नई दर्ा ह।ै 2. और िबदक राष्ट्रीय औषध मल्ू य जनधावरण प्राजधकरण (जिसे आग े एनपीपीए के रूप म ें संदर्भवत दकया िाएगा) को “प्रत्येक पाउच म:ें पैराजसटामोल आई.पी. 500 जमग्रा और फेजनलफ्रीन एचसीएल आई.पी. 10 जमग्रा” के जलए अलग कीमत हते ुमेससस ग्लैक्सोजस्ट्मथक्लाइन एजिया प्राइर्ेट जलजमटेड से आर्ेदन प्राप्त हुआ था। 3. और िबदक, मैससव ग्लेक्सोजस्ट्मथक्लाइन एजिया प्रा. जल. का आर्ेदन जर्िेषज्ञों की बहु-जर्षयक सजमजत के समक्ष इसकी 65र्ीं बैठक 23.01.2025, 66र्ीं बैठक 03.03.2025 और 68र्ीं बैठक 03.06.2025 म ेंरखा गया था । आर्ेदक न े66र्ीं बैठक में अपने उत्पाद और उसके लाभों के बारे में जर्स्ट्ततृ प्रस्ट्तुजत दी। सजमजत ने कहा दक कंपनी ने समान उत्पादों के पैक िॉट्स प्रस्ट्ततु दकए और तेिी स ेघुलनिीलता, तिे ी स ेजर्घटन, बेहतर सुरक्षा और प्रभार्काररता, बेहतर एयूसी स्ट्तर, अंत्र म ें 4417 GI/2025 (1)2 THE GAZETTE सजमजत ने इस मामल े पर जर्चार-जर्मिव दकया और बािार म ें उपलब्ध समान उत्पाद के आधार पर डीपीसीओ, 2013 के पैराग्राफ 11 (3) के तहत मैसस वग्लेक्सोजस्ट्मथक्लाइन एजिया प्रा. जल. के जलए "पैराजसटामोल आईपी 500 जमलीग्राम और फेनीलेदफ्रन एचसीएल 10 जमलीग्राम यक्तु प्रत्येक पैकेट" के जलए अलग से कीमत की जसफाररि की। 4. और िबदक, एनपीपीए ने 26.06.2025 को आयोजित प्राजधकरण की 134र्ीं बैठक में मेससव ग्लैक्सोजस्ट्मथक्लाइन एजिया प्राइर्ेट जलजमटेड के आर्ेदन पर जर्चार-जर्मिव दकया और डीपीसीओ 2013 के पैरा 11(3) के तहत उपरोक्त पैरा 2 म ें उजल्लजखत फॉमलूव ेिन के जलए मेससव ग्लैक्सोजस्ट्मथक्लाइन एजिया प्राइर्ेट जलजमटेड के जलए अलग मल्ू य प्रदान दकए िान ेहते ु जर्िेषज्ञों की बहु-जर्षयक सजमजत की जसफाररिों को स्ट्र्ीकार कर जलया। 5. इसजलए, भारत सरकार के रसायन एर्ं उर्वरक मंत्रालय द्वारा िारी ददनांक 30 मई, 2013 की अजधसूचना सं. 1394(अ) के साथ परठत औषजध (मल्ू य जनयंत्रण) आदिे , 2013 के पैराग्राफ 11(3) द्वारा प्रदत्त िजक्तयों का प्रयोग करते हुए एनपीपीए एतद्द्वारा, बािार आंकडों पर मसे सव ग्लैक्सोजस्ट्मथक्लाइन एजिया प्राइर्ेट जलजमटेड के जलए कॉलम (2) म ें जनर्दवष्ट फॉमूवलिे न के साथ कॉलम (3) और (4) म ें जनर्दवष्ट प्रबलता एर् ं इकाई के जलए नीचे दी गई ताजलका के कॉलम (5) म ें जनर्दवष्ट मल्ू य को र्स्ट्तु एर्ं सेर्ा कर, यदद कोई हो, के मल्ू य के रूप में जनधावररत करता ह;ै ताजलका क्रम सं. दर्ाएं प्रबलता इकाई खुदरा कीमत (रूपए में) (1) (2) (3) (4) (5) 1 पैराजसटामोल प्रत्यके पाउच में: 1 पाउच 6.96 और फेजनलफ्रीन पैराजसटामोल आई.पी. 500 जमग्रा और पाउच फेजनलफ्रीन एचसीएल आई.पी. 10 जमग्रा रटप्पजणया:ं (क) कॉलम (5) म ें जनर्दवष्ट मूल्य मैससव ग्लेक्सोजस्ट्मथक्लाइन एजिया प्रा. जल. के जलए कॉलम (3) और (4) में जनर्दष्टव िजक्त और इकाई के साथ कॉलम (2) म ें जनर्दवष्ट फॉमूवलेिन पर लाग ूहोगा। (ख) मेससव ग्लैक्सोजस्ट्मथक्लाइन एजिया प्राइर्ेट जलजमटेड र्स्ट्त ु एर्ं सेर्ा कर तभी िोड सकता ह,ै िब उसने र्ास्ट्तर् म ें भुगतान दकया हो या यह उपरोक्त सारणी के कॉलम (5) म ेंउजल्लजखत मल्ू य पर सरकार को यह