L.-33004/99 सी.जी.-डी.एल.-अ.-25072024-255717 CG-DxLx-xEG-I2D5H0x7x2x0 24-255717 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (i) PART II—Section 3—Sub-section (i) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 408] नई ददल्ली, बुधिार, िुलाई 24, 2024/श्रािण 2, 1946 No. 408] NEW DELHI, WEDNESDAY, JULY 24, 2024/SHRAVANA 2, 1946 सचं ार मत्रं ालय (दरू सचं ार जिभाग) अजधसचू ना नई ददल् ली, 24 िुलाई, 2024 सा.का.जन. 447(अ)- — जनम्नजलजखत प्रारूप जनयम जिसे केंद्रीय सरकार दरू संचार अजधजनयम, 2023 (2023 का 44) की धारा 56 की उप-धारा (2) के खंड (यझ) के साथ पठित धारा 47 द्वारा प्रदत्त िजियों का प्रयोग करते हुए बनाने का प्रस्ट्ताि करती ह,ै को इससे प्रभाजित होने िाले सभी व्यजियों की सूचना के जलए एतदद्वारा प्रकाजित दकया िाता ह ै और एतद्द्वारा सूचना दी िाती ह ै दक उि प्रारूप जनयम पर उस तारीख से तीस ददन की अिजध की समाजि के पश्चात जिचार दकया िाएगा जिस तारीख से सरकारी रािपत्र म ें यथाप्रकाजित इस अजधसूचना की प्रजतया ं सिवसाधारण को उपलब्ध कराई िाती ह;ैं यदद कोई, आपजत्त अथिा सझु ाि हो, तो उसे संयिु सजचि (दरू संचार), दरू संचार जिभाग, संचार मंत्रालय, भारत सरकार, संचार भिन, 20, अिोक रोड, नई ददल्ली-110001 को भेिा िा सकता ह;ै केंद्रीय सरकार द्वारा उि अिजध की समाजि स े पूि व उि प्रारूप जनयम के संबंध में दकसी भी व्यजि स े प्राि आपजत्त अथिा सुझाि पर जिचार दकया िाएगा। 4557 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 1. सजं िि नाम और प्रारंभ (1) इन जनयमों को दरू संचार (एमेचर स्ट्टेिन प्रचालक) जनयम, 2024 कहा िाएगा। (2) य ेसरकारी रािपत्र म ेंप्रकािन की तारीख को प्रिृत्त होंगे। 2. पठरभाषाएं (1) इन जनयमों म,ें िब तक दक संदभव से अन्यथा अपेजित न हो, - (क) “अजधजनयम” से दरू संचार अजधजनयम, 2023 (2023 का 44) अजभप्रेत ह;ै (ख) “एमचे र रेजडयो उपकरण” से केंद्रीय सरकार द्वारा अजधसूजचत एमेचर स्ट्टेिन के प्रचालन के जलए आिश्यक रेजडयो उपकरण अजभप्रेत ह;ै (ग) “एमचे र सिे ाएं” से एमेचर यानी रेजडयो तकनीक में रुजच रखने िाले जिजधित रूप से अजधकृत व्यजि द्वारा केिल व्यजिगत उद्देश्य से और जबना दकसी आर्थवक जहत के, स्ट्ि-प्रजििण, अंतरसंचार और तकनीकी िांच के उद्दश्े य स े की िाने िाली रेजडयो संचार सेिाएं अजभप्रेत है; (घ) “एमचे र स्ट्टेिन” स ेएमेचर सेिाओं के जलए एमेचर द्वारा प्रचाजलत रेजडयो स्ट्टेिन अजभप्रेत है; (ङ) “एएसओसी” या “एमचे र स्ट्टेिन प्रचालक प्रमाण-पत्र” स े जनयम 3 के उप-जनयम (2) के तहत जनर्दवष्ट प्रमाण-पत्रों की दो श्रेजणयों नामतः एएसओसी (सामान्य) और एएसओसी (प्रजतबंजधत) म ें स े कोई एक अजभप्रेत ह ै और “एएसओसी धारक” से िह व्यजि जिसे जनयम 6 के उप-जनयम (1) के तहत ऐसा प्रमाण-पत्र प्रदान दकया गया ह,ै अजभप्रेत ह;ै (च) "अतं राष्ट्रव ीय दरू सचं ार कन्ििे न" स े िष व 1992 में जिनेिा में हस्ट्तािठरत अंतरावष्ट्रीय दरू सचं ार संघ कन्िेन्िन अथिा उसके बाद दकया गया कोई संिोधन अथिा आिोधन अजभप्रते ह ै जिसे भारत सरकार ने अनुसमर्थवत अथिा स्ट्िीकार दकया ह;ै (छ) "पोटवल" से ऐसा पोटवल अजभप्रेत ह ै जिसे इन जनयमों के जनयम 15 के अधीन केंद्र सरकार द्वारा अजधसूजचत दकया िाएगा; (ि) "रेजडयो जिजनयम" स े जिश्व रेजडयो संचार सम्मेलन (जिनेिा 1995) द्वारा अपनाए गए जिजनयम अजभप्रेत ह ै और इसमें बाद म ें दकया गया कोई संिोधन अथिा आिोधन िाजमल ह ै जिसे भारत सरकार न े अनुसमर्थवत अथिा स्ट्िीकार दकया ह;ै (झ) "जनयम" स ेदरू संचार (एमचे र स्ट्टेिन प्रचालक) जनयम, 2024 से अजभप्रेत ह;ै और (ञ) "एसएसीएफए" स े दरू संचार जिभाग, भारत सरकार के अधीन फ्रीक्वेन्सी आिंटन संबंधी स्ट्थायी सलाहकार सजमजत अजभप्रेत ह।ै (2) उन िब्दों और पदों के, िो इसमें प्रयिु ह ैंऔर पठरभाजषत नहीं ह ैंदकन्त ु अजधजनयम में पठरभाजषत हैं, िही अथ व होंग े िो उनके उस अजधजनयम में ह।ै 3. कायिव त्रे (1) कोई भी व्यजि इन जनयमों के अधीन ददए गए एएसओसी के जनबंधन और ितों के अनुसार ही एमेचर स्ट्टेिन स्ट्थाजपत या प्रचाजलत करेगा। (2) एएसओसी की दो श्रेजणयां होंगी जिन्ह ेंकेंद्रीय सरकार जनयम 6 के उप-जनयम (1) के तहत प्रदान करेगी, अथावत्: (क) एमेचर स्ट्टेिन प्रचालक प्रमाण-पत्र (सामान्य), अथिा एएसओसी (सामान्य); (ख) एमेचर स्ट्टेिन प्रचालक प्रमाण-पत्र (प्रजतबंजधत), अथिा एएसओसी (प्रजतबंजधत)। 4. एमचे र स्ट्टेिन प्रचालक प्रमाण-पत्र प्राि करन ेके जलए पात्रता की ित ें (1) जनयम 6 के उप-जनयम (1) के अधीन उस व्यजि को एएसओसी प्रदान दकया िाएगा, िो:[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 3 (क) भारत का नागठरक ह;ै (ख) बारह िषव स ेकम आय ुका नहीं है; और (ग) एएसओसी प्रदान करन े के जलए जनयम 5 के अधीन परीिा उत्तीणव करता ह।ै बिते दक केंद्रीय सरकार, समय-समय पर अजधसूजचत ऐस े जनबंधन और ितों के अधीन रहत े हुए, दकसी ऐस े व्यजि को, िो भारत का नागठरक नहीं ह,ै एएसओसी प्रदान करन े पर जिचार करन े के जलए परीिा देन े की अनुमजत द े सकती ह ै या उसे प्रमाण-पत्र प्रदान कर सकती ह,ै यदद िह उप-जनयम (2) के अंतगवत अन्यथा अहताव प्राि ह।ै (2) पात्र जिदेिी नागठरकों को जिदिे मंत्रालय, भारत सरकार से अपेजित मंिूरी के अध्ययधीन पारस्ट्पठरक आधार पर जनर्दवष्ट फॉमव म ेंप्रस्ट्तुत आिेदन और एक हिार रुपय ेके िल्ु क के साथ एएसओसी प्रदान दी िा सकती ह।ै 5. एमचे र स्ट्टेिन ऑपरेटर की िाचं (1) जनयम 4 के तहत जनधावठरत यथा लाग ू पात्रता मानदडं ों को पूरा करने िाला कोई भी व्यजि एमेचर स्ट्टेिन ऑपरेटर की िांच के जलए एएसओसी प्राि करन े हते ु केंद्र सरकार को इस उद्दश्े य के जलए जनर्दवष्ट फॉमव म ें आिेदन कर सकता ह ैपरंत ु यह आिेदन परीिा की तारीख स े एक महीन े पहले िमा करना होगा। (2) उप-जनयम (1) के तहत दकसी भी आिेदन के साथ एएसओसी की दकसी भी श्रणे ी के जलए एक सौ रुपय े का परीिा िुल्क दने ा होगा। (3) केंद्र सरकार दकसी भी श्रेणी म ें एएसओसी प्राि करने के जलए परीिा हते ु पाठ्यक्रम, स्ट्थान, प्रदक्रया, तारीख और समय और ऐसी परीिा के पठरणामों की घोषणा की तारीख प्रकाजित करेगी। यह परीिा अंग्रेिी म ें होगी। एएसओसी (सामान्य) के जलए परीिा हते ुमोस व कोड म ें प्रिीणता अपेजित ह।ै (4) परीिा म ें सफलतापूिवक उत्तीण व होन े के जलए एएसओसी की प्रत्येक श्रणे ी म ें कुल अंकों का न्यनू तम चालीस प्रजतित लाना अपेजित ह।