ब्यरू ो धनयम, 1987 के धनयम-13 की िजरज (चक) के अनुसरण म ेंभजरतीय मजनक ब्यरू ो से परजमशा करने के पश्चजत ्धनम्नधलधखत आदशे र्जरी करती ह,ै अर्जात ् :- 1. संधिप्त नजम और प्रजरम्भ – (1) इस आदशे कज संधिप्त नजम सोलर फोटो वोल्टेइक प्रणजधलयज,ाँ उपकरण और संघटक मजल (अधनवजया रधर्स्रीकरण के धलए आवश्यकतजए)ं आदेश, 2017 ह।ै (2) यह आदेश सरकजरी रजर्पत्र में इसके प्रकजशन की तजरीख से 1 वर्ा की अवधि के अवसजन पर प्रवृत्त होगज। 2. पररभजर्जएं – (1) इस आदेश म ेंर्ब तक दक संदभा में अन्द्यर्ज अपेधित न हो, (क) “अधिधनयम” से भजरतीय मजनक ब्यूरो अधिधनयम, 1986 (1986 कज 63) अधभप्रेत ह;ै (ख) “समधचत प्रजधिकजरी” से कोई अधिकजरी र्ो नवीन और नवीकरणीय ऊर्जा मंत्रजलय यज इसके अिीनस्र् यज संबद्ध कजयजालयों के धनदेशक यज वैज्ञजधनक ‘एफ’ से नीचे की पंधि कज न हो, धर्से सधचव नवीन और नवीकरणीय ऊर्ज ामंत्रजलय, भजरत सरकजर द्वजरज प्रजधिकृत दकयज गयज हो, अधभप्रेत ह;ै (ग) “मजल” से अनुसूची के स्तम्भ (2) म ें धवधनर्दष्टा सोलर फोटो वोल्टेइक प्रणजधलयों, उपकरणों अर्वज संघटक मजल अधभप्रेत ह;ै (घ) “धनयमों” से भजरतीय मजनक ब्यरू ो धनयम, 1987 अधभप्रेत है; (ङ) “अनुसूची” से इस आदेश से उपजबद्ध अनुसूची अधभप्रेत ह;ै (च) “उत्पजदों की रृंृंखलज” स े उसी पररवजर के उत्पजद अधभप्रेत ह ैं लदे कन र्ो आकजर यज रेटटंग यज धनमजाण म ें अलग- अलग हों; 5528 दकसी भजरतीय मजनक धवशेर् कज प्रधतधनधित्व करन े हते ु ब्यरू ो द्वजरज यर्ज धनिजाररत भजरतीय मजनक प्रमजणन धचह्न अधभप्रेत ह।ै (2) उन शब्दों और पदों कज, र्ो यहजाँ प्रयुि ह ैं दकन्द्तु पररभजधर्त नहीं ह,ै वही अर् ा होगज र्ो उनकज क्रमशः अधिधनयम यज इसके अन्द्तगता बनजए गए धनयमों म ेंह।ै 3. मजल के धवधनमजाण, भंडजरण, धबक्री, धवतरण आदद के बजरे में धनर्ेि – (1) कोई धवधनमजातज र्ो मजल कज धवधनमजाण, धबक्री के धलए भंडजरण, धबक्री यज धवतरण करतज ह,ै अनुसूची के स्तम्भ (3) में उधल्लधखत भजरतीय मजनक के संबंि में मजनक धचह्न कज प्रयोग करने के धलए रधर्स्रीकरण प्रजप्त करन े हते ु ब्यूरो में आवेदन करेगज। (2) ब्यूरो द्वजरज रधर्स्रीकरण अधिधनयम और धनयमों के प्रजविजनों और उनके अंतगात बनजए गए धवधनयमों के अनुसजर प्रदजन दकयज र्जएगज। (3) कोई व्यधि स्वयं अर्वज अपनी ओर से दकसी व्यधि के मजध्यम से ऐसे मजल कज धवधनमजाण यज धबक्री के धलए भडं जरण, आयजत, धबक्री यज धवतरण नहीं करेगज र्ो धवधनर्दष्टा मजनक के अनरूु प नहीं ह ैऔर ऐसे मजल पर ब्यूरो से रधर्स्रीकरण अधभप्रजप्त करने के पश्चजत् समय-समय पर ऐसे मजल के धलए ब्यूरो द्वजरज अधिसूधचत मजनक धचह्न नहीं हःै परन्द्त ुइस आदेश की कोई बजत धनयजात के धलए आशधयत मजल के धवधनमजाण के संबंि म ेंलजगू नहीं होगी। (4) अवमजनक यज त्रुरटपूण ा मजल र्ो अनुसूची के स्तम्भ (3) में उधल्लधखत धवधनर्दष्टा मजनक के अनरूु प नहीं ह,ै को धवधनमजातज द्वजरज उपयोगजतीत धवरूधपत दकयज र्जएगज और उनकज व्ययन धवधनमजातज अर्वज धवदेशी धवधनमजातज के प्रधतधनधि द्वजरज भजरत म ें धस्र्त संपका कजयजालय अर्वज शजखज कजयजालय अर्वज धवधनमजातज द्वजरज भजरत म ें अपन े प्रजधिकृत प्रधतधनधि के रूप म ेंअधिकृत दकसी एर्ेंसी द्वजरज स्क्रैप के रूप में दकयज र्जएगजः परन्द्त ु भेर्ी गई ऐसी सजमग्री धर्स पर दकसी के द्वजरज दजवज न दकयज गयज हो, को समुधचत प्रजधिकजरी द्वजरज प्रजधिकृत ऐसे दकसी धवभजग अर्वज एर्ेंसी द्वजरज स्क्रैप मजल के रूप म ेंधवरूधपत और व्यधयत दकयज र्जएगज। 