(1) इन धर्धनयम ंइंधडयन बैंक (कमजर्ारी) पेंशन (संश िन) धर्धनयम, 2024 कहा र्ा सके गा।

(2) यह सरकारी रार्पत्र में अपने प्रकाशन की तारीख से प्रर्ृत्त ह गं े। 7191 GI/2025 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] इंधडयन बैंक (कमजर्ारी) पेंशन धर्धनयम, 1995 (इसके बाद उि धर्धनयम ंके रूप में संदधभजत) में, धर्धनयम 2 में, खंड (डब्लू) के पश्चात्, धनम्नधलक्तखत खंड प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्:

“(डब्ल्यूए) ‘त्यागपत्र देनेर्ाला भूतपूर्ज कमजर्ारी’ से तात्पयज ऐसे कमजर्ारी से है, र् - (ए) 1 र्नर्री, 1986 क या उसके बाद बैंक की सेर्ाओ ंमें र्ा; (ख) 1 अप्रैल, 2010 से पहले बैंक में कायजग्रहण धकया र्ा;

(सी) 26 अप्रैल, 2010 क या उससे पहले बैंक की सेर्ाओ ंसे त्यागपत्र दे धदया र्ा; और (डी) बैंक की सेर्ा में रहते हुए पेंशन य र्ना में शाधमल ह ने के धलए अन्यर्ा पात्र र्ा;"।

1. "उि धर्धनयम ं के धर्धनयम 3 में, उप-धर्धनयम (14) के पश्चात्, धनम्नधलक्तखत प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्: -" “(15) धर्धनयम 2 के खंड (डब्लूए) में पररभाधित त्यागपत्र देनेर्ाला भूतपूर्ज कमजर्ारी की पररभािा क पूरा करता है और बैंक क त्यागपत्र के समय या बाद में बैंक से प्राप्त भधर्ष्य धनधि (उस पर अधर्जत ब्यार् सधहत) में बैंक का पूरा य गदान र्ापस करने के धलए सहमत ह गया है तर्ा बैंक द्वारा धनिाजररत समय के भीतर बैंक द्वारा प्रदान धकए गए प्ररूप के अनुसार एक र्र्नपत्र प्रस्तुत धकया है।"

2. “उि धर्धनयम ं के धर्धनयम 22 में, उप-धर्धनयम (1) में, परंतुक के पश्चात्, धनम्नधलक्तखत परंतुक प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्: –" “बशते धक धर्धनयम 2 के खंड (डब्लूए) में पररभाधित त्यागपत्र देनेर्ाले धकसी भूतपूर्ज कमजर्ारी और र् धर्धनयम 3 के उप-धर्धनयम (15) में धनधहत शतों का अनुपालन करने का र्र्न देता है, उसका त्यागपत्र धपछली सेर्ा की र्ब्ती क अधनर्ायज नही ंकरेगा।"

3. "उि धर्धनयम ंके धर्धनयम 29 में, –

(i) "उप-धर्धनयम (1) में, तीसरे परंतुक के बाद, धनम्नधलक्तखत परंतुक प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्: –" "बशते यह भी धक धर्धनयम 2 के खंड (डब्लूए) में पररभाधित और धर्धनयम 3 के उप-धर्धनयम (15) में धर्धनधदजष्ट शतों के अनुरूप त्यागपत्र देनेर्ाला भूतपूर्ज कमजर्ारी भी पेंशन का हकदार ह गा, बशते धक उन् नं े ऐसी अहजक सेर्ा पूरी कर ली ह ।"

(ii) उप-धर्धनयम (5) में, धनम्नधलक्तखत परंतुक प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्: – "बशते धक धर्धनयम 2 के खंड (डब्लूए) में पररभाधित त्यागपत्र देनेर्ाला भूतपूर्ज कमजर्ारी ऐसी अहजक सेर्ा की र्ृक्ति के लाभ के धलए पात्र नही ंह गा।"

