DRAFT REHABILITATION AND RESETTLEMENT SCHEME
F. No. LAC/C/2020/092623813/704.—In the exercise of the powers conferred by sub section (2) of section
16 of the Right to Fair Compensation and Transparency in Land Acquisition,Rehabilitation and Resettlement Act,
2013, the draft Rehabilitation and Resettlement Scheme has been prepared under section 16 of the Right to Fair
Compensation and Transparency in Land Acquisition Act, 2013, for families affected with the proposed acquisition of
land bearing Property No. 8736-C & 8736-D total land measuring 62 Sq. Mtr. (0.0062 hectares)at Rahat
Ganj/Aram Ganj, Roshanara Road, Pul Bangash of Sub Division Kotwali in District Centralfor public purpose,
namely for the MRTS (Metro Rail Transit System) project Phase-IVstarting from Janak Puri West -
Mukundpur- R.K. Ashram Marg Corridor at Rahat Ganj / Aram Ganj, Roshanara Road, Pul Bangash
New Delhi.
Preface: -
Vide Preliminary Notification No. F. No. LAC/C/2020/(092623813)/440-452 dated 27.05.2024 u/s 11 (1) of
Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 issued
by District Magistrate (Central), Govt. of NCT of Delhi, for MRTS (Metro Rail Transit System) project Phase-
IVstarting from Janak Puri West -Mukundpur- R.K. Ashram Marg Corridor at Rahat Ganj / Aram Ganj,
Roshanara Road, Pul Bangash New Delhi, the land bearing Property No. 8736-C & 8736-D total land measuring
62 Sq. Mtr. (0.0062 hectares) at Rahat Ganj / Aram Ganj, Roshanara Road, Pul Bangash of Sub Division
Kotwali in District Central was notified for acquisition.
Vide above notification, Additional District Magistrate (Central) was appointed as the Administrator under
sub section (1) of Section 43 of the said Act for Rehabilitation & Resettlement of affected families due to acquisition
of the said land as mentioned above.8 DELHI GAZETTE : EXTRAORDINARY PART IV]
As per section 16 of the RFCTLARR Act, 2013, Draft Rehabilitation & Resettlement Scheme has been
prepared by the Administrator.
Upon the publication of the preliminary notification under sub-section 1 of section 11 by the Collector,
Central, a joint survey u/s 16(1) was carried out on 12/07/2024,regarding census of the affected families, particulars of
land and immovable properties, structures, trees, infrastructure facilities and utilities etc. of land bearing Property No.
8736-C & 8736-D.

(b) Livelihoods lost in respect of land losers and landless whose livelihood are primarily dependent on the lands
being acquired: -
As per Final SIA report Para 8.1.3, at Page No. 75 stated that:
“8.1.3 Compensation for loss of livelihood of PAFS
Mr. Vivek Sadana earns Rs. 1,20,000/pm- Mrs. Puja Sadana earns Rs.1,00,000/pm- respectively. The third
land owner. Mr. Anurag Nanda is a single earning member in his family and his monthly income is 2,30,000/
pm. As per them their income is totally dependent on the land which is to be acquired by DMRC. However,
no proof in support of monthly income has been provided by any of them.
8.1.4 Compensation for loss of livelihood of workers and labourers.
Seven laborers are working with the land owners in their shops, they need to be compensated appropriately
along with land owners for the loss of their livelihood. As per the Second Schedule of the act, each affected
family which is displaced from the land acquired shall be compensated. However, parameters have been
defined to calculate the same as the land is located in NCT of Delhi, the Minimum wages fixed by the Govt. of
Delhi are being taken into account to compensate the losses of livelihood of workers/laborers.
Further, as per SIA report, as the workers involves little technical knowhow and knowledge to run machines
the laborers are treated as semi-skilled and the wages of that category are considered to calculate
compensation. A year's losses of wages has been taken as compensation for the laborers (Table 8.3)

