  • It outlines amendments related to Renewable Purchase Obligations (RPO) for obligated entities in Delhi, including definitions, targets, and compliance mechanisms.
  • The amendments also address penalties for non-compliance with RPO targets and the treatment of shortfalls.

Key Changes

  • Effective Date: The regulations are applicable from April 1, 2023.
  • Definition of Consumption: Clarifies the definition of 'Consumption' for distribution licensees and open access consumers.
  • RPO Targets: Specifies the RPO targets for obligated entities for financial years 2023-24, 2024-25, and 2025-26. For FY 2023-24, the Wind RPO is 1.60%, Other RPO is 24.81%, HPO Target (only for Distribution Licensee) is 0.66%, and the Total RPO Target is 27.07%.
  • Wind RPO Fulfillment: Wind RPO must be met by energy produced from wind power projects commissioned after March 31, 2022, with specific provisions for projects commissioned before that date.
  • HPO Fulfillment: HPO must be met by energy produced from hydro power projects commissioned after March 8, 2019, including Large Hydro Projects (LHPs), Pumped Storage Projects, and Small Hydro Projects (SHPs).
  • Other RPO Fulfillment: Other RPO is to be met by energy from renewable energy projects not covered under Wind or HPO, including hydro projects commissioned before March 8, 2019.
  • Shortfall Adjustments: Allows for adjustments in case of shortfalls in 'Other RPO' or 'Wind RPO' achievement by utilizing excess energy from other renewable sources.
  • Renewable Energy Certificates (REC): RECs will be considered as per Central Electricity Regulatory Commission (Terms and Conditions for Renewable Energy Certificates for Renewable Energy Generation) Regulations, 2022, for calculating RPO shortfalls.
  • HPO Import Restrictions: Hydro power imported from outside India will not be considered for meeting HPO.
  • Certification and Computation: Addition of certification of purchase of electricity from renewable energy sources in excess of RPO for all eligible entities and computation of quantum of RPO compliance & Excess Renewable Purchase for non-obligated and obligated entities.
  • BG/FDR Value: The value of Bank Guarantee/Fixed Deposit Receipt shall be the weighted average price of Renewable Energy Certificates (REC) discovered at Power Exchange (IEX) for the past three months.
  • REC Cost for Shortfall: Distribution licensees may be allowed REC cost for shortfall of units to meet RPO target, after physical procurement of power, which shall be considered as per Central Electricity Regulatory Commission (Terms and Conditions for Renewable Energy Certificates for Renewable Energy Generation) Regulations, 2022.
  • Penalty for Non-Compliance: Penalty for not meeting RPO targets is set at 10% of the weighted average REC price at the Power Exchange (IEX) for the relevant year, for the quantum of shortfall in RPO.
  • Penalty Adjustment for Distribution Licensees: Penalties imposed on distribution licensees for RPO non-compliance will be reduced from their Aggregate Revenue Requirement (ARR) during the true-up of the relevant financial year.
  • Open Access Consumer Penalties: Penalties for Open Access consumers will be computed by the State Nodal Agency (SNA) and billed by the distribution licensee.

Impact Analysis

Distribution Licensees

  • Action Items: Revise power procurement strategies to include more renewable energy sources. Factor in REC costs and potential penalties in financial planning. Coordinate with SNA for Open Access consumer penalties.

Open Access Consumers

  • Action Items: Assess current renewable energy consumption and procurement strategies. Procure RECs or renewable energy to meet RPO targets. Engage with distribution licensees and SNA to understand compliance requirements.

Renewable Energy Generators

  • Action Items: Explore opportunities to supply renewable energy to obligated entities. Participate in REC market.

State Nodal Agency (SNA)

  • Action Items: Develop a mechanism for monitoring RPO compliance. Calculate penalties for Open Access consumers and communicate to distribution licensees.

Delhi Electricity Regulatory Commission (DERC)

  • Action Items: Monitor RPO compliance by obligated entities. Ensure penalties are appropriately levied and collected. Address recovery mechanism for penalties on remaining obligated entities on case to case basis.
