L.-33004/99 सी.जी.-डब्लू.बी.-अ.-14112025-267687 xxxGIDHxxx CG-WB-E-14112025-267687 xxxGIDExxx असाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 736] नई दद्ली, िुक्रवार, नवम्ब र 14, 2025/कार्तका 23, 1947 No. 736] NEW DELHI, FRIDAY, NOVEMBER 14, 2025/KARTIKA 23, 1947 यूको बैंक (प्रधान कायाला य) अजधसचू ना कोलकाता, 13 नवंबर, 2025 फा. स.ं एचओपीएसडी/पिें न/2025-26/147(E).-—बैंककंग कंपनी (उपक्रमों का अजधग्रहण और अंतरण) अजधजनयम, 1970 (1970 का 5) की धारा 19 की उप-धारा (2) के खंड (एफ) द्वारा प्रदत्त िजियों का प्रयोग करते हुए, यूको बैंक के जनदेिक मंडल, भारतीय ररिव ाबैंक के परामिा से और केंद्र सरकार की जपछली मंिूरी के साथ, भारत सरकार, जवत्त मंत्रालय, जवत्तीय सेवा जवभाग, पत्र संख्या 4/2/1/2022-आईआर, ददनांक 13 माचा, 2024 के अनुसरण में दकए गए या दकए िाने से चूक गए कायों के संबंध में, 1 नवंबर, 2022 से और आजधकाररक रािपत्र में इस अजधसूचना के प्रकािन की तारीख तक, यूको बैंक (कमाचारी) पेंिन जवजनयम, 1995 में संिोधन और संिोजधत करने के जलए जनम्नजलजखत जवजनयम बनाता ह,ै अथाात्:-
1. (1) इन जवजनयमों को यूको बैंक (कमाचारी) पेंिन (संिोधन) जवजनयम, 2025 कहा िाएगा।
(2) य ेसरकारी रािपत्र में प्रकािन की जतजथ से लाग ूमाने िाएंगे।
2. यूको बैंक (कमाचारी) पेंिन जवजनयम, 1995 (जिसे इसके बाद उि जवजनयम कहा िाएगा) में, जवजनयम 2 में, खंड (डब्ल्यू) के पश्चात, जनम्नजलजखत खंड िोडा िाएगा, अथाात्:- “(डब्ल्यूए) 'त्यागपत्र देने वाले भूतपूवा कमाचारी' से तात्पया ऐसे कमाचारी से ह,ै िो – (क) 1 िनवरी, 1986 या उसके बाद बैंक की सेवा में थे;
7604 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) 1 अप्रैल, 2010 से पहले बैंक में पदभार ग्रहण दकए हों; (ग) 26 अप्रैल, 2010 को या उससे पहले बैंक की सेवा से त्यागपत्र दे ददया हो; और (घ) अन्यथा बैंक की सेवा में रहते हुए पेंिन योिना में िाजमल होने के जलए पात्र था;"।
3. उि जवजनयमों के जवजनयम 3 में, उप-जवजनयम (14) के पश्चात् जनम्नजलजखत को सजम्मजलत दकया िाएगा, अथाात्:- “(15) जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित त्यागपजत्रत भूतपूवा कमाचारी की पररभािा के अंतगात पात्र ह ैंऔर जिसने त्यागपत्र के समय या तत्पश्चात में बैंक से प्राप्त भजवष्य जनजध में बैंक के संपूणा अंिदान (उस पर संजचत ब्लयाि सजहत) को बैंक को वापस करने की सहमजत दी ह ैऔर जनधााररत समय के भीतर बैंक द्वारा जनधााररत प्रारूप के अनुसार वचनबद्धता दी ह।ै ”
4. उि जवजनयमों के जवजनयम 22 के, उप-जवजनयम (1) में, प्रावधान के पश्चात् जनम्नजलजखत प्रावधान सजम्मजलत दकया िाएगा, अथाात्:- “इसके अजतररि यह भी प्रावधान ह ैदक जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित त्यागपजत्रत भूतपूवा कमाचारी द्वारा ददए गए त्यागपत्र, तथा िो जवजनयम 3 के उप-जवजनयम (15) में जनजहत ितों के अनुरूप भी ह,ै जपछली सेवा की िब्लती नहीं करेगा।”
5. उि जवजनयमों के जवजनयम 29 में, -
