No. 336 भाग II—I PART II—I राष्ट्रीय रािधानी राज्य क्षत्रे दिल्ली सरकार GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI कायाला य मख्ु य जनर्ाचा न अजधकारी, दिल्ली अजधसचू ना दिल् ली, 11 िनर्री, 2025 स.म.ु च.ु अ./च.ु स.ं /102(2)/2025/1360. –– जनम्न जलजित को सर्ासाधारण की िानकारी के जलए प्रकाजित दकया िाता ह:ै — भारत जनर्ाचा न आयोग आििे नई दिल्ली,8 िनर्री,2025 स.ं 3/4/आईडी/2025/एसडीआर/िण्ड-I.––यतः लोक प्रजतजनजधत्र् अजधजनयम, 1951 की धारा 61 में यह उपबंजधत है दक जनर्ााचकों के प्रजतरुपण का जनर्ारण करने की िजृ ि से, तादक उक्त अजधजनयम की धारा 62 के अधीन र्ास्ट्तजर्क जनर्ााचकों का उनके मत िेने के अजधकार को और अजधक प्रभार्ी बनाया िा सके, मतिान के समय जनर्ााचकों की पहचान सुजनजित करने के साधन के रुप में जनर्ााचकों के जलए जनर्ााचक फोटो पहचान पत्र के उपयोग हते ु जनयमों के द्वारा उपबंध दकए िा सकते हैं, तथा 296 DG/2025 (1)2 DELHI GAZETTE : EXTRAORDINARY PART II—I] 2. यतः जनर्ााचकों का रजिजस्ट्रकरण जनयम, 1960 का जनयम 28 जनर्ााचन आयोग को, इस िजृि से दक जनर्ााचकों के प्रजतरुपण का जनर्ारण हो सके तथा मतिान के समय उनकी पहचान को सरल बनाया िा सके, जनर्ााचको को राज्य की लागत पर फोटोयुक्त जनर्ााचक फोटो-पहचान पत्र िारी करने के जलए जनिेि िेने की िजक्त प्रिान करता है; तथा 3. यतः, जनर्ााचनों का संचालन जनयम, 1961 के जनयम 49 ि(3) और 49 ट(2) (ि) में यह उपबंजधत ह ै दक िहााँ दकसी जनर्ााचन क्षेत्र के जनर्ााचकों को जनर्ााचक रजिजस्ट्रकरण जनयम, 1960, के जनयम 28 के उक्त उपबंधों के अधीन जनर्ााचक फोटो पहचान- पत्र दिए गए ह,ैं र्हां जनर्ााचकों को मतिान केन्द्र में अपना जनर्ााचक फोटो पहचान-पत्र दििाना होगा तथा उनकी ओर से उन जनर्ााचक फोटो पहचान पत्रों को नहीं दििाए िाने या दििाने में असमथा होने पर उन्द्ह ेंमत डालने की अनुमजत िेने से इन्द्कार दकया िा सकता है; तथा 4. यतः, उक्त अजधजनयम, और जनयमों के उपयुाक्त उपबंधों को जमलाकर एर्ं सामंिस्ट्यपूणा ढंग से उनके अध्ययन से यह स्ट््षट होता ह ैदक यद्यजप मत िेने का अजधकार जनर्ााचक नामार्ली में नाम के होने से ही होता हैं, यह जनर्ााचन आयोग द्वारा राज्य की लागत पर, मतिान के समय उनकी पहचान स्ट्थाजपत करने के साधन के रुप में प्रिान करर्ाए गए जनर्ााचक फोटो पहचान पत्र के प्रयोग पर भी जनभार करता ह,ै तथा िोनों का एक साथ प्रयोग करना होता है; तथा 5. यतः, जनर्ााचन आयोग ने एक समयबद्ध कायाक्रम के अनुसार सभी जनर्ााचकों को जनर्ााचक फोटो पहचान-पत्र ई0पी0आई0सी0 िारी करने का जनिेि िेते हुए 28 अगस्ट्त, 1993 को एक आिेि िारी दकया है; तथा 6. यतः, राष्ट्रीय रािधानी क्षेत्र दिल्ली तथा उत्तर प्रिेि एर्ं तजमलनाडु राज्यों में उप-चुनार् र्ाले जनर्ााचन क्षेत्रों में लगभग 100% मतिाताओं को मतिाता फोटो पहचान पत्र िारी दकए िा चुके हैं; तथा 7. अत: अब, सभी संबद्ध कारकों तथा जर्जधक एर्ं तथ्यात्मक जस्ट्थजतयों को, ध्यान में रिते हुए, जनर्ााचन आयोग, एतद्द्वारा, यह जनिेि िेता ह ै दक दिनांक 10 िनर्री, 2025 को अजधसजू चत दकये िाने र्ाले, राष्ट्रीय रािधानी क्षेत्र दिल्ली जर्धानसभा के साधारण जनर्ााचन एर्ं उत्तर प्रिेि में 273-जमल्कीपुर (अ.िा.) जर्धानसभा जनर्ााचन क्षेत्र और तजमलनाडु में 98-इरोड (पूर्ा) जर्धानसभा जनर्ााचन क्षेत्र के उप जनर्ााचनों के जलए सभी जनर्ााचकों जिन्द्ह ेंजनर्ााचक फोटो पहचान पत्र िारी दकए गए ह,ैं से अपेक्षा की िाती ह ै दक र्े मतिान स्ट्थल पर अपना मत डालने से पहले अपनी पहचान सुजनजित करने हते ु अपना जनर्ााचक फोटो पहचान पत्र दििाएंगे। ऐसे जनर्ााचक िो अपना जनर्ााचक फोटो पहचान पत्र प्रस्ट्तुत नहीं कर पाते ह,ैं उन्द्हें अपनी पहचान स्ट्थाजपत करने के जलए जनम्नजलजित र्ैकजल्पक फोटो पहचान िस्ट्तार्ेिों में से कोई एक प्रस्ट्तुत करना होगा:- i. आधार काडा। ii. मनरेगा िॉब काडा , iii. बैंको / डाकघरों द्वारा जनगात फोटोयुक्त पासबुक, iv. श्रम मंत्रालय की योिना के अन्द्तगात जनगात स्ट्र्ास्ट्थ्य बीमा स्ट्माटा काडा, v. ड्राइवर्ंग लाइसेन्द्स , vi. पैन काडा, vii. एनपीआर के अंतगात आरिीआई द्वारा जनगात स्ट्माटा काडा, viii. भारतीय पासपोटा; ix. फोटोयुक्त पेंिन िस्ट्तार्ेि , x. केन्द्र/ राज्य सरकार/ लोक उपक्रम/पजललक जलजमटेड कंपजनयों द्वारा अपने कमाचाररयों को िारी दकए गए फोटोयुक्त सेर्ा पहचान पत्र, xi. सांसिो/ जर्धायकों / जर्धान पररषि ्सिस्ट्यों को िारी दकए गए सरकारी पहचान पत्र, और xii. यूजनक जडसएजबजलटी आईडी (यूडीआईडी) कार्डा, सामाजिक न्द्याय एर्ं अजधकाररता मंत्रालय, भारत सरकार। 