Short - Titles and Commencements: (i) These Regulations may be called ‘Delhi Water Board Septage Management Regulations 2018’ (ii) These Regulations shall come into force on the date their publication in the Delhi Gazette. 2. Definitions: (i) ‘Act’ means the Delhi Water Board Act, 1998 (Delhi Act N0. 4 of 1998); (ii) ‘Board’ means the Board as defined in the Act; (iii) ‘CEO’ means the Chief Executive Officer of the Board; (iv) ‘Cleaning’ means removal of septage; (v) ‘Committee’ means the Septage Management Committee constituted in each District headed by the District Magistrate; the Members of the Committee may be co-opted by the District Magistrate from Government Departments, Public Undertakings, Municipalities etc. including Delhi Jal Baord. (vi) ‘Designated Officer(s)’ means an officer of Delhi Jal Board authorized by Chief Executive Officer to issue license or any other work assigned to him; (vii) ‘Disposal’ means transfer of septage to a designated location; (viii) ‘District Magistrate’ means the District Magistrate of the area appointed by the Government. of National Capital Territory of Delhi and authorized to ensure the enforcement as well as compliance of these Regulations. He/she shall head the Committee constituted for enforcement and compliance of these Regulations; (ix) “Drain” means as board as defined in the act. (x) “License” means a written permission granted for this purpose to any person, Government. department, public undertaking, local bodies, firm, company registered under the Indian Companies Act, Associations, Society registered under Society Registration Act-1860 etc. intend to carry out the services of septage management having mentioned the purpose, period, name and address, route etc. under the signature of the authorized signatory of the Delhi Jal Board; (xi) “Licensee” means any person /department /agency firm holding license. (xii) ‘Licensed vehicle’ means a registered vehicle carrying valid license for cleaning, disposal and transportation of septage; (xiii) “Manhole” means an opening through which a man may enter or leave a sewer or other closed structure for inspection, cleaning and other maintenance operations, fitted with a suitable cover; (xiv) ‘Member Secretary’ means Secretary of the Committee nominated by the Chief Executive Officer, Delhi Jal Board; (xv) “Notified location” means the location of delivery and disposal of septage, as defined and earmarked by Delhi Jal Board.[PART IV DELHI GAZETTE : EXTRAORDINARY 17 (xvi) ‘IN PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITATION Act-2013’ means Prohibition of Employment as Manual Scavenger and their Rehabilitation Act-2013 and Rules made there under. (xvii) ‘Penalty’ means financial punishment imposed for violation of these Regulations. (xviii) “Registered Vehicle’ means a vehicle duly registered by the Transport Authority of the State to perform the designated purpose; (xix) “Septage” means fecal sludge produced in septic tanks; (xx) “Septic-Tank” An underground tank that treats wastewater by a combination of solids settling and anaerobic digestion. The effluents may be discharged into soak pits or small bore sewers and the solids have to be pumped out periodically. (xxi) “Sewers” means conduits provided for the purposes of carrying the liquid wastes of the community, otherwise known as sewage or sludge. (xxii) “Sewage Pumping Station (SPS)” means the pump-house of Delhi Jal Board from where Sewage is pumped to a desired location. (xxiii) “Sewage Treatment Plant (STP)” means the place where Sewage is treated by Delhi Jal Board. (xxiv) “Sludge” means the settled solid-matter in semi-solid condition, it is usually a mixture of solids and water deposited at the bottom of Septic-tank, ponds etc. The term sewage- sludge is generally used to describe residuals from centralized waste water treatment while the term Septage is used to describe the residual from septic tank. (xxv) ‘Transportation’ means safe transfer of septage through licensed vehicle from the place of work to the designated disposal location; (xxvi) “Treatment” means any Technical method or process Design to alter the physical, chemical or biological and radiological character or composition of any waste or waste water to reduced or prevent pollutions. (xxvii) ‘Vendor(s)’ means the person/entities that have been granted license by the Designated Officer of Delhi Jal Board. (xxviii) ‘Worker(s)’means any person engaged by the