S.O. 1782(E).—In exercise of the powers conferred by paragraphs 5, 11 and 15 of the Drugs (Prices Control)
Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013 and S.O. 701(E) dated 10th March, 2016 issued by the
Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority
(hereinafter referred as NPPA), hereby fixes, the price as specified in column (6) of the table herein below as the retail
price, exclusive of Goods and Services Tax, if any, in relation to the formulation specified in the corresponding entry

Note:
(a) The manufacturer of above mentioned formulations i.e. “new drug” under paragraph 2(u) of the DPCO, 2013
shall fix the retail price as specified in column (6) of the table hereinabove.
(b) The manufacturer may add Goods and Services Tax only if they have paid actually or it is payable to the
Government on the retail price mentioned in column (6) of the above said table.
(c) The retail price for a pack of the aforesaid formulation shall be arrived at by the concerned manufacturer in
accordance with the retail price specified in column (6) of the above table as per provisions contained in
paragraph 11 of the DPCO, 2013. The manufacturer shall issue a price list in Form–V from date of
Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State
Drug Controller and dealers.
(d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary
price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on
business in a manner so as to be easily accessible to any person wishing to consult the same.
(e) The above mentioned retail price is applicable only to the individual manufacturer / marketer as mentioned
above i.e. who have applied for the same by submitting Form-I for price fixation / revision as stipulated
under DPCO, 2013 and subject to fulfilment of all the applicable statutory requirements as laid down by the8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent
Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned
manufacturer/marketing companies.
(f) In case the retail price of any of the aforesaid formulations is not complied with, as per instant price
notification and notes specified hereinabove, then the concerned manufacturer/marketing company shall be
liable to deposit the overcharged amount along with the interest thereon under the provisions of the DPCO,
2013 read with the Essential Commodities Act, 1955.
(g) Consequent to the issue of ceiling price of such formulation as specified in column (2) of the above table in
this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of
notification, stand(s) superseded.

पीआई.I के तहत अन्य बातों के साथ-साथ, थोक दर्ाओं और उनके जर्जनर्मवजत की कीमतें तय करने और यदद उनमें कोई बदलार् हो को
अजधसूजर्त करने, गैर-अनुसूजर्त दर्ाओं और जर्जनर्मवजत की कीमतों की जनगरानी करने और दर्ाओं (मूल्य जनयंत्रण) आदिे (डीपीसीओ) के
प्रार्धानों के कायावन्र्यन की जनगरानी करने के जलए राष्ट्रीय औषध मूल्य जनधावरण प्राजधकरण(एनपीपीए) की स्ट्थापना की गई थी।
2. और िबदक रसायन और उर्वरक मंत्रालय ने आर्श्यक र्स्ट्तु अजधजनयम, 1955 की धारा 3 और 5 द्वारा प्रदत्त िजियों का प्रयोग करते हुए
ददनांक 30 मई, 2013 के एसओ.1394 (अ) के द्वार उि आदिे के पैरा 32 सजहत डीपीसीओ, 2013 जनर्दष्टव पैरा के संबंध में केंद्र सरकार की
ओर से एनपीपीए द्वारा प्रयोग की िाने र्ाली िजियां प्रत्सयायोजित की गई ह।ैं
3. और िबदक मेससव सीरम इंस्ट्टीट्यूट ऑि इंजडया प्राइर्ेट जलजमटेड से "न्यूमोकोकल पॉलीसेकेराइड कॉन्िुगेट र्ैलसीन (एडिॉब्डव) आईपी
(10-र्ैलेंट) (पीसीर्ी 10र्ी) इन (i) लसंगल डोि के संबंध में (0.5 जमली) िीिी, (ii) बहु-खुराक (5 डोि-2.5 जमली) िीिी, और (iii) एकल
खुराक (0.5 जमली) पहले से भरी हुई सीररंि” के जर्जनर्मवजत संबंध म ेंउि आदिे के पैरा 32 (ii) के तहत, डीपीसीओ, 2013 के प्रार्धानों से
