अंतगगत प्रदत्त िजक्तयों का प्रयोग करते हुए, आयोग एतदद्वारा जनम्नजलजखत जिजनयम बनाता है, अथागत;्
1. सजं िप्त नाम, जिस्ट्तार और प्रारंभ:
1. इन जिजनयमों को जम्मू और कश्मीर ि लद्दाख के जलए संयुक्त जिद्युत जनयामक आयोग (जम्मू और कश्मीर तथा
लद्दाख के केंद्र िाजसत प्रदिे ों के जलए सलाहकार सजमजत का गिन) जिजनयम, 2022 कहा जा सकता है।
2. ये जिजनयम केंद्र िाजसत प्रदिे जम्मू-कश्मीर और केंद्र िाजसत प्रदिे लद्दाख के जलए ह ैं और आयोग के अजधकार
िेत्र में आने िाले सभी मामलों के संबंध में लागू होंगे।
3. ये जिजनयम सरकारी राजपत्र में उनके प्रकािन की जतजथ से लागू होंगे।
2. पठरभाषाएं
1. इन जिजनयमों में जब तक कक संदभग के अनुसार अन्यथा अपेजित न हो;
क) "अजधजनयम" का अथग ह ैजिद्युत अजधजनयम, 2003 (2003 का 36);
ख) "आयोग" का अथग ह ै जिद्युत अजधजनयम, 2003 (2003 का 36) की धारा 83 के अंतगगत गठित जम्मू-
कश्मीर और लद्दाख के केंद्र िाजसत प्रदिे ों के जलए संयुक्त जिद्युत जनयामक आयोग;

ग) "सजमजत" का अथग ह ै अजधजनयम की धारा 87 के प्रािधानों के अनुसार गठित केंद्र िाजसत प्रदिे ों की
सलाहकार सजमजत।
घ) यहां प्रयुक्त िब्द और अजभव्यजक्तयााँ जजन्ह ेंयहााँ पठरभाजषत नहीं ककया गया है, उनका अथग िही होगा जो
अजधजनयम में पठरभाजषत ककया गया ह।ै
3. सजमजत का गिन
1. जम्मू-कश्मीर और लद्दाख के केंद्र िाजसत प्रदिे ों के जलए एक सलाहकार सजमजत होगी।
2. सलाहकार सजमजत में इक्कीस से अजधक सदस्ट्य नहीं होंगे जो िाजणज्य, उद्योग, पठरिहन, कृजष, श्रम,
उपभोक्ताओं, गैर-सरकारी संगिनों और जिद्युत िेत्र में िैिजणक और अनुसंधान जनकायों के जहतों का
प्रजतजनजधत्ि करेंगे।
3. सजमजत के सदस्ट्य दो िषग की अिजध के जलए मनोनीत होंगे और पुनर्ननयुजक्त के पात्र होंगे।
4. पदने सदस्ट्य के अलािा कोई अन्य सदस्ट्य, जो आयोग को पूिग सूचना के जबना और उसकी अनुपजस्ट्थजत के िैध
कारणों के जबना सजमजत की लगातार तीन बैिकों में भाग लेने में जिफल रहता है, िह सजमजत का सदस्ट्य नहीं
रहगे ा।
5. आयोग के अध्यि सजमजत के पदने अध्यि और आयोग के सदस्ट्य होंगे, और जम्मू-कश्मीर और लद्दाख सरकार के
सजचि, जो उपभोक्ता मामलों और सािगजजनक जितरण प्रणाली से संबजं धत जिभाग के प्रभारी हैं, सजमजत के पदने
सदस्ट्य होंगे।
4. सजमजत के काय ग
1. अजधजनयम की धारा 88 के अनुसार, सजमजत का कायग आयोग को जनम्नजलजखत पर सलाह दने ा होगा:
क) प्रमुख नीजतगत प्र्न;
ख) लाइसेंसधाठरयों द्वारा प्रदान की जाने िाली सेिा की गुणित्ता, जनरंतरता और सीमा से संबंजधत मामले;
ग) लाइसेंसधाठरयों द्वारा उनके लाइसेंस की ितों और आिश्यकताओं का अनुपालन;
घ) उपभोक्ताओं के जहतों की सुरिा; और
ड़) जबजली आपूर्नत और उपयोजगताओं द्वारा प्रदिगन के समग्र मानक।
2. इन जिजनयमों के खंड 3 के अंतगगत स्ट्थाजपत केंद्र िाजसत प्रदिे जम्मू और कश्मीर और केंद्र िाजसत प्रदेि लद्दाख
के जलए सजमजत केिल उन मामलों में आयोग को सलाह दने े के जलए सिम होगी जहां ऐसी सलाह जम्मू और
कश्मीर और लद्दाख के केंद्र िाजसत प्रदिे ों के अनन्य िेत्रीय अजधकार िेत्र के मामले से संबंजधत है।
5. सजमजत के सजचि
1. आयोग का सजचि सजमजत का पदने सजचि होगा। सजचि इस तरह के कतगव्य के कारण ककसी भी अजतठरक्त
पाठरश्रजमक का हकदार नहीं होगा।
2. सजचि का यह कतगव्य होगा कक िह अध्यि की अनुमजत से सजमजत की बैिकें बुलाएं और उसके सदस्ट्यों को