Vender(s) for removal, transportation and disposal of septage. All other words and expressions used in these Regulations and not defined in these regulations and not defined herein above but defined in the Act or any other law for the time being in force shall have the meaning respectively assigned to them under the Act or law and in absence thereof, the meaning as commonly understood in the water supply and sewage treatment / disposal industry. CHAPTER-II LICENSE FOR COLLECTION AND TRANSPORTATION OF SEPTAGE 3. License to be issued by the Delhi Jal Board. Designated officer(s) of Delhi Jal Board will issue License for Collection and Transportation of Septage to notified locations.18 DELHI GAZETTE : EXTRAORDINARY PART IV] (i) License will be issued in the format, prescribed in Annexure –(1), of these Regulations and will be valid for a period of five years from the date of issue, unless revoked earlier, and shall be renewable on its expiry subject to fulfilment of terms and conditions by the Licensee and on payment of fee prescribed for renewable. 4. Criteria for issue of License a. The eligible applicant for obtaining the license means the person/entities as defined in regulation-2 clause (x) of these Regulations. b. The applicant should own leak-proof, odour and spill proof transporting vehicle (s) with a proper vacuum/ suction and discharging arrangement. c. The vehicle will have a valid permit of the Transport Department to operate in Delhi. d. The applicant shall have workers adequately trained for this purpose. e. The workers shall be equipped with safety gears and other protective equipment required to safely collect, transport and dispose of the Septage at the notified locations. 5. Application for License The application for obtaining License for collection, transportation and disposal of Septage shall be submitted in prescribed format appended as annexure Annexure –(2) including Terms and Conditions and with such documents as prescribed by the Designated Officer (s) of Delhi Jal Board. 6. Invitation of Applicants to apply for License. Delhi Jal Board shall give wide publicity on its web site and through leading Newspapers and other print and electronic media periodically, inviting prospective applicants to apply for the License. 7. Application Fee for the License Delhi Jal Board shall charge application fee as prescribed from time-to-time for processing the application to grant the License. The fee will be Non-refundable and the same can be paid electronically or by Demand Draft in favour of Delhi Jal Board. 8. Performance Guarantee. The Licensee shall deposit prescribed amount, notified from time-to-time as performance Guarantee, in the form of Bank Guarantee which will be forfeited in case of any violation under the Regulations. 9. Publicity of the Licensed Vendor(s). The Delhi Jal Board will periodically give wide publicity to the Agencies on its website as well as through print and electronic media, who have been granted License under these Regulations to undertake the work of collections and transportation of Septage. 10. Awareness Campaign The Delhi Jal Board will undertake an awareness campaign to make the people aware of these Regulations as well as the need to engage only the Licensed agencies for collection, transportation and disposal of Septage.[PART IV DELHI GAZETTE : EXTRAORDINARY 19 CHAPTER-III 11. COLLECTION AND TRANSPORTATION OF SEPTAGE Septic Tank Waste (Septage) shall be collected and transported only by vendor(s) having a valid License for this purpose issued by the Delhi Jal Board in the format prescribed at Annexure-(1) of these Regulations. 12. Owner/occupier of Building to engage only Licensed vendor(s). (a) It shall be the duty of each owner/occupier of the building to engage the services of only those vendor(s) who has been issued License by the Delhi Jal Board for collection and transportation of Septage. (b) The owner/occupier shall confirm that the License issued to the vendor(s) is valid on the date of execution of work. She/he shall also append her/his signature to the collection of septage record form prescribed at Annexure-3 of these Regulations. 