4. सूचनज इत्यजदद मजंगन े की शधि – (1) समचुत प्रजधिकजरी यज उसके द्वजरज प्रजधिकृत कोई व्यधि इस आदशे कज अनुपजलन सुधनधश्चत करने के दधृ ष्ट स े धवधनमजाण, धबक्री के धलए भंडजरण, दकसी मजल की धबक्री यज धवतरण में लगे व्यधि से धवधनमजाण, धबक्री के धलए भंडजरण आयजत, दकसी मजल की धबक्री अर्वज धवतरण से संबंधित ऐसी सूचनज, र्ो भी वह आवश्यक समझे, देने यज दकसी ऐसे व्यधि से मजल के नमनू े उपलब्ि करजन े की अपिे ज कर सकेगज। (2) नवीन और नवीकरणीय ऊर्ज ा मंत्रजलय म ें सधचव द्वजरज नजम धनर्दष्टा समुधचत र्ष्ठे स्तर पर प्रत्येक बजर दकसी प्रजधिकजरी के धवधशष्ट आदेश से समुधचत प्रजधिकजरी अर्वज उसके द्वजरज प्रजधिकृत व्यधि इस आदेश कज सुधनधश्चत अनुपजलन करने की दधृ ष्ट से ------ (क) धवधनमजाण, धबक्री के धलए भंडजरण, आयजत, मजल की धबक्री अर्वज धवतरण म ें लग े दकसी व्यधि स े संबंधित अर्वज उसके कब्र्े में यज उसके धनयंत्रणजिीन दकसी पुस्तक अर्वज अन्द्य दस्तजवेर् और अन्द्य मजल यज संघटक पुर्े अर्वज उसके द्वजरज रखी र्जन े वजल े दकसी मजल की सजमग्री कज भी धनरीिण कर सकेगज अर्वज करज सकेगज; (ख) दकसी पररसर में प्रवेश कर सकेगज एवं उसकी तलजशी ले सकेगज तर्ज ऐसे मजल कज अधभग्रहण कर सकेगज धर्सकी बजबत उसके पजस यह धवश्वजस करने कज कजरण ह ैदक इस आदेश कज उल्लघं न दकयज गयज ह ैयज उि मजल धवधनर्दष्टा मजनकों के अनुरूप नहीं ह।ै (3) तलजशी और अधभग्रहण से संबधं ित दण्ड प्रदक्रयज संधहतज, 1973 (1974 कज 2) के उपबंि र्हजं तक हो सके, इस खण्ड के अिीन तलजशी और अधभग्रहण को लजगू होंगे 5. नमूनज लेनज और उसकज परीिणः- 1) र्हजं मजल धवधभन्न आकजर, रेटटंग, दकस्मों आदद कज ह,ै वहज ं ऐसे उत्पजदों को समूहबद्ध दकयज र्जएगज और प्रधतधनधिक प्रधतरूपों के परीिण के आिजर पर उत्पजदों की रृंृंखलज के धलए रृंृंखलज अनुमोदन दकयज र्ज सकेगज। 2) आदेश कज कजयजान्द्वयन करते समय रृंृंखलज अनुमोदन संबंिी धवधनश्चय नवीन और नवीकरणीय ऊर्जा मंत्रजलय यज इसकी प्रजधिकृत एर्ेंधसयों द्वजरज धलयज र्जएगज।II (i) 3 3) रधर्स्रीकृत उपयोिज के मजल कज नमूनज समधचत प्रजधिकजरी यज उसके द्वजरज प्रजधिकृत व्यधि द्वजरज उसकी धवधनमजाण इकजई यज बजर्जर से यह अधभधनधश्चत करने के धलए धलयज र्जएगज दक वे धवधनर्दष्टा मजनकों के अनुरूप ह ैंयज नहीं: परन्द्त ुयदद आवश्यक हो तो नमनू े ब्यरू ो यज इसके प्रजधिकृत प्रधतधनधियों द्वजरज भी धलए र्ज सकेंगे। 4) नमूने प्रदत्त रधर्स्रीकरण के ित्रे के अंतगात आने वजल े उत्पजद अर्वज उत्पजद की रृंृंखलज के धलए दो वर् ा म ें कम से कम एक बजर धलए र्जएगं े। 5) चुने र्जने वजले स्र्जन और उत्पजद कज चयन यजदधृ छछक रूप से दकयज र्जएगज। 6) प्रदत्त रधर्स्री के संभजधवत िेत्र में आन े वजल े उत्पजदों की रेंर् म ें स े कम स े कम एक नमून े को परीिण के धलए चुनज र्जएगज। 7) इस तरह से धलए गए नमून े को दकसी भी प्रकजर के नुकसजन स े बचजने के धलए समुधचत रूप स े मुहरबंद दकयज र्जएगज और रधर्स्री संयायज, सैंपल धलए र्जने की तजरीख, बजर्जर नमूने यज धवधनमजाण इकजई नमूने के रोतोत, नमूनज लेन े वजल े व्यधि कज तीन अंकीय कोड और पहचजन संयायज, यदद मजल पर दी गई हो, तो लेबल के रूप में नमून ेपर उपदर्शात दकयज र्जएगज। परन्द्त ु र्हजं नमूनज धवधनमजाण यधू नट से धलयज गयज ह,ै वहजं परीिण के धलए भेर्े र्जने वजले नमूने के अधतररि उसी बैच अर्वज लॉट स े अन्द्य नमूनज भी धलयज र्जएगज और उसे भी मुहरबंद दकयज र्जएगज और उस पर भी लेबल लगजयज र्जएगज और उसे प्रधत नमूनज के रूप में रधर्स्री उपयोिज के पजस पश्चजतवती दकसी धववजद की धस्र्धत म ेंप्रयोग हते ु रखज र्जएगज। 8) इस तरह से धलए गए मुहरबंद और लेबलयिु नमनू े को समुधचत प्रजधिकजरी यज उसके द्वजरज प्रजधिकृत व्यधि द्वजरज ब्यरू ो की ओर से स्र्जधपत यज मजन्द्यतज प्रजप्त प्रयोगशजलज में परीिण के धलए यह उपदर्शात करन े वजल े अनुरोि के सजर् भेर्ज र्जएगज दक नमूने की र्जंच धवधनर्दष्टा मजनक की सभी आवश्यकतजओं की बजबत की र्जए और र्जंच ररपोट ासमुधचत प्रजधिकजरी को भेर्ी र्जएगी। 