जनयम एव ंित ें
1. भारतीय प्रौद्योजगकी सस्ट्ं थान ददल्ली िौज खास जो दक ईपभोगी संस्ट्था के रूप में संदर्भभत िै, को सात वर्षों की ऄवजध के जलए
पौधों के सम्पूणा जवकास एवं रखरखाव िते ु ईपरोिानुसार 89,49,000/-रुपये नवासी लाख ईनचास िजार मात्र
@ रु. 57000/- प्रजत वृक्ष) की राजि ऄजग्रम रूप से जमा करवानी िोगी और यदद ईपभोगी संस्ट्था द्वारा 2, 3 और 4 में
ईजल्लजखत जनयमों और ितों का पालन निीं दकया जाता िै, तो आस राजि को जब्त कर जलया जाएगा और आस राजि को वन
जवभाग द्वारा वृक्षारोपण के जलए ईपयोग दकया जाएगा ।
2. ईपभोगी सस्ट्ं था द्वारा वक्षृ ों का प्रत्यारोपण/ कटाइ िरूु करन ेस ेपिल ेपूरी की जान ेवाली अवश्यक ितें:-
a. ददल्ली वृक्ष संरक्षण ऄजधजनयम, 1994 की धारा 12 के ऄनुपालन में ईपभोगी संस्ट्था द्वारा संबंजधत वृक्ष ऄजधकारी /
ईप- वन संरक्षक को जवस्ट्तृत वृक्षारोपण कायाक्रम प्रस्ट्तुत दकया जाएगा ।
b. ईपभोगी संस्ट्था द्वारा साआट की तैयारी और वृक्षारोपण के जलए एक जवस्ट्तृत योजना प्रस्ट्तुत दकया जाएगा ।
c. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक वृक्षों की कटाइ/ प्रत्यारोपण से पूवा कोइ लंजबत मुकदमा या
स्ट्थगन अदिे दकसी भी न्यायालय / ऄन्य प्राजधकरण द्वारा पाररत न हुअ िो।
d. ईपभोगी संस्ट्था द्वारा वृक्षों को कटाइ/ प्रत्यारोपण का काया सभी वैधाजनक मंजूररयों को लेने के बाद िी िुरू दकया
जाएगा।
e. ईपभोगी संस्ट्था के द्वारा वन मंजूरी में और ऄन्य मंजूरी में ईजल्लजखत सभी ितों, यदद कोइ िो, का जनष्ठापूवाक पालन
दकया जाएगा ।
3. वक्षृ ों के प्रत्यारोपण/कटाइ के दौरान पूरी की जान ेवाली अवश्यक ितें:-
a. क्र. सं. 2 में ितों के ऄनुपालन िोने के तुरंत बाद ईपभोगी संस्ट्था द्वारा वृक्षों का प्रत्यारोपण िुरू दकया जाएगा और
आसे छ: मिीने के ऄंतराल में पूणा दकया जाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोने का बाद एक सम्पूणा ररपोटा[PART IV DELHI GAZETTE : EXTRAORDINARY 3
संबंजधत वृक्ष ऄजधकारी /ईप-वन संरक्षक को प्रस्ट्तुत की जायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की दरू ी
4 मीटर (मबद ुसे मबद)ु से कम निीं िोनी चाजिए ।
b. ईपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में ईजल्लजखत सभी ितों का पालन दकया जाएगा ।
c. ईपभोगी संस्ट्था द्वारा 73 वृक्षों को काटने से पूवा प्रत्यारोपण दकया जाएगा । 73 वृक्षों की ऄनुमजत 84 वृक्षों के सफल
प्रत्यारोपण और संबंजधत वृक्ष ऄजधकारी/ईप-वन संरक्षक को ऄनुपालन प्रमाणपत्र प्रस्ट्तुत करने के बाद दी जायेगी।
d. ईपभोगी संस्ट्था द्वारा प्रत्यारोपण/काटे जाने वाले वृक्षों की प्रगजत ररपोटा संबंजधत वृक्ष ऄजधकारी/ईप- वन संरक्षक
को वृक्षों के पूणा जववरण के साथ प्रस्ट्तुत की जाएगी।
e. यदद दकसी वृक्ष में पजक्षयों का घोंसला पाया जाता ि ै तो ईसे तब तक निीं काटा/ प्रत्यारोपण दकया जाएगा जब
