2. उपरोक्त 1 (क) और (ख) के अनुसार, दिे ी प्रजाजतयों के 9490 पौधो का 100 % प्रजतपूरक िृक्षारोपण और उनका सात
िर्षो तक रखरखाि ददल्ली जिकास प्राजधकरण द्वारा दकया जायेगाA इस िृक्षारोपण के सफलतापूिगक स्ट्थापना के बाद
ददल्ली जिकास प्राजधकरण द्वारा जनगरानी की जाएगी A
3. 949 िृक्षो को काटे/ प्रत्यारोपण जाने के बदले मे 1:10 के अनुपात मे स्ट्िदिे ी प्रजाजतयों के 6-8 फीट की ऊाँचाई िाले
9490 पौधो का प्रजतपूरक िृक्षारोपण गैर-िन भूजम पर दकया जाएगा । िृक्षारोपण की अनुमजत के जारी िोने के तीन मिीने के
अंदर जनधागररत की गई भूजम पर अजतररक्त उपायों के साथ िृक्षारोपण स्ट्थल के अनुसार जिजिष्ट िृक्षारोपण तकनीकों के द्वारा
दकया जाएगा और उसका रखरखाि उपभोगी संस्ट्था द्वारा अपने स्ट्ियं की लागत पर दकया जाएगा ।
4. अनुमजत जारी िोने के तुरंत बाद िृक्षो का प्रत्यारोपण उपभोगी संस्ट्था (राष्ट्रीय भिन जनमागण जनगम) द्वारा िुरू दकया जाएगा
और इसे छ: मिीने के अंतराल में पूणग दकया जाएगा । प्रत्यारोपण प्रदक्रया के पूणग िोने के बाद एक सम्पूणग ररपोटग संबजन्धत
िृक्ष अजधकारी को प्रस्ट्तुत की जायेगी । प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत िृक्षो की दरू ी 4 मीटर (लबद ु से लबद)ु से कम निीं
िोनी चाजिए ।
5. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया जायेगा दक इस प्रस्ट्ताि की योजना को पररिर्वतत निीं दकया जाएगा ।
6. जो भूजम प्रजतपूरक िृक्षारोपण के जलया आिंरटत ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्िीकृजत के
जबना निीं दकया जाएगा।
7. िृक्षों के प्रत्यारोपण िते ु एक प्रस्ट्ताजित नीजत ददल्ली सरकार मे जिचाराधीन ि,ै इसजलए भजिष्य की अनुमजत में नीजत के
कायागन्ियन के कारण प्रभािी िोने िाले दकसी भी बदलाि को संभाजित प्रभाि के साथ सक्षम प्राजधकरण की मंजूरी के साथ
उस सीमा तक संिोजधत दकया जाएगा ।
8. िृक्षो को काटने/ प्रत्यारोपण के जलए अनुमजत उनके स्ट्ियं के जोजखम पर और दकसी भी अन्य व्यजक्त के दािे के पक्षपात के
जबना, जो िृक्षो और भूजम पर सिी िो सकती िै, दी जा रिी िै ।
9. उपभोगी संस्ट्था द्वारा िृक्षो को काटने/ प्रत्यारोपण का कायग सभी िैधाजनक मंजूररयों को लेने के बाद िी िुरू दकया जाएगा ।
10. उपभोगी संस्ट्था द्वारा 949 िृक्षो के अलािा दकसी भी िृक्ष की कटाई/प्रत्यारोपण एक अपराध िोगा ।
11. उपभोगी संस्ट्था द्वारा िृक्षो को काटने के उपरान्त प्राप्त लकजड़यों की नीलामी की जाएगी और उससे प्राप्त धनराजि को
सरकार के खाते मे राजस्ट्ि के रूप में जमा की जाएगीA

F. No. R. 432/TO(S)/TC-Felling/20-21/4492-4500.—In exercise of the powers conferred
by section 29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of
National Capital Territory of Delhi, hereby, in public interest exempts an area of 7.66 ha. (18.94 Acre) as
detailed below for redevelopment of GPRA Colony at Sarojini Nagar in Phase-I, New Delhi from the
provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. NBCC (India) Limited, herein referred to as User Agency, shall make an advance deposit of an amount of
Rs. 5,40,93,000 /- (Rupees Five Crore Forty Lakh Ninety Three Thousand Only) towards security deposit for
creation and maintenance of compensatory plantation for a period of Seven years as follows,

2. 100% Compensatory Plantation of 9490 saplings of native species shall be raised and maintained
by DDA for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b)
above.
3. Saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio
of 1:10 on non-forest land in lieu of removal/ transplantation of 949 no. of trees. The plantation
shall be done by following site specific plantation techniques with additional measures on
identified land within three months of issue of tree felling/ removal permission and maintenance
shall be carried out there after by DDA.
4. Transplantation of trees by User Agency i.e NBCC shall be initiated immediately after permission
is issued and should be completed not later than six months, after which a completion report has to
be submitted to the concerned Tree Officer. The spacing of the transplantation of trees shall not be
less than 4 meter (point to point) at transplantation site.
5. The User Agency shall ensure that the plan of this proposal shall not be changed.
6. The land over which compensatory plantation raised shall not be utilized for other purpose without
the approval of State Government.
7. A draft policy on transplantation of trees is under active consideration with State Government of
Delhi, therefore, any change brought in to effect due to implementation of the policy in future
permission shall be modified to that extent with the approval of Competent Authority with
prospective effect.
8. Permission for felling/ transplantation of all tress is being granted at their own risk and without
prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or
the trees.
9. Before the felling/ transplantation of trees from the site is commenced all requisite statutory
clearances shall necessarily be obtained by the User Agency.
10. Felling/ transplantation of any tree apart from 949 trees by User Agency shall constitute an offence.
11. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as
revenue to the Government account by the User Agency.
12. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the
same should be reported to DCF (South) by User Agency.
13. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the
said wood shall be obtained from the DCF (South) by User Agency.
14. It should be ensured by the user agency that all the conditions mentioned in environmental
clearance, if any obtained, shall be followed scrupulously.
