सा.का.जन. 387(अ).—आयुर्वेद जिक्षण एर्वं अनुसंधान संस्ट्थान अजधजनयम, 2020 (2020 का 16) की धारा 27
द्वारा प्रदत्त िजियों का प्रयोग करते हुए केंद्रीय सरकार, आयर्वु ेद जिक्षण एर्वं अनुसंधान संस्ट्थान, आयुर्वेद, योग र्व प्राकृ जतक
जिककत् सा, यूनानी, जसद्ध और होम् योपैथी मंत्रालय के जलए एतदद्वारा जननलिजलजखत जनयम ानाती ह,ै अथाात:्-
1. संजक्षप्त नाम और प्रारंभ - (1) इन जनयमों का संजक्षप्त नाम आयुर्वेद जिक्षण एर्व ंअनुसंधान संस्ट्थान जनयम, 2021 ह।ै
(2) ये जनयम रािपत्र म ेंउनके प्रकािन की तारीख को प्रर्वृत्त होंगे।
2. पररभाषा - इन जनयमों म,ें िा तक कक संदभा स ेअन्यथा अपेजक्षत न हो,-
(क) ‘‘अजधजनयम" से आयुर्वेद जिक्षण एर्वं अनुसंधान संस्ट्थान अजधजनयम, 2020 (2020 का 16) अजभप्रेत ह;ै
(ख) ‘‘संस्ट्थान" स ेअजधजनयम की धारा 3 के खंड (ि) के अधीन यथा पररभाजषत संस्ट् थान अजभप्रेत ह;ै
(ग) ‘‘अध् यक्ष" से अजधजनयम की धारा 8 की उपधारा (1) के अधीन यथा पररभाजषत अध् यक्ष अजरि प्रेत ह;ै
(घ) ‘‘जनयमों" से अजधजनयम की धारा 27 के अधीन केंद्रीय सरकार द्वारा ानाए गए जनयम अजरि पर ्ेत ह।।

3. सस्ट्ं थान की िजिया ाँऔर काया - संस्ट्थान जननलिजलजखत कायों का जनष्प ादन करेगा –
(i) संस्ट् थान के समर क कायों और प्रगजत का मागादिान, पयार्वेक्षण और देखरेख।
(ii) संस्ट्थान के र्वार्षाक खातों और र्वार्षाक ररपोर्ा को मंिूरी देगा।
(iii) केंद्रीय सरकार के पूर्वा अनुमोदन से जर्वजनयम ानाएगा।
(iv) केंद्रीय सरकार के पूर्वा अनुमोदन से संस्ट्थान के सभी या ककसी भी जनयम या जर्वजनयम या सजमजत को ानाएगा
अथर्वा संिोधन करेगा अथर्वा जनरस्ट् त करेगा, इस िता के अध्यधीन रहत े हुए कक यह अजधजनयम अथर्वा जनयम
के जर्वपरीत नहीं होंगे।
(v) संस्ट्थान के ककसी भी काया के जनर्वाहन में ककसी िजि का उपयोग करने या ककसी ऐसे मामले में, िो संस्ट् थान
द्वारा उन्ह ें भेिा िाए, के ाारे में पूछताछ करन े या ररपोर्ा करने या सलाह देने के जलए स्ट्थायी सजमजतयों और
तदथ ासजमजतयों का जर्वजनयमों द्वारा जर्वजनर्दष्टा तरीके से गठन करेगा।
(vi) संस्ट्थान के कामकाि के संिालन के जलए ऐसे कताव्यों का पालन करेगा और ऐसी िजियों का प्रयोग करेगा िो
अजधजनयम या जनयमों के जर्वरोधात् मक नहीं होंगे।
4. अध्य क्ष की िजिया ाँ- अध् यक्ष ऐसे कताव्यों का पालन करेंगे और ऐसी िजियों का प्रयोग करेंग ेिो -
(i) संस्ट्थान के कामकाि का संिालन, िैसा कक संस्ट्थान द्वारा उन् ह ें जनजहत ककया िाए।
(ii) समय-समय पर संस्ट्थान के काया और प्रगजत की समीक्षा करना।
(iii) संस्ट्थान की ाैठकें आयोजित करना और प्रत्येक ाैठक की अध्यक्षता करना।
(iv) िासी जनकाय के अध्यक्ष के रूप में काया करना।
(v) संस्ट्थान अथर्वा िासी जनकाय द्वारा समय-समय पर सौंपी गई ऐसी अन्य िजि का प्रयोग करना।
