाएगी। (ख) वृक्षों की कटाई संबंजधत केंद्रीर् र्ा राज्र् के अजधजनर्म र्ा उसके अधीन बनाए गए जनर्मों के उपबंधों के अनुसार जवजनर्जमत की िाएगी।

16. वन उत्पािों और गैर काष्ठ वन अनुसूजचत िनिाजत और अन्र् पारंपररक वन जनवासी [वन उत्पािों (एनटीएफपी) का सग्रं हण । अजधकारों की मान्र्ता] अजधजनर्म, 2006 के अनुसार जवजनर्जमत।

17. जवद्युत और संचार टॉवर लगान,े लाग ू जवजधर्ों के अधीन जवजनर्जमत होगा (भूजमगत केबल जबिान े तार-जबिान े तथा अन्र् बुजनर्ािी को बढ़ावा दिर्ा िाएगा)। ढांच े की व्यवस्ट्था ।

18. नागररक सुजवधाओं सजहत बुजनर्ािी लागू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागिा िाक ढांचा। जसद्धांतों के अनुसार िमन उपार्ों के साथ दकर्ा िाएगा।

19. वतामान सडकों को चौडा करना, उन्ह ें लागू जवजधर्ों, जनर्मों और जवजनर्मों तथा उपलब्ध मागिा िाक मिबूत बनाना और नई सडकें जसद्धांतों के अनुसार िमन उपार्ों के साथ दकर्ा िाएगा। बनाना।

23. स्ट्थानीर् समुिार्ों द्वारा चल रही स्ट्थानीर् लोगों के उपर्ोग के जलए लागू जवजधर्ों के अनुसार कृजर् और बागवानी प्रथाओं के साथ जवजनर्जमत। िग्ु धिाला, पिुपालन, िल कृजर् और मत् स्ट्र् पालन ।

6.सिं भ ा की ित.ें- (1) जनगरानी सजमजत इस अजधसूचना के उपबंधों के अनुपालन की जनगरानी करेगी।

(2) जनगरानी सजमजत का कार्का ाल तीन (3) वर् ा का होगा र्ा राज्र् सरकार द्वारा नई सजमजत के पुनगािन तक का होगा और उसके बाि राज्र् सरकार द्वारा जनगरानी सजमजत का गिन दकर्ा िाएगा।

(3)उन दक्रर्ाकलापों की, िो भारत सरकार के तत्कालीन पर्ाावरण और वन मंत्रालर् की अजधसूचना संख्र्ा का.आ. 1553 (अ), तारीख 14 जसतंबर, 2006 की अनुसूची म े सजममजलत ह ै और िो पाररजस्ट्थजतकी संवेिी िोन में आते हैं, जसवार् इसके पैराग्राफ 4 के अधीन सारणी में र्था जवजनर्िाि प्रजतजर्द्ध दक्रर्ाकलापों के जनगरानी सजमजत द्वारा वास्ट्तजवक जवजनर्िाि स्ट्थलीर् ििाओं के आधार पर संवीक्षा की िाएगी और उि अजधसूचना के उपबंधों के अधीन पूव ा पर्ाावरण अनापजत्त के जलए केन्द्रीर् सरकार के पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् र्ा र्थाजस्ट्थजत, राज्र् पर्ाावरण समाघात जनधाारण प्राजधकारी को जनर्िाि दकर्ा िाएगा।

(4) पूवावती पर्ाावरण और वन मंत्रालर् की तारीख 14 जसतमबर, 2006 की का.आ. 1533(अ), के माध्र्म स े प्राि सरकार की अजधसूचना के अधीन सजममजलत नहीं दकए गए और पाररजस्ट्थजतकी संवेिी िोन में आन े वाल े कार्ाकलापों की संवीक्षा जनगरानी सजमजत द्वारा स्ट्थल जवजिि पररजस्ट्थजतर्ों के आधार पर की िाएगी। जिसमें पैरा 4 के अधीन सारणी म ें सजममजलत और संबंजधत जवजनर्ामक प्राजधकरण को सौंप ेगए कार्ाकलाप सजममजलत नहीं ह।ै[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 15

(5) जनगरानी सजमजत के सिस्ट्र्-सजचव र्ा संबंजधत कलेक्टर र्ा संबंजधत उप वन सरं क्षक पर्ावा रण अजधजनर्म की धारा 19 के अधीन इस अजधसूचना के उपबंधों का उल्लघं न करन े वाल े दकसी भी व्यजि के जवरुद्ध जिकार्त फाइल करन े के जलए सक्षम होंगे।

