(1) आन वनयमों का संविप्त नाम भारतीय प्रौद्योवगकी संस्थान और प्रारम्भ – (भारतीय खान ववद्यालय), धनबाद पररवनयम, 2017 ह।ै (2) य ेराजपत्र में ईनके प्रकाशन की तारीख को प्रवृत्त होंगे। पररभाषाएं - 2. (1) आन पररवनयमों म ेंजब तक दक संदभा से ऄन्यथा ऄपेवित न हो,- (क) “ऄवधवनयम” से प्रौद्योवगकी संस्थान ऄवधवनयम, 1961 (1961 का 59) ऄवभप्रेत ह;ै (ख) “प्रावधकारी”, “ऄवधकारी” और “अचाय”ा से संस्थान के प्रावधकारी ऄवधकारी और अचाय ा ऄवभप्रेत ह;ैैँ (ग) “वनमााण और संकमा सवमवत” से संस्थान की वनमाणा और काया सवमवत ऄवभप्रेत ह;ैं (घ) “केन्र” या “ववद्यालय” से शैिवणक या शोध दिया-कलापों या दोनों को दियावन्वत करने के वलए और ईन्ह ें सुकर बनान े के वलए आस प्रकार स्थावपत शैिवणक केन्र या ववद्यालय ऄवभप्रेत ह ै वजनके पररणाम स्वरूप बैचले र या मास्टर या पीएचडी वडग्री प्रदान की जाती ह,ै ऄवभप्रेत ह;ै (ङ) “केन्रीय सरकार” से भारत सरकार ऄवभप्रेत ह;ै (च) छात्रावास के सम्बन्ध में “मुख्य वाडान” से ईसका मुख्य वाडना ऄवभप्रेत ह;ै (छ) “संकायाध्यि” से वनदेशक द्वारा वनयुि संकायाध्यि ऄवभप्रेत ह;ै 3895 GI/2017 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (ज) “ववभाग” से स्नातक या स्नातकोत्तर या दोनों और पीएचडी की ईपावधयों हते ु ऄनदु ेश देन े और शोध दिया-कलाप करने के वलए स्थावपत कोइ शिै वणक ववभाग ऄवभप्रेत है; (झ) “ववत्त सवमवत” से संस्थान की ववत्त सवमवत ऄवभप्रेत ह;ै (ञ) दकसी ववभाग या केन्र या ववद्यालय के सम्बन्ध में “प्रधान” से ईसका प्रधान ऄवभप्रेत ह;ै (ट) “छात्रावास” से संस्थान के छात्रों के वनवास के वलए छात्रावास ऄवभप्रेत ह;ै (ठ) “संस्थान” से ऄवधवनयम के ऄधीन वनगवमत भारतीय प्रौद्योवगकी संस्थान (भारतीय खान ववद्यालय), धनबाद नाम से ज्ञात संस्था ऄवभप्रेत ह;ै (ड) “ऄध्यादशे ” से संस्थान के ऄध्यादेश ऄवभप्रते ह;ै (ढ) “सीनेट” संस्थान का सीनेट ऄवभप्रेत ह;ै (ण) “सेवा केन्र” स े ऄवसंरचनात्मक या वैज्ञावनक या दोनों तथा शैिवणक और शोध दिया- कलापों को ऄग्रसर करन े तथा ईनमें वृवि करन े के वलए तकनीकी सहायता प्रदान करने हते ु आस प्रकार स्थावपत शैिवणक सेवा केन्र ऄवभप्रेत ह;ै (त) संस्थान के छात्रावास के सम्बन्ध में “वाडान” से ईसका वाडान ऄवभप्रेत ह।ै (2) आसमें प्रयुि शब्दों और पदों और जो आस ऄवधवनयम म ें पररभावषत नहीं ह ै या पररभावषत ह,ै का वही ऄथ ाहोगा जो ईसका ऄवधवनयम ह।ै ऄवभशासक बोड ा 3. (1) बोड ा वनम्नवलवखत के सम्बन्ध में केन्रीय सरकार द्वारा जारी समग्र नीवत ववषयक ढांच े से संगत सवियम ऄवधकवथत करता ह,ै ऄथाात्:- (i) औद्योवगक परामश;ा (ii) ववदेशी और भारतीय शैिवणक तथा ऄनुसंधान संस्थानों का सहयोग; (iii) दान की स्वीकृवत; (iv) ऄन्य तकनीकी संस्थाओं को शिै वणक सहायता। (2) बोडा, लघ ु और पूंजी संकम ा तथा संपदा की मरम्मत और रख-रखाव और संकमा के मामले ईन पर ईपगत दकए जाने वाल ेव्यय की सीमा तथा ईसके ऄनुमोदन के बारे में नीवत ऄवधकवथत करेगा। बठै क 4. बोड ाके संववधान और ईसकी बैठकों की प्रदिया वनम्नानुसार होगी, ऄथाात:् - (क) बोडा म ें प्रवतवनवधयों को नामवनर्ददष्ट करन े या ईनका चयन करने के वलए हकदार वनकायों को ऐसा करने के वलए रवजस्रार द्वारा ऐसे युवियुि समय के भीतर, जो ईस तारीख से, वजसको वह ऐसे वनमंत्रण जारी करता ह,ै जो सामान्यतः अठ सप्ताह स े ऄवधक न हो, अमंवत्रत दकया जाएगा और बोडा म ें अकवस्मक ररवियों को भरन े के वलए ईसी प्रदिया का पालन दकया जाएगा। (ख) बोडा ईतनी बार वजतनी बार अवश्यक हो दकन्त ु दकसी कैलेन्डर वषा के दौरान कम से कम दो बार बैठक करेगा। (ग) ऄध्यि द्वारा बोडा की बैठकें या तो ईसकी ऄपनी पहल पर या वनदेशक के ऄनुरोध पर या बोडा के कम स ेकम तीन सदस्यों द्वारा हस्तािररत ऄध्यपेिा पर बुलाइ जाएगी। (घ) चार सदस्य, वजनमें संस्थान स े बाहर का एक सदस्य भी ह,ै बोडा की बैठक के वलए कोरम होगा: परन्तु यदद कोरम के ऄभाव में, बैठक अस्थवगत कर दी जाती ह ै तो बैठक ऐसे ददन को, समय और स्थान पर, जो ऄध्यि ऄवधाररत करे, अयोवजत की जाएगी और यदद ऐसीII (i) 3 बैठक में, बैठक अयोवजत करन े के वलए वनयत समय से अध े घन्टे के भीतर कोरम ईपवस्थत नहीं होता ह,ै ईपवस्थत सदस्य कोरम होंगे। (ङ) बोडा की बैठकों में ववचार दकए गए सभी प्रश्नों का ईपवस्थत सदस्यों, वजनमें ऄध्यि भी ह,ै के बहुमत द्वारा वववनश्चय दकया जाएगा और यदद मतों का बराबर-बराबर ववभाजन हो जाता ह ैतो ऄध्यि का वनणाायक मत होगा। (च) ऄध्यि, यदद ईपवस्थत ह,ै बोडा की प्रत्येक बैठक की ऄध्यिता करेगा और ईसकी ऄनुपवस्थवत में, ईपवस्थत सदस्य बैठक में ऄध्यिता करने के वलए स्वयं ऄपने में से एक का चयन करेंगे। (छ) प्रत्येक बैठक की वलवखत सूचना रवजस्रार द्वारा बैठक की तारीख स े कम स े कम तीन सप्ताह पूवा प्रत्येक सदस्य को भेजी जाएगी और सूचना में बैठक का स्थान और समय ईवल्लवखत होगा: परंत ु ऄध्यि ऄत्यावश्यक ववशषे मुद्दों पर ववचार करन े ऄल्पकावलक सूचना पर बोड ा की बैठकें बुला सकेगा। (ज) सूचना, बोड ा के कायाालय म ें यथा ईवल्लवखत प्रत्येक सदस्य के पते पर या तो दस्ती या स्पीड पोस्ट द्वारा या रवजस्रीकृत डाक या इ-मेल द्वारा पररदत्त की जा सकेगी और यदद आस प्रकार भेजी गइ सूचना ऐसे समय पर, वजस पर सूचना डाक के सामान्य ऄनुिम में पररदत्त की गइ हो तो, सम्भवतः पररदत् त की गइ समझी जाएगी। (झ) रवजस्रार द्वारा कायासूची बैठक स े कम से कम दस ददन पूव ा सदस्यों को पररचावलत दकया जाएगा। (ञ) कायासूची पर दकसी मद को सवम्मवलत करन े के वलए प्रस्तावों की सूचना रवजस्रार के पास बैठक में कम से कम एक सप्ताह पूवा पहुचं जानी चावहए और तथावप, ऄध्यि ऐसी दकसी मद को सवम्मवलत करने की ऄनुज्ञा दे सकेगा वजसके वलए सम्यक सूचना प्राप्त नहीं की गइ ह।ै (ट) प्रदिया के सभी प्रश्नों के सम्बन्ध में ऄध्यि का वववनणाय ऄवन्तम होगा। (ठ) बोडा की बैठक की कायावावहयों के कायावृत्त ऄध्यि के ऄनुमोदन स े रवजस्रार द्वारा तैयार दकया जाएगा और भारत में ईपवस्थत बोडा के सभी सदस्यों को पररचावलत दकया जाएगा तथा संशोधनों, यदद कोइ सुझाए हों, सवहत कायावृत्त बोडा की ऄगली बैठक म ें पुवष्ट के वलए रखा जाएगा और कायावृत्त की ऄध्यि द्वारा पुवष्ट दकए जान े तथा ईस पर हस्तािर दकए जाने के पश्चात ् ईन्ह ें कायावृत्त पवु स्तका म ें ऄवभवलवखत दकया जाएगा ईसे कायाालय घंटों के दौरान सभी समयों पर बोड ा और पररषद के सदस्यों के वनरीिण के वलए खुला रखा जाएगा। (ड) यदद बोडा का कोइ सदस्य बोड ा से ऄनुपवस्थत रहन े की ऄनुमवत वलए वबना तीन लगातार बैठकों में ईपवस्थत नहीं होता ह ैतो वह बोड ाका सदस्य नहीं रहगे ा। (ढ) बोडा, वनदेशक को ऄपनी ऐसी शवियां प्रत्यायोवजत कर सकेगा जो ईसके द्वारा समुवचत समझी जाएं, तथावप, वनदेशक, ऄगली बैठक म ें ईसके द्वारा की गइ कारावाइ के बारे में बोड ा को ररपोटा करेगा। बोड ा के अदेशों तथा 5. बोड ा के सभी अदशे और वववनश्चय रवजस्रार के या आस वनवमत्त बोडा द्वारा प्रावधकृत दकसी ऄन्य वववनश्चयों का व्यवि के हस्तािर द्वारा ऄवधप्रमावणत दकए जाएंगे। ऄवधप्रमाणन4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] सीनटे 6. (1) ऄवधवनयम की धारा 14 में ईवल्लवखत व्यवियों के ऄवतररि, वनम्नवलवखत सीनेट के सदस्य होंगे, ऄथाात:् - (क) ऐसे अचायों, जो सीनेट के सदस्य नहीं ह,ैं से वभि ववभागाध्यि या ऄकादमी केन्रों या ववद्यालयों के ऄध्यि; (ख) जो सीनेट के सदस्य नहीं ह ैईन अचायों से वभि संकायाध्यि तथा सहयुि संकायाध्यि; (ग) संस्थान का पुस्तकालयाध्यि; (घ) एक वषा की ऄववध के वलए वनदेशक द्वारा चिानुिम द्वारा नामवनर्ददष्ट दकया जाने वाला एक मुख्य वाडना ; (ङ) ऐसी ऄववध, जो ऄध्यि द्वारा वववनर्ददष्ट की जाए, के वलए वनदेशक के परामशा के पश्चात् ऄध्यि द्वारा वनयिु दकए गए ईनके ववशेष ज्ञान के वलए शैिवणक संकमाचाररवृन्द को छह ऄन्य सदस्यों से ऄनवधक सदस्य; (2) ऄवधवनयम के ईपबंधों के ऄधीन रहत ेहुए, सीनेट की वनम्नवलवखत की शवियां होंगी:- (क) वववभि भागों या शैिवणक केन्रों या ववद्यालयों के वलए ऄध्ययन पाठ्यिमों के वलए पाठ्यचयाा और पाठ्य वववरण बनाना तथा ईनका पुनरीिण करना; (ख) परीिाओं के संचालन हते ु व्यवस्था करना, परीिकों, पररमाजका ों, सारणीकारों अदद की वनयुवि करना; (ग) परीिाओं के पररणाम घोवषत करना या ऐसा करने के वलए सवमवतयों या ऄवधकाररयों की वनयुवि करना तथा वडग्री, वडप्लोमा एवं ऄन्य शैिवणक सम्मान या ईपावधयां प्रदान या स्वीकृत करन े के सम्बन्ध में बोडा की वसफाररश करना; (घ) ववभागों या शैिवणक केन्रों या ववद्यालय के कायाकरण से सम्बि शैिवणक ववषयों पर वसफाररश करन े के वलए संस्थान के ववभागों तथा शैिवणक केन्रों या ववद्यालयों के वलए सलाहकार सवमवतयों या ववशषे ज्ञ सवमवतयों या दोनों की वनयुवि करना और सम्बि ववभागाध्यि ऐसी सवमवतयों के संयोजक के रूप में काय ाकरेंगे; (ङ) ऐसे वववनर्ददष्ट शैिवणक ववषयों, जो सीनेट द्वारा दकसी ऐसी सवमवत को वनर्ददष्ट दकए जाएं, पर सलाह देन े के वलए सीनेट के सदस्यों, संस्थान के ऄन्य ऄध्यापकों तथा बाहर के ववशेषज्ञों में से सवमवतयां वनयिु करना; (च) वववभि ववभागों या शैिवणक केन्रों या ववद्यालयों से सम्बि सलाहकार सवमवत की वसफाररशों तथा ववशेषज्ञ तथा ऄन्य सवमवतयों की वसफाररशों पर ववचार करना और ऐसी कारावाइ (वजसम ें बोड ा को वसफाररश करना भी ह)ै करना वजसकी प्रत्येक की पररवस्थवतयों म ेंऄपिे ा की जाए; (छ) ववभागों का दिया-कलापों का अववधक पुनर्ववलोकन करना तथा समुवचत कारावाइ (वजसमें बोडा की वसफाररशें करना भी ह)ै करना; (ज) पुस्तकालय के कायाकरण का पयावेिण करना; (झ) संस्थान के भीतर शोध को बढावा देना और ईसमें लग े हुए व्यवियों से ऐसे शोध पर ररपोटों की ऄपेिा करना;II (i) 5 (ञ) ईनमें वशिा तथा ऄनशु ासन की बाबत किाओं तथा छात्रावासों के वनरीिण के वलए व्यवस्था करना, संस्थान के छात्रों के पाठ्यिमेत्तर दिया-कलाप का पयावेिण करना तथा ईस पर बोड ाको ररपोटें प्रस्ततु करना; (ट) वृवतका, छात्रवृवत्त, ऄध्येतावृवत्त, पदकों तथा पुरस्कार प्रदान करना और ऄध्यादेशों तथा ऐसी ऄन्य शतों के ऄनुसार जो पुरस्कार से सम्बि हों, ऄन्य परु स्कार देना; (ठ) शैिवणक संकमाचाररवृन्द पर पदों का सृजन तथा ईनके ईत्सादन और ऐस ेपदों के कतव्ा य ों के सम्बन्ध में बोड ाको वसफाररश करना; (ड) ववभागों या केन्रों या ववद्यालयों या सेवा केन्रों की स्थापना तथा ईनके ईत्सादन के सम्बन्ध में बोडा को वसफाररश करना और ऐसे शैिवणक ववभागों या केन्रों या ववद्यालयों या ऐसे केन्रों के वलए शैिवणक और ऄन्य संकमाचाररवृन्द का अबंटन; (ढ) ऄन्य तकनीकी संस्थाओं को ईनके शैिवणक मानकों को ऄग्रसर करने म ें सहायता प्रदान करना; (ण) संस्थान की शैिवणक तथा शोध ईत्पादकता में वृवि करन े के वलए दरू स्थ वशिा पिवत के माध्यम से पहुचं बनाना। (3) सीनेट, ईतनी बार वजतनी बार अवश्यक हो, दकन्त ु दकसी कैलेन्डर वष ा के दौरान चार बार स े कम बैठक नहीं होगी। (4) (क) सीनेट की बैठकें ऄध्यि द्वारा या तो ईसकी स्वयं की पहल पर या सीनेट के कम से कम 20% सदस्यों द्वारा हस्तािररत ऄध्यपेिा पर बुलाइ जाएगी। (ख) ऄध्यपेवित बैठक कायासूची की केवल ईन मदों पर चचाा करने के वलए ववशेष बैठक होगी वजसके वलए ऄध्यपेिा की जाती ह।ै ऄध्यपेवित बैठक सीनेट के ऄध्यि द्वारा ईस े सुववधाजनक तारीख और समय पर ऐसी ऄध्यपेिा के वलए दी गइ सूचना के पन्रह ददन के भीतर बुलाइ जाएगी। (5) सीनेट के सदस्यों की कुल संख्या का एक वतहाइ सीनेट की बैठक के वलए गणपूर्वत होगी। (6) वनदेशक, यदद ईपवस्थत हो, सीनेट की प्रत्येक बैठक की ऄध्यिता करेगा। ईसकी ऄनुपवस्थवत में, ईप-वनदेशक ऄध्यिता करेगा और वनदेशक तथा ईप-वनदेशक दोनों की ऄनुपवस्थवत म,ें संकायाध्यिों में से ज्येष्ठतम संकायाध्यि बैठक की ऄध्यिता करेगा। यदद संकायाध्यिों म ें से कोइ भी ईपवस्थत नहीं ह ै तो ईपवस्थत अचायों में से ज्यष्ठे तम अचाय ाबैठक की ऄध्यिता करेगा। (7) प्रत्येक बैठक की वलवखत सूचना काया सूची के साथ रवजस्रार द्वारा बैठक स े कम स े कम एक सप्ताह पहले सीनेट के सदस्यों को पररचावलत की जाएगी और सीनेट का ऄध्यि ऐसी दकसी मद को सवम्मवलत करने की ऄनुज्ञा दे सकता ह ैवजसके वलए सम्यक सूचना नहीं दी जा सकी थी। (8) ईप-पररवनयम (7) के ईपबंधों के होते हुए भी, वनदेशक ऄत्यावश्यक ववशेष मुद्दों पर ववचार करन े के वलए दकसी ऄल्प सूचना पर सीनेट अपातकालीन बैठक बलु ा सकेगा। (9) प्रदिया के सभी प्रश्नों के बारे म ेंसीनेट के ऄध्यि का वववनणाय ऄंवतम होगा। (10) सीनेट की बैठक की कायावावहयों का कायावृत्त सीनेट के ऄध्यि के ऄनुमोदन से कुलसवचव द्वारा तैयार दकया जाएगा तथा भारत म ें ईपवस्थत सीनेट के सभी सदस्यों को पररचावलत दकया जाएगा। परंतु ऐसा कोइ कायावृत पररचावलत नहीं दकया जाएगा यदद सीनेट समझती ह ै दक ईसका पररचालन संस्थान के वहतों पर प्रवतकूल प्रभाव डालेगा। कायावृत, संशोधनों के साथ, यदद कोइ हों तो, सीनेट की ऄगली बैठक म ें पुवष्ट के वलए प्रस्तुत दकया जाएगा। कायावृत की पुवष्ट हो जान े तथा आस पर सीनेट के ऄध्यि के हस्तािर हो जान े के पश्चात,् आनको कायावृत पुवस्तका में ऄवभवलवखत दकया जाएगा जो6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] कायाालय घण्टों के दौरान सभी समय पर सीनेट, बोडा तथा पररषद के सदस्यों के वनरीिण के वलए खुली रखी जाएगी। (11) अपाती दशाओं म ें सीनेट का ऄध्यि सीनेट के ऄवधकारों का प्रयोग कर सकेगा तथा ईसके द्वारा की गइ कारावाइ को सीनेट की अगामी बैठक में ईस पर ऄनुमोदन प्राप्त करने हते ु सीनेट को ररपोटा कर सकेगा। ववत्त सवमवत 7. (1) ववत्त सवमवत, ऄवधवनयम की धारा 10 के ऄथाान्तगात, संस्थान का एक प्रावधकारी होगी और आसमें वनम्नवलवखत संदस्य होंग,े ऄथाात्:- (क) ऄध्यि, पदेन, जो ववत्त सवमवत का ऄध्यि होगा; (ख) केन्रीय सरकार द्वारा नामवनर्ददष्ट दो व्यवि; (ग) बोडा द्वारा नामवनर्ददष्ट तीन व्यवि; और (घ) वनदेशक। (2) (क) ईपरोि ईप-पररवनयम (1) के ईप-खंड (ख) और (ग) के ऄधीन नामवनर्ददष्ट सदस्य का कायाकाल, वजस वष ा में ईसे नामवनर्ददष्ट दकया गया हो, ईस वषा की जनवरी के प्रथम ददन से तीन वष ा का होगा। (ख) दकसी अकवस्मक ररवि को भरन े हते ु नामवनर्ददष्ट सदस्य का कायाकाल ईस सदस्य के कायाकाल की शेष ऄववध तक के वलए होगा वजसके स्थान पर ईसे नामवनर्ददष्ट दकया गया ह।