राजि देय हो। (ग) मेससव ग्लैक्सोजस्ट्मथक्लाइन एजिया प्राइर्ेट जलजमटेड डीपीसीओ, 2013 के पैराग्राफ 24 के अनुसार अजधसूचना की जतजथ से प्रपत्र- V में आईपीडीएमएस के माध्यम से एनपीपीए को मूल्य सूची िारी करेगा और राज्य औषजध जनयंत्रक और जर्तरकों को इसकी एक प्रजत प्रस्ट्तुत करेगा। (घ) उपयुवक्त ताजलका के कॉलम (2) म ें जनर्दवष्ट फॉमूवलेिन के जलए कॉलम (5) में जनर्दष्टव कीमत डीपीसीओ, 2013 के पैरा 20 के अनुसार संिोजधत की िा सकती ह।ै (ङ) डीपीसीओ 2013 के पैरा 24(4) के अनुसार, प्रत्येक खुदरा जर्क्रेता और जर्तरक को जनमावता द्वारा प्रस्ट्तुत मल्ू य सूची और अनुपरू क मूल्य सूची, यदद कोई हो, को पररसर के एक जर्जिष्ट भाग पर प्रदर्िवत करना होगा, िहां र्ह व्यर्साय करता ह,ै तादक उसे देखन े के इच्छुक दकसी भी व्यजक्त के जलए यह आसानी से उपलब्ध हो। (च) उपयुवक्त कीमत केर्ल मेसस व ग्लक्ै सोजस्ट्मथक्लाइन एजिया प्राइर्ेट जलजमटेड पर लागू ह ै और संबंजधत जनमावता/जर्पणन कंपजनयों द्वारा सक्षम प्राजधकारी यानी केंद्रीय/राज्य लाइसेंससंग प्राजधकरण से जर्जनमावण लाइसेंस की अनुमजत सजहत प्रासंजगक कानूनों/जनयमों के तहत सरकार द्वारा जनधावररत सभी लागू र्ैधाजनक आर्श्यकताओं की पूर्तव के अधीन ह।ै[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (छ) यदद कॉलम (2) म ेंजनर्दष्टव ताकत और इकाई के साथ कॉलम (3) और (4) म ेंजनर्दष्टव फॉमूवलेिन की कीमत तत्काल मल्ू य अजधसूचना और ऊपर जनर्दष्टव नोट्स के अनुसार अनुपालन नहीं की िाती ह,ै तो मैससव ग्लेक्सोजस्ट्मथक्लाइन एजिया प्रा. जल. आर्श्यक र्स्ट्त ु अजधजनयम, 1955 के साथ पढ़े गए डीपीसीओ, 2013 के प्रार्धानों के तहत उस पर ब्याि के साथ अजधभाररत राजि िमा करने के जलए उत्तरदायी होगी। AUTHORITY) ORDER New Delhi, the 4th July, 2025 S.O. 2999(E).— Whereas formulation “Paracetamol I.P. 500 mg and Phenylephrine HCl I.P. 10 mg” is a new drug as per Para 2(1)(u) of DPCO 2013. 2. And whereas National Pharmaceutical Pricing Authority (hereinafter referred as NPPA) had received application from M/s GlaxoSmithKline Asia Private Limited for separate price of “Each sachet containing Paracetamol I.P. 500 mg and Phenylephrine HCl I.P. 10 mg”. 3. And whereas, the application of M/s GlaxoSmithKline Asia Private Limited was placed before the Multidisciplinary Committee of Experts in its 65th meeting held on 23.01.2025, 66th meeting held on 03.03.2025 and 68th meeting held on 03.06.2025. The applicant in 66th meeting gave detailed presentation about their product and its benefits. The committee noted that the company submitted the pack shots of similar products and claimed advantages like faster solubility, faster disintegration hence better safety and efficacy, better AUC level, absorption in intestine, useful in patents who have difficulty in swallowing and claimed lower price compared to other companies. The Committee deliberated up on the matter and recommended a separate price for “Each sachet containing Paracetamol I.P. 500 mg and Phenylephrine HCl I.P. 10 mg” for M/s GlaxoSmithKline Asia Private Limited under Para 11(3) of DPCO,2013 based on similar product available in the market. 