(i) उप-जवजनयम (1) में, तीसरे प्रावधान के पश्चात् जनम्नजलजखत प्रावधान सजम्मजलत दकए िाएंगे, अथाात्:- “यह भी प्रावधान ह ैदक जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित और जवजनयम 3 के उप-जवजनयम (15) में जनर्दाष्ट ितों के अनुसार त्यागपजत्रत भूतपूवा कमाचारी भी पेंिन का हकदार होगा, बिते उसने आवश्यक योग्यता सेवा पूरी की हो।”
(ii) उप-जवजनयम (5) में, जनम्नजलजखत प्रावधान सजम्मजलत दकया िाएगा, अथाात्:- “बिते जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित त्यागपजत्रत भूतपूवा कमाचारी ऐसी योग्यता सेवा की वृजद्ध के लाभ के जलए पात्र नहीं होगा।”
6. उि जवजनयमों के जवजनयम 36 में, खंड (िी) के पश्चात् जनम्नजलजखत खंड िोडा िाएगा, अथाात्:- एक कमाचारी “(एच) अंिकाजलक कमाचारी को छोडकर, के संबंध में, िहां कमाचारी 1 नवंबर, 2022 को या उसके बाद सेवाजनवृत्त हुए हो, पांच हिार पचहत्तर रुपये प्रजत माह, िहां कमाचारी 1 नवंबर, 2022 को या उसके बाद सेवाजनवृत्त हुआ हो, 1/3 वेतनमान प्राप्त करने वाले अंिकाजलक कमाचारी के संबंध में एक हिार सात सौ रुपये प्रजत माह, ½ वेतनमान प्राप्त करने वाले अंिकाजलक कमाचारी के संबंध में दो हिार पांच सौ सैंतालीस रुपये प्रजत माह, और ¾ वेतनमान प्राप्त करने वाले अंिकाजलक कमाचारी के संबंध में तीन हिार आठ सौ बीस रुपये प्रजत माह, िहां अंिकाजलक कमाचारी 1 नवंबर, 2022 को या उसके बाद सेवाजनवृत्त हुआ हो।”
7. उि जवजनयमों के जवजनयम 39 के, उप-जवजनयम (1) में, खंड (सी) में, प्रावधान के पश्चात्, जनम्नजलजखत प्रावधान सजम्मजलत दकए िाएंग,े अथाात्:- “इसके अलावा, जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित दकए अनुसार, मृतक त्यागपजत्रत भूतपूवा कमाचारी का पररवार भी पाररवाररक पेंिन के जलए पात्र होगा, बिते मृतक त्यागपत्र देने वाले भूतपूवा कमाचारी ने जवजनयम 29 के उप-जवजनयम (1) के तहत बैंक में अपेजित योग्यता सेवा पूरी कर ली हो, बिते मृतक त्यागपजत्रत भूतपूवा कमाचारी (अपनी मृत्यु से पूव)ा या पररवार के सदस्ट्य ने बैंक से त्यागपत्र के समय या बाद में प्राप्त भजवष्य जनजध में बैंक के संपूणा अंिदान (उस पर संजचत ब्लयाि सजहत) को बैंक को वापस करने के जलए सहमजत दे दी हो और बैंक द्वारा जनधााररत समय सीमा में बैंक द्वारा प्रदान दकए गए मसौद ेके अनुसार एक वचनबद्धता दे दी हो।”
8. उि जवजनयमों के जवजनयम 40 के उप-जवजनयम (1) में,-
(i) खंड (बी) में, पहले प्रावधान के स्ट्थान पर जनम्नजलजखत प्रावधान प्रजतस्ट्थाजपत दकया िाएगा, अथाात्:- “बिते पुत्र या पुत्री (जवधवा या तलाकिुदा सजहत) को देय पाररवाररक पेंिन तब बंद कर दी िाएगी या स्ट्वीकाया नहीं होगी िब पात्र पुत्र या पुत्री सरकारी या जनिी िेत्र या स्ट्व-रोिगार आदद में रोिगार से अठारह हिार रुपये प्रजत माह से[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 अजधक की राजि अर्िात करना िुरू कर दे:”;
(ii) खंड (सी) के स्ट्थान पर जनम्नजलजखत खंड प्रजतस्ट्थाजपत दकया िाएगा, अथाात्:- (सी) माता-जपता के मामले में, पररवार पेंिन बंद कर दी िाएगी या स्ट्वीकाया नहीं होगी, यदद माता-जपता में से दकसी एक की आय या माता-जपता दोनों की सरकारी या जनिी िेत्र या स्ट्व-रोिगार आदद में रोिगार से कुल आय अठारह हिार रुपये प्रजत माह से अजधक है।