ै (3) ववत्त सवमवत वनम्नवलवखत कृत्य करेगी, ऄथाात्:- (क) वनदेशक द्वारा तैयार दकए गए संस्थान के वार्वषक बजट की जांच एवं संवीिण तथा बोड ा को वसफाररशें करना; (ख) संस्थान को प्रभाववत करने वाले दकसी भी ववत्तीय प्रश्न पर, या तो बोडा की, या वनदेशक की या स्वयं ऄपनी पहल पर ऄपने ववचार रखना तथा बोड ाको ऄपनी वसफाररशें करना; (ग) संस्थान स े सम्बवन्धत सभी ऐसे मामलों पर, जो ववत्तीय ववविाएं रखत े हों, ववचार करना तथा बोड ाको ऄपनी वसफाररशें करना। (4) ववत्त सवमवत की बैठक ईतनी बार वजतनी बार अवश्यक हो परंतु एक वष ा म ें कम स े कम दो बार होगी। (5) ववत्त सवमवत की दकसी बैठक हते ु ववत्त सवमवत के तीन सदस्य गणपूर्वत करेंगे। (6) ऄध्यि, यदद ईपवस्थत हो, ववत्त सवमवत की बैठकों की ऄध्यिता करेगा और ईसकी ऄनुपवस्थवत में, ईपवस्थत सदस्य ऄपन ेमें स ेदकसी एक सदस्य को बैठक की ऄध्यिता करन े के वलए चनु ेगा। (7) बैठक की सूचनाएं, कायासूची में मदों का समावेशन और बोडा की बैठकों को लाग ू कायावृत् की पुवष्ट के बारे में ईपरोि पररवनयमों में ईपबंध, यथाशक्य, ववत्त सवमवत की बैठकों के सम्बन्ध म ेंलागू होंगे। (8) ववत्त सवमवत की प्रत्येक बठै क के कायावृत्त की एक प्रवत बोडा को भेजी जाएगी। (9) अकवस्मक मामलों में, ऄध्यि, ववत्त सवमवत की शवियों का प्रयोग कर सकेगा तथा ईसके द्वारा की गइ कारावाइ को, ईसके ऄनमु ोदन हते ु ववत्त सवमवत की अगामी बैठक में ररपोटा कर सकेगा। भवन एव ं 8. (1) भवन एवं संकमा सवमवत, ऄवधवनयम की धारा 10 के ऄथाान्तगात संकम ासवमवत संस्थान का एक प्रावधकरण होगा और आसमें वनम्नवलवखत सदस्य होंगे, ऄथाात:् - (क) वनदेशक, पदेन, जो भवन एवं सकं मा सवमवत का ऄध्यि होगा;II (i) 7 (ख) ईप-वनदेशक, पदने ; (ग) भारसाधक अचाया, संपदा एवं संकमा, पदेन; (घ) केन्रीय सरकार द्वारा नामवनर्ददष्ट एक व्यवि; (ङ) दकसी सरकारी ववभाग/ऄवभकरण से बोड ा द्वारा नामवनर्ददष्ट एक वसववल आंजीवनयर, जो ऄधीिण आंजीवनयर से नीचे की पंवि का न हो; (च) दकसी सरकारी ववभाग या ऄवभकरण स ेबोडा द्वारा नामवनर्ददष्ट एक ववद्युत आंजीवनयर; (छ) बोडा द्वारा नामवनर्ददष्ट दकए जाने वाले संस्थान के ऐसे तीन अचाया, जो सुसंगत ववशेषज्ञता रखते हों; (ज) संस्थान आंजीवनयर, पदेन; (झ) कुलसवचव, पदेन, सवचव; (2) (क) पदने सदस्य की पदाववध तब तक बनी रहगे ी जब तक वह ईस पद को धारण करता ह ै वजसके अधार पर वह सदस्य ह।ै (ख) ईपरोि परवनयम (1) के खंड (घ), (ड.), (च) तथा (छ) के ऄन्तगात नामवनर्ददष्ट दकए गए सदस्य का कायाकाल ईस वष ा की जनवरी के प्रथम ददन स ेदो वषा का होगा। (3) भवन एवं संकमा सवमवत वनम्नवलवखत कृत्यों का पालन करेंगी तथा ईसकी वनम्नवलवखत शविया ं होंगी, ऄथाात:् - (क) यह बोडा से अवश्यक प्रशासवनक ऄनुमोदन तथा व्यय की मंजूरी प्राप्त करन े के पश्चात्, बोडा के वनदेशाधीन सभी मुख्य पूंजी संकमों के प्रवत ईत्तरदायी होगी; (ख) आसे बोड ा द्वारा ऄनुमोददत व्यय की सीमा के भीतर, आस प्रयोजन के वलए संस्थान के व्ययन पर रखे गए ऄनदु ान के भीतर, ऄनुदान रावश के ऄन्तगात, लघु संकमों और ऄनुरिण तथा मरम्मत से सम्बवन्धत लघ ु संकमों हते ु अवश्यक प्रशासवनक ऄनुमोदन तथा व्यय मंजूरी की शवि होगी; (ग) यह भवनों व ऄन्य पूंजी संकमों, लघ ु संकमों, मरम्मत, ऄनुरिण और ऐस े ही ऄन्य कायों के प्राक्कलन तैयार करवाएगी; (घ) यह ऐसी तकनीकी संवीिा करने हते ु यह ईत्तरदायी होगी जो आसके द्वारा अवश्यक समझी जाए; (ङ) यह ईपयुि ठेकेदारों के सूचीकरण तथा वनववदाओं की स्वीकृवत के वलए ईत्तरदायी होगी तथा जहां अवश्यक हो, वहां आसे ववभागीय संकमों हते ु वनदेश देने की शवि भी होगी। (च) आसे वनववदाओं के ऄन्तगता न अने वाली दरों को तय करने तथा ठेकेदारों के साथ दावों और वववादों को वनपटान ेकी शवि होगी; (4) भवन एवं संकमा सवमवत, संस्थान हते ु भवनों के सविमााण एवं भूवम के ववकास के ववषय में ऐसे ऄन्य कृत्य भी करेगी जो बोडा द्वारा आसे समय-समय पर, सौंपे जाएं।8 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (5) अकवस्मक मामलों में भवन एवं संकमा सवमवत का ऄध्यि भवन एवं संकमा सवमवत सवमवत के ऄवधकारों का प्रयोग कर सकेगा और ऐसे मामले ईसके द्वारा भवन एवं संकमा सवमवत की ऄगली बैठक में ररपोटा दकए जाएगं े। (6) भवन एवं संकमा सवमवत की बैठक ईतनी बार वजतनी बार अवश्यक हो, परंतु एक वषा म ें दो बार से कम नहीं, होगी। (7) भवन एवं संकमा सवमवत की दकसी बैठक के वलए तीन सदस्य कोरम परू ा करेंगे। (8) बैठक की सूचनाओं, कायासूची में मदों का समावेशन तथा कायावृत्त की पुवष्ट के सम्बन्ध म ें बोडा की बैठकों को आन पररवनयमों के ईपबंध, जहां तक हो सके, भवन एवं संकम ा सवमवत की बैठकों के सम्बन्ध में भी लागू होंगे। (9) भवन एवं संकमा सवमवत की बैठक के प्रत्येक कायावृत्त की एक प्रवत बोड ाको भेजी जाएगी। ऄध्यि 9. (1) ऄध्यि को चयन सवमवत की वसफाररशों पर, ऐसे पदों के सम्बन्ध में, वजन पर ऄवधवनयम के ईपबंधों के ऄधीन बोडा द्वारा वनयुवि की जा सकती हो, दकसी पद धारक का प्रारवम्भक वेतन, वेतनमान के न्यूनतम से एक चरण उपर वनधााररत करन े की शवि प्राप्त होगी। (2) ऄध्यि को संस्थान के संकमाचाररवृन्द के सदस्यों को प्रवशिण या दकसी ऄनुदेश के पाठ्कयिम हते ु, बोडा द्वारा समय-समय पर, वनबंधनों एव ं शतों के ऄधीन रहते हुए भारत स े बाहर भेज े जाने का ऄवधकार होगा। (3) ऄध्यि, वनदेशक एवं संस्थान के बीच सेवा की संववदा का वनष्पादन करेगा: परंतु ऐसी संववदा के ऄधीन दकसी बात के सम्बन्ध में ऄध्यि व्यविगत रूप से ईत्तरदायी नहीं होगा। (4) अकवस्मक मामलों म,ें ऄध्यि, बोड ा की शवियों का प्रयोग कर सकेगा तथा ईसके द्वारा की गइ कारावाइ के ऄनुमोदन के वलए ईसे बोडा की अगामी बैठक म ेंसूवचत कर सकेगा। वनदेशक 10. (1) वववजटर के पूवा ऄनमु ोदन से पररषद द्वारा, समय-समय पर, यथा संशोवधत ‘प्रौद्योवगकी संस्थान ऄवधवनयम, 1961’ की धारा 17(1) के ईपबंधों के ऄधीन, पांच वष ा की ऄववध के वलए संववदा पर या ईसके द्वारा सत्तर(70) वषा की अयु प्राप्त करन े तक, जो भी पूवातर हो, वनयुि वनदेशक को ऐसी प्रदिया, जो वववनर्ददष्ट प्रयोजन दकए गए बजट ईपबंधों के ऄधीन रहते हुए समय-समय पर, बोडा द्वारा ऄवधकवथत की जाए, के ऄनुसार व्यय ईपगत करने की शवि होगी। (2) वनदशे क को प्रत्येक मद के वलए ऐसी सीमा तक अवती बजट गरठत करने वाले वभि-वभि मदों के सम्बन्ध में ऐसी वववधयों को पुनर्वनयोवजत करने की शवि होगी जो बोडा द्वारा समय-समय पर, ऄवधाररत की जाए: परंत ु ऐस े पुनर्वववनयोग म ें भावी वषों का कोइ दावयत्व ऄन्तवावलत नहीं होगा। प्रत्येक ऐस े पुनर्वववनयोग की, यथासंभव शीघ्र, ररपोटा बोड ाको दी जाएगी। (3) वनदेशक को ऐसी सीमा तक, जो समय-समय पर, बोड ा द्वारा ऄवधाररत की जाए, संकमचा ाररवृन्द के सदस्य को दकए गए ऄवत सदं ाय, वजसका पता संदाय के चौबीस मास के भीतर नहीं चलता ह,ै की वसूली को ऄवधत्यवजत करन े की शवि होगी। प्रत्येक ऐसा ऄवधत्यजन, यथाशक्य, बोड ा को ररपोटा दकया जाएगा। (4) वनदेशक को ऐसी ववत्तीय सीमा, जो समय-समय पर, बोडा द्वारा वववनर्ददष्ट दकया जाए, के ऄधीन रहते हुए ऐसे प्रयोजन के वलए बोडा द्वारा वनयुि स्थायी सवमवत की वसफाररश पर ऄवसूलनीय हावनयों और गुम हुए या वघसावट के कारण ऄनुपयोगी हुए भण्डारों के ऄवसूलनीय मल्ू य को बट्टे खात े में डाल देने की शवि होगी।II (i) 9 (5) वनदेशक को ऐसे पदों, वजन पर ऄवधवनयम के ऄनुसार बोडा द्वारा यथा वनयत ईसके द्वारा वनयुवि की जा सकती ह,ै के सम्बन्ध म ें चयन सवमवत की वसफाररश पर दकसी पदधारी के अरवम्भक वेतन को ऐसे प्रिम पर, जो वेतनमान के न्यूनतम से ऄवधक ह ै दकन्त ु ईसमें पांच वेतन वृवियों से ऄवधक वेतन वृवियां ऄन्तवावलत नहीं ह,ैं वनयत करन े की शवि होगी। (6) वनदेशक को ऐसी पररलवब्धयां, जो समय-समय पर, बोडा द्वारा वनयत की जाएं, ऄन्तवावलत करन े वाली अकवस्मकता वनवध से सदं त्त तकनीवशयनों और संकमाकारों को वनयोवजत करने की शवि होगी। (7) वनदेशक को ऐसे वनबंधनों और शतों, जो समय-समय पर, बोडा द्वारा ऄवधकवथत की जाएं, के ऄधीन रहत े हुए भारत के भीतर प्रवशिण के वलए या ऄनुदेश पाठ्यिम के वलए संकमाचाररवृन्द सदस्यों को भेजने की शवि होगी। (8) वनदशे क को पूणता ः या अंवशकतः ऄनुपयुि ठहराए गए भवनों के दकराए की माफी या ईसमें कमी की मंजूरी की शवि होगी। (9) वनदशक को दकसी भवन के, दकसी प्रयोजन से वभि दकसी ऐसे प्रयोजन के वलए, वजसके वलए आसका सविमााण दकया गया ह,ै ऄस्थायी अबंटन को मंजूर करने की शवि होगी। (10) अपवाददक मामलों म,ें वनवधयों की ईपलब् धता के ऄधीन रहते हुए, वनदेशक को ऄध्यि के ऄनुमोदन स े बोड ा के ररपोटााधीन ऄनुमोददत वेतनमानों पर दो वष ा स े ऄनवधक की ऄववध के ऄस्थायी पदों को ऄध्यि के ऄनुमोदन से सृवजत करने की शवि होगी परन्तु ऐसा कोइ पद, वजसका वनदेशक वनयुि प्रावधकारी नहीं ह,ै आस प्रकार सृवजत नहीं दकया जाएगा। (11) वनदशे क को सरकार के लेखा कोड और ऄनुकूल वनयमों तथा ऄन्य वनयमों, जहां तक वे संस्थान के कारबार के संचालन को लाग ूहोते ह ैंया ईसको लाग ूदकए जा सकते ह,ैं में वनयमों के प्रयोजन के वलए ववभागाध्यि की शवि होगी। (12) यदद, दकसी कारणवश, कुलसवचव एक मास से ऄनवधक ऄववध के वलए स्थायी रूप स ेऄनुपवस्थत ह ै तो वनदेशक कुलसवचव के कृत्यों में से दकसी कृत्य को ऄपन े प्रबन्ध म ें ल े सकेगा या ईसे सस्ं थान के संकमाचाररवृन्द के दकसी सदस्य को समनुदेवशत कर सकेगा: परंत ु यदद दकसी भी समय कुलसवचव की स्थायी ऄनपु वस्थवत एक मास से ऄवधक ह ैतो बोडा, यदद वह ठीक समझता ह ै एक मास की ऄववध के वलए पूवोि कुलसवचव के कृत्यों को प्रबन्ध म ें लने े के वलए या समनुदेवशत करन े के वलए वनदेशक को प्रावधकृत कर सकेगा। (13) वनदशे क मुख्यालयों से ऄपनी ऄनुपवस्थवत के दौरान ईप-वनदेशक या संकाय ऄध्यिों में से एक संकायाध्यि या ईपवस्थत ज्यष्ठे तम अचाया को संकमाचाररवृन्द के यात्रा भत्ते, अकवस्मक वनवधयों और वचदकत्सा ईपचार के वलए ऄवग्रम मंजूर करने तथा ईसकी ओर से वबलों पर हस्तािर और प्रवतहस्तािर करने के वलए प्रावधकृत कर सकेगा और वनदेशक की ऐसी शवियों को ग्रहण करने के वलए ईसे प्रावधकृत कर सकेगा जो वववनर्ददष्ट रूप स े वलवखत म ें ईसके द्वारा ईप-वनदेशक या संकायाध्यिों में भी एक संकाय ऄध्यि या ईपवस्थत ज्यष्ठे तम अचाया को प्रत्योवजत की जाएं। (14) वनदेशक, ऄपने वववेकानसु ार ऐसी सवमवतयों का गठन कर सकेगा जो वह समुवचत समझे। (15) ऄध्यि के पद पर ईसकी मृत्यु, पदत्याग या ऄन्यथा दकसी ररवि के होन े की दशा म ें या ऄनुपवस्थवत, बीमारी या दकसी ऄन्य कारण से ऄध्यि के ऄपन े कृत्यों का वनवहना करने में ऄसमथा होन े की दशा में, वनदेशक पररवनयम 9 के ऄधीन ऄध्यि को समनुदेवशत कृत्यों का वनवाहन कर सकेगा। ईप-वनदेशक 11. (1) ईप-वनदेशक, ऄध्यि के पूवा ऄनुमोदन से ऐसे वनबंधनों और शतों पर, जो बोडा द्वारा समय- समय पर, वववनवश्चत की जाएं, संस्थान के अचायों में स े वनदशे क द्वारा वनयिु दकया जाएगा और ईप- वनदेशक ऐसे ऄवतररि धनीय फायदा के वलए हकदार होगा, जो समय-समय पर, भारत सरकार द्वारा वववहत/ऄनुमोददत की जाए।