तक दक पक्षी ईसे स्ट्वतः छोड न द।ें
f. ईपभोगी संस्ट्था द्वारा 157 वृक्षों के ऄलावा दकसी भी वृक्ष की कटाइ / प्रत्यारोपण ददल्ली वृक्ष संरक्षण ऄजधजनयम,
1994 के ऄन्तगात एक ऄपराध िोगा।
g. ईपभोगी संस्ट्था द्वारा वृक्षों को िटाए जाने के ईपरान्त प्राप्त लकजडयों की नीलामी की जाएगी और ईससे प्राप्तधन
राजि को सरकार के खाते मे राजस्ट्व के रूप में जमा की जाएगी।
h. ईपभोगी संस्ट्था द्वारा वृक्षों के उपरी िाखाओं को काटे जाने के ईपरान्त प्राप्त लकजडयों को मुफ्त में जनकटतम
सावाजजनक िवदािों में प्रयोग िते ु सौपी जाएगी और आसकी सूचना संबंजधत वृक्ष ऄजधकारी/ईप- वन संरक्षक को
भी दी जाएगी।
i. ईपभोगी संस्ट्था द्वारा वृक्षों को िटाए जाने के स्ट्थल से लकजडयों को ले जाने से पूवा संबंजधत वृक्ष ऄजधकारी/
ईप- वन संरक्षक से ढुलाइ ऄनुमजत प्राप्त करनी िोगी।
j. ईपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण / कटाइ और ईसमें पैदा िोने वाली वन ईपज को सावाजजनक श्मिान मे
90 ददनों के ऄंदर पूरा दकया जाएगा ।
k. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत निीं दकया जाएगा ।
l. ईपभोगी संस्ट्था के द्वारा वन मंजूरी में और ऄन्य मंजूरी में ईजल्लजखत सभी ितों, यदद कोइ िो, का जनष्ठापूवाक पालन
दकया जाएगा ।
m. ईपभोगी संस्ट्था के द्वारा ऄनुमोददत वृक्ष संरक्षण योजना के ऄंतगात प्रस्ट्तुत सभी गजतजवजधयों का जनष्ठापूवाक पालन
दकया जाएगा ।
n. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक वृक्ष प्रत्यारोपण नीजत 2020 की धारा 4 (6-बी) के
ऄंतगात सभी प्रावधानों का जनष्ठापूवाक पालन दकया गया ि ैऔर आसका जववरण संबंजधत वृक्ष ऄजधकारी / ईप- वन
संरक्षक को प्रस्ट्तुत दकया जाएगा ।
o. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जाएगा दक सभी प्रजतरोजपत वृक्षों के जलए जो 15 फीट उंचाइ और
कम से कम 6 आंच व्यास वाले स्ट्वदेिी वृक्ष प्रजाजतयों में जीजवत निीं रि पाते िैं, तो ईन्ि ें1:5 के ऄनुपात में लगाया
जाएगा । अवश्यक ऄजतररि भूजम ईपभोगी संस्ट्था द्वारा प्रदान की जाएगी और वृक्षारोपण स्ट्वयं की लागत पर
दकया जाएगा।
4. वक्षृ ऄजधकारी / ईप- वन संरक्षक द्वारा सफल वक्षृ ारोपण और सरु क्षा जमा राजि जारी करन े पर जवचार करन े के जलए
अवश्यक ित:ें-
a. ईपरोि ताजलका 1 (क) और (ख) के ऄनुसार, दिे ी प्रजाजतयों के 1570 पौधो का 100 % प्रजतपूरक वृक्षारोपण
और ईनका सात वर्षों तक रखरखाव ईपभोगी संस्ट्था द्वारा दकया जायेगा । आस वृक्षारोपण के सफलतापूवाक
स्ट्थापना के बाद ईपभोगी संस्ट्था द्वारा जनगरानी की जाएगी।
b. 157 वृक्षों के प्रत्यारोपण/ काटे दकए जाने के बदले मे 1:10 के ऄनुपात मे स्ट्वदिे ी प्रजाजतयों के 6-8 फीट की उाँचाइ
वाले 1570 पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया जाएगा । वृक्षारोपण की ऄनुमजत के जारी िोने
