II. काली मंदिर के पीछे बािरी ररंग रोड पर दिल्ली जवकास प्राजधकरण िीन बेल्ट के 03 पॉकेट्स- 8905 वगा
मीटर ।
2. उपरोि 1 (क) व (ि) के अनुसार, ििे ी प्रिाजतयों के 29400 पौधो का 100 % प्रजतपूरक वृक्षारोपण और उनका सात वर्ो
तक रिरिाव उपभोगी संस्ट्था द्वारा दकया िायेगा। इस वृक्षारोपण के सफलतापूवाक स्ट्थापना के बाि उपभोगी संस्ट्था द्वारा

3. 2940 वृक्षो को काटे िाने के बिले मे 1:10 के अनुपात मे स्ट्वििे ी प्रिाजतयों के 6-8 फीट की ऊाँचाई वाले 29400 पौधो का
प्रजतपूरक वृक्षारोपण गैर-वन भूजम पर दकया िाएगा । वृक्षारोपण की अनुमजत के िारी िोने के तीन मिीने के अंिर जनधााररत
की गई भूजम पर अजतररि उपायों के साथ वृक्षारोपण स्ट्थल के अनुसार जवजिष्ट वृक्षारोपण तकनीकों के द्वारा दकया िाएगा
और उपभोगी संस्ट्था द्वारा रिरिाव दकया िाएगा ।
4. अनुमजत िारी िोने के तुरंत बाि वृक्षो का प्रत्यारोपण िुरू दकया िाएगा और इसे छ: मिीने के अंतराल में पूणा दकया
िाएगा । प्रत्यारोपण प्रदक्रया के पूणा िोने का बाि एक सम्पूणा ररपोटा संबजन्धत वृक्ष अजधकारी को प्रस्ट्तुत की िायेगी ।
प्रत्यारोपण स्ट्थल मे प्रत्यारोजपत वृक्षो की िरू ी 4 मीटर (बबंि ुसे बबंि)ु से कम निीं िोनी चाजिए ।
5. उपभोगी संस्ट्था के द्वारा वृक्ष प्रत्यारोपण नीजत 2020 में उजल्लजित सभी ितों का पालन दकया िाएगा ।
6. इस कॉरीडोर में भूजम के डायवसान के जलए वन (संरक्षण) अजधजनयम, 1980 के तित अनुमजत दिल्ली वृक्ष संरक्षण
अजधजनयम, 1994 के तित वृक्ष अजधकारी से वृक्ष िटाने की अंजतम अनुमजत से पिले प्राप्त कर ली िाएगी ।
7. दिल्ली मेरो रेल कॉपोरेिन जलजमटेड दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 के तित वृक्ष अजधकारी से लंजबत मामलों के
प्रकरण के पररणाम / जनणाय को स्ट्वीकार करने के जलए बाध्य िोगा ।
8. उपभोगी संस्ट्था द्वारा 4820 वृक्षो के प्रजतपूरक वृक्षारोपण की अनुपालन ररपोटा िो दक उप-वन संरक्षक (पजिम) द्वारा 03
प्रस्ट्तावों (20 िून, 2018, 27 जसतंबर 2019 और 3 अक्टूबर 2019 को अनुमजतयााँ प्रिान की गई) के जवरुद्ध वृक्षो को िटाने
के जलए अजिम अनुमजत िने े से पूवा, प्रस्ट्तुत की िाएगी ।
9. उपभोगी संस्ट्था के द्वारा यि सुजनजित दकया िायेगा दक इस प्रस्ट्ताव की योिना को पररवर्तात निीं दकया िाएगा ।
10. उपभोगी संस्ट्था द्वारा प्रजतपूरक वृक्षारोपण/ साइट को अजतक्रमण और बायोरटक िस्ट्तक्षेप से सुरजक्षत करना िोगा ।
11. िो भूजम प्रजतपूरक वृक्षारोपण के जलया आवंरटत िै, उसका उपयोग दकसी अन्य कायो के जलए राज्य सरकार की स्ट्वीकृजत के
जबना निीं दकया िाएगा।
12. वृक्षो को प्रत्यारोपण/ काटने के जलए अनुमजत उनके स्ट्वयं के िोजिम पर और दकसी भी अन्य व्यजि के िावे के पक्षपात के
जबना, िो वृक्षो और भूजम पर सिी िो सकती िै, िी िा रिी ि ै।
13. उपभोगी संस्ट्था द्वारा वृक्षो को प्रत्यारोपण/ काटने का काया सभी वैधाजनक मंिूररयों को लेने के बाि िी िुरू दकया िाएगा ।
14. उपभोगी संस्ट्था द्वारा 2940 वृक्षो के अलावा दकसी भी वृक्ष की प्रत्यारोपण/ कटाई दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 के
तित एक अपराध िोगा ।
15. उपभोगी संस्ट्था द्वारा वृक्षो की प्रत्यारोपण की प्रगजत ररपोटा संबंजधत जनरीक्षण अजधकारी के माध्यम से वृक्ष अजधकारी को
प्रस्ट्तुत की िाएगी ।
16. दिल्ली मेरो रेल कॉपोरेिन जलजमटेड ने दिल्ली वृक्ष संरक्षण अजधजनयम, 1994 का उल्लंघन दकया ि ै और प्रस्ट्ताजवत मेरो
कॉररडोर में कुछ वृक्षो को नुकसान पहुचं ाकर, जिसके जलए जवचाराधीन प्रकरण िो दक उप- वन संरक्षक (पजिम)/ वृक्ष
अजधकारी के पास ि ै उसके पररणाम / जनणाय को अंजतम अनुमजत से पूवा िता के रूप में रिा िाएगा और दिल्ली मेरो रेल
कॉपोरेिन जलजमटेड पररणाम / जनणाय को स्ट्वीकार करने के जलए बाध्य िोगा ।
17. उपभोगी संस्ट्था द्वारा वक्षृ ो को काटने के उपरान्त प्राप्त लकजड़यों की नीलामी की िाएगी और उससे प्राप्त धनराजि को सरकार
के िाते मे रािस्ट्व के रूप में िमा की िाएगी।
18. उपभोगी संस्ट्था द्वारा वृक्षों के ऊपरी िािाओं को काटे िाने के पिात प्राप्त लकजड़यों को मुफ्त में जनकटतम सावािजनक
िविािों में प्रयोग िते ु सौपी िाएगी और इसकी सूचना वृक्ष अजधकारी (पजिम) को भी िी िाएगी ।
19. उपभोगी संस्ट्था द्वारा वृक्षो को काटने के स्ट्थल से लकजड़यों को ले िाने से पूवा वृक्ष अजधकारी (पजिम) से ढुलाई अनुमजत प्राप्त
करनी िोगी।
20. उपभोगी संस्ट्था के द्वारा पयाावरण मंिूरी में उजल्लजित सभी ितों का पालन दकया िाए ।

