## Policy Analysis Report: Government of India Allocation of Business Rules, 1961 - Amendment **1. Executive Summary:** This report analyzes the "Government of India Allocation of Business Three Hundred and Sixty First Amendment Rules, 2021" (dated July 6, 2021). This amendment modifies the Government of India Allocation of Business Rules, 1961, specifically concerning the allocation of business related to Public Enterprises. The key change involves the creation of a distinct "Department of Public Enterprises" under the Ministry of Finance and the transfer of responsibilities related to various Public Sector Enterprises (PSEs) from the Ministry of Heavy Industries and Public Enterprises to the Ministry of Heavy Industries. This restructuring aims to streamline the management and oversight of Public Sector Enterprises. **2. Introduction:** This report provides an analysis of the Government of India Allocation of Business Three Hundred and Sixty First Amendment Rules, 2021, based solely on the information contained within the provided policy text. The report aims to inform stakeholders, particularly those in the Public Sector Enterprises, about the changes introduced by this amendment. **3. Policy Overview:** * **Original Policy:** Government of India Allocation of Business Rules, 1961. * **Core Objective(s) (Inferred):** The amendment seeks to revise the allocation of governmental business, specifically relating to Public Sector Enterprises, to presumably improve efficiency, oversight, and strategic management. **4. Background and Rationale:** The amendment suggests a shift in the government's approach to managing Public Sector Enterprises. The creation of a dedicated "Department of Public Enterprises" under the Ministry of Finance implies a greater emphasis on financial oversight, performance monitoring, and potentially, strategic decision-making regarding these enterprises. The transfer of specific PSEs from the Ministry of Heavy Industries and Public Enterprises to the Ministry of Heavy Industries suggests a separation of responsibilities, perhaps to allow the latter to focus specifically on heavy industries while the former takes on the broader role of public enterprise management. The rationale is likely to enhance the overall effectiveness of Public Sector Enterprises and align their operations with broader economic and financial objectives. **5. Key Provisions / Changes:** The amendment introduces the following key changes: * **Creation of the Department of Public Enterprises:** A new "Department of Public Enterprises" (Lok Udyam Vibhag) is created under the Ministry of Finance (Vitta Mantralaya). This department is assigned specific responsibilities related to PSEs. * **Responsibilities of the Department of Public Enterprises:** The newly formed department will handle various functions, including: * Residual work of the erstwhile Bureau of Public Enterprises. * Coordination of general policy matters affecting all PSEs. * Evaluation and monitoring of PSE performance. * Matters relating to arbitration for PSEs. * Employee rehabilitation under Voluntary Retirement Schemes. * Review of capital projects and expenditure. * Performance improvement measures and capacity building. * Advice on revival, restructuring, or closure of PSEs. * Matters relating to the Standing Conference of Public Enterprises and the International Center for Public Enterprises. * Categorization of PSEs, including conferring Ratna status. * Survey of Public Enterprises. * **Re-designation of Ministry:** The "Ministry of Heavy Industries and Public Enterprises" (Bhari Udyog aur Lok Udyam Mantralaya) is renamed as the "Ministry of Heavy Industries" (Bhari Udyog Mantralaya). * **Transfer of PSEs to the Ministry of Heavy Industries:** A comprehensive list of Public Sector Enterprises, previously under the Ministry of Heavy Industries and Public Enterprises, are now explicitly assigned to the Ministry of Heavy Industries. This list includes entities in various sectors such as engineering, machinery, cement, paper, and automotive. **Difference and Effect of Changes:** * The Department of Public Enterprises will now handle central policy, monitoring, restructuring and VRS for PSEs, shifting these responsibilities away from the Heavy Industries Ministry. * The Ministry of Heavy Industries now focuses directly on the operational management and specific concerns of the listed PSEs, potentially allowing for more targeted support and oversight related to the heavy industry sector. **6. Target Audience and Stakeholders:** The primary target audience and stakeholders directly affected by this amendment include: * **Public Sector Enterprises (PSEs):** Especially those listed under the Ministry of Heavy Industries. * **Employees of PSEs:** Particularly those involved in voluntary retirement schemes or those affected by restructuring initiatives. * **Ministry of Finance (Vitta Mantralaya):** The newly empowered ministry responsible for the Department of Public Enterprises. * **Ministry of Heavy Industries (Bhari Udyog Mantralaya):** The ministry whose role in PSE oversight is significantly reduced and refocused. * **Bureaucracy associated with the public sector enterprises:** They will be required to adjust to the new rules of operation. **7. Implementation Aspects (Inferred):** * **Responsible Agency/Bodies:** The Cabinet Secretariat is responsible for the notification of these amendments. The Department of Public Enterprises, under the Ministry of Finance, is responsible for implementing the changes related to policy coordination, monitoring, and restructuring of PSEs. The Ministry of Heavy Industries is responsible for the management of the listed PSEs. * **Timelines/Procedures:** The amendment comes into force "at once," implying immediate implementation. Specific timelines or procedures for the transfer of responsibilities and reporting lines are not detailed in the text but would likely be defined subsequently by the respective ministries. **8. Expected Outcomes / Impact of Changes:** The likely intended outcome of these changes is: * **Improved Oversight and Performance Monitoring:** Centralized oversight of PSEs under the Ministry of Finance's Department of Public Enterprises is expected to lead to better performance monitoring and strategic decision-making. * **Streamlined Operations within Heavy Industries:** The Ministry of Heavy Industries can focus its attention on the operational efficiency and specific challenges of the listed PSEs within the heavy industry sector. * **Enhanced Financial Management:** Integrating Public Sector Enterprise oversight within the Finance Ministry suggests a focus on financial performance, resource allocation, and strategic financial planning for these entities. * **Quicker Restructuring:** Concentrating expertise on PSE restructuring may speed up difficult, but required, policy concerning the future of central public sector enterprises. **9. Conclusion:** The Government of India Allocation of Business Three Hundred and Sixty First Amendment Rules, 2021, represents a significant restructuring of the oversight and management of Public Sector Enterprises. By creating a dedicated Department of Public Enterprises under the Ministry of Finance and re-aligning the responsibilities of the Ministry of Heavy Industries, the government likely aims to improve the efficiency, financial performance, and strategic direction of these vital economic entities. This policy changes have implications for the operation of all associated companies.