5. सस्ट्ं थान की ाठै कें - (1) सस्ट्ं थान के कामकाि के संिालन के जलए अध् यक्ष द्वारा जितनी ाार आर्व्यक माना िाएगा
संस्ट् थान की ाैठकें की िाएंगी लके कन र्वषा में कम से कम एक ाार ाैठक की िाएगी।
(2) संस्ट्थान की ाैठक अध् यक्ष द्वारा जनयत िगह, तारीख और समय पर आयोजित की िाएगी।
(3) संस्ट्थान की ककसी साधारण ाैठक के जलए, ाैठक की िगह, तारीख और समय को जर्वजनर्दष्टा करने र्वाली एक
सूिना सजिर्व द्वारा इस तरह की ाैठक की तारीख से कम स े कम दो सप्ताह पहल े संिार के कानूनी रूप स े
स्ट्र्वीकाया मोड के माध्यम से भिे ी िाएगी। ाैठक की सूिना के साथ कायासूिी भी भेिी िानी िाजहए और
िहां यह संभर्व नहीं ह,ै कायासूिी को कम से कम दस कदन पहले संिार के कानूनी रूप स े स्ट्र्वीकाया रीजत के
माध्यम से भेिा िाएगा।
(4) संस्ट्थान के अत्यार्व्यक काया के संिलान के जलए अध् यक्ष द्वारा ककसी भी समय संस्ट्थान की एक असाधारण
ाैठक ाुलाई िा सकेगी।
(5) संस्ट्थान की ककसी असाधारण ाठै क के जलए, ाैठक की िगह, तारीख और समय को जर्वजनर्दष्टा करने र्वाली एक
सूिना सजिर्व द्वारा इस तरह की ाैठक की तारीख से कम स े कम दो सप्ताह पहल े संिार के कानूनी रूप स े
स्ट्र्वीकाया मोड के माध्यम से भिे ी िाएगी। ाैठक की सूिना के साथ कायासूिी भी भेिी िानी िाजहए और
िहां यह संभर्व नहीं ह,ै कायासूिी को कम से कम िार कदन पहले संिार के कानूनी रूप से स्ट्र्वीकाया रीजत के

(6) संस्ट्थान की असाधारण ाैठक सस्ट्ं थान के कम से कम नौ सदस्ट्यों के जलजखत अनुरोध पर, अनुरोध की प्राजप्त के
एक महीने के भीतर भी ाुलाई िा सकती ह,ै सदस्ट्यों द्वारा अपजे क्षत ाैठक के जलए ककए गए अनुरोध म ें ाैठक
का उद्दे्य इंजगत ककया िाएगा।
(7) संस्ट्थान की ककसी भी ाैठक में अध्यक्ष की अनुपजस्ट्थजत में, उपजस्ट्थत सदस्ट्य ऐसी ाैठक की अध्यक्षता करने के
जलए अपने ाीि स ेएक व्यजि का ियन करेंगे।
(8) सस्ट्ं थान की ाैठक के जलए कोरम पिास प्रजतित होगा।
(9) अध् यक्ष ककसी भी समय ाैठक से पहले अथर्वा ाैठक के दौरान कायासूिी में कामकाि की नई मदों और पूरक
मदों को िाजमल कर सकेंगे और इस तरह की मदों पर भी जर्विार ककया िाएगा।
(10) संस्ट्थान की ककसी भी ाैठक म ें ककसी भी प्रस्ट्तार्व को आगे ाााने के इछुछुक सदस्ट्य, सजिर्व को इस संांध म ें
जलजखत रूप से सूिना दगे ा, ताकक ाैठक की तारीख से कम से कम ाीस कदन पहल े र्वह उन् ह ें प्रात त हो सके और
प्रस्ट्ताजर्वत प्रस्ट्तार्व को कायासूिी में िाजमल ककया िाएगा।
(11) ककसी ाैठक में संस्ट्थान द्वारा जनपर्ाए गए ककसी भी जर्वषय को एक र्वषा की समाजप्त से पूर्वा पुन: जर्विार के जलए
नहीं लाया िाएगा जसर्वाय उस मामले में िहां अध् यक्ष या सरकार यह सूजित करती ह ै कक संस्ट्थान के जहत म ें
जर्वषय पर और अजधक जर्विार की आर्व्यकता ह।ै
