L.-33004/99 EXTRAORDINARY II— — (i) PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY ] No. 606] NEW DELHI, THURSDAY, JULY 6, 2017/ASADHA 15, 1939 सचं ार और सचू ना प्रौद्योगिकी मत्रं ालय अगिसचू ना नई दिल् ली, 5 जुलाई, 2017 सा.का.गन. 842(अ).—केन्‍द रीय सरकार, भारतीय िरू संचार गिगनयामक प्रागिकरण अगिगनयम, 1997 की िारा 35 की उप िारा (2) के खंड (ख,ि) द्वारा प्रित् त शग‍ तयों का प्रयोि करते हुए और िरू संचार गििाि समािान और अपील अगिकरण, समूह ‘ि ‘और समूह ‘ घ ‘ पि भती गनयम, 2003 को उन बातों के गसिाए अगिक्ांत करते हुए गजन्‍द ह ें ऐसे अगिक्मण से पहले दकया िया ह ै या करने का लोप दकया िया है, िरू संचार गििाि समािान और अपील अगिकरण के समूह ‘ ि ’ पिों पर भती की पद्धगत का गिगनयमन करने के गलए गनम् नगलगखत गनयम बनाती ह,ैं अर्ाात:- 1. सगं िप्त नाम और प्रारंभ: (1) इन गनयमों का संगिप्त नाम िरू संचार गििाि समािान और अपील अगिकरण समूह “ि” पि भती गनयम, 2017 ह।ै (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रिृत् त होंि े। 2. लाि ूहोना-ये गनयम इन गनयमों से उपाबद्ध अनुसूची के स् तंभ (।) में गिगनर्िष्ा ट पिों को लाि ूहोंि े। 3. पि-संख्य ा, ििीकरण, और िते न मट्रै ि‍स म ेंस्त र: - पि की संख्य ा, उसका ििीकरण और िेतन मैट्रि‍ स में स् तर िह होिा, जो इन गनयमों से उपाबद्ध अनुसूची के स् तंभ (2) से स् तंभ (4) में गिगनर्िष्ा ट ह ैं। 4. गनयगु ‍त - उ‍ त अनुसूची में गिगनर्िष्ा ट पिों के संबंि में गनयुग‍ त प्रागिकारी रगजस्ि ार, िरू संचार गििाि समािान अपील अगिकरण होंि े। 5. भती की पद्धगत, आय-ु सीमा, अहता ाएं आदि - भती की पद्धगत, आयु-सीमा, अहता ाएं और उससे संबंगित अन्‍द य बातें िह होंिी जो उ‍ त/पूिोक त अनुसूची के स् तंभ (5) से (13) में गिगनर्िष्ा ट ह ैं। 6. गनहता ाएं- िह व् यग‍ त-- (क) गजसने ऐसे व् यग‍ त से, गजसका पगत या गजसकी पत् नी जीगित ह,ै गििाह दकया है, या गििाह की संगििा की है; या (ख) गजसने अपने पगत या अपनी पत् नी के जीगित रहते हुए दकसी व् यग‍ त से गििाह दकया ह ैया गििाह की संगििा की ह ै। 4200 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] उ‍ त पि पर गनयुग‍ त का पात्र नहीं होिा : परंतु यदि केन्‍द रीय सरकार का यह समािान हो जाता ह ै दक ऐसा गििाह उस व् यग‍ त और गििाह के अन्‍द य पिकार को लाि ू स् िीय गिगि के अिीन अनुज्ञेय ह ैऔर ऐसा करने के गलए अन्‍द य आिार ह ैंतो िह दकसी व् यग‍ त को इस गनयम के प्रितान से छूट ि े सकेिी । 7. गशगर्ल करन े की शग‍त - जहां केन्‍द रीय सरकार की यह राय ह ै दक ऐसा करना आिश् यक या समीचीन ह,ै िहां िह उसके गलए जो कारण ह,ैं उन्‍द ह ेंलेखबद्ध करके, इन गनयमों के दकसी उपबंि को दकसी िि ाया प्रिि ा के व् यग‍ तयों की बाबत, आिशे द्वारा गशगर्ल कर सकेिी । 8. व् यािगृ त्त - इन गनयमों की कोई बात, ऐसे आरिण, आयु सीमा में छूट और अन्‍द य ट्ररयायतों पर प्रभाि नहीं डालेिी, गजनका केन्‍द रीय सरकार द्वारा इस संबंि में समय-समय पर जारी दकए िए आिशे ों के अनुसार अनुसगू चत जागतयों, अनुसूगचत जनजागतयों, अन्‍द य गपछडे ििों, भूतपूिा सैगनकों और अन्‍द य गिशेष प्रििा के व् यग‍ तयों के गलए उपबंि करना अपेगित ह ै। अनसु चू ी पि का नाम पि की संख्य ा ििीकरण िते न मट्रै ि‍स चयन पि या सीि ेभती दकए जान ेिाले व्य ग‍त यों सीि ेभती दकए म ेंस्त र अचयन पि के गलए आय-ु सीमा जान ेिाल े व् यग‍त यों के गलए अपगे ित शगै िक और अन्‍दय अहता ाएं (1) (2) (3) (4) (5) (6) (7) 1.