(6) जनगरानी सजमजत मामला-िर मामला के आधार पर अपक्षे ाओं पर जनभार रहत े हुए समबद्ध जवभाग के प्रजतजनजध र्ा जविेर्ज्ञ, औद्योजगक सगं मों र्ा पणधाररर्ों के प्रजतजनजध को अपने जवचार-जवमिा म ेंसहार्त के जलए आमंजत्रत कर सकेगी।

(7) जनगरानी सजमजत म ें जवजनर्िाि जनििान पत्र प्रत्र्ेक वर् ा के 31 माचा तक की अवजध के अपने दक्रर्ाकलापों की वार्र्ाक कारावाई ररपोटा उस वर् ा के 30 िून तक राज्र् के मख्ु र् वन्र्िीव संरक्षक को अनुलग्नक –VI म ें दिए गए प्रोफॉमाा के अनुसार प्रस्ट्तुत करेगी।

(8) केन्द्रीर् सरकार का पर्ाावरण, वन और िलवार्ु पररवतना मंत्रालर् जनगरानी सजमजत को उसके कार्ा-कलापों के प्रभावी जनवाहन के जलए ऐसे जनििे ि ेसकेगा िो वह उजचत समझे।

7. अजतररक्त उपार्. - इस अजधसूचना के उपबंधों को प्रभाव िेन े के जलए केन्द्रीर् सरकार और राज्र् सरकार अजतररक्त उपार्, र्दि कोई हों, जवजनर्िाष् ट कर सकेंगी।

WHEREAS, the Nagarahole Tiger Reserve encompassing an area of 843.96 sq. km. is situated in Mysore district (Hunsur, Periyapatna and Heggadadevankote taluks) and Kodagu district (Ponnampete and Virajpet taluks) in the State of Karnataka. It lies between latitudes 11°50'N and 12°25'N and longitudes 75°54'E and 76°18’E. The area was first constituted as Nagarahole Wildlife Sanctuary in the year 1955, covering an area of 285 sq. km.

Subsequently, additional areas were included and final notification for an area of 643.39 sq. km. was issued in the year 1983 notifying the same as the Nagarahole National Park. In the year 2002, the National Park area was notified as an extension of the Bandipur Tiger Reserve landscape.

AND WHEREAS, the Nagarahole Tiger Reserve was also notified as Core/Critical Tiger Habitat (CTH) on 20th December, 2007. Further, an area of 562.41 sq. km. was notified as Buffer Zone of the Nagarahole Tiger Reserve on 14th August, 2012;

AND WHEREAS, the Nagarahole Tiger Reserve forms part of the Nilgiri Biosphere Reserve (~5500 sq. km.) and also forms an integral part of the Mysore Elephant Reserve. It supports very high density of Asian Elephants with significantly higher number of adult tuskers signifying its ecological importance;

AND WHEREAS, the Nagarahole Tiger Reserve is contiguous with Bandipur Tiger Reserve and Wayanad Wildlife Sanctuary in the State of Kerala making it one of the largest wildlife habitat landscapes in the country. The Tiger Reserve is also linked to Bramhagiri Wildlife Sanctuary through reserve forests in Kerala. This entire landscape is also home to a healthy viable population of wild Tigers;

AND WHEREAS, the Nagarahole Tiger Reserve also serves as a catchment of important perennial streams and tributaries of the Kaveri, Lakshmanathirtha and Kabini Rivers. The region is home to Jenu Kuruba, Betta Kuruba and Yerava forest dwelling Scheduled Tribes;

AND WHEREAS, the region has very high floral and faunal diversity. The major forests of Nagarahole National Park and Tiger Reserve can broadly be classified into Southern Tropical Semi-evergreen forests, occuring in patches along the western boundary with Kerala, Southern Tropical Moist deciduous forests, which are found in the reserve forests of Hatghat, Nalkeri, Arikeri and south-western parts of Kakankote and western part of Metikuppe, and Southern Tropical Dry deciduous forests, which are confined to the reserve forests of Metikuppe, Veeranahosahalli, Kachuvanahalli, and parts of Kakanakote;

AND WHEREAS, the vegetation of the region comprises of species of Shorea talura, Santalum album, Terminalia chebula, Anogeissus latifolia, Azadirachta indica, Chloroxylon swietenia, Acacia leucophloea, Acacia catechu, Stereospermum chelonoides, Zizyphus sps., Diospyros melnoxylon, Diospyros montana, etc. Lantana bushes cover large areas as under growth, including Phoenix acaulis at some places. Cassia tora, Cassia auriculata, Desmodium etc., also form the undergrowth. Acacia intsia is the common climber. Bamboos are generally absent.