के तीन मिीने के ऄंदर जनधााररत की गइ भूजम पर ऄजतररि ईपायों के साथ वृक्षारोपण स्ट्थल के ऄनुसार जवजिष्ट4 DELHI GAZETTE : EXTRAORDINARY PART IV]
वृक्षारोपण तकनीकों के द्वारा दकया जाएगा और ऄजग्रम सात (7) वर्षों के जलए रखरखाव तथा ईसके बाद ईनका
रखरखाव ईपभोगी संस्ट्था द्वारा ऄपनी स्ट्वयं की लागत पर दकया जाएगा ।
c. यदद ईपभोगी संस्ट्था सफलतापूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती िै । ईपभोगी संस्ट्था द्वारा ऄजतररि
साआट सुधार खचों को जमा दकया जाएगा जो दक सम्बंजधत वृक्ष ऄजधकारी / ईप- वन संरक्षक द्वारा गणना के
ऄनुसार वृक्षारोपण के जलए ईपयुि बनाने के जलए अवश्यक िो सकती ि।ै
d. जो भूजम प्रजतपूरक वृक्षारोपण/ वृक्ष प्रत्यारोपण के जलए अवंरटत ि,ै ईसका ईपयोग दकसी ऄन्य कायों के जलए राज्य
सरकार की स्ट्वीकृजत के जबना निीं दकया जाएगा।
e. ईपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यजीव जवभाग राष्ट्रीय राजधानी क्षेत्र ददल्ली सरकार को
जनधााररत करेंगी और आसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के ऄंत में संबंजधत वृक्ष ऄजधकारी / ईप- वन संरक्षक को
प्रस्ट्तुत की जाएगी ।
f. भूजम स्ट्वाजमत्व एजेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोइ
ऄजतक्रमण न िो ।
g. ईपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृदा नमी संरक्षण काया की गजतजवजधयों को दकया
जाएगा।
h. ईपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक आस प्रस्ट्ताव की योजना को पररवर्भतत निीं दकया जाएगा ।
5. 157 वृक्षों को प्रत्यारोपण/ कटाइ के जलए ऄनुमजत ईनके स्ट्वयं के जोजखम पर और दकसी भी ऄन्य व्यजि के दावे के पक्षपात के
जबना, जो वृक्षो और भूजम पर सिी िो सकती िै, दी जा रिी ि ै।

Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Lt. Governor of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 3.0 ha approx. for construction of Engineer Block 99B & 99C at Mini
Academic Complex, IIT Delhi Campus, Hauz Khas, New Delhi from the provision of sub-section (3) of section 9 of
the said Act.

(b) Transplantation of 84 numbers of trees which are standing on site shall be done by User within the project
sitewith their own funds.
TERMS & CONDITIONS
1. Indian Institute of Technology (IIT) Delhi Hauz Khas herein referred to as User Agency, shall make an
advance deposit of an amount of Rs.89,49,000/- (Rupees Eighty Nine Lakh Forty Nine Thousand Only@
Rs. 57000/- per tree) towards security deposit for creation and maintenance of compensatory plantation for a
period of Seven (7) years and the same shall be forfeited and utilized for plantation by the Forest Department
if terms and conditions mentioned at 2, 3 & 4 are not followed by User Agency.