(12) ककसी सदस्ट्य द्वारा उठाए गए बांद ुके आधार पर ाैठक के अध्यक्ष द्वारा कदया गया जनणाय अंजतम होगा।
(13) संस्ट्थान के सभी जनणाय ाहुमत के आधार पर जलए िाएंगे और मतों की समानता के मामले में अध् यक्ष के पास
जनणाायक मत होगा।
(14) संस्ट्थान की ाैठक की समस्ट्त कारार्वाई संस्ट्थान के सजिर्व द्वारा रखी गई एक कायार्वृत् त पुजस्ट्त क में दि ा की
िाएगी, ाैठक के कायार्वृ त् त को संिार के कानूनी रूप स ेस्ट्र्वीकाया मोड के माध्यम से पररिाजलत ककया िाएगा,
कायार्वृत्त और उस पर की गई कारार्वाई को पुजष्ट के जलए अगली ाैठक के समक्ष रखा िाएगा।
6. सदस्ट्यता समाप्त करना- यकद कोई नाजमत सदस्ट्य, संस्ट्थान की लगातार तीन ाैठकों में अनपु जस्ट्थजत के समुजित अर्वकाि
के जाना भाग नहीं लते ा ह,ै तो ऐसा सदस्ट्य संस्ट्थान का सदस्ट्य नहीं ाना रहगे ा।
7. आकजस्ट्मक ररजियों को भरना- जनधन, त्यागपत्र या अन्य कारण स े हुई सदस्ट्यों (पदेन सदस्ट् यों के अलार्वा) की आकजस्ट्मक
ररजियां उस प्राजधकारी की सुजर्वधानुसार िल्द से िल्द भरी िाएंगी, िो उस सदस्ट्य को जिसका स्ट्थान ररि हो गया ह,ै को
जनयुि, नाजमत अथर्वा जनर्वााजित करता ह।ै
8. ररजि जिसस े कायर्वा ाही प्रभाजर्वत न हो - सदस्ट्यता म ें ररजि के होत े हुए भी संस्ट्थान काया करेगा और ककसी भी सदस्ट्य
की जनयुजि या नामांकन या ियन में ककसी भी दोष के होते हुए भी और संस्ट्थान की कोई भी कायार्वाही ककसी भी ररजि के
अजस्ट्तत्र्व के कारण या उसके ककसी भी सदस्ट्य की जनयुजि या नामांकन या ियन म ेंकोई दोष के कारण अमान्य नहीं होगी।
9. अयोग्यता- (1) पदेन सदस्ट्य के अलार्वा ककसी अन् य सदस्ट्य को संस्ट्थान के ककसी भी प्राजधकारी के रूप में ियन के जलए
अयोग्य घोजषत ककया िाएगा -
(i) यकद र्वह असंतुजलत मानजसकता का ह;ै
(ii) यकद र्वह अमुक् त कदर्वाजलया ह;ै या
(iii) यकद उसे नैजतक मयाादा के अपराध में कानूनी अदालत द्वारा दोषी ठहराया गया ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(2) यकद कोई प्रश्न उठता ह ै कक क्या कोई व्यजि ऊपर उजल्लजखत ककसी भी अयोग्यता के अधीन है या रहा ह,ै तो प्रश्न
अध् यक्ष के जनणाय के जलए भेिा िाएगा और उनका जनणाय अंजतम होगा।
10. सदस्ट्यों को पाररश्रजमक- संस्ट्थान के गैर-आजधकाररक सदस्ट्य इस तरह के पाररश्रजमक, यात्रा और दैजनक भत्ते के
हकदार होंग,े िो संस्ट् थान की ाठै कों में भाग लेन े के जलए उनके द्वारा की गई ककसी भी यात्रा के संांध म ें ानाए िाने
र्वाले जर्वजनयमों में उपांजधत ककए िाएं।
11. स्ट्थायी सजमजतया-ाँ संस्ट्थान िैसा आर्व् यक हो स्ट्थायी सजमजतयों का गठन करेगा जिनमें जननलिजलजखत िाजमल ह-।
(i) जर्वत्त सजमजत;
(ii) िैक्षजणक पररषद;
(iii) अनुसंधान सजमजत;
(iv) संपदा सजमजत;
(v) योिना और जनगरानी सजमजत;
(vi) परीक्षा जनयंत्रण ाोड;ा
