L.-33004/99 सी.जी.-डी.एल.-अ.-29102022-239946 xxxGIDHxxx CG-DL-E-29102022-239946 xxxGIDExxx ऄसाधारण EXTRAORDINARY भाग III—खण् ड 4 PART III—Section 4 प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 532] नइ ददल्ली, िुक्रर्ार, ऄक्त बू र 28, 2022/ कार्ततक 6, 1944 No. 532] NEW DELHI, FRIDAY, OCTOBER 28, 2022/ KARTIKA 6, 1944 उजा ा दक्षता ब्यरू ो ऄजधसचू ना नइ ददल्ली, 27 ऄक् तूबर, 2022 फा. स.ं बीइइ/एसएंडएल/जचल्ल स/ा40/2022-23.—उजाा संरक्षण ऄजधजनयम 2001 (2001 का 52) की धारा 13 की ईपधारा (2) के खंड (ढ) के साथ पठठत धारा 58 की ईपधारा (2) के खडं (झ) द्वारा प्रदत् त जि ियों का प्रयोग करते हुए उजाा दक्षता ब्यूरो (ब्यूरो) केंद्रीय सरकार के पूर्ा ऄनुमोदन स े जर्जनयमों ऄथाात ् “उजाा दक्षता ब्यूरो (जचल्ल स ा के लेबल पर जर्र्रण और ईसके प्रदिान का तरीका) जर्जनयम 2022” का जनम्नजलजखत प्रारूप बनाने का प्रस्ट्तार् करता ह,ै जजसे ईि ऄजधजनयम की धारा 58 की ईप-धारा (1) द्वारा यथा-ऄपेजक्षत ईि जर्जनयमों के प्रारूप को ईन सभी व्यजियों की के सूचनाथा प्रकाजित दकया जाता ह,ै जजनको आससे प्रभाजर्त होने की संभार्ना ह;ै और एतदद्वारा यह सूचना दी जाती ह ै दक ईि जर्जनयमों के प्रारूप पर ह,ैं से तीस ददन की ऄर्जध की समाजि पर या ईसके पश्चात ्जर्चार दकया जाएगा;ह ैजजसे ईक्त ऄजधजनयम की धारा 58 की ईप-धारा (1) द्वारा ऄपेजक्षत आससे प्रभाजर्त होन े र्ाल े सभी व्यजियों की जानकारी के जलए प्रकाजित दकया जाता ह;ै और नोठटस ददया जाता ह ै दक ईि जर्जनयमों के प्रारूप पर, ऄजधसचू ना के प्रकािन की तारीख स े तीस ददन की ऄर्जध की समाजि पर या ईसके बाद जर्चार दकया जाएगा; अक्षेप या सुझार्, यदद कोइ हो, तो ईसे महाजनदेिक, उजाा दक्षता ब्यूरो, जर्द्युत मंत्रालय, चौथा तल, सेर्ा भर्न, अर के परु म, सेक्टर-1, नइ ददल्ली-110 066 को प्रेजित दकए जा सकते ह;ैं उजाा दक्षता ब्यरू ो द्वारा ईक्त जर्जनयमों के प्रारूप के संबंध म ें दकसी भी व् यजि स े पैरा 1 म ें जर्जनर्ददष् ट 30 ददन की ऄर्जध की समाजि स े पहले प्राप् त होने र्ाली अपजियों या सुझार्ों पर जर्चार दकया जाएगा। 7222 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] जर्जनयमों का प्रारूप 1. सजं क्षि नाम और प्रारंभ—(1) आन जर्जनयमों का संजक्षि नाम उजाा दक्षता ब्यूरो (जचल् लस ा के लेबल पर जर्र्रण और ईसके प्रदिना का तरीका) जर्जनयम, 2022 ह।ै (2) ये अजधकाठरक राजपत्र म ेंप्रकािन की तारीख को प्रर्ृि होंगे। 2. पठरभािाए ँ—(1) आन जर्जनयमों म,ें जब तक दक संदभ ा म ेंऄन्यथा ऄपेजक्षत न हो,— (क) "ऄजधजनयम" से तात् पया उजा ासंरक्षण ऄजधजनयम, 2001 (2001 का 52) ह ै ; (ख) "बेजसक मॉडल ग्रपु (बीएमजी)" स े तात् पय ा ईन मॉडलों का समहू ह ै जजनकी जर्िेिताएं समान ह ै और जो एक मॉडल के प्रदिना को समहू के भीतर ऄन्य मॉडलों के प्रदिान का प्रजतजनजधत्र् करत े ह।ैं िीतलन क्षमता की एक जनजश्चत सीमा के भीतर, एक बीएमजी में र्े जचल्ल र मॉडल िाजमल होंग,े जो अइएसइइअर के संदभा म ेंसमान उजाा प्रदिना के साथ एक ही स्ट्टार लेर्ल बैंड म ेंरख ेहोंगे। (ग) "पेरेंट मॉडल" संबंजधत बीएमजी की िीतलन क्षमता सीमा के भीतर दकलोर्ाट में ईच्चतम िीतलन क्षमता र्ाला एक जचल्ल र मॉडल होगा। (घ) "चाआल्ड मॉडल" की कूललग क्षमता दकलोर्ाट में होगी, जो ईसी बीएमजी में मूल मॉडल की कूललग क्षमता से कम होगी। (ड.) "प्ररूप" स ेतात प् या ईन जर्जनयमों के साथ सलं ग्न प्ररूप ह;ै (च) "लेबल" से तात् पया जचल् लर पर जचपकाइ गइ ऄथर्ा प्रदर्तित, जलखत, मुदद्रत, ऄंदकत, मुहर लगी या ग्रादफक सामग्री ह ै; (छ) "लेबल की ऄर्जध" से तात् पया ऄजधजनयम की धारा 14 के खंड (क) के तहत केन् द्रीय सरकार द्वारा ऄजधसूजचत उजा ाखपत मानकों की र्ैधता ऄर्जध ह:ै बिते दक यदद लेबल र्ैधता ऄर्जध की समाजि समय तक, ऄजधजनयम की धारा 14 (क) के तहत नए उजाा खपत मानकों को ऄजधसूजचत नहीं दकया जाता ह ै तो मौजूदा मानकों को तब तक र्ैध माना जाएगा जब तक दक केन्द्रीय सरकार द्वारा आसके जलए नए मानक ऄजधसूजचत नहीं