4. And whereas, NPPA in its 134th authority meeting held on 26.06.2025 deliberated upon the application of M/s GlaxoSmithKline Asia Private Limited and accepted the recommendations of the Multidisciplinary Committee of Experts to give separate price for “Each sachet containing Paracetamol I.P. 500 mg and Phenylephrine HCl I.P. 10 mg” for M/s GlaxoSmithKline Asia Private Limited under para 11(3) of DPCO 2013. 5. Therefore, in exercise of powers, conferred by paragraph 11(3) of the Drugs (Prices Control) Order, 2013 read with S.O. No. 1394(E) dated the 30th May, 2013 issued by the Government of India in the Ministry of Chemicals and Fertilizers, the NPPA, hereby fixes, the price as specified in column (5) of the table herein below as the price exclusive of goods and services tax, if any, for the formulation specified in the corresponding entry in column (2) of the said Table with the strength, unit, as specified in the corresponding entries in columns (3), and (4) thereof for M/s GlaxoSmithKline Asia Private Limited based on the market data; TABLE S. (c) M/s GlaxoSmithKline Asia Private Limited shall issue a price list in Form–V from date of Notification as per paragraph 24 of the DPCO, 2013 to NPPA through IPDMS and submit a copy to State Drug Controller and dealers. (d) The price of the Paracetamol and Phenylephrine Hydrochloride sachet as specified in column (5) for the formulations as specified in column (2) of the above said table may be revised as per para 20 of DPCO, 2013. (e) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same. (f) The above-mentioned price is applicable only to M/s GlaxoSmithKline Asia Private Limited and subject to fulfilment of all the applicable statutory requirements as laid down by the Govt. under relevant statutes/ rules, including manufacturing license permission from the Competent Authority i.e. the Central/State Licensing Authority, as may be applicable, by the concerned manufacturer/marketing companies. (g) In case the price of the formulation specified in column (2) with strength and unit as specified in column (3) and (4) is not complied as per the instant price notification and notes specified hereinabove, then M/s GlaxoSmithKline Asia Private Limited shall be liable to deposit the overcharged amount along with the interest thereon under the provisions of the DPCO, 2013 read with the Essential Commodities Act, 1955.