4. "उि धर्धनयम ंके धर्धनयम 36 में, खंड (र्ी) के पश्चात्, धनम्नधलक्तखत खंड प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्:–" “(एर्) ऐसे कमजर्ारी, अंशकाधलक कमजर्ारी क छ डकर, र् 1 नर्ंबर, 2022 क या उसके बाद सेर्ाधनर्ृत्त हुआ ह , के संबंि में प्रधत माह रुपए पांर् हर्ार पर्हत्तर, र्हां अंशकाधलक कमजर्ारी 1 नर्ंबर, 2022 क या उसके बाद सेर्ाधनर्ृत्त हुआ ह , र्हााँ 1/3 र्ेतनमान आहरण कर रहे अंशकाधलक कमजर्ारी के संबंि में प्रधत माह रुपए एक हर्ार सात सौ, 1/2 र्ेतनमान आहरण कर रहे ऐसे[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 अंशकाधलक कमजर्ारी के संबंि प्रधत माह रुपए द हर्ार पााँर् सौ सैंतालीस, और 3/4 र्ेतनमान आहरण कर रहे ऐसे अंशकाधलक कमजर्ारी के संबंि में प्रधत माह रुपए तीन हर्ार आठ सौ बीस। "

5. "उि धर्धनयम ं के धर्धनयम 39 के उप-धर्धनयम (1) के खंड (सी) में, परंतुक के पश्चात्, धनम्नधलक्तखत परंतुक प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्: –" “बशते यह भी धक धर्धनयम 2 के खंड (डब्लूए) में पररभाधित धदर्ंगत त्यागपत्र देनेर्ाला भूतपूर्ज कमजर्ारी का पररर्ार भी पाररर्ाररक पेंशन के धलए पात्र ह गा, बशते धक धदर्ंगत त्यागपत्र देनेर्ाले भूतपूर्ज कमजर्ारी ने धर्धनयम 29 के उप-धर्धनयम (1) के तहत बैंक में अपेधित अहजक सेर्ा पूरी कर ली ह , इस शतज के अध्यिीन धक धदर्ंगत त्यागपत्र देनेर्ाले भूतपूर्ज कमजर्ारी (अपनी मृत्यु से पहले) या पररर्ार के सदस्य ने बैंक क त्यागपत्र के समय या बाद में बैंक से प्राप्त भधर्ष्य धनधि (उस पर अधर्जत ब्यार् सधहत) में बैंक का पूरा य गदान र्ापस करने के धलए सहमधत दे दी है और बैंक द्वारा धनिाजररत समय के भीतर बैंक द्वारा प्रदान धकए गए प्ररूप के अनुसार एक र्र्नपत्र धदया है।"

6. "उि धर्धनयम ंके धर्धनयम 40 में, उप-धर्धनयम (1) में, –"

(i) खंड (ख) में, पहले परंतुक के स्र्ान पर, धनम्नधलक्तखत परंतुक प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्:– “बशते धक र्ब पात्र पुत्र या पुत्री सरकारी या धनर्ी िेत्र में र र्गार या स्व-र ज़गार आधद से प्रधत माह अठारह हर्ार रुपये से अधिक की राधश अधर्जत करना शुरू कर दे, त पुत्र या पुत्री (धर्समें धर्िर्ा या तलाकशुदा शाधमल हैं) क देय पाररर्ाररक पेंशन तब बंद कर दी र्ाएगी या देय नही ंह गी,;”

(ii) "खंड (सी) हेतु, धनम्नधलक्तखत खंड प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्:–" "(सी) माता-धपता के मामले में, यधद धकसी एक अधभभार्क की आय या द न ं अधभभार्क ं की कु ल आय, सरकारी या धनर्ी िेत्र में र र्गार या स्व-र ज़गार आधद से प्रधत माह अठारह हर्ार रुपये से अधिक ह र्ाती है, त पाररर्ाररक पेंशन बंद कर दी र्ाएगी या देय नही ंह गी,

7. "उि धर्धनयम ं के धर्धनयम 41 में, उप-धर्धनयम (1) में, परंतुक के पश्चात,् धनम्नधलक्तखत परंतुक अंतःस्र्ाधपत धकया र्ाएगा, अर्ाजत्:–" "बशते यह भी धक धर्धनयम 2 के खंड (डब्लूए) में पररभाधित और धर्धनयम 3 के उप-धर्धनयम

(15) में धनधहत शतों के अनुरूप त्यागपत्र देनेर्ाला भूतपूर्ज कमजर्ारी अपनी पेंशन के संराधशकरण के धलए पात्र नही ंह गा।"

8. "उि धर्धनयम ं के धर्धनयम 55 में, “अध्यि और प्रबंि धनदेशक” शब् ं के स्र्ान पर, “प्रबंि धनदेशक एर्ं मुख्य कायजपालक अधिकारी” शब् प्रधतस्र्ाधपत धकए र्ाएंगे।"

9. "उि धर्धनयम ंमें, पररधशष्ट – II के स्र्ान पर, धनम्नधलक्तखत पररधशष्ट प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्:–"4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] “पररधशष्ट – II (धर्धनयम 37 देखें) "मूल पेंशन पर महंगाई राहत धनम्नानुसार ह गी:"