(vii) अस्ट्पताल प्रांधन सजमजत; तथा
(viii) कमािारी ियन सजमजतयााँ।
12. ािर् प्रस्ट्तार्व- संस्ट्थान जर्वत्त मत्रं ालय द्वारा जनधााररत प्रारूप में ािर् अनुमान और संिोजधत अनुमान के अधीन
मंत्रालय को ािर् प्रस्ट्तार्व प्रस्ट्ततु करेगा।
13. जिकायत जनर्वारण और अन्य तत्रं - सस्ट्ं थान जननलिजलजखत का गठन और प्रार्वधान करेगा अथाात:्
(क) रेंबगगं जर्वरोधी प्रकोष्ठ ;
(ख) भेदभार्व जर्वरोधी प्रकोष्ठ ;
(ग) िडें र संर्वेदीकरण प्रकोष्ठ ;
(घ) जिकायत जनर्वारण प्रकोष्ठ;
(ङ) यौन उत्पीड़न को रोकन े के जलए आंतररक जिकायत सजमजत;
(ि) कदव्यांगिनों के जलए सभी सुजर्वधाओं तक ााधा मिु पहुिाँ ।
14. प्रर्विे और फीस सरं िना- (1) संस्ट्थान म ें छात्रों का प्रर्वेि पणू ात: योग् यता और जर्वजनयमों द्वारा जनधााररत अजखल
भारतीय परीक्षा के आधार पर तथा इस संांध में समय-समय पर राष्ट्रीय नीजत के अनुसार होगा।
(2) संस्ट्थान कम से कम पांि र्वषों के जलए प्रर्वेि के ररकॉडा को सरं जक्षत रखगे ा
(3) संस्ट्थान में अध्ययन के जर्वजभन्न कायाक्रमों की फीस संरिना समय-समय पर संस्ट्थान द्वारा जनधााररत फीस
संांधी जनयमों के अनुसार तय की िाएगी।
(4) संस्ट्थान म ें कदए िान े र्वाल े पाठ्यक्रमों के जलए फीस के स्ट्तर और पाठ्यक्रम को िलान े की लागत के ाीि एक
उजित संांध होगा, फीस संरिना को प्रास्ट्पेक्र्स और संस्ट्थान की र्वेासाइर् पर प्रदर्िता ककया िाएगा।[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 5
(5) संस्ट्थान यह सुजनज त करेगा कक जिक्षा का कोई व्यार्वसायीकरण न हो, साथ ही संस्ट्थान सभी योग्य छात्रों को
िााँि और पहुिाँ सुजर्वधा प्रदान करेगा।

NOTIFICATION
New Delhi, the 3rd June, 2021
G.S.R. 387(E).— In exercise of the powers conferred by section 27 of the Institute of Teaching and Research
in Ayurveda Act, 2020(16 of 2020), the Central Government hereby makes the following rules for Institute of
Teaching and Research in Ayurveda, Ministry of Ayurveda, Yoga & Naturopathy, Unani, Siddha and Homoeopathy,
namely:-
1. Short title and commencement.- (1) These rules may be called the Institute of Teaching and Research in
Ayurveda Rules, 2021.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.- In these rules, unless the context otherwise requires,
(a) “Act” means the Institute of Teaching and Research in Ayurveda Act, 2020 (16 of 2020);
(b) “Institute” means the Institute as defined under clause (h) of section 3 of the Act;
(c) “President” means the President as defined under sub-section (1) of section 8 of the Act;
(d) “rules” means the rules framed by the Central Government under section 27 of the Act.