दकए जाते; (ज) "ऄनज्ञु ा प्राि व्यजि" स े तात् पय ा ईस व्यजि या एजेंसी स े ह ै जजसे जर्जनयम 7 के तहत लेबल जचपकाने की ऄनुज्ञा दी गइ ह;ै (झ) "ऄनुसूची" से तात् पया आन जर्जनयमों से जु़ी ी ऄनुसूची ह ै; (ञ) "जचल् लस"ा से तात् पय ा ऄजधजनयम की धारा 14 के खंड (ख) के तहत ऄजधसूचना म ें जर्जनर्ददष् ट एक ईपकरण ह;ै (ट) "स्ट्टार रेटटग या स्ट्टार लेर्ल" से तात् पया ह ै ऄजधजनयम की धारा 14 के खडं (क) के तहत केन्द्र ीय सरकार द्वारा ऄजधसूजचत अइएसइइअर के अधार पर जचल् लर के लेबल पर प्रदर्तित उजा ादक्षता का ग्रेड; (ठ) लेबल लगे जचल् लर के संबंध में "व्यापारी या जर्क्रेता" से तात् पया ईस व्यजि से ह ैजो ससे जचल् लर की जबक्री ऄथर्ा जर्तरण करता ह ै और आसमें दकु ानदार, व्यापारी, जर्जर्जनमााता और आस पर लेबल जचपकाने के जलए ऄनुज्ञा प्राप् त ऄनुज्ञाधारक िाजमल ह।ैं (2) यहां आसमें प्रयुि जो िब् द और ऄजभव् यजियां ऄपठरभाजित ह ैं लेदकन ऄजधजनयम म ें पठरभाजित की गइ ह ैं ईनका ऄजधजनयम म ेंईन् ह ेंक्रमि: ददया गया अिय ही होगा। 3. लबे ल पर प्रदर्तित दकया जान े र्ाला जर्र्रण (1) प्रत्येक जचल् लर पर, आसके लेबल पर जनम्नजलजखत जर्र्रण प्रदर्तित दकया जाएग, नामत:— (क) उजाा दक्षता ब्यरू ो का प्रतीक जचह्न; (ख) ईपकरण / प्रकार; (ग) जर्जनमााता या अयातक और ब्ांड का नाम;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 3 (घ) बीएमजी/मॉडल/जर्जनमााण या अयात का र्ि;ा (ड.) जर्जिष्ट ्ृंखला कोड; (च) िीतलन प्रौद्योजगकी; (छ) कंप्रेसर प्रकार; (ज) ठंडा करन े की क्षमता; (झ) अइएसइइअर; (ञ) कुल जबजली आनपुट; (ट) लेबल की ऄर्जध; (ठ) मूल देि (2) लेबल का जडजाआन, रंग, अकार और सामग्री आन जर्जनयमों के साथ संलग् न ऄनुसूची में यथा जर्जर्जनर्ददष् ट होगा। 4. लबे लों के प्रदिना के जलए समय सीमा- (1) जर्जनयम 3 म ें जर्जर्जनर्ददष् ट सभी जर्र्रणों र्ाला लेबल आन जर्जनयमों के लाग ूहोने की तारीख से छह माह की ऄर्जध के भीतर प्रत्येक जचल्ल र पर प्रदर्तित दकया जाएगा। (2) केन् द्रीय सरकार द्वारा ऄजधजनयम की धारा 14 के खंड (क) के तहत ऄजधसूजचत उजाा खपत मानकों के अरंभ होने पर और अरंभ होने स,े प्रत्येक ऄनुज्ञाधारक या व्यापारी या जर्क्रेता सुजनजश्चत करेगा दक- (क) जबक्री के जलए जडजाआन दकए जा रह े जचल्ल र संिोजधत उजाा खपत मानकों के साथ स्ट्ट ार लेर्ल और लेबल ऄर्जध और उजाा खपत मानकों के साथ जचल्ल र के जनमाणा र्िा को प्रदर्ति त करेगा तथा जपछले उजाा खपत मानकों के साथ जचल्ल र का ईत् पादन नहीं करेगा; बिते दक आसके प्रारंभ होन े की तारीख स े दो माह पूर् ा जर्जनमााता उजा ा जनष्प ादन मानकों के साथ ईपकरण का ईत् पादन या अयात कर सकता ह।ै ; (ख) डीलरों, खुदरा व् यापाठरयों को जानकारी देने के जलए, ईनको जिजक्षत करने के साथ ही ईपभोक्त ाओं क को जिजक्षत करने के जलए ऄपेजक्षत प्रचार-प्रसार सजहत सभी प्रारंजभक कदम आसके अरंभ होन े से तीन माह पहल े ईठाए जाने चाजहए। 5. लबे ल प्रदर्तित करन े की प्रजर्जध - (1) जबक्री के स्ट् थान पर प्रत् येक जचल् लर पर जन्‍न जलजखत तरीके से लेबल जचपकाया जाएगा, ऄथाात्: — (i) लेबल जचल्ल र पर और ईसकी नामपठटिकका के पास मजबू ती से जचपकाया जाएगा। (ii) लेबल ठटकाउ सामग्री (एल्यूमीजनयम एनोडाआज्ड) का होगा और नीच े ददए गए अकार के ऄनुसार मुदद्रत दकया जाएगा। संक्षारण प्रजतरोधी सामग्री की नामपठटिकका जचल् लर पर जचपकाइ जाएगी । ऄनुसूची द्वारा ऄपेजक्षत ऄंकन सुपाठ्य, ऄजमट और ठटकाउ होन े चाजहए। 