1. (1) इन जवजनयमों को यूको बैंक (कमाचारी) पेंिन (संिोधन) जवजनयम, 2024 कहा िाएगा।

(2) वे आजधकाररक रािपत्र में उनके प्रकािन की तारीख से प्रवृत्त होंगे।

2. यूको बैंक (कमाचारी) पेंिन जवजनयम, 1995 (इसके पश्चात उि जवजनयम के रूप में संदर्भात) में, जवजनयम 2 के, खंड(ध), उप- खंड (घ) में, जनम्नजलजखत परंतुक िोड़ा िाएगा, यथा:- “परंतु 01 नवंबर, 2012 से लाग ूककए गए जविेष भत्ते को िाजमल नहीं ककया िाएगा:

परंतु यकद कोई कमाचारी िो 01 नवंबर, 2017 को बैंक की सेवा में था और जिसकी स्ट्टेगनेिन वेतनवृजि उसके वेतन के अजधकतम स्ट्तर तक पहुचं ने की तारीख से संिोजधत आवजधकता के अनुसार कफर से समायोजित की गई ह,ै वह पेंिन के प्रयोिनों के जलए 01 3906 GI/2024 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] नवंबर, 2017 से इस तरह के संिोजधत स्ट्टेगनेिन वेतनवृजि/(यों) के जलए नोिनल रूप से पात्र होगा, लेककन इस तरह के पुनः समायोिन के कारण मौकद्रक लाभ केवल 01 नवंबर, 2020 से या पात्रता की वास्ट्तजवक जतजथ,िो भी बाद में हो, से देय होगा।“

3. उि जवजनयमों के जवजनयम-22 में उप-जवजनयम(01)में जनम्न परंतुक िोड़ा िाएगा: “परंतु कोई कमाचारी, िो पूणाकाजलक काया पर स्ट्थायी आधार पर या स्ट्केल वेतन पर स्ट्थायी आधार पर अंिकाजलक काया परश्रजमक के रूप में बैंक की सेवा में जनयोजित ह ै,उसे हटाए िाने की जस्ट्थजत में, उसकी संपूणा जपछली सेवा िब्त नहीं होगी और वह पेंिन संबंधी लाभों के जलए अह ाहोगा।”

4. उि जवजनयमों के जवजनयम-36 में खंड(च) के पश्चात, जनम्नजलजखत खंड िोड़ा िाएगा, यथा:- (छ) अंिकाजलक कमाचारी को छोड़कर ककसी कमाचारी के संबंध में तीन हिार नौ सौ पचासी रुपये प्रजतमाह, िहां कमाचारी 1 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त हुआ हो, 1/3 वेतनमान का वेतन प्राप्त करने वाले अंिकाजलक कमाचारी के संबंध में एक हिार तीन सौ पैंतीस प्रजतमाह, 1/2 वेतनमान का वेतन प्राप्त करने वाले अंिकाजलक कमाचारी के संबंध में दो हिार रुपये प्रजतमाह, और 3/4 वेतनमान का वेतन प्राप्त करने वाले अंिकाजलक कमाचारी के संबंध में तीन हिार रुपये प्रजतमाह, िहां अंिकाजलक कमाचारी 1 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त हुआ हो।

5. उि जवजनयमों के जवजनयम-40 में,- (क) उप-जवजनयम (1) में,-

(i) खंड (बी) में, पहले परंतुक के स्ट्थान पर, जनम्नजलजखत परंतुक प्रजतस्ट्थाजपत ककया िाएगा, यथा:- "परंतु यकद पात्र पुत्र या पुत्री सरकारी या जनिी क्षेत्र या स्ट्व-रोिगार से प्रजतमाह बारह हिार रुपये से अजधक राजि अर्िात करने लगे तो पुत्र या पुत्री (जवधवा/तलाक़िुदा सजहत) को देय पाररवाररक पेंिन बंद कर दी िाएगी या स्ट्वीकाया नहीं होगी,”:

(ii) खंड (ग) के स्ट्थान पर, जनम्नजलजखत खंड प्रजतस्ट्थाजपत ककया िाएगा, यथा:- “(ग) माता-जपता के मामले में, पाररवाररक पेंिन बंद कर दी िाएगी या स्ट्वीकाया नहीं होगी यकद माता-जपता में से ककसी एक की आय या माता-जपता दोनों की कुल आय सरकारी या जनिी क्षेत्र या स्ट्व-रोिगार से प्रजत माह बारह हिार रुपये से अजधक हो,”;

