2. उपरोि 1 (क) व (ख) के अनुसार, ििे ी प्रिाजतयों के 7250 ikS/kksa का 100 % प्रजतपूरक वृक्षारोपण और उनका सात o"kks± तक
रखरखाव उपभोगी संस्ट्था / दिल्ली जवकास प्राजधकरण द्वारा 43.5 हक्े टेयर आवंरटत भूजम पर 04.12.2019 के संिभा मे दकया
िायेगाA इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा जनगरानी की िाएगी A हालांदक, राष्ट्रीय रािधानी
क्षेत्र पररवहन जनगम वृक्षारोपण और प्रत्यारोपण के जलए जिम्मेिार होगा। इन जस्ट्थजतयों में से दकसी भी जवचलन के जलए राष्ट्रीय रािधानी
क्षेत्र पररवहन जनगम जिम्मेिार होगा ।
3. 725 वृक्षोa को काटे िाने के बिले मे 1:10 के अनुपात मे स्ट्विेिी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 7250 ikS/kksa का प्रजतपूरक
वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी होने के तीन महीने के अंिर जनधााररत की गई भूजम पर
अजतररि उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा । दिल्ली जवकास प्राजधकरण/
उपभोगी संस्ट्था द्वारा अगले सात o"kks± तक रखरखाव स्ट्वय की लागत पर करेंगी । पौधों के खराब रखरखाव या पौधों के नुकसान या हाजन
के मामले में राष्ट्रीय रािधानी क्षेत्र पररवहन जनगम ही जिम्मेिार होगी।
4. उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया िायगे ा दक इस प्रस्ट्ताव की योिना को पररवर्तात नहीं दकया िाएगा ।
5. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत ह,ै उसका उपयोग दकसी अन्य dk;ks± के जलए राज्य सरकार की स्ट्वीकृजत के जबना
नहीं दकया िाएगा।
6. उपभोगी संस्ट्था द्वारा जवस्ट्तृत वृक्षारोपण अनुसूची को दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 की धारा 12 के अनुपालन में वृक्ष
अजधकारी ¼िजक्षण½ को प्रस्ट्तुत दकया िाएगा ।
7. उपभोगी संस्ट्था/ दिल्ली जवकास प्राजधकरण द्वारा वृक्षो को काटे / प्रत्यारोपण िुरू करने से पहले साइट की तैयारी और वृक्षारोपण के
जलए एक जवस्ट्तृत योिना प्रस्ट्तुत करेगी ।
8. उपभोगी संस्ट्था/ दिल्ली जवकास प्राजधकरण द्वारा प्रजतपूरक वृक्षारोपण/ प्रत्यारोपण स्ट्थल में मृिा नमी संरक्षण काया की गजतजवजधयों
को दकया िाएगा ।
9. उपभोगी संस्ट्था/ दिल्ली जवकास प्राजधकरण द्वारा अजतररि साइट सुधार खचों को िमा दकया िाएगा िो दक वृक्ष अजधकारी
¼िजक्षण½ द्वारा गणना के अनुसार वृक्षारोपण के जलए उपयुि बनाने के जलए आवश्यक हो सकता है ।[PART IV DELHI GAZETTE : EXTRAORDINARY 3
10. अनुमजत िारी होने के तुरंत बाि o`{kks aका प्रत्यारोपण िुरू दकया िाएगा और इसे तीन महीने के अंतराल में पूणा दकया िाएगा । प्रत्यारोपण
प्रदक्रया के पूणा होन ेका बाि एक सम्पूणा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी । प्रत्यारोपण स्ट्थल मेa प्रत्यारोजपत o`{kks aकी
िरू ी 4 मीटर (लबंि ुसे लबंि)ु से कम नहीं होनी चाजहए ।
11. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
12. o`{kks a को प्रत्यारोपण/काटने के जलए अनुमजत उनके स्ट्वयं के िोजखम पर और दकसी भी अन्य व्यजि के िावे के पक्षपात के जबना, िो o`{kks a
और भूजम पर सही हो सकती ह,ै िी िा रही ह ै।
13. उपभोगी संस्ट्था के द्वारा यह सुजनजित दकया िायेगा दक o`{kksa की कटाई से पूवा कोई लंजबत मुकिमेबािी या स्ट्थगन आिेि दकसी भी
न्यायालय/अन्य प्राजधकरण द्वारा पाररत न हुआ हो ।
14. उपभोगी संस्ट्था द्वारा o`{kksa को प्रत्यारोपण/ काटने का काया सभी वैधाजनक मिं ूररयों को लेने के बाि ही िुरू दकया िाएगा ।
15. उपभोगी संस्ट्था द्वारा 725 o`{kksa के अलावा दकसी भी वृक्ष की प्रत्यारोपण/ कटाई दिल्ली वृक्ष lja {k.k अजधजनयम, 1994 के तहत एक
अपराध होगा ।
16. उपभोगी संस्ट्था द्वारा o`{kks a की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को प्रस्ट्तुत की
िाएगी ।
17. उपभोगी संस्ट्था द्वारा o`{kks aको काटने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार के खाते मे
रािस्ट्व के रूप में िमा की िाएगीA
18. उपभोगी संस्ट्था द्वारा o`{kksa के ऊपरी िाखाओं को काटे िाने के पिात प्राप्त लकजड़यों को मुफ्त म ेंजनकटतम lkoZtfud “konkgksa es a iz;ksx
gsr q सौaपी िाएगी और इसकी सूचना वृक्ष अजधकारी (िजक्षण) को भी िी िाएगी ।
19. उपभोगी संस्ट्था द्वारा o`{kks aको काटने के स्ट्थल से लकजड़यों को ys tku s ls iwo Z o`{k vf/kdkjh ¼िजक्षण½ l s <qykbZ vueq fr izkIr djuh