छूट के जलए प्राप्त आर्ेदन, जिसे ड्रग एंड कॉस्ट्मेठटलस एलट, 1940 और उसके तहत जनयमों के तहत 'नई दर्ा' के तौर पर केंद्रीय औषजध
मानक जनयंत्रण संगिन (भारत) के कायावलय द्वारा जर्जधर्त ददनांक 17.07.2020 को अनुमोददत दकया गया था। ।
4. और िबदक, पेटेंट कायावलय, भारत सरकार ने मेससव सीरम इंस्ट्टीट्यूट ऑि इंजडया प्राइर्ेट जलजमटेड को (i) पेटेंट अजधजनयम, 1970 (पेटेंट
संख्या 318780 और प्रदान दकए िाने की जतजथ: 22.08.2019) के प्रार्धानों के अनुसार 15.05.2010 से 20 र्षों की अर्जध के जलए
'कैप्सुलर पॉलीसैकेराइड्स की िुजि' नामक आजर्ष्कार, (ii) पेटेंट अजधजनयम, 1970 (पेटेंट संख्या 284211 और प्रदान दकए िाने की जतजथ:
14.06.2017) के प्रार्धानों के अनुसार 26.04.2010 से 20 र्षों की अर्जध के जलए 'बैलटीठरयल टीके तैयार करने के जलए जर्जध' नामक
आजर्ष्कार और (iii) पेटेंट अजधजनयम, 1970 (पेटेंट संख्या 276304 और प्रदान दकए िाने की जतजथ: 13.10.2016) के प्रार्धानों के अनुसार
26.03.2010 से 20 र्षों की अर्जध के जलए 'एकाजधक एंटीिन के मूल्यांकन के जलए जर्जध' नामक आजर्ष्कार के जलए पेटेंट प्रदान दकया ह।ै
5. और िबदक एनपीपीए ने अपनी ददनांक 24.03.2022 की 96र्ीं बैिक में दखे ा दक मेससव सीरम इंस्ट्टीट्यूट ऑि इंजडया प्रा. जलजमटेड
डीपीसीओ 2013 के पैरा 32 (ii) की अपेिाओं को पूरा करता ह ै और यह जनणवय जलया ह ै दक मेससव सीरम इंस्ट्टीट्यूट ऑि इंजडया प्राइर्टे
जलजमटेड को डीपीसीओ, 2013 के पैरा 32 (ii) के तहत उनके जर्जनर्मवजत "न्यूमोकोकल पॉलीसेकेराइड कॉन्िुगेट र्ैलसीन (एडिॉब्डव) आईपी
(10-र्ैलेंट) (पीसीर्ी 10र्ी)" ( i ) लसंगल डोज़ (0.5 जमली) िीिी, (ii) मल्टी- खुराक (2.5 जमली) िीिी), और (iii) एकल खुराक (0.5
जमली) पहल ेसे भरी हुई सीररंि के जलए छूट दी िा सकती ह।ै
6. अब, इसजलए, रसायन और उर्वरक मंत्रालय, भारत सरकार द्वारा िारी 30 मई, 2013 के एसओ 1394 (अ) के माध्यम से औषध (मल्ू य
जनयंत्रण) आदिे , 2013 के पैरा 32 के तहत प्रत्सयायोजित िजियों का प्रयोग करते हुए, मेससव सीरम इंस्ट्टीट्यूट ऑि इंजडया प्रा. जलजमटेड को
(i) लसंगल डोज़ (0.5 जमली) िीिी, (ii) मल्टी-डोज़ (5 डोि-2.5 जमली) िीिी), और (iii) लसंगल डोज़ (0.5 जमली) पहले से भरी हुई सीररंि
में "न्यूमोकोकल पॉलीसेकेराइड कॉन्िुगेट र्ैलसीन (एडिाब्डव) आईपी (10-र्ैलेंट) (पीसीर्ी 10र्ी)" के जर्जनर्मजव त के संबंध में उि आदिे के
पैरा 32 (ii) के तहत दिे में इसका र्ाजणजययक उत्सपादन िुरू होने की तारीख से पांर् साल की अर्जध के जलए डीपीसीओ, 2013 के

7. मेससव सीरम इंस्ट्टीट्यूट ऑि इंजडया प्रा. जलजमटेड दिे में (i) लसंगल डोज़ (0.5 जमली) िीिी, (ii) मल्टी-डोज़ (5 डोि-2.5 जमली) िीिी),
और (iii) लसंगल डोज़ (0.5 जमली) पहले से भरी हुई सीररंि में "न्यूमोकोकल पॉलीसेकेराइड कॉन्िुगेट र्ैलसीन (एडिाब्डव) आईपी (10-र्ैलेंट)
(पीसीर्ी 10र्ी)" के जर्जनर्मवजत के र्ाजणजययक उत्सपादन की तारीख और डीपीसीओ, 2013 के तहत िॉमव V में मूल्य सूर्ी िारी कर के उि
िॉमूवलेिन के संबंध में खुदरा जर्क्रेता को ददए िाने र्ाले मूल्य (पीटीआर) और कंपनी द्वार जनधावठरत अजधकतम खुदरा मूल्य एनपीपीए को
सूजर्त करेगा।
8. मेससव सीरम इंस्ट्टीट्यूट ऑि इंजडया प्रा. जलजमटेड यदद लाग ू हो तो (i) लसंगल डोज़ (0.5 जमली) िीिी, (ii) मल्टी-डोज़ (5 डोि-2.5
जमली) िीिी), और (iii) लसंगल डोज़ (0.5 जमली) पहले से भरी हुई सीररंि में "न्यूमोकोकल पॉलीसेकेराइड कॉन्िुगेट र्ैलसीन (एडिाब्डव)
आईपी (10-र्ैलेंट) (पीसीर्ी 10र्ी)" के जर्जनर्मवजत के जलए, यदद लाग ू हो तो डीपीसीओ 2013 के पैरा 32 (ii) के तहत दी गई छूट की
समाजप्त से तीन महीने पहले खुदरा मूल्य अनुमोदन की भी मांग करेगा।

S.O. 1783(E).—Whereas the National Pharmaceutical Pricing Authority (NPPA) was established vide the
Resolution of the Government of India in the Ministry of Chemicals and Fertilizers No. 33/7/97-PI.I dated 29th August,
1997, inter-alia, to fix prices and notify the changes therein, if any, of bulk drugs and formulations, monitor the prices of
non-scheduled drugs and formulations and oversee the implementation of the provisions of the Drugs (Price Control)
Order (DPCO).