10 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (2) ईप-वनदेशक शैिवणक और प्रशासवनक काया म ें तथा ईच्चतर वशिा और ऄनुसंधान की ऄन्य संस्थाओं के साथ और औद्योवगक ईपिमों तथा ऄन्य संकमाचाररयों के साथ भी सम्पका बनाए रखन े म ें वनदेशक की सहायता करेगा। संकायाध्यि 12. (1) वनदेशक संकायाध्यिों और सहयुि संकायाध्यिों को ऄपने कताव्यों और वजम्मेदाररयों का वनवाहन करन े में ईसकी सहायता करने के वलए ऄध्यि के परामशा से वनयिु कर सकेगा। (2) संकायाध्यि और सहयुि संकायाध्यिों की वनयुवि तीन वषा की ऄववध के वलए ऄध्यापकों में से वनदेशक द्वारा की जाएगी और वे वनदेशक के प्रसादपयान्त ऄपना पदधारण करेंगे। (3) संकायाध्यि और सहयुि संकायाध्यि संस्थान के ऄवधकारी समझ े जाएंग े और व े ऐसी शवियों का प्रयोग करेंगे तथा ऐसे कताव्यों का पालन करेंगे जो ईन्ह ें बोडा के पूवा ऄनुमोदन से वनदशे क द्वारा प्रत्यायोवजत दकए जाएं और सहयुि संकायाध्यि का प्रसामान्यतः ऄपने कताव्यों के वनष्पादन म ें सम्बवन्धत संकायाध्यिों की सहायता करेंगे। (4) संकायाध्यि और सहयिु संकायाध्यि ऄवतररि धनीय फायदे के वलए हकदार होंगे, जो समय-समय पर, भारत सरकार द्वारा वववहत या ऄनुमोददत दकया जाए। सस्ं थान के 13. (1) अकवस्मक वनवधयों से संदत्त संकमाचाररयों के मामले में के वसवाय संस्थान के संकमाचाररयों संकमचा ाररवन्ृ द तथा को वनम्नवलवखत रूप में वगीकृत दकया जाएगा:- संकमचा ाररयों का वगीकरण (क) शैिवणक संकमाचाररवृन्द – वजनके ऄन्तगात वनदशे क, ईप-वनदेशक, अचाया, सह-अचाया, पुस्तकालयाध्यि, ईप-पुस्तकालयाध्यि, सहायक पुस्तकालयाध्यि, प्रणाली प्रबंधक, ज्यष्ठे कायािमक, प्रणाली ववश्लषे क, कायािमक, ऄनुसधं ान आंजीवनयर या कंप्यूटर आंजीवनयर, कायाशाला ऄधीिक, सहायक ऄधीिक कायाशाला, मुख्य वैज्ञावनक ऄवधकारी, प्रधान वैज्ञावनक ऄवधकारी, ज्येष्ठ वैज्ञावनक ऄवधकारी, वैज्ञावनक ऄवधकारी ह ैं और ऐसे ऄन्य शिै वणक पद भी होंगे, वजनका बोडा द्वारा समय-समय पर, वववनवश्चय दकया जाए। (ख) तकनीकी संकमाचाररवृन्द – वजनके ऄन्तगात संस्थान या कैम्पस आंजीवनयर, सहायक संस्थान या कैंपस आंजीवनयर, कवनष्ठ आंजीवनयर, तकनीकी ऄवधकारी, फोरमैन, सहायक फोरमैन, ज्येष्ठ प्रयोगशाला सहायक, प्रयोगशाला सहायक, ज्येष्ठ तकनीकी सहायक, तकनीकी सहायक, टेलीफोन ऑपरेटर, चालक, ज्येष्ठ भेषजज्ञ, स्टॉफ नसा, ड्रैसर, शारीररक प्रवशिण ऄनुदेशक, सहायक कोच और ऐस े ऄन्य तकनीकी पद भी होंग,े वजनका बोडा द्वारा समय-समय पर, वववनवश्चय दकया जाए। (ग) प्रशासवनक और ऄन्य सकं माचाररवृन्द – वजनके ऄन्तगता कुलसवचव, ईप-कुलसवचव, सहायक रवजस्टार, सम्पदा ऄवधकारी, सुरिा ऄवधकारी, ईद्यान कृवष ववशेषज्ञ, लोक सम्पका ऄवधकारी, मुख्य वचदकत्सा ऄवधकारी, वचदकत्सा ऄवधकारी, खेल-कूद ऄवधकारी, सहायक खेल-कूद ऄवधकारी, परामशादाता, सहायक परामशादाता, वनजी सवचव, वनजी सहायक, ऄधीिक, सहायक, ईच्च श्रेणी वलवपक, ऄवर श्रेणी वलवपक, ज्येष्ठ अशुवलवपक, अशुवलवपक, ज्यष्ठे भण्डारी, भण्डारी, बहुकाया संकमाचाररवृन्द ऐसे ऄन्य प्रशासवनक और ऄन्य संकमाचाररवृन्द भी होंग े वजनका बोड ा द्वारा समय-समय पर, वववनवश्चय दकया जाए। (2) ईपरोि वगीकरण के होते हुए भी, बोड ापररषद के वनदेशों के ऄनुसार पद की व्यवस्था कर सकेगा या वगीकरण में पररवतान कर सकेगा। वनयवु िया ं 14. (1) संस्थान में सभी पद, प्रसामान्यतः ववज्ञापन द्वारा भरे जाएंगे दकन्त ु बोडा को वनदेशक की वसफाररशों पर यह वववनश्चय करने की शवि होगी दक दकसी वववशष्ट पद को अमंत्रण द्वारा या संस्थान के संकमाचाररवृन्दों के सदस्यों म ेंसे प्रोिवत द्वारा भरा जाएगा।।II (i) 11 (2) संस्थान समय-समय पर, पररषद के वनदेशों के ऄनुसार बोड ा द्वारा यथा ऄवधकवथत पदों के अरिण के वलए अवश्यक ईपबंध करेगा और ऐसे पदों पर वनयुवि करते समय वनयुवि प्रावधकारी संगततः संस्थान में प्रशासन की दिता के ऄनरु िण और वशिण को ऄिुण्ण रखेगा। (3) ववज्ञापन द्वारा या संस्थान के संकमाचाररवृन्द के सदस्यों में से प्रोिवत द्वारा संस्थान (संववदा अधार पर पदों स े वभि) के ऄधीन पदों को भरन े के वलए चयन सवमवत का नीच े ऄवधकवथत रीवत म ें गठन दकया जाएगा, ऄथाात:् - (क) वैज्ञावनक, वडजाआन और कम्प्यूटर, संकमाचाररवृन्द काडरों में अचायों के पदों में और समतुल्य पदों के मामल े में चयन सवमवत वनम्नवलवखत सदस्यों से वमलकर बनेगी, ऄथाात्:- (i) वनदेशक - ऄध्यि (ii) वववजटर का एक नामवनदेवशती - सदस्य (iii) बोडा के दो नामवनदेवशती, जो एक ववशेषज्ञ हो दकन्तु बोड ाके सदस्य से वभि हो - सदस्य (iv) सीनेट द्वारा नामवनदेवशत सीनेट के सदस्य स ेवभि एक ववशेषज्ञ – सदस्य (ख) वैज्ञावनक, वडजाआन और कम्प्यूटर संकमाचाररवृन्द काडरों में सह-अचाया, सहायक अचाया के पदों, समतल्ु य पदों और पस्ु तकालायाध्यि, ईप-पुस्तकालायाध्यि और सहायक पुस्तकालायाध्यि के पदों तथा ऐस े ऄन्य शैिवणक पदों, जो बोड ा द्वारा समय-समय पर, वववनवश्चत दकए जाएं, के मामले में चयन सवमवत वनम्नवलवखत सदस्यों से वमलकर बनगें ी, ऄथाात्:- (i) वनदेशक - ऄध्यि (ii) बोडा के दो नामवनदेवशती, वजनमें से एक ववशेषज्ञ हो दकन्त ु बोडा के सदस्य से वभि हो - सदस्य (iii) सीनेट द्वारा नामवनदेवशत सीनेट के सदस्य स ेवभि एक ववशेषज्ञ - सदस्य (iv) ईप-पुस्तकालायाध्यि और सहायक पस्ु तकालायाध्यि के पदों के वलए ऄध्यि, संस्थान की पुस्तकालय सलाहकार सवमवत - सदस्य (ग) रवजस् रार, ईप-कुलसवचव, सहायक कुलसवचव, संस्थान आंजीवनयर, खले -कूद ऄवधकारी, सहायक से वमलकर बनगे ी, ऄथाात्:- (i) वनदेशक या ईसका नामवनदेवशती – ऄध्यि (ii) बोडा का नामवनदेवशती – सदस्य (iii) यथावस्थवत, सम्बि ववभाग/केन्र/स्कूल का ऄध्यि – सदस्य (iv) वनदेशक द्वारा नामवनदेवशती सस्ं थान के संकमाचाररवृन्द म ेंसे एक ववशेषज्ञ – सदस्य (च) ऄन्य सभी पदों के मामले म,ें वनदेशक ऄपने वववेकानुसार ऐसी चयन सवमवतयों का गठन कर सकेगा जो ईसके द्वारा ईवचत समझी जाए। रटप्पणः 1. चयन सवमवत का ऄध्यि चयन सवमवत की सहायता करन े के वलए ऄनुमोददत पैनलों में स े एक या ऄवधक ऄवतररि ववशेषज्ञ को अमंवत्रत कर सकेगा। 2. वनदशे क द्वारा ऄनुमोददत पनै ल से िमशः ऄनुसूवचत जावत या ऄनुसूवचत जनजावत तथा ऄन्य वपछडे वगों के ऄभ्यर्वथयों के वलए अरवित पदों पर वनयुवियों के वलए चयन सवमवत। (4) वनदेशक की ऄनुपवस्थवत में, संस्थान के संकमाचाररवृन्द का कोइ सदस्य, जो वनदेशक के वतामान कताव्यों का पालन करन े के वलए वनयिु दकया जाता ह,ै वनदशे क के स्थान पर, चयन सवमवतयों का ऄध्यि होगा। (5) ईप-वनदेशक की ऄनुपवस्थवत म,ें वनदेशक, ऄपन े स्थान पर चयन सवमवत म ें काय ा करने के वलए संस्थान के संकमाचाररवृन्द के दकसी सदस्य को नामवनर्ददष्ट कर सकेगा। (6) जहां पद संववदा अधार या अमंत्रण द्वारा भरा जाना ह,ै वहां ऄध्यि, ऄपने वववेकानुसार, जैसी प्रत्येक मामले की पररवस्थवतयों में ऄपेिा की जाए, ऐसी तदथा चयन सवमवत का गठन कर सकेगा। (7) जहां कोइ पद संस्थान के सदस्यों में से प्रोिवत द्वारा या बारह मास से ऄनवधक की ऄववध के वलए ऄस्थायी रूप से भरा जाना ह,ै वहां बोडा ऄनुसररत की जान े वाली प्रदिया ऄवधकवथत करेगा। (8) आन पररवनयमों में दकसी बात के होते हुए भी, बोडा को “ऄनुमोददत” कायािमों के ऄधीन प्रवशवित व्यवियों की वनयुवियां ऐसी रीवत में करने की शवि होगी जैसी वह ठीक समझे और बोडा ऐसे “ऄनुमोददत” कायािमों की ऄनसु ूची बनाए रखेगा। (9) यदद पद ववज्ञापन द्वारा भरा जाना ह,ै पद के वनबंधन और शतें कुलसवचव द्वारा ववज्ञावपत की जाएंगी और ववज्ञापन म ें वववनर्ददष्ट तारीख के भीतर प्राप्त सभी अवेदनों पर चयन सवमवत द्वारा ववचार दकया जाएगा परन्त ु चयन सवमवत पयााप्त कारणों स े आस प्रकार वववनर्ददष्ट तारीख के पश्चात ् प्राप्त दकसी अवेदन पर ववचार कर सकेगी:II (i) 13 परंत ु यह और दक यदद बोड ा यह समुवचत समझता ह,ै वववभि पदों के वलए संस्थान की वेबसाआट पर ववज्ञापन वनकाला जाएगा और समय-समय पर, प्राप्त अवेदनों पर समुवचत ववभागीय सवमवतयों द्वारा ववचार दकया जा सकेगा और ईनकी वसफाररशें समय-समय पर, ऄवधकवथत प्रदिया के ऄनुसार समुवचत कारावाइ करन े के वलए वनदेशक को भेजी जा सकेंगी। (10) चयन सवमवत ईन सभी व्यवियों के प्रत्यय पत्रों की जांच करेगी वजन्होंन े अवेदन दकया ह ै और चयन सवमवत के दकसी सदस्य द्वारा सुझाए गए या सवमवत के ध्यान में ऄन्यथा लाये गये ऄन्य ईपयुि नाम, यदद कोइ हो, पर भी ववचार दकया जा सकेगा तथा चयन सवमवत दकसी भी ऄभ्यथी का, वजसे वह ठीक समझे, सािात्कार ल े सकेगी और ऄध्यि के ऄपन े वववेकानुसार सभी या कुछ ऄभ्यर्वथयों के वलए अयोवजत की जान े वाली वलवखत परीिा या परीिाए,ं वजनके ऄन्तगात मौवखक प्रस्तुवत ह,ै जैसा ऄध्यि ईवचत समझे, करवा सकेगी और यथावस्थवत, बोडा या वनदेशक को योग्यता के िम में िमबि करके चयवनत ऄभ्यर्वथयों के नामों सवहत ऄपनी वसफाररशें करेगी: परंत ु ईपरोि ईप-परवनयम (3) के खंड (ख) के ऄधीन गरठत चयन सवमवत तीन वष ा की अरवम्भक ऄववध के वलए, वजसे दो वष ा से ऄनवधक ऄववध के वलए और बढाया जा सकेगा, संववदा पर दकसी ऄभ्यथी को बाह्य काडर सहायक अचाय ा के रूप में वनयिु दकए जाने वाले ऄभ्यथी की वसफाररश कर सकेगी। (11) दकसी चयन सवमवत का कोइ काया या कायावाही चयन सवमवत के दकसी सदस्य के या सदस्यों की ईपवस्थवत के मात्र अधार पर प्रश्नगत नहीं की जाएगी: परंतु यदद चयन सवमवत की कोइ बैठक अवश्यक पाइ जाती ह ै तो कुलसवचव चयन सवमवत के सदस्यों को बैठक की तारीख से कम से कम पंरह ददन पहल े बैठक की सूचना दगे ा। (12) आन पररवनयमों के ऄधीन जब तक ऄन्यथा ईपबंवधत न हो, दकसी पद पर वनयुवि के वलए वसफाररशें करने के प्रयोजन के वलए गरठत चयन सवमवत ईस पद के संबंध में ऄपने कृत्यों का प्रयोग करने के वलए तब तक पात्र होगी जब तक वनयुवि नहीं कर दी जाती ह।ै (13) संस्थान के ऄधीन संकाय और शैिवणक पदों से वभि, दकसी पद के वलए अवेदन करने वाला ऄभ्यथी ऐसी अवेदन फीस से प्रभाररत होगा जो समय-समय पर, बोडा द्वारा ऄवधाररत की जाए: परंतु ऄनुसूवचत जावत और ऄनुसूवचत जनजावतयों और ववस्थावपत व्यवियों के ऄभ्यर्वथयों को अवेदन फीस के संदाय में ऐसी छूट प्रदान की जा सकेगी जो समय-समय पर, बोडा या सवमवत द्वारा वववनवश्चत की जाए। (14) संस्थान के ऄधीन दकसी पद के वलए सािात्कार हते ु चयवनत ऄभ्यर्वथयों को ऐसा यात्रा भत्ता संदत्त दकया जा सकेगा जो आस वनवमत्त समय-समय पर, बोडा द्वारा ऄवधाररत दकया जाए। (15) संस्थान में की गइ सभी वनयुवियां बोडा की ऄगली बैठक में बोड ाको ररपोटा की जाएगं ी स्थायी सकं मचा ाररयों 15. संस्थान के स्थायी संकमाचारी वनम्नवलवखत वनबंधनों और शतों द्वारा शावसत स्थायी संकमाचाररयों की सवे ा के की सेवा के वनबंधन और शत ें होंगे, ऄथाात्:- वनबधं न और शत ें (1) प्रत्येक वनयुवि आस शत ा के ऄध्यधीन होगी दक वनयुि दकए गए व्यवि को बोड ा द्वारा नामवनर्ददष्ट वचदकत्सा प्रावधकारी द्वारा स्वस्थ तथा भारत म ें कहीं भी सेवा करने के वलए शारीररक रूप से योग्य हो, प्रमावणत ह:ै14 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] परंत ु बोडा पयााप्त कारणों से दकसी वववशष्ट मामले या मामलों के वग ा में ऐसी शतों, यदद कोइ हों, जो बोडा द्वारा ऄवधकवथत की जाएं, के ऄधीन रहते हुए, वचदकत्सा सम्बन्धी ऄपेिाओं को वशवथल कर सकेगा। (2) आस ऄवधवनयम और पररवनयमों के ईपबंधों के ऄधीन रहते हुए, संस्थानों के ऄधीन ऐसे पदों पर सभी वनयुवियां मामूली तौर पर एक वषा की ऄववध के वलए पररवीिा पर की जाएंगी वजस ऄववध के पश्चात्, वनयुि दकया गया व्यवि, यदद पुष्ट हो जाता ह ै तो आस ऄवधवनयम और पररवनयमों के ऄधीन रहते हुए ऄपना पद ईस मास के ऄन्त तक धारण करता रहगे ा वजसमें वह समय-समय पर, पररषद और/या केन्रीय सरकार द्वारा यथा वववनवश्चत ऄवधवर्वषता की अयु प्राप्त कर लते ा ह:ै परंतु जहां बोड ा यह समझता ह ै दक छात्रों के वहत म ें और पी.एच.डी. के वलए रवजस्रीकृत छात्रों की वशिा और मागादशान के प्रयोजन के वलए, शैिवणक संकमचा ाररवृन्द का कोइ सदस्य पनु ःवनयोवजत दकया जाना चावहए तो बोडा ऐसे सदस्य को सेमेस्टर या शिै वणक सत्र की समावप्त तक, जैसा प्रत्येक मामले की पररवस्थवतयों म ेंईवचत समझा जाए, ऐस ेसदस्य को पुनर्वनयोवजत कर सकेगा: परंतु यह और दक जहां, यथावस्थवत, सेमेस्टर या शिै वणक सत्र की समावप्त से अगे दकसी ऐसे सदस्य को पुनर्वनयोवजत करना अवश्यक हो जाता ह ै वहां बोडा वववजटर के पूवा ऄनुमोदन से, ऐसे दकसी सदस्य को ऐसी ऄववध के वलए, जो अवश्यक समझी जाए, पनु र्वनयोवजत कर सकेगा और दकसी भी दशा म ें ईस शैिवणक सत्र की समावप्त से अगे नहीं, वजसमें वह सत्तर वषा की अयु प्राप्त कर लेता ह ैपरंतु यह भी दक दकसी भी पररवस्थवत म ें ऐसा सदस्य पीएचडी कायािम के वलए रवजस्रीकृत छात्रों के वशिण और मागादशान के प्रयोजन से वभि दकसी प्रयोजन के वलए पुनर्वनयोवजत नहीं दकया जाएगा। (3) दकसी संकमाचारी द्वारा दकसी भी समय बीस वष ा की ऄहका सेवा पूरी कर लेन े पर, वह वनयुवि प्रावधकारी को वलवखत म ें तीन मास स े ऄन्यनू की सूचना देकर केन्रीय सरकार द्वारा ईसके ऄपने संकमाचाररयों के वलए समय-समय पर, ऄवधकवथत वनबंधनों और शतों पर सेवावनवृत्त हो सकेगा। (4) वनयुवि प्रावधकारी को ऐसी ऄववध के वलए, जैसी अवश्यक पायी जाए, दकन्त ु दो वषा स े ऄनवधक की ऄववध के वलए वनयिु दकए गए दकसी व्यवि की पररवीिा की ऄववध को बढान े की शवि होगी परंतु यदद पररवीिा की ववस्ताररत ऄववध के पश्चात् वनयिु दकया गया व्यवि न तो पष्टु दकया गया ह ै और न ही ईसकी सेवाएं समाप्त की गईं ह,ैं वह ईसके पश्चात ्तीसवें ददन पष्टु दकया हुअ समझा जाएगा। (5) संस्थान का संकमाचारी ऄपना पूणा समय संस्थान की सेवा में लगाएगा और दकसी ऐसे व्यापार या कारबार या दकसी ऄन्य काया म,ें जो ईसके कताव्यों के ईवचत वनवाहन में व्यवधान ईत्पि करे, प्रत्यितः या ऄप्रत्यितः नहीं लगेगा परंतु यह वजान वनदेशक के पूवा ऄनुमवत से या समय-समय पर, बोडा द्वारा ऄवधकवथत प्रदियाओं के ऄनुसार दकए गए शैिवणक काया और परामशी व्यवसाय को लागू नहीं होगा। (6) वनयुवि प्रावधकारी को परीवीिा की ऄववध के दौरान सकं माचाररवृन्द के दकसी सदस्य की सेवाओं को वबना सूचना और ईनके वलए कोइ कारण बताए वबना समाप्त करन े की शवि होगी। (7) वनयुवि प्रावधकारी को तीन मास की सूचना देकर या ईसके बदले में तीन मास के वेतन के संदाय पर, यदद, बोड ा द्वारा नामवनर्ददष्ट वचदकत्सा प्रावधकारी द्वारा प्रमावणत हो जाता ह,ै सेवा में ईसका प्रवतधारण ऐसे वनयुवि प्रावधकारी द्वारा ऄवांछनीय समझा गया ह,ै संकमाचाररवृन्द के दकसी सदस्य की सेवाएं समाप्त करने की शवि होगी। (8) बोड ा को, सम्बि व्यवि को छह मास की वलवखत में सूचना देकर या ईसके बदल े म ें छह मास के वेतन का संदाय करन े पर, छंटनी या दकफायत के अधारों पर संकमाचाररवृन्द के दकसी सदस्य की सेवाएं समाप्त करने की शवि होगी। (9) संस्थान का कोइ संकमाचारी वनयुि प्रावधकारी को तीन मास की सूचना देकर ऄपनी वनयुवि समाप्त कर सकेगा परन्त ु वनयुवि प्रावधकारी पयााप्त कारणों से, या तो आस ऄववध को कम कर सकेगा या सम्बि संकमाचारी से ईस शैिवणक सत्र, वजसमें सूचना प्राप्त होती ह,ै की समावप्त तक बन े रहन े की ऄपेिा कर सकेगा।