(क)
‘अिधिनयम’ से भारतीय मानक (cid:7)य ूरो अिधिनयम, 1986 (1986 का 63) अिभ(cid:14)ेत ह:ै
(ख)
‘उपयु2त (cid:14)ािधकारी’ से कोई ऐसा अिधकारी अिभ(cid:14)ेत ह-ै
(i)
िजसका "त र इ"प ात मं*ालय म, अवर सिचव के "त र से कम न हो:
(ii)
रा5य सरकार(cid:21) के िजला उ6ोग के(cid:3)(cid:5) (cid:21) के महा (cid:14)बंधक:

परंतु िनयात(cid:28) के िलए अपेि1त ऐस े "ट ेनलेस इ"प ात उ(cid:16)प ाद(cid:21) के िनयात(cid:28) के संबंध म , इस आदशे क(cid:10) कोई भी
बात लागू नहL होगी जो िवदशे ी खरीददार(cid:21) (cid:11)ारा अपेि1त -कसी अ(cid:3)य िविनदशP न के अनु<प हो।
(2) अवमानक अथवा दोषपूण(cid:28) "ट ेनलेस इ"प ात उ(cid:16)प ाद(cid:21) , जो िविनEदFट मानक के अनु<प न ह(cid:21), को "A ैप
के <प म, भारतीय मानक (cid:7)य रू ो क(cid:10) जांच एवं परी1ण योजना के अनुसार िनपटाया जाएगा।

भारतीय मानक (cid:7)य ूरो को आवदने (cid:14)"त ुत कर,गे।
(2) भारतीय मानक (cid:7)य ूरो (cid:11)ारा मानक िच(cid:3)ह के (cid:14)योग के िलए लाइस,स क(cid:10) मंजूरी अिधिनयम और उसके
अधीन बनाए गए िनयम(cid:21) और िविनयम(cid:21) के उपबंधो के अनुसार दी जाएगी।
(3) जब कोई 9य ि(cid:20) "व यं अथवा अपनी ओर से -कसी 9य ि(cid:20) के (cid:11)ारा "ट ेनलेस इ"प ात उ(cid:16)प ाद(cid:21) के िविनमा(cid:28)ण
का (cid:14)"त ाव करता ह ै तो वह मानक िच(cid:3)ह के (cid:14)योग के िलए भारतीय मानक (cid:7)य ूरो से िविधमा(cid:3)य लाइस,स
(cid:14)ाNत करने के बाद ही िनयिमत उ(cid:16)प ादन (cid:14)ारंभ करेगा।

सुिनिSत करन े हते ु िलए गए -कसी "ट ेनलेस इ"प ात उ(cid:16)प ाद के नमूने का भारतीय मानक (cid:7)य रू ो (cid:11)ारा
अनुमो-दत (cid:14)योगशाला म, ऐसी रीित से परी1ण -कया जाएगा, जो संबंिधत भारतीय मानक म, िविनEदFट
हो।

को ऐस े िनदशे जारी कर सकेगा जो अिधिनयम के (cid:14)ावधान(cid:21) अथवा जो इस आदशे के अनु<प ह(cid:21) और इस
आदशे के (cid:14)ावधान(cid:21) को -Aयाि(cid:3)वत करने के िलए आव(cid:29)य क ह(cid:21)।
8. ििििननननददददशशशश**** &&&& ककककाााा अअअअननननपपुुपपुु ााााललललनननन.— अनुसूची म, -दए गए -कसी "ट ेनलेस इ"प ात उ(cid:16)प ाद के िविनमा(cid:28)ण, िबA(cid:10) के िलए
भंडारण, िबA(cid:10) अथवा िवतरण म, लगा (cid:14)(cid:16)य के 9य ि(cid:20), िजसको इस आदशे के तहत कोई िनदशP जारी -कया
गया हो, ऐसे िनदशP का अनपु ालन करेगा।
9. ससससचचूूचचूू ननननाााा ददददननननेेेे ेे ेे कककक(cid:28)(cid:28)(cid:28)(cid:28) अअअअििििननननववववााााययययतततत(cid:24)(cid:24)(cid:24)(cid:24) ाााा.— कोई भी िविनमा(cid:28)ता अथवा डीलर इस आदशे के उपबंध(cid:21) क(cid:10) अवहले ना करन े