13. Fee for Collection/Transportation of Septage. (a) The fee for collection and transportation of Septage up to notified locations at Sewage Pumping Station(s)/Sewage Treatment Plant(s) shall be as notified by the Designated officer of Delhi Jal Board from time to time. (b) Licensee shall not charge any amount from the Owner/Occupier of the Building in excess to the amount notified from time to time. (c) Any demand for fee for collection and transportation of Septage in excess of the notified fee shall make the Licensee liable for cancellation of License and imposition of penalty prescribed for violation of these Regulations. 14. Vehicles for Transportation of Septage. The Septage shall be transported only in the Vehicles approved for these purposes by the Designated Officer of Delhi Jal Board. 15. Precautions during Transportation. The Licensee shall ensure that there will be no leakage/spillage of the Septage during transportation from the collection point to the notified location for disposal. 16. Preventive Measure in Case of Accident. The vehicle carrying Septage shall be fitted with required equipments to avoid the pollution during the movement of the vehicle from Collection point to the notified disposal location. 17. Liability of Licensee in the Eventuality of Accident. The Licensee shall be fully and solely liable for any damage cause to any person, vehicles, property and environment in the eventuality of any accident or disaster and shall be liable on its own to pay any damage charges /compensation, if any imposed by the authority /court of law there to, to the victims/their legal heirs. 18. Safety- Measure for the worker(s) deployed. The Licensee shall be responsible for taking all the Safety Measures including provision of hand held Gas- Detectors, Gas-Masks, Protective-Gear, Oxygen-Mask with Oxygen- Cylinder and First Aid Box etc. and such20 DELHI GAZETTE : EXTRAORDINARY PART IV] other Measures as specified in Prohibition of Employment as Manual Scavengers and their Rehabilitation Act -2013 and Rules made there under including these Regulations. 19. Disposal of Septage. (a) The Licensee shall dispose off Septage only at the locations notified by the Delhi Jal Board from time to time. (b) The Licensee shall submit duly signed Septage collection and disposal form prescribed at Annexure -2 of these Regulations duly filled-in to the official of the Delhi Jal Board deployed to receive the Septage at the notified locations. 20. Training of worker(s). The Licensee shall be responsible for periodic training of the worker(s) deployed in collection, transportation and disposal of the Septage. 21 Regular Health Check up of worker(s) The Licensee shall be responsible for ensuring that every worker(s) deployed under goes Health Check-up at least twice per year and submit record of the same to Delhi Jal Board failing which the licensee shall be liable to pay penalty as notified from time to time . 22. Insurance The worker(s) deployed by the Licensee shall be insured to cover compensation to be paid to the victims /their legal heirs under IN PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITATION Act 2013 & APEX Court’s order dated 27-03-2014 in Writ Petition No.583 of 2003 (Safai Karamchari Andolan and Ors. V/s Union of India & Ors.) in the eventuality of accident during the process of Cleaning, Transportation and Disposal of Septage. 23. Cancelation of License. In case of violation of any of the provisions of IN PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITATION Act-2013 including these Regulations, the Licensee shall be liable to pay penalty as notified from time to time, including the Cancellation of license and forfeiture of performance guarantee as per the recommendation of Committee or Designated Officer (s). CHAPTER IV Disposal of Septage 24. Identification of Disposal Sites The Delhi Jal Board will identify and notify the Sewage Pumping Stations and Sewage Treatment Plants where the Septage shall be disposed of by the License vendor(s). 25. Creation of Infrastructure to Receive the Septage. The Board will create necessary infrastructure and provide necessary equipments at the notified locations, to facilitate the disposal of Septage brought by the License vendor(s).[PART IV DELHI GAZETTE : EXTRAORDINARY 21 26. Deployment of Staff to Receive the Septage The Delhi Jal Board shall deploy sufficient staff at each notified locations, to receive the Septage and dispose it off through the Sewage Treatment Plants and Sewage Pumping Stations as the case may be. 27. Timing to Receive the Septage The Septage will be received by the staff deployed by the Delhi Jal Board at each notified location during the hours as notified from time to time. 28 Industrial Waste not to be received. The disposal of septage containing the Industrial waste shall not be permitted at the notified locations. 