9. उि जवजनयमों के जवजनयम 41 के, उप-जवजनयम (1) में, प्रावधान के पश्चात् जनम्नजलजखत प्रावधान सजम्मजलत दकए िाएंगे, अथाात्:- “इसके अजतररि यह भी प्रावधान ह ैदक जवजनयम 2 के खंड (डब्ल्यूए) में पररभाजित त्यागपजत्रत भूतपूवा कमाचारी, िो जवजनयम 3 के उप-जवजनयम (15) में ितों के अनुरूप जनजहत ह,ै अपनी पेंिन के संरािीकरण के जलए पात्र नहीं होगा।”
10. उि जवजनयमों के जवजनयम 55 में, “अध्यि एव ं प्रबंध जनदेिक” िब्लदों के स्ट्थान पर, “प्रबंध जनदेिक एव ं मुख्य कायापालक अजधकारी” िब्लद प्रजतस्ट्थाजपत दकए िाएंगे।
11. उि जवजनयमों में, पररजिष्ट-II के स्ट्थान पर जनम्नजलजखत पररजिष्ट प्रजतस्ट्थाजपत दकए िाएंगे, अथाात्:- “पररजिष्ट-II (जवजनयम 37 देखें) मूल पेंिन पर महगं ाई राहत जनम्नानुसार होगी:
(1) उन कमाचाररयों के मामले में िो कमाचारी संवगा में थे और िो 1 िनवरी, 1986 को या उसके बाद, दकन्तु 1 नवम्बर, 1992 से पूव ासेवाजनवृत्त हुए थे और उन कमाचाररयों के मामले में िो अजधकारी संवगा में थे और िो 1 िनवरी, 1986 को या उसके बाद, दकन्तु 1 िुलाई, 1993 से पहले सेवाजनवृत्त हुए थे, उनके मामले में, औद्योजगक श्रजमकों हते ु अजखल भारतीय औसत उपभोिा मू्य सूचकांक 1960 = 100 श्रृंखला के अनुसार, त्रैमाजसक औसत पर 600 अंकों से अजधक प्रत्येक 4 अंकों की प्रत्येक वृजद्ध पर महगं ाई राहत देय होगी या प्रत्येक जगरावट पर वसूली योग्य होगी। उि प्रत्येक 4 अंकों के जलए महगं ाई राहत में ऐसी वृजद्ध या कमी की गणना जनम्नजलजखत ताजलका में दी गई प्रदक्रया से की िाएगी, अथाात्:- ताजलका क्र.स.ं प्रजत माह मलू पिें न का मलू पिें न के प्रजतित के रूप म ेंमहगं ाई राहत की दर वते नमान

2. ₹1251/- से ₹2000/- ₹1250/- का 0.67 प्रजतित और ₹1250/- से अजधक मूल पेंिन का 0.55 प्रजतित
3. ₹2001/- से ₹2130/- ₹1250/- का 0.67 प्रजतित, ₹2000/- और ₹1250/- के बीच के अंतर का 0.55 प्रजतित, 2000 रुपये से अजधक मूल पेंिन का 0.33 प्रजतित
4. ₹2130/- से ऊपर ₹1250/- का 0.67 प्रजतित, ₹2000/- और ₹1250/- के बीच का अंतर का 0.55 प्रजतित, ₹2130/- और ₹2000/- के बीच के अंतर का 0.33 प्रजतित, ₹2130/- से अजधक मूल पेंिन का 0.17 प्रजतित: बिते 1 अक्टूबर, 2023 से, औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक, 1960 = 100 श्रृंखला के त्रैमाजसक औसत के अनुसार, 600 अंक से अजधक प्रजत स्ट्लैब पर 0.67 प्रजतित की समान दर से महगं ाई राहत देय होगी:

(2) उन कमाचाररयों के मामले में िो कमाचारी संवगा में ह ैंऔर िो 1 नवम्बर, 1992 को या उसके बाद सेवाजनवृत्त हुए हैं तथा उन कमाचाररयों के मामले में िो अजधकारी संवगा में थ ेऔर िो 1 िुलाई, 1993 को या उसके बाद सेवाजनवृत्त हुए ह,ैं महगं ाई राहत, औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक 1960 = 100 श्रृंखला के त्रैमाजसक औसत के अनुसार, 1148 अंकों से अजधक प्रत्येक 4 अंकों की प्रत्येक वृजद्ध पर देय होगी या प्रत्येक जगरावट पर वसूली योग्य होगी। उि प्रत्येक 4 अंकों के जलए महंगाई राहत में ऐसी वृजद्ध या कमी की गणना जनम्नजलजखत ताजलका में दी गई रीजत से की िाएगी, अथाात्:- ताजलका क्र.स.ं प्रजत माह मलू पिें न का मलू पिें न के प्रजतित के रूप म ेंमहगं ाई राहत की दर वते नमान

3. ₹3851/- से ₹4100/- ₹2400/- का 0.35 प्रजतित, ₹3850/- और ₹2400/- के बीच के अंतर का 0.29 प्रजतित, ₹3850/- से अजधक मूल पेंिन का 0.17 प्रजतित
