L.-33004/99 xxxGIDHxxx सी.जी.-डी.एल.-अ.-26122023-250908 xxxGIDExxx CG-DL-E-26122023-250908 असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 858] िई दिल्ली, मगं लिार, दिसम्ब र 26, 2023/पौष 5, 1945 No. 858] NEW DELHI, TUESDAY, DECEMBER 26, 2023/PAUSHA 5, 1945 केन्द्रीय जिद्यतु जिजियामक आयोग अजधसचू िा िई दिल्ली, 15 दिसम्बर, 2023 स.ं -एल-1/236/2018/सीईआरसी.—केन्द्रीय जिद्युत जिजियामक आयोग, जिद्युत अजधजियम, 2003 (2003 का 36) की धारा 61 के साथ पठित धारा 178 की उपधारा (2) के खंड (ध) के अधीि प्रित्त िजियों और इस जिजमत्त सभी अन्द्य सभी सामर्थययकारी िजियों का प्रयोग करत े हुए, और पूिय प्रकािि के बाि, केन्द्रीय जिद्युत जिजियामक आयोग (टैठरफ के जिबंधि और ित)ें जिजियम, 2019 (इसके बाि “मलू जिजियम” के रूप म ें संिर्भयत) को संिोजधत करिे के जलए जिम्नजलजखत जिजियम बिाता ह,ै अथायत:् - 1. सजं ित िाम तथा आरंभ: (1) इि जिजियमों का संजिप्त िाम केन्द्रीय जिद्युत जिजियामक आयोग (टैठरफ के जिबंधि और ितें) (ततृ ीय संिोधि) जिजियम, 2023 ह।ै (2) य ेजिजियम िासकीय रािपत्र में इिके प्रकािि की तारीख से प्रिृत्त होंगे। 2. मलू जिजियमों के पठरजिष्ट-II “दकसी मास के जलए पारेषण प्रणाली उपलब्धता कारक की सगं णिा करि े की प्रदिया” के अधीि खडं (4) का सिं ोधि: 2.1 मलू जिजियमों के पठरजिष्ट-II के अधीि खडं (4) के उप-खंड (ii) के बाि िया उप-खंड (iii) जिम्नािुसार िोडा िाएगा: “(iii) एिएचएआई, रेलिे, और सीमा सडक सगं िि की पठरयोििा (पठरयोििाओं) के कारण ऐसी पारेषण लाइि की जिफ्टंग या आिोधि या अन्द्यथा के कारण पारेषण लाइि का िट डाउि। सिस्ट्य सजचि, आरपीसी िाजमल कायय के जलए उिके द्वारा युजियिु समझे िािे िाली अिजध तक डीम्ड उपलब्धता अिजध को सीजमत कर सकते ह;ैं 7942 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंत ु यह दक ऐसी पारेषण लाइि के िटडाउि स ेडीआईसी प्रभाजित िहीं ह।ैं ” 3. मलू जिजियमों के पठरजिष्ट-II “दकसी मास के जलए पारेषण प्रणाली उपलब्धता कारक की सगं णिा करि े की प्रदिया” के अधीि खडं (5) का सिं ोधि: 3.1 मलू जिजियमों के पठरजिष्ट-II के अधीि खडं (5) के उप-खंड (ii) के परंतुक को हटाया िाएगा। 3.2 मलू जिजियमों के पठरजिष्ट-II के अधीि खडं (5) के उप-खंड (ii) के बाि िया उप-खंड (iii) जिम्नािुसार िोडा िाएगा: “(iii) आउटेि अिजध, जिसे इस खंड के उप-खंडों (i) और (ii) के उद्देश्य हते ु िाजमल िहीं दकया िाएगा, को जिम्नािुसार घोजषत दकया िाएगा: क) सिस्ट्य सजचि, आरपीसी द्वारा अजधकतम एक मास तक ख) एक मास के बाि से तीि मास तक आरपीसी में जिणयय के बाि ग) तीि मास के बाि आयोग द्वारा जिसके जलए पारेषण अिुज्ञजप्तधारी कारणों, आउटेि और पुिःस्ट्थापिा समय सीमा को कम करि ेके जलए उिाए गए किमों के साथ आयोग को संपकय करेगा। हरप्रीत फसंह प्रथु ी, सजचि [जिज्ञापि-III/4/असा./641/2023-24] िोट : (1) केन्द्रीय जिद्युत जिजियामक आयोग (टैठरफ के जिबंधि और ित)ें जिजियम, 2019 दििांक 3 मई, 2019 को भारत के रािपत्र (असाधारण) के भाग III-खंड 4, सं.144 में प्रकाजित हुए थे। (2) केन्द्रीय जिद्युत जिजियामक आयोग (टैठरफ के जिबंधि और ित)ें जिजियम, 2020 (प्रथम संिोधि) दििांक 3 फरिरी, 2021 को भारत के रािपत्र (असाधारण) के भाग III-खंड 4, सं.53 में प्रकाजित हुए थे। (3) केन्द्रीय जिद्युत जिजियामक आयोग (टैठरफ के जिबंधि और ित)ें (जद्वतीय संिोधि) जिजियम, 2021 दििांक 13 जसतम्बर, 2021 को भारत के रािपत्र (असाधारण) के भाग III-खंड 4, सं.394 में प्रकाजित हुए थे। CENTRAL ELECTRICITY REGULATORY COMMISSION NOTIFICATION New Delhi, the 15th December, 2023 No. L-1/236/2018/CERC.—In exercise of powers conferred under clause (s) of subsection (2) of section 178 of the Electricity Act, 2003 (36 of 2003) read with Section 61 thereof and all other powers enabling it in this behalf, and after previous publication, the Central Electricity Regulatory Commission hereby makes the following regulations, to amend the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2019 (hereinafter referred to as “the Principal Regulations”), namely:- 1. Short Title and Commencement: (1) These regulations may be called the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) (Third Amendment) Regulations, 2023. (2) These regulations shall come into force from the date of publication of these Regulations in the official Gazette. 2. Amendment to Clause (4) under Appendix-II “Procedure for Calculation of Transmission System Availability Factor for a Month” of the Principal Regulations: 2.1 New sub-clause (iii) shall be added after sub-clause (ii) of Clause (4) under Appendix-II of the Principal Regulations as under: “(iii) Shut down of a transmission line due to shifting or modification of such transmission line or otherwise because of the Project(s) of NHAI, Railways, and Border Road Organisation. Member Secretary, RPC may restrict the deemed availability period to that considered reasonable by him for the work involved; Provided that DICs are not affected by the shutdown of such a transmission Line;” 3. Amendment to Clause (5) under Appendix-II “Procedure for Calculation of Transmission System Availability Factor for a Month” of the Principal Regulations: 3.1 Provisos to sub-clause (ii) to Clause (5) under Appendix-II of the Principal Regulations shall be deleted.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 3.2 New sub-clause (iii) shall be added after sub-clause (ii) of Clause (5) under Appendix-II of the Principal Regulations as under: “(iii) The outage period which can be excluded for the purpose of sub-clauses (i) and (ii) of this clause shall be declared as under: a) Maximum up to one month by Member Secretary, RPC b) Beyond one month and up to three months after a decision at RPC c) Beyond three months by the Commission for which the transmission licensee shall approach the Commission along with reasons, steps taken to mitigate the outage and restoration timeline.” HARPREET SINGH PRUTHI, Secy.