ै 6. एमचे र स्ट्टेिन ऑपरेटर का प्रमाण पत्र देना और िधै ता (1) केंद्र सरकार, जनयम 5 के तहत परीिा के सफल समापन पर एमेचर स्ट्टेिन ऑपरेटरों के जलए जिजिष्ट कॉल साइन के साथ जनम्नजलजखत श्रेजणयों के प्रमाण पत्र िारी करेगी, िो नीच ेजनर्दवष्ट िुल्क के भगु तान के अधीन ह ै प्रमाण पत्र की श्रणे ी िल्ु क एएसओसी (सामान्य) (i) 20 िष व की िैधता अिजध के जलए 1000 रु एएसओसी (प्रजतबंजधत) (ii) आिीिन िैधता के जलए 2000 रु (2) इस जनयम के प्रयोिनों के जलए अजभव्यजि "समयािजध" स े तात्पय व एएसओसी धारक के अस्ट्सी िषव की आयु प्राि करने स े ह।ै (3) दकसी भी श्रेणी के एएसओसी के जलए पठरणामों की घोषणा की तारीख से दो साल के भीतर भुगतान दकया िाएगा जिसम ें जिफल होन े पर कोई प्रमाण पत्र िारी नहीं दकया िाएगा। 7. एमचे र स्ट्टेिन ऑपरेटर के जलए लाग ूसामान्य ित ें (1) एएसओसी धारक फ्रीक्वेन्सी बैंड और एजमिन पर एमेचर स्ट्टेिनों का संचालन करेगा और एएसओसी की प्रत्येक श्रेणी के संबंध म ें केंद्र सरकार द्वारा जनर्दष्टव पािर रांसजमट करेगा। एएसओसी (सामान्य) के धारक को एएसओसी (प्रजतबंजधत) के धारक की तुलना म ें अजधक एजमिन टाइप और उच्च पािर के उपयोग की अनुमजत दी िाएगी। (2) प्रत्येक एमेचर स्ट्टेिन को जनम्नानुसार स्ट्थाजपत और संचाजलत दकया िाएगा: (क) अजधजनयम के उपबंध और उसके तहत बनाए गए कोई भी जनयम िहां भी लागू ह।ैं (ख) इन जनयमों के अनुबंध क म ेंजनर्दवष्ट जनयम और ितें; और (ग) अंतराष्ट्रव ीय दरू संचार सम्मेलन और रेजडयो जिजनयमों के प्रािधान।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (3) एएसओसी धारक को एमेचर रेजडयो उपकरण के आयात के जलए एक अलग प्राजधकार की आिश्यकता नहीं होगी। (4) केंद्र सरकार दकसी भी समय एएसओसी धारक को जलजखत रूप म ें जिजिष्ट नोठटस द्वारा या आजधकाठरक रािपत्र म ें प्रकाजित सामान्य नोठटस के माध्यम स े या समाचार पत्र म ें व्यापक रूप स े प्रसार द्वारा एएसओसी की दकसी भी ितव को संिोजधत, पठरिर्तवत या रद्द कर सकती ह।ै (5) एएसओसी धारक अपन े स्ट्िय ं के खचव पर केंद्र सरकार द्वारा अजधसूजचत एएसओसी की ितों म ेंबदलाि करेगा। (6) एएसओसी धारक एक हिार रुपय े के िल्ु क के भगु तान पर अपन े एएसओसी की डुजललकेट प्रजत िारी करन े या अपना स्ट्थान बदलन े के जलए आिेदन कर सकता ह।ै (7) एएसओसी धारक प्राकृजतक जिपदा और आपदाओं के दौरान केंद्र सरकार या राज्य सरकार या केंद्र सरकार और राज्य सरकार द्वारा इस संबंध में जििषे रूप स े अजधकृत दकसी अजधकारी के अनुरोध पर जबना दकसी िुल्क या प्रभार के एमेचर सेिा फ्रीक्वेंसी बैंड म ेंरेजडयो संचार सेिाए ं प्रदान करेगा। (8) एएसओसी धारक को भारत म ें पंिीकृत िहाि पर एमेचर स्ट्टेिन स्ट्थाजपत करन े और सचं ाजलत करन े के जलए केंद्र सरकार द्वारा इस उद्देश्य हते ु जनर्दवष्ट प्रपत्र म ें एक जिजिष्ट अनुरोध करन े के पश्चात अनुमजत दी िा सकती ह।ै . 8 एमचे र स्ट्टेिन ऑपरेटर के प्रमाण पत्र का निीनीकरण (1) एएसओसी धारक जनयम 6 के उप-जनयम (1) म ें जनर्दष्टव िल्ु क के भगु तान के साथ इस उद्दश्े य के जलए जनर्दवष्ट फॉम व म ें इस प्रमाण पत्र की समाजि की तारीख स े कम स े कम बारह महीने पहले आिेदन िमा करके अपने एएसओसी के निीनीकरण के जलए आिेदन कर सकता ह।ै बिते दक इस समय अिजध की समाजि के बाद और इस समाजि की तारीख के दो साल बाद तक निीनीकरण के जलए कोई आिेदन करना हो तो एक हिार रुपय ेके जिलंब िुल्क के भगु तान पर आिेदन दकया िा सकता है; बिते दक निीनीकरण के जलए एएसओसी की समाजि की तारीख से दो साल के बाद प्राि होन े िाल े दकसी भी आिेदन पर जिचार नहीं दकया िाएगा। (2) इस उद्दश्े य के जलए आिीिन प्रमाण पत्र की िैधता को जनर्दवष्ट प्रपत्र म ें एएसओसी धारक द्वारा दकए गए जिजिष्ट अनुरोध पर जबना दकसी अजतठरि िल्ु क के एक बार म ें दस साल के जलए बढाया िा सकता ह।ै 9. एमचे र स्ट्टेिन ऑपरेटर के प्रमाण पत्र का जनलबं न या इस ेरद्द करना (1) केंद्र सरकार दकसी एएसओसी को जनलंजबत या रद्द कर सकती ह ैयदद उनके मतानुसार, एएसओसी धारक: (क) इन जनयमों के तहत ददए गए एएसओसी के जनबधं नों और ितों, रेजडयो उपकरण के संचालन के संबंध म ें लाग ू जनयमों या अजधजनयम के दकसी अन्य प्रािधान का पालन करन े में जिफल रहा ह;ै या (ख) अंतरावष्ट्रीय दरू संचार सम्मले न या रेजडयो जिजनयमों के लागू प्रािधानों का पालन करने म ेंजिफल रहा है, या (ग) िानबूझकर केंद्र सरकार को गलत या असत्य सूचना दी ह।ै बिते दक इस उप-जनयम के तहत जनलंबन या जनरस्ट्तीकरण का कोई आदेि तब तक नहीं ददया िाएगा िब तक दक एएसओसी धारक को ऐस े जनलबं न या जनरस्ट्तीकरण के जिरुद्ध केन्द्रीय सरकार के समि अभ्यािेदन दने े का उजचत अिसर नहीं दे ददया गया हो। 10. िल्ु क की िापसी नहीं दकसी भी कारण से एएसओसी के जनलंबन या जनरस्ट्तीकरण,या एएसओसी के जनबंधनों और ितों के दकसी भी संिोधन,पठरितनव ,जनरस्ट्तीकरण या जनरसन के पठरणामस्ट्िरूप कोई मुआििा या िल्ु क की िापसी लाग ूनहीं होगी। 11. एमचे र स्ट्टेिन ऑपरेटर के प्रमाणपत्र का अतं रण या सरेंडर (1) एएसओसी का अतं रण नहीं होगा। (2) एएसओसी धारक को दकसी भी समय ऐसे एएसओसी का सरेंडर करन े की अनुमजत होगी, बिते दक ऐसे सरेंडर के जलए कोई िुल्क िापस नहीं दकया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5 12. स्ट्कूलों, कॉलिे ों या अन्य सस्ट्ं थानों म ें एमचे र सोसायटी की गजतजिजधयों के जलए एमचे र स्ट्टेिन सचं ालक के प्रमाण पत्र का उपयोग (1) कम से कम चार एएसओसी धारकों का एक समूह, स्ट्कूलों, कॉलेिों, जिश्वजिद्यालयों या अन्य संस्ट्थानों में एमेचर स्ट्टेिन की स्ट्थापना और संचालन तथा एमेचर सेिाएं िरूु करने के प्रयोिन से, एमेचर सोसायटी बनाने के प्रयोिन के जलए जिजनर्दवष्ट प्रपत्र म ेंआिेदन तथा दो हिार रुपय ेके िुल्क का भुगतान कर सकता ह।