आशुगलगपक 02* सािारण िेतन मैट्रि‍ स लाि ू नहीं 18 िषा और 27 िषा के बीच (।) दकसी मान्‍द यता श्रेणी-।। केन्‍द रीय सेिा, में स् तर-4 होता प्राप्त बोडा या (2017) (केन्‍द रीय सरकार द्वारा जारी दकए िए (22500- गिश् िगिद्यालय से समूह ‘ ि ‘ अनुिशे ों या आिशे ों के अनसु ार 81100 रू.) 12िीं किा में अरापजगत्रत सरकारी सेिकों के गलए 40 िषा तक * कायाभार के उत् तीणा या अनुसगचिीय गशगर्ल की जा सकती ह ै।) आिार पर समतुल् य । ट्रटप्प ण 1:-आयु सीमा अििाट्ररत पट्ररितान दकया (।।) कौशल परीिा करने के गलए गनणाायक तारीख भारत जा सकता ह।ै सगनयम में अभ् यर्थर्ायों से आिेिन प्राप्त करने श्रुतलेख: 10 गमनट के गलए गनयत की िई अंगतम तारीख @80 शब् ि प्रगत होिी। (न दक िह अंगतम तारीख जो गमनट असम, मेघालय, अरुणाचल प्रिेश, प्रगतलेखन: 50 गमजोरम, मगणपुर, नािालैंड, गत्रपुरा, गमनट गसग‍ कम, जम् मू-कश् मीर राज्य के (अंग्रेजी) लद्दाख खंड गहमाचल प्रिशे के 65 गमनट (हहिं ी) लाहोल और स् पीगत गजले तर्ा चम् बा- (केिल कम् प्य ूटर गजले के पांिी उपखंड, अंडमान और पर) गनकोबार द्वीप या लिद्वीप के अभ् यर्थर्ायों के गलए गिगहत की िई ह ै। ) ट्रटप्प ण 2: रोजिार कायाालय के माध्य म से आन े िाले अभ् यर्थर्ायों की िशा में आयु सीमा अििाट्ररत करने के गलए गनणाायक तारीख िह अगंतम तारीख होिी गजस तक रोजिार कायाालय से नाम भेजने के गलए कहा िया ह ै।II (i) 3 सीि े भती दकए जान े िाल े व्य ग‍त यों के परीिीिा की अिगि, भती की पद्धगत : भती सीि े होिी या प्रोन्‍दन गत द्वारा या गलए गिगहत आय ु और शगै िक अहता ा प्रगतगनयगु ‍त या आमले न द्वारा तर्ा गिगभन्‍दन पद्धगतयों द्वारा यदि कोई हो। प्रोन्‍दन त व्य ग‍त यों की िशा भरी जान ेिाली ट्ररग‍त यों की प्रगतशतता म ेंलाि ूहोंिी या नहीं। (8) (9) (10) लाि ूनहीं होता । सीिे भती दकए जाने सीिी भती द्वारा गजसके न हो सकने पर प्रगतगनयुग‍ त द्वारा िाले व् यग‍ तयों के ट्रटप्प ण:- पििारी के प्रगतगनयुग‍ त या लम् बी बीमारी या गलए िो िषा । अध्य यन छुट्टी या दकन्‍द हीं अन्‍द य पट्ररगस् र्गतयों में एक िष ा या उससे अगिक अिगि के गलए बाहर रहने के कारण हुई ट्ररग‍ तयां, केन्‍द रीय सरकार के ऐसे अगिकाट्ररयों में से जो सिशृ पि िारण दकए हुए हैं,स् तंभ (7) के अिीन अहता ाएं हैं, प्रगतगनयुग‍ त के आिार पर भरी जा सकेिी । प्रोन्‍दन गत या प्रगतगनयगु ‍त या आमले न द्वारा भती की िशा म ेंि ेश्रगे णया ंगजनस ेप्रोन्‍दन गत या प्रगतगनयगु ‍त या आमले न दकया जाएिा । (11) प्रगतगनयुग‍ त पर:- केन्‍द रीय सरकार या राज्य सरकारों, न्‍द यायलयों, अगिकरण, पगब् लक से‍ टर उपक्म और स् िायत् त गनकाय से पििारी- क. (।) मूल संिि ाया गिभाि में गनयगमत आिार पर सिशृ पि िारण कर रह ेहों, या (।।) मूल संििा या गिभाि में गनयगमत आिार पर इसकी गनयुक गत के पश चात िेतन मैट्रिक