(1) उन कमजर्ाररय ं के मामले में र् कमजकार संर्गज में र्े और र् 1 र्नर्री, 1986 क या उसके बाद, लेधकन 1 नर्ंबर, 1992 से पहले सेर्ाधनर्ृत्त हुए, और उन कमजर्ाररय ं के मामले में, र् अधिकारी संर्गज में र्े और र् 1 र्नर्री, 1986 क या उसके बाद, लेधकन 1 र्ुलाई, 1993 से पहले सेर्ाधनर्ृत्त हुए, महंगाई राहत 1960=100 श्ृंखला में औद्य धगक श्धमक ं के धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक के धतमाही औसत में 600 धबंदुओ ं से अधिक प्रत्येक 4 अंक ं की र्ृक्ति के धलए देय ह गी या, र्ैसा भी मामला ह , हर 4 अंक ं की धगरार्ट के धलए र्ापस ली र्ा सके गी। उि प्रत्येक 4 अंक ं के धलए महंगाई राहत में ऐसी र्ृक्ति या कमी की गणना धनम्नधलक्तखत ताधलका में दी गई प्रधक्रयाधर्धि से की र्ाएगी, अर्ाजत्:–

3. रु. 2001 से रु. 2130 रु. 1250 का 0.67 प्रधतशत प्लस रु. 2000 और रु. 1250 के बीर् के तक अंतर का 0.55 प्रधतशत प्लस रु. 2000 से अधिक की मूल पेंशन का

0.33 प्रधतशत

4. रु. 2130 से अधिक रु. 1250 का 0.67 प्रधतशत प्लस रु. 2000 और रु. 1250 के बीर् के अंतर का 0.55 प्रधतशत प्लस रु. 2130 और रु. 2000 के बीर् के अंतर का 0.33 प्रधतशत और रु. 2130 से अधिक की मूल पेंशन का

0.17 प्रधतशत। बशते धक 1 अक्टूबर, 2023 क या उसके बाद, महंगाई राहत 1960 = 100 की शंखला में औद्य धगक श्धमक ं के धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक' में 600 अंक ं से ऊपर प्रत्येक स्लैब पर 0.67 प्रधतशत की एक समान दर पर देय ह गी। बशते धक 1 अक्टूबर, 2023 क या उसके बाद, ऊपर दी गई ताधलका में दी गई महंगाई राहत के अधतररि, नीर्े दी गई ताधलका में धनधदजष्ट अनुग्रह राधश भी देय ह गी। ताधलका क्र. सं. मूल पेंशन अनुग्रह राधश

(3) उन कमजर्ाररय ं के मामले में र् कामगार संर्गज में हैं और र् 1 नर्ंबर, 1992 क या उसके बाद सेर्ाधनर्ृत्त हुए हैं , और उन कमजर्ाररय ं के मामले में र् अधिकारी संर्गज में हैं और र् 1 र्ुलाई, 1993[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 क या उसके बाद सेर्ाधनर्ृत्त हुए हैं , महंगाई राहत, 1960 = 100 श्ृंखला में औद्य धगक श्धमक ंके धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक के धतमाही औसत में 1148 अंक ं से अधिक प्रत्येक 4 अंक ं की प्रत्येक र्ृक्ति के धलए देय ह गी या प्रत्येक धगरार्ट के धलए र्सूली य ग्य ह गी। प्रत्येक उि 4 अंक ं के धलए महंगाई राहत में ऐसी र्ृक्ति या कमी की गणना धनम्नधलक्तखत ताधलका में प्रदान की गई प्रधक्रयाधर्धि से की र्ाएगी, अर्ाजत:- ि़ातलक़ा क्र.सं. प्रधत माह मूल पेंशन मूल पेंशन के प्रधतशत के रुप में महंगाई राहत की दर र्ेतनमान

4. रु. 4100 से अधिक रु. 2400 का 0.35 प्रधतशत प्लस रु. 3850 और रु. 2400 के बीर् के अंतर का 0.29 प्रधतशत प्लस रु. 4100 और रु. 3850 के बीर् के अंतर का 0.17 प्रधतशत प्लस रु. 4100 से अधिक मूल पेंशन का 0.09 प्रधतशत:

बशते धक 1 अक्टूबर, 2023 क या उसके बाद, महंगाई राहत 1960 = 100 की शंखला में औद्य धगक श्धमक ं के धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक' में 1148 अंक ं से ऊपर प्रत्येक स्लैब पर 0.35 प्रधतशत की एक समान दर पर देय ह गी। बशते धक 1 अक्टूबर, 2023 क या उसके बाद, ऊपर दी गई ताधलका में दी गई महंगाई राहत के अधतररि, नीर्े दी गई ताधलका में धनधदजष्ट अनुग्रह राधश भी देय ह गी। ि़ातलक़ा क्र. सं. मूल पेंशन अनुग्रह राधश

0.06 प्रधतशत: बशते धक 1 मई, 2005 क या उसके बाद, उन कमजर्ाररय ं के मामले में, र् 1 अप्रैल, 1998 क या उसके बाद लेधकन 31 अक्टूबर, 2002 क या उससे पहले सेर्ाधनर्ृत्त हुए हैं, महंगाई राहत 1960=100 श्ृंखला में औद्य धगक श्धमक ं के धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक के धतमाही औसत में 1684 अंक ं से ऊपर प्रत्येक र्ृक्ति के धलए महंगाई राहत देय ह गी या प्रत्येक धगरार्ट के धलए र्सूली य ग्य ह गी। महंगाई राहत में उि प्रत्येक 4 अंक ं की र्ृक्ति या कमी की गणना धनम्नधलक्तखत ताधलका में धदए गए प्रधक्रयाधर्धि से की र्ाएगी, अर्ाजत्:– ि़ातलक़ा क्र.सं. प्रधत माह मूल पेंशन मूल पेंशन के प्रधतशत के रुप में महंगाई राहत की दर र्ेतनमान

4. रु. 6010 से अधिक रु. 3550 का 0.24 प्रधतशत प्लस रु. 5650 और रु. 3550 के बीर् के अंतर का 0.20 प्रधतशत प्लस रु. 6010 और रु.

(5) उन कमजर्ाररय ं के संबंि में र् 1 मई, 2005 क या उसके बाद सेर्ाधनर्ृत्त हुए है, महंगाई राहत 1960=100 की श्ृंखला में औद्य धगक श्धमक ं के धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक के धतमाही औसत में 2288 अंक ं से ऊपर प्रत्येक 4 अंक ं की प्रत्येक र्ृक्ति के धलए महंगाई राहत देय ह गी या प्रत्येक धगरार्ट के धलए र्सूली य ग्य ह गी। उि प्रत्येक 4 अंक ं के धलए महंगाई राहत में ऐसी र्ृक्ति या कमी की गणना मूल पेंशन के 0.18 प्रधतशत की दर से की र्ाएगी:

बशते धक 1 मई, 2005 क या उसके बाद, उन कमजर्ाररय ंके संबंि में र् 1 नर्ंबर, 2002 क या उसके बाद लेधकन 30 अप्रैल, 2005 क या उससे पहले सेर्ाधनर्ृत्त हुए हैं, महंगाई राहत इस खंड के अनुसार देय ह गी।" बशते धक 1 नर्ंबर, 2007 क या उसके बाद सेर्ाधनर्ृत्त हुए कमजर्ाररय ं के संबंि में, 1960=100 श्ृंखला में औद्य धगक श्धमक ं के धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक के धतमाही औसत में 2836 अंक ं से ऊपर प्रत्येक 4 अंक ं की प्रत्येक र्ृक्ति के धलए महंगाई राहत देय ह गी या प्रत्येक धगरार्ट के धलए र्सूली य ग्य ह गी। उि प्रत्येक 4 अंक ं के धलए महंगाई राहत में ऐसी र्ृक्ति या कमी की गणना मूल पेंशन के 0.15 प्रधतशत की दर से की र्ाएगी:

बशते यह भी धक 1 नर्ंबर, 2012 क या उसके बाद सेर्ाधनर्ृत्त हुए कमजर्ाररय ं के संबंि में, 1960=100 श्ृंखला में औद्य धगक श्धमक ं के धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक के धतमाही औसत में 4440 अंक ं से ऊपर प्रत्येक 4 अंक ं की प्रत्येक र्ृक्ति के धलए महंगाई राहत देय ह गी या प्रत्येक धगरार्ट के धलए र्सूली य ग्य ह गी। उि प्रत्येक 4 अंक ं के धलए महंगाई राहत में ऐसी र्ृक्ति या कमी की गणना मूल पेंशन के 0.10 प्रधतशत की दर से की र्ाएगी::

