L.-33004/99 सी.जी.-डी.एल.-अ.-04112025-267390 CG-DxLx-xEG-I0D4H1x1x2x0 25-267390 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4863] नई ददल्ली, मगं लर्ार, नर्म्ब र 4, 2025/कार्तकव 13, 1947 No. 4863] NEW DELHI, TUESDAY, NOVEMBER 4, 2025/KARTIKA 13, 1947 रसायन और उर्रव क मत्रं ालय (औषध जर्भाग) (राष्ट्रीय औषध मल्ू य जनधारव ण प्राजधकरण) आदेि नई ददल्ली, 4 नर्म् बर, 2025 का.आ. 5018(अ).—भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा िारी का. आ. 1394(अ) तारीख 30 मई, 2013 और का. आ. 5249(अ) तारीख 11 नर्म्बर, 2022 के साथ पठित औषध (कीमत जनयंत्रण) आदेि, 2013 के पैरा 4, 6, 10, 11, 14, 16, 17 और 18 द्वारा प्रदत्त िजियों का प्रयोग करत े हुए और भारत सरकार म ें रसायन एर् ं उर्वरक मंत्रालय (राष्ट्रीय औषध मूल्य जनधावरण प्राजधकरण) के का. आ. 1487(अ) ददनांक 27 मार्,व 2025 के आदेि के अजधक्रमण में िहां तक उसका संबंध नीर्े की सारणी के जर्जनर्मवजत पैक से ह,ै उन बातों के जसर्ाय अजधक्रान्त करते हुए जिन्ह ें ऐसे अजधक्रमण के पूर्व दकया गया ह ैया करन ेका लोप दकया गया है, राष्ट्रीय औषध मूल्य जनधावरण प्राजधकरण नीर् ेकी सारणी के स्ट्तंभ (5) म ेंजर्जनर्दवश्ट अजधकतम कीमत को उि सारणी के स्ट्तंभ (3) और (4) म ेंक्रमि: तत्सस्ट्थानी प्रजर्जियों म ेंजर्जनर्दवि खुराक रूप एर्ं प्रबलता और इकाई सजहत उस सारणी के स्ट्तंभ (2) में की तत्सस्ट्थानी प्रजर्जि में जर्जनर्दवि अनुसूजर्त जर्जनर्मवजतयों में से प्रत्सयेक की, र्स्ट्तु एर्ं सेर्ा कर, यदद कोई ह,ै को छोड़कर अजधकतम कीमत के रूप में जनयत करती हैःै 7353 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] सारणी क्रम दर्ाईया ं खरु ाक रूप एर् ंप्रबलता इकाई अजधिम मल्ू य (रु.) सख्ं या (1) (2) (3) (4) (5) 1 राइबोफ्लेजर्न गोली 10 जम.ग्रा. 1 गोली 1.11 2 पेठरटोजनयल डायजलजसस सॉल्यिू न लाइसेंस के अनुसार 1 जमली 0.22 3 इथाइल अल्कोहल (जडनेर्रड) सॉल्यिू न 70% 1 जमली 0.40 सॉल्यूिन फार इंफ्युिन 4 ह्युमन नामवल इम्युनोग्लोबुजलन 1 जमली 478.57 (16.5%) सॉल्यूिन फार इंफ्युिन 5 ह्युमन नामलव इम्युनोग्लोबुजलन 1 जमली 206.53 (10%) सॉल्यूिन फार इंफ्युिन 6 ह्युमन नामलव इम्युनोग्लोबुजलन 1 जमली 148.60 (5%) नोट: (क) सरकार द्वारा इस प्रकार जनयत की गई और अजधसूजर्त की गई अजधकतम कीमत (र्स्ट्तु एर्ं सर्े ा कर, िो लाग ू हों सजहत) स ेअजधक कीमत पर अनुसूजर्त जर्जनर्मवजतयों के ब्ांडेड या िने ेठरक या दोनों रूपांतरों को बेर् रह ेअनुसूजर्त जर्जनर्मवजतयों के सभी जर्जनमावता, उपयुवि सारणी के स्ट्तंभ (5) में र्र्णवत अजधकतम कीमत (र्स्ट्तु एर्ं सेर्ा कर, िो लाग ूहों सजहत) से अजधक सभी ऐसी जर्जनर्मवतयों की कीमत का अधोमुखी पुनरीक्षण करेंगे। (ख) मौिूदा जनमावताओं को उपयिुव कजथत अनुसूजर्त जर्जनर्मवजतयों के अजधकतम खुदरा कीमत उपयुवि सारणी के स्ट्तंभ (5) में जर्जनर्दवि अजधकतम कीमत र्स्ट्त ु एर् ं सेर्ा कर सजहत से कम ह ै तो, िहां कही भी लागू हो, औषध (मूल्य जनयंत्रण) आदेि, 2013 के परै ाग्राफ 13(2) के अनुसार उसके मौिूदा अजधकतम खुदरा कीमत को बनाए रखना होगा। (ग) अगर जनमावताओं ने उपयिुव सारणी के स्ट्तंभ (5) में र्र्णवत अजधकतम कीमत पर सरकार को र्ास्ट्तर् में भुगतान दकया ह ैया यह देय ह ैतो र्े र्स्ट्तु एर्ं सेर्ा कर को िोड़ सकत े ह।