L.-33004/99 सी.जी.-डी.एल.-अ.-29082025-265797 xxxGIDHxxx CG-DLxx-ExG-I2D9E0x8x2x0 25-265797 असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 3874] नई ददल्ली, िुक्रर्ार, अगस्ट्त 29, 2025/भाद्र 7, 1947 No. 3874] NEW DELHI, FRIDAY, AUGUST 29, 2025/BHADRA 7, 1947 रसायन और उर्रव क मत्रं ालय (औषध जर्भाग) (राष्ट्रीय औषध मल्ू य जनधारव ण प्राजधकरण) आदेि नई ददल्ली, 29 अगस्ट् त, 2025 का.आ. 3979(अ).— िबदक, (i) इंिेक्िन के जलए मरे ोपेनम पाउडर 500 जमलीग्राम (राइहाइड्रेट के रूप में) और (ii) इंिेक्िन के जलए मेरोपने म पाउडर 1000 जमलीग्राम (राइहाइड्रेट के रूप में) डीपीसीओ 2013 की अनुसूची-I के तहत अनुसूजचत फोमूवलिे न ह ैऔर इसकी अजधकतम कीमत तय ह।ै और िबदक, मैसस व गुदफक बायोसाइंसेस जलजमटेड न े (i) इंिेक्िन के जलए मरे ोपेनम पाउडर 500 जमलीग्राम (राइहाइड्रेट के रूप म)ें और (ii) इंिेक्िन के जलए मरे ोपेनम पाउडर 1000 जमलीग्राम (राइहाइड्रेट के रूप म)ें के अलग अजधकतम मल्ू य के जलए आर्ेदन दकया ह ै जिसमें जर्िेष जर्िषे ताएं िेस े (i) आत्म-संकुचनिीलता और स्ट्र्-सीलिीलता (ii) र्ाय-ु र्ेंट नहीं होना; और (iii) दोहरे कक्ष बगै म ेंजनमावण/िलसेक/जमश्रण स्ट्तर के दौरान संदषू ण की कोई संभार्ना नहीं ह।ै और िबदक, जर्िेषज्ञों की बहु-जर्षयक सजमजत ने 03.07.2025 पर आयोजित अपनी 69र्ीं और 05.08.2025 पर आयोजित 70र्ीं बैठक में उपरोक्त जर्िेष जर्िेषताओ को दखे ा और मौिूदा अजधकतम मूल्य से 15 प्रजतित की र्ृजि की जसफाररि की। 5799 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और िबदक, राष्ट्रीय औषध मल्ू य जनधावरण प्राजधकरण (इसके बाद एनपीपीए के रूप म ें संदर्भवत) ने 28.08.2025 को आयोजित अपनी 136 र्ीं प्राजधकरण बैठक में जर्िेषज्ञों की बहु-जर्षयक सजमजत की जसफाररि को स्ट्र्ीकार दकया। इसजलए, औषध (मल्ू य जनयंत्रण) आदेि, 2013 के पैराग्राफ 11 के उप परै ाग्राफ (3) और (4) द्वारा प्रदत्त िजक्तयों का प्रयोग करत े हुए, रसायन और उर्वरक मंत्रालय में भारत सरकार द्वारा िारी 30 मई 2013 के का. आ. 1394 (अ) और 11 नर्ंबर, 2022 के का. आ. 5249 (अ) के साथ पढ े िाने पर, एनपीपीए नीचे ताजलका 'बी' में जनर्दष्टव जनमावता के जलए ताजलका 'ए' के कॉलम (5) में जनर्दवष्ट मल्ू य को, र्स्ट्तु एर्ं सेर्ा कर को छोड़कर, यदद कोई हो, उक्त ताजलका के कॉलम (2) म ें संबंजधत प्रजर्जष्ट में जनर्दवष्ट अनुसजू चत फोमूवलेिन, कॉलम (3) और (4) में संबंजधत प्रजर्जष्टयों में क्रमिः जनर्दवष्ट खुराक रूप और प्रबलता और इकाई के संबंध में अजधकतम मल्ू य जनधावररत दकया िाता ह:ै ताजलका ‘ए ’ क्रम सं अनुसूजचत खुराक रूप और प्रबलता ईकाई अजधकतम मल्ू य . फोमूवलेिन का िीएसटी को नाम छोड़कर(रु.) (1) (2) (3) (4) (5) 1 मेरोपीनम इंिेक्िन के जलए पाउडर 500 जमलीग्राम प्रत्येक दोहरे चैम्बर 845.94 बैग (राइहाइड्रेट के रूप में) 2 मेरोपीनम इंिेक्िन के जलए पाउडर 1000 जमलीग्राम प्रत्येक दोहरे चैम्बर बैग 1114.72 (राइहाइड्रेट के रूप में) ताजलका ‘बी ’ क्र.स.ं जर्जनमावता का नाम (1) (2) 1 मैससव गुदफक बायोसाइंसेि जलजमटेड नोट: (क) ताजलका ए के कॉलम (5) म ें जर्जनर्दवष्ट अजधकतम मूल्य केर्ल ताजलका बी म ें उजल्लजखत जर्जनमावताओं पर लाग ू होता ह।ै ताजलका बी में जर्जनर्दवष्ट जर्जनमावता, सरकार द्वारा जनजित और अजधसूजचत अजधकतम मल्ू य (लागू र्स्ट्तु एर्ं सेर्ा कर के साथ िोड़कर) से अजधकतम कीमत पर क्रमिः ताजलका ए के कॉलम (2) और (3) म ें जर्जनर्दवष्ट खुराक रूप और प्रबलता के साथ अनुसूजचत जर्जनर्मवती के दोनों ब्ांडेड या िेनेररक र्र्वन को बेच रहा हो उपरोक्त ताजलका म ें कॉलम (5) म ेंमूल्य और लाग ूस्ट्थानीय कर, यदद कोई हो, ऐस ेसभी जर्जनर्मवती की कीमतों को संिोजधत करेगा िो अजधकतम सीमा से अजधक नहीं ह।ै (ख) जनमावता र्स्ट्तु एर्ं सेर्ा कर तभी िोड़ सकता ह ै िब उसने र्ास्ट्तर् में भुगतान दकया हो या यदद र्ह उपरोक्त ताजलका के कॉलम (5) में उजल्लजखत अजधकतम मल्ू य पर सरकार को भगु तान योग्य हो। (ग) जनमावता डीपीसीओ, 2013 के पैराग्राफ 24 के अनुसार इस अजधसूचना की तारीख से अनुपालन म ें फॉमव-V म ें मल्ू य सूची िारी करेगा।