4. ₹4100/- से ऊपर ₹2400/- का 0.35 प्रजतित, ₹3850/- और ₹2400/- के बीच के अंतर का 0.29 प्रजतित, ₹4100/- और ₹3850/- के बीच के अंतर का 0.17 प्रजतित, ₹4100/- से अजधक मूल पेंिन का 0.09 प्रजतित: बिते 1 अक्टूबर, 2023 से, 1960=100 श्रृंखला में औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक के त्रैमाजसक औसत में 1148 अंकों से अजधक प्रजत स्ट्लैब 0.35 प्रजतित की एक समान दर से महगं ाई राहत देय होगी:

(4) 1 मई, 2005 को या उसके बाद सेवाजनवृत्त होने वाले कमाचाररयों के संबंध में, 1960=100 श्रृंखला में औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक के जतमाही औसत में 2288 अंकों से ऊपर प्रत्येक 4 अंकों की प्रत्येक वृजद्ध पर महगं ाई राहत देय होगी या प्रत्येक जगरावट पर वसूली योग्य होगी। उि प्रत्येक 4 अंकों के जलए महगं ाई राहत में ऐसी वृजद्ध या कमी मूल पेंिन के 0.18 प्रजतित की दर से पररकजलत की िाएगी:
बिते 1 मई, 2005 से, उन कमाचाररयों के संबंध में िो 1 नवंबर, 2002 को या उसके बाद लेदकन 30 अप्रैल, 2005 को या उससे पहले सेवाजनवृत्त हुए हों, इस खंड के अनुसार महगं ाई राहत देय होगी: बिते 1 नवंबर, 2007 को या उसके बाद सेवाजनवृत्त हुए कमाचाररयों के संबंध में, 1960=100 श्रृंखला में औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक के जतमाही औसत में 2836 अंकों से ऊपर प्रत्येक 4 अंकों की प्रत्येक वृजद्ध के जलए महंगाई राहत देय होगी या प्रत्येक जगरावट के जलए वसूली योग्य होगी। उि प्रत्येक 4 अंकों के जलए महगं ाई राहत में ऐसी वृजद्ध या कमी मूल पेंिन के 0.15 प्रजतित की दर से पररकजलत की िाएगी:
यह भी प्रावधान ह ैदक 1 नवंबर, 2012 को या उसके बाद सेवाजनवृत्त हुए कमाचाररयों के संबंध में, 1960=100 श्रृंखला में औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक के जतमाही औसत में 4440 अंकों से ऊपर प्रत्येक 4 अंकों की प्रत्येक वृजद्ध के जलए महंगाई राहत देय होगी या प्रत्येक जगरावट के जलए वसूली योग्य होगी। उि प्रत्येक 4 अंकों के जलए महगं ाई राहत में ऐसी वृजद्ध या कमी मूल पेंिन के 0.10 प्रजतित की दर से पररकजलत की िाएगी:
बिते 1 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त हुए कमाचाररयों के संबंध में, 1960=100 श्रृंखला में औद्योजगक श्रजमकों के जलए अजखल भारतीय औसत उपभोिा मू्य सूचकांक के जतमाही औसत में 6352 अंकों से ऊपर प्रत्येक 4 अंकों की प्रत्येक वृजद्ध के जलए महंगाई राहत देय होगी या प्रत्येक जगरावट के जलए वसूली योग्य होगी। उि प्रत्येक 4 अंकों के जलए महगं ाई राहत में ऐसी वृजद्ध या कमी मूल पेंिन के 0.07 प्रजतित की दर से गणना की िाएगी:
बिते 1 नवंबर, 2022 को या उसके बाद सेवाजनवृत्त होने वाले कमाचाररयों के संबंध में, औद्योजगक श्रजमकों के जलए अजखल भारतीय उपभोिा मू्य सूचकांक आधार 2016=100 के जतमाही औसत में 123.03 अंकों से अजधक की वृजद्ध या जगरावट के प्रत्येक पररवतान के जलए मूल पेंिन पर सूचकांक के प्रजत प्रजतित बबंद ुपर 1 प्रजतित की दर से महंगाई राहत देय होगी।