बशते यह भी धक 1 नर्ंबर, 2017 क या उसके बाद सेर्ाधनर्ृत्त हुए कमजर्ाररय ं के संबंि में, 1960=100 श्ृंखला में औद्य धगक श्धमक ंके धलए अक्तखल भारतीय औसत उपभ िा मूल्य सूर्कांक के धतमाही औसत में 6352 अंक ं से ऊपर प्रत्येक 4 अंक ं की प्रत्येक र्ृक्ति के धलए महंगाई राहत देय ह गी या प्रत्येक धगरार्ट के धलए र्सूली य ग्य ह गी। उि प्रत्येक 4 अंक ं के धलए महंगाई राहत में ऐसी र्ृक्ति या कमी की गणना मूल पेंशन के 0.07 प्रधतशत की दर से की र्ाएगी:8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] बशते यह भी धक 1 नर्ंबर, 2022 क या उसके बाद सेर्ाधनर्ृत्त ह ने र्ाले कमजर्ाररय ं के संबंि में, औद्य धगक श्धमक ं के धलए अक्तखल भारतीय उपभ िा मूल्य सूर्कांक आिार 2016=100 के धतमाही औसत में 123.03 अंक ं से अधिक की र्ृक्ति या धगरार्ट के प्रत्येक पररर्तजन के धलए मूल पेंशन पर सूर्कांक के प्रधत प्रधतशत धबंदु पर 1 प्रधतशत की दर से महंगाई राहत देय ह गी।

(6) महंगाई राहत 1 फरर्री से शुरू ह कर 31 र्ुलाई क समाप्त ह ने र्ाली छमाही के धलए धपछले र्िज के अक्टूबर, नर्ंबर और धदसंबर महीन ं के धलए प्रकाधशत सूर्कांक आंकड ं के धतमाही औसत पर और 1 अगस्त से शुरू ह कर 31 र्नर्री क समाप्त ह ने र्ाली छमाही के धलए उसी र्िज के अप्रैल, मई और र्ून महीन ंके धलए प्रकाधशत सूर्कांक आंकड ंके धतमाही औसत पर देय ह गी

(7) पाररर्ाररक पेंशन, अमान्य पेंशन और अनुकं पा भत्ता के मामले में,महंगाई राहत ऊपर र्धणजत दर ं के अनुसार देय ह गी।

(8) संराशीकरण के बाद भी पूणज मूल पेंशन पर महंगाई राहत की अनुमधत दी र्ाएगी।

(9) अधतररि पेंशन पर महंगाई राहत देय नही ंहै।

(10) धर्स पेंशनभ गी की मूल पेंशन न्यूनतम पेंशन से कम है, लेधकन मूल पेंशन और अधतररि पेंशन का कु ल य ग न्यूनतम पेंशन से अधिक है, उन्ें न्यूनतम पेंशन पर लागू महंगाई राहत धमलेगी।

10. उि धर्धनयम ंमें, पररधशष्ट-III के स्र्ान पर, धनम्नधलक्तखत पररधशष्ट प्रधतस्र्ाधपत धकया र्ाएगा, अर्ाजत्:–" “पररधशष्ट-III (धर्धनयम 39 देखें) 1 अप्रैल, 2021 से पाररर्ाररक पेंशन की सामान्य दरें धनम्नानुसार ह गं ी:

(ए) अंशकाधलक कमजर्ाररय ं के अलार्ा अन्य कमजर्ाररय ं के संबंि में, र्हां कमजर्ारी कमजकार संर्गज में र्ा और 1 नर्म्बर, 1992 से पहले सेर्ाधनर्ृत्त हुआ र्ा या र्हां कमजर्ारी अधिकारी संर्गज में र्ा और 1 र्ुलाई, 1993 से पहले सेर्ाधनर्ृत्त हुआ र्ा:- क्र. र्ेतनमान प्रधत माह माधसक पाररर्ाररक पेंशन की राधश सं.

(1) (2) (3) र्ेतन का 30 प्रधतशत मूल पाररर्ाररक पेंशन ह गा और भत्त ं का अधतररि 30 प्रधतशत, धर्नकी गणना भधर्ष्य धनधि में अंशदान के धलए की र्ाती है

1. रु. 1500 तक लेधकन महंगाई भत्ते के धलए नही,ं अधतररि पाररर्ाररक पेंशन ह गा। बशते धक मूल और अधतररि पाररर्ाररक पेंशन का कु ल य ग न्यूनतम प्रधत माह रु. 375 के अध्यिीन ह गा। र्ेतन का 30 प्रधतशत मूल पाररर्ाररक पेंशन ह गा और भत्त ं का अधतररि 30 प्रधतशत, धर्नकी गणना भधर्ष्य धनधि में अंशदान के धलए की र्ाती है रु. 1501 से