3. Powers and functions of the Institute.- The Institute shall perform the following functions -
(i) Guide, supervise and oversee the overall functioning and progress of the Institute.
(ii) Approve the annual accounts and annual report of the Institute.
(iii) Make regulations with previous approval of the Central Government.
(iv) Make or modify or cancel all or any rules or regulations or committee of the Institute, subject to the
condition that it shall not be contradicting the Act or rules, with previous approval of the Central
Government.
(v) Constitute standing committees and ad hoc committees for exercising any power in discharging any
function of the Institute or for inquiring into or reporting or advising upon, any matter which the
Institute may refer to them, in such manner as may be specified by regulations.
(vi) Perform such duties and exercise such powers for the conduct of business of the Institute that it shall
not be contradicting the Act or rules.
4. Powers of President.- The President shall perform such duties and exercise such power -
(i) Conduct of business of the Institute, as may be vested in him by the Institute.
(ii) Review periodically the work and progress of the Institute.
(iii) Convene meetings of the Institute and preside over every meeting.
(iv) Act as chairperson of the Governing Body.6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(i)]
(v) Exercise such other power as may be assigned by the Institute or Governing Body from time to time.
5. Meetings of the Institute.- (1) The Institute shall meet as often as may be considered necessary by the
President for the transaction of the business of the Institute but shall meet at least once in a year.
(2) Meeting of the Institute shall be held at such place, date and time as may be fixed by the President.
(3) For an ordinary meeting of the Institute, a notice specifying the place, date and time of the meeting
shall be sent by the secretary at least two weeks prior to the date of such meeting through legally
acceptable mode of communication, the agenda shall also be sent along with the notice of the meeting
and where it is not possible, the agenda shall be sent at least ten days before the meeting through
legally acceptable mode of communication.
(4) An extraordinary meeting of the Institute may be called by the President at any time for the transaction
of urgent business of the Institute.
(5) For an extraordinary meeting of the Institute, a notice specifying the place, date and time of the
meeting shall be sent by the secretary at least one week prior to the date of such meeting through
legally acceptable mode of communication, the agenda shall also be sent along with the notice of the
meeting and where it is not possible, the agenda shall be sent at least four days before the meeting
through legally acceptable mode of communication.
(6) An extraordinary meeting of the Institute may also be called on a written request of not less than nine
members of the Institute within a period of one month of the receipt of the requisition, the request made
by the members for a requisitioned meeting shall indicate the purpose of the meeting.
(7) In the absence of the President at any meeting of the Institute, the members present shall select a person
from among themselves to preside over such meeting.
(8) The quorum for a meeting of the Institute shall be fifty per cent.
(9) The President may include in the agenda at any time before or during a meeting fresh items of business
and supplementary items to those included in the agenda and such items shall also be taken up for
consideration.
(10) Any member desirous of moving any resolution at a meeting of the Institute shall give notice thereof in
writing to the secretary so as to reach him not less than twenty days before the date of the meeting and
the proposed resolution shall be included in the agenda.
(11) No subject disposed of by the Institute at a meeting shall be brought up again for consideration until
after the expiry of one year except in a case where the President or Government intimates that the
subject required further consideration in the interest of the Institute.
(12) A decision given by the President of the meeting on a point of order raised by a member shall be final.
(13) All decisions of the Institute shall be taken on a majority vote and in case of equality of votes the
President shall have a casting vote.
