L.-33004/99 सी.जी.-जे.के.-अ.-27042023-245456 xxxGIDHxxx CG-JK-E-27042023-245456 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 268] नइ कदल्ली, मगं लिार, ऄप्रलै 25, 2023/ििै ाख 5, 1945 No. 268] NEW DELHI, TUESDAY, APRIL 25, 2023/ VAISAKHA 5, 1945 सयं क्तु जिद्यतु जिजनयामक अयोग (जम्म-ू कश्मीर और लद्दाख के केंद्र िाजसत प्रदेि के जलए) ऄजधसचू ना जम्मू, 31 माच,च 2023 स.ं जइे अरसी-टेक/2023/08.—जिद्युत ऄजधजनयम, 2003 (2003 का 36) की धारा 15, 16, 18 और 52 के साथ पठठत धारा 181 के तहत जनजहत ऄजधकारों और आस सबं ंध म ें आसे सक्षम करने योग्य ऄन्य सभी ऄजधकारों का प्रयोग करते हुए, केंद्र िाजसत प्रदिे जम्मू और कश्मीर और केंद्र िाजसत प्रदेि लद्दाख के जलए संयक्तु जिद्युत जिजनयामक अयोग एतद्द्वारा व्यापाठरक लाआसेंस दने े के जलए पात्रता मानदंड, जबजली व्यापारी के कतचव्यों और ऄन्य संबंजधत मामलों को जनर्ददष्ट करते हुए जनम्नजलजखत जिजनयम बनाता ह:ै 1. संजक्षप्त िीर्चक, जिस्ट्तार और प्रारंभ क. आन जिजनयमों को संयुक्त जिद्युत जनयामक अयोग केंद्र िाजसत प्रदेि जम्म ू और कश्मीर और केंद्र िाजसत प्रदेि लद्दाख (जिद्युत व्यापार) जिजनयम, 2023 कहा जाएगा। ख. ये जिजनयम केंद्र िाजसत प्रदेि जम्मू और कश्मीर और केंद्र िाजसत प्रदेि लद्दाख के भीतर व्यापार के जलए लाग ू होंगे। ग. ये जिजनयम राजपत्र म ेंऄजधसूचना की तारीख स ेलागू होंगे। 2. पठरभार्ा और व्याख्या 2.1. आन जिजनयमों में, जब तक कक संदभच से ऄन्यथा ऄपेजक्षत न हो: क. "ऄजधजनयम" का ऄथ चह ैजिद्युत ऄजधजनयम, 2003 (2003 का 36); 2712 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ख. "अिेदक" का ऄथच ईस व्यजक्त स े ह ै जजसने जबजली के व्यापार के जलए लाआसेंस प्रदान करन े के जलए अयोग को अिेदन ककया ह;ै ग. "समझौता" का ऄथच जबजली व्यापारी द्वारा जबजली के जिक्रेता, जबजली के खरीदार, ऄन्य लाआसेंसधाठरयों और राज्य भार प्रेर्ण केंद्र के साथ ककया गया समझौता ह,ै जो व्यापार लने देन को सक्षम बनाता ह;ै घ. " लेखा परीक्षक" का ऄथ च ह ैरेडडग लाआसेंसधारी द्वारा जनयुक्त लखे ा परीक्षक; ङ. "अयोग" का ऄथच ह ै संयुक्त जिद्युत जिजनयामक अयोग; केंद्र िाजसत प्रदेि जम्मू-कश्मीर और केंद्र िाजसत प्रदेि लद्दाख के जलए ; च. "जबजली व्यापारी" का ऄथच ईस व्यजक्त से ह ै जजसे ऄजधजनयम की धारा 14 के तहत जबजली का व्यापार करने के जलए लाआसेंस प्रदान ककया गया ह;ै छ. "लाआसेंस" का ऄथच ऄजधजनयम की धारा 14 के तहत कदया गया लाआसेंस ह;ै ज. "लाआसेंसधारी" का ऄथच ईस व्यजक्त से ह ै जजसे ऄजधजनयम की धारा 14 के तहत एक जबजली व्यापारी के रूप म ें जबजली का व्यापार करने के जलए लाआसेंस प्रदान ककया गया ह।ै झ. "लाआसेंस प्राप्त व्यिसाय" का ऄथच ह ैलाआसेंस के तहत ऄजधकृत राज्य में जबजली के व्यापार का व्यिसाय; ञ. ककसी भी समय "नेट िथच" प्रदत्त पूंजी (िेयर प्रीजमयम सजहत) और संजचत घाटे को घटाकर मुक्त भंडार का कुल योग ह,ै लेककन आसम ें संपजत्त के पुनमूचल्यांकन स े बनाए गए भंडार, मूल्यह्रास प्रािधानों और समामेलन को िापस करना िाजमल नहीं होगा; ट. "ऄन्य व्यिसाय" का ऄथ चह ैव्यापार के लाआसेंस प्राप्त व्यिसाय के ऄलािा व्यापारी का कोइ भी व्यिसाय; ठ. "व्यजक्त" म ेंकोइ भी कंपनी या जनगजमत जनकाय या संघ या व्यजक्तयों का जनकाय, चाह े जनगजमत हो या नहीं, या कृजत्रम न्याजयक व्यजक्त िाजमल होंग;े ड. "जतमाही" का ऄथ च तीन महीन े की ऄिजध ह ै जो ऄप्रलै , जलु ाइ, ऄक्टूबर या जनिरी के पहल े कदन स े िरूु होती ह ै और जित्तीय िर्च के क्रमिः जून, जसतबं र, कदसंबर या माचच के ऄंजतम कदन समाप्त होती ह;ै ढ. "रेडडग" का ऄथ च ह ै ईसके पुनर्विक्रय के जलए जबजली की खरीद और ऄजभव्यजक्त "रेड" का ऄथ च तदनुसार लगाया जाएगा; ण. "िर्च" का ऄथच ह ै31 माचच को समाप्त होने िाला जित्तीय िर्च। 2.2.आन जिजनयमों में अने िाले और उपर पठरभाजर्त नहीं ककए गए िब्दों और ऄजभव्यजक्तयों का िही ऄथच होगा जो ऄजधजनयम में ह।ै 3. जिद्युत व्यापारी बनन े के जलए पात्रता की ित ें 3.1.पूंजी पयाचप्तता अिश्यकता और ऊण योग्यता: क. अिेदक को ककए जाने िाले प्रस्ट्ताजित व्यापार की मात्रा के अधार पर िगीकृत ककया जाएगा और तदनुसार अिेदक का जनिल मल्ू य यहां जनर्ददष्ट राजि से कम नहीं होगा: क्र.सं. रेडडग लाआसेंस की श्रणे ी प्रजत िर्च व्यापार करने के जलए प्रस्ट्ताजित जबजली की कुल संपजत्त (रुपय ेकरोड़ में) मात्रा (एमयू में) 1. क. 50 एमयू तक 1.0 2. ख. 51 एमयू से 100 एमय ू 2.0 3. ग. 101 एमयू से 200 एमय ू 4.0 4. घ. 201 एमयू से 500 एमय ू 8.0 5. ङ. 500 एमयू से उपर 10.0 ख. अिेदक, और यकद अिेदक एक कंपनी ह,ै तो कंपनी के प्रितकच , और यकद अिेदक एक साझेदारी फमच ह,ै तो फमच के भागीदारों को ककसी भी समय "भारतीय ठरजिच बैंक या ऄन्य संबंजधत प्राजधकरण द्वारा जिलफुल जडफॉल्टर" के रूप म ें िगीकृत नहीं ककया जाना चाजहए।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 ग. अिेदक अिेदन करत े समय अयोग की सतं ुजष्ट के जलए एक लखे ा परीक्षक द्वारा जिजधित प्रमाजणत ऄपन े जनिल मल्ू य का प्रदिचन करेगा। घ. अयोग ईसके द्वारा जनर्ददष्ट एक जतजथ स,े नए अिेदकों के जलए समय-समय पर जनिल मल्ू य की अिश्यकता को बदल सकता ह।ै 3.2. तकनीकी अिश्यकताए ं क. अिेदक जनम्नजलजखत जिर्यों म ें से प्रत्येक में न्यनू तम 5 िर्च के ऄनुभि िाल े कम से कम एक पूणचकाजलक पेिेिर को जनयुक्त करेगा, ऄथाचत्: - i. पािर जसस्ट्टम ऑपरेिंस और पािर रांसफर के िाजणजज्यक पहलू, और ii. जित्त, िाजणज्य और लेखा। ईपरोक्त (i) के जलए न्यूनतम योग्यता आलेजक्रकल आंजीजनयररग म ें स्नातक होगी और ईपरोक्त (ii) के जलए सीए / अइसीडब्ल्यूए होगी। ख. अिेदक अयोग को व्यापार करने स े पहल े पणू चकाजलक अधार पर ईसके द्वारा लगाए गए पिे ेिर और सहायक कमचचाठरयों का जििरण प्रस्ट्तुत करेगा। ग. ईपरोक्त जानकारी को सहायक दस्ट्तािेजों के साथ दायर ककया जाना चाजहए। i. अिेदक को अयोग की संतुजष्ट के जलए यह जसद्ध करना चाजहए कक अिेदक द्वारा प्रदर्वित तकनीकी क्षमता और संसाधन व्यापार की आजछछत मात्रा का प्रबंधन करने के जलए पयाचप्त ह।