II (i) 15 (10) संस्थान म ें वनयुि संकमचा ाररवृन्द का सदस्य वनलवम्बत दकया जा सकेगा या पररवनयमों या दोनों में बनाइ गइ प्रदिया के ऄनुसार ईसके ववरूि ऄनुशासवनक कायावावहयां अरम्भ की जा सकेंगी। (11) संस्थान के संकमाचारी बोडा द्वारा समय-समय पर, ऄवधकवथत वेतन के ऄनुसार यात्रा और दैवनक भत्तों के हकदार होंगे। (12) संस्थान के संकमाचारी पररषद के पूवा ऄनुमोदन स े स्वयं पर और ऄपन े कुटुम्बों पर ईपगत वचदकत्सा व्ययों की प्रवतपूर्वत के वलए हकदार होंगे। (13) संस्थान के संकमाचारी अचरण वनयमों द्वारा शावसत होंग।े (14) संस्थान के दकसी वगा के संकमाचारी, जो दीघाावकाश के वलए हकदार ह,ैं के बारे में वनणया पररषद द्वारा दकया जाएगा। ऄस्थायी 16.(1) ऄस्थायी संकमाचारी की सेवा या तो संकमाचारी द्वारा वनयुि प्रावधकारी या वनयुि संकमचा ाररयों की प्रावधकारी द्वारा संकमाचारी को वलवखत म ें सूचना देकर दकसी भी समय समाप्त की जा सकती ह ै और सेवा के वनबधं न और ऐसी सूचना की ऄववध एक मास की होगी जब तक दक संस्थान और संकमाचारी द्वारा ऄन्यथा सहमवत शत ें न हो जाए । (2) ऐसे संकमाचारी की सेवा के ऄन्य वनबंधन और शतें वे होंगी जो ईसके वनयुवि पत्र में वनयुि प्रावधकारी द्वारा वववनर्ददष्ट की जाएं। ऐसे संकमाचाररयों की सेवा ऄन्य वनबंधन और शत ें व े होंगी जो ईसकी वनयुवि के पत्र म ेंवनयुवि प्रावधकारी द्वारा वववनर्ददष्ट की जाएं। संववदा पर 17. (1) आन पररवनयमों म ें ऄन्तर्ववष्ट दकसी बात के होत े हुए भी, बोड ा ववशेष पररवस्थवतयों में, पांच वष ा वनयवु ि से ऄनवधक की ऄववध, वजसमें ऄगली ऄववध के नवीकरण का ईपबंध भी होगा, के वलए संववदा पर दकसी प्रवतवष्ठत व्यवि को वनयिु कर सकेगा। परन्त ु प्रत्येक ऐसी वनयुवि और ईसके वनबंधन पररषद के ऄध्यि के पूवा ऄनुमोदन के ऄध्यधीन होंगे। (2) ऄवधवनयम में ऄन्तर्ववष्ट ईपबंधों के ऄधीन रहते हुए, बोडा दकसी व्यवि को वववहत वेतन मानों में तथा सुसंगत पदों को लाग ू वनबंधन और शतों पर, ऄवतररि ऄववध के नवीकरण के ईपबंध सवहत पांच वषा से ऄनवधक की ऄववध के वलए वनयिु कर सकेगा और ऐसी वनयुवियां करन े के वलए, ऄध्यि ऄपन े वववेकानुसार ऐसी तदथा चयन सवमवतयों का गठन कर सकेगा जो प्रत्येक मामले की पररवस्थवतयों म ें ऄपेवित हो। सेवावनवृवत्त 18. ऄवभदायी भववष्य वनवध-सह-ईपदान स्कीम, साधारण भववष्य वनवध-सह-पेंशन-सह-ईपदान स्कीम फायद े और पररभावषत ऄवभदान पेंशन स्कीम (नइ पशें न स्कीम 1 जनवरी, 2004 से प्रभावी) संस्थान के संकमाचाररयों के वलए गरठत की जाएगी, चलायी जाएगी और प्रशाररत भी की जाएगी। दीघावा काश 19. (1) संस्थान का प्रत्येक संकमाचारी दीघाावकाश और छुट्टी के वलए हकदार होगा। और छुट्टी (2) जब दकसी ऄन्य संस्थान या दकसी ऄन्य ववश्वववद्यालय या दकसी राज्य ववश्वववद्यालय या केन्रीय सरकार या राज्य सरकार के दकसी ऄन्य संस्थान या संगठन से कोइ संकमाचारी संस्थान या दकसी केन्रीय ववश्वववद्यालय में पदग्रहण करता ह ै तो ऐसे पदग्रहण करने की तारीख से ठीक पूवा की तारीख को और छुट्टी के संचयन की वववहत सीमा के ऄधीन रहत े हुए संस्थान या केन्रीय ववश्वववद्यालय म ें ईसके खाते में छुट्टी ऄग्रनीत की जाएगी और ईसके खात े में जमा की जाएगी: परंत ु आस प्रयोजन के वलए राज्य ववश्वववद्यालय या केन्रीय या राज्य सरकार का कोइ ऄन्य संस्थान या संगठन, वजससे कोइ संकमाचारी संस्थान में पदग्रहण करता ह,ै ऄग्रनीत की जाने वाले ऐसी छुट्टी के वलए छुट्टी वेतन दावयत्व का वनवाहन करेगा।16 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] संकमचा ाररवन्ृ द 20. संस्थान के संकमाचारी संस्थान के पररसर के भीतर गृह अबंटन, यदद कोइ ईपलब्ध हो, के वलए के वलए वनवास पात्र होंगे। स्थान यात्रा भत्ता 21. (1) These Statutes may be called the first statutes of the Indian Institute of Technology Commencement. (Indian School of Mines), Dhanbad, 2017. (2) They shall come into force on the date of their publication in the official Gazette. Definitions. 2. (1) In these Statutes unless the context otherwise requires - (a) “Act” means the Institutes of Technology Act, 1961 (59 of 1961 (b) “Authorities”, „Officers‟ and „Professors‟ respectively means the authorities, officers and professors of the Institute; (c) „Building and Works Committee‟ means the Building and Works Committee of the Institute; (d) “Centre” or “School” means an Academic Centre or School so established to carry out and facilitate academic or research activities or both leading to Bachelor‟s or Master‟s or Ph.D. degree; (e) “Central Government” means the Government of India; (f) “Chief Warden” in relation to the Hostels, means the Chief Warden thereof; (g) “Dean” means the Dean appointed by the Director; (h) “Department” means an Academic Department established to impart instructions and for carrying out research activities leading to Bachelor‟s or Master‟s degree or both and Ph.D. degrees; (i) “Finance Committee” means the Finance Committee of the institute; (j) “Head” in relation to a Department or Centre or School means the Head thereof; (k) “Hostel” means a Hostel for the residence of the students of the Institute ; (l) “Institute” means the Institute known as the Indian Institute of Technology (Indian School of Mines) Dhanbad, incorporated under the Act; (m) “Ordinances” means the Ordinances of the Institute; (n) “Senate” means the Senate of the Institute; (o) “Service Centre” means an Academic Service Centre so established to provide infrastructural or scientific or both and technical support to further and enhance academic and research activities; (p) “Warden” in relation to a Hostel of the Institute means a Warden thereof 2 (2) Words and expressions used herein and not defined or defined in the Act shall have the same meanings assigned to them in the Act.20 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Board of Governors. 3 (1) The Board shall lay down norms consistent with the overall policy frame work issued by the Central Government in regard to the following, namely:- (i) industrial consultancy; (ii) collaboration with Foreign and Indian Educational and Research Institutions; (iii) acceptance of Donations; (iv) academic Support to other Technical Institutions. (2) The Board shall lay down the policy regarding the limit of expenditure to be incurred and the approval thereof in case of minor and capital works and repair and maintenance of estate and works. Meeting. 4. The procedure for the constitution and the meetings of the Board shall be as follows, namely:- (a) The bodies entitled to nominate or elect representatives on the Board shall be invited by the Registrar to do so within a reasonable time not ordinarily exceeding eight weeks from the date on which he issues such invitations and the same procedure shall be followed for filling casual vacancies on the Board. (b) The Board shall meet as often as may be necessary but not less than twice during a calendar year. (c) Meetings of the Board shall be convened by the Chairman either on his own initiative or at the request of the Director or on a requisition signed by not less than three members of the Board. (d) Four members including one member from outside the Institute shall form a quorum for a meeting of the Board: Provided that if a meeting is adjourned for want of quorum, it shall be held on such a day, time and place, as the Chairman may determine, and if at such a meeting, a quorum is not present within half-an-hour from the time appointed for holding a meeting, the members present shall be a quorum. (e) All questions considered at the meetings of the Board shall be decided by a majority of the votes of the members present including the Chairman and if the votes be equally divided, the Chairman shall have a second or casting vote. (f) The Chairman, if present, shall preside at every meeting of the Board and in his absence, the members present shall elect one from amongst themselves to preside at the meeting. (g) A written notice of every meeting shall be sent by the Registrar to every member at least three weeks before the date of the meeting and the notice shall state the place, the date and time of the meeting: Provided that the Chairman may call a special meeting of the Board at short notice to consider urgent special issues. (h) The notice may be delivered either by hand or by speed or registered post at the address of each member as recorded in the office of the Board or by email and if so sent, shall be deemed to be duly delivered at the time at which notice would be delivered in the ordinary course of post. (i) Agenda shall be circulated by the Registrar to the members at least ten days before the meeting. (j) Notices of motions for inclusion of any item on the agenda must reach the Registrar at least one week before the meeting and the Chairman may, however, permit inclusion of any item for which due notice has not been received. (k) The ruling of the Chairman in regard to all questions of procedure shall be final.II (i) 21 (l) The minutes of the proceedings of a meeting of the Board shall be drawn up by the Registrar with the approval of the Chairman and circulated to all members of the Board present in India and the minutes along with amendments, if any suggested, shall be placed for confirmation at the next meeting of the Board and after the minutes are confirmed and signed by the Chairman, they shall be recorded in a minute book which shall be kept open for inspection of the members of the Board and the Council at all times during office hours. (m) If a member of the Board fails to attend three consecutive meetings without leave of absence from the Board he shall cease to be a member of the Board. (n) The Board may delegate such of its powers to the Director, as may be deemed appropriate by it, however, the Director shall report to the Board of the action taken by him at its next meeting. Authentication of 5. All orders and decisions of the Board shall be authenticated by the signature of the orders and decisions Registrar or any other person authorised by the Board in this behalf. of the Board. Senate. 