प्रस्ट्ताजित बैिक की जतजथ, समय और स्ट्थान की जलजखत सूचना कम से कम 14 कदन पहले दें, यकद अध्यि द्वारा
जििेष रूप से जनदिे न कदया जाए।
6. बैिक का एजेंडा
1. बैिक का एजेंडा उन जिषयों के अनुसार होगा जजन पर अजधजनयम के अंतगगत सजमजत से परामिग करना
आिश्यक है। बैिक के अध्यि की जिजिष्ट अनुमजत के जबना सजमजत की बैिक में एजेंडे में िाजमल ककसी अन्य
मामले पर जिचार या चचाग नहीं की जाएगी। कोई मामला सजमजत के कायगिेत्र और कायग से संबंजधत ह ैया नहीं,
इस संबंध में अध्यि का जनणगय अंजतम और सजमजत के जलए बाध्यकारी होगा।
2. यकद कोई सदस्ट्य सजमजत की बैिक में ककसी जिषय को चचाग के जलए लाना चाहता है, तो िह आगामी बैिक के
दस कदनों से पहले जलजखत रूप में सजचि को सूजचत करेगा।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3
7. सजमजत की कायिग ाही
1. सजमजत की बैिकों की कायगिाही को एक कायग-जििरण पुजस्ट्तका में दजग ककया जाएगा और बैिक के अध्यि द्वारा
अगली बैिक में या ऐसी सफल बैिक से पहले ककसी भी समय हस्ट्तािठरत ककया जाएगा। कायग जििरण की
प्रजतयां संघीय राज्य िेत्र सलाहकार सजमजत के सभी सदस्ट्यों को भेजी जाएंगी।
2. केंद्र िाजसत प्रदिे की सजमजत हर छह महीने में कम से कम एक बार बैिक करेगी।
3. सजमजत की बैिक के प्रारंभ के जलए कोरम सजमजत के कुल सदस्ट्यों का एक जतहाई होगा।
4. िैध कोरम के साथ प्रारम्भ करने के बाद बैिक जारी रखी जा सकती है, भले ही बैिक के दौरान भाग लेने िाले
सदस्ट्यों की संख्या कोरम से कम हो जाए।
5. यकद बैिक के प्रारंभ में कोरम पूरा नहीं है, तो कोई कायग नहीं ककया जाएगा और बैिक का अध्यि बैिक को
अध्यि द्वारा जनयत की जाने िाली ककसी अन्य जतजथ के जलए स्ट्थजगत कर सकता ह।ै स्ट्थजगत बैिक में कोरम की
आिश्यकता नहीं होगी।
6. स्ट्थजगत बैिक में जपछली बैिक के जलए प्रस्ट्ताजित कायगसूची पर पहले जिचार ककया जाएगा। ककसी अन्य मामल े
पर जिचार नहीं ककया जा सकता है, बिते कक अध्यि कोई नया मामला ला सकता ह ै या लाने का जनदिे दे
सकता है, जो उसकी राय में अत्यािश्यक है।
7. सजमजत की कोई भी कायगिाही केिल सजमजत में जिद्यमान ठरजक्त के कारण या सजमजत के ककसी सदस्ट्य द्वारा
नोठिस या कायगसूची के कागजात प्राप्त न होने के कारण या के संचालन में ककसी अजनयजमतता के कारण अमान्य
नहीं होगी। बैिक का व्यिसाय।
8. अध्यि, सजमजत के सदस्ट्यों के अलािा ककसी अन्य व्यजक्त या व्यजक्तयों को, जजन्ह ें जहत के मामले में जििेष या
उपयोगी जानकारी हो, आयोग के जिचार-जिमिग में सहायता के जलए आमंजत्रत कर सकता है।
9. आयोग के अध्यि को सजमजत की प्रत्येक बैिक की अध्यिता करनी होगी। उनकी अनुपजस्ट्थजत में आयोग के
सदस्ट्य बैिक की अध्यिता करेंगे।
10. सजमजत की सभी बैिकें सामान्य रूप से आयोग के कायागलय जम्मू/श्रीनगर में या आयोग द्वारा अजधसूजचत ककसी
अन्य स्ट्थान पर आयोजजत की जाएंगी।
8. केंद्र िाजसत प्रदिे सलाहकार सजमजत के सदस्ट्यों के जलए िल्ु क और भत्ते
1. पदने सदस्ट्य के अलािा सजमजत का कोई भी सदस्ट्य प्रत्येक बैिक के जलए 2000 रुपये (रुपये दो हजार मात्र)
के िुल्क का हकदार होगा।
2. सजमजत की बैिक में भाग लेने िाला सजमजत का कोई सदस्ट्य जनम्नानुसार बताए गए आधार पर यात्रा और
िहरने के जलए भत्ते का हकदार होगा:
क) सजमजत का कोई सदस्ट्य जो सरकारी कमगचारी ह ैया ककसी सािगजजनक िेत्र के उपक्रम का कमगचारी है,