Sandal occurs profusely in this type of forests;

AND WHEREAS, the diverse fauna of Nagarahole Tiger Reserve is due to its ecological variations from dry deciduous forests in the eastern regions of the National Park to tropical moist deciduous forests in the western parts of the National Park. The unique grassy swamps locally called ‘Hadlus’ provide forage for herbivores through the dry periods of summer. The elevation of the Tiger Reserve varies from 700 m to 960 m. AND WHEREAS, it is one of the high density tiger landscapes recognized by the Global Tiger Initiative for conservation of Tiger. It is also one of the richest wildlife areas noted for the intact assemblage of seven large ungulate species such as Chital, Sambar, Chowsingha, Gaur, Muntjac, Wild Pig and Elephant;

AND WHEREAS, other commonly encountered mammals include Tiger, Leopard, Jungle cat, Leopard cat, Fishing cat, Rusty spotted cat, Small Indian civet, Common palm civet, Common mongoose, Striped necked mongoose, Brown mongoose, Ruddy mongoose, Jackal Dhole or Indian wild dog, Sloth bear, Common otter, Flying fox, Indian giant squirrel, Common giant flying squirrel, Three Stripped palm squirrel, Indian porcupine, Indian hare, Elephant, Gaur, Four horned antelope, Sambar, Chital, Barking deer, Mouse deer, Wild boar, Indian pangolin, etc. also inhabit the Tiger Reserve.

AND WHEREAS, 330 species of avifauna are recorded in the Tiger Reserve such as Malabar Pied Hornbill, Malabar Trogon, Green Imperial Pigeon, Peafowl, Crested Serpent Eagle, Osprey, Grey Jungle Fowl, Wooly Necked Stork, King Vulture, etc. along with critically endangered Long-billed and White- Rumped Vultures;

AND WHEREAS, the important butterfly species include the Tree Nymph, Blue Tiger, Common Tiger, Plain Tiger, Common Indian Crow, Common Four-ring, Common Evening-Brown, Tawny Rajah, Gray Count, Baronet, Colour Sergeant, Common Sergeant, Common Sailer, Great Egg fly, Danaid Egg fly, Grey Pansy, Chocolate Pansy, Yellow Pansy,Blue Pansy, Lemon Pansy, Peacock Pansy, Small Leopard, Angled Caster, Pale Grass Blue, Gram Blue, Common Bird-wing, Crimson Rose, Common Rose, Common Mime, Blue Mormon, Red Helen, Common Mormon, Lime Butterfly, Malabar-banded Swallow-tail, Spectacle Sword-tail, Tailed Jay, Common Jezbel, Indian Cabbage White, Great Orange Tip, Common Emigrant, Common Grass Yellow, etc.;

AND WHEREAS, the important reptile species include Marsh Crocodile, Indian Pond Terrapin, Monitor lizard, Chameleon, Spectacled Cobra, Russell’s Viper, Common Krait, Indian Rock Python and a host of other snakes, lizards and turtles species.

AND WHEREAS, as per the International Union for Conservation of Nature and Natural Resources (IUCN) some of the species, which fall under category of Critically Endangered, Endangered, Vulnerable, Near Threatened are found in Nagarahoole Tiger Reserve includes Mammals such as, Tiger (Panthera tigris), Common leopard (Panthera pardus), Rusty spotted cat (Prionailurus rubiginosus), Sloth Bear (Melursus ursinus), Asian Elephant (Elephas maximus), Gaur (Bos gaurus), Sambar (Cervus unicolor), Indian Pangolin (Manis crassicaudata), Leopard Cat (Felis bengalensis), Spotted Deer (Axis axis), Jungle Cat (Felis chaus), Common Mongoose (Herpestes edwardsi), Stripe necked Mongoose (Herpes tesvitticollis), Jackal (Canis aureus), Wild Dog (Cuon alpinus), Indian Porcupine (Hystrix indica), Barking Deer (Muntiacus muntjak), Mouse Deer (Tragulus meminna), Wild Pig (Sus scrofa), Pangolin (Manis crassicaudata), Flying Fox (Ptreopus molarus), Small Indian Civet (Viverricula indica) etc.;