स (19900-56900 रु.) में स तर-2 में आठ िषा गनयगमत सेिा की हो, और ख. स तंभ (7) के अिीन सीिी भती के गलए शैगिक अहता ाएं अनुभि रखते हों । यदि गिभािीय प्रोन्‍दन गत सगमगत ह,ै तो उसकी सरं चना भती करन ेम ेंदकन पट्ररगस्र् गतयों म ें सघं लोक सिे ा आयोि स ेपरामश ा दकया जाएिा। (12) (13) गिभािीय पुगि सगमगत(पुगि के संबंि में गिचार करने के गलए) गजसमें गनम् नगलगखत होंि:े- लाि ूनहीं होता । (1) रगजस्ि ार या सलाहकार, िरू संचार गििाि समािान और अपील अगिकरण -अध्य ि (2) गनिशे क या संयु‍त सलाहकार, िरू संचार गििाि समािान और अपील अगिकरण -सिस् य (3) उप रगजस्ि ार, िरू संचार गििाि समािान और अपील अगिकरण या उप सगचि -सिस् य उप सगचि, िरू संचार गिभाि (1) (2) (3) (4) (5) (6) (7) (8) (9) (10) 2.उच् च 02* सािारण केन्‍द रीय िेतन मैट्रि‍ स अचयन लाि ू नहीं लाि ू लाि ूनहीं लाि ूनहीं प्रोन्‍द नगत द्वारा श्रेणी सेिा, में स् तर-4 होता नहीं होता । होता गजसके ना हो गलगपक (2017) प्रोन्‍दन गत:- ऐसा अिर श्रेणी गलगपक या रोकगडया गजसने श्रेणी में आठ िष ागनयगमत सेिा की हो । ट्रटप्प ण-1 : जहां ऐसे कगनष् ठ व् यग‍ तयों के संबंि में, गजन्‍द होंने अपनी अहका /पात्रता सेिा पूरी कर ली ह,ै प्रोन्‍द नगत के गलए गिचार दकया जा रहा हो, िहां उनके ज्य ेष् ठ व् यग‍ तयों के संबंि में भी गिचार दकया जाएिा परंतु यह तब जब दक उसके द्वारा की िई ऐसी अहका /पात्रता सेिा, अपेगित अहका /पात्रता सेिा के आि ेसे अगिक से या िो िष ासे, इनमें से जो भी कम हो, कम न हो और उन्‍द होंन ेअपन े ऐसे कगनष् ठ व् यग‍ तयों सगहत , गजन्‍द होने ऐसी अहका /पात्रता सेिा पहले ही पूरी कर ली है, अिली उच् चतर श्रेणी में प्रोन्‍द नगत के गलए अपनी पट्ररिीिा की अिगि सफलतापूिाक पूरी कर ली हो । ट्रटप्प ण-2 : प्रोन्‍द नगत के गलए न्‍द यूनतम अहका सेिा की संिणना करने के प्रयोजन के गलए दकसी अगिकारी द्वारा, 01 जनिरी, 2016 से पहले या उस तारीख से गजससे सातिें केंरीय िेतन आयोि की गसफाट्ररशों पर आिाट्ररत पुनरीगित िेतन संरचना का गिस्त ार दकया िया है, िेतन आयोि की गसफाट्ररशों पर आिाट्ररत गिस्त ाट्ररत तत् स् र्ानी ग्रेड िेतन या िेतनमान पर की िई सेिा समझी जाएिी । प्रगतगनयुग‍ त: केन्‍द रीय सरकार या राज्य सरकार, पगब् लक से‍ टर उपक्मों, स् िायत् त गनकायों, न्‍द यायालयों या अगिकरणों के अगिकारी- क) (।) मूल संिि ाया गिभाि में गनयगमत आिार पर सिशृ पि िारण कर रह ेहों, या (।।) मूल संििा या गिभाि में िेतन मैट्रि‍ स म ें(19,900-63200 रू.) में स् तर -2 में आठ िष ागनयगमत सेिा में गनयगमत सेिा की हो और पहले ही िेतन मैट्रि‍ स में स् तर-2 (19900-63200 रू.) हो, 12िीं किा अिश् य उत् तीणा करना चागहए । ख) (।) मान्‍द यता प्राप्त बोडा या गिश् िगिद्यालय से अहता ा 12 िीं किा उतीणा या समतुल् य । (।।) अंग्रेजी में प्रगत गमनट 35 शब् िों की िगत में टंकण या कम् प् यूटर पर हहंिी में प्रगत गमनट 30 शब्ि (औसत 5 कुंजी िबाि पर 10500 के डी पी एच / 9000 के डी पी एच के गलए तत्स् र्ानी प्रगत गमनट 35 शब्ि और 30 शब् ि प्रगतगमनट) पोषक प्रिि ा के ऐसे गिभािीय अगिकारी, जो प्रोन्‍द नगत की सीिी पगं ‍ त में ह,ै