ैं (घ) औषध (मल्ू य जनयंत्रण) आदेि, 2013 के पैराग्राफ 11 में ददए गए प्रार्धानों के तहत सम्बजन्धत जनमावताओं को उपयुवि सारणी के स्ट्तंभ (5) म ें जर्जनर्दवि अजधकतम कीमत के आधार पर अनुसूजर्त जर्जनर्मवजतयों के पैकों के जलए अजधकतम कीमत जनधावठरत करें। जनमावता औषध (मूल्य जनयंत्रण) आदेि, 2013 के परै ाग्राफ 24 के तहत फॉमव - V में अजधसूर्ना की तारीख से आईपीडीएमएस के माध्यम से भरकर एनपीपीए को एक मूल्य सूर्ी िारी करें तथा उसकी कॉपी राज्य औषजध जनयत्रं कों और जर्जनमावता जर्तरकों को िारी करें। (ङ) औषध (मल्ू य जनयंत्रण) आदेि, 2013 के पैरा 24 (4) के अनसु ार प्रत्सयेक फुटकर जर्क्रेता और जर्तरक जर्जनमावता द्वारा ददए गए रूप म ेंऐसे पठरसर, िहा ंकारोबार को इस प्रकार दकया िा रहा ह ैदक उससे परामषव के इच्छुक दकसी व्यजि के जलए पहुर्ं आसान हो, र्हां उसके दकसी सुस्ट्पि भाग पर कीमत सूर्ी और पूरक सूर्ी, यदद कोई हो, को प्रदर्षवत करेगा। (र्) उपयुवि सारणी में यथा जर्जनर्दवि खुदरा या प्रबलता या दोनों के साथ अनुसूजर्त जर्जनर्मजव त का कोई मौिूदा जर्जनमावता औषध मूल्य जनयंत्रण आदषे , 2013 के परै ा 2 (1) (य)ू के अनुसार कोई नई औषजध को लांर् करता ह ैतो ऐसे मौिूदा जर्जनमावता की औषध (मल्ू य जनयंत्रण) आदेि 2013 की अनुसूर्ी- II के अंतगवत यथा जर्जनर्दवि फामव- I में एनपीपीए को ऐसी नई औषजध के पूर् वमूल्य अनुमोदन हते ु आर्ेदन करना होगा। (छ) उपयुवि अनुसूजर्त जर्जनर्मवजतयों के जनमावता उत्सपादन/आयात और जबक्री के सम्बन्ध म ेंऔषध (मूल्य जनयंत्रण) आदेि, 2013 के अनुसूर्ी II के फॉमव III को आईपीडीएमएस के माध्यम से भरकर एनपीपीए को हर जतमाही की ठरपोट व प्रस्ट्तुत करेगा। कोई जनमावता उपयुवि अनुसूजर्त जर्जनर्मवजतयों का उत्सपादन बन्द करने का इच्छुक हो तो र्ह इसके[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 सम्बन्ध में के उत्सपादन और आयात को बन्द करने की जतजथ से छैः महीने पहले अनुसूर्ी II के फॉमव IV में भरकर एनपीपीए को प्रस्ट्तुत करेगा। (ि) जर्जनमावता या जर्पणन कम्पनी, उपरोि कजथत सारणी म ें दिावये अजधकतम मूल्य और ितों का पालन नहीं करती ह ैंतो र्े आर्श्यक र्स्ट्तुएँ अजधजनयम, 1955 के साथ पठित डीपीसीओ, 2013 के प्रार्धानों के अधीन ब्याि सजहत अजधप्रभाठरत राजि को िमा करने के जलए उत्तरदायी होंगे। (झ) इस आदेि म ें उपरोि सारणी के स्ट्तंभ (2) म ें की गई तत्सस्ट्थानी प्रजर्जि म ें जर्जनर्दवि ऐसी जर्जनर्मवजतयों के पैकों की अजधकतम कीमत जनयत होन े के पठरणामस्ट्र्रुप, अजधकतम या खुदरा मल्ू य जनधावठरत आदेि यदद कोई हो, िो दक इस आदेि से पूर् विारी हुए ह,ै उनका स्ट्र्तैः ही अजधक्रमण हो िाएगा। [कां. सं. /270/138/2025/एफ/फा. सं. 8(138)/2025/डीपी/एनपीपीए-जडर्ी.-II] युजर्का पंर्ार, सहायक जनदेिक MINISTRY OF CHEMICALS AND FERTILIZERS (Department of Pharmaceuticals) (NATIONAL PHARMACEUTICAL PRICING AUTHORITY) ORDER New Delhi, the 4th November, 2025 S.O. 5018(E).