ै (2) उप-जनयम) 1) के तहत आिेदन में एएसओसी धारकों में से एक आिेदक को प्रस्ट्ताजित एमेचर सोसायटी के संरिक के रूप में जिजनर्दवष्ट दकया िाएगा। ऐसी सोसायटी के भीतर ऐसी एमेचर सोसायटी की संरिकता को पठरिर्तवत कर दकसी अन्य एएसओसी धारक को ददए िाने पर, इस प्रयोिन के जलए जिजनर्दवष्ट प्रपत्र म ें केंद्र सरकार को तरु ंत सूजचत दकया िाएगा। (3) उपजनयम )1) के अधीन आिेदन प्राि होन े पर, केन्द्रीय सरकार एमेचर सोसायटी के जलए एक जिजिष्ट कॉल साइन के साथ अनुमजत द ेसकती ह,ै िो बीस िषव के जलए िैध होगी, या ऐसी एमेचर सोसायटी के संरिक के एएसओसी की िैधता, िो भी पहल े हो, के साथ समाि होगी। (4) यदद उप-जनयम) 1) के तहत आिेदकों में से कोई भी एमेचर सोसायटी छोड़ता है, तो उसे इस प्रयोिन के जलए जिजनर्दवष्ट प्रपत्र म ेंकेंद्र सरकार को तुरंत सूजचत दकया िाएगा। (5) इस जनयम के तहत दी गई अनुमजत तब तक िैध बनी रहगे ी िब तक दक उप-जनयम) 1) के तहत आिेदक एएसओसी धारकों में से कम से कम चार एमेचर सोसायटी के सदस्ट्य बन े रहते ह।ैं 13. जिजिष्ट आयोिनों के जलए जििषे कॉल साइन िारी करना (1) इस प्रयोिन के जलए जिजनर्दवष्ट दकए िा सकन े िाल े फॉम व में आिेदन प्राि होन े और दो सौ रुपय े की फीस का भुगतान करन े पर एएसओसी धारकों और जनयम 12 के तहत गठित एमेचर सोसाइठटयों को दकसी जिजिष्ट आयोिन के जलए एक जििेष कॉल साइन जनधावठरत दकया िा सकता ह।ै (2) उप-जनयम) 1) के तहत जनधावठरत एक जििेष कॉल साइन नब्बे ददनों या आयोिन की अिजध तक, िो भी पहल े हो, िैध होगा। 14. अजभलखे ों का जनरीिण और सचू ना मागं ना प्रत्येक एएसओसी धारक का यह कतवव्य होगा दक िह जनरीिण के जलए अजभलेखों के साथ-साथ एमेचर रेजडयो उपकरण प्रस्ट्तुत करे और केंद्र सरकार द्वारा उसके संबंध म ेंअपेजित कोई अन्य सूचना प्रदान करे। 15. इन जनयमों का जडजिटल कायान्व ियन केन्द्रीय सरकार, अजधजनयम की धारा 53 के अनुसरण में, आिेदन प्रस्ट्तुत करने, पाठ्यक्रम का प्रकािन, परीिा का स्ट्थान, तरीका, जतजथ और समय, परीिाओं के पठरणामों की घोषणा और इन जनयमों के तहत जिजनर्दवष्ट एएसओसी और अन्य अनुमजतयां प्रदान करने सजहत इन जनयमों के जडजिटल कायावन्ियन के जलए एक पोटवल अजधसजू चत कर सकती ह।ै अनबु धं क (जनयम 7(2)(ख) देख)ें एमचे र स्ट्टेिन की सस्ट्ं थापना और पठरचालन के जलए जनबधं न और ितें 1. एमचे र स्ट्टेिन का उपयोग एमेचर स्ट्टेिन का उपयोग अजधकृत दफ्रक्वेंसी बैंड के भीतर एमेचर स्ट्टेिन के प्रठरचालन को सुजिधािनक बनाने के जलए मानक दफ्रक्वेंसी और टाइम जसग्नल सर्िवस में रांसजमिन को ठरसीि करने के उद्देश्य के जलए उपयोग में जलया िा सकता ह।ै 2. सदं ेि (1) (क) रेजडयो संचार का आदान-प्रदान अन्य अजधकृत एमेचर स्ट्टेिनों के साथ दकया िा सकता ह।ै एमेचर स्ट्टेिन उन देिों के एमेचर स्ट्टेिनों के साथ संचार नहीं करेंगे जिनके प्रिासन न े ऐसे रेजडयो संचार पर अपनी आपजत्त के बारे में अंतरराष्ट्रीय दरू संचार सम्मेलन को सूजचत दकया ह।ै6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ख) रांसजमिन सरल भाषा म ेंदकया िाएगा तथा तकनीकी प्रकृजत के संदेिों तक सीजमत होगा। (2) अजधकृत संस्ट्था जनम्नजलजखत संदेि प्रसाठरत नहीं करेगी: (क) ब्रॉडकास्ट्ट कायवक्रमों, टेप ठरकॉर्डिंग या मनोरंिन के साधन अथिा संगीत के रांसजमिन का ठरप्रोडक्िन; (ख) झूिे या भ्रामक कॉल, जसग्नल्स, समाचार, जिज्ञापन, व्यिसाय के संचार, रािनीजतक या औद्योजगक जििाद के जिषयों पर बयान, या तीसरे पि के संदेि; या (ग) अभद्र, अश्लील, आपजत्तिनक भाषा या जसग्नल्स का उपयोग। (3) सामान्य दरू संचार सुजिधाओं की जिफलता की जस्ट्थजत में एएसओसी धारक को प्राकृजतक आपदाओं से संबंजधत थड व पाटी के जसग्नल्स को प्रबंजधत करने की अनुमजत दी गई ह ै िो सिम जसजिल प्राजधकारी अथावत ् जिला मजिस्ट्रेट या उपायुि या जिलाधीि और उनके द्वारा प्राजधकृत दकसी अन्य अजधकारी द्वारा ददये गए हो और संबोजधत ह।ैं 3. दफ्रक्वेंसी, एजमिन्स और पॉिर एमेचर स्ट्टेिन को उन दफ्रक्वेंसी पर प्रचाजलत दकया िाएगा िो सर्टवदफकेट से संबंजधत श्रेणी के जलए अजधकृत दफ्रक्वेंसी बैंड के भीतर ह ैंऔर एजमिन्स और पॉिर की ऐसी श्रणे ी िो की सरकार द्वारा अजधसूजचत की गई ह।ै 4. दफ्रक्वेंसी जनयत्रं ण और माप (1) रांसजमटटंग एपरेटस को यथा संभि सटीक रूप स े ट्यनू दकया िाएगा तादक यह सुजनजश्चत दकया िा सके दक अजधकृत दफ्रक्वेंसी बैंड की सीमाओं के बाहर दकसी भी दफ्रक्वेंसी पर दकसी एनिी का जिदकरण ना हो। (2) एएसओसी धारक के पास प्राजधकृत एमेचर स्ट्टेिन पर दफ्रक्वेंसी को मापन े िाला एक जिश्वसनीय उपकरण होना चाजहए तादक प्रत्येक बार रांसमीटर की दफ्रक्वेंसी बदलने पर और िब भी यह िांचना आिश्यक हो दक रांसजमटेड दफ्रक्वेंसी म ें एजमिन अजधकृत दफ्रक्वेंसी बैंड के भीतर ह ै को सत्याजपत दकया िा सके। एएसओसी धारक दफ्रक्वेंसी मापने िाले उपकरण की सटीकता बनाए रखने के जलए सभी आिश्यक कदम उिाएगा। (3) दफक्स्ट्ड एमेचर स्ट्टेिन के मामले में एसएसीएफए की क्लीयरेंस प्रयोिन होगी। 5. नॉन-इंटरफेरेंस (1) एमेचर स्ट्टेिन को इस तरह से जडिाइन, जनर्मवत, स्ट्थाजपत, अनरु जित और प्रचाजलत दकया िाएगा दक दकसी भी अजधकृत रेजडयो संचार सेिा में कोई इंटरफेरेंस न हो। (2) स्ट्टेिन द्वारा इंटरफेरेंस दकए िाने की जस्ट्थजत में एएसओसी धारक केंद्र सरकार या दकसी लैंड स्ट्टेिन के अनरु ोध पर उपकरण के समायोिन तक रांसजमिन को बंद कर दगे ा या प्रजतबंजधत कर दगे ा। (3) एएसओसी धारक िग वख के एजमिन (डैम्लड िेि) का उपयोग नहीं करेगा। 6. रेजडयो सिे ा की लॉग डायरी (1) एमेचर स्ट्टेिन स े आने िाल े या प्राि होन े िाल े सभी रांसजमिन का कालानुक्रजमक ठरकॉड व बाउंड बुक (नॉट लूि- लीफ) में रखा िाएगा जिसमें जनम्नजलजखत दिावया िाएगा: (क) प्रत्येक रांसजमिन की तारीख और समय; (ख) आदान-प्रदान दकए गए सचं ार का सारांि; (ग) दकए गए प्रयोगों और परीिणों का संजिि जििरण; (घ) उन स्ट्टेिनों या स्ट्टेिनों का कॉल साइन, जिनके साथ संदिे ों का आदान-प्रदान दकया गया ह ै प्रत्येक मामल े में दकए गए एजमिन का समय और प्रकार; (ङ) एमेचर स्ट्टेिन के खलु ने और बंद होन े का समय; (च) पोटेबल या मोबाइल एमेचर स्ट्टेिन के मामल े में अस्ट्थायी स्ट्थान का जििरण। (2) लॉग म ेंसभी समय भारतीय मानक समय म ेंजलख ेिाएंगे। (3) लॉग में प्रजिजष्टयों के बीच कोई गैप नहीं छोड़ा िाएगा और उन्ह ें ठरसीविंग और रांसजमटटंग के समय तैयार और दि व दकया िाएगा। (4) एएसओसी धारक लॉग को नष्ट करन े से पहल े उसमें अंजतम प्रजिजष्ट की तारीख स े एक िषव की अिजध के जलए संरजित रखेगा:[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7 बिते दक दकसी भी लॉग को ऐसी अजतठरि अिजध के जलए नष्ट नहीं दकया िाएगा िैसा दक केंद्र सरकार जनदेजित कर सकती ह।