अ(cid:29)मता संिहता, 2016 (2016 का 31) क) धारा 240 के साथ प.ठत धारा 196 क) उपधारा (1) के खंड (न) 3ारा 4द5 शि6य7 का
4योग करते 9ए, भारतीय (cid:4)दवाला और शोधन अ(cid:29)मता बोड(cid:15) (कारपोरेट <ि6य7 के िलए (cid:4)दवाला समाधान 4(cid:4)=या) िविनयम, 2016 का
संशोधन करने के िलए िन>िलिखत िविनयम बनाता है, अथा(cid:15)त्: -
1. (1) इन िविनयम7 का संि(cid:29)B नाम भारतीय (cid:4)दवाला और शोधन अ(cid:29)मता बोड (cid:15) (कारपोरेट <ि6य7 के िलए (cid:4)दवाला समाधान
4(cid:4)=या) (दसू रा संशोधन) िविनयम, 2018 ह ै।
(2) ये 1 अ4ैल, 2018 को 4वृ5 ह7गे ।
2. भारतीय (cid:4)दवाला और शोधन अ(cid:29)मता बोड(cid:15) (कारपोरेट <ि6य7 के िलए (cid:4)दवाला समाधान 4(cid:4)=या) िविनयम, 2016 (िजGहH इसमH
इसके पIात् मूल िविनयम कहा गया ह)ै के िविनयम 3 के उप-िविनयम (1) के खंड (ग) के उपखंड (i) मH ‘कंपनी सिचव’ शJद7 के Kथान पर
‘सिचवीय लेखापरी(cid:29)क’ शJद रखे जाएंगे ।
3. मूल िविनयम7 के िविनयम 33 मH, KपLीकरण के Kथान पर िन>िलिखत KपLीकरण रखा जाएगा, अथा(cid:15)त् ::::----
““““%%%%पपपप&&&&ीीीीककककररररणणणण—इस िविनयम के 4योजन7 के िलए, “<य” के अंतग(cid:15)त अंत.रम समाधान <ावसाियक को संद5 क) जाने वाली
फ)स, (cid:4)दवाला <ावसाियक संKथा को, य(cid:4)द कोई ह,ै संद5 क) जाने वाली फ)स और <ावसाियक7 को, य(cid:4)द कोई हO, संद5 क) जाने वाली
फ)स और अंत.रम समाधान <ावसाियक 3ारा उपगत (cid:4)कए जाने वाले अGय <य भी आते ह O।”
4. मूल िविनयम7 के िविनयम 34 मH, KपLीकरण के Kथान पर िन>िलिखत KपLीकरण रखा जाएगा, अथा(cid:15)त:्-
““““%%%%पपपप&&&&ीीीीककककररररणणणण—इस िविनयम के 4योजन7 के िलए, “<य” के अंतग(cid:15)त समाधान <ावसाियक को संद5 क) जाने वाली फ)स,
(cid:4)दवाला <ावसाियक संKथा को, य(cid:4)द कोई ह,ै संद5 क) जाने वाली फ)स और <ावसाियक7 को, य(cid:4)द कोई ह,O संद5 क) जाने वाली फ)स
और समाधान <ावसाियक 3ारा उपगत (cid:4)कए जाने वाले अGय <य भी आते ह O।”