प्रगतगनयगु ‍ त पर गनयुग‍त के गलए गिचार दकए जाने के पात्र नहीं होंि े। इसी प्रकार प्रगतगनयुग‍ त व् यग‍ त प्रोन्‍द नगत द्वारा गनयुग‍ त के गलए गिचार दकए जाने के पात्र नहीं होंि े। प्रगतगनयुग‍ त की अिगि, गजसके अंतिात केन्‍द रीय सरकार के उसी या दकसी अन्‍द य संिठन या गिभाि में इस गनयुग‍ त से ठीक पहले िाट्ररत दकसी अन्‍द य काडर बाह्य पि पर प्रगतगनयुग‍ त की अिगि है सािारणतया 3 िष ासे अगिक नहीं होिी । प्रगतगनयुग‍ त द्वारा गनयुग‍ त के गलए अगिकतम आयु सीमा आिेिन प्राप् त करने की अंगतम तारीख को 56 िषा से अगिक नहीं होिी । प्रगतगनयुग‍ त के आिार पर गनयुग‍ त के प्रयोजन के गलए दकसी अगिकारी द्वारा, 01 जनिरी, 2016 से पहले या उस तारीख से गजससे छठिें केन्‍द रीय िेतन आयोि की गसफाट्ररशों पर आिाट्ररत पुनरीगित िेतन संरचना का गिस्त ार दकया िया है, गनयगमत आिार पर की िई सेिा को, उ‍ त िेतन आयोि की गसफाट्ररशों पर आिाट्ररत गिस्त ाट्ररत तत् स् र्ानी िते न मट्रै ि‍स म ेंस्त र म ेंकी िई सिे ा समझी जाएिी, गसिाय उस िशा के, जहा ं एक स ेअगिक पिू ा पनु रीगित ग्रेड िते न या िते नमान के स्त र म ें गिलय हो िया ह ै और िहा ं यह लाभ केिल उन पिों पर गिस्त ाट्ररत होिा गजसके गलए ग्रडे िते न या िते नमान गबना दकसी उन्‍दन यन का सािारण प्रगतस्र् ापन ग्रेड ह ै। (12) (13) गिभािीय प्रोन्नगत सगमगत(प्रोन्नगत और पुगि के संबंि में गिचार करने के गलए) गजसमें गनम् नगलगखत होंि:े- लाि ूनहीं होता । (1) रगजस्ि ार या सलाहकार, िरू संचार गििाि समािान और अपील अगिकरण -अध्य ि बा-गजले के पांिी उपखंड, गलए तत्स् र्ानी प्रगत गमनट अंडमान और गनकोबार द्वीप या लिद्वीप 35 शब्ि और 30 शब्ि के अभ् यर्थर्ायोंके गलए गिगहत की िई है। प्रगतगमनट) ट्रटप्प णी :- रोजिार कायाालय के माध्य म से hereby makes the following rules regulating the method of recruitment to Group ‘C’ posts in the Telecom Disputes Settlement and Appellate Tribunal, namely:- 1. Short title and commencement. — (1) These rules may be called the Telecom Disputes Settlement and Appellate Tribunal Group ‘C’ posts Recruitment Rules, 2017. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Application. — These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules. 3. Number of post, classification and the level in pay matrix. —The number of the posts, their classification and the level in pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule. 4. Appointment. — The appointing authority in respect of posts specified in the said schedule shall be the Registrar, Telecom Disputes Settlement and Appellate Tribunal. 5. Method of recruitment, age-limit, qualifications, etc. — The method of recruitment to the said post, age- limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule. 6. Disqualification. — No person,– (a) who has entered into or contracted a marriage with a person having a spouse living, or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 7.
