Delhi, the 3rd March, 2022
F. No. 10(176)/ENV/2014/Pt-fl/8162.—The following draft notification which the Hon`ble Lieutenant
Governor, Government of National Capital Territory of Delhi proposes to issue in exercise of the powers conferred by
section 5 of the Environment (Protection) Act, 1986 (29 of 1986), read with Government of India, Ministry of Home
Affairs, Notification No. S.O. 667 (E) dated the 10th September, 1992 read with sub-rule (3) of rule 5 of the
Environment (Protection) Rules, 1986, is hereby published for information of all persons likely to be affected thereby
and notice is hereby given that the said draft will be taken into consideration by the Hon`ble Lieutenant Governor,
Government of NCT of Delhi on or after the expiry of sixty days from the date of publication of this Notification in the
official Gazette.
The objections or suggestions which may be received from any person with respect to the said draft
Notification before the expiry of the period so specified shall be considered. Objections or suggestions to this draft
Notification may be addressed to the Principal Secretary, Department of Environment, Government of National
Capital Territory of Delhi, 6th Level, ‘C’ –Wing, Delhi Secretariat, I.P Estate, New Delhi-110002 and on e-mail at
senv@nic.in.
DRAFT NOTIFICATION
Whereas, Delhi faces air pollution concerns and level of pollutants like Particulate Matter Concentration
(PM and PM ) goes much beyond the prescribed standards for Ambient Air Quality during certain months.

And whereas air pollution affects severely the health of citizens and research has shown that vulnerable
population especially children are more susceptible to diseases occurring due to severe air pollution including
respiratory problems and cutaneous diseases.
And whereas the Commission for Air Quality Management in National Capital Region and Adjoining Areas
had vide its direction no. 44 issued on 16.11.2021 has specifically directed to stop plying of visibly polluting vehicles
and vehicles without PUC in NCR and to primarily carry out checks for PUC at the petrol pumps so as to obviate
congestion on free roads.
And whereas Pollution Under Control (PUC) certificate is an important instrument for vehicles issued through
registered PUC centres to control vehicular tail pipe emissions and are crucial in monitoring vehicular pollution and
certifying fitness of vehicles as per emission norms.
And whereas, the enforcement of pollution norms has been found to be more efficacious when targeted at
Petrol Pumps, and to improve the numbers further, the strategy to further strengthen PUCC enforcement at fuel pumps
needs to be strongly enforced for far reaching benefits.
Now, therefore, in view of the above, in exercise of the powers conferred under Section 5 of the Environment
(Protection) Act, 1986 read with notification No. SO 667 (E) issued by Ministry of Home Affairs, Government of India
dated 10.09.1992, following direction is hereby issued in larger public interest:
To control vehicular tail pipe emissions, all the dealers of the petrol/ diesel/ CNG pumps are directed to
dispense/sell the petrol/ diesel/ CNG to motor vehicles only on production of valid Pollution under Control Certificate
(PUCC) with immediate effect.
The Indian Oil Corporation Limited, Bharat Petroleum Corporation Limited, Hindustan Petroleum
Corporation Limited, Indraprastha Gas Limited, Reliance Industries Limited (Reliance Petroleum), other petrol/
diesel/ CNG pumps/stations and Commissioner, Transport Department, Delhi shall implement the aforesaid directions
in letter and spirit. The violation of the directions issued under Section 5 of the Environment (Protection) Act, 1986 or
the rules made there under shall be punishable under Section 15 of the said Act which includes imprisonment up to
five years and / or with fine which may extend to Rs. One Lakh or with both. Quarterly action taken reports as per
Annexure-I are required to be submitted to Department of Environment, Government of National Capital Territory of
Delhi on email ID: senv@nic.in in annexed format.
