(i) उपयिुड उजल्लजखत कायों में लग ेकमडकारों के जहत संरजित हों;

(ii) ऐसे कमडकार को कोल इंजडया जलजमटेड, कोयला मंत्रालय, भारत सरकार द्वारा जनयिु उच्च अजधकार प्राप्त सजमजत के जसफाररिों के अनुसार और कोल इंजडया जलजमटेड द्वारा समय-समय पर अजधसूजचत िरों पर मििरू ी और अन्द्य प्रसुजिधाए ं िी िाए;ं 6145 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(iii) केन्द्रीय ठेका श्रम सलाहकार बोडड को यह सुजनजश्चत करने और िांच करन े के जलए प्रजतष्ठान का जनरीिण करने का अजधकार होगा दक क्या कोई ओजडिा कोल एडं पािर जलजमटेड अर्ाडत, मनोहरपुर कोयला पररयोिना, सुंिरगढ, ओजडिा म ें ऐसे कमडकारों को ऐसी मििरू ी और प्रसुजिधााँए िी िाती ह;ैं

(iv) ओजडिा कोल एडं पािर जलजमटेड का प्रबंधन यह सुजनजश्चत करेगा दक िब कभी संजििा में कोई पररितडन होता ह,ै तो जिद्यमान ऐसे ठेका कमडकारों को, िो कायडरत ह,ैं कतडव्यों का समाधानप्रि अनपु ालन के अधीन रहते हुए, आने िाले ठेकेिार द्वारा जनयोिन म ें अजधमान दिया िाएगा;

(v) उि अजधसूचना संखया का.आ. 2063(अ), तरीख 21 िून, 1988 की अनुसूची के क्रम संखया 1 स े3 के सामन ेजिजनर्िडष्ट कोयला खनन संकमड पर प्रासंजगक या आनुषंजगक नौकरी में कायडरत कमडकार कोल इंजडया जलजमटेड, कोयला मंत्रालय, भारत सरकार द्वारा जनयिु उच्च अजधकार प्राप्त सजमजत द्वारा अिधाररत और कोल इंजडया जलजमटेड द्वारा समय-समय पर अजधसूजचत िरों के अनुसार मििरू ी प्राप्त करेंग;े

(vi) ठेकेिार, प्रधान जनयोिा के सार्-सार् उि उच्च अजधकार प्राप्त सजमजत की मििरू ी की, िो प्रत्येक छह मास में बढ़ती ह ै और खान अजधजनयम, 1952 (1952 का 35) के उपबंधों के अनुसार अन्द्य फायिे का भी संिाय सुजनजश्चत करेगा;

(vii) ठेका कमडकार, उपिान संिाय अजधजनयम, 1972 (1972 का 39) के उपबंधों के अधीन आएंग;े और

(viii) ठेका कमडकारों को खान अजधजनयम, 1952 (1952 का 35) के उपबंधों के अनुसार मििरू ी सजहत बोनस संित दकया िाएगा और छुट्टी िी िाएगी । [फा. स. ं एस-16012/01/2018-एल.डब्लल्य.ू ] आिुतोष ए.टी. पडे णेकर, संयुक् त सजचि MINISTRY OF LABOUR AND EMPLOYMENT

NOTIFICATION New Delhi, the 16th September, 2025 S.O. 4190(E).— In exercise of the powers conferred by section 31 of the Contract Labour (Regulation and Abolition) Act, 1970 (37 of 1970), the Central Government, after consultation with the Central Advisory Contract Labour Board, hereby exempts the Coal Mines allotted to the Odisha Coal and Power Limited, Zone-A, Ground Floor, Fortune Towers, Chandra sekharpur, Bhubaneswar-751023, namely the Manoharpur Coal Mine Project, Sundergarh, Odisha from the applicability of notification of the Government of India in the Ministry of Labour vide notification number S.O. 2063 dated the 21st June, 1988, published in the Gazette of India, Part II, section 3, sub-section (ii), in respect of employment of contract labour in the works specified in the Schedule to the said notification against serial numbers 1 to 3, for a period of three years from the date of publication of this notification in the Official Gazette subject to the following conditions,

namely:-

(i) The interest of the workmen engaged in the above mentioned works be protected;

(ii) Such workmen be paid wages and other benefits as per the recommendations of the High Powered Committee appointed by the Coal India Limited, Ministry of Coal, Government of India and the rates notified by the Coal India Limited from time to time;

(iii) The Central Advisory Contract Labour Board shall have the right to inspect the establishment to ensure and check whether such wages and benefits are given to such workers in the Odisha Coal and Power Limited, namely the Manoharpur Coal Mine Project, Sundergarh, Odisha;

(iv) The Management of Odisha Coal and Power Limited shall ensure that whenever there is a change of contract, existing contract workmen who are working may be given preference in employment by the incoming contractor, subject to satisfactory performance of duties;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3

(v) The workmen working in jobs ancillary or incidental to coal mining works specified against serial numbers 1 to 3 of the Schedule to the said notification number S.O. 2063(E), dated the 21st June, 1988, shall get wages as determined by the High Powered Committee appointed by the Coal India Limited, Ministry of Coal, Government of India and the rates notified by the Coal India Limited from time to time;

(vi) The contractor, as well as the Principal Employer, shall ensure payment of the said High Powered Committee wages, which increases every six months, and also other benefits as per the provisions of the Mines Act, 1952 (35 of 1952);

(vii) The contract workers shall be covered under the provisions of the Payment of Gratuity Act, 1972 (39 of 1972); and