Birds such as Grey fronted Green Pigeon (Tretonpom padora), Spotted dove (Streptopelia chinensis), Black winged Stilt (Himantopus himantopus), Red wattled Lapwing (Vanellus malabaricus), Little ringed Plover (Charadrius dubius), Green shank (Tringao chropus), Wood Sandpiper (Tringa glareola), Pintail Snipe (Gallina gostenura), Woodcock (Scolopax rusticola), Indian Lorikeet (Loriculus vernalis), Blue winged Parakeet (Psittacula columoides), Koel (Eudynamys scolopacea), Crow pheasant (Centropus sinensis) etc.; Reptiles such as Crocodile (Crocodylus palustris), Spectacled cobra (Naja naja), Rock Python (Python molarus), Russels Viper (Viper arussllii), etc.; Floral species such as Gulganji (Abrus precatorious), Banni (Acacia ferruginea), Seege (Acacia concinna), Bilvapatre (Aegle marmelos), Bage (Albizzia lebbeck), Chigare (Albizzia amara), Seethaphala (Annona squamosal), Kadu-nimbe (Aristolocia indica), Shathavari (Asparagus recemosus), Jagalaganti (Diosporus Montana), Bela (Limonia apidissima), Navilaadi (Witex altissima), Tapasi (Olina intrigfolia), Edathala (Vachelli anilotica) etc.

AND WHEREAS, it is necessary to conserve and protect the area, surrounding the boundaries of Nagarahole Tiger Reserve which are specified in paragraph 1 as Eco-sensitive Zone from ecological, environmental and biodiversity point of view and to prohibit industries or class of industries and their operations and processes in the said Eco-sensitive Zone;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) and clauses (v) and (xiv) of sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (Act 29 of 1986) (hereafter in this notification referred to as the Environment Act) read with sub-rule (3) of rule 5 of the Environment

(Protection) Rules, 1986, the Central Government hereby notifies an area to an extent varying of 0 (zero) to 7.5 km around the boundary of Nagarahole Tiger Reserve in the State of Karnataka as Eco-sensitive Zone (hereafter in this

notification referred to as the Eco-sensitive Zone) details of which are as under, namely:-

1. Extent and Boundaries of the Eco-Sensitive Zone of Nagarahole Tiger Reserve-

(1) The Eco-sensitive Zone shall be to an extent of 0 (zero) to 7.5 km around the boundary of Nagarahole Tiger Reserve and the area of the Eco-sensitive zone is 573.959 sq. km. The extent of Eco-sensitive Zone at various

➢ The Eco-sensitive Zone covers 101 villages (entire/partial) with a geographical area of 271.61 sq. km. ➢ The notified Reserve Forest Areas under the Nagarahole Tiger Reserve Eco-Sensitive Zone has a geographical area of 302.36 sq. km.

➢ The distance from the adjoining Reserve Forest Areas situated at the northern directions is 23.6 km from the boundary of the Nagarahole Tiger Reserve.

(2) The boundary description of Nagarahole Tiger Reserve and its Eco-sensitive Zone is appended as Annexure – IA and Annexure – IB.

(3) The map of Nagarahole Tiger Reserve and its Eco-sensitive Zone is appended as Annexure - II.

(4) List of prominent geo-coordinates of the boundary of Nagarahole Tiger Reserve and Eco-Sensitive Zone is appended as Annexure-IIIA & Annexure-IIIB.

(5) The list of villages falling in the proposed Eco-sensitive zone is appended as Annexure-IV.

(6) The list of the adjoining Reserve Forest Areas included in the Eco-sensitive Zone of Nagarahole Tiger Reserve is appended as Annexure-V.

2. Zonal Master Plan for the Eco-Sensitive Zone of Nagarahole Tiger Reserve-

(1) The State Government shall, for the purpose of the Eco-sensitive Zone prepare, a Zonal Master Plan, within a period of two years from the date of publication of final notification in the Official Gazette, in consultation with local people and adhering to the stipulations given in this notification for approval of Competent Authority in the State Government.

(2) The Zonal Master Plan for the Eco-sensitive Zone shall be prepared by the State Government in such manner as is specified in this notification and also in consonance with the relevant Central and State laws and the guidelines issued by the Central Government, if any.

(3) The Zonal Master Plan shall be prepared in consultation with the following State Departments, for

integrating the ecological and environmental considerations into the said plan:-

(i) Environment;

(ii) Forest and Wildlife;

(iii) Agriculture;

(iv) Revenue;

(v) Urban Development;

(vi) Tourism;

(vii) Rural Development;

(viii) Irrigation and Flood Control;

(ix) Municipal;

(x) Panchayati Raj;

(xi) Public Works Department.

(4) The Zonal Master Plan shall not impose any restriction on the approved existing land use, infrastructure and activities, unless so specified in this notification and the Zonal Master Plan shall factor in improvement of all infrastructure and activities to be more efficient and eco-friendly.