ैं ii. व्यापार हते ु लाआसेंस के जलए अिेदन करत े समय अिेदक को तकनीकी अिश्यकताओं का पालन करना होगा: बिते कक अयोग अिेदक को रेडडग लाआसेंस प्रदान कर सकता ह,ै बित े कक व्यापारी रेडडग करने स े पहले ईपरोक्त जिजनयम 3.2 के ऄनुसार जििरण प्रस्ट्तुत करे और तकनीकी अिश्यकताओं के ऄनपु ालन को प्रदर्वित करे। 4. रेडडग के जलए लाआसेंस प्रदान करने की प्रकक्रया क. व्यापार के जलए लाआसेंस प्रदान करन े के जलए अिेदन आन जिजनयमों के ऄनुबंध-1ए म ें जनजहत प्रपत्र म ें व्यापार जिजनयमों के संचालन म ें जनर्ददष्ट तरीके स े अयोग को प्रस्ट्ततु ककया जाएगा और साथ ही जम्म-ू कश्मीर केंद्र िाजसत प्रदेि और लद्दाख केंद्र िाजसत प्रदेि द्वारा जनधाचठरत िुल्क भी देना होगा। संयुक्त जिद्युत जिजनयामक अयोग, जम्म ू और कश्मीर और लद्दाख (व्यिसाय का संचालन) जिजनयम 2022 के प्रािधानों के ऄनुसार अयोग द्वारा अिेदन पर कायचिाही की जाएगी जजसम ें अिेदन की सूचना का प्रकािन, जहतधारकों स े अपजत्तयां अमजं त्रत करना और अिेदक स े प्रजतकक्रया मांगना िाजमल होगा और आस े 45 कदनों की ऄिजध के भीतर ऄंजतम रूप स ेपूरा ककया जाएगा। ख. अिेदन जनम्नजलजखत के साथ प्रदान ककया जाना चाजहए: i. लाआसेंस प्राप्त व्यिसाय चलान े म ें खचच की जान े िाली प्रस्ट्ताजित पूंजी का जििरण और ऐसे ऄन्य जििरण जजनकी अयोग को अिश्यकता हो सकती ह;ै ii. कंपनी के मेमोरेंडम एंड अर्टटकल्स ऑफ एसोजसएिन की एक प्रजत, जहां अिेदक एक जनगजमत जनकाय ह,ै और ऄन्य व्यािसाजयक संस्ट्थाओं के मामल े में जनगमन, पंजीकरण या समझौते के समान लाग ूदस्ट्तािेज; iii. ईपरोक्त खडं (ए) के ऄनुसार जनर्ददष्ट अिेदन िुल्क के भगु तान की रसीद; iv. अिेदक द्वारा अिेदन में प्रदान की गइ जानकारी की पुजष्ट करन े िाला एक हलफनामा; v. जहां अिेदक एक जनगजमत जनकाय ह,ै जबजली के ईत्पादन, जितरण, पारेर्ण या व्यापार के व्यिसाय में लगी ककसी भी समूह कंपनी ( यों ) का जििरण, चाह े िह केंद्र िाजसत प्रदेि जम्मू-कश्मीर और केंद्र िाजसत प्रदेि लद्दाख या ककसी ऄन्य राज्य म ेंहो; vi. जहां अिेदक एक जनगजमत जनकाय नहीं ह,ै जबजली के ईत्पादन, जितरण, पारेर्ण या व्यापार के ककसी भी व्यिसाय का जििरण, चाह े िह केंद्र िाजसत प्रदिे जम्मू-कश्मीर और केंद्रिाजसत प्रदेि लद्दाख के भीतर हो या ककसी ऄन्य राज्य में, जजसमें अिेदक प्रत्यक्ष या ऄप्रत्यक्ष रूप से रुजच रखता हो ; vii. जिद्युत क्षत्रे म ेंअिेदक की ककसी जित्तीय धाठरता का जििरण viii. अिेदक के कॉरपोरेट जनकाय होने की जस्ट्थजत में प्रितचकों का संजक्षप्त आजतहास;4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ix. ऐसे ऄन्य दस्ट्तािेज या जानकारी जो अयोग मांग सकता ह।ै ग. अिेदक द्वारा अिेदन की सूचना प्रकाजित करन े के बाद और प्राप्त अपजत्तयों, यकद कोइ हो, पर जिचार करन े के बाद, अयोग ऄनंजतम रूप से लाआसेंस देने या ऄस्ट्िीकार करने का जनणचय ले सकता ह ै और यकद यह लाआसेंस प्रदान करने का जनणचय लेता ह,ै तो यह ऐसे अयोग द्वारा तय ककए गए जिजिष्ट जनयमों और ितों पर और सामान्य ितों म ें ऐस े संिोधनों के साथ कर सकता ह।ै घ. जब अयोग लाआसेंस प्रदान करने का जनणचय लेता ह,ै तो अयोग जजसे िह लाआसेंस प्रदान करना चाहता ह ै ईस व्यजक्त का नाम और पता सूजचत करते हुए नोठटस और ऄन्य जििरण प्रकाजित करेगा जो अिश्यक हो और जनता स े सुझाि/अपजत्तयां मांगेगा और व्यजक्तगत रूप स े सुनिाइ की आछछा रखन े िालों की सुनिाइ के जलए एक तारीख भी सूचत करेगा। ङ. सभी सुझािों/अपजत्तयों पर जिचार करने के बाद और व्यजक्तगत रूप से सुनिाइ के आछछुक लोगों को सुनने के बाद, अयोग ऄंततः लाआसेंस देन े या ऄस्ट्िीकार करन े का जनणचय ले सकता ह।ै च. यकद अयोग लाआसेंस प्रदान करता ह,ै तो अयोग का सजचि लाआसेंस जारी करन े के तरु ंत बाद लाआसेंस की एक प्रजत राज्य सरकार, केंद्रीय जिद्युत प्राजधकरण, केंद्रीय जिद्युत जिजनयामक अयोग और ऐसे ऄन्य व्यजक्तयों को भेजगे ा जजन्ह ें अयोग अिश्यक समझता ह।ै छ. लाआसेंसधारी व्यापार लाआसेंस प्रदान करन े के जलए िुल्क, जुमाचना और िल्ु क जिजनयमों के ऄनुसार अयोग को लाआसेंस िुल्क का भुगतान करेगा। िर्च के जलए पणू च लाआसेंस िुल्क देय होगा चाह े लाआसेंस परू े िर्च के जलए या अंजिक रूप से संचाजलत हो। िुल्क, जमु ाचना और िुल्क जिजनयमों म ें ईजल्लजखत रूप और तरीके स े िुल्क का भगु तान ककया जाएगा। लाआसेंस िल्ु क का भगु तान प्रत्येक िर् च के ऄप्रैल के प्रथम सप्ताह तक ककया जाएगा। बिते कक संचालन के पहले िर् च के जलए लाआसेंस िुल्क का भगु तान अयोग द्वारा अिेदक को लाआसेंस जारी करने के सैद्धांजतक ऄनुमोदन की सूचना देने के एक सप्ताह के भीतर ककया जाएगा। 5. रेडडग मार्वजन की प्रयोज्यता व्यापार लाआसेंसधारी द्वारा ककए गए जनम्नजलजखत लेनदने पर रेडडग मार्वजन लागू होगा: क) ऄल्पकाजलक ऄनुबंधों के तहत लेनदने (जहां जिक्रेता और खरीदार दोनों के साथ व्यापार लाआसेंसधारी के ऄनुबंध की ऄिजध, पािर एक्सचेंजों के माध्यम से ककए गए लेनदने सजहत, एक िर्च तक ह)ै ; ख) लंबी ऄिजध के ऄनुबंधों के तहत लेनदने (जहा ं जिक्रेता या खरीदार या दोनों के साथ व्यापार लाआसेंसधारी के ऄनुबंध की ऄिजध एक िर् च से ऄजधक ह)ै ; ग) जबजली की बैंककग, चाह ेऄनुबंध की ऄिजध कुछ भी हो; घ) बैक टू बैक संजिदाओं के ऄंतगचत लेनदने , चाह ेऄनुबंध की ऄिजध कुछ भी हो; 5.1 रेडडग मार्वजन 1. व्यापार लाआसेंसधारी नीचे कदए गए ऄनुसार रेडडग मार्वजन का ऄनुपालन करेगा: क. रेडडग मार्वजन जबजली की जनधाचठरत मात्रा पर लगाया जाएगा ख. रेडडग मार्वजन में ऄनुसूजचत उजाच, ओपन एक्सेस और रांसजमिन हाजनयों के िुल्कों को छोड़कर सभी िुल्क िाजमल होंगे: बिते कक ओपन एक्सेस के िल्ु क म ें रांसजमिन िल्ु क, पठरचालन िुल्क और अिेदन िल्ु क िाजमल ह।ैं ग. ऄल्पकाजलक और दीघचकाजलक ऄनुबंधों और एक िर्च तक पािर एक्सचेंजों के माध्यम स े ऄनुबंध के तहत लेनदने के जलए, व्यापार लाआसेंसधारी िन्ू य (0.0) पैसा/ककलोिाट घंटा स े कम और चार (4.0) पैसा/ककलोिाट घंटा स े ऄजधक का रेडडग मार्वजन प्रभाठरत नहीं करेगा: बिते कक ऄनुबंधों म ें जहा ं एस्ट्क्रो व्यिस्ट्था लाग ू हो या एक िर्च की िैधता के साथ दीघचकाजलक ऄनुबंध के मामले म ें और जिक्रेता के पक्ष म ें ऄपठरितचनीय, जबना ितच के रेडडग लाआसेंसधारी द्वारा औसत माजसक जबल राजि के एक दिमलि एक (1.1) गुना के बराबर (तीन महीनों के जलए माजसक जबडलग राजियों या जपछले तीन महीनों के जलए िास्ट्तजिक माजसक जबडलग राजि का ऄनुमाजनत औसत, जैसा भी मामला हो) क्रेजडट का पत्र प्रदान नहीं ककया जाता ह,ै तो व्यापार लाआसेंसधारी 2 (2.0) पैसा/ककलोिाट घंटा स ेऄजधक का रेडडग मार्वजन प्रभाठरत नहीं करेगा।