[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3 (घ) डीपीसीओ 2013 के पैराग्राफ 24 (4) के अनुसार, प्रत्येक खुदरा जर्क्रेता और डीलर को पररसर के एक जर्जिष्ट जहस्ट्से में मूल्य सूची और परू क मल्ू य सूची, यदद कोई हो, प्रदर्ितव करनी होगी, िहां र्ह व्यर्साय करता ह,ै तादक दकसी भी व्यजक्त के जलए आसानी से सुलभ हो सके। (ङ) कोई भी अन्य जनमावता िो अलग अजधकतम मल्ू य का दार्ा करता ह,ै जिसमें दोहरे चैम्बर बैग की जर्िेष जर्िेषता होती ह,ै जो दवा दने ेके समय म ेकमी, सही खुराक का ममश्रण और सदं षू ण म ेकमी म ेंसहायक के जलए, र्ह अलग अजधकतम मूल्य अनुमोदन के जलए एनपीपीए को आर्ेदन करेगा। (च) दार्ा की गई अन्य जर्िेष जर्िषे ताओं या दकसी अन्य पैक आकार के जनर्मवत के जलए, जनमावता इसके जनमावण के जलए जर्जिष्ट मूल्य अनुमोदन के जलए एनपीपीए स ेसंपकव करेगा। (छ) िहां उपरोक्त ताजलका ए में जनर्दवष्ट खुराक या िजक्त या दोनों के साथ अनुसूजचत फॉमूवलिे न का एक मौिूदा जनमावता, डीपीसीओ, 2013 के परै ाग्राफ 2 (1) (य)ू के अनुसार एक नई दर्ा लॉन्च करता ह,ै तो ऐसे मौिदू ा जनमावता डीपीसीओ, 2013 की अनुसूची-II के तहत जनर्दवष्ट फॉमव-I में एनपीपीए को ऐसी नई दर्ा के पूर्व मल्ू य अनमु ोदन के जलए आर्ेदन करेंगे। (ि) उपरोक्त अनुसूजचत फॉमूवलिे न के जनमावता (ओं) डीपीसीओ, 2013 की अनुसूची-II के फॉम-व III में अनुसूजचत फॉमूवलेिन के उत्पादन/आयात और जबक्री के संबंध में एनपीपीए को त्रैमाजसक ररटनव प्रस्ट्तुत करेंगे। उपरोक्त अनुसूजचत फॉमूवलिे न का उत्पादन बंद करने का इरादा रखने र्ाले दकसी भी जनमावता को उत्पादन बंद करने और/या अनुसूजचत फॉमूवलेिन के आयात के संबंध म ें डीपीसीओ, 2013 की अनुसूची-II के फॉम-व IV में िानकारी बंद करन े की इजछछत जतजथ से कम से कम छह महीने पहले प्रस्ट्ततु करनी होगी। (झ) जनमावता (ओं) यहां ऊपर जनर्दष्टव अजधकतम मल्ू य और नोट्स का अनपु ालन नहीं कर रहा ह,ै र्ह आर्श्यक र्स्ट्त ु अजधजनयम, 1955 के साथ परठत औषजध (मूल्य जनयंत्रण) आदिे , 2013 के प्रार्धानों के तहत उस पर ब्याि के साथ अजधभाररत राजि िमा करने के जलए उत्तरदायी होगा। (ञ) इस अजधसूचना में उपरोक्त ताजलका ए के कॉलम (2) में जनर्दवष्ट ऐसे फॉमूवलिे नों के अजधकतम मूल्य िारी करने के पररणामस्ट्र्रूप, अजधकतम मूल्य या खुदरा मूल्य तय करने र्ाला मूल्य आदेि, यदद कोई हो, उपरोक्त अजधसूचना की तारीख से पहले िारी दकया गया, तो उस ेहटा ददया िाएगा। [पी.एन./268/136/2025/एफ/फा. स.ं 8(136)/2025/डी.पी/एनपीपीए-डीर्ी-II] महार्ीर सैनी, उप जनदेिक4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] MINISTRY OF CHEMICALS AND FERTILIZERS (Department of Pharmaceuticals) (NATIONAL PHARMACEUTICAL PRICING AUTHORITY) ORDER New Delhi, the 29th August, 2025 S.O. 3979(E).— Whereas, (i) Meropenem Powder for Injection 500 mg (as trihydrate) and (ii) Meropenem Powder for Injection 1000 mg (as trihydrate) are scheduled formulation under Schedule-I of DPCO 2013 and its ceiling price is fixed. And whereas, M/s Gufic Biosciences Limited have applied for separate ceiling price of (i) Meropenem Powder for Injection 500 mg (as trihydrate) and (ii) Meropenem Powder for Injection 1000 mg (as trihydrate) having special features viz. (i) self-collapsibility and self-sealability (ii) not having air-vent; and (iii) there is no chance of contamination during manufacture/ infusion/ admixing levels in dual chamber bags. And whereas, the Multidisciplinary Committee of Experts in its 69th meeting held on 03.07.2025 and 70th meeting held on 05.08.2025observed the special features as mentioned above and recommended an increase of 15% over and above the ceiling price. And whereas, National Pharmaceutical Pricing Authority (hereinafter referred as NPPA) in its 136thAuthority meeting dated 28.08.2025 accepted the recommendation of the Multidisciplinary Committee of Experts. Therefore, in exercise of powers, conferred by sub paragraph (3) and (4) of paragraph 11 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30th May, 2013, S.O. 5249(E) dated 11th November, 2022 issued by the Government of India in the Ministry of