हुए, केंद्रीय सरकार के पूर्व अनुमोिन से, भारत अंतरराष्ट्रीय माध्यस्ट्थम ् केंद्र (मध्यस्ट्थों के पैनल में प्रर्ेि हते ु मानिडं )
जर्जनयम, 2023 का और संिोधन करने के जलए जनम्नजलजखत जर्जनयम बनाता है, अथातव ् :-
1. संजिप्त नाम और प्रारंभ – (1) इन जर्जनयमों को भारत अतं रराष्ट्रीय माध्यस्ट्थम ् केंद्र (मध्यस्ट्थों के पैनल में प्रर्ेि हते ु
मानिंड) संिोधन जर्जनयम, 2025 कहा िा सकता ह।ैं
(2) य ेरािपत्र म ेंउनके प्रकािन की तारीख को प्रर्ृत्त होंग े।
2. भारत अंतरराष्ट्रीय माध्यस्ट्थम ् केंद्र (मध्यस्ट्थों के पनै ल में प्रर्ेि हते ु मानिडं ) जर्जनयम, 2023 (जिसे इसमें इसके
पश्चात् उि जर्जनयम कहा गया ह)ै के जर्जनयम 2 म ेंउपजर्जनयम (1) में, -
(i) खंड (ड.) के पश्चात् जनम्नजलजखत खंड अतं :स्ट्थाजपत दकया िाएगा, अथातव ् :-
‘(ड.क) “सूक्ष्म उद्यम” स े सूक्ष्म, लघ ु और मध्यम उद्यम जर्कास अजधजनयम, 2006 (2006 का 27)
की धारा 2 के खंड (ि) के अधीन यथापररभाजित सूक्ष्म उद्यम अजभप्रेत ह;ै
(ii) खंड (ि) के पश्चात ्जनम्नजलजखत खंड अंत:स्ट्थाजपत दकया िाएगा, अथावत् :-

‘(झ) “लघु उद्यम” से सूक्ष्म, लघ ु और मध्यम उद्यम जर्कास अजधजनयम, 2006 (2006 का 27) की धारा 2 के
खंड (ढ) के अधीन यथापररभाजित सूक्ष्म उद्यम अजभप्रेत है;|
3. उि जर्जनमयों के जर्जनयम 3 में, उपजर्जनयम (2) के पश्चात्, जनम्नजलजखत उपजर्जनयम अंत:स्ट्थाजपत दकया िाएगा,
अथावत ् :-
“(3) रजिस्ट्रार माध्यस्ट्थम् चैम्बर का सिस्ट्य –सजचर् होगा।”
4. उि जर्जनयमों के जर्जनयम 5 म,ें उपजर्जनयम (1) और उपजर्जनयम (2) के पश्चात् जनम्नजलजखत उपजर्जनयम
प्रजतस्ट्थाजपत दकया िाएगा, अथावत् :-
“(1) कोई व्यजि जिसके पास या तो घरेल ू माध्यस्ट्थम् या अतं रराष्ट्रीय माध्यस्ट्थम् या िोनों में जर्िेिज्ञता, अनुभर्
और प्रजतष्ठा हो, मध्यस्ट्थ के रुप में पैनलबद्ध होन े को आर्ेिन कर सकेगा।
(2) मध्यस्ट्थ के रुप में पैनलबद्ध होने के जलए आर्ेिन केंद्र की र्ेबसाइट (www.indiaiac.org): पर अजधमानतः
ऑनलाइन के रुप में दकया िाएगा ।
परंत ु कोई आर्ेिन इन जर्जनयमों से उपाबद्ध प्ररुप म ें िस हिार रुपए की अप्रजतिेय फीस के साथ रजिस्ट्रार के
कायावलय में दकया िा सकेगा:
परंतु यह और दक सूक्ष्म उद्यम या लघु उद्यम के जर्र्ािों के समाधान के जलए मध्यस्ट्थ के रुप में पैनलबद्ध होने के
जलए आर्ेिन िो हिार पांच सौ रुपए की अप्रजतिेय फीस के साथ दकया िाएगा।”
5. उि जर्जनमयों के जर्जनयम 6 में, उपजर्जनयम (1) म,ें -
(क) खडं (i) म,ें जनम्नजलजखत परंतुक अतं :स्ट्थाजपत दकया िाएगा, अथावत:् -
“परंतु सूक्ष्म उद्यम या लघु उद्यम के जर्र्ािों के समाधान के जलए आर्ेिक पच्चीस र्िव से कम की आयु का नहीं होगा।”
(ख) खडं (ii) म,ें जनम्नजलजखत परंतुक अंत:स्ट्थाजपत दकया िाएगा, अथावत् :-
“परंत ु सूक्ष्म उद्यम या लघ ुउद्यम के जर्र्ािों के समाधान के जलए पांच र्िव का अनुभर् आर्श्यक नहीं होगा।”

New Delhi, the 24th December, 2025
F. No. A-60011/3/2023-IIAC—In exercise of the powers conferred by clause (e) of sub-section (2) of
section 31 of the India International Arbitration Centre Act, 2019 (17 of 2019), the India International Arbitration
Centre, with the previous approval of the Central Government, hereby makes the following regulations further to
amend the India International Arbitration Centre (Criteria for Admission to the panel of arbitrators) Regulations, 2023,
namely: -
1. Short title and commencement. - (1) These regulations may be called the India International Arbitration Centre
(Criteria for Admission to the panel of arbitrators) Amendment Regulations, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the India International Arbitration Centre (Criteria for Admission to the panel of arbitrators) Regulations, 2023
(hereinafter referred to as the said regulations), in regulation 2, in sub-regulation (1), -
(i) after clause (e), the following clause shall be inserted, namely:-[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3
‘(ea) “micro enterprise” means the micro enterprise as defined under clause (h) of section 2 of the
Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006);
(ii) after clause (h), the following clause shall be inserted, namely:-
‘(i) “small enterprise” means the small enterprise as defined under clause (m) of section 2 of the
Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006);.
3. In the said regulations, in regulation 3, after sub-regulation (2), the following sub-regulation shall be inserted,
namely: -
“(3) The Registrar shall be the Member Secretary of the Chamber of Arbitration.”.
4. In the said regulations, in regulation 5, for sub-regulations (1) and (2), the following sub-regulations shall be
substituted, namely:-
“(1) Any person having expertise, experience and standing either in domestic arbitration or international
arbitration or both, may apply for empanelment as an arbitrator.
(2) An application for empanelment as an arbitrator shall preferably be made online on the website of the
Centre (www.indiaiac.org):
Provided that an application may be made in the Form, annexed to these regulations to the office of the
Registrar accompanied by a non-refundable fee of rupees ten thousand:
Provided further that an application for empanelment as an arbitrator for resolution of disputes of a micro
enterprise or a small enterprise shall be accompanied by a non-refundable fee of rupees two thousand and five
hundred.”.
5. In the said regulations, in regulation 6, in sub-regulation (1), -
(a) in clause (i), the following proviso shall be inserted, namely: -
“Provided that for resolution of disputes of a micro enterprise or a small enterprise, the applicant shall
not be less than twenty-five years of age.”.
(b) in clause (ii), the following proviso shall be inserted, namely: -
“Provided that the experience of five years shall not be necessary for resolution of disputes of a micro
enterprise or a small enterprise.”.