[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5 ऄल्पािजध ऄनुबंध के मामल े में, जिक्रेता के पक्ष म ें व्यापार लाआसेंसधारी द्वारा ऄल्पािजध ऄनुबधं के जलए ऄनबु धं मल्ू य के एक दिमलि िून्य पांच (1.05) गनु ा के बराबर क्रेजडट का पत्र प्रदान नहीं ककया जाता ह,ै तो व्यापार लाआसेंसधारी 2 पैसा/ककलोिाट घंटा स ेऄजधक का रेडडग मार्वजन प्रभाठरत नहीं करेगा। 2. आन जनयमों के तहत जनर्ददष्ट रेडडग मार्वजन ईत्पन्नकता च और ऄंजतम खरीदार के बीच लेन-दने की श्रृंखला म ें िाजमल सभी व्यापाठरयों द्वारा लगाए गए रेडडग मार्वजन का संचयी मूल्य होना चाजहए, कहन े का मतलब यह ह ै कक कइ रेडर-टू- रेडर लेनदेन के मामले म ें रेडडग मार्वजन और आन जिजनयमों के तहत जनर्ददष्ट रेडडग मार्वजन की सीमा स े ऄजधक नहीं होगा। 6. लाआसेंस में संिोधन क. ऄजधजनयम की धारा 18 के तहत मौजूदा लाआसेंस की ितों में संिोधन/ितों की मांग करन े िाला अिेदन आन जिजनयमों के ऄनुबंध-1बी म ें जनजहत प्रपत्र म ें प्रस्ट्तुत ककया जाएगा और ऄजधकृत व्यजक्त के एक हलफनाम े द्वारा समर्वथत होगा जसै ा कक व्यिसाय जिजनयमों के संचालन के फॉम च-2 म ें प्रदान ककया गया ह।ै ख. ऐसे अिेदन:- i. मौजूदा ितों, लाआसेंस की ितों में प्रस्ट्ताजित संिोधनों और ईनके कारणों को बताए;ं ii. लाआसेंस की ितों में पठरितचन को ईजचत ठहरान े के जलए अिश्यक दस्ट्तािेजों के साथ होना चाजहए; और iii. िुल्क, जुमाचना और िल्ु क जिजनयमों म ें जनर्ददष्ट राजि के िल्ु क के साथ और ईसके रूप म ें ईजल्लजखत रूप और तरीके स े होना चाजहए। ग. लाआसेंसधारी, आस तरह के अिेदन के प्रिेि की तारीख स े 7 कदनों के भीतर, केंद्र िाजसत प्रदेि जम्मू-कश्मीर और केंद्रिाजसत प्रदेि लद्दाख म ें व्यापक प्रसार िाले ऄंग्रेजी, ईद चू और डहदी भार्ाओं के दैजनक समाचार पत्रों के एक-एक ऄंक म ेंआन जिजनयमों के ऄनुबंध-2 म ेंजनर्ददष्ट प्रपत्र म ेंएक नोठटस प्रकाजित करेगा। घ. मौजूदा लाआसेंस म ें संिोधन की मांग करने िाले लाआसेंसधारी के अिेदन पर व्यापार जिजनयमों और आन जिजनयमों के अचरण के प्रािधानों के ऄनुसार जिचार ककया जाएगा और ऄंजतम रूप स े 45 कदनों की ऄिजध के भीतर जनपटाया जाएगा। 7. लाआसेंसधारी के कतचव्य और दाजयत्ि लाआसेंसधारी के जनम्नजलजखत कतचव्य एिं दाजयत्ि होंग:े - क. लाआसेंसधारी व्यापार जिजनयमों के संचालन के प्रािधानों का पालन करेगा और व्यापार जिजनयमों के संचालन म ें जनर्ददष्ट व्यापार लाआसेंस की सामान्य ितों के साथ-साथ ईसे जारी ककए गए लाआसेंस की जििेर् ितों का भी पालन करेगा; ख. लाआसेंसधारी एक महीने की ऄिजध के भीतर ऄपने जनिल मल्ू य म ें िृजद्ध करेगा यकद खंड 3.1 म ें जनर्ददष्ट व्यापार की मात्रा एक िर्च म ें ककसी भी स्ट्तर पर जनम्न श्रेणी स े ईच्च श्रेणी म ें ईन्नत हो जाती ह ैऔर लाआसेंसधारी आस तरह के ककसी भी ईन्नयन और जनिल मूल्य में बाद के बदलाि के बारे म ेंअयोग को सूजचत करेगा; ग. यकद ककसी लाआसेंसधारी के पास कइ लाआसेंस ह ैं और एक िर्च म ें ककसी भी स्ट्तर पर ईसके व्यापार की संयुक्त मात्रा ऐसे लाआसेंसों के जलए अिश्यक संयुक्त नेट िथच स े ऄजधक ह,ै तो िह एक महीने की ऄिजध के भीतर ऄपने नेट िथ च म ें िृजद्ध करेगा और अयोग को ईसका प्रमाण प्रदान करेगा; घ. लाआसेंसधारी व्यापार का कारोबार िरूु करन े स े पहल े एसएलडीसी की अिश्यकता के ऄनुसार पयाचप्त संचार सुजिधाएं स्ट्थाजपत करेगा; ङ. आन जिजनयमों के ऄनुबंध 3 और 4 म ें जनधाचठरत प्रारूप म ें जानकारी और व्यापार के संबंध म ें ऄन्य अिश्यक जानकारी पोस्ट्ट करने के जलए लाआसेंसधारी की ऄपनी एक िेबसाआट होनी चाजहए। िह यह सुजनजित करेगा कक लाआसेंस की िैधता के दौरान िेबसाआट हर समय चालू रह;े च. लाआसेंसधारी, व्यापार संचालन के प्रत्येक िर् च की िुरुअत के एक महीन े के भीतर, ऄपन े जनिल मूल्य के संबंध म ें ऄपन े लेखा परीक्षक की ठरपोट चप्रस्ट्ततु करेगा; छ. लाआसेंसधारी व्यापार के जलए रेडडग मार्वजन के ऄधीन होगा जैसा कक अयोग द्वारा समय-समय पर ऄजधसूजचत ककया जाता ह;ै6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ज. लाआसेंसधारी ऄपन ेद्वारा ककए गए सभी व्यापाठरक लेनदने का एक ऄद्यतन ठरकॉडच बनाए रखगे ा। िह लाआसेंसधारी के ठरकॉडच का जनरीक्षण करन े के जलए अयोग द्वारा ऄजधकृत ककसी भी व्यजक्त को अिश्यक सहायता भी प्रदान करेगा; झ. लाआसेंसधारी यह सुजनजित करेगा कक सभी व्यापार जबजली के जिक्रेता या जबजली के खरीदार के साथ जैसा भी मामला हो, ईजचत समझौते करने के बाद ककया जाता ह।ै व्यापार के माध्यम से जबजली की अपूर्वत और कारोबार की गइ जबजली के भुगतान के संबंध में अिश्यक सरु क्षा ईपायों को पार्टटयों के बीच समझौतों में िाजमल ककया जाएगा। सभी जित्तीय लेन-देन ऄनुसूजचत बैंकों के साख पत्रों के माध्यम से होंग;े ञ. व्यापारी अयोग को िुल्क, जुमाचना और िल्ु क जिजनयमों म ें ईजल्लजखत ऄप्रजतदेय िार्वर्क लाआसेंस िुल्क का भुगतान करेगा। ट. लाआसेंसधारी यह सुजनजित करेगा कक उजाच लेखांकन के ईद्देश्य से स्ट्थाजपत मीटर जग्रड कोड, केंद्रीय जिद्युत प्राजधकरण (मीटरों की स्ट्थापना और संचालन) जिजनयम, 2006 के जिजनदेिों का ऄनुपालन करते ह।ैं ठ. लाआसेंसधारी के पास पारेर्ण लाआसेंसधारी (ओं) और जितरण लाआसेंसधारी (ओं) के साथ जबजली के पारेर्ण और/या व्हीडलग के जलए अिश्यक समझौते होंगे, जैसा भी मामला हो; ड. लाआसेंसधारी व्यापार संचालन के प्रत्येक िर्च की िुरुअत के एक महीने के भीतर अयोग, राज्य पारेर्ण ईपयोजगता और एसएलडीसी को ऄपनी िार्वर्क व्यापार योजना प्रदान करेगा; ढ. व्यापारी ऄपन े व्यापाठरक व्यिसाय के जलए ऄलग खाते बनाए रखगे ा, समय-समय पर संिोजधत कंपनी ऄजधजनयम, 1956/2013 के प्रािधानों के ऄनुसार आस े तैयार और बनाए रखगे ा और आस तरह के ऄन्य जििरण जजस तरह स े अयोग समय-समय पर जनदेजित कर सकता ह ैतैयार और बनाए रखगे ा। ण. व्यापारी अयोग को लेखांकन जििरण और ईस पर लेखापरीक्षक की ठरपोटच की प्रजतयां ईस जित्तीय िर्च की समाजप्त के बाद छह महीन े के भीतर प्रस्ट्ततु करेगा जजससे ि े संबंजधत ह।