8. एजपक के संबंध में, लेिन अिुजद्धयां, र्तानी की अिुजद्धयां इत्यादि को निरअंिाि कर िेना चाजहए बितें जनर्ााचक की पहचान एजपक स े सुजनजित की िा सके। यदि कोई जनर्ााचक कोई ऐसा जनर्ााचक फोटो पहचान पत्र पेि करता ह,ै िो दक दकसी अन्द्य जर्धान सभा जनर्ााचन-क्षेत्र के जनर्ाचा क रजिस्ट्रीकरण अजधकारी द्वारा िारी दकया गया हैं, तो ऐसे एजपक भी पहचान स्ट्थाजपत करने हते ू स्ट्र्ीकृत दकए िाएंग े बितें उस जनर्ााचक का नाम िहा ं र्ह मतिान करने आया ह ै उस मतिान केंर स े संबंजधत जनर्ााचक नामार्ली में उपललध हो। यदि फोटोग्राफ इत्यादि के बेमेल होने के कारण जनर्ााचक की पहचान सुजनजित करना संभर् न हो तब जनर्ााचक को उपयुाक्त पैरा 7 में उजल्लजित दकसी एक र्ैकजल्पक फोटो िस्ट्तार्ेि को प्रस्ट्तुत करना होगा।[PART II—I DELHI GAZETTE : EXTRAORDINARY 3 9. उक्त पैरा 7 में दकसी बात के होते हुए भी, प्रर्ासी जनर्ााचकों को िो अपने भारतीय पासपोटा में जर्र्रणों के आधार पर लोक प्रजतजनजधत्र् अजधजनयम, 1950 की धारा 20क के अधीन जनर्ााचक नामार्जलयों में पंिीकृत हैं, मतिान केन्द्र में केर्ल उनके मूल पासपोटा (तथा कोई अन्द्य पहचान िस्ट्तार्ेि नहीं) के आधार पर ही पहचाना िाएगा । आिेि से, बी. सी. पात्रा ,सजचर् ––––––––––––– vkns”k ls jkts”k dqekj fo”k’s k eq[; fuokZpu vf/kdkjh] fnYyh OFFICE OF THE CHIEF ELECTORAL OFFICER, DELHI NOTIFICATION Delhi, the 11th January 2025 No. CEO/COE/102(2)/2025/1360.–– The following is published for general information: — ELECTION COMMISSION OF INDIA ORDER New Delhi ,8 January ,2025 No.3/4/ID/2025/SDR/VOL.I.––Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing personation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and 2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing personation of electors and facilitating their identification at the time of poll, issue of Electors’ Photo Identity Card to electors bearing their photographs at State cost; and 3. Whereas, Rules 49H (3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors’ Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Elector Photo Identity Card at the polling station and failure or refusal on their part to produce those Elector Photo Identity Card may result in the denial of permission to vote; and 4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Elector Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and 5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors’ Photo Identity Card (EPIC) to all electors, according to a time bound programme; and 6. Whereas, Electors’ Photo Identity Card have been issued to approximately 100% electors in NCT of Delhi, and the constituencies going for bye election in the State of Uttar Pradesh & Tamil Nadu; and 7. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that for the current general election to the Legislative Assembly of NCT of Delhi and bye-elections to 273-Milkipur(SC) Assembly Constituency in Uttar Pradesh and4 DELHI GAZETTE : EXTRAORDINARY PART II—I] 98-Erode(East) Assembly Constituency in Tamil Nadu, to be notified on 10th January, 2025, all electors who have been issued EPIC are expected to produce the EPIC for their identification at the polling stations before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity: - i. Aadhaar Card, ii. MNREGA Job Card, iii. Passbooks with photograph issued by Bank/Post Office, iv. Health Insurance Smart Card issued under the scheme of Ministry of Labour, v. Driving License, vi. PAN Card, vii. Smart Card issued by RGI under NPR, viii. Indian Passport, ix. Pension document with photograph, x. Service Identity Cards with photograph issued to employees by Central/State Govt./PSUs/Public Limited Companies, xi. Official identity cards Issued to MPs/MLAs/MLCs; and xii. Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of India. 8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an EPIC which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification provided that the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 above. 9. Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral roll under Section 20A of the Representation of the People Act, 1950, based on the particulars in their Indian Passport, shall be identified on the basis of their original passport only (and no other identity document) at the polling station.
