6. (अ) अनुमित जारी होने के तुरंत बाद पेड़, का /0यारोपण शुE (cid:21)कया जाना चािहए और इसे 3 महीने के अंतराल म(cid:25) पूरा (cid:21)कया
जाना चािहए, िजसके बाद एक पूण’ #रपोट’ वृ+ अिधकारी को /2तुत क- जानी चािहए । 2थानांत#रत (cid:21)कए जाने वाले वृ+ो क-

Delhi, the 20th June, 2019
F.No.R.75/TO(S)/TC-Felling/18-19/ 4619-27.—In exercise of the powers conferred by section 29 of the Delhi
Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, hereby,
in public interest exempts an area of total 13.75 hectare approx (34 Acres) as detailed below for reconstruction of US
Embassy Office and Utilities Building at Plot No. 1, Block E&F, Chanakyapuri, New Delhi from the provision of sub-
section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. The applicant M/s Roopak Kothari & Associates who have been authorized by Embassy of the USA, New Delhi
India shall make an advance deposit of an amount of Rs. 1,16,85,000 /- (Rupees One Crore Sixteen Lakh Eighty
Five Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a
period of Seven years as follows,

2. Transplantation of 35 trees which are standing on site shall be done at appropriate site. Post
transplantation care of the trees will be ensured by the project proponent.
2. 100% Compensatory Plantation of 2050 saplings of native species will be raised and maintained by M/s Roopak
Kothari & Associates for Seven years and monitored till its successful establishment at Sardar Patel Marg,
Simon Bolivar Marg and Manas Marg, New Delhi.
3. 1:10 plants of indigenous species 6-8 feet height will be planted as compensatory plantation on non-forest land
in lieu of removal of 205 no. of trees. The plantation will be done following site specific plantation techniques
with additional measures on identified land within three months of issue of tree removal permission and
maintenance would be carried out there after by User agency with their own funds.
4. The User agency shall implement the improved soil moisture conservation activities on identified land using
their own funds.
5. The User agency shall ensure that the plan of this proposal shall not be changed.
6. (i) Transplantation of trees must be initiated immediately after permission is issued and should be completed not
later than 3 months, after which a completion report has to be submitted to the Tree Officer. The spacing of the
translocated trees should not be less than 4 metres (point to point).
(ii). A draft policy on transplantation of trees is under active consideration with State Government of Delhi,
therefore any change brought in to effect due to implementation of the policy in future permission would be
modified to that extent with the approval of Competent Authority with prospective effect.4 DELHI GAZETTE : EXTRAORDINARY PART IV]
7. Completion of documentation regarding compensatory plantation as per provisions in DPTA, 1994 would be
done by user agency.
8. The permission for felling of the trees would be granted at their own risk and without prejudice to the claim (S)
of any other person/s who may be having right (s) over the land of the trees.
9. All statutory provisions shall be complied by User agency before the tree removal is commenced.
10. The timber obtained from felling/ transplanting of 205 trees shall be auctioned by the land owning agency and
the proceeds shall be deposited as revenue to the Government.
11. Before shifting of timber if any, from site of removal/ transplantation of trees, transportation permission for
transportation of the said wood shall be obtained from DCF/ Tree Officer (South).
12. The lops and tops obtained on removal of trees shall be handed over by the M/s Roopak Kothari & Associates to
the officials concerned of Municipal Corporation of Delhi for its use on public crematoria in Delhi free of cost
and receipt so obtained may be deposited with DCF (South).
13. The progress of felling of trees, transportation & compensatory plantation shall be submitted through Inspection
Officer to DCF (South) after completion alongwith complete details of trees immediately.