29 Training in Septage Management The staff deployed by Delhi Jal Board at the notified locations will be trained for receiving and disposal of Septage. CHAPTER V MISCELLANEOUS 30 Display of License and Colour Coding on the Vehicle (a) A copy of License shall be prominently displayed on the vehicle used for transportation of Septage. (b) The vehicle/ container/tanker shall be painted with Yellow colour duly marked with (the precaution) in Red Colour “SEPTAGE TANK” (in English) and “ ” (in Hindi). 31 Installation of GPS System Each Vehicle used for Transportation of Septage shall be fitted with GPS Device and Access Rights of the same shall be given to the respective District Magistrates and the Agency Notified by District Magistrates for tracking of such vehicles. 32. Dispute Resolution Clause Any dispute, arising out or in the connection with the operation of these regulations, shall be resolved under Indian Laws by competent Court of Law having jurisdiction of Delhi only. License will be issued in the format, prescribed in Annexure –(1), of these Regulations and will be valid for a period of five years from the date of issue, unless revoked earlier. 3. Fee for Collection/Transportation of Septage. (a) The fee for collection and transportation of Septage up to notified locations at Sewage Pumping Station(s)/Sewage Treatment Plant(s) shall be as notified by the Designated officer of Delhi Jal Board from time to time. (b) Licensee shall not charge any amount from the Owner/Occupier of the Building in excess to the amount notified from time to time. (c) Any demand for fee for collection and transportation of Septage in excess of the notified fee shall make the Licensee liable for cancellation of License and imposition of penalty prescribed for violation of these Regulations. 4. Application Fee for the License Delhi Jal Board shall charge application fee per vehicle as prescribed from time-to-time for processing the application to grant the License. The fee will be Non-refundable and the same can be paid electronically or by Demand Draft in favour of Delhi Jal Board. 5. Performance Guarantee. The Licensee shall deposit prescribed amount per vehicle, notified from time-to-time as performance Guarantee, in the form of Bank Guarantee which will be forfeited in case of any violation under the Regulations. 6. Vehicles for Transportation of Septage. The Septage shall be transported only in the Vehicles approved for these purposes by the Designated Officer of Delhi Jal Board. 7. Precautions during Transportation. The Licensee shall ensure that there will be no leakage/spillage of the Septage during transportation from the collection point to the notified location for disposal. 8. Preventive measure in case of accident. The vehicle carrying Septage shall be fitted with required equipments to avoid the pollution during the movement of the vehicle from Collection point to the notified disposal location. 9. Liability of Licensee in the eventuality of accident. The Licensee shall be fully and solely liable for any damage cause to any person, vehicles, property and environment in the eventuality of any accident or disaster and shall be liable on its own to pay any damage charges /compensation, if any imposed by the authority /court of law there to, to the victims/their legal heirs. 10. Safety- Measure for the worker(s) deployed. The Licensee shall be responsible for taking all the Safety Measures including provision of hand held Gas- Detectors, Gas-Masks, Protective-Gear, Oxygen-Mask with Oxygen- Cylinder and First Aid Box etc. and such other Measures as specified in IN PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITATION Act -2013 and Rules made there under including these Regulations.26 DELHI GAZETTE : EXTRAORDINARY PART IV] 11. Disposal of Septage. (a) The Licensee shall dispose off Septage only at the locations notified by the Delhi Jal Board from time to time. (b) The Licensee shall submit duly signed Septage collection and disposal form prescribed at Annexure -3 of these Regulations duly filled-in to the official of the Delhi Jal Board deployed to receive the Septage at the notified locations. 12. Training of worker(s). The Licensee shall be responsible for periodic training of the worker(s) deployed in collection, transportation and disposal of the Septage. 