ै 7. एमचे र रेजडयो उपकरण (1) एमेचर स्ट्टेिन ठरसेलिन के साथ-साथ रांसजमिन के जलए भी तैयार होगा। (2) एएसओसी धारक द्वारा उपयोग दकए िाने िाल े या उपयोग दकए िाने के जलए एमेचर रेजडयो उपकरण और अन्य सहायक उपकरण इस तरह स े सुव्यिजस्ट्थत दकए िाएंग े तादक दकसी व्यजि की सुरिा को खतरा न हो और/या दकसी भी सेिा में बाधा न आए। (3) इन एमेचर रेजडयो उपकरण को सुरजित जस्ट्थजत में और इस प्रकार रखा िाएगा जिससे दक अनजधकृत व्यजियों की उस तक पहुचं न हो। (4) प्रत्येक एएसओसी धारक को अपने द्वारा उपयोग दकए िाने िाल े एमेचर रेजडयो उपकरणों का ठरकाड व नीचे जनर्दष्टव प्रपत्र के अनुसार रखना होगा: क्र. स.ं उपकरण का जििरण जिस व्यजि से प्राि दकया गया ह ै प्राजि या उसका नाम और पता (यदद असेम्बल की मेक मॉडल और सीरीयल जतजथ प्राजधकृत संस्ट्था द्वारा संकजलत टाइप न. दकया गया हो तो स्ट्िजनर्मवत जलखें) खरीद के मामले उस व्यजि का नाम और पता जिसे बेचा जबक्री या क्रेता के नाम पर ठटलपणी म,ें रसीद संख्या या हस्ट्तांतठरत दकया गया ह।ै हस्ट्तांतरण िारी प्रमाण-पत्र की जतजथ का जििरण दें और जिक्रेता का प्रमाण-पत्र संख्या बताएं 8. पत्राचार की गोपनीयता यदद कोई ऐसा संदेि जिसे एएसओसी धारक प्राि करन े के जलए हकदार नहीं ह ै तब भी प्राि होता ह ै तो ऐसे एएसओसी धारक इसकी जिषय-िस्ट्त,ु इसके स्रोत या गंतव्य, इसके अजस्ट्तत्ि या इसकी प्राजि के तथ्य को दकसी व्यजि (केन्द्रीय सरकार या दकसी न्यायालय द्वारा इस प्रयोिन के जलए प्राजधकृत अजधकारी के अलािा) को नहीं बताएगा या बताने की अनुमजत नहीं देगा और ऐस े एएसओसी धारक ऐसे संदेि का जलजखत रूप म ें प्रजतजलजप तैयार ,कॉपी या उपयोग नहीं करेंग,े या जलजखत रूप म ेंप्रजतजलजप तैयार करन,े कॉपी करने या उपयोग करने की अनुमजत नहीं दगें े। 9. सामान्य रेजडयो सचं ार प्रदक्रया (1)(क) प्रसारण स े पहले, स्ट्टेिन को यह सुजनजश्चत करने के जलए सािधानी रखनी होगी दक उनके इजमिन के कारण पहल े से चल रह े प्रसारण में बाधा न आए। यदद ऐसी दकसी बाधा की संभािना होती ह ै तो प्रसारण को तब तक िुरू नहीं दकया िाएगा िब तक दक संचार म ेंउपयुि जनयंत्रण न हो। (ख) प्रमाण-पत्र म ें अंदकत कॉल साइन को प्रसारण की प्रत्येक अिजध के आरंभ और अतं म ें पहचान के जलए भेिा िाएगा। िब प्रसारण की अिजध 10 जमनट स े अजधक हो िाती ह ै तो कॉल साइन को दोहराया िाएगा। एएसओसी धारक जबना पहचान के या गलत पहचान के साथ प्रसारण नहीं करेगें। (ग) लम्बी कॉल और प्रसारण स ेबचा िाए। (घ) िब कॉल साइन, कुछ अजभव्यजियााँ, कठिन िब्द, संजिि रूप, आकड़ें आदद का उच्चारण करना आिश्यक हो, तो अंतराष्ट्रव ीय दरू संचार सम्मेलन म ेंददए गए ध्िन्यात्मक िणवमाला और दफगर कोड का उपयोग दकया िाएगा।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) कॉल और उत्तर की प्रदक्रया: (क) कॉल में कॉल करने िाल ेस्ट्टेिन का कॉल साइन तीन बार से अजधक नहीं होना चाजहए; िब्द डीई (मोसव प्रसारण के मामल े में) और िब्द "ददस इस" (टेलीफोनी के मामल े में)। कॉल करने िाले स्ट्टेिन का कॉल साइन, तीन बार से अजधक नहीं। (ग) कॉल दो जमनट के अतं राल पर तीन बार भेिी िा सकेगी; उसके बाद इसे 10 जमनट के अतं राल तक दोहराया नहीं िाएगा जिसके दौरान ऑपरेटर उस फ्रीक्वेन्सी बैंड म ेंसुनगे े जिस पर कॉल की गई ह।ै (घ) सभी स्ट्टेिनों पर सामान्य कॉल के मामले म ें जसग्नल 'सीक्यू' (रेजडयोटेलीग्राफी के मामले में) और िब्द 'हलै ो आल स्ट्टेिन' या जसग्नल 'सीक्यू' (रेजडयोटेलीफोनी के मामले में) कॉवलंग प्रदक्रया में कॉल दकए गए स्ट्टेिन के कॉल साइन का स्ट्थान लगें े। (3) प्रसारण और काय वकी समाजि: (क) संदेि का प्रसारण जसग्नल एआर (मोसव प्रसारण के मामले म)ें और िब्द 'ओिर' (टेलीफोनी के मामले म)ें द्वारा समाि दकया िाएगा। (ख) दो स्ट्टेिनों के बीच कायव की समाजि को उनमें स े प्रत्येक द्वारा संकेत िीए (मोसव प्रसारण के मामल े में) के माध्यम स े और रेजडयोटेलीफोनी के मामले में 'आउट' (या िीए जिसे जिक्टर अल्फा बोला िाता है) िब्द द्वारा सूजचत दकया िाएगा। (4) परीिण: (क) िब रांसमीटर या ठरसीिर के समायोिन या दकसी प्रयोग के जलए परीिण संकेत बनाना आिश्यक हो तो ऐस े संकेतों को 30 सेकंड स े अजधक समय तक िारी नहीं रखा िाएगा और यह िीिीिी की सीरीि से बना होगा जिसके बाद परीिण जसग्नल इजमिन करन े िाल े स्ट्टेिन का कॉल साइन होगा। रेजडयोटेलीफोनी के मामल े म ें िीिीिी की सीरीि को दफगर कोड म ेंबोले गए 1,2,3,4... अंकों से प्रजतस्ट्थाजपत दकया िाएगा। (ख) 30 सेकंड से अजधक के परीिण के जलए आर्टवदफिल एठरयल का उपयोग दकया िाएगा। (ग) एएसओसी धारक केठरयर िेि का इजमिन नहीं करेग ें िब तक दक ऐसे केठरयर िेि स्ट्पष्ट मॉड्यूलेिन के अधीन न हो। 10. जनरीिण (1) केन्द्रीय सरकार द्वारा जलजखत रूप में जनरीिण करने के जलए प्राजधकृत कोई भी अजधकारी दकसी भी उपकरण का जनरीिण, िांच या परीिण कर सकता ह ै तथा जनरीिण अजधकारी द्वारा िांच के जलए प्रमाण-पत्र, स्ट्टेिन लॉग या अन्य ठरकॉडव उपलब्ध कराना। (2) केन्द्रीय सरकार द्वारा िब एएसओसी धारक को ऐसा करने के जलए कहा िाएगा तो िह प्रमाण-पत्र, लॉग बुक या कोई अन्य ठरकाडव या डाटा, केन्द्रीय सरकार द्वारा िांच के जलए भेिने की व्यिस्ट्था करेगें। 11. एएसओसी धारक प्रमाण-पत्र द्वारा अनुमत दकसी भी काय व से उत्पन्न होन े िाली दकसी भी िजत के संबंध में दकसी भी व्यजि द्वारा दकए गए सभी कायों, दािों और मागं ों के जखलाफ केन्द्रीय सरकार को िजतपूर्तव दगे ें। [फा. सं 24-03/2024-यूबीबी] देिेंद्र कुमार राय, संयुि सजचि[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 9 MINISTRY OF COMMUNICATIONS (Department of Telecommunications) NOTIFICATION New Delhi, the 24th July, 2024 G.S.R. 447(E).— The following draft rules, which the Central Government proposes to make in exercise of the powers conferred by section 47 read with clause (zi) to sub-section (2) of section 56 of the Telecommunications Act, 2023 (44 of 2023), are hereby published for the information of all persons likely to be affected thereby and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of thirty days from the date on which copies of this notification as published in the Official Gazette, are made available to the public; Objections or suggestions, if any, may be addressed to the Joint Secretary (Telecom), Department of Telecommunications, Ministry of Communications, Government of India, Sanchar Bhawan, 20, Ashoka Road, New Delhi - 110001; The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the aforesaid period shall be taken into consideration by the Central Government. 