पठरयोजनाओं (डब्लल्यूपीपी) से उत्पाददत ऊजाा स े की जाएगी और 31 माचा 2022 तक चाल ू की गई डब्लल्यपू ीपीसे 7% से अजधक पिन ऊजाा की खपत होगी। (3) एचपीओ की पूर्भत 8 माचा 2019 के बाद िरूु की गई हाइड्रो पािर पठरयोजनाओं [बडी हाइड्रो पठरयोजनाओं (एलएचपी), पंप स्ट्टोरेज पठरयोजनाओं और लघु हाइड्रो पठरयोजनाओं (एसएचपी) सजहत] स े उत्पाददत ऊजाा से की जाएगी। (4) अन्य आरपीओ की पूर्भत उपरोि 4(2) और 4(3) में अिर्भणत दकसी भी निीकरणीय ऊजा ा जिद्युत पठरयोजना से उत्पाददत ऊजाा से की जाएगी और इसमें जल जिद्युत पठरयोजनाएं [बडी जलजिद्युत पठरयोजनाओं (एलएचपी), पंप भंडारण पठरयोजनाओं और लघ ुजलजिद्युत पठरयोजनाओं (एसएचपी) सजहत] िाजमल होंगी जो 8 माचा 2019 से पहले कमीिन की गई थी। (5) दकसी जििेर् िर्ा में 'अन्य आरपीओ' श्रेणी की उपलजब्लध म ें रही दकसी कमी को या तो उस िर्ा के जलए 'पिन आरपीओ' से परे 31 माचा 2022 के बाद कमीिन की गई पठरयोजनाओं और लघ ुजलजिद्युत पठरयोजनाओं (एसएचपी) सजहत], से अजधक ऊजाा खपत आंजिक रूप स े दोनों के साथ परू ी की जाएगी। इसके अलािा, दकसी जििेर् िर्ा म ें 'पिन आरपीओ' की उपलजब्लध म ें कोई कमी जल जिद्युत संयत्रों से खपत की गई अजतठरि ऊजाा से परू ी की जाएगी, जो उस िर्ा के जलए 'एचपीओ' से अजधक ह ैऔर इसके जिपरीत। (6) आरपीओ में और कमी, यदद कोई हो, की गणना के जलए समय-समय पर संिोजधत केंद्रीय जिद्युत जिजनयामक आयोग (निीकरणीय ऊजा ाउत्पादन के जलए निीकरणीय ऊजाा प्रमाणपत्र हते ुजनयम और ितें) जिजनयम, 2022 के अनुसार निीकरणीय ऊजाा प्रमाणपत्रों पर जिचार दकया जाएगा। (7) भारत के बाहर से आयाजतत जलजिद्युत को एचपीओ की पूर्भत के जलए जिचार नहीं दकया जाएगा और जलजिद्युत पठरयोजनाओं के संिोजधत कमीिननग िेड्यलू के आधार पर एचपीओ रैजेक्टरी को िार्भर्क आधार पर ट्रू दकया जाएगा। इसके अलािा, एचपीओ के अनुपालन को सुजिधाजनक बनाने के जलए, उपलब्लध जलजिद्युत ऊजाा प्रमाणपत्रमैकेजनज्म का उपयोगदाजयत्िइकाई द्वारा दकया जा सकता ह।ै 4.0 प्रमखु जिजनयमों के जिजनयम 6(1) म ेंिजृ ि: (f) सभी पात्र इकाईयोंके जलए आरपीओ से अजधक निीकरणीय ऊजाा स्रोतों से जबजली की खरीद का प्रमाणन और गैर-दाजयत्ि और दाजयत्ि इकाईयों के जलए आरपीओ अनुपालन तथा अजतठरि निीकरणीय खरीद की मात्रा की गणना। 5.0 प्रमखु जिजनयमों के जिजनयम 7(3) और 8(2) के प्रथम प्रािधान म ें सिं ोधन: बिते दक बीजी/एफडीआर का मूल्य जपछले तीन (3) महीनों के जलए पािर एक्सचेंज (आईईएक्स) में खोजे गए निीकरणीय ऊजा ा प्रमाणपत्र (आरईसी) का भाठरत औसत मूल्य होगा। 6.0 प्रमखु जिजनयमों के जिजनयम 9(1) के प्रथम प्रािधान म ें सिं ोधन: बिते दक आरपीओ लक्ष्य को पूरा करन े के जलए इकाइयों की कमी के जलए, जबजली की भौजतक खरीद के बाद, जितरण लाइसेंसधाठरयों को आरईसी लागत की अनुमजत दी जा सकती है, जजसे केंद्रीय जिद्युत जिजनयामक आयोग (निीकरणीय ऊजाा उत्पादन के जलए निीकरणीय ऊजाा प्रमाणपत्र हतेु जनयम और ितें)जिजनयम, 2022 समय- समय पर संिोजधत के अनुसार माना जाएगाऔर इसे ट्रू-अप दकया जाएगा। 7.0 प्रमखु जिजनयमों के जिजनयम 10 के िीर्का म ें सिं ोधन: 10. आरपीओ अनुपालन के जलए कमी का उपचार 8.0 प्रमखु जिजनयमों के जिजनयम 12 म ें सिं ोधन: 12. आरपीओ के गरै अनपु ालन के जलए जमु ाना ा (1) एक दाजयत्ि इकाई द्वारा आरपीओ लक्ष्यों का अनुपालन नहीं करने पर आरपीओ म ें कमी की मात्रा के जलए, संबंजधत िर्ा के जलए पािर एक्सचेंज (आईईएक्स) में प्राप्त हुए भाठरत औसत आरईसी मूल्य के 10% की दर से जुमााना लगाया जाएगा। बिते दक आरपीओ लक्ष्यों के गैर-अनुपालन के कारण जितरण लाइसेंसधाठरयों पर लगाए गए जुमााने की राजि डीईआरसी के जिजनयम 124 (टैठरफ के जनधाारण के जलए जनयम और ित)ें जिजनयम, 2017के अनुसार प्रासंजगक जित्तीय िर्ा के टू-अप के Delhi, the 6 April, 2023 Delhi Electricity Regulatory Commission Renewable Purchase Obligation and Renewable Energy Certificate Framework Implementation) (First Amendment) Regulations, 2023 F.3(679)/Tariff/DERC/2022-23/7460/28.—In exercise of powers conferred under Section 181 read with Section 61 and Section 86(1)(b) of the Electricity Act, 2003 (Act 36 of 2003) and all other powers enabling it in this behalf and after previous publication, the Delhi Electricity Regulatory Commission hereby makes the following Regulations to amend the Delhi Electricity Regulatory Commission (Renewable Purchase Obligation and Renewable Energy Certificate Framework Implementation) Regulations, 2021(hereinafter referred to as “the Principal Regulations”) 1.0 Short Title and Commencement: (1) These Regulations may be called the Delhi Electricity Regulatory Commission Renewable Purchase Obligation and Renewable Energy Certificate Framework Implementation) (First Amendment) Regulations, 2023and shall be applicable from 1/04/2023 onwards. 