Amendment to the Tamil Nadu Prohibition Act.

No. II(1)/HOPE/31/2024.—In exercise of the powers conferred by sub-section (1) of Section 18-B of the Tamil Nadu
Prohibition Act, 1937 (Tamil Nadu Act X of 1937), the Governor of Tamil Nadu hereby makes the following amendment to
the prohibition and Excise Department Notification No.II(1)/PE/239(d)/81, published at page 2 of Part II-Section 1 of the
Tamil Nadu Government Gazette Extraordinary, dated the 1st May 1981, as subsequently amended:-
Amendment.
In the said notification, in the TABLE, in the Annexure referred to in the entry “Indian Made Foreign Spirits (brand
names of which are specified in the Annexure) other than sacramental wine” in column (1), under the heading “PREMIUM
BRANDS”, under the sub-heading “Thiruvalargal Empee Distilleries Limited”, after the entry “Bols Premier XO Excellence
Brandy”, the entry “British Empire Premium Gold Whisky” shall be added.

No. II(1)/HOPE/32/2024.—In exercise of the powers conferred by sub-section (1) of Section 18-B of the Tamil Nadu
Prohibition Act, 1937 (Tamil Nadu Act X of 1937), the Governor of Tamil Nadu hereby makes the following amendment to
the prohibition and Excise Department Notification No.II(1)/PE/239(d)/81, published at page 2 of Part II-Section 1 of the
Tamil Nadu Government Gazette Extraordinary, dated the 1st May 1981, as subsequently amended:-
Amendment.
In the said notification, in the TABLE, in the Annexure referred to in the entry “Indian Made Foreign Spirits (brand
names of which are specified in the Annexure) other than sacramental wine” in column (1), under the heading “PREMIUM
BRANDS”, under the sub-heading “Thiruvalargal Golden Vats Private Limited”, after the entry “Black & Gold Premium
French Brandy VSOP”, the entry “Courrier Napoleon Ultra French Brandy” shall be added.

Declarations of the Premises of M/s.Hindustan Petroleum Corporation Limited (HPCL) – Vijayawada Dharmapuri
Pipeline Project (VDPLP) – Dharmapuri Storage Terminal and HPCL Sectionalizing Valve Station-17, located at
Sivadi Village, Nallampalli Taluk and at Kumbarahalli Village, Karimangalam Taluk respectively in Dharmapuri
District as “Prohibited Places” under the Act.

No. II(1)/PUSC/33/2024.—WHEREAS, the authority of M/s.Hindustan Petroleum Corporation Limited (HPCL),
Vijayawada Dharmapuri Pipeline Project (VDPLP), Dharmapuri Receiving Station, Dharmapuri District in its letters
No.VDPL/DPJ/015, dated 22.04.2022 and No.VDPL/DPJ/017, dated 18.12.2023, among other things, has requested to
declare the HPCL - VDPL Project, Dharmapuri Storage Terminal and HPCL - Sectionalizing Valve Station-17, located
at Sivadi Village, Nallampalli Taluk and at Kumbarahalli village, Karimangalam Taluk, wherein the Storage Terminal and
Sectionalizing Valve Station are handling petroleum products, which are flammable in nature, as Prohibited Places, under
the Official Secrets Act, 1923 (Central Act XIX of 1923);
AND WHEREAS, based on the reports and recommendations of the Revenue Divisional Officer, Dharmapuri
District and the Superintendent of Police, Dharmapuri District, the District Collector, Dharmapuri District in his letters
Rc.No.10113/2022/C3, dated 30.05.2024, Rc.No.10113/2022/C3, dated 29.07.2024 and Rc.No.10113/ 2022/C3, dated
06.09.2024 has recommended to declare the said premises of M/s. Hindustan Petroleum Corporation Limited–Vijayawada
Dharmapuri Pipeline Project, Dharmapuri Storage Terminal, located at Sivadi Village to an extent of 113.64 acres and
Hindustan Petroleum Corporation Limited - Sectionalizing Valve Station-17, located at Kumbarahalli Village to an extent of
0.20 acre as “Prohibited Places” under the Official Secrets Act, 1923 (Central Act XIX of 1923);Dec 18, 2024] TAMIL NADU GOVERNMENT GAZETTE 113
AND WHEREAS, the Collector, Dharmapuri District has stated that there is no private properties, public utilities, such
as roads, Railway lines, Temples, Churches, Mosques, Graveyards, etc. lies within the area of the proposed lands and
recommended for the declaration of the above lands as “Prohibited Places”;
AND WHEREAS, the Collector, Dharmapuri District has also informed that the total area of the land of 113.64
acres in Survey Nos.161/1B and 137 other Survey Nos. in Sivadi Village have been purchased by Hindustan Petroleum
Corporation Limited from the land owners through direct negotiation, change of ownership of Government alienated lands
and compulsory land acquisition method through patta No.2149. Likewise, the total area of the land of 0.20 in Survey
No.238/2A2 in Kumbarahalli village has been purchased from the land owner through sale deed, dated 15.03.2021 (Patta
No.1250);
AND WHEREAS, the Deputy Inspector General of Police, Intelligence (Security), Chennai, in his letter
No.SCA.3.No.6686-1/2024/C, dated 29.05.2024, has also recommended to declare the above premises as “Prohibited
Places” under the Official Secrets Act, 1923 (Central Act XIX of 1923);
AND WHEREAS, the reports / recommendations of the Collector, Dharmapuri District and the Deputy Inspector
General of Police, Intelligence (Security), Chennai, were examined carefully and the Government has come to a conclusion
that it is necessary to declare the premises of M/s.Hindustan Petroleum Corporation Limited – Vijayawada Dharmapuri
Pipeline Project – Dharmapuri Storage Terminal and Hindustan Petroleum Corporation Limited - Sectionalizing Valve
Station-17, as specified in the Schedules I and II below, to be ‘Prohibited Places’ under Clauses (c) and (d) of Sub-Section
(8) of Section 2 of the Official Secrets Act, 1923 (Central Act XIX of 1923), on the grounds that the premises are being dealt
with for storage of petroleum products, which is an highly explosive products; that any information with respect thereto, or
damage thereto, or the destruction or obstruction thereof, or interference therewith, would be useful to an enemy;
AND WHEREAS, in pursuance of clause (1) of Article 258 of the Constitution of India, the Government of India,
Ministry of Home Affairs, New Delhi, have in its Notification No.S.O.1285, dated the 4th May 1963, published in the Gazette
of India, dated the 11th May 1963, entrusted to the Government of Tamil Nadu, the functions of the Central Government
in relation to any matter specified in Clauses (c) and (d) of Sub-Section (8) of Section 2 of the Official Secrets Act, 1923
(Central Act XIX of 1923);
NOW, THEREFORE, in exercise of the powers conferred by Clauses (c) and (d) of Sub-Section (8) of Section 2 of
the Official Secrets Act, 1923 (Central Act XIX of 1923), the Governor of Tamil Nadu hereby declares, with effect on
and from the date of publication of this Notification in the Tamil Nadu Government Gazette, the premises of M/s.Hindustan
Petroleum Corporation Limited – Vijayawada Dharmapuri Pipeline Project – Dharmapuri Storage Terminal and Hindustan
Petroleum Corporation Limited – Sectionalizing Valve Station-17, as specified in the Schedules below, to be “Prohibited
Places” for the purposes of the said Act:-