ैं अयोग द्वारा ऄजधकृत कोइ भी व्यजक्त व्यापारी के खातों का जनरीक्षण और सत्यापन करने का हकदार होगा और व्यापारी ऐसे व्यजक्त को सभी अिश्यक सहायता प्रदान करेगा। त. लाआसेंसधारी राज्य लोड जडस्ट्पचै सेंटर, (एसएलडीसी), स्ट्टेट रांसजमिन यूठटजलटी और सेंरल आलेजक्रजसटी ऄथॉठरटी द्वारा ऄजधजनयम के तहत ऄपन ेकायों के जनिचहन में जारी ककए गए अदेिों और जनदिे ों का जिजधित पालन करेगा; थ. लाआसेंसधारी ऄजधजनयम की धारा 66 के तहत समय-समय पर अयोग द्वारा जनर्ददष्ट अिश्यकताओं का ऄनुपालन करेगा। द. व्यापारी जिद्युत पारेर्ण के व्यिसाय में संलग्न नहीं होगा। ध. व्यापारी, अयोग की पूि च स्ट्िीकृजत के जबना ककसी भी व्यजक्त को जबक्री, पट्टे, जिजनमय या ऄन्यथा ऄपना लाआसेंस सौंप या स्ट्थानांतठरत नहीं करेगा। जहां भी अयोग के पूिच ऄनुमोदन की अिश्यकता होती ह,ै व्यापारी व्यिसाय जिजनयमों के संचालन के ऄनुसार अयोग के समक्ष एक ईपयक्तु याजचका दायर करेगा। 8. अयोग और ऄन्य को सूचना की अपूर्वत क. लाआसेंसधारी अयोग द्वारा समय-समय पर जनधाचठरत की गइ सूचना की अपूर्वत करेगा। ख. लाआसेंसधारी राज्य लोड जडस्ट्पैच सेंटर (एसएलडीसी) या अयोग द्वारा जिजनर्ददष्ट ककसी ऄन्य यूठटजलटी को आन जिजनयमों के ऄनुबंध-3 म ें जनधाचठरत प्रारूप म ें सूचना की अपूर्वत करेगा और आसकी एक प्रजत अयोग को जतमाही अधार पर दगे ा और िेबसाआट पर भी पोस्ट्ट करेगा। एसएलडीसी, व्यापार की गइ उजाच की मात्रा की सत्यता को सत्याजपत करेगा, जैसा कक ईक्त जतमाही सूचना म ें दिाचया गया ह ैऔर अयोग को ठरपोट च करेगा। 9. जनष्पादन के मानक क. अयोग, लाआसेंसधारी से परामिच के बाद, लाआसेंसधारी के जनष्पादन के मानकों को जनर्ददष्ट कर सकता ह।ै ख. आन जिजनयमों के ऄनुबंध-4 में जनधाचठरत प्रारूप में जतमाही अधार पर अयोग को जनष्पादन जििरण प्रस्ट्तुत करेगा। 10. लाआसेंस के जनयमों और ितों का ईल्लंघन यकद लाआसेंसधारी द्वारा लाआससें के जनयमों और ितों का ईल्लघं न या ईल्लंघन की संभािना ह,ै तो अयोग ऄजधजनयम के प्रािधानों के ऄनुसार आस तरह के अदेि पाठरत कर सकता ह।ै[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 7 11. लाआसेंस से आनकार यकद अयोग लाआसेंस देन े के जलए आछछुक नहीं ह,ै तो अयोग अिेदन को ऄस्ट्िीकार करन े से पहले अिेदक को व्यजक्तगत रूप से सुनिाइ का ऄिसर देगा। 12. एक लाआसेंस का जनरसन क. ऄजधजनयम की धारा 19 के तहत लाआसेंस रद्द करन ेऔर/या कोइ ऄन्य अदेि जारी करने की कायचिाही अयोग द्वारा एक अदेि के माध्यम स ेिुरू की जाएगी। अयोग स्ट्िप्ररे णा स ेया लाआसेंसधारी के अिेदन पर या ककसी व्यजक्त स े कोइ जिकायत या सूचना प्राप्त होने पर ऐसी कायचिाही िुरू कर सकता ह।ै ख. अयोग लाआसेंस के जनरसन की कायचिाही की सूचना लाआसेंसधारी और ऐसे ऄन्य व्यजक्त, प्राजधकरण या जनकाय को देगा जजसे अयोग ईजचत समझे। ग. ऄजधजनयम के प्रािधानों और ईसमें जनधाचठरत प्रकक्रया के ऄधीन रहत े हुए, लाआसेंस के जनरसन के जलए अयोग द्वारा जांच, जहां तक यह लाग ू ह,ै ईसी तरीके स े होगी जैसा कक अयोग के संचालन जिजनयमों म ेंलाग ू होता ह।ै घ. यकद अयोग लाआसेंस रद्द करन ेका जनणचय लेता ह,ै अयोग िह जतजथ बतात े हुए लाआसेंसधारी को जनरस्ट्तीकरण के अदेि की सूचना दगे ा जबसे ऐसा जनरस्ट्तीकरण प्रभािी होगा। ङ. अयोग लाआसेंस को रद्द करन े के बजाय ऐसे जनयमों या ितों को लागू करने के जलए कोइ ऄन्य अदेि पाठरत कर सकता ह ैजजसके ऄधीन लाआसेंसधारी को ईसके बाद काम करने की ऄनुमजत होगी। 13. अदेि और ऄभ्यास जनदिे जारी करना ऄजधजनयम, और आन जिजनयमों के प्रािधानों के ऄधीन, अयोग समय-समय पर, आन जिजनयमों के कायाचन्ियन, पालन की जाने िाली प्रकक्रया अकद, और ऄन्य मामलों के संबंध म ेंअदेि और ऄभ्यास जनदेि जारी कर सकता ह,ै जजन्ह ें अयोग जनर्ददष्ट या प्रत्यक्ष करन ेके जलए आन जिजनयमों द्वारा सिक्त ककया गया ह।ै 14. कठठनाआयों को दरू करन े की िजक्त यकद आन जिजनयमों के ककसी भी प्रािधान को प्रभािी करने म ेंकोइ कठठनाइ ईत्पन्न होती ह,ै अयोग, सामान्य या जििेर् अदिे द्वारा, कुछ भी कर सकता ह,ै जो ऄजधजनयम या ईसके तहत बनाए गए जनयमों के प्रािधानों स े ऄसगं त न हो, जो ऐसी कठठनाइ को दरू करन े के ईद्देश्य स ेअिश्यक या समीचीन प्रतीत हो। 15. संिोधन करने की िजक्त अयोग अिश्यक प्रकक्रयाओं का पालन करन े के बाद समय-समय पर आन जिजनयमों के ककसी भी प्रािधान को जोड़, बदल या संिोजधत कर सकता ह।ै अयोग के अदेि द्वारा, िी. के. धर, सजचि [जिज्ञापन-III/4/ऄसा./48/2023-24] ऄनबु धं -1ए (जिजनयम-4 देख ें) सयं क्तु जिद्यतु जिजनयामक अयोग लद्दाख म ेंरेडडग लाआससें प्रदान करन ेके जलए अिदे न पत्र अिेदक को छह (6) प्रजतयों म ें भरे हुए अिेदन को सजचि, जम्म-ू कश्मीर के जलए केंद्र िाजसत प्रदेि के संयुक्त जिद्युत जिजनयामक अयोग और लद्दाख के केंद्र िाजसत प्रदेि, ऄंबेडकर चौक (पनामा चौक), रेलिे लाआन, जम्मू के साथ ______ रुपय े (रुपय े ______ मात्र) के अिेदन िल्ु क के साथ जमा करना होगा, जैसा कक जम्म-ू कश्मीर केंद्र िाजसत प्रदिे और लद्दाख केंद्र िाजसत प्रदेि के जलए संयक्तु जिद्युत जिजनयामक अयोग के पक्ष म ें अहठरत डीडी/प े ऑडचर के रूप म ें ईपयुक्त सरकार द्वारा जनधाचठरत और जम्म ू में दये ह।ै भाग-ए: अिेदक पर सामान्य जानकारी 1. अिेदक का जििरण8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ख) अिेदक का परू ा नाम: ग) अिेदक का परू ा पता: घ) संपकच व्यजक्त का नाम, पदनाम और पता : ङ) संपकच टेलीफोन नंबर: फैक्स नंबर: इमेल अइडी: 2. स्ट्िाजमत्ि का जििरण क) कंपनी/फमच/सहकाठरता सोसायटी/व्यजक्त/ऄन्य (जनर्ददष्ट करें): ख) जनगमन/पंजीकरण का जििरण जनगमन/पंजीकरण का स्ट्थान: जनगमन/पंजीकरण का िर्च: पंजीकरण संख्या: ग) जनदेिकों का नाम और पता: 3. प्रधान िेयरधारक / भागीदार / सदस्ट्य: 4. Short Title, Extent and Commencement a. These Regulations shall be called the Joint Electricity Regulatory Commission for the UT of Jammu & Kashmir and the UT of Ladakh (Electricity Trading) Regulations, 2023. b. These Regulations shall be applicable to Trading within Union Territory of Jammu and Kashmir & Union Territory of Ladakh. c. These Regulations shall come into force from the date of notification in the Official Gazette. 