6. लबे ल प्रदर्तित करन े की ऄनज्ञु ा- (1) ब्यूरो की पूर् ा ऄनज्ञु ा प्राि दकए जबना दकसी जचल्ल र पर कोइ स्ट्टार लेबल नहीं जचपकाया जाएगा । (2) कंपनी पंजीकरण - ब्यूरो की ऄनुज्ञा प्राि करने के प्रयोजनों के जलए, प्रत्येक ब्ांड को एक लाख रुपए के लेबल प्रजतभूजत िुल् क के साथ, ऄलग से पंजीकृत दकया जाएगा जैसा दक प्ररूप I - (क) में जर्जनर्ददष् ट दकया गया ह,ै भुगतान के आल क्े र ाजनक मोड द्वारा देय ह:ै बिते दक लघ ु ईद्योग के मामले में लेबल प्रजतभूजत िल्ु क केर्ल पच् चीस हजार रुपए होगा; (3) मॉडल पंजीकरण- ईप-जर्जनयम (2) के तहत ऄनुज्ञाधारक के प्रत्येक अर्ेदन के साथ— (क) भगु तान के आलेक्रॉजनक मोड द्वारा देय प्रजत मॉडल दो हजार रुपए का अर्ेदन िल्ु क; तथा (ख) प्ररूप-1 – (ख) म ेंयथा जर्जर्जनर्ददष् ट दस्ट् तार्ेज4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 7. ऄनज्ञु ा प्रदान करना - (1) जर्जनयम 6 के तहत कोइ अर्ेदन प्राि होने पर और आससे संतुष्ट पर दक आसमें दी गइ सभी ऄपेक्षाओं क का पालन दकया गया है, ब्यूरो मानक और लेबललग पर ससी प्राजि की तारीख से ददिा (ब्यूरो के ऑपरेिन मैनऄु ल ऑन स्ट्टैंडर्डस ा एंड लेबललग) म ें जर्जनर्ददष् ट ऄर्जध के ऄंदर, जर्जनयम 8 म ें यथा जर्जर्जनर्ददष् ट जनयमों एर् ं ितों के ऄध् यधीन के जलए ऄनुज्ञा प्रदान करता ह,ै — (क) प्ररूप II-(क) में आलेक्रॉजनक रूप में ब्ांड पंजीकृत करना; या (ख) प्ररूप II-(ख) में आलेक्रॉजनक रूप में जचल्ल र पर लेबल लगाने की ऄनुज्ञा देना। (2) ब् यरू ो द्वारा प्ररूप-III में रजजस्ट् टर का ऄनरु क्षण दकया जाएगा और आसमें ऄनज्ञु ाधारक का नाम प्रजर्ष्ट दकया जाएगा; (3) ईप-जर्जनयम (1) के तहत आस प्रकार प्रदि ऄनज्ञु ा ईस ऄर्जध तक मान् य होगी जो केन् द्रीय सरकार द्वारा धारा 14 के खण्ड (क) के तहत यथा: ऄजधसूजचत उजा ा खपत मानक द्वारा स्ट् टार लेर्ल के जलए जर्जर्जनर्ददष् ट की गइ ह;ै (4) ऄनुज्ञाधारक द्वारा स्ट् टार रेटटग योजना के संिोधन के मामले म,ें ऄनुज्ञा के नर्ीनीकरण का अर्ेदन आसकी समाजि के छह माह बाद लेदकन तीन माह से पहल े नहीं दकया जाएगा और आसके साथ उजाा दक्षता ब्यूरो, नइ ददल्ली के पक्ष में आलेक्रॉजनक मोड म ेंएक हजार रुपए का िुल्क देय होगा। बिते, स्ट्टार रेटटग योजना के जर्स्ट्तार के मामले म,ें एक हजार रुपए के ईि नर्ीनीकरण िुल्क से छूट दी जाएगी। (5) ईप-जर्जनयम (4) के तहत नर्ीकरण के जलए अर्ेदन-पत्र प्राप् त होने पर और सभी ऄपेक्षाएं पूरी होन े के संबंध में संतुष्ट होन े पर, ब् यरू ो ईक्त अर्ेदन प्राप् त होन े की तारीख से एक माह की ऄर्जध के ऄंदर प्ररूप-II में ऄनुज्ञा का नर्ीकरण कर सकता ह;ै (6) र्ैधता की ऄर्जध समाप् त होने के बाद दकसी अर्ेदन का नर्ीकरण नहीं दकया जाएगा और आस मामल े म ें ऄनुज्ञाधारक को नया अर्ेदन पत्र देना होगा; (7) जो ऄनुज्ञाधारक ईस तारीख से जचल् लर के मौजूदा मॉडल पर लेबल जचपकाने को जारी रखने की ऄनुज्ञा की मांग करता ह,ै जजस तारीख से संिोजधत स्ट् टार लेर्ल लाग ूहुअ ह,ै केर्ल प्ररूप IV में एक घोिणा प्रस्ट्त ुत करेगा; (8) यदद जचल ल् र के नए मॉडल की योजना संिोजधत स्ट् टार लेर्ल के साथ ताल-मेल जबठाकर िरूु करन े की योजना ह ैतो ऄनुज्ञाधारक को नया लेबल जचपकाने की ऄनुज्ञा लेगा और ईक्त ऄनुज्ञा के जलए अर्ेदन संिोजधत स्ट् टार लेर्ल के लाग ूहोन े से छह माह पूर् ादकया जाए; 8. लबे ल पर जर्र्रण प्रदर्तित करन ेके जलए जनयम और ित:ें- प्रत् यके ऄनुज्ञाधारक और व् यापारी एर्ं जर्क्रेता लेबल पर जर्र्रण प्रदर्तित करने म ेंजन्‍ नजलजखत जनयमों एर् ंितों का पालन करेगा, नामत:— (क) जचल् लर के लेबल पर प्रदर्तित स्ट् टार लेर्ल ऄजधजनयम की धारा 14 के खण् ड (क) के तहत केंद्र सरकार द्वारा ऄजधसूजचत जचल्ल र के जलए उजाा खपत मानकों के ऄनुरूप होंगे; (ख) यह लेबल जचल्ल र के ससे मॉडलों पर ही जचपकाया जाएगा जजसके जलए ऄनुज्ञा ली गइ है; (ग) लेबल को ऄनुज्ञाधारक की लागत पर मुदद्रत और जचल् लर पर जचपकाया जाएगा; (घ) ऄनुज्ञाधारक, व् यापारी और जर्क्रेता यह सुजनजश्चत करेगा दक जचल् लर पर लेबल पर प्रदर्तित स्ट् टार लेर्ल हर समय बना रहगे ा; (ङ) ऄनुज्ञाधारक जर्जनयम 9 में यथा-जर्जनर्ददष् ट लेबल िल्ु क का भगु तान करेगा; (च) ऄनुज्ञाधारक ब् यूरो को जर्र्रण मुहयै ा कराएगा जजसमें लेबल लग े ईपकरणों को बनान े का ब् यौरा और जर्िीय र्िा की प्रत् येक जतमाही के ऄंत में जन्‍न जलजखत माह के ऄदं र प्रत् येक जतमाही के जलए देय प्रोभूभूत ले बललग िुल् क का जर्र्रण हो; (छ) ऄनुज्ञाधारक, ब् यरू ो को ऄपने लेबल लगे ईत् पादों की जबक्री के जलए जनयुक्त प्रत् यके र्िा 