(5) महगं ाई राहत 1 फरवरी से िुरू होकर 31 िुलाई को समाप्त होने वाले आध े विा के जलए जपछले विा के अक्टूबर, नवंबर और ददसंबर महीनों के जलए प्रकाजित सूचकांक आंकडों के त्रैमाजसक औसत पर और 1 अगस्ट्त से िुरू होकर 31 िनवरी को समाप्त होने वाल ेआध ेवि ाके जलए उसी विा के अप्रैल, मई और िून महीनों के जलए प्रकाजित सूचकांक आंकडों के त्रैमाजसक औसत पर देय होगी।
(6) पाररवाररक पेंिन, अिि पेंिन और अनुकंपा भत्ते के मामले में, महगं ाई राहत ऊपर वर्णात दरों के अनुसार देय होगी।
(7) कम्युटेिन के बाद भी पूणा मूल पेंिन पर महगं ाई राहत की अनुमजत दी िाएगी।
(8) अजतररि पेंिन पर महगं ाई राहत देय नहीं ह.ै
(9) ऐसे पेंिनभोगी जिनकी मूल पेंिन न्यूनतम पेंिन से कम ह,ै दकन्त ु मूल पेंिन और अजतररि पेंिन का योग न्यूनतम पेंिन स े अजधक ह,ै उन्ह ेंन्यूनतम पेंिन पर लाग ूमहगं ाई राहत जमलेगी।
12. उि जवजनयमों म,ें पररजिष्ट-III के स्ट्थान पर जनम्नजलजखत पररजिष्ट प्रजतस्ट्थाजपत दकया िाएगा, अथाात्:— “पररजिष्ट-III (जवजनयम 39 देखें) 1 अप्रैल, 2021 से पाररवाररक पेंिन की सामान्य दरें जनम्नानुसार होंगी:
(क) अंिकाजलक कमाचाररयों के अलावा अन्य कमाचाररयों के संबंध में, िहां कमाचारी कमाकार संवगा में था और 1 नवम्बर, 1992 से पहले सेवाजनवृत्त हुआ था या िहां कमाचारी अजधकारी संवगा में था और 1 िुलाई, 1993 से पहले सेवाजनवृत्त हुआ था:-[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 क्र.स.ं प्रजत माह वते नमान माजसक पाररवाररक पिें न राजि

3. ₹3000/- से ऊपर अजतररि पाररवाररक पेंिन होगा: बिते मूल और अजतररि पाररवाररक पेंिन का कुल योग न्यूनतम ₹600/- प्रजत माह होगा। (ख) अंिकाजलक कमाचाररयों के अलावा अन्य कमाचाररयों के संबंध में, िहां कमाचारी कमाकार संवगा में था और 1 नवम्बर, 1992 को या उसके बाद सेवाजनवृत्त हुआ था या िहां कमाचारी अजधकारी संवग ामें था और 1 िुलाई, 1993 को या उसके बाद सेवाजनवृत्त हुआ था:- क्र.स.ं प्रजत माह वते नमान माजसक पाररवाररक पिें न राजि

NOTIFICATION Kolkata, the 13th November, 2025 F. No. HO/PSD/PEN/2025-26/147(E).—In exercise of the powers conferred by clause (f) of sub-section (2) of section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the UCO Bank, after consultation with the Reserve Bank of India and with the previous sanction of the Central Government, except as respects things done or omitted to be done in pursuance of the Government of India, Ministry of Finance, Department of Financial Services, letter number 4/2/1/2022-IR, dated the 13th March, 2024, on and from the 1st November, 2022 till the date of publication of this notification in the Official Gazette, hereby makes the following regulations further to amend the UCO Bank (Employees’) Pension Regulations, 1995, namely:–
1. (1) These regulations may be called the UCO Bank (Employees’) Pension (Amendment) Regulations, 2025.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the UCO Bank (Employees’) Pension Regulations, 1995 (hereinafter referred to as the said regulations), in regulation 2, after clause (w), the following clause shall be inserted, namely:– “(wa) ‘resigned former employee’ means an employee, who –