5. मूल िविनयम7 मH, िविनयम 34 के पIात् िन>िलिखत िविनयम अंतःKथािपत (cid:4)कया जाएगा, अथा(cid:15)त:्-
“34क. लागत का 4कटन – यथािKथित, अंत.रम समाधान <ावसाियक या समाधान <ावसाियक, (cid:4)दवाला समाधान 4(cid:4)=या
लागत को ऐसी रीित मH, जैसी बोड(cid:15) 3ारा अपे(cid:29)ा क) जाए, मदवार 4कट करेगा”
6. मूल िविनयम7 मH, िविनयम 35 के पIात् िन>िलिखत िविनयम अंतःKथािपत (cid:4)कया जाएगा, अथा(cid:15)त्:-
“35क. समाधान आवेदक क) पहचान - समाधान <ावसाियक, (cid:4)दवाला 4(cid:4)=या 4ारंभ होने क) तारीख से 105वH (cid:4)दन या उससे
पूव(cid:15) 4Uयािशत समाधान आवेदक7 क) पहचान करेगा ।”
7. मूल िविनयम7 क) अनुसूची के 4Wप क मH, 4िविL 8 और 9 के Kथान पर िन>िलिखत 4िविLयां रखी जाएंगी, अथा(cid:15)त्:-
“8. अंत.रम समाधान <ावसाियक के Wप मH काय(cid:15) करने वाले (cid:4)दवाला <ावसाियक का नाम और
रिजKXीकरण संYयांक
9. बोड(cid:15) के पास यथा-रिजKXीकृत अंत.रम समाधान <ावसाियक का पता और ईमेल पता
10. अंत.रम समाधान <ावसाियक के साथ पZ-<वहार के िलए 4योग मH लाया जाने वाला पता
और ईमेल पता, य(cid:4)द वह =म सं. 9 मH (cid:4)दए गए पते और ईमेल पते से िभ[ ह ै।

Regulations, 2018
No. IBBI/2017-18/GN/REG030.ÑIn exercise of the powers conferred by clause (t) of sub-section (1) of section
196 read with section 240 of the Insolvency and Bankruptcy Code, 2016 (31 of 2016), the Insolvency and Bankruptcy
Board of India hereby makes the following regulations further to amend the Insolvency and Bankruptcy Board of India
(Insolvency Resolution Process for Corporate Persons) Regulations, 2016, namely: -
1. (1) These regulations may be called the Insolvency and Bankruptcy Board of India (Insolvency Resolution
Process for Corporate Persons) (Second Amendment) Regulations, 2018.
(2) They shall come into force on 1st April, 2018.
2. In the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons)
Regulations, 2016, (hereinafter referred to as the principal regulations), in regulation 3, in sub-regulation (1), in
clause (c), in sub-clause (i), for the words “company secretaries”, the words “secretarial auditors” shall be
substituted.
3. In the principal regulations, in regulation 33, for the Explanation, the following Explanation shall be substituted,
namely: -
“Explanation. - For the purposes of this regulation, “expenses” include the fee to be paid to the interim resolution
professional, fee to be paid to insolvency professional entity, if any, and fee to be paid to professionals, if any,
and other expenses to be incurred by the interim resolution professional.”
4. In the principal regulations, in regulation 34, for the Explanation, the following Explanation shall be substituted,
namely: -
“Explanation. - For the purposes of this regulation, “expenses” include the fee to be paid to the resolution
professional, fee to be paid to insolvency professional entity, if any, and fee to be paid to professionals, if any,
and other expenses to be incurred by the resolution professional.”.
5. In the principal regulations, after regulation 34, the following regulation shall be inserted, namely: -
“34A. Disclosure of Costs. - The interim resolution professional or the resolution professional, as the case may
be, shall disclose item wise insolvency resolution process costs in such manner as may be required by the
Board.”.
6. In the principal regulations, after regulation 35, the following regulation shall be inserted, namely: -
“35A. Identification of Resolution Applicant.- The resolution professional shall identify the prospective
resolution applicants on or before the 105th day from the insolvency commencement date.”.
7. In the principal regulations, in the Schedule, in Form A, for entries 8 and 9, the following entries shall be
substituted, namely: -

8. In the principal regulations, in the Schedule, in Form B, for the Affidavit and Verification, the following shall

CREDITOR” shall be substituted;
(b) for the Affidavit and Verification, the following shall be substituted, namely: -

1. [Name of corporate debtor], the corporate debtor was, at the insolvency commencement date, being