30 ऄप्रैल को ऄजधकृत जर्तरकों, डीजरों और थोक जर्क्रेताओं क एर्ं जर्क्रेताओं क की सूची मुहयै ा कराएगा; (ज) ससे ऄन् य जनयमों एर्ं ितों का पालन करेंग े जो ब् यूरो द्वारा, मानक और लेबललग के संबंध में ब् यूरो की प्रचालन पुजस्ट्तका ददिा म ेंजनजहत जनयमों एर्ं ितों सजहत जर्जनर्ददष् ट दकए गए हों;[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 5 9. लबे ल िल्ु क - (1) प्रत् येक ऄनुज्ञाधारक को जचल्ल र पर प्रत् येक जचपकाए जाने र्ाले प्रत्येक लेबल के जलए केर्ल 3/- रुपए प्रजत दकलोर्ाट का एक लेबल िल्ु क का भगु तान करेगा; (2) ईप-जर्जनयम (1) के तहत जर्जर्जनर्ददष् ट लेबल िल्ु क प्रत् येक जर्त् तीय र्िा की ऄंजतम तारीख से एक माह के ऄंदर र्ार्तिक रूप से दकया जाएगा; बिते दक यथा-जर्जनर्ददष् ट ऄर्जध के ऄंदर लेबल िुल् क का भगु तान न करन े पर, ब् यरू ो जर्जनयम 6 के ईप-जर्जनयम (3) के खण् ड (ख) के तहत प्रजतभूजत राजि से आस पर प्रजतर्ि ा दस प्रजतित की दर स े आस पर ब् याज का भुगतान करेगा और यदद आसे जमा दकए जाने की ऄंजतम तारीख से एक माह के ऄंदर पूरा लेबललग िल्ु क र्सूल नहीं दकया जाता, ब् यरू ो ऄनुज्ञाधारक को प्रदि सभी ऄनज्ञु ा रद क कर सकता ह ै और ऄनज्ञु ाधारक का नाम चूककताा के रूप म ें समाचार पत्र में प्रकाजित कर सकता ह।ै 10. लबे ल प्रजतभजू त िल्ु क का प्रजतदाय:- जर्जनयम 9 के ईप-जर्जनयम (2) के प्रार्धान के ऄधीन, ऄनुज्ञाधारक को जचल् लर का जर्जनमााण बंद करन े पर लेबल प्रजतभूजत िल्ु क के प्रजतदाय का ऄजधकार होगा। 11. ब्यरू ो द्वारा सत्यापन- जचल्ल र जर्जनमााता ऑनलाआन बीइइ पोटाल में त्रैमाजसक रूप से स्ट्टार रेटटग कायाक्रम के तहत पंजीकृत जचल्ल र के बारे में जचल्ल र ईत्पादन कायाक्रम और जर्तरण कायाक्रम प्रस्ट्तुत करेगा । (1) जचलरों का परीक्षण या तो एनएबीएल द्वारा जर्जधर्त प्रत् यायन प्राि जर्जनमााता परीक्षण प्रयोगिाला म ें या एनएबीएल द्वारा जर्जधर्त प्रत् यायन प्राि दकसी तीसरे पक्ष/स्ट्र्तंत्र परीक्षण प्रयोगिाला म ें या एपीएसी और/या अइएलएसी के साथ एमअरए र्ाले दकसी ऄन्य प्रत्यायन जनकाय में अयोजजत दकया जाएगा। (2) बीइइ के प्रजतजनजध की ईपजस्ट्थजत में एनएबीएल द्वारा जर्जधर्त प्रत् यायन प्राि स्ट्र्तंत्र परीक्षण प्रयोगिाला / आन-हाईस जर्जनमााता की परीक्षण प्रयोगिाला में जचल्ल र के जलए जांच परीक्षण अयोजजत दकया जाएगा। (3) ब् यरू ो ऄथर्ा आसकी नामोदद कष्ट एजेंसी, स्ट् र्यमेर् ऄथर्ा आसे जिकायत प्राप् त होन े पर, यह सुजनजश्चत करने के जलए सत् यापन करेगा दक जचल्ल र आसके लेबल पर प्रदर्तित स्ट् टार लेर्ल और ऄन् य जर्र्रण के ऄनुरूप ह ै और दक यह ऄनुज्ञा के ऄन् य जनयमों एर् ंितों के ऄनपु ालन में ह।ै बिते चुनौती परीक्षण की प्रदक्रया र्ही होगी जो जर्जनयम (11) के ईप-जर्जनयम (3) म ेंईजल्लजखत ह।ै (4) जचल् लर मॉडल के जलए प्राि जिकायत पर, ब्यूरो/नाजमत एजसें ी बीइइ द्वारा ददए गए ऄनुमोदन की प्रामाजणकता सुजनजश्चत करन े के जलए जर्जनमाता ा के पठरसर म ेंपरीक्षण ठरकॉडा का सत्यापन करेगी। (5) जाँच परीक्षण के दौरान, जचल् लर जर्फल होन े पर: (क) प्ररूप V, में ऄनुज्ञाधारक को सभी राज्य नामोदद कष्ट एजेंजसयों को जनदेि देगा दक ऄनज्ञु ाधारक दो माह की ऄर्जध के ऄंदर, (i) जचल् लर के लेबल पर सही स्ट् टार लेर्ल प्रदर्तित करेगा ऄथर्ा परीक्षण के दौरान त्रुठटयों और खराजबयों को दरू करेगा; (ii) ब् यरू ो के ददिा- जनदेिों के ऄनुपालन म ेंबाजार से सभी स्ट् टॉक को र्ापस लेगा; और (iii) जर्ज्ञाजपत सामग्री पर प्रदर्तित जर्र्रण में पठरर्तान करेगा। (ख) ईपभोक्त ाओं क के लाभ के जलए, दो माह के ऄंदर ऄनुज्ञाधारक का नाम, ब्ाण् ड का नाम, मॉडल का नाम ऄथर्ा मॉडल संख् या, प्रतीक जचह्न और ऄन् य जर्जर्जनर्ददष् टता दकसी दैजनक राष्र ीय ऄथर्ा क्षेत्रीय समाचारपत्र ऄथर्ा आलेक्र ॉजनक ऄथर्ा यथोजचत दकसी ऄन् य तरीके से प्रकाजित करेगा। (ग) बीइइ जचल् लर मॉडल और संब्ध बेजसक मॉडल ग्रुप की मंजरू ी रद क करेगा। (घ) संबंजधत राज्य नामोदद कष्ट एजेंसी को इसी ऄजधजनयम, 2001 की धारा 27 के तहत ऄनुज्ञाधारक और व् यापारी के जखलाफ न् याजयक कानूनी कारार्ाइ करन े की सूचना दें। (ड.) जर्जनमााता की घोिणा के ऄनुसार गैर-ऄनपु ालन के मामल े म,ें जर्जनमााता को संबंजधत बेजसक मॉडल ग्रपु के जलए डी-रेटेड सीओपी / अइएसइइअर के साथ दफर से एक नया अर्ेदन जमा करना होगा।