(a) was in the services of the Bank on or after the 1st January, 1986;
(b) joined the Bank before the 1st April, 2010;
(c) has resigned from the services of the Bank on or before the 26th April, 2010; and
(d) was otherwise eligible to join the pension scheme while in service of the Bank;”.
3. In regulation 3 of the said regulations, after sub-regulation (14), the following shall be inserted, namely:– “(15) qualifies the definition of resigned former employee defined in clause (wa) of regulation 2 and has agreed to refund to the Bank the entire Banks’ contribution to Provident Fund (along with accumulated interest thereon) received by him at the time of resignation or later, from the Bank and has given an undertaking as per the draft provided by the Bank within the time as stipulated by the Bank.”.
4. In regulation 22 of the said regulations, in sub-regulation (1), after the proviso, the following proviso shall be inserted, namely:–12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “Provided further that resignation by a resigned former employee defined in clause (wa) of regulation 2, and who also conforms to the conditions contained in sub-regulation (15) of regulation 3, shall not entail forfeiture of the past service.”.
5. In regulation 29 of the said regulations, –
(i) in sub-regulation (1), after the third proviso, the following proviso shall be inserted, namely:– “Provided also that a resigned former employee as defined in clause (wa) of regulation 2 and conforming to the conditions specified in sub-regulation (15) of regulation 3, shall also be entitled for pension provided he has completed such qualifying service.”;
(ii) in sub-regulation (5), the following proviso shall be inserted, namely: – “Provided that the resigned former employee defined in clause (wa) of regulation 2 shall not be eligible for the benefit of increase of such qualifying service.”.
6. In regulation 36 of the said regulations, after clause (g), the following clause shall be inserted, namely: – “(h) rupees five thousand and seventy-five per month in respect of an employee, other than a part- time employee, where the employee retired on or after the 1st November, 2022, rupees one thousand seven hundred per month in respect of a part-time employee drawing 1/3 scale of wages, rupees two thousand five hundred and forty seven per month in respect of part-time employee drawing ½ scale wages, and rupees three thousand eight hundred and twenty per month in respect of a part-time employee drawing ¾ scale wages, where the part-time employee retired on or after the 1st November, 2022.”.