1. Short title and commencement (1) These rules may be called the Telecommunications (Amateur Station Operator) Rules, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions (1) In these rules, unless the context otherwise requires: (a) “Act” means the Telecommunications Act, 2023 (44 of 2023); (b) “amateur radio equipment” means radio equipment required for operating an amateur station as notified by the Central Government; (c) “amateur services” means radio communication services for the purpose of self-training, intercommunication and technical investigations carried out by amateurs, that is, by duly authorised person interested in radio technique solely with a personal aim and without any pecuniary interest; (d) “amateur station” means a radio station operated by an amateur for amateur services; (e) “ASOC” or “Amateur Station Operator’s Certificate” means either of the two categories of certificates, namely ASOC (General) and ASOC (Restricted), as specified under sub-rule (2) of rule 3, and an “ASOC holder” means the person who has been granted such certificate under sub-rule (1) of rule 6; (f) “International Telecommunication Convention” means the Convention of the International Telecommunication Union signed at Geneva in 1992 or any subsequent revision or modification thereof which the Government of India has ratified or accepted; (g) “portal” means the portal which may be notified by the Central Government under rule 15 of these rules; (h) “Radio Regulations” means the regulations adopted by the World Radiocommunication Conference (Geneva 1995) and includes every revision or modification thereof which the Government of India has ratified or accepted; (i) “rules” means the Telecommunications (Amateur Station Operator) Rules, 2024; and (j) “SACFA” means the Standing Advisory Committee for Frequency Allocation under the Department of Telecommunications, Government of India. (2) The words and expressions used in these rules and not defined herein but defined in the Act, shall have the meaning assigned to them in the Act.10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] 3. Scope (1) No person shall install or operate an amateur station except under and in accordance with the terms and conditions of an ASOC granted under these rules. (2) There shall be two categories of ASOC which may be granted by the Central Government under sub-rule (1) of rule 6, namely: (a) Amateur Station Operator’s Certificate (General), or ASOC (General); (b) Amateur Station Operator’s Certificate (Restricted), or ASOC (Restricted). 4. Eligibility conditions for obtaining an amateur station operator’s certificate (1) An ASOC shall be granted to any person under sub-rule (1) of rule 6, who: (a) is a citizen of India; (b) is not less than twelve years of age; and (c) qualifies the examination under rule 5 for the award of an ASOC. Provided however that the Central Government may, subject to such terms and conditions as it may notify from time to time, permit a person, who is not a citizen of India, to undertake an examination for consideration of the grant of an ASOC or grant him a certificate, if he is otherwise qualified under sub-rule (2). (2) An ASOC may be granted, on a reciprocal basis, to eligible foreign nationals subject to requisite clearance from the Ministry of External Affairs, Government of India based on an application submitted in the form as may be specified for this purpose, along with a fee of one thousand rupees. 5. Amateur station operator’s examination (1) Any person satisfying the eligibility criteria set forth under rule 4, as may be applicable, may make an application for appearing for the amateur station operator’s examination for obtaining the ASOC, to the Central Government, in the form specified for this purpose, no later than one month before the date of such examination. (2) Any application under sub-rule (1) shall be accompanied by examination fee of one hundred rupees, for either category of ASOC. (3) The Central Government shall publish the syllabus, place, manner, date and time for the examination for obtaining the ASOC in either category, and the date of announcement of the results of such examination. The language of such examination shall be English. The examination for ASOC (General) shall require proficiency in Morse Code. (4) The successful completion of such examination shall require a minimum of forty percent of the total marks in respect of each category of ASOC. 6. Grant and validity of the amateur station operator’s certificate (1) The Central Government shall, upon successful completion of the examination under rule 5, issue any of the following categories of certificates along with unique call signs for amateur station operators, subject to payment of fees as specified below: Category of certificate Fee ASOC (General) (i) Rs. 1000/- for validity period of 20 years ASOC (Restricted) (ii) Rs. 2000/- for life time validity (2) For the purposes of this rule, the expression “lifetime” means till the holder of the ASOC attains the age of eighty years. (3) Payment for the grant of ASOC of either category, shall be made within two years from the date of declaration of results, failing which no certificate shall be issued.