2. देिी प्रिाजतयों के 19440 पौधो का 100 % प्रजतपूरक वृक्षारोपण भारतीय राष्ट्रीय रािमागा प्राजधकरण/ उपभोगी संस्ट्था द्वारा कराया िायेगा और
उनका सात वर्षो तक रखरखाव तथा सफलतापूवाक स्ट्थापना के बाद उपरोक्त 1 (क) के अनुसार जनगरानी की िाएगी ।
3. 1:10 स्ट्वदेिी प्रिाजतयों के 6-8 फीट की ऊ चाई वाले पौधे 1944 वृक्षों को हटाये िाने के बदले में प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया
िाएगा । वृक्षारोपण की अनुमजत के िारी होने के तीन महीने के अंदर जनधााररत की गई भूजम पर अजतररक्त उपायों के साथ वृक्षारोपण साइट जवजिष्ट
वृक्षारोपण तकनीकों के बाद दकया िाएगा और पजिमी ou foHkkx द्वारा उपभोगी संस्ट्था द्वारा दकए गए िमा का उपयोग करने के बाद रखरखाव
दकया िाएगा ।
4. उपभोगी संस्ट्था यह सुजनजित करेगी दक इस प्रस्ट्ताव की योिना को पररवर्ततत नहीं दकया िाएगा ।
5. साइट को अजतक्रमण और बायोरटक हस्ट्तक्षेप से सुरजक्षत करना होगा ।
6. जिस भूजम पर प्रजतपूरक वृक्षारोपण दकया गया है, उसका उपयोग संबंजधत वृक्ष अजधकारी की स्ट्वीकृजत के जबना अन्य प्रयोिन के जलए नहीं दकया
िाएगा।
7. वृक्षों को हटाने के जलए अनुमजत उनके स्ट्वयं के िोजखम पर दी िाएगी और दकसी भी अन्य व्यजक्त के दावे के पक्षपात के जबना अनुमजत दी िाएगी,
िो वृक्षों और भूजम पर सही हो सकती ह ै।
8. वृक्षों को हटाने से पहले सभी वैधाजनक प्रावधानों का अनुपालन उपभोगी संस्ट्था द्वारा दकया िाएगा ।
9. 1944 वृक्षों के अजतररक्त दकसी भी वृक्ष की कटाई / प्रत्यारोपण एक अपराध होगा ।
10. ददल्ली वृक्ष परररक्षण अजधजनयम, 1994 के प्रावधानों के अनुसार प्रजतपूरक वृक्षारोपण के संबंध में प्रलेखन का समापन उपभोगी संस्ट्था द्वारा
दकया िाएगा ।
11. हटाए िाने वाले वृक्षों की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से उपभोगी संस्ट्था द्वारा प्रस्ट्तुत की िाएगी ।
12. वृक्षों को हटाए िाने के उपरान्त प्राप्त लकड़ी की नीलामी भू-स्ट्वाजमत्व संस्ट्था द्वारा की िाएगी और उससे प्राप्त धनराजि को सरकार को रािस्ट्व के

Delhi, the 4th August, 2020
F.No.158/WFD/ COT/ 17-18/ 1563-71.—In exercise of the powers conferred by section 29 of the Delhi
Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi, had
already exempted an area of total 27.2951 ha. approx as detailed below for construction of Dwarka Expressway from
Shiv Murti, NH-8 to Road Under Bridge near Sector-21, Dwarka (Km. 0.000 to 5.300) Package-I in the State of Delhi
from the provision of sub-section (3) of section 9 of the said Act in public interest vide its Notification

as given below:-

The said exemption is subject to fulfillment of the following conditions:-
1. The applicant i.e National Highway Authority of India shall make an advance deposit of an amount of
Rs. 11,08,08,000/-(Rupees Eleven Crore Eight Lakh and Eight Thousand Only) towards security deposit for
creation and maintenance of compensatory plantation for a period of Seven years as follows:-

2. 100% Compensatory Plantation of 19440 saplings of native species shall be raised and their maintenance shall be
caused by National Highway Authority of India for Seven years and monitored till its successful establishment as
indicated at 1 (a) above.
3. 1:10 plants of indigenous species 6-8 feet height shall be planted as compensatory plantation on non-forest land in
lieu of transplantation of 1944 no. of trees. The plantation shall be done following site specific plantation
techniques with additional measures on identified land within three months of issue of tree removal permission
and maintenance would be carried out there after by West Forest Division utilizing the deposits made by User
agency.
4. The User Agency shall ensure that the plan of this proposal shall not be changed.
5. Site shall have to be secured from encroachment and undesired biotic interference.
6. The land over which compensatory plantation raised shall not be utilized for any other purpose without the
approval of Tree Officer concerned.
7. Permission for felling of tress would be granted at their own risk and without prejudice to the claim (s) of any
other person/s who may be having any rights(s) over the land or the trees.
8. Before the felling of trees from the site is commenced all requisite statutory clearances shall necessarily be
obtained by the user agency.
9. Felling of any trees apart from 1944 trees by NHAI shall constitute an offence.
10. Completion of documentation regarding compensatory plantation as per provisions of DPTA, 1994 shall be done
by User Agency.
11. Progress report of felling shall be submitted through inspection officer concerned along with complete details of
trees.
12. The timber obtained from removal of trees shall be auctioned by the user agency. The proceeds shall be deposited
as revenue to the Government account. The lops and tops of trees shall be sent/supplied to nearest crematorium
free of cost and the same should be reported to DCF (West)/Tree Officer.
13. Before shifting of timber if any, from site of removal of trees, permission for transportation of the said wood shall
be obtained from the DCF (West).
14. It should be ensured by the user agency that all the conditions mentioned in environmental clearance if any
obtained, must be followed scrupulously.