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] ठटप्प णी : ईत्पाद की प्रकृजत को ऄनुकूजलत दकया जा रहा ह,ै सत्यापन प्रदक्रया केर्ल एकल जाचं परीक्षण पर अधाठरत होगी। दकसी भी जर्फलता के मामले में ब्यूरो का जनणाय जर्जनयम (11) के ईप-जर्जनयम (5) के खंड (क) से खंड (ड.) के ऄनुसार दकया जाएगा। (6) ऄनुज्ञाधारी, ईप-जर्जनयम (5) में जर्जनर्ददष् ट दो माह की ऄर्जध की समाजि के दस ददनों के ऄंदर, जनदेि के ऄनुपालन म ेंकी गइ कारार्ाइ के संबंध में प्ररूप VI में ऄनुपालन ठरपोटा ब्यरू ो को भेजगे ा। 12. ऄनज्ञु ा जनरस्ट्त करना - ब्यरू ो जर्जनयम 7 के तहत प्रदत् त ऄनुज्ञा को जनरस्ट् त कर सकता ह,ै यदद ऄनुज्ञाधारक, (क) जर्जनयम 8 के तहत जर्जनर्ददष्ट दकसी जनयम और िता का पालन नहीं करता; No. BEE/S&L/Chillers/40/2022-23.—In exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 of the Energy Conservation Act, 2001 (52 of 2001), the Bureau of Energy Efficiency (the Bureau) with the previous approval of the Central Government, proposes to notify the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Chillers) Regulations, 2022, the proposed draft regulations are hereby published in the Gazette of India, Extraordinary, as required by sub- section (1) of section 58 of the said Act, for the information of all the persons likely to be affected thereby and inviting their suggestions and objections (if any); and the notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of the period of thirty days from the date of their publication in the Gazette of India, Extraordinary; Objections or suggestions, if any, may be addressed to the Director-General, Bureau of Energy Efficiency, Ministry of Power, 4th Floor, Sewa Bhawan, North Wing, Sector-1, R.K.Puram, New Delhi-110066; Objections or suggestions which may be received from the persons with respect to the said draft regulations before the expiry of the period of thirty days specified in para 1 above, shall be taken into consideration by the Bureau of Energy Efficiency. Draft Regulations 1. Short title and commencement.—(1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Chillers) Regulations, 2022. 2. Definitions.—(1) In these regulations, unless the context otherwise requires,— (a) ―Act‖ means the Energy Conservation Act, 2001 (52 of 2001); (b) ―Basic Model Group (BMG)‖ means group of models that share characteristics which allow the performance of one model to be representative of the performance of other models within the group. Within a given range of cooling capacity, a BMG shall comprise of chiller models, lying in the same star level band with similar energy performance in terms of ISEER. (c) ―Parent Model‖ shall be a chiller model with highest cooling capacity in kW, within the cooling capacity range of respective BMG. (d) ―Child model‖ shall have cooling capacity in KW, less than that of the cooling capacity of the parent model in the same BMG. (e) ―Form‖ means a form appended to these regulations; (f) ―label‖ means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the Chiller; (g) ―label period‖ means the validity period of the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act: Provided that if, by the ending timeline of the label validity