9) सभी र्जंच ररपोटों की नमून े की अनुरूपतज के धलए धवधनर्दष्टा मजनकों की सभी आवश्यकतजओं की बजबत र्जंच की र्जएगी। 10) अनुरूप नमूने की र्जंच ररपोट ा समुधचत प्रजधिकजरी के पजस सुरधित रहगे ी और अननुरूप नमूने की र्जंच ररपोटा को एक पखवजडे के भीतर समुधचत प्रजधिकजरी द्वजरज ब्यरू ो को आगजमी कजरावजई हते ु भर्े ज र्जएगज। 11) समुधचत प्रजधिकजरी कजयावजही की प्रजधस्र्धत से संबंधित र्जनकजरी को अपनी वेबसजइट पर भी उपलब्ि करजएगज। 6. धवधनमजातजओं को धनदेश र्जरी करन े की शधि – समुधचत प्रजधिकजरी, इस आदेश के प्रयोर्न को पूरज करजन े के धलए अधिधनयम, धनयम यज इस आदशे के उपबंिों के संगत, र्ो भी आवश्यक हो, धवधनमजातजओं को धनदेश र्जरी कर सकेंगे। 7. धनदेशों कज अनुपजलन – प्रत्येक धवधनमजातज, धर्से इस आदेश के अिीन कोई धनदेश र्जरी दकयज र्जतज ह,ै वह ऐसे धनदेश कज अनुपजलन करेगज। 8. र्जनकजरी उपलब्ि करजन े की बजध्यतज – कोई भी धवधनमजातज खण्ड 4 के अिीन धवधिपूवाक मजंगी गई र्जनकजरी दने े से इंकजर नहीं करेगज यज अपने स्वजधमत्व यज धनयंत्रणजिीन दकसी पुस्तक यज संबंधित दस्तजवेर् को नष्ट, धवकृत यज धवरूधपत नहीं करेगज और कोई र्जनकजरी नहीं छुपजएगज।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART सलजहकजर/वैज्ञजधनक ‘र्ी’ MINISTRY OF NEW AND RENEWABLE ENERGY ORDER New Delhi, the 30th August, 2017 S.O. 2920(E).— In exercise of the powers conferred by clause (p) of sub section (1) of section 10 of the Bureau of Indian Standards Act, 1986 (63 of 1986) and in pursuance of clause (fa) of rule 13 of the Bureau of Indian Standards Rules, 1987, the Central Government, after consulting the Bureau of Indian Standards, hereby makes the following Order, namely:-II (i) 5 1. Short title and commencement - (1) This Order may be called the Solar Photovoltaics, Systems, Devices and Components Goods (Requirements for Compulsory Registration) Order, 2017. (2) It shall come into force on the expiry of one year from the date of its publication in the Official Gazette. 2. Definitions - (1) In this Order, unless the context otherwise requires - (a) “Act” means the Bureau of Indian Standards Act, 1986 (63 of 1986); (b) “Appropriate Authority” means any officer, not below the rank of Director or Scientist ‘F’, of the Ministry of New and Renewable Energy or its sub-ordinate or attached offices, authorised by the Secretary, Ministry of New and Renewable Energy, Government of India; (c) “Goods” means the Solar Photovoltaics Systems, Devices or Components goods specified in the column (2) of the Schedule; (d) “Rules” means the Bureau of Indian Standards Rules, 1987; (e) “Schedule” means the Schedule annexed to this Order; (f) “Series of products” means the products of the same family but varying in sizes or rating or construction; (g) “Specified Standard” in relation to Goods means the Indian Standard as specified in column (3) of the Schedule. (h) “Standard Mark” means the Bureau of Indian Standards Certification Mark as specified by the Bureau to represent a particular Indian Standard. (2) Words and expressions used herein and not defined but defined in the Act and the rules made there under, shall have the meanings respectively assigned to them in the Act and those rules. 