## Report on Amendment to the Delhi Shops and Establishments Act, 1954 **1. Executive Summary:** This report analyzes an amendment to the Delhi Shops and Establishments Act, 1954, as notified by the Government of the National Capital Territory of Delhi on October 13, 2022. This amendment adds entry 272 to the Schedule of the Act, granting exemptions from certain provisions of Section 15 of the Act to five Disruptive Health Solutions Pvt. Ltd. establishments and one Bizbox publishing pvt. Limited establishment subject to specific conditions regarding working hours, overtime wages, shift work, employee safety, and compliance with labor laws. The primary purpose of this amendment, as inferred from the text, is to provide operational flexibility to these specific establishments while ensuring the protection of employee rights. **2. Introduction:** The purpose of this report is to provide an informative overview of an amendment to the Delhi Shops and Establishments Act, 1954, based solely on the official notification provided. This report will outline the specific changes introduced, their likely rationale, and potential implications for affected establishments and employees. **3. Policy Overview:** * **Original Policy:** Delhi Shops and Establishments Act, 1954. * **Core Objective(s):** The Delhi Shops and Establishments Act, 1954 generally aims to regulate the conditions of work and employment in shops, commercial establishments, residential hotels, restaurants, eating houses, theaters, and other places of public amusement or entertainment in the National Capital Territory of Delhi. * *Inferred from text:* Section 4 allows exemptions to certain provisions of the act, implying a goal to balance regulatory oversight with operational flexibility for specific businesses. **4. Background and Rationale:** This amendment appears to address a need for operational flexibility within specific establishments, namely the six businesses mentioned, while maintaining employee protections. The amendment exempts these establishments from certain aspects of Section 15 (likely related to working hours), which suggests that these establishments may require different or extended operating hours. The conditions attached to the exemption indicate a focus on preventing overwork and ensuring fair compensation and safe working conditions for employees. **5. Key Provisions / Changes:** This amendment focuses *specifically* on the changes introduced by the *provided amendment text*. * **What specific part of the original policy is being changed:** An exemption from Section 15 of the Delhi Shops and Establishments Act, 1954, is being granted through an addition to the Schedule of the Act. * **What the *new* rule/provision *is*, based *only* on the amendment text:** * The following establishments are added to the Schedule of exempted establishments, under serial number 272: 1. Bizbox publishing pvt. Limited (lajpat nagar delhi) 2. Disruptive Health Solutions Pvt. Ltd. (Guru Ramdass Nagar Laxmi Nagar, Delhi) 3. Disruptive Health Solutions Pvt. Ltd. (Balco Apartment near Patparganj Delhi) 4. Disruptive Health Solutions Pvt. Ltd. (Pitampura Delhi) 5. Disruptive Health Solutions Pvt. Ltd. (Sector 11 Rohini Delhi) * This exemption is conditional upon adherence to the following stipulations: * No employee shall be employed or allowed to work for more than nine hours including that of meal and rest on any day and for not more than forty-eight hours a week. * No employee shall be allowed to work for more than five hours at a stretch. * Overtime wages shall be paid to eligible employees at double the normal rate. * Biometric machine records (if maintained) shall be preserved for a duration similar to other registers and records. * Shift work, if any, shall be arranged so that no employee is forced to work in night shift only. * Employer shall arrange for safety, security, and transportation of employees working overtime or in shifts outside of normal hours. * The employer shall install Closed Circuit Television (CCTV) for videography of the establishment and preserve the recordings for at least six months. * Employees working on national holidays shall be given compensatory leave and double rate of wages as overtime. * Weekly off days will be allowed to employees in rotation. * The employer shall ensure that workers are provided all the legal benefits under various labor laws, including PF, ESI, Bonus, and Leave facility, and the same be put on website of the shop establishment. * Payment of wages shall be made by cheque or Electronic Clearing Service (ECS). * The exemption does not override other notifications issued by other authorities or agencies. * A copy of the notification shall be prominently displayed at the employee entrance/exit. * **Explain the *difference* or the *effect* of this specific change:** This amendment effectively allows the listed establishments to potentially operate with more flexible hours, as long as they adhere to the specific conditions listed to protect employee rights and well-being. Without the exemption, Section 15 would presumably impose stricter limitations on working hours. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders are: * The management and employees of Bizbox publishing pvt. Limited and the five Disruptive Health Solutions Pvt. Ltd. establishments listed in the notification. * The Labour Department of the Government of the National Capital Territory of Delhi, responsible for enforcing the Delhi Shops and Establishments Act, 1954, and monitoring compliance with the conditions of the exemption. **7. Implementation Aspects (Inferred):** * **Responsible agency/bodies mentioned:** The Labour Department of the Government of the National Capital Territory of Delhi is implicitly responsible for oversight. The "Chief Inspector of Shops" is mentioned as an entity to whom CCTV recordings may be submitted on demand. * **Timelines or procedures specified:** The notification requires CCTV recordings to be preserved for at least six months. There is no explicit timeline for implementation, but immediate compliance is implied. **8. Expected Outcomes / Impact of Changes:** The likely intended outcomes of this amendment are: * To provide the listed establishments with greater operational flexibility regarding working hours, potentially enabling them to better meet business demands. * To ensure that employee rights are protected by requiring overtime pay, compensatory leave, and adherence to other labor laws, even with the flexibility in working hours. * To enhance transparency and accountability through the CCTV recording requirement. **9. Conclusion:** The amendment to the Delhi Shops and Establishments Act, 1954, detailed in this report provides a specific exemption to Bizbox publishing pvt. Limited and five Disruptive Health Solutions Pvt. Ltd. establishments, subject to stringent conditions aimed at safeguarding employee welfare. This amendment reflects a balancing act between fostering business flexibility and upholding labor standards. Its effectiveness will depend on the diligent implementation and oversight by the Labour Department and the compliance of the exempted establishments.
