होगा ।
12. िव2तृत व9ृ ारोपण अनसु ूची को (cid:18)द(cid:20)ली वृ9 (प(cid:23)रर9ण) अिधिनयम, 1994 कB धारा 12 के अनपु ालन म 1 उपभोगी

एक िव2तृत योजना (cid:29)2तुत करेगा।
14. (अ) अनमु ित जारी होन ेके तुरंत बाद पेड़@ का (cid:29)^यारोपण श;ु (cid:18)कया जाना चािहए और इस े3 महीन ेके अतं राल म 1
पूरा (cid:18)कया जाना चािहए, िजसके बाद एक पूण (cid:27) (cid:23)रपोट(cid:27) वृ9 अिधकारी को (cid:29)2तुत कB जानी चािहए । 2थानातं (cid:23)रत
(cid:18)कए जान ेवाले व(cid:15)ृ (cid:16) कB दरू ी 4 मीटर (_बंद ुसे _बंद)ु स ेकम नहP होनी चािहए ।

in public interest exempts an area of total 19 Acres. (7.68 ha.) approx as detailed below for the work of construction of
Dwarka Expressway Package-II from rail under Bridge, Near Sector-21, Dwarka, Delhi to Delhi-Haryana Border from
the provision of sub-section (3) of section 9 of the said Act.

3. User agency shall also deposit extra site improvement expenses which may be required to make the site suitable
for plantation as calculated by Tree Officer concerned (as deposits).
4. 1:10 plants of indigenous species 6-8 feet height will be planted as compensatory plantation on non-forest land
in lieu of removal of 2675 no. of trees. The plantation will be done following site specific plantation techniques
with additional measures on identified land within three months of issue of tree removal permission and
maintenance would be carried out there after by NHAI/ User agency with their own funds.
5. The NHAI/ User agency shall implement the improved soil moisture conservation activities on identified land
using their own funds.
6. The NHAI/ User agency shall ensure that the site specific (Compensatory plantation site) wildlife conservation
plan is implemented through competent wildlife professionals from their own funds.
7. The NHAI/ User agency shall ensure that the plan of this proposal shall not be changed.
8. The land over which compensatory plantation raised shall not be utilized for other purpose without the approval
of Tree Officer concerned.
9. All outstanding liabilities of the user agency, including the payment of pending amount of Rs. 6,14,00,000/-
(Rupees Six Crore Fourteen Lakh Only) must be settled before permission is issued.
10. Site will have to be secured from encroachment and biotic interference. In Pocket 3 of Aravalli Biodiversity
Park, measures for repair of boundary wall and closure of illegal road will also have to be taken by user agency/
NHAI along with security/watch and ward arrangements at least for seven years..
11. Extensive interventions will have to be undertaken for soil preparation, at least in Pockets 2 and 3 of Aravalli
Biodiversity Park.
12. Detailed plantation schedule will have to be submitted by user agency in compliance with Section 12 of Delhi
Preservation of Trees Act, 1994.
13. NHAI/DDA shall submit a detailed plan for site preparation and plantation.
14. (a) Transplantation of trees must be initiated immediately after permission is issued and should be completed
not later than 3 months, after which a completion report has to be submitted to the Tree Officer. The spacing of
the translocated trees should not be less than 4 metres (point to point).
(b). A draft policy on transplantation of trees is under active consideration with State Government of Delhi,
therefore any change brought in to effect due to implementation of the policy in future permission would be
modified to that extent with the approval of Competent Authority with prospective effect.
15. Completion of documentation regarding compensatory plantation as per provisions in DPTA, 1994 would be
done by user agency.
16. The permission for felling of the trees would be granted at their own risk and without prejudice to the claim (S)
of any other person/s who may be having right (s) over the land of the trees.6 DELHI GAZETTE : EXTRAORDINARY PART IV]
17. Progress report of felling & transplanting shall be submitted through inspection officer concerned along with
complete details of trees.
18. The timber obtained from removal of felling shall be auctioned by the user agency and deposit the proceeds as
Govt. revenue. Lops and tops of the trees, will be sent to the nearest public crematoria free of cost.
19. For shifting of timber from site of removal of trees, permission for transport of the said wood shall be obtained
from the DCF (West)/ Tree Officer.
20. Felling/transplant of any trees apart from the proposed 2675 trees by NHAI would constitute an offence.
21. Usual conditions governing felling/transplant of trees would be applicable.
22. Adequate space will have to be indicated by user agency for transplantation of proposed trees.
23. All statutory provisions shall be complied by NHAI/User agency before the tree removal is commenced.
24. If any land proposed for compensatory Afforestation/ plantation (26.75ha) falls short, it will be compensated by
additional land for compensatory Afforestation/ plantation.
25. If land for remaining trees proposed to be felled in future is not provided, legal action will be initiated by the
department against user agency (NHAI) and all the conditions stipulated in the order will be complied by user
agency, failing which order may be withdrawn.
26. In view of the opinion given by Prof. C.R. Babu, Professor Emeritus, Centre for Environment Management of
Degraded Ecosystems, University of Delhi, Forest Department GNCTD may re-examine if there is potential for
plantation of more trees for compensatory plantation on the land already identified, identify additional land, if
required and process remaining part of proposal as per Rules/Law.