2. And whereas the Ministry of Chemicals and Fertilizers vide S.O.1394 (E) dated the 30th May, 2013, in exercise of the
powers conferred by Section 3 and 5 of Essential Commodities Act, 1955 has delegated the powers in respect of specified
Paras of the DPCO, 2013, including Para 32 of the said order to be exercised by the NPPA on behalf of the Central
Government.
3. And whereas an application received from M/s Serum Institute of India Pvt. Ltd, for exemption from the provisions of
DPCO, 2013 under Para 32 (ii) of the said order in respect of the formulation “Pneumococcal Polysaccharide Conjugate
Vaccine (Adsorbed) IP (10-Valent) (PCV 10V) in (i) single dose (0.5 ml) vial, (ii) multi-dose (5 dose-2.5 ml) vial, and (iii)
single dose (0.5ml) pre-filled syringes which was duly approved by the Office of Central Drugs Standard Control
Organisation (India) as ‘new drug’ under the Drugs and Cosmetics Act, 1940 and Rules thereunder on 14.07.2020.
4. And whereas, the Patent Office, Government of India has granted Patent to M/s Serum Institute of India Pvt. Ltd for (i)
an invention entitled ‘PURIFICATION OF CAPSULAR POLYSACCHARIDES’ for the term of 20 years from
15.05.2010 in accordance with the provisions of the Patents Act, 1970 (Patent No. 318780 and Date of Grant: 22.08.2019),
(ii) an invention entitled ‘A METHOD FOR PREPARING BACTERIAL VACCINES’ for the term of 20 years from
26.04.2010 in accordance with the provisions of the Patents Act, 1970 (Patent No. 284211 and Date of Grant: 14.06.2017)
and (iii) an invention entitled ‘METHOD FOR EVALUATION OF MULTIPLE ANTIGENS’ for the term of 20 years
from 26.03.2010 in accordance with the provisions of the Patents Act, 1970 (Patent No. 276304 and Date of Grant:
13.10.2016).
5. And whereas the NPPA at its 96th meeting dated 24.03.2022 observed that M/s Serum Institute of India Pvt. Ltd meets
the requirement of Para 32(ii) of DPCO 2013 and decided that exemption may be granted to M/s Serum Institute of India
Pvt. Ltd under Para 32(ii) of DPCO, 2013 for their formulation “Pneumococcal Polysaccharide Conjugate Vaccine
(Adsorbed) IP (10-Valent) (PCV 10V)” in (i) single dose (0.5 ml) vial, (ii) multi-dose (5 dose-2.5 ml) vial), and (iii) single
dose (0.5ml) pre-filled syringes.
6. Now, therefore, in exercise of the powers delegated under Para 32 of the Drugs (Prices Control) Order, 2013 vide S.O.
1394(E) dated 30th May, 2013 issued by the Government of India in the Ministry of Chemicals and Fertilizers, M/s Serum
Institute of India Pvt. Ltd is exempted from the provisions of DPCO, 2013 under para 32 (ii) of the said order in respect of
the formulation “Pneumococcal Polysaccharide Conjugate Vaccine (Adsorbed) IP (10-Valent) (PCV 10V)” in (i) single
dose (0.5 ml) vial, (ii) multi-dose (5 dose-2.5 ml) vial), and (iii) single dose (0.5ml) pre-filled syringes for a period of five
years from the date of commencement of its commercial production in the country. Further, the period of five years is co-
terminus with the duration of Indian Patent.
7. M/s Serum Institute of India Pvt. Ltd shall inform NPPA, the date of commercial production of the formulation
“Pneumococcal Polysaccharide Conjugate Vaccine (Adsorbed) IP (10-Valent) (PCV 10V)” in (i) single dose (0.5 ml) vial,
(ii) multi-dose (5 dose-2.5 ml) vial), and (iii) single dose (0.5ml) pre-filled syringes in the country and the Price to Retailer10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
(PTR) and Maximum Retail Price fixed by the company in respect of above said formulation by issuing a price list in
Form V under DPCO, 2013.
8. M/s Serum Institute of India Pvt. Ltd shall also seek retail price approval for the formulation ““Pneumococcal
Polysaccharide Conjugate Vaccine (Adsorbed) IP (10-Valent) (PCV 10V)” in (i) single dose (0.5 ml) vial, (ii) multi-dose
(5 dose-2.5 ml) vial), and (iii) single dose (0.5ml) pre-filled syringes, if applicable, three month before the expiry of the
exemption granted under Para 32(ii) of DPCO 2013