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 11 7. General conditions applicable to an amateur station operator (1) An ASOC holder shall operate amateur stations on such frequency bands and emissions, and transmit power as specified by the Central Government in respect of each category of ASOC. The holder of ASOC (General) shall be permitted use of more emission types and higher power than the holder of ASOC (Restricted). (2) Every amateur station shall be installed and operated in accordance with: (a) the provisions of the Act, and any rules made thereunder, in so far as they are applicable. (b) the terms and conditions specified in Annexure A to these rules; and (c) the provisions of the International Telecommunication Convention and Radio Regulations. (3) An ASOC holder shall not require a separate authorisation for the import of amateur radio equipment. (4) The Central Government may modify, vary, cancel or revoke any of the conditions of the ASOC at any time either by specific notice in writing to the ASOC holder, or by means of a general notice published in the Official Gazette, or in a newspaper with wide circulation. (5) The ASOC holder shall at their own expense, give effect to any variations in the conditions of the ASOC as notified by the Central Government. (6) The ASOC holder may apply for issuance of a duplicate of their ASOC or apply to change their location, upon payment of fees of one thousand rupees. (7) The ASOC holder shall provide radio communication services in amateur services frequency band, at the request of the Central Government or a State Government or any officer specially authorized in this behalf by the Central Government or a State Government, during natural calamities and disasters, without any fee or charge. (8) The ASOC holder may be permitted to install and operate an amateur station on board a ship registered in India, upon placing a specific request in the form as may be specified for this purpose, by the Central Government. 8. Renewal of amateur station operator’s certificate (1) An ASOC holder may apply for renewal of his ASOC by making an application in the form specified for this purpose, at least twelve months prior to the date of expiry of such certificate, along with payment of fees as specified in sub-rule (1) of rule 6. Provided however that any application for renewal after the expiry of such time period and up to two years after the date of such expiry, may be made upon payment of late fees of one thousand rupee ; Provided further that no application for renewal shall be considered if received after two years from the date of expiry of the ASOC. (2) Validity of lifetime certificate may be extended for ten years at a time, without any additional fees, upon specific request made by the ASOC holder in the form specified for this purpose. 9. Suspension or cancellation of amateur station operator’s certificate (1) The Central Government may suspend or cancel an ASOC if in its opinion, the ASOC holder has: (a) failed to comply with the terms and conditions of the ASOC granted under these rules, rules applicable in respect of operation of radio equipment, or any other provision of the Act; or (b) failed to comply with the applicable provisions of the International Telecommunication Convention or the Radio Regulations, or (c) wilfully furnished incorrect or false information to the Central Government. Provided that no order of suspension or cancellation under this sub-rule shall be made unless the ASOC holder has been given a reasonable opportunity of making a representation against such suspension or cancellation to the Central Government. 10. No refund of fees12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] No compensation or refund of fees shall be applicable as a result of any suspension or cancellation of the ASOC for any reason whatsoever, or for any modification, variation, cancellation or revocation of terms and conditions of the ASOC. 11. Transfer or surrender of amateur station operator’s certificate (1) The ASOC shall be non-transferable. (2) The ASOC holder shall be permitted to surrender such ASOC at any point of time, provided however that no refund of fees shall be granted for such surrender. 12. Use of amateur station operator’s certificate for activities of an amateur society in schools, colleges or other institutions (1) A group, comprising of a minimum of four ASOC holders, may submit an application in the form specified for this purpose, and payment of fees of two thousand rupees, to form an amateur society in schools, colleges, universities or other institutions, for the purpose of installation and operation of an amateur station and undertaking of amateur services. (2) The application under sub-rule (1) shall specify one of the applicant ASOC holders as the custodian of the proposed amateur society. Any change of custodianship of such amateur society to any other ASOC holder within such society, shall be promptly communicated to the Central Government in such form as may be specified for this purpose. (3) Upon receipt of the application under made sub-rule (1), the Central Government may grant permission for the amateur society, along with a unique call sign, which shall be valid for twenty years, or co-terminus with the validity of the ASOC of the custodian of such amateur society, whichever is earlier. (4) If any of the applicants under sub-rule(1) leaves the amateur society, the same shall be communicated promptly to the Central Government in the form specified for this purpose. (5) The permission granted under this rule shall continue to remain valid so long as at least four of the applicant ASOC holders under sub-rule (1) continue as members of the amateur society. 