13. Regular Health Check up of worker(s) The Licensee shall be responsible for ensuring that every worker(s) deployed under goes Health Check-up at least twice per year and submit record of the same to Delhi Jal Board failing which the licensee shall be liable to pay penalty as notified from time to time . 14. Insurance The worker(s) deployed by the Licensee shall be insured to cover compensation to be paid to the victims /their legal heirs under IN PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITATION Act 2013 & APEX Courts order dated 27-03-2014 in Writ Petition No.583 of 2003 in the eventuality of accident during the process of Cleaning, Transportation and Disposal of Septage. 15. Cancellation of License. In case of violation of any of the provisions of IN PROHIBITION OF EMPLOYMENT AS MANUAL SCAVENGERS AND THEIR REHABILITATION Act-2013 including these Regulations, the Licensee shall be liable to pay penalty as notified from time to time, including the Cancellation of license and forfeiture of performance guarantee as per the recommendation of Committee or Designated Officer (s) 16. Identification of Disposal Sites The Delhi Jal Board will identify and notify the Sewage Pumping Stations and Sewage Treatment Plants where the Septage shall be disposed of by the License vendor(s). 17. Creation of Infrastructure to Receive the Septage. The Board will create necessary infrastructure and provide necessary equipments at the notified locations, to facilitate the disposal of Septage brought by the License vendor(s). 18. Deployment of staff to receive the Septage The Delhi Jal Board shall deploy sufficient staff at each notified locations, to receive the Septage and dispose it off through the Sewage Treatment Plants and Sewage Pumping Stations as the case may be. 19. Timing to receive the Septage The Septage will be received by the staff deployed by the Delhi Jal Board at each notified location during the hours as notified from time to time. 20. Industrial Waste not to be received. The disposal of septage containing the Industrial waste shall not be permitted at the notified locations. 21. Training in Septage Management The staff deployed by Delhi Jal Board at the notified locations will be trained for receiving and disposal of Septage. 22. Display of License and colour coding on the vehicle (a) A copy of License shall be prominently displayed on the vehicle used for transportation of Septage. (b) The vehicle/ container/tanker shall be painted with Yellow colour duly marked with (the precaution) in Red Colour “SEPTAGE TANK” (in English) and[PART IV DELHI GAZETTE : EXTRAORDINARY 27 “ ” (in Hindi). 23. Installation of GPS System Each Vehicle used for Transportation of Septage shall be fitted with GPS Device and Access Rights of the same shall be given to the respective District Magistrates and the Agency Notified by District Magistrates for tracking of such vehicles. 24. Application for License The application for obtaining License for collection, transportation and disposal of Septage shall be submitted in the format attached as Annexure-2 of the regulations along with the following documents:- i) Format available as above to be duly filled up. ii) List of number of vehicles with registration number and year of Manufacture. iii) Self-attested Copy of Valid Permits of vehicles(s) obtained from the Transport Authority. iv) Self-attested copy of proof of address for communication. v) List of worker(s)viz Vehicle Driver, Helper etc. vi) List of safely equipments with each vehicle vii) Application fee in the form of DD/ Pay Order amounting to Rs (As prescribed from time to time) per vehicle drawn in favour of Delhi Jal Board. viii) Performance Guarantee in form of Bank Guarantee in favour of Delhi Jal Board amounting to Rupees (As notified by designated officer)) only per vehicle. ix) Applicant to bring along Original Documents for verification of Permit of vehicles(s) and address proof for verification at the time of submission of the application. It is hereby undertaken that the above stated terms and conditions have been clearly understood and I/we fully agree to abide by the same. Date: Name: Place: Address: Contact no: Modified Standard Operating Practices for workers safety in sewer lines, septic tanks and closed pits: 1. Background: Hon’ble Lt. Governor convened a meeting on 21.08.2017 taking cognizance of many deaths of sewer workers in Delhi. Hon’ble Lt. Governor expressed concerns on lack of awareness about