3. Prohibition regarding manufacture, storage, sale, distribution, etc. of Goods- (1) Any manufacturer, who manufactures, stores for sale, sells or distributes Goods shall make an application to the Bureau for obtaining registration for use of the Standard Mark in respect of the Indian Standard mentioned in column (3) of the Schedule. (2) The grant of registration by the Bureau shall be as per the provisions of the Act and Rules and Regulations made thereunder. (3) No person shall by himself or through any person on his behalf manufacture or store for sale, import, sell or distribute Goods which do not conform to the Specified Standard and do not bear the Standard Mark as notified by the Bureau for such Goods from time to time after obtaining registration from the Bureau: Provided that nothing in this Order shall apply in relation to manufacture of Goods meant for export. (4) The substandard or defective Goods which do not conform to the Specified Standard mentioned in column (3) of the Schedule shall be deformed beyond use and disposed of as a scrap by the manufacturer or the representative of overseas manufacturer from liaison office or branch office located in India or by any agency authorised by the manufacturer as its authorised representative in the India: Provided that unclaimed consignment of such Goods shall be deformed and disposed of as scrap by such department or agency as may be authorised by the Appropriate Authority. 4. Power to call for information, etc.- (1) The Appropriate Authority or a person authorised by it may, with a view to secure compliance with this Order, require any person engaged in the manufacture, storage for sale, sale or distribution of any Goods to give such information as the said Authority deems necessary relating to the manufacture, storage for sale, import, sale or distribution of any Goods or require any such person to furnish to it samples of Goods. (2) With the specific order each time of an Authority at an appropriate senior level nominated by the Secretary in the Ministry of New and Renewable Energy, the Appropriate Authority or person authorised by it, with a view to secure compliance with this Order may also- (a) inspect or cause to be inspected any books or other document and other Goods or the components or materials of any Goods kept by or belonging to or in the possession or under the control of any person engaged in the manufacture, storage for sale, import, sale or distribution of Goods;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] (b) entry and search any premises and seize Goods in respect of which it has reason to believe that a contravention of this order has been committed or the said Goods are not complying to the specified standard. (3) The provisions of the Code of Criminal Procedure, 1973 (2 of 1974) relating to search and seizure shall so far as may be, apply to searches and seizures under this paragraph. 5. Drawing and testing of sample.