अपने मूल संगिन से यात्रा और दजै नक भत्ता प्राप्त करेगा।
ख) सरकारी कमगचारी या सािगजजनक िेत्र के उपक्रम के कमगचारी के अलािा सजमजत का कोई सदस्ट्य,
भारत सरकार के ग्रेड ए अजधकारी के जलए लागू िेतनमान पर और जनयमों के अनुसार दये यात्रा भत्ता
और दजै नक भत्ता का हकदार होगा।
9. सदस्ट्य का त्यागपत्र
पदने सदस्ट्य के अलािा सजमजत का कोई सदस्ट्य आयोग के सजचि को जलजखत नोठिस द्वारा अपने पद से इस्ट्तीफा द े
सकता ह ैऔर यह उस कदन से प्रभािी होगा जजस कदन आयोग का अध्यि इसे स्ट्िीकार करता ह।ै
10. सदस्ट्य को पदमक्तु करना
1. आयोग पदने सदस्ट्य के अलािा सजमजत के ककसी भी सदस्ट्य को हिा सकता है, जो:
क) कदिाजलया घोजषत ककया गया है; या4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
ख) नैजतक अपराध के जलए दोषी िहराया गया है; या
ग) सदस्ट्य के रूप में कायग करने में िारीठरक या मानजसक रूप से अिम हो गया है; या
घ) स्ट्ियं को इस तरीके से व्यिहार ककया ह ैया अपने पद का इस प्रकार दरुु पयोग ककया ह ैकक एक सदस्ट्य
के रूप में उसके बने रहने से जनजहत या अजधजनयम के उद्देश्यों पर प्रजतकूल प्रभाि पड़ता है।
जजस सदस्ट्य को उपरोक्त उपखंड (1) के तहत हिाया जाना प्रस्ट्ताजित है, उसे आयोग के अध्यि के समि अपनी
जस्ट्थजत का प्रजतजनजधत्ि करने का अिसर कदया जाएगा।
11. जिजिध
1. अजधजनयम और इन जिजनयमों के प्रािधानों के अधीन, आयोग समय-समय पर इन जिजनयमों के कायागन्ियन
और जिजभन्न मामलों पर अपनाई जाने िाली प्रकक्रया के संबंध में आदिे और जनदिे जारी कर सकता है,
जजनके जलए या आकजस्ट्मक या प्रासंजगक मामलों के जलए आयोग को इन जिजनयमों द्वारा अजधकार कदया गया
ह।ै
2. आयोग ककसी भी समय इन जिजनयमों के ककसी भी प्रािधान में नया प्रािधान जोड़ सकता है, उसे बदल
सकता है, पठरिर्नतत कर सकता है या उसे संिोजधत कर सकता है।
3. यकद इन जिजनयमों के ककसी भी प्रािधान को प्रभािी करने में कोई कठिनाई उत्पन्न होती ह,ै तो आयोग,
सामान्य या जििेष आदिे द्वारा, सजमजत को ऐसे काम करने की अनुमजत द े सकता ह ै जो आयोग की राय म ें
आिश्यक ह ैया कठिनाइयों को दरू करने के जलए उपयुक्त ह।ै
4. इन जिजनयमों की व्याख्या और सजमजत की बैिकों में कायग संचालन के संबंध में आयोग के अध्यि के जनणगय
अंजतम होंगे।

No. JERC-JKL/REG/2022/02.—In exercise of powers conferred under Section 87 read with Section 181
of the Electricity Act, 2003 (36 of 2003), the Commission hereby makes the following Regulations, namely;
1. Short title, extent and commencement:
1. These Regulations may be called the Joint Electricity Regulatory Commission for Jammu &
Kashmir and Ladakh (Constitution of Advisory Committee for UT of J&K and UT of Ladakh)
Regulations, 2022.
2. These Regulations extend to the whole of the UT of J&K and UT of Ladakh and shall apply in
relation to all matters falling within the jurisdiction of the Commission.
3. These Regulations shall come into force from the date of their publication in the Government
Gazette.
2. Definitions
1. In these Regulations unless the context otherwise requires;
a) “Act” means The Electricity Act, 2003 (36 of 2003);[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5