20. o`{kks aकी प्रत्यारोपण/ कटाई और उसमें पैिा होने वाली वन उपि को सावािजनक श्मिान मे 90 दिनों के भीतर पूरा दकया िाएगा ।
21. उपभोगी संस्ट्था द्वारा 142 o`{kksa को काटने से पूवा प्रत्यारोपण दकया िाएगा । वृक्षो की अनुमजत 583 o`{kks aके सफल प्रत्यारोपण और mi&
ou lja {kd (िजक्षण) को अनुपालन प्रमाण पत्र प्रस्ट्तुत करने के बाि िी िायेगी ।
22. भूजम स्ट्वाजमत्व एिेंसी यह सुजनजित करेगी दक प्रजतपूरक वृक्षारोपण के जलए प्रस्ट्ताजवत क्षेत्र में कोई अजतक्रमण न हो ।
23. उपभोगी संस्ट्था द्वारा पयाावरण मंिूरी में उजल्लजखत सभी ितों का पालन दकया िाएगा ।
यह माननीय पयाावरण एवं वन मंत्री राष्ट्रीय रािधानी क्षेत्र दिल्ली सरकार के पूवा अनुमोिन से िारी दकया िाता ह ै।

F. No.1196/TO(S)/TC/Felling/18-19/11947-55.— In exercise of the powers conferred by section 29 of the
Delhi Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 9.105 ha. as detailed below for implementation of Delhi-Ghaziabad-
Meerut Regional Rapid Transit System (RRTS) Corridor (from Sarai Kale Khan to centre of River Yamuna),
New Delhi from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. Delhi National Capital Region Transport Corporation (NCRTC),. herein referred to as User Agency, shall
make an advance deposit of an amount of Rs. 4,13,25,000 /- (Rupees Four Crore Thirteen Lakh Twenty Five
Thousand Only) towards security deposit for creation and maintenance of compensatory plantation for a
period of Seven years as follows,

(b) Transplantation of 583. of trees which are standing on site shall be done by User Agency in the location as
mentioned in the table above.
2. 100% Compensatory Plantation of 7250 saplings of native species shall be raised and maintained by User
Agency through DDA at allocated land measuring 43.5 ha. vide letter dated 04.12.2019 for Seven years and
monitored till its successful establishment as indicated at 1 (a) & (b) above. However ensuring Compensatory
Plantation and transplantation shall be responsibility of NCRTC. For any deviation from these conditions
NCRTC shall be responsible.
3. Plants saplings of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of
1:10 on non-forest land in lieu of transplantation/ felling of 725 no. of trees. The plantation shall be done by
following site specific plantation techniques with additional measures on identified land within three months
of issue of tree removal permission and maintenance for next Seven (7) years shall be carried out thereafter,
by user agency through DDA with their own funds. In case of poor maintenance or causality of plants User
Agency/ NCRTC shall be responsible.
4. The User Agency shall ensure that the plan of this proposal shall not be changed.
5. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
6. Detailed plantation schedule shall be submitted by User Agency in compliance with Section 12 of Delhi
Preservation of Trees Act, 1994 before initiating felling/ transplantation.
7. The User Agency/ DDA shall submit a detailed plan for site preparation and plantation before initiating
felling/ transplantation.
8. The User Agency/ DDA shall implement the improved soil moisture conservation activities on compensatory

9. The User Agency/ DDA shall also deposit extra site improvement expenses which may be required to make
the site suitable for plantation as calculated by Tree Officer concerned (as deposits).
10. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than three months, after which a completion report has to be submitted to the Tree Officer. The spacing
of the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
11. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
12. Permission for transplantation/ felling of all tress is being granted at their own risk and without prejudice to
the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
13. The User Agency shall ensure that there is no pending litigation or stay order passed by any court of law/
other authority before undertaking felling of trees.
14. Before the transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
15. Transplantation/ felling of any tree apart from 725 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act, 1994.
16. The progress report of transplantation shall be submitted through inspection officer concerned along with
complete details of trees.
17. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to
the Government account by the User Agency.
18. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (South) by User Agency.
19. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the DCF (South) by User Agency.
20. Transplantation/ felling of trees and transportation of forest produce arising therefrom to the public
crematorium shall be completed within 90 days.
21. The transplantation shall be carried out prior to felling of 142 nos. of trees permitted herein. The 142 trees
shall be removed/ felled after successful transplantation of 583 trees and submission of compliance certificate
to DCF (South).
22. Land Owning agency shall ensue that there is no encroachment in area proposed for compensatory plantation.
23. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, and
other clearances, if any obtained, shall be followed scrupulously.