(ख) उप-जवजनयम (4)में, -

(i) खंड (क) में, उप-खंड(vi) के पश्चात, जनम्नजलजखतखंड िोड़ा िाएगा, यथा:- “(vii) छब्बीस हिार पांच सौ साठ रुपये प्रजतमाह मात्र उन कमाचाररयों को, अजधकाररयों और कामगारों दोनों के संबंध में, िो 1 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त हुए या उनकी मृत्यु हो गई हो।“ परंतु 01 अप्रैल 2021 से और उसके बाद, उप-खंड (i) से (vii) प्रभावी नहीं रह िाएगा और उपयुाि सभी श्रेणी के कमाचाररयों के जलए दोनों पेंिन की राजि जवजनयम-39 के उप-जवजनयम (3) के खंड (क) के उप-खंड (i) और खंड (ख) के उप-खंड (i) के प्रावधानों के अनुसार देय होगी।“;

(ii) खंड (ख)में, उप-खंड (vi) के पश्चात, जनम्नजलजखत िोड़ा िाएगा, यथा:- “(vii) छब्बीस हिार पांच सौ साठ रुपये प्रजतमाह मात्र उन कमाचाररयों को, अजधकाररयों और कामगारों दोनों के संबंध में, िो 1 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त हुए या उनकी मृत्यु हो गई हो।“[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 परंतु 01 अप्रैल 2021 से और उसके बाद, उप-खंड (i) से (vii) प्रभावी नहीं रह िाएगा और उपयुाि सभी श्रेणी के कमाचाररयों के जलए दोनों पेंिन की राजि जवजनयम 39 के उप-खंड (1) या उि जवजनयम के उप-जवजनयम (3) के खंड (क) के उप-खंड (i) और खंड (ख) के उप-खंड (i) के प्रावधानों के अनुसार देय होगी, िैसा भी मामला हो।“;

(iii) खंड (ग) में, उप-खंड (vi) के पश्चात, जनम्नजलजखत उप-खंड िोड़े िाएंगे, यथा:- “(vii) तेरह हिार दो सौ अस्ट्सी रुपये प्रजतमाह मात्र उन कमाचाररयों को, अजधकाररयों और कामगारों दोनों के संबंध में, िो 1 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त हुए या उनकी मृत्यु हो गई हो।“ परंतु 01 अप्रैल 2021 से और उसके बाद, उप-खंड (i) से (vii) प्रभावी नहीं होगा और उपयुाि सभी श्रेणी के कमाचाररयों के जलए दोनों पेंिन की राजि जवजनयम 39 के उप-जवजनयम (1) के प्रावधानों के अनुसार देय होगी।“;

6. उि जवजनयमों के पररजिष्ट-II में,खंड(4) के स्ट्थान पर जनम्नजलजखत को प्रजतस्ट्थाजपत ककया िाएगा, यथा:- “(4) 1 मई, 2005 को या उसके बाद सेवा जनवृत्त होने वाले कमाचाररयों के संबंध में, 1960=100 िृंखला में औद्योजगक कामगारों के जलए अजखल भारतीय औसत उपभोिा मूल्य सूचकांक के जतमाही औसत में 2288 जबन्दओंु से अजधक प्रत्येक 4 जबन्दओंु पर प्रत्येक वृजि के जलए महगं ाई राहत देय होगी या प्रत्येक कमी के जलए वसूली योग्य होगी, िैसा भी मामला हो। उि प्रत्येक 4 बबंदओंु के जलए महगं ाई राहत में इस तरह की वृजि या कमी की गणना मूल पेंिन के 0.18 प्रजतित की दर से की िाएगी। परंतु 01 मई 2005 को या और उसके बाद से, उन कमाचाररयों के संबंध में िो 01 नवंबर 2002 को या उसके बाद लेककन 30 अप्रैल 2005 को या उससे पहले सेवाजनवृत्त हुए ह,ैं महंगाई राहत इस खंड के संदभा में देय होगी:

परंतु आगे कक 1 नवंबर, 2007 को या उसके बाद सेवाजनवृत्त होने वाले कमाचाररयों के संबंध में, 1960=100 िृंखला में औद्योजगक कामगारों के जलए अजखल भारतीय औसत उपभोिा मूल्य सूचकांक के जतमाही औसत में 2836 जबन्दओंु से अजधक प्रत्येक 4 जबन्दओंु पर प्रत्येक वृजि के जलए महंगाई राहत देय होगी या प्रत्येक कमी के जलए वसूली योग्य होगी, िैसा भी मामला हो। उि प्रत्येक 4 बबंदओंु के जलए महगं ाई राहत में इस तरह की वृजि या कमी की गणना मूल पेंिन के 0.15 प्रजतित की दर से की िाएगी। परंतु यह भी कक 1 नवंबर, 2012 को या उसके बाद सेवाजनवृत्त होने वाले कमाचाररयों के संबंध में, 1960=100 िृंखला में औद्योजगक कामगारों के जलए अजखल भारतीय औसत उपभोिा मूल्य सूचकांक के जतमाही औसत में 4440 जबन्दओंु से अजधक प्रत्येक 4 जबन्दओंु पर प्रत्येक वृजि के जलए महगं ाई राहत देय होगी या प्रत्येक कमी के जलए वसूली योग्य होगी, िैसा भी मामला हो। उि प्रत्येक 4 बबंदओंु के जलए महगं ाई राहत में इस तरह की वृजि या कमी की गणना मूल पेंिन के 0.10 प्रजतित की दर से की िाएगी। परंतु यह भी कक 1 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त होने वाले कमाचाररयों के संबंध में, 1960=100 िृंखला में औद्योजगक कामगारों के जलए अजखल भारतीय औसत उपभोिा मूल्य सूचकांक के जतमाही औसत में 6352 जबन्दओंु से अजधक प्रत्येक 4 जबन्दओंु पर प्रत्येक वृजि के जलए महगं ाई राहत देय होगी या प्रत्येक कमी के जलए वसूली योग्य होगी, िैसा भी मामला हो। उि प्रत्येक 4 बबंदओंु के जलए महगं ाई राहत में इस तरह की वृजि या कमी की गणना मूल पेंिन के 0.07 प्रजतित की दर से की िाएगी।

7. उि जवजनयमों के पररजिष्ट-III में,खंड(च) के पश्चात,जनम्नजलजखत खंड िोड़े िाएंगे, यथा:- "(छ) 01 नवंबर, 2017 को या उसके बाद सेवाजनवृत्त होने वाले अंिकाजलक कमाचाररयों के अलावा अन्य कार्माकों (अजधकाररयों और कमाचाररयों दोनों) के संबंध में :

प्रजतमाह माजसक पाररवाररक पेंिन की राजि वेतनमान

(1) (2) रु.15880/-तक वेतन का 30 प्रजतित मूल पाररवाररक पेंिन होगा तथा भत्ते का अजतररि 30 प्रजतित,जिसे भजवष्य जनजध म ें अंिदान के जलए जगना िाता है, लेककन महगं ाई भत्ते के जलए नहीं, अजतररि पाररवाररक पेंिन होगी।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु मूल और अजतररि पाररवाररक पेंिन की कुल राजि न्यूनतम 3,985 रुपये प्रजतमाह होगी। रु.15881/-से वेतन का 20 प्रजतित मूल पाररवाररक पेंिन होगा तथा भत्ते का अजतररि 20 प्रजतित, जिसे भजवष्य जनजध म ें रु.31760/-तक अंिदान के जलए जगना िाता ह,ै लेककन महगं ाई भत्ते के जलए नहीं, अजतररि पाररवाररक पेंिन होगी। परंतु मूल और अजतररि पाररवाररक पेंिन की कुल राजि न्यूनतम 4,900 रुपये प्रजतमाह होगी। रु.31760/- से वेतन का 15 प्रजतित मूल पाररवाररक पेंिन होगा तथा भत्ते का अजतररि 15 प्रजतित, जिसे भजवष्य जनजध म ें अंिदान के जलए जगना िाता है, लेककन महगं ाई भत्ते के जलए नहीं, अजतररि पाररवाररक पेंिन होगी। अजधक परंतु मूल और अजतररि पाररवाररक पेंिन की कुल राजि न्यूनतम 6,365 रुपये प्रजतमाह एवं अजधकतम 13,280 रुपये प्रजत माह होगी। (ि) 1 अप्रैल, 2021 को और उसके बाद से खंड (क) से (छ) प्रभावी नहीं रह िाएंगे तथा उि खंडों में उजल्लजखत सभी कमाचाररयों (अजधकारी और कामगार दोनों) के संबंध में वेतन का 30 प्रजतित मूल पाररवाररक पेंिन तथा इसके अजतररि भत्ते का 30 प्रजतित,जिसे भजवष्य जनजध में अंिदान के जलए जगना िाता है, लेककन महंगाई भत्ते के जलए नहीं,अजतररि पाररवाररक पेंिन होगी। स्ट्पष्टीकरणात्मक ज्ञापन जिन जवजनयमों को भूतलक्षी प्रभाव कदया गया है, वे इस संबंध में संबंजधत बैंकों के द्वारा कदए गए जवजिष्ट अजधदेि के आधार पर उनकी ओर से भारतीय बैंक संघ तथा बैंकों के िीषा स्ट्तरीय कामगार यूजनयनों और अजधकाररयों के एसोजसएिनों द्वारा हस्ट्ताक्षररत समझौते और संयुि नोट के सहमत जनबंधन एव ं ितों केअनुसार है। इसजलए, इस तरह के भूतलक्षी प्रभाव से ककसी भी व्यजि के जहतों पर प्रजतकूल प्रभाव नहीं पड़ेगा। अंजबकानन्द झा, महाप्रबंधक [जवज्ञापन-III/4/असा./244/2024-25] रटप्पणी:मूल जवजनयम भारत के रािपत्र, भाग III, खंड 4 में अजधसूचना संख्या पीईआर/पीईएन/265/95, कदनांक 29 जसतंबर, 1995 के माध्यम से प्रकाजित ककए गए थे और अंजतम रूप से अजधसूचना संख्या एचओपीएसडी/पेंिन/2023-24/67, कदनांक 18 अगस्ट्त, 2023 द्वारा संिोजधत ककए गए थे। UCO BANK (Head Office: Kolkata)