b) “Commission” means the Joint Electricity Regulatory Commission for the UTs of J&K and
Ladakh constituted under Section 83 of the Electricity Act, 2003 (36 of 2003);
c) “Committee” means the UTs Advisory Committee constituted in accordance with the
provisions of Section 87 of the Act.
d) Words and expressions used and not defined herein but defined in the Act shall have the
meaning assigned to them in the Act.
3. Constitution of the Committee
1. There shall be a advisory Committee for the UTs of J&K and Ladakh.
2. The Advisory Committee shall consist of not more than twenty one members to represent the
interest of commerce, industries, transport, agriculture, labour, consumers, non-governmental
organizations and academic and research bodies in the electricity sector.
3. The Members of the Committee shall be nominated for a period of two years and shall be eligible
for re-appointment.
4. A member other than the ex-officio member, who fails to attend three consecutive meetings of the
committee without prior intimation to the Commission and without valid reasons for his absence,
shall cease to be a member of the Committee.
5. The Chairperson of the Commission shall be the ex-officio Chairperson of the Committee and
Member of the Commission, the Secretaries to J&K and Ladakh Governments in charge of the
Department dealing with consumer affairs and public distribution system shall be the ex-officio
members of the Committees.
4. Functions of the Committee
1. Pursuant to Section 88 of the Act, the functions of the Committee shall be to advise the Commission
on:
a. major questions of policy;
b. matters relating to quality, continuity and extent of service provided by the licensees;
c. compliance by licensees with the conditions and requirements of their license;
d. protection of consumer interest; and
e. electricity supply and overall standards of performance by utilities.
2. The Committee for UT of Jammu & Kashmir and UT of Ladakh established under clause 3 of these
regulations shall be competent to give advice to the Commission only in cases where such advice
relates to matter within the exclusive territorial jurisdiction of the Union territories of Jammu &
Kashmir and Ladakh.
5. Secretary of the Committee
1. The Secretary of the Commission shall be the ex-officio Secretary to the Committee. The Secretary
shall not be entitled to any extra remuneration on account of such duty.
2. It shall be the duty of the Secretary to convene the meetings of the Committee with the permission
of the Chairperson and to give to the members thereof, unless otherwise specifically directed by the
Chairperson not less than 14 days’ notice in writing of the date, time and place of the proposed
meeting. The agenda of the meeting shall accompany such notice.