1. रु. 2870 तक लेधकन महंगाई भत्ते के धलए नही,ं अधतररि पाररर्ाररक पेंशन ह गा। बशते धक मूल और अधतररि पाररर्ाररक पेंशन का कु ल य ग न्यूनतम प्रधत माह रु. 720 के अध्यिीन ह गा। र्ेतन का 30 प्रधतशत मूल पाररर्ाररक पेंशन ह गा और भत्त ंका अधतररि 30 प्रधतशत, धर्नकी गणना भधर्ष्य धनधि में अंशदान के धलए की र्ाती है

2. रु. 2871 से रु.5740 लेधकन महंगाई भत्ते के धलए नही,ं अधतररि पाररर्ाररक पेंशन ह गा। बशते धक मूल और अधतररि पाररर्ाररक पेंशन का कु ल य ग न्यूनतम प्रधत माह रु. 860 के अध्यिीन ह गा। र्ेतन का 30 प्रधतशत मूल पाररर्ाररक पेंशन ह गा और भत्त ंका अधतररि 30 प्रधतशत, धर्नकी गणना भधर्ष्य धनधि में अंशदान के धलए की र्ाती है

3. रु. 5740 से ऊपर लेधकन महंगाई भत्ते के धलए नही,ं अधतररि पाररर्ाररक पेंशन ह गा। बशते धक मूल और अधतररि पाररर्ाररक पेंशन का कु ल य ग न्यूनतम प्रधत माह रु. 1150 के अध्यिीन ह गा। (सी) 1 अप्रैल, 1998 क या उसके बाद सेर्ाधनर्ृत्त ह ने र्ाले अंशकाधलक कमजर्ाररय ंके अलार्ा अन्य कमजर्ाररय ं(अधिकाररय ंऔर कामगार ंद न )ं के संबंि में:- क्र. सं. र्ेतनमान प्रधत माह माधसक पाररर्ाररक पेंशन की राधश

1. रु. 4040 तक लेधकन महंगाई भत्ते के धलए नही,ं अधतररि पाररर्ाररक पेंशन ह गा। बशते धक मूल और अधतररि पाररर्ाररक पेंशन का कु ल य ग न्यूनतम प्रधत माह रु. 1015 के अध्यिीन ह गा। र्ेतन का 30 प्रधतशत मूल पाररर्ाररक पेंशन ह गा और भत्त ंका अधतररि 30 प्रधतशत, धर्नकी गणना भधर्ष्य धनधि में अंशदान के धलए की र्ाती है

2. रु. 4211 से रु. 8420 र्ेतन का 30 प्रधतशत मूल पाररर्ाररक पेंशन ह गा और भत्त ंका अधतररि 30 प्रधतशत, धर्नकी गणना भधर्ष्य धनधि में अंशदान के धलए की र्ाती है लेधकन महंगाई भत्ते के धलए नही,ं अधतररि पाररर्ाररक पेंशन ह गा। बशते धक मूल और अधतररि पाररर्ाररक पेंशन का कु ल य ग न्यूनतम प्रधत माह रु. 1262 के अध्यिीन ह गा।

3. रु. 11,440 से अधिक र्ेतन का 30 प्रधतशत मूल पाररर्ाररक पेंशन ह गा और भत्त ं का अधतररि 30 प्रधतशत, धर्नकी गणना भधर्ष्य धनधि में अंशदान के धलए की र्ाती है लेधकन महंगाई भत्ते के धलए नही,ं अधतररि पाररर्ाररक पेंशन ह गा। बशते धक मूल और अधतररि पाररर्ाररक पेंशन का कु ल य ग न्यूनतम प्रधत माह रु. 2292 के अध्यिीन ह गा। बशते धक 1 मई, 2005 से, उन कमजर्ाररय ं के संबंि में र् 1 नर्म्बर, 2002 क या उसके बाद परन्तु 30 अप्रैल, 2005 क या उससे पहले सेर्ाधनर्ृत्त हुए ह ,ं पाररर्ाररक पेंशन की सामान्य दरें इस खंड के अनुसार ह गं ी। (ई) 1 नर्ंबर, 2007 क या उसके बाद सेर्ाधनर्ृत्त ह ने र्ाले अंशकाधलक कमजर्ाररय ं के अलार्ा अन्य कमजर्ाररय ं(अधिकाररय ंऔर कामगार ंद न )ं के संबंि में:- क्र. सं. र्ेतनमान प्रधत माह माधसक पाररर्ाररक पेंशन की राधश

