2. उपरोक्त 1 (क) व (ख) के अनुसार, ििे ी प्रिाजतयों के 66790 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका सात वर्षो तक
रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगाA इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की
िाएगी A िालांदक, भारतीय राष्ट्रीय रािमागा प्राजधकरण वृक्षारोपण और प्रत्यारोपण के जलए जिम्मेिार िोगा। इन जस्ट्थजतयों में से
दकसी भी जवचलन के जलए भारतीय राष्ट्रीय रािमागा प्राजधकरण जिम्मेिार िोगा । उपभोगी संस्ट्था द्वारा फोटोग्रादफक/ वीजडयोग्रादफक
साक्ष्य यथासमय संबंजधत वृक्ष अजधकारी को प्रस्ट्तुत दकए िाएं।
3. 6679 वृक्षो को काटे/ प्रत्यारोपण दकए िान े के बिले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 66790
पौधो का प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के छ: मिीने के अंिर जनधााररत की
गई भूजम पर अजतररक्त उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा । दिल्ली जवकास
प्राजधकरण/ उपभोगी संस्ट्था द्वारा अगले सात वर्षो तक रखरखाव स्ट्वय की लागत पर करेंगी । पौधों के खराब रखरखाव या पौधों के
नुकसान या िाजन के मामले में गोिरेि वेस्ट्टमाका एलएलपी िी जिम्मेिार िोगी ।
4. यदि उपभोगी संस्ट्था सफलतापूवाक प्रजतपूरक वृक्षारोपण करने में जवफल रिती ि।ै उपभोगी संस्ट्था द्वारा अजतररक्त साइट सुधार खचों
को िमा दकया िाएगा िो दक वृक्ष अजधकारी ¼पजि ½ द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुक्त बनाने के जलए आवश्यक
िो सकती ि ै ।
5. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के जबना

6. उपभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में वृक्ष
अजधकारी ¼पजिम½ को प्रस्ट्तुत दकया िाएगा ।
7. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधााररत करेंगी
और इसकी एक प्रजत प्रत्येक जवत्तीय वर्षा के अंत में प्रस्ट्तुत की िाएगी ।
8. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को दकया िाएगा ।
9. अनुमजत िारी िोने के तुरंत बाि वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे छ: मिीने के अंतराल में पूणा दकया िाएगा । प्रत्यारोपण
प्रदक्रया के पूणा िोने का बाि एक सम्पूणा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की
िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम निीं िोनी चाजिए ।
10. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
11. वृक्षो को प्रत्यारोपण/ काटन े के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजक्त के िावे के पक्षपात के जबना, िो वृक्षो
और भूजम पर सिी िो सकती ि,ै िी िा रिी ि ै।
12. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक वृक्षो की कटाई से पूव ाकोई लंजबत मुकिमेबािी या स्ट्थगन आििे दकसी भी
न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ िो ।
13. उपभोगी संस्ट्था द्वारा वृक्षो को प्रत्यारोपण/ काटने का काया सभी वैधाजनक मिं ूररयों को लेने के बाि िी िुरू दकया िाएगा ।
14. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा ।
15. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की
िाएगी ।
16. उपभोगी संस्ट्था द्वारा वृक्षो को िटाए िाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के
खाते मे रािस्ट्व के रूप में िमा की िाएगीA
17. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds i”pkr izkIr लकजड़यों को मुफ्त में जनकटतम lkoZtfud “konkgks a es a
iz;ksx gsr q सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी (पजिम) को भी िी िाएगी ।
18. उपभोगी संस्ट्था द्वारा वृक्षो को काटने के स्ट्थल से लकजड़यों को ys tkus l s iwo Z o`{k vf/kdkjh ¼पजिम½ l s <yq kbZ vueq fr izkIr

19. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा िोने वाली वन उपि को सावािजनक श्मिान मे 90 दिनों के अंिर
पूरा दकया िाएगा ।
20. उपभोगी संस्ट्था द्वारा 1214 वृक्षो को काटने से पूवा प्रत्यारोपण दकया िाएगा । 1214 वृक्षो की अनुमजत 4365 वृक्षो के सफल प्रत्यारोपण
और mi& ou laj{kd (पजिम) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाि िी िायेगी ।
21. भूजम स्ट्वाजमत्व एिेंसी यि सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न िो ।
22. उपभोगी संस्ट्था द्वारा 6679 वृक्षो के अलावा दकसी भी वृक्ष का प्रत्यारोपण/ कटाई दिल्ली वृक्ष lja {k.k अजधजनयम,1994 के अंतगात एक
अपराध िोगा ।
23. यदि दकसी वृक्ष में पजक्षयों का घोंसला पाया िाता ि ैतो उस वृक्ष को घोंसला स्ट्थानांतररत करने के पिात िी काटा िाए ।
24. उपभोगी संस्ट्था के द्वारा पयाावरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िाएगा
यि माननीय पयाावरण एवं वन मंत्री राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के पूवा अनुमोिन से िारी दकया िाता ि ै।

1. National Highway Authority of India (NHAI), herein referred to as User Agency, shall make an
advance deposit of an amount of Rs. 38,07,03,000/- (Rs. Thirty Eight Crores Seven Lakh Three
Thousand only) towards security deposit for creation and maintenance of compensatory plantation

(b) Transplantation of 4365 no. of trees which are standing on site shall be done by User Agency within the
project site at vacant area UER-II (Package-I to V) along the road proposed to be constructed with their
own funds.
2. 100% Compensatory Plantation of 66790 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.
However ensuring Compensatory Plantation and transplantation shall be responsibility of NHAI. For any
deviation from these conditions NHAI shall be responsible. Photographic/ videographic evidence in due
course shall be submitted to Tree Officer concerned by User Agency.
3. 66790 tree saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio
of 1:10 on non-forest land in lieu of transplantation/ felling of 6679 no. of trees. The plantation shall be done
by following site specific plantation techniques with additional measures on identified land within six months[PART IV DELHI GAZETTE : EXTRAORDINARY 5
of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out there after
by User Agency with their own funds. In case of poor maintenance or causality of plants User Agency/
NHAI shall be responsible.
4. If the User Agency fails to successfully raise compensatory plantation. The User Agency shall also deposit
extra site improvement expenses which may be required to make the site suitable for plantation as calculated
by Tree Officer concerned (as deposits).
5. The land over which compensatory plantation raised shall not be utilized for any other purpose without the
approval of the State Government.
6. Detailed plantation schedule shall have to be submitted by User Agency in compliance with Section 12 of
Delhi Preservation of Trees Act, 1994 before initiating felling/ transplantation.
7. User Agency shall maintain plantation journal as prescribed by Department of Forests and Wildlife, Govt. of
NCT of Delhi and submit a copy of same at end of each financial year.
8. The User Agency/ NHAI shall implement the improved soil moisture conservation activities on
compensatory plantation / transplantation site.
9. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than six (06) months, after which a completion report has to be submitted to the Tree Officer. The
spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
10. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
11. Permission for felling/ transplantation of all tress is being granted at their own risk and without prejudice to
the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
12. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling/ transplantation of trees.
13. Before the felling/ transplantation of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
14. The User Agency shall ensure that the plan of this proposal shall not be changed.
15. The progress report of transplantation shall be submitted through inspection officer concerned along with
complete details of trees.
16. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to
the Government account by the User Agency.
17. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (West) by User Agency.
18. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the DCF (West) by User Agency.
19. Felling/ transplantation of trees and transportation of forest produce arising threfrom to the public
crematorium shall be completed within 90 days.
20. The transplantation shall be carried out prior to felling of 1214 nos. of trees permitted herein. The 1214 trees
shall be removed/ felled after successful transplantation of 4365 trees and submission of compliance
certificate to DCF (West).
21. Land Owning agency shall ensue that there is no encroachment in area proposed for compensatory
plantation.
22. Felling/ transplantation of any tree apart from 6679 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act, 1994.
23. If any tree is found to have nest of birds it should not be felled/ transplant till the same is abandoned by the
birds.
24. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any
obtained, shall be followed scrupulously.
