2. उपरोक्त 1 (क) और (ख) के अनसु ार, देिी प्रिाजतयों के 1350 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका
सात विो तक रखरखाव उपभोगी संस्ट्था द्वारा दकया िायेगा। इस वृक्षारोपण के सफलतापवू कद स्ट्थापना के बाद
उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी ।
3. 135 वृक्षो को कािे/ प्रत्यारोपण िान े के बदल े म े 1:10 के अनुपात म े स्ट्वदेिी प्रिाजतयों के 6-8 फीि की ऊाँचाई
वाले 1350 पौधो का प्रजतपरू क वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोन े
के तीन मिीने के अदं र जनधादटरत की गई भूजम पर अजतटरक्त उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट
वृक्षारोपण तकनीकों के द्वारा दकया िाएगा और उसका रखरखाव उपभोगी संस्ट्था द्वारा अपने स्ट्वय ं की लागत पर
दकया िाएगा ।
4. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पटरवर्भतत निीं दकया िाएगा।
5. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंटित ि,ै उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की
स्ट्वीकृजत के जबना निीं दकया िाएगा।
6. अनुमजत िारी िोन े के तरु ंत बाद वृक्षो का प्रत्यारोपण उपभोगी संस्ट्था द्वारा िुरू दकया िाएगा और इस े ि: मिीन े
के अंतराल म ें पूण द दकया िाएगा । प्रत्यारोपण प्रदक्रया के पणू द िोन े का बाद एक सम्पूण द टरपोि द संबजन्धत वृक्ष
अजधकारी को प्रस्ट्तुत की िायगे ी । प्रत्यारोपण स्ट्थल म े प्रत्यारोजपत वृक्षो की दरू ी 4 मीिर (बबद ु स े बबद)ु स े कम
निीं िोनी चाजिए ।
7. उपभोगी संस्ट्था द्वारा वृक्ष प्रत्यारोपण नीजत 2020 म ें उजल्लजखत सभी ितों का पालन दकया िायेगा ।
8. वृक्षो को कािने/ प्रत्यारोपण के जलए अनुमजत उनके स्ट्वय ं के िोजखम पर और दकसी भी अन्य व्यजक्त के दाव े के
पक्षपात के जबना, िो वृक्षो और भूजम पर सिी िो सकती ि,ै दी िा रिी ि ै।
9. उपभोगी संस्ट्था द्वारा वृक्षो को कािने/ प्रत्यारोपण का काय द सभी वैधाजनक मंिूटरयों को लेने के बाद िी िरूु दकया
िाएगा ।
10. उपभोगी संस्ट्था द्वारा प्रस्ट्ताजवत 135 वृक्षों के अलावा दकसी भी वृक्ष की किाई / प्रत्यारोपण fnYyh o`{k laj{k.k

11. उपभोगी संस्ट्था द्वारा वृक्षों को कािने के उपरान्त प्राप्त लकजियों की नीलामी की िाएगी और उससे प्राप्त धनराजि
को सरकार के खात े में रािस्ट्व के रूप म ें िमा की िाएगी।
12. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds i“pkr izkIr लकजियों को मुफ्त म ें जनकितम

F. No. 134/WFD/COT/19-20/ 8531-39.— In exercise of the powers conferred by section 29 of the Delhi
Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 28.57 ha. (285789.18 Sq. Mtr.) as detailed below for construction of
Wholesale Fruit and Vegetable Market at Village Tikri Khurd, Delhi from the provision of sub-section (3) of section 9
of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. Delhi Agriculture and Marketing Board (DAMB), herein referred to as User Agency, shall make an advance
deposit of an amount of Rs. 76,95,000 /- (Rupees Seventy Six Lakh Ninety Five Thousand Only) towards
security deposit for creation and maintenance of compensatory plantation for a period of Seven years as
follows,

2. 100% Compensatory Plantation of 1350 saplings of native species shall be raised and maintained by User
Agency (DAMB) for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b)
above.
3. Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on
non-forest land in lieu of removal/ transplantation of 135 no. of trees. The plantation shall be done by
following site specific plantation techniques with additional measures on identified land within three months
of issue of tree removal permission and maintenance shall be carried out there after by User Agency with
their own funds.
4. The User Agency shall ensure that the plan of this proposal shall not be changed.
5. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
6. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than six months, after which a completion report has to be submitted to the concerned Tree Officer. The
spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
7. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
8. Permission for felling/ transplantation of all tress is being granted at their own risk and without prejudice to
the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
9. Before the felling/ transplantation of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
10. Felling/ transplantation of any tree apart from 135 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act, 1994.
11. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to
the Government account by the User Agency.
12. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (West) by User Agency.
13. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the DCF (West) by User Agency.
14. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any
obtained, shall be followed scrupulously.
