को लागू करेगी।
7. उपभोगी सं!था यह सिुनिBत करेगी /क इस (cid:6)!ताव क& योजना को प@रव2तत नहG /कया जाएगा ।
8. साइट को अितHमण और बायो@टक ह!त(cid:21)ेप से सुरि(cid:21)त करना होगा ।
9. जहां कहG भी आवFयक हो, मृदा तैयार करने के िलए Iापक ह!त(cid:21)ेप एवं अित@र% बजट उपभोगी सं!था Cारा /कया

11. अनुमित जारी होने के तुरंत बाद वृ(cid:11)(cid:18) का (cid:1)(cid:26)यारोपण शु@ (कया जाना चािहए और इसे 3 महीने के अंतराल मA पूरा (कया जाना
चािहए, िजसके बाद एक पूण # Bरपोट# वृ(cid:11) अिधकारी को (cid:1)(cid:28)तुत क, जानी चािहए । (cid:28)थानांतBरत (कए जाने वाले वृ(cid:11)(cid:18) क, दरू ी

12. वृ(cid:11)(cid:18) को हटाने/ (cid:1)(cid:26)यारोपण के िलए अनुमित उनके (cid:28)वय ंके जोिखम पर दी जाएगी और (कसी भी अ%य HिI के दावे के प(cid:11)पात के

Delhi, the 31st December, 2019
F. No. 158/WFD/ COT/ 17-18/ 11020-28.—In exercise of the powers conferred by section
29 of the Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National
Capital Territory of Delhi, hereby, in public interest exempts an area of total 27.2951 ha. approx as
detailed below for construction of Dwarka Expressway from Shiv Murti, NH-8 to Road Under Bridge
near Sector-21, Dwarka (Km. 0.000 to 5.300) Package-I in the State of Delhi from the provision of
sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. The applicant i.e National Highway Authority of India shall make an advance deposit of an
amount of Rs. 25,22,25,000/-(Rupees Twenty Five Crores, Twenty Two Lakh and Twenty Fifth
Thousand Only) towards security deposit for creation and maintenance of compensatory

2. 100% Compensatory Plantation of 44250 saplings of native species shall be raised and their
maintenance shall be caused by National Highway Authority of India for Seven years and
monitored till its successful establishment as indicated at 1 (a) above.
3. The User Agency shall submit fresh drawing indicating the GPS co-ordinates of site where trees
would be transplanted and compensatory plantation is proposed to be carried out.
4. 1:10 plants of indigenous species 6-8 feet height shall be planted as compensatory plantation on
non-forest land in lieu of transplantation of 4425 no. of trees. The plantation shall be done
following site specific plantation techniques with additional measures on identified land within
three months of issue of tree removal permission and maintenance would be carried out there
after by West Forest Division utilizing the deposits made by User Agency.
5. User Agency shall also deposit extra site improvement expenses which may be required to make
the site suitable for plantation as calculated by Tree Officer concerned (as deposits)
6. The User agency shall implement the improved soil moisture conservation activities on
identified land division utilizing the deposits made by user agency.
7. The User Agency shall ensure that the plan of this proposal shall not be changed.
8. Site shall have to be secured from encroachment and undesired biotic interference.
9. Extensive interventions if any required to be undertaken for soil preparation, would be carried
out and additional budget if needed, shall be provided by User Agency.
10. The land over which compensatory plantation raised shall not be utilized for any other purpose
without the approval of Tree Officer concerned.
11. Transplantation of trees must be initiated immediately after permission is issued and should be
completed not later than 3 (three) months, after which a completion report has to be submitted to
the Tree Officer. The spacing of the transplantation of trees should not be less than 4 metres

12. Permission for felling/ transplantation of tress would be granted at their own risk and without
prejudice to the claim (s) of any other person/s who may be having any rights(s) over the land or
the trees.
13. Before the felling/ transplantation of trees from the site is commenced all requisite statutory
clearances shall necessarily be obtained by the user agency.
14. Permission of tree removal shall be provided only after the User Agency shall submit the
amount Rs. 2,40,00,000 (Two Crores Forty Lakhs only) for the missing 400 Nos. of trees in
Package-II, Dwarka Expressway, Delhi as indicated in the letter of DCF (West) dated
09.10.2019.
15. Felling/ Transplantation of any trees apart from 4425 trees by NHAI shall constitute an offence.
16. Completion of documentation regarding compensatory plantation as per provisions of DPTA,
1994 shall be done by User Agency.
17. Progress report of transplantation shall be submitted through inspection officer concerned along
with complete details of trees.
18. The timber obtained from removal of trees shall be auctioned by the user agency. The proceeds
shall be deposited as revenue to the Government account. The lops and tops of trees shall be
sent/ supplied to nearest crematorium free of cost and the same should be reported to DCF
(West)/ Tree Officer.
19. Before shifting of timber if any, from site of removal of trees, permission for transportation of
the said wood shall be obtained from the DCF (West).
20. It should be ensured by the user agency that all the conditions mentioned in environmental
clearance if any obtained, must be followed scrupulously.