(5) The Zonal Master Plan shall provide for restoration of denuded areas, conservation of existing water bodies, management of catchment areas, watershed management, groundwater management, soil and moisture conservation, needs of local community and such other aspects of the ecology and environment that need attention.[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 35

(6) The Zonal Master Plan shall demarcate all the existing worshipping places, villages and urban settlements, types and kinds of forests, agricultural areas, fertile lands, green area, such as, parks and like places, horticultural areas, orchards, lakes and other water bodies and also with supporting maps.

(7) The Zonal Master Plan shall regulate development in the Eco-sensitive Zone and adhere to prohibited, regulated activities listed in Table in paragraph 4 and also ensure and promote eco-friendly development for livelihood security of local communities.

(8) The Zonal Master Plan shall be co-terminus with the Regional Development Plan.

(9) The Zonal Master Plan so approved shall be the reference document for the Monitoring Committee for carrying out its functions of monitoring in accordance with the provisions of this notification.

3. Measures to be taken by the State Government.- The State Government shall take the following measures for giving effect to the provisions of this notification, namely:-

1. Land use. - (a) Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Eco-sensitive Zone shall not be used or converted into areas for major commercial or major residential complex or industrial activities.

Provided that the conversion of agricultural and other lands, for the purpose other than that specified at part

(a), within the Eco-sensitive Zone may be permitted on the recommendation of the Monitoring Committee, and with the prior approval of the competent authority under the relevant State laws and other rules and regulations of Central or State Government as applicable and vide provisions of this notification, to meet the residential

needs of the local residents such as: i. Widening and strengthening of existing roads and construction of new roads; ii. Construction and renovation of infrastructure and civic amenities; iii. Small scale industries not causing pollution;

iv. Cottage industries including village industries; convenience stores and local amenities supporting eco- tourism including home stay; and v. Promoted activities and given under para 4

Provided further that no use of tribal land shall be permitted for commercial and industrial development activities without the prior approval of the competent authority under the relevant State laws and other rules and regulations of State Government and without compliance of the provisions of article 244 of the Constitution or the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (2 of 2007):

Provided also that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by the State Government, after obtaining the views of Monitoring Committee, once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate

Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph.

(b) Efforts shall be made to reforest the unused or unproductive agricultural areas with afforestation and habitat restoration activities.

2. Natural water bodies. - The catchment areas of all natural springs/rivers/ channels shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan.

3. Tourism/Eco-tourism. – (a) All new Eco-tourism activities or expansion of existing tourism activities within the Eco- sensitive Zone shall be as per the Tourism Master Plan for the Eco-sensitive Zone;

(b) The Tourism Master Plan shall be prepared by Department of Tourism in consultation with State Departments of Environment and Forests;

(c) The Tourism Master Plan shall form a component of the Zonal Master Plan;

(d) The Tourism Master Plan shall be drawn based on the study of carrying capacity of the Eco- sensitive Zone;

(e) The activities of Eco-tourism shall be regulated as under, namely:- i. No new construction of hotels and resorts shall be allowed within 1 km from the boundary of the Tiger Reserve or up to the extent of the Eco-sensitive Zone whichever is nearer:

Provided that beyond the distance of 1 km from the boundary of the Tiger Reserve till the extent of the Eco-sensitive Zone, the establishment of new hotels and resorts shall be allowed only in pre-defined and designated areas for Eco-tourism facilities as per Tourism Master Plan.36 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] ii. all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate Change and the Eco-tourism guidelines issued by National Tiger Conservation Authority (as amended from time to time) with emphasis on eco-tourism.

iii. until the zonal master plan is approved, development for tourism and expansion of existing tourism activities in the Eco-Sensitive Zone areas falling outside forest lands shall be permitted by the concerned regulatory authorities based on the actual site-specific scrutiny and recommendation of the monitoring committee and no new hotels/ resorts or commercial establishment construction is permitted within Eco-Sensitive Zone Area.

4. Natural Heritage. - All sites of valuable natural heritage in the Eco-sensitive Zone, such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and a heritage conservation plan shall be drawn up for their preservation and conservation as a part of the Zonal Master Plan.

5. Man-made heritage sites. - Buildings, structures, artifacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Eco-sensitive Zone and heritage conservation plan for their conservation shall be prepared as part Zonal Master Plan.

6. Noise pollution. - Prevention and Control of noise pollution in the Eco-sensitive Zone shall be complied with in accordance with Noise Pollution (Regulation and Control) Rules, 2000 under the Environment (Protection) Act, 1986.