(14) All proceedings of the meeting of the Institute shall be entered in a minutes book to be maintained by
the secretary to the Institute, the minutes of the meeting shall be circulated through legally acceptable
mode of communication, the minutes and the action taken thereon shall be placed before the next
meeting for confirmation.
6. Termination of membership.- If a nominated member does not attend three consecutive meetings of the
Institute, without proper leave of absence, such member shall cease to be a member of the Institute.
7. Filling up of casual vacancies.- Casual vacancies among the members (other than ex-officio members) due to
demise, resignation or otherwise shall be filled up as soon as it may be convenient by the authority who
appointed or nominated or elected the member whose place has become vacant.
8. Vacancy not to affect proceedings.- The Institute shall function, notwithstanding any vacancy in the
membership therein and notwithstanding any defect in the appointment or nomination or election of any of its
member and no act or proceedings of the Institute shall be invalid merely by reasons of the existence of any
vacancy therein or of any defect in the appointment or nomination or election of any of its members.
9. Disqualification.- (1) A member other than ex-officio member shall be disqualified for being chosen as and
for being a member of any of the authorities of the Institute –
(i) if he is of unsound mind;
(ii) if he is an un-discharged insolvent; or
(iii) if he has been convicted by a court of law of an offence involving moral turpitude.[भाग II—खण् ड 3(i)] भारत का रािपत्र : असाधारण 7
(2) If any question arises as to whether a person is or has been subjected to any disqualification mentioned
above, the question shall be referred for decision to President and his decision shall be final.
10. Remuneration to members.- The non-official members of the Institute shall be entitled to such remuneration,
travelling and daily allowance as may be provided for in the regulations to be made in this behalf in respect of
any journey undertaken by them for attending the meetings of the Institute.
11. Standing Committees.- The Institute shall constitute such standing committees as may be necessary including
the following -
(i) Finance Committee;
(ii) Academic Council;
(iii) Research Committee;
(iv) Estate Committee;
(v) Planning and Monitoring Committee;
(vi) Examination Control Board;
(vii) Hospital Management Committee; and
(viii) Staff Selection Committees.
12. The budget proposals.- The Institute shall submit budget proposals to the Ministry under Budget Estimate
and Revised Estimate in the format prescribed by Ministry of Finance.
13. Grievance Redressal and other mechanism.- The Institute shall constitute and provide the following,
namely:-
(a) Anti Ragging Cell;
(b) Anti-discrimination Cell;
(c) Gender Sensitisation Cell;
(d) Grievance Redressal Cell;
(e) Internal Complaints Committee for prevention of sexual harassment;
(f) Barrier free access of all the facilities to persons with disabilities.
14. Admission and fee structure.- (1) Admission of the students to the Institute shall be made strictly on merit
based on an all India examination as prescribed by the regulations and in consistence with the national policy
in this behalf, from time to time.
(2) The Institution shall preserve the records of admission at least for five years.
(3) The fee structure of various programmes of study in the Institute shall be fixed in accordance with the
fee regulations framed by the Institute from time to time.
(4) The level of the fee charged for the courses offered in the Institute shall have a reasonable relation to
the cost of running the course, the fee structure shall be displayed in the prospectus and on the
Institution’s website.
(5) The Institute shall ensure that there is no commercialisation of education, further, Institution shall
provide for enquiry and access to all deserving students.
15. Annual Report and Accounts.- (1) In accordance with General Financial Rules of the Government of India,
the Accounts of the Institute shall be in the format prescribed by Comptroller and Auditor General of India.
(2) A draft of the Annual Report and the Annual Accounts of the Institute shall be placed before the
Annual General Meeting of the Institute for its consideration and approval, the copies of the Annual
Report and Annual Accounts as finally approved by the Institute shall be submitted to Ministry of
Ayurveda, Yoga & Naturopathy, Unani, Siddha and Homeopathy, Government of India, for the
purpose of being laid down on the Table of each House of Parliament within nine months of closure of
the accounting year.