6. (1) In addition to the persons mentioned in section 14 of the Act, the following shall be the members of the Senate, namely:- (a) the Heads of the Departments or Academic Centres or Schools other than Professors, as are not members of the Senate; (b) the Deans and Associate Deans other than Professors, as are not members of the Senate; (c) the Librarian of the Institute; (d) one Chief Warden by rotation to be nominated by the Director for a period of one year; (e) not more than six other members of the academic staff for their special knowledge appointed by the Chairman after consultation with the Director for such period as may be specified by the Chairman. (2) Subject to the provisions of the Act, the Senate shall have the power to:- (a) frame and revise curricula and syllabi for the courses of studies for the various Departments or Academic Centres or Schools; (b) make arrangements for the conduct of examinations, appoint examiners, moderators, tabulators and the like; (c) declare the results of the examinations or to appoint Committees or officers to do so and to make recommendations to the Board regarding conferment or grant of degrees, diplomas and other academic distinctions or titles; (d) appoint Advisory Committees or Expert Committees or both for the Departments and the Academic Centres or Schools of the Institute to make recommendation on academic matters connected with the working of the Department or Academic Centre or School and the Head of the Department concerned shall act as convenor of such Committees; (e) appoint Committees from amongst the members of the Senate, other teachers of the Institute and experts from outside to advise on such specific academic matters as may be referred to any such Committee by the Senate; (f) consider the recommendations of the Advisory Committee attached to various Departments or Academic Centres or Schools and that of Expert and other committees and take such action (including the making of recommendations to the Board) as circumstances of each may require; (g) make periodical review of the activities of the Departments and take appropriate22 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] action (including the making of recommendations to the Board); (h) supervise the working of the Library; (i) promote research within the Institute and require reports on such research from the persons engaged thereon; (j) provide for the inspection of the classes and the Hostels in respect of the instructions and discipline therein, supervise the co-curricular activities of the students of the Institute and submit reports thereon to the Board; (k) award stipends, scholarships, fellowships, medals and prizes and make other awards in accordance with the Ordinances and such other conditions as may be attached to the award; (l) make recommendations to the Board with regard to the creation of posts on the academic staff and the abolition thereof, and duties attached to such posts; (m) make recommendations to the Board with regard to the establishment of the Departments or Centres or Schools or Service Centres and the abolition thereof, and the allocation of academic and other staff to such Academic Departments or Centres or Schools or Service Centres; (n) provide support to other technical institutions in furtherance of their academic standards; (o) outreach through distance learning mode to enhance the academic and research productivity of the Institute. (3) The Senate shall meet as often as necessary, but not less than four times during a calendar year. (4) (a) Meetings of the Senate shall be convened by the Chairman of the Senate either on his own initiative or on a requisition signed by not less than 20% of the members of the Senate. (b) The requisitioned meeting shall be a special meeting to discuss only those items of agenda for which requisition is made. The requisitioned meeting shall be convened by the Chairman of the Senate on date and time convenient to him within fifteen days of the notice given for such a requisition. (5) One third of the total number of members of the Senate shall form a quorum for a meeting of the Senate. (6) The Director, if present, shall preside at every meeting of the Senate. In his absence, the Deputy Director shall preside and in the absence of both the Director and the Deputy Director, the senior-most of the Deans present shall preside at the meeting. In case none of the Deans are present, the senior-most of the Professors present shall preside at the meeting. (7) A written notice of every meeting, together with the agenda shall be circulated by the Registrar to the members of the Senate at least a week before the meeting and the Chairman of the Senate may permit inclusion of any item for which due notice could not be given. (8) Notwithstanding the provisions of sub-statute (7), the Director may call an emergency meeting of the Senate at short notice to consider urgent special issues. (9) The ruling of the Chairman of the Senate in regard to all questions of procedure shall be final. (10) The minutes of the proceedings of a meeting of the Senate shall be drawn up by the Registrar with the approval of the Chairman of the Senate and circulated to all theII (i) 23 members of the Senate present in India: Provided that any such minute shall not be circulated if the Senate considers such circulation prejudicial to the interests of the Institute and the minutes along with amendments, if any suggested, shall be placed for confirmation at the next meeting of the Senate and after the minutes are confirmed and signed by the Chairman of the Senate, they shall be recorded in the minute book which shall be kept open for inspection of the members of the Senate, the Board and the Council at all times during office hours. (11) In emergent cases the Chairman of the Senate may exercise the powers of the Senate and report to the Senate of the action taken by him at its next meeting for its approval. Finance Committee. 7. (1) The Finance Committee, shall be an authority of the Institute within the meaning of section 10 of the Act and it shall consist of the following members, namely:- (a) the Chairman, ex officio, who shall be the Chairman of the Finance Committee; (b) two persons nominated by the Central Government; (c) three persons nominated by the Board, and (d) the Director. (2) (a) The term of office of a member nominated under clauses (b) and (c) of sub-statute (1) above shall be three years from the 1st day of January of the year in which he is nominated. (b) The term of office of a member nominated to fill a casual vacancy shall continue for the remainder of the term of the member in whose place he has been nominated. (3) The Finance Committee shall perform the following functions, namely:- (a) to examine and scrutinise the annual budget of the Institute prepared by the Director and make recommendations to the Board; (b) to give its views and make its recommendations to the Board either on the initiative of the Board or of the Director, or on its own initiative of any financial question affecting the Institute; (c) to consider and make its recommendations to the Board on all such matters connected with the Institute as have financial implications. (4) The Finance Committee shall meet as often as may be necessary but at least twice a year. (5) Three members of the Finance Committee shall form a quorum for a meeting of the Finance Committee. (6) The Chairman, if present, shall preside at the meeting of the Finance Committee and in his absence, the members present shall elect one from amongst themselves to preside at the meeting. (7) The provisions in the above Statutes regarding notices of the meeting, inclusion of items in the agenda and confirmation of the minutes applicable to the meetings of the Board shall, so far as may be, be applicable in connection with the meetings of the Finance Committee. (8) A copy of the minutes of every meeting of the Finance Committee shall be sent to the Board.24 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] In emergent cases, the Chairman may exercise the powers of the Finance Committee (9) and report the action taken by him at the next meeting of the Finance Committee for its approval. The Building and Works Committee shall be an authority of the Institute within the Building and Works 8. (1) meaning of section 10 of the Act and it shall consist of the following members, Committee. namely:- (a) the Director, ex-officio, who shall be the Chairman of the Building and Works Committee; (b) the Deputy Director, ex officio; (c) the Professor in Charge Estate and Works, ex-officio; (d) one person nominated by the Central Government; (e) one Civil Engineer, not below the rank of Superintending Engineer, nominated by the Board from a Government Department or Agency; (f) one Electrical Engineer, nominated by the Board from a Government Department or Agency; (g) three Professors of the Institute with relevant specialisations, to be nominated by the Board; (h) the Institute Engineer, Ex-officio; (i) the Registrar, Ex-officio Secretary. (a) The term of office of an ex-officio member shall continue so long as he holds the (2) office by virtue of which he is a member. (b) The term of office of a member nominated under clauses (d), (e), (f) and (g) of sub-statute (1) above shall be two years from the 1st day of January of the year in which he is nominated. The Building and Works Committee shall perform the following functions and have (3) the following powers, namely:- (a) it shall be responsible under the direction of the Board for construction of all major capital works after securing from the Board the necessary administrative approval and expenditure sanction; (b) it shall have the power to give the necessary administrative approval and expenditure sanction for minor works and works pertaining to maintenance and repairs, within the expenditure limit approved by the Board and within the grant placed at the disposal of the Institute for the purpose; (c) it shall cause to be prepared estimates of cost of buildings and other capital works, minor works, repairs, maintenance and the like; (d) it shall be responsible for making technical scrutiny as may be considered necessary by it; (e) it shall be responsible for enlistment of suitable contractors and acceptance of tenders and shall have the power to give direction for departmental works where necessary; (f) it shall have the powers to settle rates not covered by tender and settle claims and disputes with contractors. The Building and Works Committee shall perform such other functions in the matter of (4) construction of buildings and development of land for the Institute as the Board may entrust to it from time to time. (5) In emergent cases, the Chairman of the Building and Works Committee may exercise the powers of the Building and Works Committee and such cases shall be reported by him to the Building and Works Committee at its next meeting.II (i) 25 (6) The Building and Works Committee shall meet as often as is necessary, but not less than twice a year. (7) Three members shall form a quorum for a meeting of the Building and Works Committee. (8) The provisions in these Statutes regarding notices of meeting, inclusion of items in the agenda and confirmation of the minutes applicable to the meetings of the Board shall, so far as may be, be applicable in connection with the meetings of the Building and Works Committee. (9) A copy of the minutes of every meeting of the Building and Works Committee shall be sent to the Board. Chairman. 