2. रु. 11,101 से र्ेतन का 30 प्रधतशत मूल पाररर्ाररक पेंशन ह गा और भत्त ं का अधतररि 30 प्रधतशत, धर्नकी गणना भधर्ष्य धनधि में अंशदान के धलए की र्ाती है लेधकन महंगाई भत्ते के धलए नही,ं अधतररि पाररर्ाररक पेंशन ह गा। बशते धक मूल और अधतररि कु टुंब पेंशन का कु ल य ग न्यूनतम प्रधत माह रु. 3422 के अध्यिीन ह गा।

NOTIFICATION Chennai, the 14th October, 2025 F. No. Pen/01/2025(E).— In exercise of the powers conferred by clause (f) of sub-section (2) of section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the Indian Bank, after consultation with the Reserve Bank of India and with the previous sanction of the Central Government, except as respects things done or omitted to be done in pursuance of the Government of India, Ministry of Finance, Department of Financial Services, letter number 4/2/1/2022-IR, dated the 13th March, 2024, on and from the 1st November, 2022 till the date of publication of this notification in the Official Gazette, hereby makes the following regulations further to amend the Indian Bank (Employees’) Pension Regulations, 1995, namely:–

1. (1) These regulations may be called the Indian Bank (Employees’) Pension (Amendment) Regulations, 2025.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Indian Bank (Employees’) Pension Regulations, 1995 (hereinafter referred to as the said regulations), in regulation 2, after clause (w), the following clause shall be inserted, namely:– “(wa) ‘resigned former employee’ means an employee, who –

(a) was in the services of the Bank on or after the 1st January, 1986;

(b) joined the Bank before the 1st April, 2010;

(c) has resigned from the services of the Bank on or before the 26th April, 2010; and

(d) was otherwise eligible to join the pension scheme while in service of the Bank;”.

3. In regulation 3 of the said regulations, after sub-regulation (14), the following shall be inserted, namely:– “(15) qualifies the definition of resigned former employee defined in clause (wa) of regulation 2 and has agreed to refund to the Bank the entire Banks’ contribution to Provident Fund (along with accumulated interest thereon) received by him at the time of resignation or later, from the Bank and has given an undertaking as per the draft provided by the Bank within the time as stipulated by the Bank.”.

4. In regulation 22 of the said regulations, in sub-regulation (1), after the proviso, the following proviso shall be inserted, namely:– “Provided further that resignation by a resigned former employee defined in clause (wa) of regulation 2, and who also conforms to the conditions contained in sub-regulation (15) of regulation 3, shall not entail forfeiture of the past service.”.

5. In regulation 29 of the said regulations, –

(i) in sub-regulation (1), after the third proviso, the following proviso shall be inserted, namely:– “Provided also that a resigned former employee as defined in clause (wa) of regulation 2 and conforming to the conditions specified in sub-regulation (15) of regulation 3, shall also be entitled for pension provided he has completed such qualifying service.”;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 15

(ii) in sub-regulation (5), the following proviso shall be inserted, namely: – “Provided that the resigned former employee defined in clause (wa) of regulation 2 shall not be eligible for the benefit of increase of such qualifying service.”.

6. In regulation 36 of the said regulations, after clause (g), the following clause shall be inserted, namely: – “(h) rupees five thousand and seventy-five per month in respect of an employee, other than a part- time employee, where the employee retired on or after the 1st November, 2022, rupees one thousand seven hundred per month in respect of a part-time employee drawing 1/3 scale of wages, rupees two thousand five hundred and forty seven per month in respect of part-time employee drawing ½ scale wages, and rupees three thousand eight hundred and twenty per month in respect of a part-time employee drawing ¾ scale wages, where the part-time employee retired on or after the 1st November, 2022.”.

7. In regulation 39 of the said regulations, in sub-regulation (1), in clause (c), after the proviso, the following proviso shall be inserted, namely: – “Provided further that family of a deceased resigned former employee as defined in clause (wa) of regulation 2 shall also be eligible for family pension provided that the deceased resigned former employee has completed required qualifying service in the Bank under sub-regulation (1) of regulation 29, subject to the condition that the deceased resigned former employee (before his death) or family member has agreed to refund to the Bank the entire Bank’s contribution to Provident Fund (along with accumulated interest thereon) received at the time of resignation or later, from the Bank and has given an undertaking as per the draft provided by the Bank within the time as stipulated by the Bank.”.