2. Definitions and Interpretation 2.1. In these Regulations, unless the context otherwise requires: a. “Act” means the Electricity Act, 2003 (36 of 2003);14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] b. “Applicant” means a person who has made an application to the Commission for grant of Licence for Trading in electricity; c. “Agreement” means agreement(s) entered into by the electricity trader with the seller of electricity, buyer of electricity, other licensees and State Load Despatch Centre, that enables the trading transactions; d. “Auditors” means the auditors appointed by the Trading Licensee; e. “Commission” means the Joint Electricity Regulatory Commission; for UT of J&K and UT of Ladakh; f. “Electricity Trader” means a person who has been granted a licence to undertake trading in electricity under Section 14 of the Act; g. “Licence” means a licence granted under Section 14 of the Act; h. “Licensee” means a person who has been granted a Licence under Section 14 of the Act to undertake trading in electricity as an Electricity Trader. i. “Licensed Business” means the business of trading in electricity in the State as authorized under the licence; j. “Net worth” at any point of time is the sum total of paid up capital (including Share Premium) and free reserves minus accumulated losses, but shall not include reserves created out of revaluation of assets, write back of depreciation provisions and amalgamations; k. “Other Business” means any business of the trader other than the licenced business of trading; l. “Person” shall include any company or body corporate or association or body of individuals, whether incorporated or not, or artificial juridical person; m. “Quarter” means a three-month period starting from 1st day of April, July, October or January and ending respectively on the last day of June, September, December or March of a financial year; n. “Trading” means purchase of electricity for resale thereof and the expression “trade” shall be construed accordingly; o. “Year” means a financial year ending on 31st March. 2.2. Words and expressions occurring in these Regulations and not defined above shall have the same meaning as in the Act. 3. Eligibility Conditions for being an Electricity Trader 3.1. Capital Adequacy Requirement and Credit Worthiness: a. The applicant shall be categorized depending upon the volume of trading proposed to be undertaken and accordingly the net worth of the Applicant shall not be less than the amounts specified hereunder: S. Category of the Volume of Electricity proposed to be Net worth (Rs. No. Trading Licence traded per year (in MU) in crores) 1. A Up to 50 MU 1.0 2. B 51 MU to 100 MU 2.0 3. C 101 MU to 200 MU 4.0 4. D 201 MU to 500 MU 8.0 5. E Above 500 MU 10.0 b. The Applicant, and if the Applicant is a company, the promoters of the company, and if the Applicant is a partnership firm, the partners of the firm, shall at no point of time have been classified as ―wilful defaulter by the Reserve Bank of India or other relevant authority. c. The Applicant will demonstrate his net worth duly certified by an auditor to the satisfaction of the Commission at the time of making the application. d. The Commission may from a date as may be specified by it, vary requirement of the net worth from time to time for new applicants. 3.2. Technical Requirements[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 15 a. The applicant will engage at least one full-time professional having minimum 5 years’ experience in each of the following disciplines, namely: - i. Power System Operations and commercial aspects of power transfer, and ii. Finance, commerce and accounts. The minimum qualification for (i) above shall be a graduate in Electrical Engineering and for (ii) above shall be CA/ICWA. b. The applicant will furnish to the Commission details of the professional and supporting staff engaged by him on full time basis before undertaking trading. c. The aforesaid information shall be filed along with the supporting documents. i. The applicant shall justify to the satisfaction of the Commission that the technical capability and resources exhibited by the applicant are adequate to manage the intended volume of trading. ii. The applicant shall comply with the technical requirements when applying for the licence for trading: Provided that the Commission may grant the trading licence to the applicant subject to the trader furnishing the details and exhibiting compliance to the technical requirements, in accordance with regulations 3.2 above, before undertaking the trading. 