9. (1) The Chairman shall have the power to fix on the recommendations of the Selection Committee, the initial pay of an incumbent at a stage higher than the minimum of the scale in respect of posts to which appointments can be made by the Board under the provisions of the Act. (2) The Chairman shall have the power to send members of the staff of the Institute for training or for a course of instruction outside India subject to such terms and conditions as may be laid down by the Board from time to time. (3) The Chairman shall execute the Contract of Service between the Institute and the Director: Provided that the Chairman shall not be personally liable in respect of anything under such contract. (4) In emergent cases, the Chairman may exercise the powers of the Board and inform the Board of the action taken by him for its approval in its next meeting. Director. 10. (1) The Director appointed, under the provisions of Section 17 (1) of „The Institutes of Technology Act, 1961‟ as amended from time to time, by the Council with the prior approval of the Visitor, on contract for a period of five years or till he or she attains the age of seventy (70) years, whichever is earlier shall have power to incur expenditure in accordance with the procedure as may be laid down by the Board from time to time subject to the budget provisions made for the specific purpose. (2) The Director shall have the power to reappropriate funds with respect to different items constituting the recurring budget up to such limit for each item as may be determined by the Board from time to time: Provided that such reappropriation shall not involve any liability in future years. Every such reappropriation shall, as soon as possible, be reported to the Board. (3) The Director shall have the power to waive recovery of overpayment up to such limit as may be determined by the Board from time to time, made to a member of the staff, not detected within twenty-four months of payment. Every such waiver shall, as soon as possible, be reported to the Board. (4) The Director shall have the power to write off irrecoverable losses and irrecoverable value of stores lost or rendered unserviceable due to fair, wear and tear on the recommendation of a Standing Committee appointed by the Board for such purpose subject to such financial limit, as may be specified by the Board from time to time. (5) The Director shall have the power to fix, on the recommendation of the Selection Committee, the initial pay of an incumbent at a stage higher than the minimum of the scale, but not involving more than five increments, in respect of such posts to which appointment can be made by him as stipulated by the Board in accordance with the Act.26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] (6) The Director shall have the power to employ technicians and workmen paid from contingencies involving such emoluments as may be stipulated by the Board from time to time. (7) The Director shall have the power to send the members of the staff for training or for a course of instruction inside India subject to such terms and conditions as may be laid down by the Board from time to time. (8) The Director shall have the power to sanction remission or reduction of rent for buildings rendered wholly or partially unsuitable. (9) The Director shall have the power to sanction temporary allocation of any building for any purpose other than that for which it was constructed. (10) In exceptional cases, subject to availability of funds, the Director shall have the power to create temporary posts with the approval of the Chairman, of not more than two years‟ duration on approved scales of pay under report to the Board provided that no such post, of which the Director is not the appointing authority, shall be so created. (11) The Director shall have the power of a Head of Department for purposes of rules in the Account Code, the Fundamental and Supplementary Rules and other rules of the Government in so far as they are applicable or may be made applicable to the conduct of the business of the Institute. (12) If, for any reason, the Registrar is temporarily absent for a period not exceeding one month, the Director may take over, or assign to any member of the staff of the Institute, any of the functions of the Registrar as he deems fit: Provided that if, at any time, the temporary absence of the Registrar exceeds one month the Board may, if it thinks fit, authorize the Director to take over or assign the function of the Registrar as aforesaid, for a period exceeding one month. (13) The Director may, during his absence from the headquarters, authorise the Deputy Director or one of the Deans or the senior most Professor present, to sanction advances for travelling allowance, contingencies and medical treatment of the staff and sign and countersign bills on his behalf and authorise him for assuming such powers of the Director as may be specifically delegated to the Deputy Director or one of the Deans or the senior most Professor present, by him in writing. (14) The Director may, at his discretion, constitute such Committees as he may consider appropriate. (15) In the event of the occurrence of any vacancy in the office of the Chairman by reason of his death, resignation, or otherwise or in the event of the Chairman being unable to discharge his functions owing to absence, illness or any other cause, the Director may discharge the functions assigned to the Chairman under Statute 9. Deputy Director. 11. (1) The Deputy Director shall be appointed by the Director from amongst the Professors of the Institute with the prior approval of the Chairman, on such terms and conditions as may be decided by the Board from time to time and the Deputy Director shall be entitled to additional monetary benefit as may be prescribed/approved by the Government of India, from time to time. (2) The Deputy Director shall assist the Director in academic and administrative work and in maintaining liaison with other institutions of higher learning and research and also with industrial undertaking and other employers. Deans. 12. (1) The Director may appoint Deans and Associate Deans to assist him in discharging his duties and responsibilities, in consultation with the Chairman.II (i) 27 (2) The Deans and Associate Deans shall be appointed by the Director from amongst the teachers for a period of three years and they shall hold their offices at the pleasure of the Director. (3) The Deans and the Associate Deans shall be deemed to be the officers of the Institute and will enjoy such powers and perform such duties as may be delegated to them by the Director with the prior approval of the Board and the Associate Deans shall normally assist the respective Deans in the performance of their duties. (4) The Deans and Associate Deans shall be entitled to additional monetary benefit as may be prescribed or approved by the Government of India, from time to time. Classification of the 13. (1) Except in the case of employees paid from contingencies, the employees of the employees of the Institute shall be classified as:- Institute. (a) Academic Staff - which shall include Director, Deputy Director, Professor, Associate Professor, Assistant Professor, Librarian, Deputy Librarian, Assistant Librarian, System Manager, Senior Programmer, System Analyst, Programmer, Research Engineer or Computer Engineer, Workshop Superintendent, Assistant Superintendent Workshop, Chief Scientific Officer, Principal Scientific Officer, Senior Scientific Officer, Scientific Officer and such other academic posts as may be decided by the Board from time to time. (b) Technical Staff - which shall include Institute or Campus Engineer, Assistant Institute or Campus Engineer, Junior Engineer, Technical Officer, Foreman, Assistant Foreman, Senior Laboratory Assistant, Laboratory Assistant, Senior Technical Assistant, Technical Assistant, Telephone Operator, Driver, Senior Pharmacist, Pharmacist, Staff Nurse, Dresser, Physical Training Instructor, Assistant Coach and such other technical posts as may be decided by the Board from time to time. (c) Administrative and other Staff - which shall include Registrar, Deputy Registrar, Assistant Registrar, Estate Officer, Security Officer, Horticulturist, Public Relations Officer, Chief Medical Officer, Medical Officer, Sports Officer, Assistant Sports Officer, Counsellor, Assistant Counsellor, Personal Secretary, Personal Assistant, Superintendent, Assistant, Upper Divisional Clerk, Lower Divisional Clerk, Senior Stenographer, Stenographer, Senior Store Keeper, Store Keeper, Multitasking Staff and such other administrative and other staff as may be decided by the Board from time to time. (2) Notwithstanding the above classification, the Board may map the post or change the classification in accordance with the directions of the Council. Appointments. 14. (1) All posts at the Institute shall normally be filled by advertisement but the Board shall have the power to decide, on the recommendations of the Director, that a particular post be filled by invitation or by promotion from amongst the members of the staff of the Institute. (2) The Institute shall make necessary provisions for the reservation of posts as laid down by the Board in accordance with the directives of the Council from time to time and while making appointments to such posts, the appointing authority shall consistently uphold the maintenance of efficiency of administration and the teaching at the Institute. (3) The Selection Committees for filling up of posts under the Institute (other than the posts on contract basis) by advertisement or by promotion from amongst the members of staff of the Institute shall be constituted in the manner laid down below, namely:- (a) In the case of posts of Professors and equivalent posts in scientific, design and computer staff cadres, the Selection Committee shall consist of the following28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] members, namely:- (i) The Director : Chairman; (ii) One nominee of the Visitor : Member; (iii) Two nominees of the Board, one being an expert, but : Members; other than a member of the Board. (iv) One expert, other than a member of the Senate, : Member. nominated by the Senate. (b) In the case of posts of Associate Professor, Assistant Professor, equivalent posts in scientific, design and computer staff cadres, and the posts of Librarian, Deputy Librarian and Assistant Librarian and such other academic posts as the Board may decide from time to time the Selection Committee shall consist of the