4. भूजम स्ट्वाजमत्व एिेंसी यह सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न हो ।
5. उपभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में वृक्ष
अजधकारी ¼िजक्षण½ को प्रस्ट्तुत दकया िाएगा ।
6. उपभोगी संस्ट्था द्वारा वृक्षारोपण पजत्रका को वन और वन्यिीव जवभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को जनधााररत करेंगी
और इसकी एक प्रजत प्रत्येक जवत्तीय वषा के अंत में प्रस्ट्तुत की िाएगी ।
7. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों को दकया िाएगा ।
8. अनुमजत िारी होने के तुरंत बाि वृक्षों का प्रत्यारोपण िुरू दकया िाएगा और इसे तीन महीने के अंतराल में पूणा दकया िाएगा ।
प्रत्यारोपण प्रदक्रया के पूणा होने का बाि एक सम्पूणा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल में
प्रत्यारोजपत वक्षृ ों की िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम नहीं होनी चाजहए ।
9. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
10. वक्षृ ों को प्रत्यारोपण/ काटन े के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजक्त के िावे के पक्षपात के जबना, िो वृक्षों
और भूजम पर सही हो सकती ह,ै िी िा रही ह ै।
11. उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया िायेगा दक वृक्षों की कटाई से पूवा कोई लंजबत मुकिमेबािी या स्ट्थगन आििे दकसी
भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ हो ।
12. उपभोगी संस्ट्था द्वारा वृक्षों को प्रत्यारोपण/ काटने का काया सभी वैधाजनक मंिूररयों को लेने के बाि ही िुरू दकया िाएगा ।

14. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ह,ै उसका उपयोग दकसी अन्य कायों के जलए राज्य सरकार की स्ट्वीकृजत के जबना
नहीं दकया िाएगा ।
15. उपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की
िाएगी ।
16. उपभोगी संस्ट्था द्वारा वृक्षों को हटाए िाने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के
खाते में रािस्ट्व के रूप में िमा की िाएगीA
17. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िाखाओं dks dkVs tkus ds i'pkr izkIr लकजड़यों को मुफ्त में जनकटतम lkoZtfud “konkgks a es a

19. उपभोगी संस्ट्था द्वारा वृक्षों की प्रत्यारोपण/ कटाई और उसमें पैिा होने वाली वन उपि को सावािजनक श्मिान में 90 दिनों के अंिर
पूरा दकया िाएगा ।
20. उपभोगी संस्ट्था द्वारा 325 वृक्षों को काटने से पूवा प्रत्यारोपण दकया िाएगा । वृक्षों की अनुमजत 1314 वृक्षों के सफल प्रत्यारोपण और

21. उपभोगी संस्ट्था द्वारा 1639 वृक्षों के अलावा दकसी भी वृक्ष का प्रत्यारोपण/ कटाई दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 के अांतगतग
एक अपराध होगा ।
22. अनुमजत तभी िी िाएगी िब “वृक्ष संरक्षण योिना” को समय पर mi& ou lja {kd (िजक्षण) द्वारा िारी दकए गए पत्र दिनााँक-
13.01.2021 के अनुसार वृक्ष अजधकारी/ mi& ou lja {kd (िजक्षण) को प्रस्ट्तुत की िाएगी ।
23. उपभोगी संस्ट्था के द्वारा पयाावरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िाएगा
यह माननीय पयाावरण एवं वन मंत्री राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के पूवा अनुमोिन से िारी दकया िाता ह ै।

Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 1.847 ha. (approx.) as detailed below for the redevelopment of GPRA
Colony at Netaji Nagar (Pkg.-II), New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is in continuation of the earlier Notification issued vide F.No.R.150/TO(S)/TC-
Felling/17-18/641-53 dated 23.04.2018 for 2490 trees and subject to fulfillment of the following conditions:-4 DELHI GAZETTE : EXTRAORDINARY PART IV]
1. NBCC (India) Limited, herein referred to as User Agency, shall make an advance deposit of an amount of
Rs. 9,34,23,000 /- (Nine Crore Thirty Four Lakh Twenty Three Thousand only) towards security deposit (if not
deposited earlier) for creation and maintenance of compensatory plantation for a period of Seven years as follows,

2. 100% Compensatory Plantation of more than 16390 (i.e 23833) saplings of native species has already been
done by DCF (North) with maintenance arrangements for 7 years over 21.45 ha. land of New Delhi and
monitored till its successful establishment as indicated at 1 (a) above.
3. Transplantation of 1314 no. of trees which are standing on site shall be done by User Agency with their own
funds in the location as indicated at 1 (b) above.
4. Land owning agency shall ensure that there is no encroachment in area proposed for compensatory
plantation.
5. Details transplantation schedule shall have to be submitted by User Agency in compliance with Section 12 of
DPTA, 1994 before initiating transplantation/ felling.
6. User Agency shall maintain plantation journal as prescribed by Department of Forests and Wildlife, GNCTD
and submit a copy of same at end of each financial year.
7. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation/ transplantation site.
8. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than three (03) months, after which a completion report has to be submitted to the Tree Officer. The
spacing of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
9. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
10. Permission for transplantation/ felling of 1639 number of tress is being granted at their own risk and without
prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
11. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling of trees.
12. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
13. The User Agency shall ensure that the plan of this proposal shall not be changed.
14. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
15. The progress report of transplantation shall be submitted through inspection officer concerned along with

16. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to
the Government account by the User Agency.
17. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (South) by User Agency.
18. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the DCF (South) by User Agency.
19. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public
crematorium shall be completed within 90 days.
20. The transplantation shall be carried out prior to felling of 325 nos. of trees permitted herein. The 325 trees
shall be removed/ felled after successful transplantation of 1314 trees and submission of compliance
certificate to DCF (South).
21. Transplantation/ felling of any tree apart from 1639 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act, 1994.
22. The permission shall be granted only is “The Tree Preservation Plan” is timely submitted to the DCF (South)
as per letter dated 13.01.2021 issued by DCF (South).
23. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, and
other clearances, if any obtained, shall be followed scrupulously.