- (1) Where the Goods have different sizes, ratings, varieties, etc., such Goods shall be grouped and may be granted series approval for a Series of products based on testing of representative models. (2) A decision concerning series approval shall be taken by the Ministry of New and Renewable Energy or its authorised agencies while implementing this order. (3) The sample of Goods of the registered user shall be drawn from his manufacturing unit or from the market by the Appropriate Authority or person authorised by it for ascertaining whether they conform to the Specified Standard: Provided that if required, samples may also be drawn by the Bureau or its authorised representatives. (4) The samples shall be drawn at least once in two years for a product or Series of products covered under the scope of registration granted. (5) The location and the product to be picked up shall be selected randomly. (6) At least one sample from the range of products covered in the scope of registration granted shall be picked up for testing. (7) The sample so drawn shall be properly sealed to protect it from any damage and labelled indicating the registration number, the date of the drawl of sample, the source of the market sample or manufacturing unit sample, a three-letter code of the person drawing the sample and the identification number, if any, given on the Goods: Provided that where the sample drawn from the manufacturing unit, in addition to the sample to be sent for testing, another sample from the same batch or lot shall also be drawn, sealed and labelled, and left with the registered user as a counter sample, for use in case of any subsequent dispute. (8) The sample so drawn, sealed and labelled, shall be sent by the Appropriate Authority or person authorised by it for testing to a laboratory established or recognised by the Bureau along with a request indicating that the sample shall be tested with respect to all the requirements of the Specified Standard and the test report shall be sent to the Appropriate Authority. (9) All the test report shall be scrutinised for conformity of the sample with respect to the requirements of the Specified Standard. (10) The test report of the conforming sample shall be retained by the Appropriate Authority and the test report of the non-conforming sample shall be sent to the Bureau by Appropriate Authority within a fortnight for further action. (11) The Appropriate Authority shall also make available the information regarding the status of processing on its website. 6. Power to issue directions to manufacturers.- The Appropriate Authority may issue such directions to manufactures, consistent with the provisions of the Act, Rules and this Order, as may be necessary, for carrying out the purposes of this Order. 7. Compliance of directions.- Every manufacturer to whom any direction is issued under this Order shall comply with such direction. 8. Obligation to furnish information.- No manufacturer shall refuse to give any information lawfully demanded from him under paragraph 4 or conceal, destroy, mutilate or deface any book or document relating thereto in his possession or control.II (i) 7 SCHEDULE Sl.