following members, namely:- (i) The Director : Chairman; (ii) Two nominees of the Board one being an expert, but : Members; other than a member of the Board (iii) One expert, other than a Member of the Senate, : Member; nominated by the Senate, and (iv) The Head of the Department/Academic Centre/School : Member; concerned, if the post for which selection is made is lower in status than that occupied by the Head of the Department/Academic Centre/School (v) The Chairman, Library Advisory Committee of the : Member. Institute, for the posts of Librarian, Deputy Librarian and Assistant Librarian (c) In the case of posts of Registrar, Deputy Registrar, Assistant Registrar, Institute Engineer, Sports Officer, Assistant Sports Officer, Chief Medical Officer and Medical Officer, the Selection Committee shall consist of the following members, namely:- (i) The Director : Chairman; (ii) The Deputy Director : Member; (iii) Two nominees of the Board as Experts : Member; (iv) The Registrar, except for the post of Registrar. : Member. (d) In the case of other Group „A‟ posts not covered by clause (a), (b) or (c) above and carrying a scale of pay the maximum of which exceeds the amount specified by the Central Government from time to time, the Selection Committee shall consist of the following members, namely:- (i) The Director or his nominee : Chairman; (ii) A nominee of the Board : Member; (iii) The Head of the Department/ Centre/School concerned or Registrar as the case may be : Member; (iv) An expert from the staff of theII (i) 29 Institute nominated by the Director. : Member. (e) In the case of other posts not covered by clause (a), (b), (c) or (d) above and carrying a scale of pay the maximum of which exceeds the amount specified by the Board from time to time, the Selection Committee shall consist of the following members, namely:- (i) The Director or his nominee : Chairman; (ii) A nominee of the Board : Member; (iii) The Head of the Department/ Academic Centre concerned or the Registrar as the case may be : Member; (iv) An expert from the staff of the Institute nominated by the Director : Member. (f) In the case of all other posts, the Director may at his discretion, constitute such Selection Committees as may be considered appropriate by him. Note : 1. The Chairman of a Selection Committee may invite one or more additional experts from approved panels to assist the Selection Committee. 2. The Selection Committee for appointments to the posts reserved for Scheduled Caste or Scheduled Tribe and OBC candidates shall include one SC/ST member and one OBC member, respectively, from a panel approved by the Director. (4) In the absence of the Director, any member of the staff of the Institute, who is appointed to perform the current duties of the Director, shall be the Chairman of the Selection Committees in the place of the Director. (5) In the absence of the Deputy Director, the Director may nominate any member of the staff of the institute to work on the Selection Committees in his place. (6) Where a post is to be filled on contract basis or by invitation, the Chairman may, at his discretion, constitute such ad-hoc Selection Committees, as circumstances of each case may require. (7) Where a post is to be filled by promotion from amongst the members of the Institute or temporarily for a period not exceeding twelve months, the Board shall lay down the procedure to be followed. (8) Notwithstanding anything contained in these Statutes, the Board shall have the power to make appointments of persons trained under “approved” programmes in such manner as it may deem appropriate and the Board shall maintain a schedule of such “approved” programmes. (9) If the post is to be filled by advertisement, the terms and conditions of the post shall be advertised by the Registrar and all applications received within the date specified in the advertisement shall be considered by the Selection Committee, provided that the Selection Committee may for sufficient reasons consider any application received after the date so specified: Provided further that if the Board considers it appropriate, there shall be an advertisement on the website of the Institute for various posts and the applications received from time to time may be considered by the appropriate Departmental Committees and their recommendations sent to the Director for taking appropriate action in accordance with the procedure laid down by the Board from time to time. (10) The Selection Committee shall examine the credentials of all persons who have applied and may also consider other suitable names suggested, if any, by a member of30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] the Selection Committee or brought otherwise to the notice of the Committee and the Selection Committee may interview any of the candidates, as it thinks fit and shall, at the discretion of its Chairman, cause a written test or tests including an oral presentation to be held for all or some of the candidates as the Chairman may think fit, and shall make its recommendations to the Board or the Director, as the case may be, with the names of the selected candidates being arranged in order of merit: Provided that the Selection Committee constituted under clause (b) of sub-statute (3) above, may recommend a candidate to be appointed as ex-cadre Assistant Professor on Contract for an initial period of three years which may be further extended for a period not exceeding two years. (11) No act or proceeding of any Selection Committee shall be called in question on the ground merely of the absence of any member or members of the Selection Committee: Provided that, if any meeting of the Selection Committee is found necessary, the Registrar shall give notice of the meeting to the members of the Selection Committee at least a fortnight before the date of the meeting. (12) Unless otherwise provided for under these Statutes, a Selection Committee constituted for the purpose of making recommendations for appointment to a post shall be eligible to exercise its functions in relation to that post until the time the appointment is made. (13) A candidate applying for a post other than faculty and academic posts under the Institute shall be charged such application fees as may be determined by the Board from time to time: Provided that the candidates belonging to the Scheduled castes and Scheduled tribes and displaced persons may be granted such concessions in the payment of application fees as may be decided by the Board or Council from time to time. (14) Candidates selected for interview for a post under the Institute may be paid such travelling allowance as may be determined by the Board from time to time in this behalf. (15) All appointments made at the Institute shall be reported to the Board at its next meeting. Terms and 15. The permanent employees of the Institute shall be governed by the following terms Conditions of and conditions, namely:- Service of (1) Every appointment shall be subject to the condition that the appointee is certified as Permanent being in sound health and physically fit for service in India by a medical authority Employees. nominated by the Board: Provided that the Board may, for sufficient reasons, relax the medical requirements in any particular case or class of cases, subject to such conditions, if any, as may be laid down by the Board. (2) Subject to the provisions of the Act and the Statutes, all appointments to such posts under the Institutes shall ordinarily be made on probation for a period of one year after which period the appointee, if confirmed, shall continue to hold his office subject to the provisions of the Act and the Statutes, till the end of the month in which he attains the age of superannuation as decided by the Council and/or the Central Government from time to time: Provided that where the Board considers that in the interest of the students and for the purpose of teaching and guiding the students registered for the Ph.D. programme, any member of the academic staff should be reemployed, it may reemploy such a member till the end of the semester or the academic session as may be considered appropriate in the circumstances of each case: Provided further that where it becomes necessary to reemploy any such memberII (i) 31 beyond the end of the semester or academic session as the case may be, the Board may, with the previous approval of the Visitor, re-employ any such member for such period as may be deemed necessary and in no case exceeding the end of the academic session in which he attains the age of seventy years. Provided also that in no circumstances such member shall be reemployed for any purposes other than those of teaching and guiding the students registered for the Ph.D. programme. (3) At any time after an employee has completed twenty years‟ qualifying service, he may, by giving notice of not less than three months in writing to the appointing authority, retire from service on the terms and conditions laid down by the Central Government from time to time for its own employees. (4) The appointing authority shall have the power to extend the period of probation of any appointee for such periods as may be found necessary but not exceeding two years, provided that if, after the extended period of probation, the appointee is neither confirmed nor his services terminated, he shall, on the 30th day thereafter, be deemed to have been confirmed. (5) An employee of the Institute shall devote his whole time to the service of the Institute and shall not engage, directly or indirectly, in any trade or business or any other work which may interfere with the proper discharge of his duties provided the bar shall not apply to academic work and consultative practice undertaken with the prior permission of the Director, or in accordance with the procedures laid down by the Board from time to time. (6) The appointing authority shall have the power to terminate the services of any member of the staff without notice and without any cause assigned thereto during the period of probation. (7) The appointing authority shall have the power to terminate the services of any member of the staff by three months‟ notice or on payment of three months‟ salary in lieu thereof, if, on medical grounds, certified by the medical authority nominated by the Board, his retention in service is considered undesirable by such appointing authority. (8) The Board shall have the power to terminate the services of any member of the staff on grounds of retrenchment or economy by giving to the person concerned six months‟ notice in writing or on payment of six months‟ salary in lieu thereof. (9) An employee of the Institute may terminate his engagement by giving the appointing authority three months‟ notice, provided that the appointing authority may for sufficient reasons, either