13. Issue of special call signs for specific events (1) A special call sign for a specific event may be assigned to ASOC holders and to the amateur societies constituted under rule 12, on receipt of an application in such form as may be specified for this purpose, and payment of fees of two hundred rupees. (2) A special call sign assigned under sub-rule (1) shall be valid up to ninety calendar days or until the duration of the event, whichever is earlier. 14. Inspection of records and calling for information It shall be the duty of every ASOC holder to produce for inspection, records as well as amateur radio equipment, and to give any other information in connection therewith as may be required by the Central Government. 15. Digital implementation of these rules The Central Government, in furtherance of section 53 of the Act, may notify a portal for the digital implementation of these rules, including for submission of applications, publication of syllabus, place, manner, date and time of examination, declaration of results of examinations, and grant of ASOC and other permissions as specified under these rules. Annexure A (See rule 7(2)(b)) Terms and conditions for the installation and operation of amateur station 1. Use of the amateur station The amateur station may be used for the purpose of receiving transmissions in the Standard Frequency and Time Signal Service to facilitate operation of the amateur station within the authorised frequency bands. 2. Messages (1) (a) Radio communications may be exchanged with other authorized amateur stations. The amateur stations shall not communicate with amateur stations of countries whose administrations have notified the International Telecommunication Convention of their objection to such radio communications. (b) Transmissions shall be made in plain language and limited to messages of a technical nature.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 13 (2) The authorised entity shall not transmit messages containing: (a) reproduction of broadcast programmes, tape recordings or transmissions of entertainment value or music; (b) false or misleading calls, signals, news, advertisements, communications of business, statements on topics of political or industrial controversy, or third party messages; or (c) use of indecent, obscene, offensive language, or signals. (3) In case of failure of normal telecommunication facilities, an ASOC holder is permitted to handle third party messages, pertaining to natural calamities, originating from and addressed to a competent civil authority namely, District Magistrates or Deputy Commissioners or Collectors of the district and any other officer authorised by them. 3. Frequencies, emissions and power The amateur station shall be operated on frequencies that are within the frequency bands authorised to respective categories of certificates and on such classes of emissions and power as notified by Government. 4. Frequency control and measurement (1) The transmitting apparatus shall be tuned as accurately as possible to ensure that no energy is radiant on any frequency outside the limits of the authorised frequency bands. (2) The ASOC holder shall have at the authorised amateur station a reliable frequency measuring equipment to verify, each time the frequency of the transmitter is changed and whenever it is necessary to check that the emissions in the transmitted frequency, are within the authorised frequency bands. The ASOC holder shall take all steps necessary to maintain the accuracy of the frequency measuring equipment. (3) In the case of a fixed amateur station, the SACFA clearance shall be applicable. 5. Non-Interference (1) The amateur station shall be so designed, constructed, erected, maintained and worked so as not to cause interference with any authorised radio communication service. (2) In the event of interference being caused by the station, the ASOC holder shall discontinue, or restrict transmissions, pending adjustment of the equipment, on request from the Central Government or any land station. (3) The ASOC holder shall not use of class B emissions (damped waves). 6. Log diary of the radio service (1) A chronological record of all transmissions emanating from or received at the amateur station shall be kept in bound book (not loose-leaf) showing the following: (a) date and time of each transmission; (b) summary of the communications exchanged; (c) brief description of the experiments and tests undertaken; (d) call sign of station or stations with which messages have been exchanged, times and type of emission employed in each case; (e) time of opening and closing down the amateur station; (f) in case of portable or mobile amateur station, the particulars of temporary location. (2) All times in the log shall be stated in the Indian Standard Time. (3) No gaps shall be left between entries in the log, and they shall be made and installed at the time of receiving and transmitting. (4) ASOC holder shall preserve the log for a period of one year from the date of last entry therein before it is destroyed: Provided that no log shall be destroyed for such further period as the Central Government may direct. 