ORDER
New Delhi, the 10th June, 2016
S. O. 2061(E).—In exercise of the powers conferred by section 14 of the Bureau of Indian
Standards Act, 1986 (63 of 1986), the Central Government after consulting the Bureau of Indian
Standards hereby makes the following Order, namely:—
1. Short title and commencement.— (1) This Order may be called the Stainless Steel Products
(Quality Control) Order, 2016.
(2) This Order shall come into force after three months from the date of publication in the
official Gazette.
2. Definitions.— In this Order, unless the context otherwise requires, -
(a) “Act” means the Bureau of Indian Standards Act, 1986 (63 of 1986);
(b) “appropriate authority” means, -
(i) an officer not below the rank of an Under Secretary in the Ministry of Steel;
(ii) General Managers, District Industries Centers of State Governments;
(iii) Directors or Commissioners of Industries of the State Governments or
Union territories; and

( c) “dealer”, in relation to stainless steel products, means a person who, or a firm or a Hindu
undivided family or a company or a co-operative society which, carries on, directly or
otherwise, the business of buying, selling, supplying or distributing stainless steel products,
whether in cash or for deferred payment or for commission, remuneration or other valuable
consideration;
(d) “ITC(HS) Codes”, in relation to the Steel and Steel Products, mean the Indian Trades
Classification (Harmonised Systems) Codes as specified in the entries in Column (4) of the
Schedule:
(e) “manufacturer”, in relation to stainless steel products, means a person who, or a firm or a
Hindu undivided family or a company or a co-operative society which, produces, makes,
assembles or manufactures stainless steel products and includes a person who, or a firm or
Hindu undivided family or a company or a co-operative society which claims such stainless
steel products to be produced, made, assembled or manufactured by such person or firm or
Hindu undivided family or a company or a co-operative society, as the case may be;
(f) “Schedule” means the Schedule annexed to this Order;
(g) “specified standard”, in relation to stainless steel products means the Indian Standard specified
in the entries in column (2) of the Schedule;
(h) “State Government” in relation to a Union territory, means the Administrator thereof;
(i) “Stainless steel products” mean the items specified in column (3) of the Schedule as covered
in the specified Indian Standards in column (2) ;
(j) words and expressions used herein and not defined but defined in the Act shall have the
meanings respectively assigned to them in the Act
3. Prohibition regarding manufacture, storage, sale, distribution etc.— (1) No person shall
by himself or through any person on his behalf manufacture or store for sale, sell or distribute
any stainless steel product specified in the Schedule, which do not conform to the specified
standards and do not bear Standard Mark of the Bureau of Indian Standards on obtaining
certification marks license:
Provided that nothing in this Order shall apply in relation to export of stainless steel
products required for export, which conform to any other specification required by the foreign
buyer.
(2) The sub-standard or defective stainless steel products, which do not conform to the
specified standard, shall be disposed off as scrap as per the scheme of testing and inspection of
the Bureau of Indian Standards.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]
4. Obligation for certification.— (1) All manufacturers of stainless steel products shall make
an application to the Bureau of Indian Standards for obtaining the licence and to maintain it
thereafter for use of the Standard Mark if not already obtained.
(2) The grant of licence by the Bureau of Indian Standards for use of the Standard Mark
shall be as per the provisions of the Act and rules and regulations made there under.
(3) When any person by himself or through any person on his behalf proposes to
manufacture stainless steel products, he shall commence regular production only after
obtaining a valid licence from Bureau of Indian Standards for the use of the Standard
Mark.
5. Power to call for information, etc.— The appropriate authority may, with a view to
securing compliance with this Order,-
(a) require any person engaged in the manufacture, storage for sale, sale or
distribution of any stainless steel product to give such information as he deems
necessary relating to the manufacture, storage for sale, sale or distribution of
any stainless steel product for the implementation of this Order or require any
such person to furnish to him samples of any such stainless steel products;
(b) inspect or cause to be inspected any books or other documents and other
stainless steel products kept by or belonging to or in the possession or under
the control of any person engaged in the manufacture, storage for sale, sale or
distribution of any stainless steel product.
6. Testing of samples.— Samples of any stainless steel product bearing the Standard Mark and
drawn by the appropriate authority, for ascertaining whether they conform to the specified
standard, shall be tested in the laboratory approved by the Bureau of Indian Standards and as
specified in the relevant Indian Standard.
7. Power to issue direction to manufactures and dealers.— The appropriate authority may
issue such directions to manufacturers and dealers, consistent with the provisions of the Act or
this Order, as may be necessary for carrying out the provisions of this Order.
8. Compliance of directions.— Every person engaged in the manufacture, storage for sale, sale
or distribution of any stainless steel product specified in the Schedule to whom any direction
is issued under this Order, shall comply with such direction.
9. Obligation to furnish information.— No manufacturer or dealer shall with intent to evade
the provisions of this Order, refuse to give any information lawfully demanded from him
under paragraph 5 or conceal, destroy, mutilate or deface any books or documents or any