6. The agenda of the meeting
1. The agenda for the meeting shall be in accordance with subjects on which the Committee is required
to be consulted under the Act. No matter other than that included in the agenda shall be considered
or discussed at the meeting of the Committee except with the specific permission of the Chairman of
the meeting. The ruling of the Chairman as regards whether a matter is related to the scope and
function of the Committee or otherwise, shall be final and binding on the Committee.
2. If a Member desires to bring a subject for discussion in the meeting of the Committee, he shall
notify the Secretary in writing accordingly before ten days of the ensuing meeting.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]
7. Proceedings of the Committee
1. The proceedings of the meetings of the Committee shall be recorded in a minute book to be kept for
the purpose and shall be signed by the Chairperson of the meeting at the next succeeding meeting or
at any time before such succeeding meeting. Copies of the minutes shall be sent to all the members
of the UT Advisory Committee.
2. The Committee of UT shall meet at least once in every six months.
3. The quorum for the commencement of a meeting of a Committee shall be one- third of the total
members of the Committee.
4. The meeting after such commencement with a valid quorum can be continued even if during the
meeting the number of participating members reduces below the quorum.
5. If there is no quorum in the commencement of the meeting, no business shall be transacted and the
Chairperson of the meeting may adjourn the meeting to another date to be fixed by the Chairperson.
No quorum shall be necessary at an adjourned meeting.
6. At the adjourned meeting the agenda proposed for the previous meeting shall be considered first. No
other matter may be considered provided that the Chairperson may bring or direct to be brought, any
new matter, which in his opinion is urgent.
7. No proceedings of the Committee shall be invalid by reason merely of a vacancy existing in the
Committee or by reason of non-receipt of the notice or the agenda papers by any member of the
Committee or by reason of any irregularity in the conduct of the business of the meeting.
8. The Chairperson may invite person or persons other than the members of the Committee, having
special or useful knowledge on a matter of interest to the Commission to assist in its deliberation.
9. The Chairperson of the Commission has to preside over every meeting of the Committee. In his
absence, Member of the Commission shall chair the meeting.
10. All meetings of the Committee shall be held at a place normally in the Office of the Commission at
Jammu/Srinagar or elsewhere as notified by the Commission.
8. Fees and allowances for members of the UT Advisory Committee
1. A member of the Committee other than an ex-officio member shall be entitled to a fee of Rs. 2000/-
(Rupees Two thousand only) for each sitting.
2. A member of the Committee attending the meeting of the Committee shall be entitled to allowances
for traveling and stay on the basis stated as follows:
a) A member of the Committee who is a Government Servant or an employee of any Public
Sector Undertaking shall draw traveling and daily allowances from his parent organization.
b) A member of the Committee other than a Government Servant or an employee of Public
Sector Undertaking shall be entitled to traveling allowance and daily allowance for attending
the meeting payable at the Scale and according to the rules applicable to Grade A officer of
the Government of India.
9. Resignation of Member
A member of the Committee other than an ex-officio member may, by a written notice to the Secretary
of the Commission resign from his office and it shall come into effect from the day the Chairperson of
the Commission accepts the same.
10. Removal of Member
1. The Commission may remove any member of the Committee other than an ex- officio member,
who:
a) has been adjudged as insolvent; or
b) has been convicted of an offence involving moral turpitude; or
c) has become physically or mentally incapable of acting as a member; or
d) has conducted himself in a manner or has so abused his position as to render his continuance
as a member prejudicial to public interest or to the objects and purpose of the Act.
The member who is proposed to be removed under sub-clause (1) above shall be given an opportunity to

11. Miscellaneous
1. Subject to the provisions of the Act and these Regulations, the Commission may, from time to time,
issue orders and directions in regard to the implementation of these Regulations and procedure to be
followed on various matters, which the Commission has been empowered by these Regulations to
direct and matters incidental or ancillary thereto.
2. The Commission may, at any time, add, vary, alter, modify or amend any of the provisions of these
Regulations.
3. If any difficulty arises in giving effect to any of the provisions of these Regulations, the
Commission may, by general or special order, do or undertake or permit the Committee to do or
undertake things which in the opinion of the Commission is necessary or expedient for removing the
difficulties.
4. The decisions of the Chairperson of the Commission in the matter of interpretation of these
Regulations and relating to conduct of business at the meetings of the Committee shall be final.
