3. उपभोगी संस्ट्था द्वारा अजतररक्त साइट सुधार खचों को िमा दकया िाएगा िो दक िृक्ष अजधकारी (िजक्षण) द्वारा गणना

4. 450 िृक्षो को काटे िाने के बिले मे 1:10 के अनुपात मे स्ट्िििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई िाले 4500 पौधो
का प्रजतपूरक िृक्षारोपण गैर-िन भूजम पर दकया िाएगा । िृक्षारोपण की अनुमजत के िारी होने के तीन महीने के अंिर
जनधााररत की गई भूजम पर अजतररक्त उपायों के साथ िृक्षारोपण स्ट्थल के अनुसार जिजिष्ट िृक्षारोपण तकनीकों के द्वारा
दकया िाएगा और उपभोगी संस्ट्था द्वारा रखरखाि दकया िाएगा ।
5. उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया िायेगा दक इस प्रस्ट्ताि की योिना को पररिर्तात नहीं दकया िाएगा ।
6. िो भूजम प्रजतपूरक िृक्षारोपण के जलया आिंरटत है, उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की
स्ट्िीकृजत के जबना नहीं दकया िाएगा।
7. उपभोगी संस्ट्था द्वारा जिस्ट्तृत िक्षृ ारोपण अनुसूची को दिल्ली िक्षृ संरक्षण अजधजनयम, 1994 की धारा 12 के
अनुपालन में िृक्ष अजधकारी (िजक्षण) को प्रस्ट्तुत दकया िाएगा ।
8. उपभोगी संस्ट्था द्वारा िृक्षो को काटे / प्रत्यारोपण िुरू करने से पहले साइट की तैयारी और िक्षृ ारोपण के जलए एक
जिस्ट्तृत योिना प्रस्ट्तुत करेगी ।
9. उपभोगी संस्ट्था द्वारा िृक्षारोपण पजत्रका को िन और िन्यिीि जिभाग राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार को
जनधााररत करेंगी और इसकी एक प्रजत प्रत्येक जित्तीय िर्षा के अंत में प्रस्ट्तुत की िाएगी ।
10. उपभोगी संस्ट्था द्वारा प्रजतपूरक िृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजिजधयों को दकया
िाएगा ।
11. अनुमजत िारी होने के तुरंत बाि िृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे छ: महीने के अंतराल में पूणा दकया
िाएगा । प्रत्यारोपण प्रदक्रया के पूणा होने का बाि एक सम्पूणा ररपोटा संबजन्धत िृक्ष अजधकारी को प्रस्ट्तुत की िायेगी ।
प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत िृक्षो की िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम नहीं होनी चाजहए ।
12. उपभोगी संस्ट्था के द्वारा िृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
13. उपभोगी संस्ट्था द्वारा िृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से िृक्ष अजधकारी
को प्रस्ट्तुत की िाएगी ।
14. िृक्षो को प्रत्यारोपण/ काटने के जलए अनुमजत उनके स्ट्ियं के िोजखम पर और दकसी भी अन्य व्यजक्त के िाि े के पक्षपात
के जबना, िो िृक्षो और भूजम पर सही हो सकती है, िी िा रही ह ै।
15. उपभोगी संस्ट्था द्वारा िृक्षो को प्रत्यारोपण/ काटने का काया सभी िैधाजनक मंिूररयों को लेने के बाि ही िुरू दकया
िाएगा ।
16. िृक्षो की प्रत्यारोपण/ कटाई और उसमें पैिा होने िाली िन उपि को सािािजनक श्मिान मे 90 दिनों के भीतर पूरा
दकया िाएगा ।
17. उपभोगी संस्ट्था द्वारा 151 िृक्षो को काटने से पूि ा प्रत्यारोपण दकया िाएगा । िृक्षो की अनुमजत 299 िृक्षो के सफल
प्रत्यारोपण और उप-िन संरक्षक (िजक्षण) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाि िी िायेगी ।
18. उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया िायेगा दक िृक्षो की कटाई से पूि ा कोई लंजबत मुकिमेबािी या स्ट्थगन
आििे दकसी भी न्यायालय / अन्य प्राजधकरण द्वारा पाररत न हुआ हो ।
19. उपभोगी संस्ट्था द्वारा िृक्षो को काटने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को
सरकार के खाते मे रािस्ट्ि के रूप में िमा की िाएगी।
20. उपभोगी संस्ट्था द्वारा िृक्षों के ऊपरी िाखाओं को काटे िाने के पश् चात प्राप्त लकजड़यों को मुफ्त में जनकटतम
सािािजनक िििाहों में प्रयोग हते ु सौपी िाएगी और इसकी सूचना िृक्ष अजधकारी (िजक्षण) को भी िी िाएगी ।
21. उपभोगी संस्ट्था द्वारा िृक्षो को काटने के स्ट्थल से लकजड़यों को ले िाने से पूिा िृक्ष अजधकारी (िजक्षण) से ढुलाई अनुमजत
प्राप्त करनी होगी।
22. उपभोगी संस्ट्था के द्वारा पयाािरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िाएगा ।4 DELHI GAZETTE : EXTRAORDINARY PART IV]
23. उपभोगी संस्ट्था द्वारा 450 िृक्षो के अलािा दकसी भी िृक्ष की प्रत्यारोपण/ कटाई दिल्ली िृक्ष संरक्षण अजधजनयम,
1994 के तहत एक अपराध होगा ।
24. भूजम स्ट्िाजमत्ि एिेंसी यह सुजनजित करेगी दक प्रजतपूरक िृक्षारोपण के जलए प्रस्ट्ताजित क्षत्रे में कोई अजतक्रमण न हो ।
25. अनुमजत तभी िी िाएगी िब “िृक्ष संरक्षण योिना” को समय पर उप-िन संरक्षक (िजक्षण) द्वारा िारी दकए गए पत्र
दिनााँक-20.01.2021 के अनुसार िृक्ष अजधकारी/उप-िन संरक्षक (िजक्षण) को प्रस्ट्तुत की िाएगी ।