4. Procedure for Grant of Licence for Trading a. The application for grant of licence for trading will be submitted to the Commission in the manner specified in the Conduct of Business Regulations in the form contained in Annexure-1A to these Regulations and will be accompanied by such fee as may be prescribed by the UT of J&K and UT of Ladakh. The application will be processed by the Commission as per the provisions of Joint Electricity Regulatory Commission, Jammu & Kashmir and Ladakh (Conduct of Business) Regulations 2022 which will include publication of notice of application, inviting objections from stakeholders and seeking response of the applicant thereto and shall be finally disposed of within a period of 45 days. b. The application shall be accompanied by: i. a statement of the capital proposed to be expended in carrying on the Licensed Business and such other particulars as the Commission may require; ii. a copy of the Memorandum and Articles of Association of the company, where the Applicant is a body corporate, and similar applicable documents of incorporation, registration or agreement in case of other business entities; iii. a receipt for payment of the application fee specified in accordance with clause (a) above; iv. an affidavit by the Applicant verifying the information disclosed in the application; v. where the Applicant is a body corporate, details of any group company(ies) engaged in the business of generation, distribution, transmission or trading of electricity, whether within the UT of J&K and UT of Ladakh or in any other State; vi. where the Applicant is not a body corporate, details of any business of generation, distribution, transmission or trading of electricity, whether within the UT of J&K and UT of Ladakh or in any other State, in which the Applicant is directly or indirectly interested; vii. Details of any financial holdings of the Applicant in the power sector; viii. Brief history of the promoters in case the Applicant is a body corporate; ix. Such other documents or information as the Commission may seek. c. After the applicant has published the notice of the application and after considering the objections received, if any, the Commission may decide, provisionally, to grant or refuse the licence and if it decides to grant the licence it may do so on such specific terms and conditions and with such modifications to the general conditions as the Commission may decide. d. When the Commission decides to grant the Licence, the Commission shall publish notice informing the name and address of the person to whom it intends to grant the Licence and other details as considered necessary and seek suggestions/objections from public and also indicate a date for hearing those who desire to be heard in person.16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] e. After considering all suggestions/objections and after hearing those desiring to be heard in person, the Commission may finally decide either to grant or refuse the Licence. f. If the Commission grants the Licence, the Secretary of the Commission shall immediately after issue of a licence, forward a copy of the licence to the State Government, Central Electricity Authority, Central Electricity Regulatory Commission, and to such other persons as the Commission considers necessary. g. The Licensee will pay to the Commission licence fee as per Fees, Fines and Charges Regulations for the grant of Trading Licence. Full licence fee would be payable for the year whether licence is operative for full or part of the year. The fee will be remitted in the form and manner as mentioned in the Fees, Fines and Charges Regulations. The licence fee will be paid by first week of April of each year. Provided that the licence fee for the first year of operation will be paid within one week of the Commission informing the applicant of its in principle approval for the issue of a licence. 5. Applicability of Trading Margin Trading margin shall be applicable to the following transactions undertaken by the Trading Licensee: a) Transactions under short term contracts (where period of the contract of the Trading Licensee with both the seller and the buyer, including transactions undertaken through power exchanges, is up to one year); b) Transactions under long term contracts (where period of the contract of the Trading Licensee with either the seller or the buyer or both is more than one year); c) Banking of electricity, irrespective of duration of the contract; d) Transactions under Back to Back contracts, irrespective of duration of the contract; 5.1 Trading Margin 1. Trading Licensee shall comply with the trading margin as given below: a. The trading margin shall be charged on the scheduled quantity of electricity b. The trading margin shall include all charges, except the charges for scheduled energy, open access and transmission losses: Provided that the charges for open access include the transmission charge, operating charge and the application fee. c. For transactions under short term and Long term contracts and contracts through power exchanges up to one year, the Trading Licensee shall charge a trading margin of not less than zero (0.0) paisa/kWh and not exceeding four (4.0) paisa/kWh: Provided that in contracts where escrow arrangement or irrevocable, unconditional and revolving