8. In regulation 40 of the said regulations, in sub-regulation (1),–

(i) in clause (b), for the first proviso, the following proviso shall be substituted, namely:– “Provided that the family pension payable to son or daughter (including widowed or divorced) shall be discontinued or not be admissible when the eligible son or daughter starts earning a sum in excess of rupees eighteen thousand per month from employment in Government or Private Sector or self– employment etc.:”;

(ii) for clause (c), the following clause shall be substituted, namely: – “(c) in the case of parents, the family pension shall be discontinued or not be admissible, if the income of one of the parents or the aggregate income of both the parents from employment in Government or Private Sector or self–employment, etc. exceeds rupees eighteen thousand per month.”.

9. In regulation 41 of the said regulations, in sub-regulation (1), after the proviso, the following proviso shall be inserted, namely:– “Provided further that a resigned former employee as defined in clause (wa) of regulation 2 and who conforms to conditions contained in sub-regulation (15) of regulation 3, shall not be eligible for commutation of his pension.”.

10. In regulation 55 of the said regulations, for the words “The Chairman and Managing Director”, the words “The Managing Director and Chief Executive Officer” shall be substituted.

11. In the said regulations, for Appendix – II, the following Appendix shall be substituted, namely:– “Appendix-II (See regulation 37)

Dearness relief on basic pension shall be as under:

(1) In the case of employees who were in the workmen cadre and who retired on or after the 1st January, 1986, but before the 1st November, 1992, and in the case of employees, who were in the officers’ cadre and who retired on or after the 1st January, 1986, but before the 1st July, 1993, dearness relief shall be payable for every rise or16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] be recoverable for every fall, as the case may be, of every 4 points over 600 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960 = 100. Provided further that on and from the 1st October, 2023, in addition to the dearness relief provided in the Table above, ex-gratia amount as specified in the Table below shall also be payable.

Such increase or decrease in dearness relief for every said 4 points shall be calculated in the manner provided in the following Table,

Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.18 per cent. of basic

pension:

Provided that on and from the 1st May, 2005, in respect of employees who retired on or after the 1st November, 2002 but on or before the 30th April, 2005, dearness relief shall be payable in terms of this clause:

Provided further that in respect of employees who retired on or after the 1st November, 2007, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2836 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.15 per cent. of basic pension:

Provided also that in respect of employees who retired on or after the 1st November, 2012, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 4440 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.10 per cent. of basic pension:

Provided also that in respect of employees who retired on or after the 1st November, 2017, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 6352 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.07 per cent. of basic pension:

Provided also that in respect of employees who retired on or after the 1st November, 2022, dearness relief shall be payable at 1 per cent. per percentage point of Index on the Basic pension for every variation of rise or fall over 123.03 points in the quarterly average of the All India Consumer Price Index for Industrial Workers Base 2016=100.

(5) Dearness relief shall be payable for the half year commencing from the 1st February and ending with the 31st July on the quarterly average of the index figures published for the months of October, November and December of the previous year and for the half year commencing from the 1st August and ending with the 31st January on the quarterly average of the index figures published for the months of April, May and June of the same year.

(6) In the case of family pension, invalid pension and compassionate allowance, dearness relief shall be payable in accordance with the rates mentioned above.

(7) Dearness relief will be allowed on full basic pension even after commutation.

(8) Dearness relief is not payable on additional pension.

(9) Pensioner whose basic pension is less than minimum pension but the aggregate of basic pension and additional pension is more than the minimum pension shall draw dearness relief as applicable to minimum pension.”.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 19

12. In the said regulations, for Appendix-III, the following Appendix shall be substituted, namely: — “Appendix-III (See regulation 39) On and from the 1st April, 2021, the ordinary rates of family pension shall be as under:

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.1262 per month.

3. Above Rs.8420 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension:

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.1687 per month.

(d) In respect of employees (both officers and workmen) other than part-time employees retiring on or after the 1st May, 2005:– Sl. No. Scale of pay per month Amount of monthly family pension

3. Above Rs.11,440 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowances, which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension:

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.2292/- per month:

Provided that on and from the 1st May, 2005, in respect of employees who retired on or after the 1st November 2002 but on or before the 30th April, 2005, ordinary rates of family pension shall be in terms of this clause.

EXPLANATORY MEMORANDUM These regulations which have been given retrospective effect are as per the agreed terms and conditions of the settlements and Joint Notes signed between the Indian Banks’ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level workmen Unions and Officers’ Associations of the banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