7. Air pollution. - Prevention and control of air pollution in the Eco-sensitive Zone shall be complied with in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981) and the rules made thereunder.

8. Discharge of effluents. - Discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the provisions of the General Standards for Discharge of Environmental Pollutants covered under the Environmental (Protection) Act, 1986 and the rules made thereunder or standards stipulated by State Government, whichever is more stringent.

9. Solid wastes. - Disposal and Management of solid wastes shall be as under:- a. the solid waste disposal and management in Eco-sensitive Zone shall be carried out in accordance with the Solid Waste Management Rules, 2016 and published by the Government of India in the Ministry of Environment, Forests and Climate Change vide notification number S.O. 1357 (E), dated the 8th April, 2016 and as amended from time to time; the inorganic material may be disposed in an environmental acceptable manner at site identified outside the Eco-sensitive Zone;

b. No burning or incineration of solid wastes and establishment of landfills shall be permitted in the Eco-sensitive Zone.

10. Bio-medical waste. - Bio medical waste management shall be as under:- a. The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out in accordance with the Bio-Medical Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide Notification number GSR 343 (E), dated the 28th March, 2016; as amended from time to time.

b. No common treatment facility or incineration shall be permitted within the Eco-sensitive Zone.

11. Plastic Waste Management. - The Plastic Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Plastic Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 340(E), dated the 18th March, 2016, as amended from time to time.

12. Construction and Demolition Waste Management. - The Construction and Demolition Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the Construction and Demolition Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change vide notification number G.S.R. 317(E), dated the 29th March, 2016, as amended from time to time.

13. E-waste. - The E- Waste Management in the Eco-sensitive Zone shall be carried out as per the provisions of the E-Waste Management Rules, 2016 published by the Government of India in the Ministry of Environment, Forest and Climate Change and as amended from time to time.[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 37

14. Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master plan is prepared and approved by the Competent Authority in the State Government, the Monitoring Committee shall monitor compliance of vehicular movement under the relevant Acts and the rules and regulations made there under.

15. Vehicular Pollution. - Prevention and control of Vehicular Pollution shall be complied with in accordance with applicable laws and efforts to be made for use of cleaner fuel for example CNG, LPG, etc.

16. Industrial Units. – a. On or after the publication of this notification in the Official Gazette, no new polluting industries shall be allowed to be set up within the Eco-sensitive Zone. b. Only non-polluting industries shall be allowed within Eco-sensitive Zone as per classification of Industries in the Guidelines issued by Central Pollution Control Board in January 2025, as amended from time to time, unless so specified in this notification. In addition, non-polluting cottage industries shall be promoted.

17. Protection of Hill Slopes. - The protection of hill slopes shall be as under:- a. The Zonal Master Plan shall indicate areas on hill slopes where no construction shall be permitted. b. No construction on existing steep hill slopes or slopes with a high degree of erosion shall be permitted.

4. List of activities Prohibited, or to be regulated within the Eco-sensitive Zone.- All activities in the Eco-Sensitive Zone of Nagarahole Tiger Reserve shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986), Wildlife (Protection) Act, 1972 (53 of

1972), Forest Act, 1927 (16 of 1927), Forest (Conservation) Act, 1980 (69 of 1980) and other applicable laws including the Coastal Regulation Zone (CRZ), 2011, Environmental Impact Assessment (EIA) Notification, 2006, and amendments made thereto and other Acts prevalent in the State. The forest area coming under the Eco-sensitive Zone will remain to be governed under existing forest laws and amendments made thereto. The Karnataka Forest Act, 1963, Karnataka Forest Rules, 1969 and amendments made thereto. Subject to the provisions of this paragraph, the activities in the Eco-sensitive Zone shall be regulated in manner specified in the Table below, namely:- Table Sl. No Activity Description A. Provided that the construction activity related to small scale industries not causing pollution shall be regulated at the minimum, with the prior permission from the Competent Authority as per applicable rules and regulations, if any.

vi. Beyond one kilometre, it shall be regulated as per the Zonal Master Plan.

5. Monitoring Committee of the Nagarahole Tiger Reserve Eco-sensitive Zone.- In exercise of the powers conferred by sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of

1986), the Central Government hereby constitutes a Committee to be called as the Monitoring Committee, to monitor and ensure the compliance with the provisions of this notification. The Monitoring Committee referred to in sub- paragraph (1) above, shall consist of the following members, namely:- Sl. No. Constituent of the Monitoring Committee Designation

Tiger Reserve, Hunsur

6. Terms of Reference.-

(1) The Monitoring committee shall monitor the compliance of the provisions of this notification.