7. In regulation 39 of the said regulations, in sub-regulation (1), in clause (c), after the proviso, the following proviso shall be inserted, namely: – “Provided further that family of a deceased resigned former employee as defined in clause (wa) of regulation 2 shall also be eligible for family pension provided that the deceased resigned former employee has completed required qualifying service in the Bank under sub-regulation (1) of regulation 29, subject to the condition that the deceased resigned former employee (before his death) or family member has agreed to refund to the Bank the entire Bank’s contribution to Provident Fund (along with accumulated interest thereon) received at the time of resignation or later, from the Bank and has given an undertaking as per the draft provided by the Bank within the time as stipulated by the Bank.”.
8. In regulation 40 of the said regulations, in sub-regulation (1),–
(i) in clause (b), for the first proviso, the following proviso shall be substituted, namely:– “Provided that the family pension payable to son or daughter (including widowed or divorced) shall be discontinued or not be admissible when the eligible son or daughter starts earning a sum in excess of rupees eighteen thousand per month from employment in Government or Private Sector or self– employment etc.:”;
(ii) for clause (c), the following clause shall be substituted, namely: – “(c) in the case of parents, the family pension shall be discontinued or not be admissible, if the income of one of the parents or the aggregate income of both the parents from employment in Government or Private Sector or self–employment, etc. exceeds rupees eighteen thousand per month.”.
9. In regulation 41 of the said regulations, in sub-regulation (1), after the proviso, the following proviso shall be inserted, namely:– “Provided further that a resigned former employee as defined in clause (wa) of regulation 2 and who conforms to conditions contained in sub-regulation (15) of regulation 3, shall not be eligible for commutation of his pension.”.
10. In regulation 55 of the said regulations, for the words “The Chairman and Managing Director”, the words “The Managing Director and Chief Executive Officer” shall be substituted.
11. In the said regulations, for Appendix – II, the following Appendix shall be substituted, namely:– “Appendix-II (See regulation 37)
Dearness relief on basic pension shall be as under:
(1) In the case of employees who were in the workmen cadre and who retired on or after the 1st January, 1986, but before the 1st November, 1992, and in the case of employees, who were in the officers’ cadre and who retired on or after the 1st January, 1986, but before the 1st July, 1993, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 600 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960 = 100. Provided further that in respect of employees who retired on or after the 1st November, 2007, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2836 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.15 per cent. of basic pension:
Provided also that in respect of employees who retired on or after the 1st November, 2012, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 4440 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.10 per cent. of basic pension:
Provided also that in respect of employees who retired on or after the 1st November, 2017, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 6352 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.07 per cent. of basic pension:
Provided also that in respect of employees who retired on or after the 1st November, 2022, dearness relief shall be payable at 1 per cent. per percentage point of Index on the Basic pension for every variation of rise or fall over 123.03 points in the quarterly average of the All India Consumer Price Index for Industrial Workers Base 2016=100.
(5) Dearness relief shall be payable for the half year commencing from the 1st February and ending with the 31st July on the quarterly average of the index figures published for the months of October, November and December of the previous year and for the half year commencing from the 1st August and ending with the 31st January on the quarterly average of the index figures published for the months of April, May and June of the same year.
(6) In the case of family pension, invalid pension and compassionate allowance, dearness relief shall be payable in accordance with the rates mentioned above.

(8) Dearness relief is not payable on additional pension.
(9) Pensioner whose basic pension is less than minimum pension but the aggregate of basic pension and additional pension is more than the minimum pension shall draw dearness relief as applicable to minimum pension.”.
12. In the said regulations, for Appendix-III, the following Appendix shall be substituted, namely: — “Appendix-III (See regulation 39) On and from the 1st April, 2021, the ordinary rates of family pension shall be as under:

3. Above Rs. 8420 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension:

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs. 2292/- per month:
Provided that on and from the 1st May, 2005, in respect of employees who retired on or after the 1st November, 2002 but on or before the 30th April, 2005, ordinary rates of family pension shall be in terms of this clause.

3. Above 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowance, which are counted for making contribution to provident fund but not Rs. 40,440 for dearness allowance, shall be the additional family pension:
Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs. 8105 per month.”.

EXPLANATORY MEMORANDUM These regulations which have been given retrospective effect are as per the agreed terms and conditions of the settlements and Joint Notes signed between the Indian Banks’ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level workmen Unions and Officers’ Associations of the banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