period, the new energy consumption standards under section 14 (a) of the Act is not notified, the existing standards shall deemed to be valid until new values for the same are notified by the Central Government;24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (h) ―permittee‖ means a person or agency to whom permission has been granted to affix label under regulation 7; (i) ―Schedule‖ means the schedule annexed to these regulations; (j) ―Chillers‖ means an appliance as specified in the notification under clause (b) of section 14 of the Act; (k) ―star rating or star level‖ means the grade of energy efficiency displayed on the label of the chillers based on ISEER notified by the Central Government under clause (a) of section 14 of the Act; (l) ―trader or seller‖ in relation to any chiller means a person who sells or distributes such chiller and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such chiller. (2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act. 3. Particulars to be displayed on label.—(1) On every chiller, the following particulars shall be displayed on its label, namely:— (a) the logo of the Bureau of Energy Efficiency; (b) appliance/type; (c) name of manufacturer or importer and brand; (d) BMG/Model/year of manufacturing or import; (e) unique series code; (f) cooling technology; (g) compressor type; (h) cooling capacity; (i) ISEER; (j) total power input; (k) label period; (l) country of origin (2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations. 4. Time limit for display of labels.—(1) A label containing all the particulars specified in regulation 3 shall be displayed on every chiller within a period of six months from the date of coming into force of these regulations. (2) On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller shall ensure that— (a) the chiller being designed for sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the chiller shall also be in synchronization with such revised energy consumption standards, and shall not manufacture chiller with the previous energy consumption standards; Provided that for smooth transition, manufacturer may produce or import the product two month in advance from the date of such commencement, with the revised energy performance standards; (b) all preparatory steps including awareness of the dealers, retailers and consumers, requisite publicity for their education shall be well planned and taken three months in advance of the date of such commencement, under these regulations. 5. Manner of display of label.—(1)There shall be a label on chiller which shall be displayed at the point of sale and such label shall be affixed on chiller in the following manner, namely:— (i) The label shall be firmly fixed on chiller and near the nameplate of the chiller. (ii) The label shall be of durable material (aluminium anodized) and be printed as per the size. The name plate of corrosion resistant material shall be affixed on the chiller. The markings required by the schedule shall be legible, indelible and durable. 6. Permission for display of label.—(1) No star label shall be affixed on a chiller without obtaining the prior permission of the Bureau.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 25 (2) Company Registration.- For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees, payable by any acceptable electronic mode of payment: Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only; (3) Model Registration.