NOTIFICATION Kolkata, the 1st July, 2024 F. No. HOPSD/Pension/2024-25/50–(E)--In exercise of the powers conferred by clause (f) of sub-section

(2) of Section 19 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1970 (5 of 1970), the Board of Directors of the UCO Bank, after consultation with the Reserve Bank of India and with the previous sanction of the Central Government, hereby makes the following regulations further to amend the UCO Bank (Employees’) Pension Regulations, 1995, namely:-

1. (1) These regulations may be called the UCO Bank (Employees’) Pension (Amendment) Regulations, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the UCO Bank (Employees’) Pension Regulations, 1995 (hereinafter referred to as the said regulations), in regulation 2, in clause (s), in sub-clause (d), the following provisos shall be inserted, namely:- “Provided further that special allowance introduced with effect from the 1st day of November, 2012 shall be

Provided also that an employee who was in the services of the Bank as on the 1st November, 2017 and whose stagnation increments have been re-adjusted as per revised periodicity from the date of reaching their maximum scale of pay, shall be notionally eligible for such revised stagnation increments with effect from the 1st November, 2017 for the purposes of Pension but the monetary benefit on account of such re-adjustment shall be payable only with effect from the 1st November, 2020 or the actual date of entitlement, whichever is later”.

3. In Regulation 22 of the said regulations, in sub-regulation (1), the following proviso shall be inserted, namely:- “Provided that the removal of an employee, who is employed in the service of the Bank as a workman on full time work on permanent basis or on part-time work on permanent basis on scale wages, shall not entail for forfeiture of his entire past service and shall qualify for pensionary benefits.”.

4. In Regulation 36 of the said regulations, after Clause (f), the following clause shall be inserted, namely:- “(g) rupees three thousand nine hundred and eighty-five per month in respect of an employee, other than a part-time employee, where the employee retired on or after the 1st day of November, 2017, rupees one thousand three hundred and thirty-five per month in respect of a part-time employee drawing 1/3 scale of wages, rupees two thousand per month in respect of part-time employee drawing ½ scale wages, and rupees three thousand per month in respect of a part-time employee drawing ¾ scale wages, where the part-time employee retired on or after the 1st day of November, 2017”.

5. In regulation 40 of the said regulations,-

(a) in sub-regulation (1),-

(i) in clause (b), for the first proviso, the following proviso shall be substituted, namely:- “Provided that the family pension payable to son or daughter (including widowed or divorced) shall be discontinued or not be admissible when the eligible son or daughter starts earning a sum in excess of rupees twelve thousand per month from employment in Government or private sector or self–employment etc.”