mandatory actions that are needed to carry out cleaning, removing blockage of drains, septic tanks, sewers etc. under the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act - 2013, “PEMS Act-2013” annexed as Annexure -1. The Hon’ble Supreme Court in the matter WP(C) 583/2003 has also given judgment in this regard which is annexed as Annexure-2. Hon’ble Lt. Governor constituted a three members committee comprising of Chief Executive Officer (Delhi Jal Board), Commissioner (South Delhi Municipal Corporation) and Chairman (New Delhi Municipal Council). Detailed deliberations were held and; thereafter, detailed Standard Operating Procedure (SOP) have been formulated which are enumerated herein below for implementation as per provisions of PEMS Act – 2013 and General Safety Measures of worker engaged in cleaning, removal of blockage in drain, sewer, septic tanks etc. within the jurisdiction of Govt. of NCT of Delhi.28 DELHI GAZETTE : EXTRAORDINARY PART IV] 2. Jurisdiction: S. N. Area of working Authority/Department responsible 1. Entire sewerage network in sewered areas being Delhi Jal Board maintained by DJB within Delhi Municipal limits. 2. Sewer line, private septic tanks/close pits in Delhi Delhi Cantonment Board Cantonment Area. 3. Sewer lines/ septic tanks if any, maintained in New New Delhi Municipal Council Delhi Municipal Council Limit 4. All septic tanks and the House sewer connections All Municipal Corporations, Delhi Cantonment constructed by private entities etc. where sewer Board, New Delhi Municipal Council, Delhi lines are not being maintained by DJB. Development Authority etc. and the private entities which is owner of the premises. 5. Apartments/ Group Housing Societies/ Malls/Pvt. Resident Welfare Associations/ Owner of the premise Hospitals etc. 6. Government Premises The respective authority i.e Delhi Development Authority, PWD, CPWD, all Municipal Corporations, Delhi Cantonment Board, Delhi Urban Shelter Improvement Board etc.; maintaining the premise 3. Procedure: a. Working in Sewered areas: After receiving any complaint, information, work regarding to blockage in sewer line, following standard operating procedure will be adopted: - In Compliance to the Rule 3(1) of the Prohibition of Employment as Manual Scavengers (PEMS) Act 2013, as far as possible, the intervention of manual cleaning be avoided. All the maintenance work of sewer line will have to be completely switched over to mechanical machinery. If, necessary for the workers to go down in the manhole, only trained workers will be assigned this job after taking all safety measures. 1. In compliance to Rule 6(3) j of the PEMS Act 2013, the Assistant Engineer(AE)/Junior Engineer(JE)/Supervisor shall have all emergency contract number of Ambulance, Police, Fire Brigade, nearby hospitals before issuance of work permit for man entry to provide immediate relief in case of any accident. 2. In compliance to Rule 6(3) a, of the PEMS Act 2013 at least three workers along with supervisor not less than the rank of Assistant Sanitary Inspector(ASI)/ Sanitary Inspector(SI)/Junior Engineer(JE) will be associated.[PART IV DELHI GAZETTE : EXTRAORDINARY 29 All these workers shall mark their attendance with the Supervisory Staff as mentioned above before leaving to attend the work of removal of blockage, cleaning etc. 3. In compliance to Rule 6(3) q, r, s of the PEMS Act 2013, before entering the sewer manhole, the manhole cover of two or three manholes on both sides (downstream & upstream) of the work place will be opened and barricaded with sign board on both sides properly to restrict the entry of other persons. These manholes will be left open for minimum one hour before entry to ensure that all the obnoxious gases are emitted. No unauthorized person shall be allowed nearby these manholes. Ignition and smoking shall be strictly prohibited near and around the manholes. 4. In compliance to Rule 7(i) of the PEMS Act 2013 the blowers/ exhaust fans will be placed on either side of the manhole before and during working in the manholes to ventilate the sewer line. All the safety gadgets as provided in the Manual Scavenging Rules, 2013 should be available at the work site and their functionality should be checked by the supervisor before use. First-aid box, Ambulance or departmental vehicle should be available near the work site to provide first aid or to carry any victim to the hospital in case met with the accident. 