- Every application of the permittee under sub-regulation (2) shall be accompanied by— (a) an application fee of two thousand rupees per model, payable by any other acceptable electronic mode of payment; and (b) documents specified in Form I- (B). 7. Grant of permission.—(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in DISHA (Bureau’s Operation Manual on Standards and Labelling) from the date of such receipt, grant, subject to such terms and conditions as are specified in regulation 8,— (a) register the brand in Form II-(A) or in electronic form; or (b) grant permission for affixing label on chiller in Form II-(B) or in electronic form. (2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein. (3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 of the Act is in force. (4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi. Provided, in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted. (5) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II – (B). (6) No application shall be renewed after expiry of validity period; in which case the permittee shall make a fresh application. (7) The permittee who seeks permission for continuance to affix label on the existing model of the chiller from the date from which the revised star level comes into force shall submit a declaration according to Form IV. (8) The permittee shall seek permission to affix label afresh, if new model of the chiller is planned to be launched synchronising with the revised star level, and application for such permission shall be made six months in advance of coming into force of the revised star level. 8. Terms and conditions for display of particulars on label.—Every permittee, trader and seller shall,— (a) comply with the energy consumption standards for chiller notified under clause (a) of section 14 of the Act; (b) affix label only on such model of chiller for which permission has been granted; (c) affix label on the chiller at the cost of the permittee; (d) ensure that the star level displayed on the label of chiller shall be maintained at all time; (e) pay the label fee as specified in regulation 9; (f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of closure of each quarter of the financial year; (g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30thday of April of each year; (h) comply with such other terms and conditions which the Bureau may specify including those contained in DISHA (Bureau’s Operation Manual on Standards and Labelling).26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] 9. Label fee.—(1) Every permittee shall pay to the Bureau a label fee of INR 3/kW only for each label being affixed on chiller; (2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure of each financial year; Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit paid under clause (b) of sub-regulation (3) of regulation 6 and if complete labelling fees are not recovered within one year of the last date of submission, the Bureau may cancel the labels granted to the permittee and publish his name in the national or regional daily newspapers and in electronic means as a defaulter. 10. Refund of label security deposit.—Subject to the provisions of sub-regulation (2) of regulation 9, the permittee shall be entitled to a refund of the label security deposit, on ceasing to manufacture chiller. 