2. The conditions required to be fulfilled before starting transplantation/ felling of trees by User
Agency:-
a. Detailed plantation schedule shall have to be submitted by User Agency to concerned Tree Officer /
Deputy Conservator of Forestsin compliance with Section-12 of Delhi Preservation of Trees Act, 1994.
b. User Agency shall submit a detailed plan for site preparation and plantation.
c. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling/ transplantation of trees.
d. Before the removal of trees from the site is commenced, all requisite statutory clearances shall
necessarily be obtained by the User Agency.
e. It should be ensured by the User Agency that all the conditions mentioned in Forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
3. The conditions required to be fulfilled during the transplantation/felling of trees:-
a. Transplantation of trees shall be initiated immediately after conditions in point no. 2 is satisfied and
should be completed not later than six (06) months of such date, after which a completion report has to6 DELHI GAZETTE : EXTRAORDINARY PART IV]
be submitted to theconcerned Tree Officer / Deputy Conservator of Forests. The spacing of the
transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
b. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by
User Agency.
c. The transplantation shall be carried out prior to felling of 73 number of trees permitted herein. The
73 trees shall be removed / felled after successful transplantation of 84 trees and submission of
compliance certificate to concerned Tree Officer / Deputy Conservator of Forests.
d. The progress report of transplantation/ felling shall be submitted to Tree Officer / Deputy Conservator of
Forests (South) along with complete details of trees by the User Agency.
e. If any tree is found to have nest of birds it should not be felled / transplanted till the same is abandoned
by the birds.
f. Transplantation / felling of any tree apart from 157 trees by User Agency shall constitute an offence
under Delhi Preservation of Trees Act (DPTA), 1994.
g. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue
to the Government account by the User Agency.
h. The lops & tops of the trees shall be sent / supplied to the nearest crematorium free of cost and the same
should be reported to concerned Tree Officer / Deputy Conservator of Forestsby User Agency.
i. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said
wood shall be obtained from the concerned Tree Officer / Deputy Conservator of Forestsby User
Agency.
j. Transplantation/ felling of trees and transportation of forest produce arising there from to the public
crematorium shall be completed within 90 days.
k. The User Agency shall ensure that the plan of this proposal shall not be changed.
l. It should be ensured by the User Agency that all the conditions mentioned in forest clearance and other
clearances, if any obtained, shall be followed scrupulously.
m. All activities as submitted under approved Tree Preservation Plan should be followed scrupulously.
n. It must be ensured that all provisions under section 4 (6-b) of Tree Transplantation Policy 2020 have
been followed and details of the same should be submitted to the Tree Officer / Deputy Conservator of
Forests concerned.
o. User Agency must ensure that, for all transplanted trees that do not survive indigenous tree species with
15 feet height and at least 6 inch diameter is planted in 1:5 ratio. The excess land required should be
provided by User Agency & plantation has to be done at own cost.
4. The conditions required to be fulfilled for considering successful plantation & release of Security
Deposit by the Tree Officer / Deputy Conservator of Forests:-
a. 100% Compensatory Plantation of 1570 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as mentioned on table above.
b. 1570 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in
ratio of 1:10 on non-forest land in lieu of felling/ transplantation 157 number of trees. The plantation
shall be done by following site specific plantation techniques with additional measures on identified land
within three months of issue of tree removal permission and maintenance for next Seven (7) years shall
be carried out there after by User Agency with their own funds.
c. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also
deposit extra site improvement expenses which may be required to make the site suitable for plantation
as calculated by Tree Officer / Deputy Conservator of Forestsconcerned (as deposits).
d. The land over which compensatory plantation/ Tree transplantation raised shall not be utilized for other
purpose without the approval of the State Government.[PART IV DELHI GAZETTE : EXTRAORDINARY 7
e. User Agency shall maintain plantation journals as prescribed by Department of Forests and Wildlife,
Govt. of NCT of Delhi and a copy of the same shall be submitted to the concerned Tree Officer / Deputy
Conservator of Forestsat the end of every financial year.
f. Land Owning agency shall ensure that there is no encroachment in area proposed for compensatory
plantation/ transplantation.
g. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation/ transplantation site.
h. The User Agency shall ensure that the plan of this proposal shall not be changed.
5. Permission for transplantation/ felling of 157numbers of tress is being granted to the User Agency at their
own risk and without prejudice the claim(s) of any other person(s) who may be having any right(s) over the
land or the trees.