(2) The tenure of the Monitoring committee is for three (3) years or till the re- constitution of the new Committee by the State Government and subsequently the Monitoring Committee would be constituted by the State Government.

(3) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the Central Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances under the provisions of the said notification.

(4) The activities that are not covered in the Schedule to the notification of the Government of India in the erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 and are falling in the Eco-sensitive Zone, except for the prohibited activities as specified in the Table under paragraph 4 thereof, shall be scrutinized by the Monitoring Committee based on the actual site-specific conditions and referred to the concerned regulatory authorities.

(5) The Member Secretary of Monitoring Committee shall be competent to file complaints under

section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification.

(6) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis.

(7) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of every year or by 30th June of that year to the Chief Wildlife Warden in the state as per pro- forma given at Annexure VI.

(8) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions, as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. Additional Measures. - The Central Government and State Government may specify additional measures, if any, for giving effect to provisions of this notification.

8. Supreme Court, etc. order. - The provisions of this notification shall be subject to the orders, if any, passed, or to be passed, by the Hon’ble Supreme Court of India or the High Court or National Green Tribunal.

Annexure IA Boundary description of Nagarahole Tiger Reserve Direction Description Gonikoppa Hunsur Highway upto the eastern, boundary of Kachuvanahalli and continued along the eastern North boundary of Kachuvanahalli S.F. in south-east direction upto Lakshmanathirtha river and continue along with northen boundary of Veeranahosahalli S.F. upto Murkal Hunsur Road.

From the above said point the line continues along the eastern boundary of Veeranahosahalli S.F.

East Metikuppe S.F. and Kakanakote S.F. and touches Kabini Reservoir at Udhoor.

From Udboor the line continues along the Southern boundary of Kakanakote S.F. upto Bavali where it South touches the inter-state boundary between Karnataka and Kerala States.

From the above point the line continue along the inter-state boundary between Karnataka and Kerala States in northern direction, passes through Kymara upto the point where the western boundary of Nalkeri R.F.

West touches the said inter State Boundary. Then the line continues along the western boundary of Nalkeri R.F.

Hatghat R.F. and Arekere R.F. and joins the starting point at Gonikoppa Hunsur Road.42 THEGAZETTEOFINDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] Annexure IB Boundary description of the Eco-sensitive Zone of the Nagarahole Tiger Reserve Direction Description The line starts from right bank of Kaveri river at the Northwest corner of Lingapura village and runs along the Northern boundary of Lingapura Village, Doddaharave Forest upto the tri-junction bhand of Doddahosur, Doddaharave Forest and Aralikumari Village. Then the line passes along Jodukolli stream upto the tri-junction bhands of Kailasapura, Basavana eni and Doddaharave village. Then it runs along Northern, Eastern and Southern boundary respectively of Basavana Eni village upto tri- junction bhand of Doddaharave, Naviluru and Basavana Eni village. Then it runs Southwards along the Western boundary of Navalur village upto the tri junction bhand of Ayarabeedu, Lingapura and Naviluru Village; then it runs Eastwards on the Southern boundary of Naviluru Village; then it run Southwards through Ayarabeedu, Lingapura villages till it touches Northern Boundary of Anechowkur State Forest at Mutturu Village. Then it runs Northern and Eastern boundary of Anechowkur State Forest through Mutturu, Kaletimmanahalli, Sulagodu, Kogilawadi Lakshmipura and Habaturu and in southern Boundary of Abbalati till it joins the tri-junction point of Abalathi, Malangi and Anechowkur State Forest. Then the line runs on the Western and Northern boundary of Malangi and North touches the tri-junction bhand of Malangi, Chowkur, and Mummadikaval village; then the line runs in the South East direction on the Eastern boundary of Malangi and touches the tri-junction point of Malangi, Chowkur and Vuttenahalli. Then the line passes along the Northern boundary of the Uttenahalli and Panchavalli and touches the tri-junction point of Itagahalli, Panchavalli and Sathegala kaval. Then the line runs in Eastern boundary of Panchavalli till it touches the Northern boundary of Beerathammanahalli village; then line runs along northern boundary of Beerathammanahalli upto junction bhand of Beeratammanahalli, Karlakuppe and Hemmige where it meets Muddanahalli SF;

then it runs on the Northern and Eastern boundary of Muddanahalli Block SF till it touches the Northern Boundary of Hanagodu village; then it runs along the Northern boundary of Hanagodu, Hangodu Nala village till touches the tri-junction bandh of Hanagodu Nala, Hegganduru and Kiranguru village; then the line runs in South East direction on the Eastern boundary of Kiranguru village and Northern boundary of Madahalli and Haralahalli and Penjahalli kaval and touches a point on the Western boundary of Ummathuru Village.