29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory
of Delhi, hereby, in public interest exempts an area of 6.243 ha. as detailed below for construction of Khanpur to
Sangam Vihar section of Aerocity to Tughlakabad corridor of Delhi MRTS Project Phase-IV, New Delhi from the
provision of sub-section (3) of section 9 of the said Act.

1. Delhi Metro Rail Corporation Ltd. (DMRC), herein referred to as User Agency, shall make an advance deposit
of an amount of Rs. 2,56,50,000 /- (Rupees Two Crore Fifty Six Lakh Fifty Thousand Only) towards security
deposit for creation and maintenance of compensatory plantation for a period of Seven years as follows,

3. The User Agency shall also deposit extra site improvement expenses which may be required to make
the site suitable for plantation as calculated by Tree Officer concerned (as deposits).
4. Plants saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in
ratio of 1:10 on non-forest land in lieu of transplantation/ felling of 450 no. of trees. The plantation
shall be done by following site specific plantation techniques with additional measures on identified
land within three months of issue of tree removal permission and maintenance shall be carried out
thereafter, by user agency with their own funds.
5. The User Agency shall ensure that the plan of this proposal shall not be changed.
6. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
7. Detailed plantation schedule shall be submitted by User Agency in compliance with Section 12 of
DPTA 1994 before initiating felling/ transplantation.
8. The User Agency shall submit a detailed plan for site preparation and plantation before initiating
felling/ transplantation.
9. The User Agency shall maintain plantation journal as prescribed by the Department of Forest and
Wildlife, GNCTD and a copy of the same may be submitted at the end of each financial year.
10. The User Agency shall implement the improved soil moisture conservation activities on compensatory
plantation/ transplantation.
11. Transplantation of trees shall be initiated immediately after permission is issued and should be
completed not later than six months, after which a completion report has to be submitted to the Tree
Officer. The spacing of the transplantation of trees shall not be less than 4 meter (point to point) at
transplantation site.
12. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by
User Agency.
13. The progress report of transplantation shall be submitted through inspection officer concerned along
with complete details of trees.
14. Permission for transplantation/ felling of all tress is being granted at their own risk and without
prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or the

15. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances
shall necessarily be obtained by the User Agency.
16. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public
crematorium shall be completed within 90 days.
17. The transplantation shall be carried out prior to felling of 151 nos. of trees permitted herein. The 151
trees shall be removed/ felled after successful transplantation of 299 trees and submission of
compliance certificate to DCF (South).
18. The user agency shall ensure that there is no pending litigation or stay order passed by any court of
law/ other authority before undertaking felling of trees.
19. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as
revenue to the Government account by the User Agency.
20. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the
same should be reported to DCF (South) by User Agency.
21. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said
wood shall be obtained from the DCF (South) by User Agency.
22. It should be ensured by the user agency that all the conditions mentioned in environmental clearance,
and other clearances, if any obtained, shall be followed scrupulously.
23. Felling/ transplantation of any tree apart from 450 trees by User Agency shall constitute an offence
under DPTA, 1994.
24. Land Owning agency shall ensue that there is no encroachment in area proposed for compensatory
plantation.
25. The permission shall be granted only is “The Tree Preservation Plan” is timely submitted to the Tree
Officer as per letter dated 20.01.2021 issued by DCF (South).