(ii) for clause (c), the following clause shall be substituted, namely:- “(c) in the case of parents, the family pension shall be discontinued or not be admissible if the income of one of the parents or the aggregate income of both the parents from employment in Government or Private sector or self – employment, exceeds rupees twelve thousand per month;”;

(b) in sub-regulation (4),-

(i) in clause (a), after Sub-clause (vi), the following shall be inserted, namely:- “(vii) twenty-six thousand five hundred and sixty rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after the 1st day of November 2017:

Provided that on and from the 1st day of April, 2021, sub-clause (i) to (vii) shall cease to have effect and the amount of both pensions for all the above said category of employees shall be payable as per the provisions of sub-clause (i) of clause(a) and sub-clause (i) of clause (b) of sub-regulation (3) of regulation 39.”;

(ii) in clause (b), after sub-clause(vi), the following shall be inserted, namely:- “(vii) twenty-six thousand five hundred and sixty rupees per mensem only in respect of employees, both officers and workmen, who retired or died on or after the 1st day of November, 2017:

Provided that on and from the 1st day of April, 2021, sub clause (i) to (vii) shall cease to have effect and the amount of both the pension for all the above said category of employees shall be payable as per the provisions of sub-clause

(1) of regulation 39 or sub-clause (i) of clause (a) and sub-clause (i) of clause (b) of sub-regulation (3) of the said regulation, as the case may be.”;

(iii) in clause (c), after the sub-clause (vi), following sub-clauses shall be inserted, namely:- “(vii) thirteen thousand two hundred and eighty only in respect of employees, both officers and workmen, who retired or died on or after the 1st day of November, 2017:

Provided that on and from the 1st day of April, 2021, sub clause (i) to (vii) shall cease to have effect and the amount of the two pensions for all the above said category of employees shall be payable as per the provisions of sub- regulation (1) of regulation 39.”.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

6) In Appendix-II to the said Regulations, for clause (4), the following shall be substituted, namely:- “(4) In respect of employees who retire on or after the 1st May, 2005, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2288 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.18 per cent. of basic pension:

Provided that on and from the 1st day of May, 2005, in respect of employees who retired on or after the 1st day of November, 2002 but on or before the 30th day of April , 2005, dearness relief shall be payable in terms of this clause:

Provided further that in respect of employees who retired on or after the 1st day of November, 2007, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 2836 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100.

Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.15 per cent. of

basic pension:

Provided also that in respect of employees who retired on or after the 1st day of November, 2012, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 4440 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100.Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.10 per cent. of basic

pension:

Provided also that in respect of employees who retired on or after the 1st day of November, 2017, dearness relief shall be payable for every rise or be recoverable for every fall, as the case may be, of every 4 points over 6352 points in the quarterly average of the All India Average Consumer Price Index for Industrial Workers in the series 1960=100. Such increase or decrease in dearness relief for every said 4 points shall be calculated at the rate of 0.07 per cent of basic pension.”.

7) In Appendix-III to the said regulations, after clause (f),the following clauses shall be inserted, namely:- “ (g) In respect of employees (both officers and workmen) other than part-time employees retiring on or after the 1st day of November, 2017:

Scale of pay per Amount of monthly Family Pension month

(1) (2) Upto Rs.15,880 30 per cent. of the pay shall be the basic family pension and additional 30 per cent. of allowance which are counted for making contribution to provident fund but not for dearness allowance, shall be the additional family pension.

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.3,985 per month.

Rs.15,881 to 20 per cent. of the pay shall be basic family pension and additional 20 per cent. of allowance Rs.31,760 which are counted for making contributions to provident fund but not for dearness allowance, shall be the additional family pension.

Provided that the aggregate of basic and additional family pension shall be subject to minimum of Rs.4,900 per month.

Above Rs.31,760 15 per cent. of the pay shall be the basic family pension and additional 15 per cent. of allowances which are counted for making contributions to provident fund but not for the dearness allowance, shall be the additional family pension.

Provided that the aggregate of basic and additional family pension shall be subject to a minimum of Rs.6365 per month and maximum of Rs.13,280 per month.

(h) On and from the 1st day of April, 2021 clauses (a) to (g) shall cease to have effect and in respect of all employees (both officers and workmen) mentioned in the said clauses, 30 per cent of the Pay shall be the[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 7 basic family pension plus 30 per cent of allowance which are counted for making contribution to provident fund but not for dearness allowance, shall be the additional family pension.”.

EXPLANATORY MEMORANDUM The regulations which have been given retrospective effect are as per the agreed terms and conditions of the settlements and Joint Notes signed between the Indian Banks’ Association on behalf of member banks on the basis of specific mandate given by the respective banks in this regard and apex level workmen unions and officers’ associations of the banks. Therefore, interests of no person shall be adversely affected by such retrospective effect.