2.0 Amendment in Regulation 2(10) of Principal Regulations: (10) “Consumption” means – In case of Distribution Licensees percentage of Total Sale of Power to its Retail Consumers in its Area of Supply. In case of Open Access consumers as the Total Energy recorded by the meter for the whole year.” 3.0 Amendment in Regulation 4 of Principal Regulations: 4. (2) Wind RPO shall be met by energy produced from Wind Power Projects (WPPs) commissioned after 31st March 2022 and the wind energy consumed over and above 7% from WPPs commissioned till 31st March 2022. (3) HPO shall be met by Energy produced from Hydro Power Projects [including Large Hydro Projects (LHPs), Pumped Storage Projects & Small Hydro Projects (SHPs)] commissioned after 8th March 2019.[PART III DELHI GAZETTE : EXTRAORDINARY 5 (4) Other RPO shall be met by Energy produced from any Renewable Energy Power Project not mentioned in 4(2) &4(3) above and shall include Hydro Power Projects [including Large Hydro Projects (LHPs), Pumped Storage Projects & Small Hydro Projects (SHPs)] commissioned before 8th March 2019. (5) Any shortfall remaining in achievement of 'Other RPO' category in a particular year shall be met with either the excess energy consumed from WPPs, commissioned after 31st March 2022 beyond 'Wind RPO' for that year or with excess energy consumed from eligible LHPs [including Large Hydro Projects (LHPs), Pumped Storage Projects & Small Hydro Projects (SHPs)], commissioned after 8th March 2019 beyond 'HPO' for that year or partly from both. Further, any shortfall in achievement of 'Wind RPO' in a particular year shall be met with excess energy consumed from Hydro Power Plants, which is in excess of `HPO' for that year and vice versa. (6) Renewable Energy Certificates shall be considered as per Central Electricity Regulatory Commission (Terms and Conditions for Renewable Energy Certificates for Renewable Energy Generation) Regulations, 2022 as amended from time to time, for computation of further shortfall in RPO, if any. (7) Hydro power imported from outside India shall not be considered for meeting HPO and the HPO Trajectory shall be trued up on an Annual Basis depending on the Revised Commissioning schedule of Hydro projects. Further to facilitate compliance of HPO, Hydro Energy Certificate mechanism, as available, may be utilized by Obligated Entity. 4.0 Addition in Regulation 6(1) of Principal Regulations: (f) Certification of Purchase of Electricity from Renewable Energy Sources in excess of RPO for all eligible entities and Computation of Quantum of RPO Compliance & Excess Renewable Purchase for non-obligated and obligated entities. 5.0 Amendment in 1st proviso of Regulation 7(3) and 8(2) of Principal Regulations: Provided that the value of BG/FDR shall be weighted average price of Renewable Energy Certificates (REC) discovered at Power Exchange (IEX) for past three (3) months. 6.0 Amendment in 1st proviso of Regulation 9(1) of Principal Regulations: Provided that for shortfall of units to meet RPO target, after physical procurement of power, the Distribution Licensees may be allowed REC cost which shall be considered as per Central Electricity Regulatory Commission (Terms and Conditions for Renewable Energy Certificates for Renewable Energy Generation) Regulations, 2022 as amended from time to time and shall be Trued-up. 7.0 Amendment in Heading of Regulation 10 of Principal Regulations: 10. TREATMENT OF SHORTFALL FOR RPO COMPLIANCE 8.0 Amendment in Regulation 12 of Principal Regulations: 12. PENALTY FOR NON COMPLIANCE OF RPO (1) Non-compliance of the RPO targets by an Obligated Entity shall attract penalty at the rate of 10% of weighted average REC price discovered at Power Exchange (IEX) for the relevant year, for quantum of shortfall in RPO. Provided that the amount of penalty imposed on the Distribution Licensees due to non-compliance of theRPO targets shall be reduced from the ARR during True up of the relevant Financial Year in terms of theRegulation 124 of the DERC (Terms and Conditions for Determination of Tariff) Regulations, 2017. Provided further that the amount of penalty to be levied on obligated Open Access consumers shall becomputed for relevant year by SNA and communicated to Distribution Licensee with a copy to Commission.The Distribution Licensee shall bill such penal amount in the electricity bill of Open Access consumers. Provided further that the penalty to be levied on remaining obligated entities will be computed for relevant year by SNA and the mechanism for its recovery will be dealt by the Commission on case to case basis.
