## Policy Analysis Report: Supreme Court Judges Rules, 1959 - Second Amendment Rules, 2021
**1. Executive Summary:**
This report analyzes the Supreme Court Judges Second Amendment Rules, 2021, which amends the Supreme Court Judges Rules, 1959. The core purpose of this amendment is to revise the existing rules regarding reimbursement of telephone call charges for Supreme Court Judges. The key change is the replacement of a fixed number of free calls with a fixed monetary reimbursement for telephone/mobile/broadband/data services.
**2. Introduction:**
This report provides an overview and analysis of the Supreme Court Judges Second Amendment Rules, 2021, based on the official notification provided. The analysis focuses on the changes introduced by the amendment, their rationale, and potential impact on the affected individuals.
**3. Policy Overview:**
* **Original Policy:** The Supreme Court Judges Rules, 1959.
* **Core Objective(s):** The original policy's objective (based on the amendment context) appears to be defining and regulating the service conditions of Supreme Court Judges, including provisions for telephone facilities. The amendment focuses on the method and amount of reimbursement for these facilities.
**4. Background and Rationale:**
This is an amendment to existing rules. The likely reason for this specific amendment is to provide a more flexible and potentially simplified system for reimbursing communication expenses of Supreme Court Judges. The amendment replaces the provision for a fixed number of free calls with a reimbursement scheme that covers various types of communication services (residential telephone, mobile phone, broadband, mobile data, or data card). This change likely reflects the evolving communication landscape and the increased reliance on diverse data services. It might also be aimed at reducing administrative burden associated with tracking call usage.
**5. Key Provisions / Changes:**
This section details the specific changes introduced by the Supreme Court Judges Second Amendment Rules, 2021:
* **Specific Part of Original Policy Changed:** Rule 3B of the Supreme Court Judges Rules, 1959, specifically subrules 1 and 2.
* **New Rule/Provision:**
* Subrule 1 and Subrule 2 are amended to replace the phrase "the number of free calls to the extent of 1500 per month over and above the number of free calls per month allowed by the telephone authorities" with "reimbursement of telephone call charges of residential telephone or mobile phone or broadband or mobile data or data card not exceeding to Rs.4200 per month taxes as applicable shall be substituted".
* **Difference/Effect of the Change:** The amendment shifts the reimbursement mechanism from a fixed number of "free calls" to a fixed monetary allowance of Rs. 4200 per month (plus applicable taxes) for telephone and data services. This allows judges to choose the communication services that best suit their needs within the allocated budget. The change from a fixed number of calls to a fixed monetary value provides more flexibility.
**6. Target Audience and Stakeholders:**
The direct target audience and stakeholders are the Supreme Court Judges of India. This amendment directly affects their entitlements regarding reimbursement for communication expenses.
**7. Implementation Aspects (Inferred):**
* **Responsible Agency/Bodies Mentioned:** The Department of Justice, Ministry of Law and Justice, is responsible for issuing the notification. The "telephone authorities" previously responsible for free call allowances are no longer directly involved in the reimbursement process.
* **Timelines or Procedures Specified:** The amendment came into force on the date of its publication in the Official Gazette (August 4, 2021). There are no further procedural details specified in the provided text.
* **Implementation of Changes:** It can be inferred that a process for claiming reimbursement up to Rs. 4200 per month, including taxes, will be established by the relevant administrative bodies for Supreme Court Judges. This process will likely require submission of relevant bills/invoices.
**8. Expected Outcomes / Impact of Changes:**
The likely intended outcome of these specific changes is:
* **Increased Flexibility:** Providing Supreme Court Judges with greater flexibility in choosing and utilizing communication services that meet their individual needs.
* **Simplified Administration:** Potentially simplifying the administrative process for both the judges and the responsible government agencies by replacing the tracking of call usage with a fixed reimbursement system.
* **Modernization of Benefits:** Aligning the benefits with current communication technologies and usage patterns by including mobile data and broadband services in the reimbursement scheme.
**9. Conclusion:**
The Supreme Court Judges Second Amendment Rules, 2021, represent a significant update to the regulations governing communication expense reimbursement for Supreme Court Judges. By replacing the fixed "free call" allowance with a monetary reimbursement system, the amendment offers greater flexibility, potentially simplifies administration, and aligns with the modern communication landscape. This change is a targeted adjustment within the broader framework of Supreme Court Judges' service conditions.