8.1.5 Compensation for loss of rent Income
As per SIA report, Mr. Vivek Sadana used to earn Rs. 20000/- per month, Ms. Puja Sadana was getting Rs.
30000/- per month and Mr. Anurag Nanda used to get Rs. 1000/- per month. However, they didn't show any
proof against their claim i.e. rent agreement paper or any kind of financial transaction evidence.
8.1.6 Shifting assistance
As per the RFCTLARR Act, 2013, one-time shifting assistance of Rs.50,000/- per affected shop owners who
required to relocate their assets due to the project shall be given to the affected family
8.1.7 Contingency Provisions:
The competent authority must take care of Contingency provisions i.e. 10% of the total cost of R&R
component.
And Joint Survey Report dated 12.07.2024 u/s 16 (1), no family is residing on the land being acquired,
Therefore, no family is displaced. But the below mentioned workers and shop owners are affected from this
acquisition:

As per SIA report, all the threeland owner interested persons involved in their own business.
Mr. Vivek Sadana has submitted a Factory License bearing No. NFL2202101563 dated 19.05.2022
issued in the name of Mr. Vivek Kumar by Factory License Department North MCD.
At the premises of Mr. Anurag Nanda, RAMA Diesel Works was found running. He has submitted a
Factory License bearing No. NFL3202210341 dated 29.05.2022 issued in the name of Mr. Hakikat Rai
Nanda by Factory License Department, MCD.
(b) List of persons belonging to SC/ST Handicapped or physically challenged persons in the affected area:
As per SIA report Para 5.2 Table 5.10, Two laborers out of seven were belongs to SC/ST category.
Further, as per report of Joint Survey u/s 16(1) conducted on dated 12.07.2024, Sh. Devender Kumar
was identified as belonging to Jatav caste, an employee of Mr. Anurag Nanda, which is recognized as
scheduled caste. However, no laborer was identified as Schedule Tribe in the Joint Survey dated
12.07.2024 as mentioned in SIA report.10 DELHI GAZETTE : EXTRAORDINARY PART IV]
However, no family was residing in the proposed land for acquisition, therefore, no family is displaced
as per definition under section 3(k). Hence, no one is eligible for benefit of Rehabilitation &
Resettlement under section 41 of RFCTLARR Act, 2013 and Rule 9 of RFCTLARR Rules, 2015.
(c) A list of public utilities and Govt. building which are affected or likely to be affected where resettlement of
affected families is involved: -
As per SIA report, no family is displaced.
Hence, may be treated as Not Applicable.
(d) Details of the amenities and infrastructural facilities which are affected or likely to be affected, where
resettlement of affected families is involved: -
No living quarters/human settlements are getting affected and so the affected families may not be
considered in the category of displaced families. Therefore, resettlement is not applicable for the
affected families. Also, the acquisition does not affect any amenities and infrastructural facilities as
none exist.
This may be treated as Not Applicable.
(e) Details of any common property resource being acquired: -
This may be treated as Not Applicable.

Mr. Vivek Sadana has submitted a Factory License bearing No. NFL2202101563 dated
19.05.2022 issued in the name of Mr. Vivek Kumar by Factory License Department
North MCD.
At the premises of Mr. Anurag Nanda, RAMA Diesel Works was found running. He has
submitted a Factory License bearing No. NFL3202210341 dated 29.05.2022 issued in the name
of Mr. Hakikat Rai Nanda by Factory License Department, MCD.
(g) List of persons belonging to the Scheduled Castes or the Scheduled Tribes, the handicapped or
physically challenged persons in the affected area;
As per SIA report Para 5.2 Table 5.10, Two laborers out of seven were belongs to SC/ST
category. Further, as per report of Joint Survey u/s 16(1) conducted on dated 12.07.2024,
Sh. Devender Kumar was identified as belonging to Jatav caste, an employee of Mr. Anurag
Nanda, which is recognized as scheduled caste. However, no laborer was identified as Schedule
Tribe in the Joint Survey dated 12.07.2024 as mentioned in SIA report.
However, no family was residing in the proposed land for acquisition, therefore, no family is
displaced as per definition under section 3(k). Hence, not eligible for benefit of Rehabilitation
& Resettlement under section 41 of RFCTLARR Act, 2013 and Rule 9 of RFCTLARR
Rules, 2015.