11. Verification by Bureau.—The chiller manufacturer shall submit the chiller production schedule and delivery schedule about the chillers which are registered under star rating program, quarterly in online BEE portal. (1) The check testing of chillers shall be conducted either in manufacturers test lab duly accredited by NABL or in a third party/ independent test laboratory duly accredited by NABL or any other accreditation bodies having MRA with APAC and/or ILAC. (2) The check testing for chillers shall be conducted at independent test laboratory/in-house manufacturer’s test laboratory duly accredited by NABL in presence of BEE’s representative. (3) The Bureau or its designated agency may, either suo motu or on a complaint received by it, carry out verification testing to ensure that the chiller conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission. Provided the procedure for challenge testing shall be same as mentioned in sub-regulation (3) of regulation (11). (4) Where, upon a complaint received for a chiller model, the Bureau/designated agency would verify the test records at manufacturer’s premises to ensure the authenticity of the approval granted by BEE. (5) During check testing, if the chiller fails: (a) direct the permittee in Form V, under intimation to all the State designated agencies, that the permittee within a period of two months shall,- (i) correct the star level displayed on the label of the room air conditioner or remove the defects and deficiencies found during testing; (ii) withdraw all the stocks from the market to comply with the directions of the Bureau; (iii) change the particulars displayed on advertising material. (b) BEE will publish, for the benefit of the stakeholders, the name of the permittee, brand name, model name or model number, logo and other specific action in any national or regional daily newspaper and in any electronic or in other manner as it deems fit within two months; (c) BEE will cancel the approval of chiller model and associated basic model group. (d) BEE shall intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the EC Act. (e) In case of non-compliance as per manufacturer’s declaration, the manufacturer has to again submit a fresh application with de-rated COP/ISEER for the respective basic model group. Note: The product being customised in nature, verification process shall be based on only single check testing. The decision of the Bureau in case of any failure shall be made in accordance with clause (a) to clause (e) of sub-regulation (5) of regulation (11). (6) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub- regulation (5) send the compliance report in Form VI to the Bureau with respect to action taken in compliance with the direction.[भाग III—खण् ड 4] भारत का राजपत्र : ऄसाधारण 27 12. Cancellation of permission.—The Bureau may cancel the permission granted under regulation 7, if the permittee, (a) fails to comply with any of the terms and conditions specified under regulation 8; (b) fails to pay label fee within the period specified under regulation 9; (c) fails to comply with the directions issued under regulation 11. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within ten days after the expiry of two months, i.e., by ...............In case no compliance report is received by the said date, the Bureau shall proceed to take action under these regulations. 6.