letter of credit equivalent to one point one (1.1) times the average monthly bill amount (estimated average of monthly billing amounts for three months or actual monthly billing amount for preceding three months as the case may be) in case of long term contract with a validity of one year is not provided by the Trading Licensee in favour of the seller, the Trading Licensee shall not charge trading margin exceeding Two (2.0) paisa/kWh. In case of Short term contract revolving letter of credit equivalent to one point zero five (1.05) times of the contract value for short terms contract is not provided by the Trading licensee in favour of the seller, the Trading licensee shall not charge trading margin exceeding 2 paisa / kWh. 2. The trading margin specified under these regulations shall be the cumulative value of the trading margin charged by all the traders involved in the chain of transactions between the generator and the ultimate buyer, that is to say, trading margin in case of multiple trader-to-trader transactions and shall not exceed the ceiling of trading margin specified under these regulations. 6. Amendment to the Licence a. An application seeking amendments/the conditions of an existing licence under Section 18 of the Act will be submitted in the form contained in Annexure-1B to these Regulations and will be supported by an affidavit of the authorized person as provided in Form-2 of the Conduct of Business Regulations. b. State the existing conditions, proposed amendments to the conditions of licence and reasons therefore; ii. be accompanied by documents required for justifying the change in conditions of licence; and iii. be accompanied by a fee of an amount as specified in the Fees, Fines and Charges Regulations and in the form and manner as mentioned thereof. c. The Licensee will, within 7 days from the date of admission of such application, publish a notice in the form specified at Annexure-2 to these Regulations in one issue each of a daily newspaper in English, Urdu and Hindi languages having wide circulation in the UT of J&K and UT of Ladakh. d. The application of a Licensee seeking amendments to an existing licence will be considered in accordance with the provisions of Conduct of Business Regulations and these Regulations and will be finally disposed of within a period of 45 days. 7. Duties and Obligations of the Licensee The Licensee will have the following duties and obligations: - a. The Licensee will comply with the provisions of the Conduct of Business Regulations and also with the General Conditions of Trading Licence as specified in the Conduct of Business Regulations as well as the special conditions of licence issued to him; b. The Licensee will within a period of one month increase his net worth if the volume of trade as specified in clause 3.1 at any stage in a year upgrades from a lower category to a higher category and the Licensee shall inform the Commission of any such upgradation and subsequent change in the net worth; c. In case a Licensee holds multiple licences and his combined volume of trade at any stage in a year exceeds the combined net worth required for such licences, he will increase his net worth within a period of one month and provide proof thereof to the Commission; d. The Licensee will establish adequate communication facilities as per requirement of SLDC before commencement of the business of trading; e. The Licensee will have a website of his own for posting information in the format prescribed in Annexure 3 and 4 to these regulations and other necessary information with regard to trade. He shall ensure that the website remains operative at all times during the validity of the licence; f. The Licensee will, within one month of the beginning of each year of trading operations, furnish his auditor’s report regarding his net worth; g. The Licensee will be subject to trading margins for Trading as notified by the Commission from time to time; h. The Licensee will maintain an up to date record of all business transactions undertaken by him. He will also render necessary assistance to any person authorized by the Commission to inspect the records of the Licensee; i. The Licensee will ensure that all trading is carried out after entering into appropriate agreements with the seller of electricity or buyer of electricity as the case may be. Necessary safeguards concerning supply of electricity through trading and payment for the electricity traded will be included in the agreements between the parties. All financial transactions will be through letters of credit of scheduled banks; j. The trader shall pay to the Commission the non-refundable annual licence fee as mentioned in Fees, Fines and Charges Regulations. k. The Licensee will ensure that meters installed for the purpose of energy accounting comply with the specifications of the Grid Code; Central Electricity Authority (Installation and Operation of Meters) Regulations, 2006. l. The Licensee will have requisite Agreements with the Transmission Licensee (s) and Distribution Licensee (s) for transmission and/or wheeling of electricity as the case may be; m. The licensee