Chemicals and Fertilizers, the NPPA hereby fixes the price as specified in column (5) of the table ‘A’ for the manufacturer specified in Table ‘B’ herein below as ceiling price exclusive of goods and services tax applicable, if any, in respect of the Scheduled formulation specified in the corresponding entry in column (2) of the said Table with the dosage form & strength and unit/packaging specified respectively in the corresponding entries in columns (3) and (4) thereof: Table ‘A’ Sl. The manufacturer specified in Table B, selling the branded or generic or both the versions of scheduled formulations with dosage form and strength specified in column (2) and (3) of Table A respectively, at a price higher than the ceiling price (plus Goods and Services Tax as applicable) so fixed and notified by the Government, shall revise their prices of all such formulations downward not exceeding the ceiling price specified in column (5) in the above table plus local taxes as applicable, if any. (b) The manufacturer may add Goods and Services Tax only if they have paid actually or if it is payable to the Government on the ceiling price mentioned in column (5) of the above said table. (c) The manufacturer shall issue a price list in Form-V in compliance from date of this notification as per paragraph 24 of the DPCO, 2013.[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 5 (d) As per para 24(4) of DPCO 2013, every retailer and dealer shall display price list and the supplementary price list, if any, as furnished by the manufacturer, on a conspicuous part of the premises where he carries on business in a manner so as to be easily accessible to any person wishing to consult the same. (e) Any other manufacturer claiming separate ceiling price having special feature of dual chamber bag helping in reduction of administration time, reconstitution of the drug with distilled water in accurate dose with reduction in the possibility of contamination shall apply to NPPA for separate ceiling price approval. (f) For other special features claimed or any other pack size manufactured, the manufacturer shall approach the NPPA for specific price approval for its formulation. (g) Where an existing manufacturer of scheduled formulation with dosage or strength or both as specified in the above Table A, launches a new drug as per paragraph 2(1)(u) of the DPCO, 2013 such existing manufacturer shall apply for prior price approval of such new drug to the NPPA in Form I as specified under Schedule-II of the DPCO, 2013. (h) The manufacturer(s) of above said scheduled formulations shall furnish quarterly return to the NPPA, in respect of production / import and sale of scheduled formulations in Form-III of Schedule-II of the DPCO, 2013. Any manufacturer intending to discontinue production of above said scheduled formulation shall furnish information to the NPPA, in respect of discontinuation of the production and / or import of scheduled formulation in Form-IV of Schedule-II of the DPCO, 2013 at least six months prior to the intended date of discontinuation. (i) The manufacturer(s) not complying with the ceiling price and notes specified hereinabove shall be liable to deposit the overcharged amount along with interest thereon under the provisions of the Drugs (Price Control) Order, 2013 read with Essential Commodities Act, 1955. (j) Consequent to the issue of ceiling prices of such formulations for specified in column (2) of the above Table A in this notification, the price order(s) fixing ceiling or retail price, if any, issued prior to the above said date of notification, stand(s) superseded.