— In exercise of the powers conferred by paragraphs 4, 6, 10, 11, 14, 16, 17 and 18 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated 30th May, 2013 and S.O. 5249(E) dated 11th November, 2022 issued by the Government of India in the Ministry of Chemicals and Fertilizers and in supersession of the Order of the Government of India in the Ministry of Chemicals and Fertilizers (National Pharmaceutical Pricing Authority) S.O. 1487(E) dated 27th March, 2025 in so far as it relates to formulation packs mentioned in the table below, except in respect of things done or omitted to be done before such supersession, the National Pharmaceutical Pricing Authority (hereinafter referred as NPPA) hereby fixes the price as specified in column (5) of the table herein below as ceiling price exclusive of Goods and Services Tax applicable, if any, in respect of the Scheduled formulation specified in the corresponding entry in column (2) of the said Table with the dosage form & strength and unit specified respectively in the corresponding entries in columns (3) and (4) thereof: TABLE Sl. (b) All the existing manufacturers of above-mentioned scheduled formulations having MRP lower than the ceiling price specified in column (5) in the above table plus Goods and Services Tax as applicable, if any, shall continue to maintain the existing MRP in accordance with paragraph 13 (2) of the DPCO, 2013. (c) The manufacturers may add Goods and Services Tax only if they have paid actually or if it is payable to the Government on the ceiling price mentioned in column (5) of the above said table. (d) The ceiling price for a pack of the scheduled formulation shall be arrived at by the concerned manufacturer in accordance with the ceiling price specified in column (5) of the above table as per provisions contained in paragraph 11 of the Drugs (Prices Control) Order, 2013. The manufacturer shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers. (e) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same. (f) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the above table launches a new drug as per paragraph 2(1)(u) of the DPCO, 2013 such existing manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified under Schedule-II of the DPCO, 2013. (g) The manufacturers of above said scheduled formulations shall furnish quarterly return to the NPPA, in respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013 through IPDMS. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish information to the NPPA, in respect of discontinuation of production and / or import of scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation. (h) The manufacturers not complying with the ceiling price and notes specified hereinabove shall be liable to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Prices Control) Order, 2013 read with Essential Commodities Act, 1955. (i) Consequent to the issue of ceiling price of such formulation as specified in column (2) of the above table in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of notification, stand(s) superseded.