will provide his annual business plan to the Commission, the State Transmission Utility and the SLDC within one month of the beginning of each year of trading operations;18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] n. The trader shall maintain separate accounts for his trading business, prepare and maintain the same in accordance with the provisions of the Companies Act, 1956/2013, as amended from time to time and such other particulars in details in the manner as the Commission may direct from time to time. o. The trader shall submit to the Commission copies of the accounting statements and Auditor’s report thereon not later than six months after the close of the financial year to which they relate. Any person authorised by the Commission shall be entitled to inspect and verify the accounts of the trader and the trader shall render all necessary assistance to such person. p. The Licensee will duly comply with the orders and directions of the State Load Dispatch Centre, (SLDC), State Transmission Utility and Central Electricity Authority issued in the discharge of their functions under the Act; q. The Licensee will comply with the requirements specified by the Commission from time to time under Section 66 of the Act. r. The trader shall not engage in the business of transmission of electricity. s. The trader shall not, without prior approval of the Commission assign or transfer his licence to any person, by sale, lease, exchange or otherwise. Wherever prior approval of the Commission is required, the trader shall file an appropriate petition before the Commission, in accordance with the Conduct of Business Regulations. 8. Supply of Information to the Commission and others a. The Licensee will supply such information as may be prescribed by the Commission from time to time. b. The Licensee will supply information in the format prescribed at Annexure-3 to these Regulations to the State Load Despatch Centre (SLDC) or any other utility as may be specified by the Commission with a copy to the Commission, on quarterly basis and also post on the website. The SLDC will verify the correctness of the quantum of energy traded, as indicated in the said quarterly information and report to the Commission. 9. Standards of Performance a. The Commission may, after consultation with the licensee, specify the standards of performance of the licensee. b. The licensee will furnish performance details to the Commission on quarterly basis in the format prescribed in Annexure-4 to these Regulations. 10. Contravention of terms and conditions of licence The Commission may pass such orders as it deems fit in accordance with the provisions of the Act, if there is a contravention or the likelihood of a contravention of the terms and conditions of licence by the Licensee. 11. Refusal of Licence If the Commission is not inclined to grant the Licence, the Commission shall give an opportunity to the Applicant for being heard in person before rejecting the application. 12. Revocation of a Licence a. The proceedings for revocation of a Licence and/or for issuing any other orders under section 19 of the Act shall be initiated by the Commission by means of an order. The Commission may initiate such proceedings suo motu or on application of the licensee or on receiving any complaint or information from any person. b. The Commission shall give notice of the proceedings for the revocation of the licence to the licensee and to such other person, authority or body as the Commission may consider appropriate. c. Subject to the provisions of the Act and the procedure prescribed therein, the inquiry by the Commission for revocation of the licence, in so far as it is applicable, shall be in the same manner as provided in the Conduct of Business Regulations of the Commission in force. d. If the Commission decides to revoke the licence, the Commission shall communicate the order of revocation to the licensee stating the date from which such revocation shall take effect. e. The Commission may instead of revoking the licence pass any other order imposing such terms or conditions subject to which the Licensee is permitted to operate thereafter.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 19 13. Issue of orders and practice directions Subject to the provisions of the Act, and these Regulations, the Commission may, from time to time, issue orders and practice directions in regard to the implementation of these Regulations, the procedure to be followed etc., and other matters, which the Commission has been empowered by these Regulations to specify or direct. 14. Power to Remove Difficulties If any difficulty arises in giving effect to any of the provisions of these Regulations, the Commission may, by general or special order, do anything, not being inconsistent with the provisions of the Act or rules framed thereunder, which appears to be necessary or expedient for the purpose of removing such difficulty. 15. Power to Amend The Commission may, from time to time, add, modify or amend any provisions of these Regulations after following the necessary procedures. By Order of the commission, V. K.