No. II(1)/PUSC/34/2024.— WHEREAS, the Ch.General Manager (Ops), Tamil Nadu State Office, M/s.Indian Oil
Corporation Limited, Marketing Division, Southern Region, “Indian Oil Bhavan”, 139, Uthamar Gandhi Salai, Chennai
– 600 034, in the letter No.TNSO/ OPS/01/A, dated 17.12.2021, addressed to the District Collector, Kallakurichi among
other things, has requested to declare the area of 74.605 acres with Survey No.365/4 in SIDCO Industrial Estate, Asanur
belonging to Indian Oil Corporation Limited (Grass Root POL Terminal), located at Asanur village, Ulundurpet Taluk,
Kallakurichi District, wherein the Terminal handling petroleum products, an highly hazardous in nature, as Prohibited Place,
under clause (d) of sub-section (8) of section 2 of the Official Secrets Act, 1923 (Central Act XIX of 1923);
AND WHEREAS, based on the reports and recommendations of the Revenue Divisional Officer, Thirukovilur and the
Superintendent of Police, Kallakurichi District, the Collector, Kallakurichi District in the letters Rc.No.C5/1411/2022, dated
12.09.2022, 01.04.2024, 28.09.2024 and 13.11.2024 has recommended to declare the said premises of M/s.Indian Oil
Corporation Limited (Grass Root POL Terminal), located at Asanur Village in Kallakurichi District to an extent of 74.60½
acres as “Prohibited Place” under the Official Secrets Act, 1923 (Central Act XIX of 1923);Dec 18, 2024] TAMIL NADU GOVERNMENT GAZETTE 115
AND WHEREAS, the Collector, Kallakurichi District has also informed that the total area of the land of 74.60½ acres
in Survey No.365/4 in Asanur Village has been purchased by M/s.Indian Oil Corporation Limited from the SIDCO Industrial
Estate vide document No.310/2022 and establishing Oil Storage Tankages for storing petroleum related products;
AND WHEREAS, the Inspector General of Police, Intelligence, Chennai, in his letter No.SCA.3.No.20874-1/ 2022/C,
dated 14.08.2023, has also recommended to declare the above premises as “Prohibited Place” under clause (d) of
sub-section (8) of section 2 of the Official Secrets Act, 1923 (Central Act XIX of 1923);
AND WHEREAS, the reports/recommendations of the Collector, Kallakurichi District and the Inspector General of
Police, Intelligence, Chennai, were examined carefully and the Government have come to a conclusion that it is necessary