7. Amateur radio equipment (1) The amateur station shall be equipped for reception as well as transmission.14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) The amateur radio equipment and other accessories used or intended to be used by the ASOC holder shall be so arranged as not to endanger the safety of any person and/or interrupt any services. (3) The amateur radio equipment shall be kept in a safe condition and housed in such manner as to preclude access to unauthorised persons. (4) Each ASOC holder shall maintain records of amateur radio equipment used by such holder in the form specified below: S. Secrecy of correspondence If any message which a ASOC holder is not entitled to receive is, nevertheless received, such ASOC holder shall not make known or allow to be made known its contents, its origin or destination, its existence or the fact of its receipt to any person (other than to an officer duly authorised for this purpose by the Central Government or a court of law) and such ASOC holder shall not reproduce in writing, copy or make any use of such message or allow the same to be reproduced in writing, copied or made use of. 9. General radiocommunication procedure (1)(a) Before transmitting, the station shall take precautions to ensure that its emissions will not interfere with transmissions already in progress. If such interference is likely the transmission shall not commence till there is an appropriate break in the communications is progress. (b) The call sign endorsed in the certificate shall be sent for identification at the beginning and at the end of each period of transmission. When the period of transmission exceeds 10 minutes the call sign shall be repeated. ASOC holder shall not make transmission without identification or with false identification. (c) Prolonged calls and transmissions shall be avoided. (d) When it is necessary to spell out call sign, certain expressions, difficult words, abbreviations, figures etc., the phonetic alphabet and figure code given in the International Telecommunication Convention shall be used. (2) Call and Reply Procedure: a) The call shall consist of the call sign of the station called not more than three times; the word DE (in case of Morse transmission) and the words "This is" (in case of telephony). the call sign of the calling station, not more than three times. b) The reply to call shall consist of - the call sign of the calling station, not more than three times; the word DE (in case of a Morse transmission) and the words "This is" (in case of telephony). The call sign of the station called, not more than three times. c) The call may be sent three times at intervals of two minutes; thereafter it shall not be repeated until an interval of 10 minutes during which the operator shall listen in the frequency band is which the call has been made. d) In case of general call to all stations the signal ‘CQ' (in case of radiotelegraphy) and the words ‘Hello all stations’ or the signal ‘CQ' (in case of radiotelephony) shall replace the call sign of the station called in the calling procedure. (3) End of Transmission and Work: (a) Transmission of a message shall be terminated by the signal AR (in case of Morse transmission) and the word ‘Over’ (in case of telephony).[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 15 (b) The end of work between two stations shall be indicated by each of them by means of signal VA (in case of Morse transmission) and by the word ‘OUT' (or VA spoken as Victor Alfa) in case of radiotelephony. (4) Tests: (a) When it is necessary to make test signals either for the adjustment of a transmitter or a receiver or for any experiment, such signals shall not be continued for more than 30 seconds and shall be composed of series of VVV followed by the call sign of the station emitting the test signals. In case of radiotelephony series of VVV shall be replaces by the figures 1,2,3,4... spoken in the figure code. (b) For tests exceeding 30 seconds an artificial aerial shall be used. (c) The ASOC holder shall not emit carrier wave unless such carrier wave is subjected to intelligible modulation. 10. Inspection (1) Any officer authorised by the Central Government in writing, to carry out an inspection, may inspect, examine, or test any apparatus, and making available the certificate, the station log or other records for examination by the inspecting officer. (2) The ASOC holder when called upon to do so by the Central Government shall arrange to forward the certificate, the log book, or any other record or data for examination by the Central Government. 11. The ASOC holder shall indemnify the Central Government against all actions, claims and demands which may be brought or made by any person in respect of any injury arising from any act permitted by the certificate.