5. In compliance to Rule 6(3) b, it shall be ensured by the AE/JE/Supervisor that none of the toxic gases are present inside the sewer line for allowing the workers to go inside. The limit of gases is tabulated as under: - S. The work permit as enclosed at Annexure-3 shall be issued by the supervisor to the worker after checking all the gases and ensuring all the safety measures. 7. Minimum of two helpers at ground level near the work place shall be provided for each worker permitted to scale down the work place under the guidance of the supervisor. Before permitting any worker to go inside the manhole, the supervisor shall check about30 DELHI GAZETTE : EXTRAORDINARY PART IV] the fitness of the worker, use of all safety gadgets and presence of all the gases within permissible limit as per the Provisions of Rules framed under PEMS Act -2013. 8. No material shall be allowed to be stacked on the verge of the manhole which may fall inside the manhole and harm the worker. 9. The following Protective Gear and Safety Equipments shall be available at work site as mentioned in clause (d) of Sub-section(1) of Section (2) of PEMS Act-2013: - (i) Safety body clothing/safety body harness/Safety belt, (ii) Normal Face Mask, (iii) Safety Torch, (iv) Hand Gloves, (v) Safety Goggles, (vi) Safety Helmet, (vii) Emergency Medical Oxygen Resuscitator Kit, (viii) Gas Monitor, (ix) Head Lamp, (x) Reflecting Jacket, (xi) Guide Pipe Set, (xii) Safety Tripod Set, (xiii) Wadder Suit, (xiv) Chlorine Mask, (xv) Air Compressor and Blower, (xvi) Modular Airlines Supply Trolley System, (xvii) Full Face Mask, (xviii) Safety Gumboots, (xix) Raincoat. 10. As soon as, the worker is scaled down with the help of chain pulley or ladder, the supervisor shall observe the movement of the worker and if the worker is uncomfortable, he shall be taken out immediately. In case the worker is stepping down through foot-rests, it should be checked whether all the footrests are properly fixed and one standby ladder is lowered and fixed properly, besides chain pulley fixed on tripod over the manhole. 11. Sudden breeze may be considered as a warning of rise in water level and possible flooding. Thereafter, worker shall be immediately withdrawn from the work place.[PART IV DELHI GAZETTE : EXTRAORDINARY 31 12. The oxygen cylinder shall be checked to ensure the gas is available at the required pressure and the availability of all required medicines in the first-aid box ensuring the expiry date thereof respectively. 13. The worker shall not be allowed inside the manhole more than 15 minutes at one stretch. In case of high temperature, this type of work should be avoided. 14. It shall be ensured by the supervisor that the worker engaged for cleaning of septic tanks/ sewer has not consumed alcohol or is under influence of any other drug. 15. The two helpers standing at ground level near the manhole/work place shall be attentive, alert and shall continue talking with the worker(s) inside the manhole to ensure about their safety. 16. After completion of the work, the worker shall take bath with antiseptic soap and massage with mustard oil. 17. After completion of the work, all the manholes shall be covered properly and site shall be cleaned in all respect. 18. The worker deployed by the contractor for cleaning, removal of blockage of sewer, septic tank, drains etc. shall be insured by the contractor for minimum Rs.10 lacs towards the compensation to be paid in the eventuality of an accident during the process of cleaning, transportation and disposal of septage as per ‘PEMS ACT- 2013’ and APEX Courts order Dated 27.03.2013 in writ petition No583 of 2003. b. Working in Unsewered areas: Since the entire area within the jurisdiction of Govt. of NCT of Delhi has not been covered with sewerage system; therefore, in the remaining areas, the soil waste is being disposed off either through drains or septic tanks. Incidents of death have occurred during cleaning of the septic tanks within the premises of private and public entities. The Standard Operating Procedure for these areas as under: 1. The District Magistrate of the area will ensure that only license holders [vendor(s)] registered with Delhi Jal Board carry out the cleaning, transport and disposal of septage/sludge from the septic tanks, drains etc. in their respective area of jurisdiction. The enforcement of these Regulations will be controlled by the Committee headed by the area District Magistrate [Deputy Commissioner (Revenue)]; however, the District Magistrate may co-opt Committee Members from various Government/Municipalities/Public Undertakings. The member of Committee from Delhi Jal Board will act as Member Secretary of the above mentioned Committee. 