Delhi, the 10th February, 2021
F.66/WFD/COT/19-20/10331-39.—In exercise of the powers conferred by section 29 of the Delhi
Preservation of Trees Act, 1994 (Delhi Act 11 of 1994), the Government of National Capital Territory of Delhi,
hereby, in public interest exempts an area of 35.2354 ha. as detailed below for construction of Line-8 Extension Metro
corridor from Janakpuri West to Mukarba Chowk (Excluding 5.34 KM on Road No.-26 managed by PWD) and
Mukarba Chowk to Deerawal Nagar (Excluding proposal for portion of cut and cover at Derawal Nagar) of Phase-IV
of Delhi MRTS under DPTA, 1994 from the provision of sub-section (3) of section 9 of the said Act.

The said exemption is subject to fulfillment of the following conditions:-
1. Delhi Metro Rail Corporation Ltd. (DMRC), herein referred to as User Agency, shall make an advance
deposit of an amount of Rs. 16,75,80,000 /- (Rupees Sixteen Crore Seventy Five Lakh Eighty Thousand
Only) towards security deposit for creation and maintenance of compensatory plantation for a period of

2. 100% Compensatory Plantation of 29400 saplings of native species shall be raised and maintained by User
Agency for Seven years and monitored till its successful establishment as indicated at 1 (a) & (b) above.
3. Plants of indigenous species 6-8 feet height shall be planted as compensatory plantation in ratio of 1:10 on
non-forest land in lieu of removal of 2940 no. of trees. The plantation shall be done by following site specific
plantation techniques with additional measures on identified land within three months of issue of tree
removal permission and maintenance shall be carried out there after by User Agency with their own funds.
4. Transplantation of trees shall be initiated immediately after permission is issued and should be completed not
later than six months, after which a completion report has to be submitted to the Tree Officer. The spacing of
the transplantation of trees shall not be less than 4 meter (point to point) at transplantation site.
5. All the conditions mentioned in Tree Transplantation Policy 2020 shall be followed scrupulously by User
Agency.
6. The permission under Forest (Conservation) Act, 1980 for diversion of land in this corridor shall be taken by
DMRC before the final permission for tree/s removal from Tree Officer under DPTA, 1994.
7. DMRC shall be bound to accept the outcome/ decision of the case pending under DPTA, 1994 before the
DCF (West)/ Tree Officer.
8. Submission of compliance report of compensatory plantation of 4820 nos. trees against the 03 proposals
(Permissions granted on 20th June, 2018, 27th September 2019 and 3rd October 2019) by DCF (West) shall
also be treated as a precondition before final permission for removal of trees in the instant proposal.
9. The User Agency shall ensure that the plan of this proposal shall not be changed.
10. Compensatory Plantation/ Transplantation sites shall have to be secured from encroachment and undesired
biotic interference if any by User Agency..
11. The land over which compensatory plantation raised shall not be utilized for other purpose without the
approval of State Government.
12. Permission for Transplantation/felling of all tress is being granted at their own risk and without prejudice to
the claim (s) of any other person/s who may be having any rights(s) over the land or the trees.
13. Before the Transplantation/ felling of trees from the site is commenced all requisite statutory clearances shall
necessarily be obtained by the User Agency.
14. Transplantation/ Felling of any trees apart from 2940 trees by User Agency shall constitute an offence under
Delhi Preservation of Trees Act, 1994.
15. The progress report of transplantation shall be submitted through inspection officer concerned along with
complete details of trees.
16. DMRC has violated the DPTA, 1994 and by damaging the roots of some trees in the proposed Metro
Corridor, for which the case is under process before the DCF (West), being the Tree Officer. The outcome/
decision of the case shall be put as a precondition before final permission and DMRC shall be bound to
accept the outcome/ decisions.
17. The timber obtained from removal of trees shall be auctioned and proceeds shall be deposited as revenue to
the Government account by the User Agency.
18. The lops and tops of the trees shall be sent/ supplied to the nearest crematorium free of cost and the same
should be reported to DCF (West) by User Agency.
19. Before shifting of timber, if any, from site of removal of trees, permission for transportation of the said wood
shall be obtained from the DCF (West) by User Agency.
20. It should be ensured by the user agency that all the conditions mentioned in environmental clearance, if any
obtained, shall be followed scrupulously.
