स्वीकृधत से एतदद्वारा बैंक ऑफ़ बड़ौदा अधिकारी कमजचारी (अनुशासन एव ं अपील) धवधनयमन, 1976/1982 में पररवतजन हते ु
धनम्नधलधित धवधनयमन में धनम्नानुसार संशोिन करता ह ै:-
1. इस धवधनयमन को बकैं ऑफ़ बड़ौदा अधिकारी कमचज ारी (अनशु ासन एव ं अपील) सशं ोधित धवधनयमन, 2019 कहा
र्ाएगा ।
2. ये धवधनयमन शासकीय रार्पत्र में प्रकाशन की तारीि से लाग ूहोंगे ।
3. बैंक ऑफ़ बड़ौदा अधिकारी कमजचारी (अनशु ासन एवं अपील) धवधनयमन, 1976/1982 में तथा इसके बाद समय-समय
पर र्ारी सभी अधिसूचनाओं/ पररपत्रों में, र्हां भी धवधनयम 6(3) का प्रयोग दकया गया है, उसे संशोधित माना र्ाएगा
और धनम्नानुसार पढ़ा र्ाएगा:-
“र्हां दकसी प्रकार की र्ांच प्रस्ताधवत की र्ाती ह,ै वहां अनुशासनात्मक प्राधिकारी अधिकारी कमजचारी के धवरूद्ध
लगाए गए आरोपों और आरोप संबंिी अंतर्ननयमों, आरोपों के धववरण, संबंधित दस्तावेर्ों की सूची सधहत उनकी प्रधतयां
और गवाहों की सूची, यदद कोई हो, धर्न पर व े धनभजर हों, के आिार पर आरोपों को पुख्ता और स्पष्ट रूप से तैयार
करेगा और उन्द्ह ें संबंधित अधिकारी कमजचारी को धलधित रूप म ें ददया र्ाएगा. संबंधित अधिकारी कमजचारी को
अनुशासनात्मक प्राधिकारी द्वारा धनर्ददष्ट समयसीमा के भीतर (अधिकतम 15 ददनों में) या उस प्राधिकारी द्वारा प्रदान
की गई अधतररि समयसीमा के भीतर अपन ेबचाव में एक धलधित बयान प्रस्तुत करना होगा ।

4. समय-समय पर यथा-शोधित बकैं ऑफ़ बड़ौदा अधिकारी कमचज ारी (अनुशासन एव ं अपील) धवधनयमन, 1976/1982 में
उप-धवधनयम 6(21) (ii) के बाद उप-धवधनयम 6(21) (iii) को धनम्नानुसार शाधमल दकया र्ाए:-
क) र्ांचकताज प्राधिकारी के रूप म ें अपनी धनयुधि का आदशे प्राि करन े की तारीि स े ह माह की अवधि के भीतर
र्ांचकताज प्राधिकारी र्ांच पूरी करेंग ेऔर अपनी ररपोर्ज प्रस्तुत करेंगे ।
ि) यदद धबन्द्द ु (क) म ें धवधनर्ददष्ट समय सीमा का पालन दकया र्ाना संभव नहीं ह ै तो र्ांचकताज प्राधिकारी को इसका
कारण बताना होगा और अनुशासनात्मक प्राधिकारी से धलधित म ें अधतररि समय मांगना होगा, र्ो र्ांच को परू ी
करने के धलए अधतररि समय की अनुमधत देंग ेऔर र्ो एक बार में ह माह से अधिक की नहीं होगी ।
ग) अधतररि समय की अनुमधत, र्ो एक बार में ह माह स े अधिक की नहीं होगी, दकसी उधचत और पयाजि कारण पर
ही दी र्ाएगी और अनुशासनात्मक प्राधिकारी अथवा अनुशासनात्मक प्राधिकारी की ओर से प्राधिकृत दकसी अन्द्य
प्राधिकारी द्वारा इसका धलधित में उल्लेि दकया र्ाएगा ।

Baroda, the 11th December, 2019
No. HO:HRM:111.―In exercise of the power conferred by section 19 of the Banking Companies (Acquisition
and Transfer of Undertakings) Act, 1970 the Board of Directors of Bank of Baroda after consultation with Reserve Bank
of India and with the previous sanction of the Central Government, hereby makes / changes the following regulations
further to amend the Bank of Baroda Officer Employees’ (Discipline & Appeal) Regulations, 1976 / 1982, namely :-
1. These Regulations may be called Bank of Baroda Officer Employees’ (Discipline & Appeal) Amendment
Regulations, 2019.
2. They shall come into force on the date of their publication in their publication in the Official Gazette.III 4 3
3. In the Bank of Baroda Officer Employees’ (Discipline & Appeal) Regulations, 1976 / 1982 and subsequent
Notifications / Circulars issued from time to time wherever Regulation 6(3) is used, be amended and read as under:-
“Where it is proposed to hold an Inquiry, the Disciplinary Authority shall frame definite and distinct charges on the
basis of the allegations against the Officer Employee and the articles of charge, together with a statement of
allegations, list of documents relied on along with a copy of such documents and list of witness, if any, on which
they are based, shall be communicated in writing to the Officer employee, who shall be required to submit, within
such time as may be specified by the Disciplinary Authority (not exceeding 15 days), or within, such extended time
as may be granted by the said Authority, a written statement of his defence:
Provided that under no circumstances, the extension of time for filing written statement of defence shall exceed
forty-five days from the date of receipt of articles of charge”.
4. The Sub-regulation 6 (21) (iii) be inserted after Sub-regulation 6 (21) (ii) as under in Bank of Baroda Officer
Employees’(Discipline & Appeal) Regulations, 1976/1982 as amended from time to time:-
a) The Inquiring Authority should conclude the inquiry and submit his report within a period of six months from the
date of receipt of order of his appointment as Inquiring Authority.
(b) Where it is not possible to adhere to the time limit specified in clause (a), the Inquiring Authority may record the
reasons and seek extension of time from the disciplinary authority in writing, who may allow an additional time not
exceeding six months for completion of Inquiry, at a time.
(c) The extension for a period not exceeding six months at a time may be allowed for any good and sufficient reasons
to be recorded in writing by the Disciplinary Authority or any other Authority authorized by the Disciplinary
Authority on his behalf.