2. The license vendor(s) will engage only trained workers having valid certificate of training from the recognized institution or the department. The vendor will also ensure that required Safety Gadgets as specified in PEMS Rules-2013 are available and used at work place. Further, Standard Operating Procedure as in Part – A above shall be applicable in case worker scales down for cleaning, removal of blockage etc. 3. It shall be mandatory for each owner/occupier of the building to engage the services of only those vendor(s) which possess valid license issued by the Delhi Jal Board.32 DELHI GAZETTE : EXTRAORDINARY PART IV] 4. The owner/occupier shall confirm that the license issued to the vendor(s) is valid on the date of execution of work. She/he shall also append her/his signature to the collection record and vendor(s) shall append his signature on transport record annexed as Annexure - 4. 5. The fee for collection and transportation of Septic Tank Waste (septage) upto notified locations at SPS/STP as well as locations for disposal of septage shall be notified by the Designated Officer of Delhi Jal Board from time to time. 6. The Licensee vendor(s), not having the safety gadgets as mentioned above or demanding fee for collection and transportation of septage in excess of the fee prescribed by the Designated Officer of Delhi Jal Board shall render the licensee liable for cancellation of license and imposition of penalty prescribed for violation of these Regulations. 7. The Septage shall be transported only in the vehicles approved for this purposes by the Designated Officer of Delhi Jal Board. 8. The licensee vendor(s) shall ensure that there is no leakage/spillage of the septage during transportation, from the collection point to the notified location for disposal. 9. The vehicle carrying septage shall be fitted with required equipments to take care of pollution due to any accident during the movement of the vehicle from Collection point to the notified disposal location. 10. The licensee vendor(s) shall be fully and completely liable for any damage to any person, vehicles, property and environment in case of any accident or disaster. 11. The licensee vendor(s) shall be responsible for taking all the safety measures including provision of hand held gas detectors, gas masks, protective gear, oxygen mask with oxygen cylinder and first aid box etc. and such other measures as prescribed by the Designated Officer of Delhi Jal Board for grant of licensee for the people deployed for cleaning, collection and transportation of septage. 12. The licensee vendor(s) shall dispose of septage only at the locations notified by the Designated Officer of Delhi Jal Board as per notified time. 13. It shall be ensured by the licensee vendor(s) that no industrial waste is disposed of at the notified locations. 14. Any licensee vendor(s) found dumping septage other than the notified locations shall be liable to pay the penalty of Rs. 50,000/- or as notified from time-to-time, per default. The license shall be cancelled for two defaults. 15. The licensee vendor(s) shall be responsible for periodical training of the staff deployed in collection, transportation and disposal of the septage, use of protective equipment for taking measures to minimize the damage to the environment. 16. The licensee vendor(s) shall be responsible for ensuring that every person deployed under goes health check- up at least twice every year and submit record of the same to the Designated Officer of Delhi Jal Board at the time of renewal of license. 17. The worker deployed by the licensee vendor(s) shall be insured for minimum Rs.10 lacs towards the compensation to be paid in the eventuality of an accident during the process of cleaning, transportation and[PART IV DELHI GAZETTE : EXTRAORDINARY 33 disposal of septage as per PEMS ACT 2013 and APEX Courts order Dated 27.03.2013 in writ petition No583 of 2003. 18. A copy of license shall be prominently displayed on the vehicle used for transportation of septage. The vehicle/ container/tanker shall be painted with Yellow color duly marked with (the precaution) in Red Color “SEPTIC TANK WASTE” (in English) and “ममममललललककककुंुंुंुंडडडड” (in Hindi).