reduce this period or call upon the employee concerned to continue till the end of the academic session in which the notice is received. (10) A member of the staff appointed at the Institute may be placed under suspension or disciplinary proceedings may be started against him as per the procedure made in Statutes or both. (11) The employees of the Institute shall be entitled to travelling and daily allowances according to the scales laid down by the Board from time to time. (12) The employees of the Institute shall be entitled to reimbursement of medical expenses incurred on themselves and their families with the prior approval of the Council. (13) The employees of the Institute shall be governed by the Conduct rules. (14) It shall be for the Council to decide as to the class of employees of the Institute who shall be entitled to vacation. Terms and 16. (1) The service of a temporary employee shall be liable to termination at any time by32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Conditions of notice in writing given either by the employee to the appointing authority, or by the Service of appointing authority to the employee and the period of such notice shall be one month, Temporary unless otherwise agreed to by the Institute and the employee. Employees. (2) The other terms and conditions of service of such employee shall be such as may be specified by the appointing authority in his letter of appointment. Appointment on 17. (1) Notwithstanding anything contained in these Statutes, the Board may, in special Contracts. circumstances appoint an eminent person on Contract for a period not exceeding five years, with a provision of renewal for further periods: Provided that every such appointment and the terms thereof shall be subject to the prior approval of the Chairman of the Council. (2) Subject to the provisions contained in the Act, the Board may appoint any person on contract in the prescribed scales of pay and on the terms and conditions applicable to the relevant posts for a period not exceeding five years with a provision of renewal for further period and for making such appointments, the Chairman may, at his discretion, constitute such ad-hoc Selection Committees, as the circumstances of each case may require. Retirement Benefits. 18. A Contributory Provident Fund-cum-Gratuity Scheme, a General Provident Fund- cum-Pension-cum-Gratuity Scheme and a Defined Contribution Pension Scheme (new pension scheme effective from 1st day of January 2004) shall be constituted, maintained and administered for the employees of the Institute. Vacation and Leave. 19. (1) Every employee of the Institute shall be entitled to vacation and leave. (2) When an employee joins the Institute or a Central University from any of the other institutes or any Central University or any State University or any other Institute/Organisation of the Central/State Government, the leave to his credit on the date immediately before the date of such joining shall be carried forward and credited to his leave account in the Institute or the Central University subject to the prescribed limit of accumulation of leave: Provided that for this purpose the State University or any other Institute/Organization of the Central/State Government from which an employee joins the Institute will discharge the leave salary liability for such leave to be carried forward. Residential 20. The employees of the Institute shall be eligible for allotment of a house within the Accommodation for campus of the Institute, if available. Staff. Travelling 21. (1) The members of the Board and other Authorities of the Institute and the members of Allowance. the Committees constituted under the Act or these Statutes or appointed by the Board and other Authorities, other than Government employees and employees of the Institute, shall be entitled to such travelling allowance and daily allowance for attending the meetings of the Authorities and the Committees as may be laid down by the Board from time to time. (2) The members of the Board and other Authorities of the Institute and the Committees, who are Government employees, shall receive travelling allowance and daily allowance from the source from which they draw their salaries at the rates admissible to them: Provided that if, required by the members, the Institute shall reimburse the Travelling allowance or Dearness allowance as laid down by the Board from time to time, to the members concerned if they declare that they shall not claim Travelling allowance or Dearness allowance from any other source. Departments, 22. (1) The Institute shall have the following Departments, namely:-II (i) 33 Centres and Service (a) Applied Chemistry; Centres. (b) Applied Geology; (c) Applied Geophysics; (d) Applied Mathematics; (e) Applied Physics; (f) Chemical Engineering; (g) Civil Engineering; (h) Computer Science and Engineering; (i) Electrical Engineering; (j) Electronics Engineering; (k) Environmental Science and Engineering; (l) Fuel and Mineral Engineering; (m) Humanities and Social Sciences; (n) Management Studies; (o) Mechanical Engineering; (p) Mining Engineering; (q) Mining Machinery Engineering; (r) Petroleum Engineering: Provided that the Board may, on the recommendation of the Senate create or modify or abolish any Department or merge it with another Department. (2) The Institute shall have the following Academic and Service Centres, namely:- (a) Centre for Innovation, Incubation and Academic Centre; Entrepreneurship (b) Centre for Renewable Energy Academic Centre; (c) Centre of Excellence in Safety, Academic Centre; Occupational Health and Disaster Management (d) Centre for Clean Coal Technology Academic Centre; (e) Centre for Water Resource Management Academic Centre; (f) Centre of Excellence in Mining Academic Centre; Technology (g) Key Resource Centre for Water And Academic Centre; Sanitation (h) Australia-India Joint Research Centre on Academic Centre; Clean Coal & Energy Technology (i) Executive Development Centre Academic Centre; (j) Central Library Academic Service Centre; (k) Computer Centre Academic Service34 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)] Centre; (l) Industry Institute Interaction Facility, Academic Service Kolkata Centre; (m) Industry Institute Interaction Facility, Academic Service New Delhi Centre; (n) Central Research Facility Academic Service Centre; (o) Centre for Societal Mission Service Centre: Provided that the Board may, on recommendation of the Senate, establish or abolish any Centre or Service Centre or merge it with another Centre or Service Centre or a Department or convert it into a Department. Head of the 23. (1) Each Department of the Institute shall be placed in charge of a Head who shall be Department. selected by the Director from amongst the Professors and Associate Professors in such manner as may be laid down by the Board from time to time. Each Centre or School or Service Centre of the Institute shall be placed in charge of a Head who shall be selected by the Director from amongst the Professors or Associate Professors, Chief Scientific Officers or Principal Scientific Officers, Chief Design Engineers or Principal Design Engineers or Librarian in the Centre or School or Service Centre or in a cognate Department or Centre or School in such manner as may be laid down by the Board from time to time: Provided that when in the opinion of the Director the situation so demands, the Director may himself take temporary charge of a Department or Centre or School or Service Centre or place it under the charge of the Deputy Director or a Professor from another Department or Centre for a period not exceeding six months. (2) The Head of the Department or Centre or School or Service Centre shall be responsible for the entire working of the Department or Centre or School or Service Centre, subject to the general control of the Director. (3) It shall be the duty of the Head of the Department or Centre or School or Service Centre to see that the decisions of the authorities of the Institute and of the Director are faithfully carried out. He shall perform such other duties as may be assigned to him by the Director. Institution of 24. Consistent with the decisions of the Council and the policies laid down by the Central Fellowships, Government, from time to time, the Institute, shall institute and award such stipends, Scholarships, fellowships, scholarships, exhibitions, medals, prizes and other awards to be awarded Exhibitions, Medals to the undergraduate, postgraduate, research and post-doctoral students for different and Prizes. academic programmes as may be prescribed by the Ordinances. Fees and Award of 25. (1) The Institute shall charge such fees from the undergraduate, postgraduate, Fee Waivers. research and post-doctoral students for different academic programmes as may be determined by the Board consistent with the decision of the Council and the policies laid down by the Central Government from time to time: Provided that the Institute shall also award fee waivers to the students and research scholars in accordance with the decision of the Board and consistent with the policy of the Central Government and directions of the Council from time to time. (2) The procedure for the deposition of fees, delay fine, entry or deletion of the names from the rolls of the academic programmes of the Institute, and such other matter as may be decided by the Senate, shall be laid down in the Ordinances.II (i) 35 Hostels. 26 (1) (a) The Institute shall build and maintain Hostels and the students, including research students may reside in the Hostels built in the Institute and Institute may frame Ordinances for the purpose from time to time. (b) The students who do not reside in the Hostels shall not be required to pay any charge that is recoverable from the students residing in the hostels e.g. establishment charges, mess subsidy charges, room rent, electricity charges, etc. (2) Every student residing in the Hostels and those living outside the Institute campuses shall conform to the Standing Orders laid down by the Senate for the purpose. (3) For each Hostel, there may be a Chief Warden, and such number of Wardens or Assistant Wardens and other staff as may be laid down by the Board and the procedure of the appointment of the Chief Warden, Warden or Assistant Warden and other staff in the Hostel, the entitlement of facilities, if any, and the allowances payable to them, if any, shall be such as may be specified in the Ordinances. Conferment of 27. All proposals for the conferment of honorary degrees shall be made by the Senate and Honorary Degrees. shall require the assent of the Board before submission to the Visitor for confirmation : Provided that in cases of urgency, the Chairman may submit on behalf of the Board, such proposal to the Visitor.