Then the line passes on Eastern side of Penjahalli Kaval and meets the Eastern Boundary of Sollepura SF and Runs along Eastern Boundary of Sollepura SF till it touches meets gadi bhand of Bheemanahalli, Yelehundi Kaval and Musakere; then the line runs in South East and South West direction on the Eastern boundary of Yelehundi Kaval and touches the tri-junction bandh of Yelehundi, Paduvakote Kaval and Annur of H.D. Kote Taluk; then the line runs on the Eastern boundary of Annur and Nanjanayakanahalli and touches the tri-junction point of Yedethore, Paduvakote Kaval and Nanjanayakanahalli; then the line runs in Southern direction on the Eastern boundary of Nanjanayakanahalli and touches the tri-junction point of Nanjanayakanahalli, Bhoodhanur and Yedethore; then the line passes all along Northern and Eastern boundary of Bhoodhanur village and touches the junction bhand of Bhoodhanur village and Chakkodanahalli village; then the line runs all along the Eastern boundary of Chakkodanahalli and till it touches the gadi bhand of Chakkodanahalli village and Sonahalli village; then the line runs all along Eastern boundary of Sonahalli and meets the gadi bhand of Sonahalli village and Dasanapura village; then the line passes all along the Eastern boundary of Dasanapura and meets the gadi bhand of Dasanapura village and Akkadevanahalli village of H.D. Kote taluk; then the line runs in the same direction and East meets the gadi bhand of Akkadevanahalli village and Naganahalli village; then the line runs on the Eastern boundary of Naganahalli village and meets the junction bhand of Naganahalli village and Hirehalli village; then the line runs in South direction on Eastern boundary of Hirihalli village and meets the junction bhand of Hirehalli village and Antharasanthe village; then the line runs all along the North and Eastern sides of Antharasanthe village and touches the gadi bhand of Antharasanthe, Nooralakuppe and Antharasanthe Kaval. Then the line runs on the Northern and Eastern boundary of Antharasanthe Kaval and touches the tri-junction point of Antharasanthe Kaval, Machyari and Nooralakuppe. Then the line runs on the Northern and Eastern boundary of Machyari and touches the boundary of Kabini River. Then the line runs in the Southern direction all along Kabini River passing through the Eastern boundary of Hosaholalu and Sogehalli. Then the line runs in the western direction on the southern boundary of Sogehalli and then in the northern direction on the Western boundary of Sogehalli along the Kabini River. Then the line runs in the Northern direction on the North Western boundary of Badanekuppe and Honnurkuppe along the Kabini river. Then the line runs in the Western direction till it touches the North Eastern boundary of Ragalakuppe. Then the line runs in the Southern direction along the Kabini river passing through the Eastern boundaries of Ragalakuppe, Halemagge, N. Belathur and Nisana. The line then runs in the Western direction on the southern[भागII—खण् ड3(ii)] भारत का रािपत्र : असाधारण 43 boundary of Nisana along the Kabini river till it meets the North Eastern boundary of Gundathur village.

The line runs all along the Eastern, Southern and Western boundaries of Gundathur Vilage till it meets the South East bhand of Udaburu Village. Then the line runs in the Western direction all along Kabini river passing through the Southern boundary of Udboor village, Eastern and Southern boundary of South Thenekallu village, Southern boundaries of Machur Village, Golur Village, Hosur Village, Netkalhundi, Anemala Village, Chikkabyranakuppe village, Doddabyranakuppe village, Thimmanahosahally Village, Vadakinamala & Kadegadde Village and meets the interstate gadi bhand of Kakanakote State Forest of Karnataka and Malabar State Forest of Kerala State.

From the above point the line continues along the inter-state boundary between Karnataka and Kerala States in Northern direction, passes through Kymara upto the point where the Southern boundary of Nalkeri Reserve Forest at Balle Murkal inter-state boundary point; then the line runs all along the Southern boundary of Nalkeri Reserve Forest and then up to 1 Km. distance from the western boundary of Nagarahole Tiger Reserve along southern boundary of Kutta village; then the line runs in North West direction and North East direction at a distance of 1 Km. from the Western boundary of Nagarahole Tiger Reserve till the line touches the Southern boundary of Badaga village; then the line runs in North East and North West direction at a distance of 1 Km. from the Western boundary of Nagarahole
