## Report on Government of National Capital Territory of Delhi Notification Regarding Essential Services Maintenance for Electricity Providers **1. Executive Summary:** This report analyzes a notification issued by the Government of the National Capital Territory of Delhi, published on July 4, 2022. The notification extends the declaration of electricity services provided by specific power companies as essential services and prohibits strikes by their employees and engineers. This measure aims to ensure the uninterrupted supply and distribution of power to the residents of Delhi. The key finding is the extension of a previous policy, demonstrating a continued prioritization of uninterrupted electricity services in the region. **2. Introduction:** This report provides an overview and analysis of a notification issued by the Government of the National Capital Territory of Delhi regarding the maintenance of essential services within the electricity sector. The analysis is based solely on the text of the provided notification and aims to inform stakeholders about the policy's objectives, provisions, and potential impacts. **3. Policy Overview:** * This is an amendment/extension of a previous policy. * **Core Objective(s):** * To maintain essential electricity services for the people in the National Capital Territory of Delhi. * To prohibit strikes by electricity employees and engineers to ensure uninterrupted power supply. **4. Background and Rationale:** * This notification extends a previous notification (F.33/HESMA/2017/HPII/312 dated 3.1.2022) that was valid until July 3, 2022. This indicates that the government perceives a continued risk of disruption to electricity services due to potential strikes or agitations by employees. The rationale stated in the notification is that prohibiting strikes by electricity employees and engineers is "necessary and expedient in the public interest." This suggests a concern that strikes would negatively impact the public's access to essential electricity services. **5. Key Provisions / Changes:** * This notification *specifically* extends the previous order. * **What specific part of the original policy is being changed?:** The expiry date. The previous policy was set to expire on 3.7.2022. * **What the new rule/provision is:** The notification extends the prohibition of strikes by Electricity Employees & Engineers of BSES Rajdhani Power Limited BRPL, BSES Yamuna Power Limited BYPL, Tata Power Delhi Distribution Limited TPDDL DTL, IPGCL, PPCL Govt. Power Corporation from 4.7.2022 up to 3.1.2023. * **Explain the difference or the effect of this specific change:** The extension ensures the continued enforcement of the "Haryana Essential Services Maintenance Act, 1974" regarding electricity services for an additional six months. This means the power companies listed above are shielded from employee strikes during this period. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders are: * **Electricity Employees and Engineers:** Employees and engineers working for BSES Rajdhani Power Limited (BRPL), BSES Yamuna Power Limited (BYPL), Tata Power Delhi Distribution Limited (TPDDL), DTL, IPGCL, PPCL Govt. Power Corporation. They are directly affected by the prohibition on strikes. * **Power Companies:** BSES Rajdhani Power Limited (BRPL), BSES Yamuna Power Limited (BYPL), Tata Power Delhi Distribution Limited (TPDDL), DTL, IPGCL, PPCL Govt. Power Corporation. These companies are the beneficiaries of the policy, as it helps to ensure uninterrupted operations. * **Residents of Delhi:** The general public in the National Capital Territory of Delhi, who rely on these companies for electricity supply. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Lt. Governor of the National Capital Territory of Delhi is the authority issuing the notification. The Home Department, Govt. of NCT of Delhi is also involved, as indicated by the notification number. * **Timelines:** The extended prohibition on strikes is effective from July 4, 2022, to January 3, 2023. * This amendment extends the existing implementation framework. Therefore, the previous procedures for monitoring and enforcing the prohibition on strikes likely remain in place. **8. Expected Outcomes / Impact of Changes:** * The likely intended outcome of this extension is the continued prevention of disruptions to electricity services due to employee strikes or agitations. By extending the prohibition, the government aims to ensure a stable and reliable power supply for residents of Delhi. * The potential impact of the amendment is that it could lead to increased stability and predictability in the electricity sector, benefiting both the power companies and the consumers. However, it could also lead to dissatisfaction among employees and engineers who may feel that their rights to collective action are being restricted. **9. Conclusion:** The notification issued by the Government of the National Capital Territory of Delhi extends the declaration of electricity services as essential and prohibits strikes by employees and engineers of specific power companies for an additional six months. This action reflects the government's continued commitment to ensuring uninterrupted electricity services for the residents of Delhi. This report provides essential information to the industry and the concerned individuals who are impacted by this policy decision.
